	<legis-body><section id="idAEF0DA3BCEC6480085CF47B0939794D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local Empowerment Act</short-title></quote>.</text></section><section id="idC03B7E57484F4BF780674D943C8DD76A"><enum>2.</enum><header>Consolidated and high performing metropolitan planning organizations</header><subsection id="id08115D93414D478D81377E5EBA3C1F0E"><enum>(a)</enum><header>Highways</header><paragraph id="id184CCA26A9154559A0ECBB03413FA798"><enum>(1)</enum><header>Apportionment</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/104">Section 104(d)(2)(A)</external-xref> of title 23, United States Code, is amended—</text><subparagraph id="idE92BC6EB7C274D02B027D7DEB6EB66C1"><enum>(A)</enum><text>in
			 clause (i), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id481693ADEA6C4D8ABACC58803D72C2AD"><enum>(B)</enum><text>by redesignating clause (ii) as clause (iii); and</text></subparagraph><subparagraph id="idBEC848E84C874D0F919DD6E7398427C6"><enum>(C)</enum><text>by inserting after clause (i) the following:</text><quoted-block display-inline="no-display-inline" id="id683ABDCEE3254B83937A4604BF17E82D" style="OLC"><clause id="id1D35EEB0BCF24D5C9E395CF80AC6EDA2"><enum>(ii)</enum><text>prioritizes the needs of high performing metropolitan planning organizations (as designated by the
			 Secretary under section
			 134(r) or <external-xref legal-doc="usc" parsable-cite="usc/49/5303">section 5303(r)</external-xref> of title 49); and</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id01DDD9AE5CE5442EA723479380F98D96"><enum>(2)</enum><header>Surface transportation program</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/133">Section 133</external-xref> of title 23, United States Code, is amended—</text><subparagraph id="id2DFBF4E91DB04D30A49A070EF51A0039"><enum>(A)</enum><text>in subsection (d), by striking paragraph (1) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id696D5D29E36046108F09C4C7D717E13F" style="OLC"><paragraph id="idF085496AD3B34C04B3B6066668075301"><enum>(1)</enum><header>Calculation</header><text>Of the funds apportioned to a State under section 104(b)(2)—</text><subparagraph id="id6FDAB2B2EAE24E3A825B77EED6459659"><enum>(A)</enum><text>50 percent for a fiscal year shall be
			 obligated under this section, in proportion to their relative shares of
			 the population of the State—</text><clause id="idA67C6CE726C94256BCDBD48E116C1031"><enum>(i)</enum><text>in urbanized areas of the State with an
			 urbanized area population of more than 200,000;</text></clause><clause id="id23A00F5076644999A6470FCACFB5B4D8"><enum>(ii)</enum><text>in urban areas of the
			 State with an urban area population of not fewer than 5,000 and not more
			 than 200,000; and</text></clause><clause id="id2DCDCDBFAC224CD4A3255A8022C22352"><enum>(iii)</enum><text>in areas of
			 the State with an area population of fewer than 5,000;</text></clause></subparagraph><subparagraph id="idDFB661B529BF442BB1088A760F7A89F3"><enum>(B)</enum><text>25 percent for a fiscal year may be obligated under this section in any area of the State;</text></subparagraph><subparagraph id="id65854B9F3EBE4BA2AD7555D3A4A71755"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id0B4F805728FF45808F6B8C0BB5297DE2"><enum>(i)</enum><text>25 percent for a fiscal year shall be obligated under this section, in proportion to their relative
			 shares of the population of the State, in urbanized areas described in
			 subparagraph (A)(i) that have a high performing metropolitan
			 planning organization (as designated by the Secretary under section
			 134(r) or <external-xref legal-doc="usc" parsable-cite="usc/49/5303">section 5303(r)</external-xref> of title 49); and</text></clause><clause id="id4103CD30BF204660A6F0E02F265E5F4F" indent="up1"><enum>(ii)</enum><text>the amount of the funds obligated to each urbanized area described in clause (i) shall—</text><subclause id="idC49241DEFF8C410C915EE089997B70A3"><enum>(I)</enum><text>be equal to 50 percent of the amount of the funds obligated to the urbanized area under
