			 reference shall be considered to be made to a section or other provision
			 of title 49, United States Code.</text></section><section changed="deleted" committee-id="SSCM00" id="idB7358D031FB74CC19D543BD3CFF5B738" reported-display-style="strikethrough"><enum>3.</enum><header>Establishment of Surface Transportation Board as an independent establishment</header><subsection id="id2FFAA434C47543C39BC68F4EE0C1FBBD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 701(a) is amended to read as follows:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id3EAF1CDFD0024537807701DF4F15BFC3" reported-display-style="strikethrough" style="OLC"><subsection id="id1D694D4866EF46A9B88A6FF015CDC964"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Surface Transportation Board is an independent establishment of the United States Government.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idBA9B2CC5CC7C4C579712E1CD9DA70F57"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id5905FA4FCAA5429C935CBD120B7B3054"><enum>(1)</enum><header>Administrative provisions</header><text display-inline="yes-display-inline">Section 703 is amended—</text><subparagraph id="id21DD7CE6958944DC8639450F0E89FA73"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsections (a), (c), (f), and (g);</text></subparagraph><subparagraph id="id167F75BC748743EEAB98F9F838BF64D3"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subsections (b), (d), and (e) as subsections (a), (b), and (c), respectively; and</text></subparagraph><subparagraph id="id1CEAD9B74FED42978D1FA1F05D1ACBCB"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id9CD654C8FE14419D8D3079DFB20603AE" reported-display-style="strikethrough" style="OLC"><subsection id="idE2317DBB751F4F6D886D7EB358188109"><enum>(d)</enum><header>Submissions and transmittals</header><text display-inline="yes-display-inline">Whenever the Board submits or transmits any budget estimate, budget request, supplemental budget
			 estimate, or other budget information, legislative recommendation,
			 prepared testimony for a congressional hearing, or comment on legislation
			 to the President or to the Office of Management and Budget, it shall
			 concurrently transmit a copy thereof to the Committee on Commerce,
			 Science, and Transportation of the Senate and the Committee on
			 Transportation and Infrastructure of the House of Representatives. No
			 officer or agency of the United States shall have any authority to require
			 the Board to submit its budget estimates or requests, legislative
			 recommendations, prepared testimony for congressional hearings, or
			 comments on legislation to any officer or agency of the United States for
			 approval, comments, or review, prior to the submission of the
			 recommendations, testimony, or comments to Congress.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id1FE41939408E44289D03932C56C4EBD4"><enum>(2)</enum><header>Administrative support</header><subparagraph id="id8389A07F4BA94D3A96F4D79DAF3908C7"><enum>(A)</enum><header>Repealer</header><text>Section 725 is repealed.</text></subparagraph><subparagraph id="id49040A63BB6E47268872BD71F3CAA265"><enum>(B)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The table of contents for chapter 7 is amended by striking the item relating to section 725.</text></subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSCM00" id="id79A194C7DE714DE28C2CD031D5C110CE" reported-display-style="strikethrough"><enum>4.</enum><header>Surface Transportation Board membership</header><subsection id="idDFFEBEE9516C4C26B6F45C6DADA4D0BE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 701(b) is amended—</text><paragraph id="id9BDFE0E39F7D4E8486ED9C0F45B4EDF3"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="id9C5A56268E4946A49298F8AE2B623904"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>3 members</quote> and inserting <quote>5 members</quote>; and</text></subparagraph><subparagraph id="idC48B065C896649658923BBCDB8DCC1D7"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>2 members</quote> and inserting <quote>3 members</quote>; and</text></subparagraph></paragraph><paragraph id="id8C4E829EBAA04F8E936AB92EAFE8DFB7"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id5DEB75929835416791361989D7AF93B6" reported-display-style="strikethrough" style="OLC"><paragraph id="idE643E5A1C6DB42A2887FD2E55FF457A7"><enum>(2)</enum><text display-inline="yes-display-inline">At any given time, at least 3 members of the Board shall be individuals with professional standing

			 individuals with professional or business experience (including
			 agriculture or other rail customers) in the private sector.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id954F06AC3CAF444F961B00563A59265D"><enum>(b)</enum><header>Repeal of holdover limitation</header><text display-inline="yes-display-inline">Section 701(b)(3) is amended by striking <quote>qualified, but for a period not to exceed one year</quote> and inserting <quote>qualified</quote>.</text></subsection><subsection id="id95678B0DA3C34DBBB7F3C6EACC7B5952"><enum>(c)</enum><header>Repeal of obsolete provision</header><text display-inline="yes-display-inline">Section 701(b) is amended—</text><paragraph id="id9D19EF5C3C9741D3B8CA0BB4677ACF4C"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (4);</text></paragraph><paragraph id="idB2A18F2EFEE34E3F958EF19F70E2A068"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (5), (6), and (7) as paragraphs (4), (5), and (6), respectively; and</text></paragraph><paragraph id="id3222A444AAEF4DD786EE425A7E33BA01"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>In the case of an individual who becomes a member of the Board pursuant to paragraph (4), or an
			 individual</quote> in paragraph (4), as redesignated, and inserting <quote>In the case of an individual</quote>.</text></paragraph></subsection></section><section changed="deleted" committee-id="SSCM00" id="id0F4CCB663768427BBBBA90B114F6BD07" reported-display-style="strikethrough"><enum>5.</enum><header>Nonpublic collaborative discussions</header><text display-inline="no-display-inline">Section 703(a), as redesignated by section 3 of this Act, is amended to read as follows:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id39198B70CD724E7D952F6984D698BF84" reported-display-style="strikethrough" style="OLC"><subsection id="idDE4D2D8FF3204B2F8FB9226854D4802C"><enum>(a)</enum><header>Open meetings</header><paragraph id="id06A05998E52F41619B050E7ABE0820C8"><enum>(1)</enum><header>In general</header><text>The Board shall be deemed to be an agency for purposes of
			 <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5.</text></paragraph><paragraph id="idEECD925C05F14AAA8DB92AB9CB18A5BA"><enum>(2)</enum><header>Nonpublic collaborative discussions</header><subparagraph id="id5C958BF26C90461F9C7A06E3F96473B0"><enum>(A)</enum><header>In general</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5, a majority of the members may hold a
			 meeting that is not open to public observation to discuss official agency
