		  passenger capacity limits and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Boating Capacity Standards Act of
			 2013</short-title></quote>.</text>
		</section><section id="idA5BF6EF94C644C0D9EB0548D97BE7EDA"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id6F39A54767EA4E9DBBE7C21866A3842E"><enum>(1)</enum><header>Passenger</header><text>The
			 term <term>passenger</term> includes any individual aboard a vessel.</text>
			</paragraph><paragraph id="idC615002F70D3442EB4475DFBC53096A6"><enum>(2)</enum><header>Recreational
			 vessel</header><text>The term <term>recreational vessel</term>—</text>
				<subparagraph id="id7608BE125542408280AD88C1B0ACC3FA"><enum>(A)</enum><text>means any vessel
			 that is—</text>
					<clause id="idaa9d31dc74cf4c41b101c8d3c91bad33"><enum>(i)</enum><text>manufactured or
			 used primarily for pleasure; or</text>
					</clause><clause id="idd094b001d99f4ad99a2e5c1953ee9a13"><enum>(ii)</enum><text>leased, rented,
			 or chartered to a person for the pleasure of that person; and</text>
					</clause></subparagraph><subparagraph id="id3ebe170f07c24c5c9216d14d3f222d34"><enum>(B)</enum><text>does not include
			 a vessel that—</text>
					<clause id="idF3C1F6A990A84704A1A9919792A1E089"><enum>(i)</enum><text>is
			 subject to Coast Guard inspection; and</text>
					</clause><clause id="ide2c76eca5d9b41ddbdf382e7df8c5c16"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id3E324BAAC4A749C3AB13FC2550BE42B7"><enum>(I)</enum><text>is engaged in
			 commercial use; or</text>
						</subclause><subclause id="idEB2EBFC1994A4484914C67D261F1319D" indent="up1"><enum>(II)</enum><text>carries paying passengers.</text>
						</subclause></clause></subparagraph></paragraph></section><section id="id3B32FD1FADD84C15A457CC90888C7953"><enum>3.</enum><header>Capacity limits
			 for recreational vessels</header>
			<subsection id="idF416C694C57641B2AC60ACBD725CB5A3"><enum>(a)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Commandant of the Coast Guard shall—</text>
				<paragraph id="id31808F53989F4C27B3C19F63D6B44240"><enum>(1)</enum><text>establish
			 standards for determining the maximum passenger capacity for recreational
			 vessels, which shall be expressed in whole number of passengers and in
			 pounds;</text>
				</paragraph><paragraph id="id63F0BEBD75FB4AFE9F425427642FBA04"><enum>(2)</enum><text>require each
			 manufacturer of a passenger vessel to post such maximum passenger capacity
			 on
			 the passenger vessel in accordance with subsection (b); and</text>
				</paragraph><paragraph id="idA814EC46E99F449B9C91C1B9956AD74D"><enum>(3)</enum><text>require each
			 operator of a passenger vessel to ensure that—</text>
					<subparagraph id="id3A2F9262A9D8415FBEAE53B7EBE0F1E3"><enum>(A)</enum><text>such maximum
			 passenger capacity is posted in accordance with subsection (b); and</text>
					</subparagraph><subparagraph id="idF8E5D6BBA9EB477F8AB0AC2F51831CFB"><enum>(B)</enum><text>notice of the
			 need to balance the weight carried by the vessel to avoid capsizing is
			 posted
			 in accordance with subsection (b).</text>
					</subparagraph></paragraph></subsection><subsection id="id1F3899CA56C4475B8B2FB252EBF4D7BF"><enum>(b)</enum><header>Elements of
			 display</header><text>The maximum passenger capacity, maximum carrying capacity
			 in pounds, and notice of the need to balance the carried weight for a
			 passenger
			 vessel—</text>
				<paragraph id="id366622AB54FE42F6AD84C6A98B38DE8E"><enum>(1)</enum><text>shall be
			 permanently displayed in a legible matter; and</text>
				</paragraph><paragraph id="idDE14B8F4A19B4389AE0ECA0ECE7D85DB"><enum>(2)</enum><text>shall be located
			 so as to be clearly visible to a passenger boarding the passenger
			 vessel.</text>
				</paragraph></subsection><subsection id="id5283CE6744D74D61A7A98F18D5051A9A"><enum>(c)</enum><header>Penalties</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the
			 Commandant
			 of the Coast Guard shall publish regulations that establish appropriate
			 penalties for a manufacturer of a recreational vessel that does not comply
			 with
			 the requirements under this section.</text>
			</subsection><subsection id="idA58892A93BA24AC4A1674DE1C1E9D356"><enum>(d)</enum><header>Application</header><text>The
			 requirements under this section shall apply to any recreational vessel
			 manufactured after the date that is 180 days after the date of the
			 enactment of
			 this Act.</text>