			 subparagraph (A)(i); and</text></subclause><subclause id="idB3D91C35A25B4620AFDF484E31FA2BA8"><enum>(II)</enum><text>be in addition to the funds obligated to the urbanized area under subparagraph (A)(i); and</text></subclause></clause></subparagraph><subparagraph id="idE8ACFA22F221413281733B506AC40077"><enum>(D)</enum><text>any funds not obligated under subparagraph (C) for a fiscal year shall be obligated under this
			 section, in proportion to the relative shares of the population of the
			 State, in any area of the State
			 under subparagraph (B).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id01CD568A66F349B495BEAE0F636416F2"><enum>(B)</enum><text>in subsection (f)—</text><clause id="id606384E284ED4569A7D2F9F22AB815DC"><enum>(i)</enum><text>in paragraph (1)—</text><subclause id="id484BD7A575894C6DAC686C4C4304C21D"><enum>(I)</enum><text>by striking <quote>A State</quote> and inserting <quote>Except as provided in paragraph (2), a State</quote>;</text></subclause><subclause id="id8FC91E0376D34C74A858EB3DCFF32D31"><enum>(II)</enum><text>by striking <quote>section 104(b)(3)</quote> and inserting <quote>section 104(b)(2)</quote>; and</text></subclause><subclause id="idC775B4E7CCF343C9B2D950C8D96E8E00"><enum>(III)</enum><text>by striking <quote>2011 through 2014</quote> and inserting <quote>2015 through 2018</quote>;</text></subclause></clause><clause id="id4B0DA33207544DBA916942948BA69066"><enum>(ii)</enum><text>by redesignating paragraph (2) as paragraph (3);</text></clause><clause id="idCB34266C8C054251873782DC07E66B48"><enum>(iii)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="id2E69AD50E891428EA7F0188015CFF2D3" style="OLC"><paragraph id="id8396924498164248A0AA5A854F6168C6"><enum>(2)</enum><header>High performing metropolitan planning organizations</header><subparagraph id="idA4372E4D6F334A9388678D7717BA6F79"><enum>(A)</enum><header>In general</header><text>A State that is
			 required to obligate in an urbanized area under subsections (d)(1)(A)(i)
			 and (d)(1)(C) funds apportioned to the State under section 104(b)(2) shall
			 make available to the urbanized area for each fiscal year during the
			 period described in paragraph (1) an amount of obligation authority
			 distributed to the State
			 for Federal-aid highways and highway safety construction programs for
			 use in the area that is equal to the amount obtained by multiplying—</text><clause id="id48C46373C87D47C2A1EB9648C6C80A2E"><enum>(i)</enum><text>the amount of funds that the State is required to obligate in the
			 area under subsections (d)(1)(A)(i) and (d)(1)(C); and</text></clause><clause id="id212A03A1BCDD42398F8777FAF405AC12"><enum>(ii)</enum><text>the ratio described in paragraph (1)(B).</text></clause></subparagraph><subparagraph id="idBAAD7AB14C8F45A0B81ECA695F522F68"><enum>(B)</enum><header>Availability</header><text>The obligation authority described in subparagraph (A) shall
			 remain available for a period of 4 fiscal years.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idFB64D06ADDF44AC5BAF86ED4E3A347F0"><enum>(iv)</enum><text>in paragraph (3) (as so redesignated), by striking <quote>paragraph (1)</quote> and inserting <quote>paragraphs (1) and (2)</quote>; and</text></clause></subparagraph><subparagraph id="id489CD2102AA54793AAB011FACF264960"><enum>(C)</enum><text>in subsection (h)(1), by striking <quote>of fiscal years 2013 through 2014</quote> and inserting <quote>fiscal year</quote>.</text></subparagraph></paragraph><paragraph id="id549BC4FE5505440FBB9B69FEE01E3757"><enum>(3)</enum><header>Metropolitan transportation planning</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/134">Section 134</external-xref> of title 23, United States Code, is amended—</text><subparagraph id="id62398A03926E4C65B5693DD359C9EE74"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><clause id="idDBE7984A262842F6867E019D73C284E8"><enum>(i)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (7) as paragraphs (2) through (8), respectively; and</text></clause><clause id="id600228C4259D422D9FF2F023D0D884DB"><enum>(ii)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block display-inline="no-display-inline" id="id301B90C1909E4B838AEAE26A255FDF03" style="OLC"><paragraph id="idDEC6F0FAEBF54DA0BFE8F097D919B598"><enum>(1)</enum><header>Consolidated metropolitan planning organization</header><text>The term <term>consolidated metropolitan planning organization</term> means a sole metropolitan planning organization that serves a metropolitan statistical area.