			 business if—</text><clause id="idF8872550748A4991A30BFAD1B05A1491"><enum>(i)</enum><text>no vote or other disposition of
			 official agency business is taken at the meeting;</text></clause><clause id="id7DB6BF7900E64E409787AD4CF3AD1506"><enum>(ii)</enum><text>each individual present at the meeting is a member or an employee of the Board; and</text></clause><clause id="id5D1A5873417441E796C24B0094B8A094"><enum>(iii)</enum><text>the General Counsel of the Board is present at the meeting.</text></clause></subparagraph><subparagraph id="idF911578C50C04316B9C6AA7C25DD799C"><enum>(B)</enum><header>Disclosure of nonpublic collaborative discussions</header><text>Except as provided under subparagraph (C), not later than 2 business days after the
			 conclusion of a meeting under subparagraph (A), the Board shall make
			 available to the public, in a
			 place easily accessible to the public—</text><clause id="idC8E898E8E8544713930A9EF103B3CDF5"><enum>(i)</enum><text>a list of the individuals present at the meeting; and</text></clause><clause id="idED286578AB9D40B1B24A3CA7AB54C8B0"><enum>(ii)</enum><text>a summary of the matters discussed at the meeting, except for any matters the
			 Board
			 properly determines may be withheld from the public under section 552b(c)
			 of title 5.</text></clause></subparagraph><subparagraph id="idB11A7361DFBF47778F1EA4D508C40EE0"><enum>(C)</enum><header>Ongoing proceedings</header><text>If a discussion under subparagraph (A) relates, directly or indirectly, to an ongoing proceeding
			 before the Board, the Board shall make the disclosure under subparagraph
			 (B) on the date of the final Board
			 decision.</text></subparagraph><subparagraph id="id7DD35868936C449FBCBCF303AB28E675"><enum>(D)</enum><header>Preservation of open meetings requirements for agency action</header><text>Nothing in this paragraph shall
			 limit the applicability of <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5
			 with respect to a meeting of the members other than that described in
			 this paragraph.</text></subparagraph><subparagraph commented="no" id="id56787155D0934B36906FD74A1136F854"><enum>(E)</enum><header>Statutory construction</header><text>Nothing in this paragraph—</text><clause commented="no" id="id6E3C06A9F37E4E128DEC2B3DEBAE82A9"><enum>(i)</enum><text>shall limit the applicability of <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5 with respect to any
			 information which is proposed to be withheld from the public under
			 subparagraph
			 (B)(ii); and</text></clause><clause commented="no" id="id45BA2B00321749FEBD2A5C2599F42E1E"><enum>(ii)</enum><text>authorizes the Board to withhold from any individual any record that is accessible to that
			 individual under <external-xref legal-doc="usc" parsable-cite="usc/5/552a">section 552a</external-xref> of title 5, United States Code.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section changed="deleted" committee-id="SSCM00" id="id9DB3B24D0F67459EB2BF46D0D3AEE0AF" reported-display-style="strikethrough"><enum>6.</enum><header>Investigative authority</header><subsection id="idCD9487A7328B448484EB5E1E28BD5C9C"><enum>(a)</enum><header>Authority To initiate investigations</header><text display-inline="yes-display-inline">Section 11701(a) is amended by striking <quote>only on complaint</quote> and inserting <quote>on the Board's own initiative or on complaint</quote>.</text></subsection><subsection id="id979253B2C73349959F846F28A6991399"><enum>(b)</enum><header>Rate proceedings</header><text display-inline="yes-display-inline">Section 10704(b) is amended by striking the first sentence and inserting <quote>The Board may begin a proceeding under subsection (a)(1) on its own initiative or upon complaint,
			 except that a proceeding to determine the reasonableness of the level of a
			 rate charged by a carrier may only be initiated upon complaint.</quote>.</text></subsection><subsection id="idC911BEB1F954405395221F5F2E057367"><enum>(c)</enum><header>Annual report; investigations</header><text>Section 704 is amended by striking <quote>on its activities.</quote> and inserting <quote>on its activities, including each instance in which the Board has initiated an investigation on its
			 own initiative under this chapter or subtitle IV.</quote>.</text></subsection></section><section changed="deleted" committee-id="SSCM00" id="idB50856E4729F4B6B87116A4B1F5C4C62" reported-display-style="strikethrough"><enum>7.</enum><header>Procedures for rate cases</header><subsection id="id2CDDAF172B9848988221C7730B921353"><enum>(a)</enum><header>Simplified procedure</header><text display-inline="yes-display-inline">Section 10701(d)(3) is amended to read as follows:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="idEF2BB07219844C3EAB34A097BB464E88" reported-display-style="strikethrough" style="OLC"><paragraph id="id2F4B06C8E3234D8FA2D0DEC97946F869"><enum>(3)</enum><text display-inline="yes-display-inline">The Board shall maintain a simplified and expedited method for determining the reasonableness of
			 challenged rates in those cases in which a full stand-alone cost
			 presentation is too costly, given the value of the case.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1851718FE2A44F69A704BF1E1878295E"><enum>(b)</enum><header>Expedited handling</header><text display-inline="yes-display-inline">Section 10704(d) is amended by striking the first sentence and inserting <quote>The Board shall maintain procedures to ensure expeditious handling of challenges to the
			 reasonableness of railroad rates.</quote>.</text></subsection></section><section changed="deleted" committee-id="SSCM00" id="idFF4FC0849BBA42A1AA91C521D13B63D4" reported-display-style="strikethrough"><enum>8.</enum><header>Rate review timelines</header><text display-inline="no-display-inline">Section 10704(d), as amended by section 7 of this Act, is further amended—</text><paragraph id="id34A793B2C90C4B4596A1E80B7A509050"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(d) The</quote> and inserting <quote>(d)(1) The</quote>; and</text></paragraph><paragraph id="id40B7EA3EFC1842CCA670FF87DFFE0E5A"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id39EF7507E665463585DEC0697D0FE64E" reported-display-style="strikethrough" style="OLC"><paragraph id="id1CAC092760384FBB92A255C5A71BF40E"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id41BB7FCCF6F14385BCEB3DA143D16648"><enum>(A)</enum><text>Except as provided under subparagraph (B), in a stand-alone cost rate challenge, the Board shall
			 comply with the following timeline:</text><clause changed="deleted" committee-id="SSCM00" id="idB4056B902A0A4237B55A99474E96E5CC" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">For discovery, completion not later than 150 days after the date that the challenge is initiated.</text></clause><clause changed="deleted" committee-id="SSCM00" id="id8B9621EAE9F8481AA85CE0EBC9987650" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">For development of the evidentiary record, completion not later than 155 days after the date that
