			 duplicative or inconsistent with existing Federal regulations, and for
			 other purposes.</official-title></form><legis-body id="H663117E426CF4F4B8D56FDD53529371B" style="OLC"><section id="HBAA30F3B196E4B4B86738278D3389000" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Financial Regulatory Clarity Act of 2014</short-title></quote>.</text></section><section id="HCA8A797AE94042668E758266F2E452B0"><enum>2.</enum><header>Federal Deposit Insurance Corporation</header><text display-inline="no-display-inline">Section 9 of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1819">12 U.S.C. 1819</external-xref>) is amended by adding at the end the
			 following:</text><quoted-block display-inline="no-display-inline" id="HDFBDE9FB20714411875D4E3A948114FF" style="OLC"><subsection id="HFBFA3A82D2C34C2CAA157671473E83EC"><enum>(c)</enum><header>Review of regulations</header><paragraph id="HEE88CB012D8B4DA88B773F8BCCD71578"><enum>(1)</enum><header>In general</header><text>Before issuing a final regulation or order the Corporation shall, as part of such regulation or
			 order, assess other Federal regulations
			 and
			 orders to determine the interaction between the proposed regulation or
			 order and other Federal regulations and orders.</text></paragraph><paragraph id="H160B416FBAF1430CBA7475752F45BE07"><enum>(2)</enum><header>Considerations</header><text>In making a determination of the interaction between the proposed regulation or order and other
			 Federal regulations, the Corporation shall evaluate the following:</text><subparagraph id="HB714C4215E6549888F24D832939AA4E1"><enum>(A)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is in conflict with other Federal regulations or orders.</text></subparagraph><subparagraph id="HD8C998BD9BC6434184D657BDDB74A982"><enum>(B)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is inconsistent with other Federal regulations or orders.</text></subparagraph><subparagraph id="H9A7A3393294F45299BC0BA96019D1E26"><enum>(C)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is duplicative of other Federal regulations or orders.</text></subparagraph><subparagraph id="H654FE55C9DE7469AA9E093191001ED67"><enum>(D)</enum><text display-inline="yes-display-inline">Whether other Federal regulations or orders are outdated.</text></subparagraph></paragraph><paragraph id="H11A2609CB37844E1B6A4A93F147446CC"><enum>(3)</enum><header>Resolving duplicative or inconsistent regulations or orders</header><text display-inline="yes-display-inline">The Corporation shall use its bests efforts through all available measures under current law to
			 reconcile any duplicative or
			 inconsistent existing regulation or order of the Corporation with any
			 proposed regulation or
			 order before issuing a final regulation or order.</text></paragraph><paragraph id="H10A37A015BCC446384EB56964F9799C4"><enum>(4)</enum><header>Report to Congress</header><text>Not later than the end of the 60-day period beginning on the date the Corporation makes a
			 determination under paragraph (2), the Corporation shall issue a report to
			 the Congress containing recommendations made by the Corporation,
			 including—</text><subparagraph id="idF4986536276D42FA80EFF182B8AD3142"><enum>(A)</enum><text>any recommendations of Federal laws or regulations that should be repealed
			 or amended; and</text></subparagraph><subparagraph id="idDDE5708935C74F048323C6013A15DB42"><enum>(B)</enum><text>any duplicative, inconsistent, or conflicting  regulation or order of another Federal financial
			 regulator (as defined under paragraph (6)(B)).</text></subparagraph></paragraph><paragraph id="H9C6B0708F5B74E899598B01846D97660"><enum>(5)</enum><header>Limitation on judicial review</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a court may not compel action or hold unlawful and set
			 aside any action solely on the basis of compliance or noncompliance with