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id60CBDADC16AC454BA7CB26963971AE82"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (d), by striking paragraph (6) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idAD1D24D4E6F8422EBE69ED6DC56873B9" style="OLC"><paragraph id="id65D52D21572D4A36BF930455BD3178EF"><enum>(6)</enum><header>Consolidation of metropolitan planning organizations in urbanized areas</header><subparagraph id="idB09DC6FD590C4FA299694FDCCC646D03"><enum>(A)</enum><header>Limitation on new metropolitan planning organizations</header><text display-inline="yes-display-inline">A metropolitan planning organization shall not be designated—</text><clause id="id7976C91F50DA43E4A6B67AD59E6C6726"><enum>(i)</enum><text display-inline="yes-display-inline">within a metropolitan statistical area if another metropolitan planning organization already exists
			 within the boundaries of the metropolitan statistical area; or</text></clause><clause id="id98F0E757AD5048F8A2E1D7B96DC8F70D"><enum>(ii)</enum><text display-inline="yes-display-inline">outside the boundaries of a metropolitan statistical area.</text></clause></subparagraph><subparagraph id="id98C3673B7477439C9DF1C42C3FA0E559"><enum>(B)</enum><header>Multiple existing metropolitan planning organizations</header><text>If more than 1 existing metropolitan planning organizations are designated within a metropolitan
			 statistical area—</text><clause id="id1588F4DD56B44C8DB53604B11920EC78"><enum>(i)</enum><text>each metropolitan planning organization may—</text><subclause id="id430FCF8137F84FDEBEAA05B4E9DE862C"><enum>(I)</enum><text>retain the designation as a metropolitan planning organization; or</text></subclause><subclause id="idC3D5A39DD50E4457B7559002744474F2"><enum>(II)</enum><text>agree to be consolidated with the other metropolitan planning organizations;</text></subclause></clause><clause id="idD189B7D3564F4B608845C4EA1D637720"><enum>(ii)</enum><text>the existing metropolitan planning organizations and the applicable Governors may—</text><subclause id="id4A8FDC819DAE45A1B43808D370B02C0E"><enum>(I)</enum><text>beginning on January 1, 2022, and once every 10 years thereafter, revisit the agreement described
			 in clause (i)(I); and</text></subclause><subclause id="idCC6D5CD75E574AB39D98F5983B407A70"><enum>(II)</enum><text>submit to the Secretary a justification of the continued necessity of that agreement; and</text></subclause></clause><clause id="idB33B8EA9C40F4660A549EC85B5FC2384"><enum>(iii)</enum><text>each metropolitan planning organization shall cooperate with every other metropolitan planning
			 organization to—</text><subclause id="id91F894FA242D4923B51FBED822A080DD"><enum>(I)</enum><text>develop a single transportation improvement plan and a single long-range plan to be used by each
			 metropolitan planning organization when developing individual plans of the
			 metropolitan planning organization; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idC843662C9CC640DDBFEC9AE1E1C2926E"><enum>(II)</enum><text>establish a single set of performance targets that address the performance measures described in
			 section 150(c) to be used in developing individual performance targets of
			 the metropolitan planning organization in accordance with subsection
			 (h)(2)(B).</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idC02307B3682A449197855958D933D633"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id125443DEF9F6475487EF14503A9C02B4" style="OLC"><subsection id="idE055E27F595D4DC0ADE2E8E9F8D83145"><enum>(r)</enum><header>High performing metropolitan planning organizations</header><paragraph id="id52BB9BC3A67D451C8021172AC01EAE3C"><enum>(1)</enum><header>In general</header><text>A metropolitan planning organization designated for  an urbanized area with a population of more
			 than 200,000 individuals may request that the Secretary designate the
			 metropolitan planning organization as a high performing metropolitan
			 planning organization.</text></paragraph><paragraph id="idAB03401CD52B4F08A1BDEB6255367A4B"><enum>(2)</enum><header>Criteria</header><text>In making a designation under paragraph (1), the Secretary shall consider—</text><subparagraph id="idA48292B320894574939B24F514135B19"><enum>(A)</enum><text>the extent to which the metropolitan planning organization has an equitable and regional approach