			 discovery is complete under clause (i).</text></clause><clause changed="deleted" committee-id="SSCM00" id="id0A3A5EE0562D43F5AADFDCD7EDD3FBC9" reported-display-style="strikethrough"><enum>(iii)</enum><text display-inline="yes-display-inline">For submission of a closing brief, submission not later than  60 days after the date that
			 development of the evidentiary record is complete under clause (ii).</text></clause><clause changed="deleted" committee-id="SSCM00" id="id2065766AE1A84E1D860FB6D3F1C28A4C" reported-display-style="strikethrough"><enum>(iv)</enum><text display-inline="yes-display-inline">For a final Board decision, issuance not later than 180 days after the date that the last closing
			 brief is submitted under clause (iii).</text></clause></subparagraph><subparagraph changed="deleted" committee-id="SSCM00" id="id3ABA5861BE774CE1B8E58E94456D95C4" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">The Board may extend a timeline under subparagraph (A) after a request from any party or in the
			 interest of due process.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section changed="deleted" committee-id="SSCM00" id="id1405337F2A29456697D5603DF98AA226" reported-display-style="strikethrough"><enum>9.</enum><header>Effect of rate bundling</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Surface Transportation Board
			 shall initiate an ex parte proceeding on whether contract proposals for
			 multiple
			 origin-to-destination movements have adversely impacted the intent of
			 Congress that the Surface Transportation Board’s rate challenge procedures
			 remain available to shippers that are subject to railroad market
			 dominance, and how the Board can prevent such practices in the future.</text></section><section changed="deleted" committee-id="SSCM00" id="id0D4F3265313141D3BD970F4A17D1F68C" reported-display-style="strikethrough"><enum>10.</enum><header>Report on rate case methodology</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Surface Transportation Board
			 shall report to the Committee on Commerce, Science, and Transportation of
			 the Senate and the Committee on Transportation and Infrastructure of the
			 House of Representatives on—</text><paragraph id="id49E9FAEE9C2A4CEEA7CC0555CBE699A6"><enum>(1)</enum><text display-inline="yes-display-inline">whether current methodologies are sufficient to address the complexity of large rate cases; and</text></paragraph><paragraph id="idF3DA2286934149518A17DB58844B6849"><enum>(2)</enum><text>alternative methodologies that could streamline and expedite large rate cases.</text></paragraph></section><section changed="deleted" committee-id="SSCM00" id="idE86C20E5C2F041599CB0ECA9D1CC4828" reported-display-style="strikethrough"><enum>11.</enum><header>Arbitration of certain rail rates, practices, and common carrier service expectation disputes</header><subsection id="idD36AAF1C759E4346918B10307A2EA7A2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 117 is amended by adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="id646CC35429674EFBAF0D68CD904C64E3" reported-display-style="strikethrough" style="USC"><section id="idFBB2805183C5471099295DE2CC07B210"><enum>11709.</enum><header>Arbitration of certain rail rates, practices, and common carrier service disputes</header><subsection id="id34E5A5774E294F6DBDED7BF029DEE55D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Surface Transportation Board Reauthorization Act of 2014</short-title>, the Board shall promulgate regulations to establish a binding arbitration process to resolve rail
			 rate, practice, and common carrier service
			 expectation complaints subject to the jurisdiction of the Board.</text></subsection><subsection id="id45FC1CB691C847E88F1C2487E5D0F085"><enum>(b)</enum><header>Covered disputes</header><text>The binding arbitration process—</text><paragraph commented="no" id="id8A5D939F619E4E00BDD0552D47737E22"><enum>(1)</enum><text>shall apply to disputes involving rates, practices, and common carrier service expectations subject
			 to the jurisdiction of the Board; and</text></paragraph><paragraph commented="no" id="idF2D11D7C400D4B98B342D78780D2A012"><enum>(2)</enum><text display-inline="yes-display-inline">shall not apply to—</text><subparagraph commented="no" id="id0C89D98D8F0D4407B14F16BCB5D0A491"><enum>(A)</enum><text display-inline="yes-display-inline">disputes to obtain the grant, denial, stay, or revocation of any license, authorization, or
			 exemption, or to prescribe for the future any conduct, rules, or results
			 of
			 general, industry-wide applicability, or to enforce a labor protective
			 condition; and</text></subparagraph><subparagraph commented="no" id="idC14ECF24C3174E168BAC096B4B8FA6CE"><enum>(B)</enum><text>disputes solely between 2 or more rail carriers.</text></subparagraph></paragraph></subsection><subsection id="id58FBE7B6CAB1456B96D5969B98BB25B7"><enum>(c)</enum><header>Arbitration procedures</header><paragraph id="idA2B38983A00746548D28CD58221B729F"><enum>(1)</enum><header>In general</header><text>The Board—</text><subparagraph id="idDFDE51A4BBB04EEAB47E4B8B596EFE65"><enum>(A)</enum><text display-inline="yes-display-inline">may make the binding arbitration process available only to the relevant parties—</text><clause id="id53A411B625E0445A9CEDE671A0307AD6"><enum>(i)</enum><text display-inline="yes-display-inline">after the filing of a formal complaint; or</text></clause><clause id="idEAF43A4A35AC49A583777E6C069B7F4A"><enum>(ii)</enum><text display-inline="yes-display-inline">upon petition by a party at the conclusion of any informal dispute resolution process provided by
			 the Board for a complaint subject to this section;</text></clause></subparagraph><subparagraph id="id6B93E752E2754DCB911777ED03EC6629"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to rate disputes, may make the binding arbitration process available only to the
			 relevant parties if the rail carrier has market dominance, as determined
			 under section 10707 of this title; and</text></subparagraph><subparagraph id="id5B509BA5BF274AD3B6439ABAA59CE622"><enum>(C)</enum><text display-inline="yes-display-inline">shall determine whether to pursue the binding arbitration process not later than 30 days after the
			 date that a petition or formal complaint is filed.</text></subparagraph></paragraph><paragraph id="idD0DE07C5A7A346629EFFBD7F5E0C0CBF"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Initiation of the binding arbitration process shall preclude the Board from separately reviewing a
			 complaint or dispute related to the same rail rate, practice, or common
			 carrier
			 service expectation in a covered dispute involving the same parties.</text></paragraph><paragraph id="idEF605B5148564B4AA5513D17B8C3CDBF"><enum>(3)</enum><header>Rates</header><text display-inline="yes-display-inline">In resolving a covered dispute involving the reasonableness of a rail carrier's rates, the
			 arbitrator or panel of arbitrators, as applicable, shall
			 consider the Board's methodologies for setting maximum lawful rates,
