			 rule on gainful employment prior to issuing a final rule on gainful
			 employment.</official-title></form><legis-body id="HA59266D420244D8B848D075CA46AADE2" style="OLC"><section id="HD6F43F4935B64BA784D75D226067EBE8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transparency in Education Act</short-title></quote>.</text></section><section id="H5C0D1D0C8A0D461FA39A19428F4ED2F7"><enum>2.</enum><header>Data analysis requirement for final rule on gainful employment</header><subsection id="H223F27761C0449A2A1E9271E916FEAEF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Education shall not issue a final rule or otherwise implement the proposed rule
			 published by the Department of Education in the notice of proposed
			 rulemaking in the Federal Register on March 25, 2014 (79 Fed. Reg. 16426
			 et seq.), or any other proposed rule that amends parts 600 or 668 of title
			 34, Code of Federal Regulations, with respect to gainful employment
			 programs, until 90 days after—</text><paragraph id="H05DBEA73D47045E8A109EBBDCEAF93BB"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of Education publishes a complete data analysis—</text><subparagraph id="H5FA3CFBD9B1448428157732EC6210F5C"><enum>(A)</enum><text>on the impact of such proposed rule (including the debt-to-earnings and programmatic cohort default
			 rate measures) on all postsecondary education programs and students at all
			 categories of institutions of higher education that participate in a
			 program under title IV of the Higher Education Act of 1965 (20 U.S.C. 1070
			 et seq.), including the impact on—</text><clause id="H9792F278BC604755BD93358C68CB038C"><enum>(i)</enum><text display-inline="yes-display-inline">students who receive Federal Pell Grants under section 401 of the Higher
			 Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref>);</text></clause><clause id="H4BB48F88736548599763ABA8148A13BC"><enum>(ii)</enum><text>minority students;</text></clause><clause id="HCA72578FCB184E63B452CBBC8A146D55"><enum>(iii)</enum><text>students over age 24;</text></clause><clause id="H9F3A537A0AD44D798163271EFC02541F"><enum>(iv)</enum><text>students who are veterans;</text></clause><clause id="H0057FF7BEEE44C4C968B4F363E98D9DB"><enum>(v)</enum><text>independent students; and</text></clause><clause id="H82381836C8A042B6A78FAC01904B46D1"><enum>(vi)</enum><text>dependent students; and</text></clause></subparagraph><subparagraph id="HA67871A40B004FC79CCFCA7DF6A4AB8E"><enum>(B)</enum><text display-inline="yes-display-inline">in a format similar to the Gainful Employment 2012 Informational Rate Calculations published by the
			 Department of Education; and</text></subparagraph></paragraph><paragraph id="HD8C5394B6C104D0AA344835C573E6CC7"><enum>(2)</enum><text display-inline="yes-display-inline">the Comptroller General of the United States issues a report that reviews such data analysis for
			 data accuracy and completeness.</text></paragraph></subsection><subsection id="H5804672DA9044C5BA0A818BF732B392C"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section:</text><paragraph id="HCA3D93AE9F0D46EAB703776EFEE9D406"><enum>(1)</enum><header>Independent student</header><text>The term <term>independent student</term> has the meaning given the term in section 480(d) of the Higher Education Act of 1965 (20 U.S.C.
			 1087vv(d)).</text></paragraph><paragraph id="HE79A0A41C860433DA0524C81F9D4D43D"><enum>(2)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 102 of the Higher Education Act of 1965 (20 U.S.C.
			 1002), except that the term does not include institutions described in
			 subparagraph (C) of such section 102(a)(1).</text></paragraph><paragraph id="HE761CD5994714F9EA469597453E112B2"><enum>(3)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given the term in section 480(c) of the Higher Education Act of 1965 (20 U.S.C.
			 1087vv(c)).</text></paragraph></subsection></section></legis-body></bill>