			 the requirements of this subsection.</text></paragraph><paragraph id="H96E161BAC0BD45E2B7031B07FFE9E4C1"><enum>(6)</enum><header>Regulation and order defined</header><text display-inline="yes-display-inline">For purposes of this subsection:</text><subparagraph id="HB522D20F27D4478FAB3419C88B4EC938"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>regulation</quote> shall have the meaning given the term <quote>rule</quote> under <external-xref legal-doc="usc" parsable-cite="usc/31/551">section 551(4)</external-xref> of title 31, United States Code, the term <quote>order</quote> shall have the meaning given such term by the Corporation, and the term <quote>other Federal regulations and orders</quote> shall mean regulations and orders of the Federal financial regulators, other than the Corporation.</text></subparagraph><subparagraph id="H92391EA10AE24F068D9BCE6A134DEDBD"><enum>(B)</enum><header>Federal financial regulators</header><text display-inline="yes-display-inline">The term <quote>Federal financial regulators</quote> means the Board of Governors of the Federal Reserve System, the Bureau of Consumer Financial
			 Protection, the Commodity Futures Trading Commission, the Comptroller of
			 the Currency, the Corporation, the National Credit Union Administration,
			 and the Securities and Exchange Commission.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3F7D5CFB70EC435CA8D280AA034000FD"><enum>3.</enum><header>Office of Comptroller of the Currency</header><text display-inline="no-display-inline">Section 324 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/12/1">12 U.S.C. 1</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE6C66AE9B9CF4B63A0DEE97125BAAF68" style="OLC"><subsection id="HE48E87CC7D864754AE222B9D00DF2485"><enum>(c)</enum><header>Review of regulations</header><paragraph id="H18FE71AF4B294CC0B657E1FBE101114F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Before issuing a final regulation or order the Comptroller of the Currency shall, as part of such
			 regulation or order, assess other
			 Federal
			 regulations and orders to determine the interaction between the proposed
			 regulation or order and other Federal regulations and orders.</text></paragraph><paragraph id="HF6D191FEE9AC4082B1F3478D9EB132D1"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In making a determination of the interaction between the proposed regulation or order and other
			 Federal regulations, the Comptroller shall evaluate the following:</text><subparagraph id="HEC3A86F969F0464B85402E225E511ADB"><enum>(A)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is in conflict with other Federal regulations or orders.</text></subparagraph><subparagraph id="HDCBB1827C6B041EA840869C6E3A18AB5"><enum>(B)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is inconsistent with other Federal regulations or orders.</text></subparagraph><subparagraph id="HEE86CD9A55224574AB0470294757D979"><enum>(C)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is duplicative of other Federal regulations or orders.</text></subparagraph><subparagraph id="H7B823024545343659EBE4EEC2EF8BF9C"><enum>(D)</enum><text display-inline="yes-display-inline">Whether other Federal regulations or orders are outdated.</text></subparagraph></paragraph><paragraph id="HDB22906F54E1424FBC2DDE826EC4C710"><enum>(3)</enum><header>Resolving duplicative or inconsistent regulations or orders</header><text display-inline="yes-display-inline">The Comptroller shall use its best efforts through all available measures under current law to
			 reconcile any duplicative or
			 inconsistent existing regulation or order with any proposed regulation or
			 order before issuing a final regulation or order.</text></paragraph><paragraph id="H3782014F8F624E999CA688472A8DA370"><enum>(4)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than the end of the 60-day period beginning on the date the Comptroller makes a
			 determination under paragraph (2), the Comptroller shall issue a report to
			 the Congress containing recommendations made by the Comptroller,
			 including—</text><subparagraph id="id1D49C04AD6A14EB1BDF0E4A2471D899B"><enum>(A)</enum><text>any recommendations of Federal laws or regulations that should be repealed
			 or amended; and</text></subparagraph><subparagraph id="idA1B4A8CAD36E451D9ECA829E91CDA78E"><enum>(B)</enum><text>any duplicative, inconsistent, or conflicting  regulation or order of another Federal financial
			 regulator (as defined under section 9(c)(6)(B) of the Federal Deposit
			 Insurance Act).</text></subparagraph></paragraph><paragraph id="H16A26F4BF2D845C9A9E333531C054302"><enum>(5)</enum><header>Limitation on judicial review</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a court may not compel action or hold unlawful and set