			 giving due consideration to the need for differential pricing to permit a
			 rail carrier to collect adequate revenues within the meaning of section
			 10704(a)(2).</text></paragraph><paragraph id="id3708D80735994B62834B42A1851D6552"><enum>(4)</enum><header>Service expectations</header><text display-inline="yes-display-inline">In resolving a dispute involving  common carrier service expectations, the arbitrator or panel of
			 arbitrators, as applicable, shall
			 consider
			 the rates and service terms, and any
			 changes thereto, as published or otherwise made available under subsection
			 (b), (c), or (d) of section 11101.</text></paragraph></subsection><subsection id="idB786AD1677024EF0AC50E4BA020FE0E6"><enum>(d)</enum><header>Arbitration decisions</header><text display-inline="yes-display-inline">Any decision reached in an arbitration process under this section—</text><paragraph id="id540AB399FC8449598632E39CA3ED18AE"><enum>(1)</enum><text display-inline="yes-display-inline">shall—</text><subparagraph id="id8E0A26DDA977408E8E15FBD5003DF912"><enum>(A)</enum><text display-inline="yes-display-inline">be consistent with subtitle IV;</text></subparagraph><subparagraph id="idCFE6799762F949F3A1E4F2A1867DC8F8"><enum>(B)</enum><text display-inline="yes-display-inline">be in writing;</text></subparagraph><subparagraph id="idCC1DA874BB754339A81928739D2CDFE6"><enum>(C)</enum><text display-inline="yes-display-inline">contain findings of fact and conclusions; and</text></subparagraph><subparagraph id="idA6FBCD8477F24B189C9F98982CAAF409"><enum>(D)</enum><text display-inline="yes-display-inline">be binding upon the parties; and</text></subparagraph></paragraph><paragraph id="id77A183FB6FC149B0A6CDA48F173F29CA"><enum>(2)</enum><text display-inline="yes-display-inline">shall not have any precedential effect in any other or subsequent arbitration dispute.</text></paragraph></subsection><subsection id="id8DC8F48D614C4B6584CD65985126A010"><enum>(e)</enum><header>Timelines</header><paragraph id="idC292C0DD23DA47D89611609968162EC8"><enum>(1)</enum><header>Selection</header><text display-inline="yes-display-inline">An arbitrator or panel of arbitrators shall be selected not later than 14 days after the date of
			 the Board's decision to
			 initiate arbitration.</text></paragraph><paragraph id="id12E846A1086148848C68EA6960E9617B"><enum>(2)</enum><header>Evidentiary process</header><text display-inline="yes-display-inline">The evidentiary process of the binding arbitration process shall be completed not later than 90
			 days after
			 the date that the arbitration process is initiated, unless a party
			 requests an extension and the arbitrator or panel of arbitrators, as
			 applicable, grants it.</text></paragraph><paragraph id="idB92BE9B4B6A442A894993A1EAC75AF7D"><enum>(3)</enum><header>Decision</header><text display-inline="yes-display-inline">The arbitrator or panel of arbitrators, as applicable, shall issue a decision not later than 30
			 days after the date that the evidentiary
			 record is closed.</text></paragraph><paragraph id="id689BB426F2FD435397520EA52BA4AFBA"><enum>(4)</enum><header>Extensions</header><text display-inline="yes-display-inline">The Board may extend any of the timelines in this subsection upon the agreement of all parties in
			 the dispute.</text></paragraph></subsection><subsection commented="no" id="id8F31A205BC9F4FD2B31FFD86D5276BA5"><enum>(f)</enum><header>Arbitrators</header><paragraph commented="no" id="id0041E8300A6D4E21B7FA1941C1591ACC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Arbitration under this section shall be conducted by an arbitrator, or a panel of arbitrators,
			 selected from a roster,
			 maintained by the Board, of persons with rail transportation, economic
			 regulation, professional or business experience, including agriculture, in
			 the private sector.</text></paragraph><paragraph commented="no" id="idB2B8CE83568C47D3B1E3ADBFE39C841E"><enum>(2)</enum><header>Selection</header><subparagraph commented="no" id="id0AD51F4EE0E24E52A468A7E27F79E1DC"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the parties cannot
			 mutually agree on an arbitrator, or the lead arbitrator of a panel of
			 arbitrators, the parties
			 shall select the arbitrator
			 or lead arbitrator from
			 the roster by alternately striking names from the roster until only 1 name
			 remains.</text></subparagraph><subparagraph commented="no" id="id9919DEAA1A4D4E41AB7D3A5BC87BB778"><enum>(B)</enum><header>Panel of arbitrators</header><text>For purposes of this section, a panel of arbitrators shall be selected as follows:</text><clause commented="no" id="idC5FDF91E6D8947B99CA3F7ECAEBA8ED4"><enum>(i)</enum><text>Notwithstanding subparagraph (A), each party to a dispute shall select 1 arbitrator from the
			 roster.</text></clause><clause commented="no" id="idC2178093223845BDBD50CFF398D0A820"><enum>(ii)</enum><text>The parties to a dispute may mutually select 1 arbitrator from the roster to serve as the lead
			 arbitrator of the panel of arbitrators.</text></clause></subparagraph></paragraph><paragraph commented="no" id="idADA6E9D451D64EF99F1404AA31C384AC"><enum>(3)</enum><header>Cost</header><text display-inline="yes-display-inline">The parties shall share the costs of the arbitration
			 equally.</text></paragraph></subsection><subsection id="id801BAF97399D456BB6122E67779361D8"><enum>(g)</enum><header>Relief</header><text display-inline="yes-display-inline">An arbitral decision under this section may award the payment of damages or rate prescriptive
			 relief, but the
			 value of the award shall be limited as follows:</text><paragraph id="idD5DB43324A9A4CB7903FCF7FA7B1BE4D"><enum>(1)</enum><text display-inline="yes-display-inline">For common carrier service and practice disputes, the damage award may not exceed $2,000,000.</text></paragraph><paragraph id="id428B98A04A1D4D94BBC4B1A58AF2E236"><enum>(2)</enum><text>For rate disputes, the damage award, including any rate prescription, may not exceed $25,000,000,
			 and any rate prescription shall be limited to not longer than 5 years from
			 the date of the arbitral decision.</text></paragraph></subsection><subsection id="idB5F80285F8AF464BB3F72A3A20D5762A"><enum>(h)</enum><header>Board review</header><text display-inline="yes-display-inline">If a party appeals a decision under this section to the Board, the Board may review the decision
			 under
			 this section to determine if—</text><paragraph id="idB5BF9FBAF01B413FBA7A85B2E129AF7B"><enum>(1)</enum><text display-inline="yes-display-inline">the decision is consistent with subtitle IV as applied by the Board; or</text></paragraph><paragraph id="id11A5EB5550F548078CCB4CEDE8802E28"><enum>(2)</enum><text display-inline="yes-display-inline">the award limitation under subsection (g).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9E480114001D437EAEC73C54E0750B05"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents for chapter 117 is amended by adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="idF0A31D33285B423C8B5AA68139CD7BA6" reported-display-style="strikethrough" style="OLC"><toc changed="deleted" committee-id="SSCM00" reported-display-style="strikethrough"><toc-entry bold="off" level="section">11709. 			 administration of the internal accounting and administrative control
