			 planning, design, and construction of treatment works to intercept,
			 transport, control, or treat municipal combined sewer overflows and
			 sanitary sewer overflows, and to require the Administrator of the
			 Environmental Protection Agency to update certain guidance used to develop
			 and determine the financial capability of communities to implement clean
			 water infrastructure programs.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Clean Water Affordability Act of 2014</short-title></quote>.</text></section><section id="ID29b49a7cce934170bdd785385b6ba549"><enum>2.</enum><header>Sewer overflow
			 control grants</header><text display-inline="no-display-inline">Section 221 of
			 the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1301">33 U.S.C. 1301</external-xref>) is amended—</text><paragraph id="id93D1484C4AB1411F968A3D67035CBC32"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsections (a) through (g) and
			 inserting the following:</text><quoted-block display-inline="no-display-inline" id="id064DAF061F8A4DB2BBCC93710CC816E0" style="OLC"><subsection id="ID7fbfaba2724a47a0a13044fbc12460c2"><enum>(a)</enum><header>Grants</header><text>The
				Administrator may—</text><paragraph id="ID477257d01b06479ba07f3e53c450c879"><enum>(1)</enum><text>make grants to
				States for the purpose of providing grants to local or regional
			 authorities or
				a municipality or municipal entity for use in planning, designing,
			 and
				constructing treatment works to intercept, transport, control, or
			 treat
				municipal combined sewer overflows and sanitary sewer overflows;
			 and</text></paragraph><paragraph id="IDa9bf1feeb8e245f1936ee965036cf24d"><enum>(2)</enum><text>make a grant
				directly to a local or regional authority or municipality or
			 municipal entity
				for the purposes described in paragraph (1).</text></paragraph></subsection><subsection id="IDecb147922b254efc8d1f81da46a6da1e"><enum>(b)</enum><header>Prioritization</header><text>In
				selecting from among municipalities applying for grants under this
			 section, a
				State or the Administrator shall give priority to—</text><paragraph id="id388206B41CE8459E980BD75BDAF32D32"><enum>(1)</enum><text>an applicant that
			 is a
				financially distressed community, as determined by the applicable
			 State under
				subsection (c); and</text></paragraph><paragraph id="iddc944302d98747b1bea7c3aae8463c7c"><enum>(2)</enum><text>an applicant that discharges into a water body, or water body segment, impaired for nutrients or
			 related pollutant indicators.</text></paragraph></subsection><subsection id="ID5f84245d6e344ecab3a2040f05dae7ef"><enum>(c)</enum><header>Determination</header><text>In
				determining whether a community is a distressed community for the
			 purposes of
				subsection (b), a State shall consider, among other factors, the
			 criteria
				described in section 7(b)(2)(A) of the <short-title>Clean Water Affordability Act of 2014</short-title>.</text></subsection><subsection id="ID8f7f4b6242ee4530a5ff8a653c932898"><enum>(d)</enum><header>Cost-Sharing</header><paragraph id="ID31d4fc7de3fe4c25be974dd3895f4c51"><enum>(1)</enum><header>Federal
				share</header><text>The Federal share of the cost of any project or activity
				carried out using funds from a grant made under subsection (a)
			 shall be not
				less than 75 percent.</text></paragraph><paragraph id="ID52dd1d2d0c6a4574964e67e439bd3cbe"><enum>(2)</enum><header>Non-Federal
				share</header><text>The non-Federal share of the cost of any project or
				activity carried out using funds from a grant made under subsection
			 (a) may
				include—</text><subparagraph id="ID846ab39f1b184c34b5102ff818f919c0"><enum>(A)</enum><text>in any amount,
				public and private funds and in-kind services; and</text></subparagraph><subparagraph id="IDb6135aa2133b4d3da3574dd487a60159"><enum>(B)</enum><text>notwithstanding
				section 603, financial assistance, including loans, from a State
			 water