			 aside any action solely on the basis of compliance or noncompliance with
			 the requirements of this subsection.</text></paragraph><paragraph id="HA796A050D93847289249E8581B2C1F4C"><enum>(6)</enum><header>Regulation and order defined</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <quote>regulation</quote> shall have the meaning given the term <quote>rule</quote> under <external-xref legal-doc="usc" parsable-cite="usc/31/551">section 551(4)</external-xref> of title 31, United States Code, the term <quote>order</quote> shall have the meaning given such term by the Comptroller, and the term <quote>other Federal regulations and orders</quote> shall mean regulations and orders of the Federal financial regulators (as defined under section
			 9(c)(6)(B) of the Federal Deposit Insurance Act), other than the
			 Comptroller.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H99522148307D455F97726F298B9C3958"><enum>4.</enum><header>Board of Governors of the Federal Reserve System</header><text display-inline="no-display-inline">Section 10 of the Federal Reserve Act is amended by inserting before paragraph (12) the following:</text><quoted-block display-inline="no-display-inline" id="H8258881B509B40489BE91547638EC00D" style="OLC"><paragraph id="H9965DB6D164149349AD1A51DD426FF85"><enum>(11)</enum><header>Review of regulations</header><subparagraph id="H83E92CEACEAD49A49E4284902070ABFB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Before issuing a final regulation or order the Board of Governors of the Federal Reserve System
			 shall, as part of such regulation or order, assess other Federal
			 regulations and orders to determine the interaction
			 between the proposed regulation or order and other Federal regulations and
			 orders.</text></subparagraph><subparagraph id="HC1FF5980B51A4D26BDF3DADAE2F67CAC"><enum>(B)</enum><header>Considerations</header><text display-inline="yes-display-inline">In making a determination of the interaction between the proposed regulation or order and other
			 Federal regulations, the Board of Governors shall evaluate the following:</text><clause id="HBF319FF1C02C4766B65446D595AF873D"><enum>(i)</enum><text>Whether the proposed regulation or order is in conflict with other Federal regulations or orders.</text></clause><clause id="H6636845CC9FF4C3BB34412E6B35B3808"><enum>(ii)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is inconsistent with other Federal regulations or orders.</text></clause><clause id="H6ACE6933C3544512BB113058083ABA2B"><enum>(iii)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is duplicative of other Federal regulations or orders.</text></clause><clause id="H07636CC32060472FB5DC2ACA1D5FBAE6"><enum>(iv)</enum><text display-inline="yes-display-inline">Whether other Federal regulations or orders are outdated.</text></clause></subparagraph><subparagraph id="H32212F99646C423587A2213459D72983"><enum>(C)</enum><header>Resolving duplicative or inconsistent regulations or orders</header><text display-inline="yes-display-inline">The Board of Governors shall use its best efforts through all available measures under current law
			 to reconcile any
			 duplicative or inconsistent existing regulation or order with any proposed
			 regulation or order before issuing a final regulation or order.</text></subparagraph><subparagraph id="H3B6C6A07AB834CC6988271616B3E9940"><enum>(D)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than the end of the 60-day period beginning on the date the Board of Governors makes a
			 determination under subparagraph (B), the Board of Governors shall issue a
			 report to the Congress containing recommendations made by the Board of
			 Governors, including—</text><clause id="id897330A54E954BB8BEB6BDD3E0DD0D12"><enum>(i)</enum><text>any recommendations of Federal laws or regulations that should be repealed
			 or amended; and</text></clause><clause id="id78160BA54AD34EAB83A166923DA058B4"><enum>(ii)</enum><text>any duplicative, inconsistent, or conflicting  regulation or order of another Federal financial
			 regulator (as defined under section 9(c)(6)(B) of the Federal Deposit
			 Insurance Act).</text></clause></subparagraph><subparagraph id="H7085294474CB4A60848C0EB52385E7D3"><enum>(E)</enum><header>Limitation on judicial review</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a court may not compel action or hold unlawful and set