			 systems of the Board;</text></paragraph><paragraph id="id07B2B6CE4683489C8CF0FF0C1F97835C"><enum>(2)</enum><text display-inline="yes-display-inline">issue findings and recommendations for actions to address such problems; and</text></paragraph><paragraph id="id1FB453268D6D4C8E8AD2D2DE271E4DC2"><enum>(3)</enum><text display-inline="yes-display-inline">report periodically to the Committee on Commerce, Science, and Transportation of the Senate and the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives on any progress made in implementing actions to address
			 such problems.</text></paragraph></subsection><subsection id="id305502676FB64253B530A786ACEAE759"><enum>(c)</enum><header>Access to information</header><text display-inline="yes-display-inline">In carrying out this section, the Inspector General may exercise authorities granted to the
			 Inspector General under subsections (a) and (b) of section 6 of the
			 Inspector General Act of 1978 (5 U.S.C. App.).</text></subsection><subsection id="id53217B640FDC44279BE85653135F61D3"><enum>(d)</enum><header>Authorization of appropriations</header><paragraph id="idA101778FAD8B4E3593B4DD1F603EC408"><enum>(1)</enum><header>Funding</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary of Transportation for use by the Inspector
			 General of the Department of Transportation such sums as may be necessary
			 to cover expenses associated with activities pursuant to the authority
			 exercised under this section.</text></paragraph><paragraph id="id00CB1DAF7DAA4FCDB33CC2074C0A5E59"><enum>(2)</enum><header>Reimbursable agreement</header><text display-inline="yes-display-inline">In the absence of an appropriation under this subsection for an expense referred to in paragraph
			 (1), the Inspector General and the Board shall have a reimbursable

			 <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5.</text></paragraph><paragraph id="id30aac8ca-7020-4739-9414-2628ab20d2ba"><enum>(2)</enum><header>Nonpublic collaborative discussions</header><subparagraph id="id5f43fb27-83f6-44b4-9958-23a45dc11116"><enum>(A)</enum><header>In general</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5, a majority of the members may hold a
			 meeting that is not open to public observation to discuss official agency
			 business if—</text><clause id="id59012fa4-9ec8-48e4-a43d-c2e3a9bb540e"><enum>(i)</enum><text>no vote or other disposition of
			 official agency business is taken at the meeting;</text></clause><clause id="id0e832dae-66fb-4707-bbe1-bbdb50fb6d58"><enum>(ii)</enum><text>each individual present at the meeting is a member or an employee of the Board; and</text></clause><clause id="idc37c3a28-6b1e-46d3-ba5e-f803687be2a5"><enum>(iii)</enum><text>the General Counsel of the Board is present at the meeting.</text></clause></subparagraph><subparagraph id="id3798eb01-ff28-46d8-9e39-a912bf3929a4"><enum>(B)</enum><header>Disclosure of nonpublic collaborative discussions</header><text>Except as provided under subparagraph (C), not later than 2 business days after the
			 conclusion of a meeting under subparagraph (A), the Board shall make
			 available to the public, in a
			 place easily accessible to the public—</text><clause id="id7d25b896-a117-4283-b31d-44641016f6b7"><enum>(i)</enum><text>a list of the individuals present at the meeting; and</text></clause><clause id="id20e7cd21-fad0-43e5-8ee0-b200a22a020f"><enum>(ii)</enum><text>a summary of the matters discussed at the meeting, except for any matters the
			 Board
			 properly determines may be withheld from the public under section 552b(c)
			 of title 5.</text></clause></subparagraph><subparagraph id="idff324666-1cc6-4a0a-9c58-218e703d5527"><enum>(C)</enum><header>Ongoing proceedings</header><text>If a discussion under subparagraph (A) relates, directly or indirectly, to an ongoing proceeding
			 before the Board, the Board shall make the disclosure under subparagraph
			 (B) on the date of the final Board
			 decision.</text></subparagraph><subparagraph id="idd906fa00-039b-4f53-aaf8-e9b5651fdddd"><enum>(D)</enum><header>Preservation of open meetings requirements for agency action</header><text>Nothing in this paragraph shall
			 limit the applicability of <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5
			 with respect to a meeting of the members other than that described in
			 this paragraph.</text></subparagraph><subparagraph commented="no" id="idbb7d3a0f-cddc-4a6e-90d1-4003b2759c2a"><enum>(E)</enum><header>Statutory construction</header><text>Nothing in this paragraph—</text><clause commented="no" id="idadecf259-b55f-49c9-9466-9dc2dfd06d38"><enum>(i)</enum><text>shall limit the applicability of <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5 with respect to any
			 information which is proposed to be withheld from the public under
			 subparagraph
			 (B)(ii); and</text></clause><clause commented="no" id="id2dfc6264-8c21-4058-aad4-e5f62cd81d24"><enum>(ii)</enum><text>authorizes the Board to withhold from any individual any record that is accessible to that
			 individual under <external-xref legal-doc="usc" parsable-cite="usc/5/552a">section 552a</external-xref> of title 5, United States Code.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section changed="added" committee-id="SSCM00" id="ida94bacb3-50e4-46ee-9ff8-b92c3aeb579c" reported-display-style="italic"><enum>6.</enum><header>Investigative authority</header><subsection id="id33e2b011-32a7-43da-aeb6-30ee957c2901"><enum>(a)</enum><header>Authority To initiate investigations</header><text display-inline="yes-display-inline">Section 11701(a) is amended by striking <quote>only on complaint</quote> and inserting <quote>on the Board's own initiative or on complaint</quote>.</text></subsection><subsection id="ida715daef-8b3c-48be-88e1-0535cd15b325"><enum>(b)</enum><header>Rate proceedings</header><text display-inline="yes-display-inline">Section 10704(b) is amended by striking the first sentence and inserting <quote>The Board may begin a proceeding under subsection (a)(1) on its own initiative or upon complaint,
			 except that a proceeding to determine the reasonableness of the level of a
			 rate charged by a carrier may only be initiated upon complaint.</quote>.</text></subsection><subsection id="id24025bd4-a42f-420e-8cef-c3b43bf78faf"><enum>(c)</enum><header>Annual report; investigations</header><text>Section 704 is amended by striking <quote>on its activities.</quote> and inserting <quote>on its activities, including each instance in which the Board has initiated an investigation on its
