		<official-title>To amend the Healthy Forests Restoration Act of 2003 to expand the use of categorical exclusions
			 for hazardous fuel reduction projects. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the
		  <quote><short-title>Emergency Fuel Reduction Act of 2014</short-title></quote>.</text></section><section id="id035befce0fe74024862cddccf3f5d5bc"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph id="idd2039a1ac28f443a9b0d30ddfcdc5378"><enum>(1)</enum><text>to expedite wildfire prevention projects to reduce the chances of wildfire on certain high-risk
			 Federal land adjacent to communities, private property, and critical
			 infrastructure;</text></paragraph><paragraph id="idc2a0b72c6c274299bf5f503f96dc0df9"><enum>(2)</enum><text>to improve forest and wildland health; and</text></paragraph><paragraph id="ida033fbe5082c425085fed7e967855ccd"><enum>(3)</enum><text>to promote the recovery of threatened and endangered species, or other species under consideration
			 for listing under the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (16 U.S.C. 1531
		et seq.), including sage-grouse, whose habitat is negatively impacted by wildland
			 fire.</text></paragraph></section><section id="id06C96959F7D14DB281C112826AE6645E"><enum>3.</enum><header>Expedited review of projects on Federal land</header><text display-inline="no-display-inline">Section  104 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6514">16 U.S.C. 6514</external-xref>) is amended—</text><paragraph id="id5F02B9E88E8147E3A0DC00CFB4D853C1"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (e) through (h) as subsections (f) through (i), respectively;</text></paragraph><paragraph id="id6CBA9F1796AA43EDB0606C701CBB7C73"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(1)(C)(i), by striking <quote>subsection (f)</quote> and inserting <quote>subsection (g)</quote>; and</text></paragraph><paragraph id="idADFEC23FA48341D08E2E0102A52918E7"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (d) the following:</text><quoted-block display-inline="no-display-inline" id="idC0DEFECE477E488EB2B888B7623D3164" style="OLC"><subsection id="idD6BC37E11410465CA381F1C10B2D7B85"><enum>(e)</enum><header>Categorical exclusion of certain projects</header><paragraph id="idae75f498e67f44fb83e67be67382aead"><enum>(1)</enum><header>Definition of adjacent Federal land</header><text>In this subsection, the term  <term>adjacent Federal land</term> means an area of Federal land—</text><subparagraph id="id603A47A5DB214C4C8A6ECD963ADBCACF"><enum>(A)</enum><text>that, while not located in the wildland-urban interface, is located within not more than 2 miles of
			 non-Federal land; and</text></subparagraph><subparagraph id="idFEE36AB2B57F41E79A99C579BE0EB7D5"><enum>(B)</enum><text>on which the  Secretary determines that conditions, such as the risk of wildfire, an insect or
			 disease epidemic, or the presence of invasive species, pose a risk to the
			 adjacent non-Federal land.</text></subparagraph></paragraph><paragraph id="ide6a116464a2d403bb66ef357f8a9a5a7"><enum>(2)</enum><header>Categorical exclusion of certain projects</header><subparagraph id="idb4e04f4afa654d5a9a9c64d4e75076c6"><enum>(A)</enum><header>In general</header><text>An authorized hazardous fuel reduction project shall be categorically excluded from the
			 requirements of the
		<act-name parsable-cite="NEPA69">National Environmental Policy Act of
		1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) if the project—</text><clause id="id3bca943398f94303bca0674f073cc0ed"><enum>(i)</enum><text>involves the removal of insect-infected trees, dead or dying trees, trees presenting a threat to
			 public safety or electrical reliability, or the removal of other hazardous
			 fuels within 500 feet of utility or
			 communications infrastructure, a municipal water supply system,
			 campground, roadside, heritage site, recreation site, school, or other
			 infrastructure;</text></clause><clause id="idebde008400a74c32880b17f170ead341"><enum>(ii)</enum><text>is intended to treat 10,000 acres or less of public land or National Forest System land that—</text><subclause id="id8218684990944b46bb9365bd05507778"><enum>(I)</enum><text>contains threatened and endangered species habitat; or</text></subclause><subclause id="id5efe0bc6ac394cfeac268b1e3f4f7695"><enum>(II)</enum><text>provides conservation benefits to species that are not listed as endangered or threatened under
			 section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>) but are a
			 State-listed species, a special concern species, or candidates for a
			 listing under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></subclause></clause><clause id="iddadfdd849eaf4e98a7a0464345b59311"><enum>(iii)</enum><text>is proposed to be conducted on adjacent Federal land or is recommended in a community wildfire
			 protection plan if—</text><subclause id="id8d84713cdb1e45d1ab1019b42e4d1cdb"><enum>(I)</enum><text>the Secretary determines that the project is consistent with the applicable resource management
			 plan; and</text></subclause><subclause id="id1a244d4359424deeae80e9dd3b2b5d63"><enum>(II)</enum><text>the decision to categorically exclude the project is made in accordance with applicable
			 extraordinary circumstances procedures established pursuant to section
			 1508.4 of title 40, Code of Federal Regulations (or a successor
			 regulation).</text></subclause></clause></subparagraph><subparagraph id="id7C19546621034A348F9766782A22D8C4"><enum>(B)</enum><header>Consultation</header><text>In determining whether an area contains trees or other hazardous fuels described in clause (i), the
			 Secretary shall consult with any utility or other entity that manages the
			 area.</text></subparagraph><subparagraph id="idb18f7f23e17c4b0b95b8496bc1128013"><enum>(C)</enum><header>Priority for certain projects</header><text>In providing categorical exclusions under subparagraph (A), the Secretary shall give priority to
			 authorized hazardous fuel reduction projects and other projects
			 recommended in a community wildfire protection plan.</text></subparagraph><subparagraph id="id5d5f4905c8d2410196b21e35511c10a2"><enum>(D)</enum><header>Exclusions</header><text>National Forest System land or public land eligible for treatment under this subsection shall not
			 include land—</text><clause id="idde50367cc7f34689b3698970f053b75e"><enum>(i)</enum><text>that is a component of the National Wilderness Preservation System;</text></clause><clause id="id319e07cfab3c4dd3b6df734ee626a4d9"><enum>(ii)</enum><text>on which the removal of vegetation is specifically prohibited by Federal law; or</text></clause><clause id="id452fb60380074a8aaf54a3bf4ad8e6c4"><enum>(iii)</enum><text>that is within a National Monument as of the date of the enactment of the <short-title>Emergency Fuel Reduction Act of 2014</short-title>.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