			 aside any action solely on the basis of compliance or noncompliance with
			 the requirements of this paragraph.</text></subparagraph><subparagraph id="H2E39C21489084F138941ABD5287F06DD"><enum>(F)</enum><header>Regulation and order defined</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term <quote>regulation</quote> shall have the meaning given the term <quote>rule</quote> under <external-xref legal-doc="usc" parsable-cite="usc/31/551">section 551(4)</external-xref> of title 31, United States Code, the term <quote>order</quote> shall have the meaning given such term by the Board of Governors, and the term <quote>other Federal regulations and orders</quote> shall mean regulations and orders of the Federal financial regulators (as defined under section
			 9(c)(6)(B) of the Federal Deposit Insurance Act), other than the Board of
			 Governors.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF085212EC4FA4BD1954C29C772322430"><enum>5.</enum><header>Bureau of Consumer Financial Protection</header><text display-inline="no-display-inline">Section 1022 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5512">12 U.S.C. 5512</external-xref>) is amended by adding
			 at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3DE603D5FA1F4E2B8490BFAE64E9ECFE" style="OLC"><subsection id="H24ED7F9EC39745F395CAC5D51F135160"><enum>(e)</enum><header>Review of regulations</header><paragraph id="HC430D5D6F3E446008DA6BB5510864D33"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Before issuing a final regulation or order the Bureau shall, as part of such regulation or order,
			 assess other Federal regulations and
			 orders
			 to determine the interaction between the proposed regulation or order and
			 other Federal regulations and orders.</text></paragraph><paragraph id="H4EFBC82FBDF74DD8A933708F55CC9E46"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In making a determination of the interaction between the proposed regulation or order and other
			 Federal regulations, the Bureau shall evaluate the following:</text><subparagraph id="H3F4342399470429281041496840AE81A"><enum>(A)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is in conflict with other Federal regulations or orders.</text></subparagraph><subparagraph id="H0E697291390C43C5AA36CC55E4E0A5C0"><enum>(B)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is inconsistent with other Federal regulations or orders.</text></subparagraph><subparagraph id="H15FACB98873344D492F38141BD2C3743"><enum>(C)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is duplicative of other Federal regulations or orders.</text></subparagraph><subparagraph id="HB1B2C61FA4BE4997B5FD358A8C69F577"><enum>(D)</enum><text display-inline="yes-display-inline">Whether other Federal regulations or orders are outdated.</text></subparagraph></paragraph><paragraph id="HFF3A21A9D5A54DEDAC1AC741BD39D3AD"><enum>(3)</enum><header>Resolving duplicative or inconsistent regulations or orders</header><text display-inline="yes-display-inline">The Bureau shall use its best efforts through all available measures under current law to reconcile
			 any duplicative or
			 inconsistent existing regulation or order with any proposed regulation or
			 order before issuing a final regulation or order.</text></paragraph><paragraph id="H7908C5645B07417F970F2EE3C3E6D34C"><enum>(4)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than the end of the 60-day period beginning on the date the Bureau makes a determination
			 under paragraph (2), the Bureau shall issue a report to the Congress
			 containing recommendations made by the Bureau, including—</text><subparagraph id="id91F2B88008164490AE4638770CA637DD"><enum>(A)</enum><text>any recommendations of Federal laws or regulations that should be repealed
			 or amended; and</text></subparagraph><subparagraph id="id52BB6407F9A04E37AC954028F2EC7A5C"><enum>(B)</enum><text>any duplicative, inconsistent, or conflicting  regulation or order of another Federal financial
			 regulator (as defined under section 9(c)(6)(B) of the Federal Deposit
			 Insurance Act).</text></subparagraph></paragraph><paragraph id="HFEBFD4BBDCEF4025A755F3C5FC3C8E0B"><enum>(5)</enum><header>Limitation on judicial review</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a court may not compel action or hold unlawful and set