			 own initiative under this chapter or subtitle IV.</quote>.</text></subsection></section><section changed="added" committee-id="SSCM00" id="id49a82cae-63df-47f4-be31-71d740712f07" reported-display-style="italic"><enum>7.</enum><header>Procedures for rate cases</header><subsection id="idcf1a27ab-be6f-4820-9437-269f13b58b67"><enum>(a)</enum><header>Simplified procedure</header><text display-inline="yes-display-inline">Section 10701(d)(3) is amended to read as follows:</text><quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="idad769f94-bb6f-47af-a5d5-805697b0b520" reported-display-style="italic" style="OLC"><paragraph id="id44ccf90c-ef39-402a-aad0-d28b1b388eca"><enum>(3)</enum><text display-inline="yes-display-inline">The Board shall maintain a simplified and expedited method for determining the reasonableness of
			 challenged rates in those cases in which a full stand-alone cost
			 presentation is too costly, given the value of the case.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1bb17494-0060-4ce4-949f-ac5c45ac7489"><enum>(b)</enum><header>Expedited handling</header><text display-inline="yes-display-inline">Section 10704(d) is amended by striking the first sentence and inserting <quote>The Board shall maintain procedures to ensure expeditious handling of challenges to the
			 reasonableness of railroad rates.</quote>.</text></subsection></section><section changed="added" committee-id="SSCM00" id="ide7581a29-f798-488a-8280-f5e35a32d890" reported-display-style="italic"><enum>8.</enum><header>Rate review timelines</header><text display-inline="no-display-inline">Section 10704(d), as amended by section 7 of this Act, is further amended—</text><paragraph id="idf4c4065b-f4da-415b-bfe4-4f2a859b76a0"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(d) The</quote> and inserting <quote>(d)(1) The</quote>; and</text></paragraph><paragraph id="id7a125596-e848-4674-8b74-ccc3723d397b"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id23a627b8-dccc-413e-8efc-03bb0c7debf8" reported-display-style="italic" style="OLC"><paragraph id="idb30a9316-f5ed-4f34-9668-a2c21130233b"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id4a3d29bd-b501-4bf7-b803-7236cc96fa98"><enum>(A)</enum><text>Except as provided under subparagraph (B), in a stand-alone cost rate challenge, the Board shall
			 comply with the following timeline:</text><clause changed="added" committee-id="SSCM00" id="id9ecd1bdc-a093-4560-9358-c6ac0aacf4a0" reported-display-style="italic"><enum>(i)</enum><text display-inline="yes-display-inline">For discovery, completion not later than 150 days after the date that the challenge is initiated.</text></clause><clause changed="added" committee-id="SSCM00" id="id3a302014-e41c-4e53-ba44-4a7634063b41" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">For development of the evidentiary record, completion not later than 155 days after the date that
			 discovery is complete under clause (i).</text></clause><clause changed="added" committee-id="SSCM00" id="id6017bc84-300a-461b-a993-bdc8db27d023" reported-display-style="italic"><enum>(iii)</enum><text display-inline="yes-display-inline">For submission of a closing brief, submission not later than  60 days after the date that
			 development of the evidentiary record is complete under clause (ii).</text></clause><clause changed="added" committee-id="SSCM00" id="iddee5ac55-53c0-4ad1-b32a-c7760a2f9fdf" reported-display-style="italic"><enum>(iv)</enum><text display-inline="yes-display-inline">For a final Board decision, issuance not later than 180 days after the date that the evidentiary
			 record is complete under clause (ii).</text></clause></subparagraph><subparagraph changed="added" committee-id="SSCM00" id="id88d7b4d7-b717-48e9-958b-1dcd1d3ef958" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">The Board may extend a timeline under subparagraph (A) after a request from any party or in the
			 interest of due process.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section changed="added" committee-id="SSCM00" id="id814ecc9b-74e1-4413-8c20-9a75b37cf8df" reported-display-style="italic"><enum>9.</enum><header>Effect of rate bundling</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Surface Transportation Board
			 shall initiate an ex parte proceeding on whether contract proposals for
			 multiple
			 origin-to-destination movements have adversely impacted the intent of
			 Congress that the Surface Transportation Board’s rate challenge procedures
			 remain available to shippers that are subject to railroad market
			 dominance, and how the Board can prevent such practices in the future.</text></section><section changed="added" committee-id="SSCM00" id="id04b1d157-9b96-483d-97a3-164c3222aae7" reported-display-style="italic"><enum>10.</enum><header>Report on rate case methodology</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Surface Transportation Board
			 shall report to the Committee on Commerce, Science, and Transportation of
			 the Senate and the Committee on Transportation and Infrastructure of the
			 House of Representatives on—</text><paragraph id="id3718c3ba-a64c-4197-9138-8cc10b24c646"><enum>(1)</enum><text display-inline="yes-display-inline">whether current large rate case methodologies are sufficient, not unduly complex, and cost
			 effective; and</text></paragraph><paragraph id="idce01b7b4-54d7-47f3-9577-e2442d639df2"><enum>(2)</enum><text>alternative methodologies that could streamline and expedite large rate cases.</text></paragraph></section><section changed="added" committee-id="SSCM00" id="idb8758af4-bd5b-4f4f-bf81-a8ddbfcf8ac9" reported-display-style="italic"><enum>11.</enum><header>Arbitration of certain rail rates, practices, and common carrier service expectation disputes</header><subsection id="id59f9a93f-99b9-4005-9b13-3998ea01470d"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter 117 is amended by adding at the end the following:</text><quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="idd82363bb-8bca-4204-8d8d-7472f775ba86" reported-display-style="italic" style="USC"><section id="id87ab0d26-afc8-4d14-9d76-39225d6d52a1"><enum>11708.</enum><header>Voluntary arbitration of certain rail rates, practices, and common carrier service disputes</header><subsection id="idaf64fd4e-dac4-4b8f-a9f7-db60ee6d3db9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Surface Transportation Board Reauthorization Act of 2014</short-title>, the Board shall promulgate regulations to establish a voluntary, but binding, arbitration process
			 to resolve rail
			 rate, practice, and common carrier service
			 expectation complaints subject to the jurisdiction of the Board.</text></subsection><subsection id="ida2413638-b240-4b36-9e2e-b50a8cbfd547"><enum>(b)</enum><header>Covered disputes</header><text>The binding arbitration process—</text><paragraph commented="no" id="id8a86b8c3-c268-427d-a69f-6ad88525b88c"><enum>(1)</enum><text>shall apply to disputes involving rates, demurrage, accessorial charges, misrouting or mishandling
			 of rail cars, and disputes involving a carrier's published rules and