				pollution control revolving fund.</text></subparagraph></paragraph></subsection><subsection id="ID493b8e853d8a4697ba3c456501321cbe"><enum>(e)</enum><header>Administrative
				requirements</header><paragraph id="IDf618333108a94f98812bd75dda59839a"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), a project that receives grant
				assistance under subsection (a) shall be carried out subject to the
			 same
				requirements as a project that receives assistance from a State
			 water pollution
				control revolving fund established pursuant to title VI.</text></paragraph><paragraph id="ID1a1e8ed6fa7a42b3a16ece0b74297dd7"><enum>(2)</enum><header>Determination
				of Governor</header><text>The requirement described in paragraph (1) shall not
				apply to a project that receives grant assistance under subsection
			 (a) to the
				extent that the Governor of the State in which the project is
			 located
				determines that a requirement described in title VI is inconsistent
			 with the
				purposes of this section.</text></paragraph></subsection><subsection id="ID77f4417e435843e1aa71772351a40a60"><enum>(f)</enum><header>Allocation of
				funds</header><paragraph id="IDdc90e7e4ee144a9a8ae9755956f5bfe9"><enum>(1)</enum><header>Fiscal year
				2015</header><text>For fiscal year 2015, subject to subsection (g), the
				Administrator shall use the amounts made available to carry out
			 this section
				under subsection (i)(1) to provide grants to municipalities and
			 municipal
				entities under subsection (a)(2) in accordance with the priority
			 criteria
				described in subsection (b).</text></paragraph><paragraph id="ID86e9b6291da74e0aa222b03224d575bd"><enum>(2)</enum><header>Fiscal year
				2016 and thereafter</header><text>For fiscal year 2016 and each fiscal year
				thereafter, subject to subsection (g), the Administrator shall use
			 the amounts
				appropriated to carry out this section under subsection (i)(1) to
			 provide
				grants to States under subsection (a)(1) in accordance with a
			 formula
				that—</text><subparagraph id="ID376d4bea33e946fb81eeec4d478d7c05"><enum>(A)</enum><text>shall be
				established by the Administrator, after providing notice and an
			 opportunity for
				public comment; and</text></subparagraph><subparagraph id="ID17f865855a64402b8911c60499b23159"><enum>(B)</enum><text>allocates to each
				State a proportional share of the amounts based on the total needs
			 of the State
				for municipal combined sewer overflow controls and sanitary sewer
			 overflow
				controls, as identified in the most recent survey—</text><clause id="ID2651c74c4ebe48e6aa32741cfb321a83"><enum>(i)</enum><text>conducted under
				section 210; and</text></clause><clause id="ID9e3922a5ac424365adbca73e91bbfce8"><enum>(ii)</enum><text>included in a
				report required under section
				516(a).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idB0826CB5078242D5A1646056C8523A6D"><enum>(2)</enum><text>by redesignating
			 subsections (h) and (i) as subsections (g) and (h), respectively;</text></paragraph><paragraph id="id22EA298EBF00429BB5700265CB731C9F"><enum>(3)</enum><text>in the first
			 sentence of subsection (h) (as redesignated by paragraph (2)), by striking
			 <quote>2003</quote> and inserting <quote>2015</quote>; and</text></paragraph><paragraph id="id970D90678E1A48C7BDB932817C230461"><enum>(4)</enum><text>by adding at the
			 end the following:</text><quoted-block display-inline="no-display-inline" id="idE153604C991449BABFF661D0FC822D1F" style="OLC"><subsection id="IDe4965b4a242f4c349ce9b74a00147607"><enum>(i)</enum><header>Funding</header><paragraph id="ID071e9d7c09b6475bb951d50e5c4b21f3"><enum>(1)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section—</text><subparagraph id="IDe1203db4444543e081bffb7f6bcbdc0b"><enum>(A)</enum><text>$250,000,000 for
				fiscal year 2015;</text></subparagraph><subparagraph id="ID91afc7fbf0b7434e9de9c90e8c8bb7e1"><enum>(B)</enum><text>$300,000,000 for
				fiscal year 2016;</text></subparagraph><subparagraph id="ID5fbeea0d2e4d4fbd86b53063b891c562"><enum>(C)</enum><text>$350,000,000 for