			 aside any action solely on the basis of compliance or noncompliance with
			 the requirements of this subsection.</text></paragraph><paragraph id="HA112448747E148A2A452E30179D74518"><enum>(6)</enum><header>Regulation and order defined</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <quote>regulation</quote> shall have the meaning given the term <quote>rule</quote> under <external-xref legal-doc="usc" parsable-cite="usc/31/551">section 551(4)</external-xref> of title 31, United States Code, the term <quote>order</quote> shall have the meaning given such term by the Bureau, and the term <quote>other Federal regulations and orders</quote> shall mean regulations and orders of the Federal financial regulators (as defined under section
			 9(c)(6)(B) of the Federal Deposit Insurance Act), other than the Bureau.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HED56B52FDB9C478A8800B5442BA487CB"><enum>6.</enum><header>National Credit Union Administration</header><text display-inline="no-display-inline">Section 102 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752a">12 U.S.C. 1752a</external-xref>) is amended by adding at the end the
			 following:</text><quoted-block display-inline="no-display-inline" id="HD5C33ADAF09D4B2CA8FFB15B3D0F682C" style="OLC"><subsection id="H3688325B9F7749CBA339DCD36FA303B0"><enum>(g)</enum><header>Review of regulations</header><paragraph id="H1B53E96F7F5B44ADA69B34312F6B4D10"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Before issuing a final regulation or order the Administration shall, as part of such regulation or
			 order, assess other Federal
			 regulations and
			 orders to determine the interaction between the proposed regulation or
			 order and other Federal regulations and orders.</text></paragraph><paragraph id="H921F4E3E0CCE48818748D47ADEC6A7F1"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In making a determination of the interaction between the proposed regulation or order and other
			 Federal regulations, the Administration shall evaluate the following:</text><subparagraph id="HE409BA09BC7F4CE6B933C43086833BFB"><enum>(A)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is in conflict with other Federal regulations or orders.</text></subparagraph><subparagraph id="H939C8C7A999145BCA685CCB299744F41"><enum>(B)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is inconsistent with other Federal regulations or orders.</text></subparagraph><subparagraph id="H4154BE41A7AA40AB8547032C2F5807F3"><enum>(C)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is duplicative of other Federal regulations or orders.</text></subparagraph><subparagraph id="HB452939C617640FD97AE0A810B16CB16"><enum>(D)</enum><text display-inline="yes-display-inline">Whether other Federal regulations or orders are outdated.</text></subparagraph></paragraph><paragraph id="H2B697A156C0A47D69D12C86C39A792EB"><enum>(3)</enum><header>Resolving duplicative or inconsistent regulations or orders</header><text display-inline="yes-display-inline">The Administration shall use its best efforts through all available measures under current law to

			 regulator (as defined under section 9(c)(6)(B) of the Federal Deposit

			 Administration.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H43709419D8094447AFBC75FC8462E533"><enum>7.</enum><header>Securities and Exchange Commission</header><text display-inline="no-display-inline">Section 4 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78d">15 U.S.C. 78d</external-xref>) is amended by adding at the end
			 the following:</text><quoted-block display-inline="no-display-inline" id="HD443E80B5D924D0AB699CD6B574FB6C4" style="OLC"><subsection id="H6EC7AB82F1934078A922256564D415C3"><enum>(j)</enum><header>Review of regulations</header><paragraph id="HB4C3BF7B146449E2806B140DDC1C58BF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Before issuing a final regulation or order the Commission shall, as part of such regulation or
			 order, assess other Federal regulations
			 and
			 orders to determine the interaction between the proposed regulation or
			 order and other Federal regulations and orders.</text></paragraph><paragraph id="HA75F37F6995741DDBD62E436B28D8F7F"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In making a determination of the interaction between the proposed regulation or order and other