			 practices as applied to particular rail transportation;</text></paragraph><paragraph commented="no" id="idc8735bf3-a922-4426-be2b-5b546c124677"><enum>(2)</enum><text display-inline="yes-display-inline">shall not apply to—</text><subparagraph commented="no" id="id5727aca8-116c-43f0-ab23-3a814fd028ed"><enum>(A)</enum><text display-inline="yes-display-inline">disputes to obtain the grant, denial, stay, or revocation of any license, authorization, or
			 exemption, or to prescribe for the future any conduct, rules, or results
			 of
			 general, industry-wide applicability, or to enforce a labor protective
			 condition; and</text></subparagraph><subparagraph commented="no" id="idc46f35af-054f-41b5-bb3e-47ca05a063c1"><enum>(B)</enum><text>disputes solely between 2 or more rail carriers; and</text></subparagraph></paragraph><paragraph commented="no" id="id3C437B7ACF894458A830C099A92E2123"><enum>(3)</enum><text>shall not prevent parties from independently seeking or utilizing private arbitration services to
			 resolve any disputes they may have.</text></paragraph></subsection><subsection id="id8448507c-16cd-43d5-be5f-3eda843f4f8a"><enum>(c)</enum><header>Arbitration procedures</header><paragraph id="idf84aab32-d237-4c72-a430-6de1a166cf74"><enum>(1)</enum><header>In general</header><text>The Board—</text><subparagraph id="id5cb52501-a97a-43ee-8c5f-8f0547b246ae"><enum>(A)</enum><text display-inline="yes-display-inline">may make the voluntary, but binding, arbitration process available only to the relevant parties—</text><clause id="idf6d182bc-afeb-46c0-bc36-456bff27bc04"><enum>(i)</enum><text display-inline="yes-display-inline">after the filing of a formal complaint;</text></clause><clause id="idca7ec983-edaa-422d-849a-e8d5b8ff0c60"><enum>(ii)</enum><text display-inline="yes-display-inline">upon petition by all parties at the conclusion of any informal dispute resolution process provided
			 by
			 the Board for a complaint subject to this section; or</text></clause><clause id="id725D7FC56E1F4DFF9676ADB04AAADAAB"><enum>(iii)</enum><text>through current or future procedures adopted by the Board to facilitate voluntary, but binding,
			 arbitration;</text></clause></subparagraph><subparagraph id="id0fe73365-e808-4989-82e0-de342c57e49e"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to rate disputes, may make the binding arbitration process available only to the
			 relevant parties if the rail carrier has market dominance, as determined
			 under section 10707 of this title; and</text></subparagraph><subparagraph id="idb26de987-706c-40dc-9b80-72f3b3d99944"><enum>(C)</enum><text display-inline="yes-display-inline">shall determine whether to pursue the binding arbitration process not later than 30 days after the
			 date that a petition or formal complaint is filed.</text></subparagraph></paragraph><paragraph id="id508a8978-a987-423f-958c-a68462a6de9a"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Initiation of the binding arbitration process shall preclude the Board from separately reviewing a
			 complaint or dispute related to the same rail rate, practice, or common
			 carrier
			 service expectation in a covered dispute involving the same parties.</text></paragraph><paragraph id="id75905eee-2f63-4b5f-bab5-44d43dca1a66"><enum>(3)</enum><header>Rates</header><text display-inline="yes-display-inline">In resolving a covered dispute involving the reasonableness of a rail carrier's rates, the
			 arbitrator or panel of arbitrators, as applicable, shall
			 consider the Board's methodologies for setting maximum lawful rates,
			 giving due consideration to the need for differential pricing to permit a
			 rail carrier to collect adequate revenues within the meaning of section
			 10704(a)(2).</text></paragraph><paragraph id="id3600d48b-9850-42b0-a72d-07d00f46bec6"><enum>(4)</enum><header>Service expectations</header><text display-inline="yes-display-inline">In resolving a dispute involving  common carrier service expectations, the arbitrator or panel of
			 arbitrators, as applicable, shall
			 consider
			 the rates and service terms, and any
			 changes thereto, as published or otherwise made available under subsection
			 (b), (c), or (d) of section 11101.</text></paragraph></subsection><subsection id="id5fc9d04f-76fa-4b07-9ad7-99735cfb8466"><enum>(d)</enum><header>Arbitration decisions</header><text display-inline="yes-display-inline">Any decision reached in an arbitration process under this section—</text><paragraph id="id9ddfc268-094d-4685-a19b-8fead591fbb7"><enum>(1)</enum><text display-inline="yes-display-inline">shall—</text><subparagraph id="id616bebf7-e7a1-47b2-bfe9-b93cef9c470f"><enum>(A)</enum><text display-inline="yes-display-inline">be in writing;</text></subparagraph><subparagraph id="ide3d450b5-a618-4fb9-9443-444f67fdd4da"><enum>(B)</enum><text display-inline="yes-display-inline">contain findings of fact and conclusions; and</text></subparagraph><subparagraph id="id3dfc7673-b07e-4579-9903-76f62efb2255"><enum>(C)</enum><text display-inline="yes-display-inline">be binding upon the parties; and</text></subparagraph></paragraph><paragraph id="id7667a805-9ea4-410d-acf2-81a654f21098"><enum>(2)</enum><text display-inline="yes-display-inline">shall not have any precedential effect in any other or subsequent arbitration dispute.</text></paragraph></subsection><subsection id="id24679742-4342-49ea-ac3e-99d60cfef510"><enum>(e)</enum><header>Timelines</header><paragraph id="id0f2b126f-e912-40aa-aeae-420fef890067"><enum>(1)</enum><header>Selection</header><text display-inline="yes-display-inline">An arbitrator or panel of arbitrators shall be selected not later than 14 days after the date of
			 the Board's decision to
			 initiate arbitration.</text></paragraph><paragraph id="idbd22744a-b33c-4c44-84a9-ce86183ac206"><enum>(2)</enum><header>Evidentiary process</header><text display-inline="yes-display-inline">The evidentiary process of the binding arbitration process shall be completed not later than 90
			 days after
			 the date that the arbitration process is initiated, unless a party
			 requests an extension and the arbitrator or panel of arbitrators, as
			 applicable, grants it.</text></paragraph><paragraph id="id8860b1eb-aea6-4d98-ae57-2a170abf0c72"><enum>(3)</enum><header>Decision</header><text display-inline="yes-display-inline">The arbitrator or panel of arbitrators, as applicable, shall issue a decision not later than 30
			 days after the date that the evidentiary
			 record is closed.</text></paragraph><paragraph id="id43db1746-c690-4a75-935c-ffc8c34c7f8a"><enum>(4)</enum><header>Extensions</header><text display-inline="yes-display-inline">The Board may extend any of the timelines in this subsection upon the agreement of all parties in
			 the dispute.</text></paragraph></subsection><subsection commented="no" id="id409650d0-849c-49cd-b67c-292f254e4d77"><enum>(f)</enum><header>Arbitrators</header><paragraph commented="no" id="idcc0e85f5-9f77-4b13-9c42-11084cc81663"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Unless otherwise agreed by all of the parties, an arbitration under this section shall be conducted
			 by a panel of arbitrators,
			 selected from a roster,