				fiscal year 2017;</text></subparagraph><subparagraph id="ID936c47a3e7164a3ba8db422d50e03483"><enum>(D)</enum><text>$400,000,000 for
				fiscal year 2018; and</text></subparagraph><subparagraph id="ID8c64c8064b70429da455d4393a16ed0a"><enum>(E)</enum><text>$500,000,000 for
				fiscal year 2019.</text></subparagraph></paragraph><paragraph id="IDa6f6099ddb4646b595eb7198c92843ce"><enum>(2)</enum><header>Availability of
				amounts</header><text display-inline="yes-display-inline">Amounts authorized to
				be appropriated under paragraph (1) shall remain available until
				expended.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="IDd7fbbcf389544566abc800966139ad87"><enum>3.</enum><header>Integrated
			 permitting process</header><subsection id="ID4019c58863f34008bdb82875b9b05dc4"><enum>(a)</enum><header>In
			 general</header><text>Section 402(a) of the Federal Water Pollution Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(a)</external-xref>) is amended by inserting after paragraph (5) the
			 following:</text><quoted-block display-inline="no-display-inline" id="id53ACC0B0D4D64B419A1D743ADF9422EE" style="OLC"><paragraph id="ID29247590029648229a0c8a70cdb788b7"><enum>(6)</enum><header>Integrated
				Permits</header><subparagraph id="id7B4EEB360D074DB7AD48B814E39E7F78"><enum>(A)</enum><header>Definition of
				publicly owned permittee</header><text>In this paragraph, the term
				<term>publicly owned permittee</term> means—</text><clause id="id15D82B84440244C082BAED68D196A897"><enum>(i)</enum><text>a
				treatment works (as defined in section 212) that is publicly owned;
			 and</text></clause><clause id="id734108D003A34D9DB3E552A15746A63D"><enum>(ii)</enum><text>a municipal
				separate storm sewer system referred to in this section.</text></clause></subparagraph><subparagraph id="id546978F724984C7B99705FC61D6F766D"><enum>(B)</enum><header>Planning
				approach</header><text>The Administrator shall establish a comprehensive and
				integrated planning approach to the obligations under this section
			 of a
				publicly owned permittee—</text><clause id="idB96CE7F1FF5B4BFC9E4A8F7C210673AD"><enum>(i)</enum><text>under which
				permit obligations may be implemented according to a schedule that—</text><subclause id="id578DB019824E48949EF8E0354F1C5406"><enum>(I)</enum><text>accounts for the
				financial capability of the publicly owned permittee;</text></subclause><subclause id="id4F9DD404BD7F401DADCBCDA2C5143BE3"><enum>(II)</enum><text>prioritizes
				permit obligations according to the most cost-effective and
			 environmentally
				beneficial outcomes;</text></subclause><subclause id="idA50F324C504C454690493EFD5C00FFF5"><enum>(III)</enum><text>accounts for
				the preexisting maintenance, operational, and regulatory
			 obligations of the
				publicly owned permittee under this section; and</text></subclause><subclause id="id67D5AAA577254006A02832541B7EF0B6"><enum>(IV)</enum><text>enables the
				publicly owned permittee to implement innovative approaches to meet
			 those
				obligations; and</text></subclause></clause><clause id="id7CD26A566A324FCEA60FE57EC7E9C164"><enum>(ii)</enum><text>that accounts
				for changed circumstances in the obligations of the publicly owned
			 permittee,
				such as—</text><subclause id="idEEA7612C94034DE5B41D70C645F2ED3C"><enum>(I)</enum><text>new innovative
				treatment approaches;</text></subclause><subclause id="idE705715884B844F3897A5A7040C7AB76"><enum>(II)</enum><text>new regulatory
				requirements; and</text></subclause><subclause id="id1BBE59A561D5436F994C7E9E4CC5C030"><enum>(III)</enum><text>changes in
				financial
				capability.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ID77e3c3b360e5424d8a5790615b105cd1"><enum>(b)</enum><header>Duration of
			 permits</header><text>Section 402(b)(1)(B) of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(b)(1)(B)</external-xref>) is amended by inserting before the
			 semicolon at the end the following: <quote>, except that a permit with a term