			 Federal regulations, the Commission shall evaluate the following:</text><subparagraph id="H7D1254B7C6A046E88AAB421A0836637B"><enum>(A)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is in conflict with other Federal regulations or orders.</text></subparagraph><subparagraph id="HD797D8EB56394149B116CC5A70680341"><enum>(B)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is inconsistent with other Federal regulations or orders.</text></subparagraph><subparagraph id="H16F2D29402584FCE955D714302F26500"><enum>(C)</enum><text display-inline="yes-display-inline">Whether the proposed regulation or order is duplicative of other Federal regulations or orders.</text></subparagraph><subparagraph id="HF96D8A2AD70347F88BB3C02DF5070D5B"><enum>(D)</enum><text display-inline="yes-display-inline">Whether other Federal regulations or orders are outdated.</text></subparagraph></paragraph><paragraph id="H1EE753D8B3324945B54D070856DBB3F5"><enum>(3)</enum><header>Resolving duplicative or inconsistent regulations or orders</header><text display-inline="yes-display-inline">The Commission shall use its best efforts through all available measures under current law to
			 reconcile any duplicative or
			 inconsistent existing regulation or order with any proposed regulation or
			 order before issuing a final regulation or order.</text></paragraph><paragraph id="H6571814693C04C0580E0041E16D7FBF7"><enum>(4)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than the end of the 60-day period beginning on the date the Commission makes a
			 determination under paragraph (2), the Commission shall issue a report to
			 the Congress containing recommendations made by the Commission, including—</text><subparagraph id="id512DE38C2E514145A162ED5D9913A2E4"><enum>(A)</enum><text>any recommendations of Federal laws or regulations that should be repealed
			 or amended; and</text></subparagraph><subparagraph id="idC109C31EC1794E75A76234894A20C9E0"><enum>(B)</enum><text>any duplicative, inconsistent, or conflicting  regulation or order of another Federal financial
			 regulator (as defined under section 9(c)(6)(B) of the Federal Deposit
			 Insurance Act).</text></subparagraph></paragraph><paragraph id="HC27465BB76CE44B394116464B96E15B6"><enum>(5)</enum><header>Limitation on judicial review</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a court may not compel action or hold unlawful and set
			 aside any action solely on the basis of compliance or noncompliance with
			 the requirements of this subsection.</text></paragraph><paragraph id="H022626045E6B43B58FAE38F195D74DE7"><enum>(6)</enum><header>Regulation and order defined</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <quote>regulation</quote> shall have the meaning given the term <quote>rule</quote> under <external-xref legal-doc="usc" parsable-cite="usc/31/551">section 551(4)</external-xref> of title 31, United States Code, the term <quote>order</quote> shall have the meaning given such term by the Commission, and the term <quote>other Federal regulations and orders</quote> shall mean regulations and orders of the Federal financial regulators (as defined under section
			 9(c)(6)(B) of the Federal Deposit Insurance Act), other than the
			 Commission.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H046ED04A21A847C6970DF771D7F4D6BB"><enum>8.</enum><header>Commodity Futures Trading Commission</header><text display-inline="no-display-inline">Section 2(a) of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2">7 U.S.C. 2(a)</external-xref>) is amended by adding at the end the
			 following:</text><quoted-block display-inline="no-display-inline" id="H81C3A533066F467490F13A3A203BB2A0" style="OLC"><paragraph id="H4212880ABEE74B08884F3A6FE754A805"><enum>(16)</enum><header>Review of regulations</header><subparagraph id="H700EAE387F8E47F9992DEF442C20B358"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Before issuing a final regulation or order the Commission shall, as part of such regulation or

			 pursuant to an amendment made under sections 2 through 8 of this Act, the
			 agencies shall jointly make such assessment and determination and shall
			 submit a single report with respect to such determination.</text></section></legis-body></bill>