			 maintained by the Board, of persons with rail transportation, economic
			 regulation, professional or business experience, including agriculture, in
			 the private sector.</text></paragraph><paragraph commented="no" id="id5ea2fa87-ca30-494c-95ee-4fec0246aebc"><enum>(2)</enum><header>Selection</header><subparagraph commented="no" id="ida7318462-41ee-4554-b5b4-e3b20512c178"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the parties cannot
			 mutually agree on an arbitrator, or the lead arbitrator of a panel of
			 arbitrators, the parties
			 shall select the arbitrator
			 or lead arbitrator from
			 the roster by alternately striking names from the roster until only 1 name
			 remains.</text></subparagraph><subparagraph commented="no" id="id83b61e62-9bf7-463f-ba9e-937a0f366277"><enum>(B)</enum><header>Panel of arbitrators</header><text>For purposes of this section, a panel of arbitrators shall be selected as follows:</text><clause commented="no" id="idD5233FE219614056BD728735E05D01FF"><enum>(i)</enum><text>The parties to a dispute may mutually select 1 arbitrator from the roster to serve as the lead
			 arbitrator of the panel of arbitrators.</text></clause><clause commented="no" id="id567849F1F1B2460C9CEA63756450CB3F"><enum>(ii)</enum><text>If the parties cannot mutually agree on a lead arbitrator, the parties shall select a lead
			 arbitrator using the process described in subparagraph (A).</text></clause><clause commented="no" id="id358cd7cb-ae96-435a-a820-27eac69d6d67"><enum>(iii)</enum><text>In addition to the lead arbitrator selected under this subparagraph,  each party to a dispute shall
			 select 1 additional arbitrator from the
			 roster.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id34b6bc7f-ab19-413e-ad94-801cb9d1b779"><enum>(3)</enum><header>Cost</header><text display-inline="yes-display-inline">The parties shall share the costs of the arbitration
			 equally.</text></paragraph></subsection><subsection id="id7f71928b-5e1e-43b8-87e4-7011ef1f02c5"><enum>(g)</enum><header>Relief</header><text display-inline="yes-display-inline">An arbitral decision under this section may award the payment of damages or rate prescriptive
			 relief, but the
			 value of the award shall be limited as follows:</text><paragraph id="id5be727cf-ccca-4887-a5f6-3f8e5a5cfc1c"><enum>(1)</enum><text display-inline="yes-display-inline">For common carrier service and practice disputes, the damage award may not exceed $2,000,000.</text></paragraph><paragraph id="idf3141f11-56d0-497c-8677-190059c1c612"><enum>(2)</enum><text>For rate disputes, the damage award, including any rate prescription, may not exceed $25,000,000,
			 and any rate prescription shall be limited to not longer than 5 years from
			 the date of the arbitral decision.</text></paragraph></subsection><subsection id="ide8b55536-4573-4dda-bda8-ecd11629b705"><enum>(h)</enum><header>Board review</header><text display-inline="yes-display-inline">If a party appeals a decision under this section to the Board, the Board may review the decision
			 under
			 this section to determine if—</text><paragraph id="id548d59f3-49bd-48b6-8c2e-aa2442831c6b"><enum>(1)</enum><text display-inline="yes-display-inline">a clear abuse of arbitral authority or discretion occurred;</text></paragraph><paragraph id="id866D67621D584712B114DA1D920F5EFC"><enum>(2)</enum><text display-inline="yes-display-inline">the decision directly contravenes statutory authority; or</text></paragraph><paragraph id="idc240e0ed-d7e8-44a8-a237-4b66a179a0be"><enum>(3)</enum><text display-inline="yes-display-inline">the award limitation under subsection (g) was violated.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2b4f878d-d0f5-4d52-89dd-789b7c148821"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents for chapter 117 is amended by adding at the end the following:</text><quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="id014d1141-1ebd-4e76-a63a-3d8d7494b502" reported-display-style="italic" style="OLC"><toc changed="added" committee-id="SSCM00" reported-display-style="italic"><toc-entry bold="off" level="section">11708. 			 Board during the previous quarter that includes—</text><subparagraph id="idde87b225-8184-4245-8332-1379bd561c0f"><enum>(A)</enum><text>a list of the type of each complaint;</text></subparagraph><subparagraph id="id42a88662-d5b0-43ba-a1ab-b15efd0f12ba"><enum>(B)</enum><text>the geographic region of each complaint; and</text></subparagraph><subparagraph id="idbb27d87b-47c3-483b-b3f6-79b7239900f2"><enum>(C)</enum><text>the resolution of each complaint, if appropriate.</text></subparagraph></paragraph><paragraph id="id187db0ab-f93b-4635-b802-da3aaee2e888"><enum>(3)</enum><header>Written consent</header><text>The quarterly report may identify a complainant that submitted an informal complaint only upon the
			 written consent of the complainant.</text></paragraph><paragraph id="id3d30b48a-5331-4432-be72-c7c07f87e05f"><enum>(4)</enum><header>Website posting</header><text>Each quarterly report shall be posted on the Board's public website.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idf303e721-c9e7-4b77-ae93-64894a586758"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents for chapter 7 is amended by striking the item relating to section 704 and

			 shall begin providing quarterly reports to the Committee on Commerce,
			 Science, and Transportation of the Senate and the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives on the Surface Transportation Board's progress toward
			 addressing the issues raised in each unfinished regulatory proceeding,
			 regardless of whether the proceeding is subject to a statutory or
			 regulatory deadline.</text></section><section changed="added" committee-id="SSCM00" id="id698f4bf7-3426-4375-b62f-f35e3667aa47" reported-display-style="italic"><enum>14.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id312be9ee-c62a-4a88-8ad7-61ffa57db6bf"><enum>(1)</enum><text>as part of Docket No. EP 722, the Surface Transportation Board should consider the costs and
			 benefits of the annual
			 determinations of revenue adequacy for Class I railroads;</text></paragraph><paragraph id="id0318f7dd-28b1-4a1d-9ac2-42307372b707"><enum>(2)</enum><text>the Surface Transportation Board should review the methodology employed to define the business
			 cycle in its annual
			 determination of revenue adequacy and consider undertaking, if necessary,
			 a rulemaking to define the business cycle;</text></paragraph><paragraph id="id63e13bac-5702-46e7-8b63-f005ce1a96cc"><enum>(3)</enum><text>as part of Docket No. EP 711, the Surface Transportation Board should consider if a rulemaking
			 proceeding on
			 competitive switching is needed to promote a viable competitive national
			 rail system; and</text></paragraph><paragraph id="idfc9169ee-e31a-4dc3-b244-d5b687fe66ca"><enum>(4)</enum><text>if the Surface Transportation Board determines a rulemaking proceeding on competitive
			 switching is needed, the
			 Surface Transportation Board should ensure that such rulemaking is
			 completed in as timely a