			 of more than 5 years but not more than 25 years may be approved if the
			 permittee has an approved integrated plan established under subsection
			 (a)(6)</quote>.</text></subsection></section><section id="id11ebe535f1bd470aa90bd8432e524090"><enum>4.</enum><header>Combined sewage
			 overflow long-term control plan</header><text display-inline="no-display-inline">Section 402(q) of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(q)</external-xref>) is amended by adding at the end
			 the
			 following:</text><quoted-block display-inline="no-display-inline" id="id22F9A70A397946E09451E6ED28251D4F" style="OLC"><paragraph id="idDADD7D592DDD4577A0ED8D225A60B0DC"><enum>(4)</enum><header>Combined sewage
				overflow long-term control plan</header><subparagraph id="ide0fc7728a209465687ac6fb4d4ae343b"><enum>(A)</enum><header>In
				general</header><text>The Administrator shall amend the CSO control policy to
				allow a publicly owned treatment work that has an approved
			 long-term control
				plan to modify the plan to incorporate green infrastructure and
				energy-efficient technologies on a showing that the use of the
			 technologies can
				cost-effectively help to meet the terms of the combined sewer
			 overflow
				compliance obligations of the treatment work.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcbed08386756487fbc09dd3ec00f3df6"><enum>(B)</enum><header>Compliance</header><text>The
				Administrator shall allow a publicly owned treatment work 30 years
			 to meet compliance obligations under
				long-term control plans modified under this
				paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id51aab996143646b2870578bcf382750a"><enum>5.</enum><header>Environmental
			 protection agency green infrastructure promotion</header><text display-inline="no-display-inline">Title V of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1361">33 U.S.C. 1361 et seq.</external-xref>) is amended—</text><paragraph id="id6A712544866845AD8357CB555B10200E"><enum>(1)</enum><text>by redesignating
			 section 519 (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251</external-xref> note) as section 520; and</text></paragraph><paragraph id="idEBF8CAE77CD04A2BA378D3A0D015F8FD"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 518 (33 U.S.C.
			 1377) the following:</text><quoted-block display-inline="no-display-inline" id="idBB7E68A0169745C7B06C96AB859154C9" style="OLC"><section commented="no" display-inline="no-display-inline" id="id2249AA4AEFE54E3BAB5DA1C3D48D1113" section-type="subsequent-section"><enum>519.</enum><header display-inline="yes-display-inline">Environmental protection agency green
				infrastructure promotion</header><subsection id="idd307aba47b324132bba37cd492b695c7"><enum>(a)</enum><header>In
				general</header><text>The Administrator shall ensure that the Office of Water,
				the Office of Enforcement and Compliance Assurance, the Office of
			 Research and
				Development, and the Office of Policy of the Environmental
			 Protection Agency
				promote the use of green infrastructure in and coordinate the
			 integration of
				green infrastructure into, permitting programs, planning efforts,
			 research,
				technical assistance, and funding guidance.</text></subsection><subsection id="id7e0eddf940b74767862553a87df74969"><enum>(b)</enum><header>Duties</header><text>The
				Administrator shall ensure that the Office of Water—</text><paragraph id="id85b467b9e55348beaba22259d88d0caa"><enum>(1)</enum><text>promotes the use
				of green infrastructure in the programs of the Environmental
			 Protection Agency;
				and</text></paragraph><paragraph id="idef9b171b9be0450cba8d25afab80e4b4"><enum>(2)</enum><text>coordinates
				efforts to increase the use of green infrastructure with—</text><subparagraph id="idc629861caf3146f5aaa3d7321a6d8c42"><enum>(A)</enum><text>other Federal
				departments and agencies;</text></subparagraph><subparagraph id="id8ae4551b91324392b7a5466e19fb77ac"><enum>(B)</enum><text>State, tribal,
				and local governments; and</text></subparagraph><subparagraph id="ida1fbc627e7c240be811bdf8bc7f7e624"><enum>(C)</enum><text>the private
				sector.</text></subparagraph></paragraph></subsection><subsection id="id7a466bdda1fb40d49e2e4669d0031285"><enum>(c)</enum><header>Regional green
				infrastructure promotion</header><text>The Administrator shall direct each
				regional office of the Environmental Protection Agency, as
			 appropriate based on
				local factors, to promote and integrate the use of green
			 infrastructure within
				the region that includes—</text><paragraph id="idfa6768f4ae8445fbb7f1f332af2702c0"><enum>(1)</enum><text>a plan for
				monitoring, financing, mapping, and designing the green
			 infrastructure;</text></paragraph><paragraph id="id6b712246dcac47f59552a737d0a4da8e"><enum>(2)</enum><text>outreach and
				training regarding green infrastructure implementation for State,
			 tribal, and
				local governments, tribal communities, and the private sector; and</text></paragraph><paragraph id="id790732131d3e4a7da53a3fff11133ff1"><enum>(3)</enum><text>the incorporation
				of green infrastructure into permitting and other regulatory
			 programs, codes,
				and ordinance development, including the requirements under consent
			 decrees and
				settlement agreements in enforcement actions.</text></paragraph></subsection><subsection id="ida22bd14ef225423fac1cc900c308b004"><enum>(d)</enum><header>Green
				infrastructure information-Sharing</header><text>The Administrator shall
				promote green infrastructure information-sharing, including through
			 an Internet
				website, to share information with, and provide technical
			 assistance to, State,
				tribal, and local governments, tribal communities, the private
			 sector, and the
				public regarding green infrastructure approaches for—</text><paragraph id="id14a301b955054eaaaa1187c1d3aa87e8"><enum>(1)</enum><text>reducing water
				pollution;</text></paragraph><paragraph id="ide767153155ba47a7be5795efc93f8aff"><enum>(2)</enum><text>protecting water
				resources;</text></paragraph><paragraph id="idee5feb355dd0424a837cef7629097214"><enum>(3)</enum><text>complying with
				regulatory requirements; and</text></paragraph><paragraph id="id25f23efd916d46ba9498dcf4e5a41c03"><enum>(4)</enum><text>achieving other
				environmental, public health, and community goals.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfb90c380610345a89df654037b87616c"><enum>(e)</enum><header>Green infrastructure
				portfolio standard</header><text>The Administrator, in collaboration with
				State, tribal, and local water resource managers, shall establish
			 voluntary
				measurable goals, to be known as the <quote>green infrastructure portfolio
				standard</quote>, to increase the percentage of annual water managed by
				eligible entities that use green
				infrastructure.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="ID2a7a46bd3a1a4cacbd0f0fd2165d3714"><enum>6.</enum><header>Updating of
			 guidance</header><subsection id="idE5C405C7FE3E4F76A360722DF72675EB"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="ID9ba03056f08c41399f3d21bd3b774cbb"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text></paragraph><paragraph id="ID913623cb53f44676ab1ead9f45df4b86"><enum>(2)</enum><header>Affordability</header><text>The
			 term <term>affordability</term> means, with respect to payment of a utility
			 bill, a measure of whether an individual customer or household can pay the
			 bill
			 without undue hardship or unreasonable sacrifice in the essential
			 lifestyle or
			 spending patterns of the individual or household, as determined by the
			 Administrator.</text></paragraph><paragraph id="ID93e41bc587a94cb4b74af340ec062bf3"><enum>(3)</enum><header>Financial
			 capability</header><text>The term <term>financial capability</term> means the
			 financial capability of a community to make investments necessary to make
			 water
			 quality-related improvements, taking into consideration the criteria
			 described
			 in subsection (b)(2)(A).</text></paragraph><paragraph id="IDbab40b6dd1b843809e93ac05c00327bc"><enum>(4)</enum><header>Guidance</header><text>The
			 term <term>guidance</term> means the guidance published by the Administrator
			 entitled <quote>Combined Sewer Overflows—Guidance for Financial Capability
			 Assessment and Schedule Development</quote> and dated February 1997, as
			 applicable to combined sewer overflows and sanitary sewer overflows.</text></paragraph></subsection><subsection id="ID0f6da06b84ff453f9adb7c036e38ca47"><enum>(b)</enum><header>Updating</header><paragraph id="ID3136695e0e0049569a2d047252011288"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Administrator shall update the guidance to ensure that the
			 evaluations
			 by the Administrator of financial capability assessment and schedule
			 development meet the criteria described in paragraph (2).</text></paragraph><paragraph id="IDd9346eca6bb7473f903cd849f710f02a"><enum>(2)</enum><header>Criteria</header><text>The
			 criteria described in this paragraph are that, under the updated
			 guidance—</text><subparagraph id="ID38a1368315534c3190428a78c7360483"><enum>(A)</enum><text>in assessing
			 financial capability of a community—</text><clause id="ID0e1285f223cd48a79569657284ba47b8"><enum>(i)</enum><text>greater emphasis
			 should be placed on local economic conditions;</text></clause><clause id="IDa97762b0963f4c8fae1b298a14000f40"><enum>(ii)</enum><text>for regional
			 systems, consideration should be given to the economic conditions of
			 political
			 jurisdictions and significant demographic groups within each region;</text></clause><clause id="ID1e9b0cbae8614a6aa057a48d3c24534a"><enum>(iii)</enum><text>prescriptive
			 formulas for use in calculating financial capability and thresholds for
			 expenditure should not be considered to be the only indicator of the
			 financial
			 capability of a community;</text></clause><clause id="IDdd969868f62d4569876f26ed15193ba8"><enum>(iv)</enum><text>site-specific
			 local conditions should be taken into consideration in analyzing financial
			 capability;</text></clause><clause id="IDc3a0b9a101844164bf9b0cf78bb0ecd5"><enum>(v)</enum><text>a
			 single measure of financial capability or affordability (such as median
			 household income) should be viewed in the context of other economic
			 measures,
			 rather than as a threshold to be achieved; and</text></clause><clause id="IDd17dc0320af74dabb063815eb9da0eed"><enum>(vi)</enum><subclause commented="no" display-inline="yes-display-inline" id="idF5A49652EA4941CB9A5954F4B81F0848"><enum>(I)</enum><text>consideration should be
			 given to the economic outlook of a community, including the potential
			 impact of
			 program requirements over time, in the development of implementation
			 schedules;
			 and</text></subclause><subclause id="id8BB2C9C033294A02B59DD0534E9BB3D8" indent="up1"><enum>(II)</enum><text>the assessment should take into
			 consideration other essential community investments relating to water
			 quality
			 improvements;</text></subclause></clause></subparagraph><subparagraph id="ID7e4ba7771c344bf39746bb9fad9a2f9b"><enum>(B)</enum><text>with respect to
			 the timing of implementation of water quality-related improvements—</text><clause id="ID619f2b34ea6541d7b5a104beb524f5fc"><enum>(i)</enum><text>environmental
			 improvement implementation schedules should be structured to mitigate the
			 potential adverse impact on distressed populations resulting from the
			 costs of
			 the improvements; and</text></clause><clause id="IDc9804e5b2b574b828c7c88e88e791710"><enum>(ii)</enum><text>implementation
			 schedules should reflect local community financial conditions and economic
			 impacts;</text></clause></subparagraph><subparagraph id="ID9ee155105408415d90878f4a673a6af9"><enum>(C)</enum><text>with respect to
			 implementation of methodologies—</text><clause id="ID4364ffd2a6ab4025b8e40b26d50de6a4"><enum>(i)</enum><text>a
			 determination of local financial capability may be achieved through an
			 evaluation of an array of factors the relative importance of which may
			 vary
			 across regions and localities; and</text></clause><clause id="ID09019536cd864ab285d0500cf0c33dc8"><enum>(ii)</enum><text>an
			 appropriate methodology should give consideration to such various factors
			 as
			 are appropriate to recognize the prevailing and projected economic
			 concerns in
			 a community; and</text></clause></subparagraph><subparagraph id="IDc3761bef0c614a908ab3c27d7881f2bf"><enum>(D)</enum><text>the residential
			 indicator should be revised to include—</text><clause id="ID26d14e80e2d44d30ba985acc4ce04e83"><enum>(i)</enum><text>a
			 consideration of costs imposed upon ratepayers for essential utilities;</text></clause><clause id="ID132993e141054237bc34a3eae17814f4"><enum>(ii)</enum><text>increased
			 consideration and quantification of local community-imposed costs in
			 regional
			 systems;</text></clause><clause id="IDcb6fb8eb348e4a208435822f86cf611a"><enum>(iii)</enum><text>a
			 mechanism to assess impacts on communities with disparate economic
			 conditions
			 throughout the entire service area of a utility;</text></clause><clause id="IDb09f61c5334147cb9d45b57fbaa5de1c"><enum>(iv)</enum><text>a
			 consideration of the industrial and population trends of a community;</text></clause><clause id="IDb75d7ec02b6140b68a0e367c74a80cd0"><enum>(v)</enum><text>recognition
			 that—</text><subclause id="ID840277c6592445f484bc7d387e748e5b"><enum>(I)</enum><text>the median
			 household income of a service area reflects a numerical median rather than
			 the
			 distribution of incomes within the service area; and</text></subclause><subclause id="ID0528ce2a840f412682691c6fe5658d43"><enum>(II)</enum><text>more
			 representative methods of determining affordability, such as shelter
			 costs,
			 essential utility payments, and State and local tax efforts, should be
			 considered;</text></subclause></clause><clause id="IDb78fbbadffe84992b15b50cb8dcb8856"><enum>(vi)</enum><text>cash-flow forecasting rather than forecasting based on a snapshot evaluation of community financial
			 capability;</text></clause><clause id="id9A94016177FD4F7EA2CDC682A8DAC919"><enum>(vii)</enum><text>a
			 consideration of low-income ratepayer percentages; and</text></clause><clause id="ID715260e8f09b4f55a90525a53d79eb15"><enum>(viii)</enum><text>impacts
			 relating to program delivery, such as water quality infrastructure market
			 saturation and program management.</text></clause></subparagraph></paragraph><paragraph id="IDe204b9aeab7443a5a3ad9fa3cb6a8533"><enum>(3)</enum><header>Implementation</header><text>The
			 updated guidance should indicate that, in a case in which a previously
			 approved
			 long-term control plan or associated enforceable agreement allows for
			 modification of the plan or terms of the agreement (including financial
			 capability considerations), and all parties are in agreement that a change
			 is
			 needed or that the plan or agreement contains a reopener provision to
			 address
			 changes in the economic or financial status of the community since the
			 effective date of the plan or agreement, reconsideration and modification
			 of
			 financial capability determinations and implementation schedules based on
			 the
			 criteria described in paragraph (2) are appropriate.</text></paragraph></subsection><subsection id="ID8392f60904b34a37a412713ea448ae29"><enum>(c)</enum><header>Publication and
			 Submission</header><text>Upon completion of the updating of guidance under
			 subsection (b), the Administrator shall publish in the Federal Register
			 and
			 submit to the Committee on Environment and Public Works of the Senate and
			 the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives
			 the updated guidance.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe10748dedaa64297bb0be0caea199be7"><enum>(d)</enum><header>Authorization
			 of Appropriations</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out this section.</text></subsection></section></legis-body></bill>