			 to decisionmaking;</text></subparagraph><subparagraph id="id4F0BC13113BB479EB78902BA53D4E522"><enum>(B)</enum><text>the extent to which the metropolitan planning organization has incorporated the performance targets
			 established pursuant to section 150 and sections 5303(h)(2), 5326(c) and
			 5329(d) of title 49 into the planning process;</text></subparagraph><subparagraph id="id6B4E1AF43D8C484786AE72960BB8DD37"><enum>(C)</enum><text>whether the metropolitan planning organization is a consolidated metropolitan planning
			 organization;</text></subparagraph><subparagraph id="idE17B85097FE74C2BA7F95C7F32123B30"><enum>(D)</enum><text>if the metropolitan planning organization is not a consolidated metropolitan planning organization,
			 the extent to which the metropolitan planning organization is coordinating
			 with all other metropolitan planning organizations designated for the same
			 metropolitan statistical area;</text></subparagraph><subparagraph id="id783772D44C964406BD4617E66C4F78AB"><enum>(E)</enum><text>the technical capacity of the metropolitan planning organization; and</text></subparagraph><subparagraph id="idF017BCF11B4446808F46BDA62C6FC77E"><enum>(F)</enum><text>any other guidance established by the Secretary.</text></subparagraph></paragraph><paragraph id="idB543F50B515747BA9240B18E472AB414"><enum>(3)</enum><header>Review</header><text>A designation under paragraph (1) shall be effective for the period beginning on the date on which
			 the designation is made and ending on the date that is 10 years after the
			 date on which the designation is made.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id8E8ED771D6784D9E8BC9C22C1BC6CC65"><enum>(4)</enum><header>Transportation alternatives</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/213">Section 213(c)</external-xref> of title 23, United States Code, is amended by striking paragraph (1) and inserting
			 the following:</text><quoted-block display-inline="no-display-inline" id="idB81CBD337F3C4674A3A0897FCEA20DA1" style="OLC"><paragraph id="idB48789DD7E07434AB42D987862F25851"><enum>(1)</enum><header>Calculation</header><text>Of the funds reserved in a State under this section—</text><subparagraph id="id72C4820863954FEB989DE6AEBC750410"><enum>(A)</enum><text>50 percent for a fiscal year shall be
			 obligated under this section to any eligible entity in proportion to their
			 relative shares of
			 the population of the State—</text><clause id="id763C81B4173344A2BE34306578BA1F95"><enum>(i)</enum><text>in urbanized areas of the State with an
			 urbanized area population of more than 200,000;</text></clause><clause id="id528F41F8966943D6A14D42DDDE436AC9"><enum>(ii)</enum><text>in urban areas of the
			 State with an urban area population of not fewer than 5,000 and not more
			 than 200,000; and</text></clause><clause id="idAC6AE3FBA162456BA48557DA5D58A5BC"><enum>(iii)</enum><text>in areas of
			 the State with an area population of fewer than 5,000;</text></clause></subparagraph><subparagraph id="idFF57353471014742B148C530094F8518"><enum>(B)</enum><text>25 percent for a fiscal year may be obligated under this section in any area of the State;</text></subparagraph><subparagraph id="id97E276059DFC402D9DAD647C0000EECF"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id371775D3EBEB4BE7B2823BBD4BF80EDC"><enum>(i)</enum><text>25 percent for a fiscal year shall be obligated under this section in urbanized areas described in
			 subparagraph (A)(i) that have a high performing metropolitan
			 planning organization (as designated by the Secretary under section
			 134(r) or <external-xref legal-doc="usc" parsable-cite="usc/49/5303">section 5303(r)</external-xref> of title 49); and</text></clause><clause id="id23ACDAF149AE40ADB1438171DFF7D2F0" indent="up1"><enum>(ii)</enum><text>the amount of the funds obligated to each urbanized area described in clause (i) shall—</text><subclause id="id95A527B899FA4506BD2D5CC6C4346AA8"><enum>(I)</enum><text>be equal to 50 percent of the amount of the funds obligated to the urbanized area under
			 subparagraph (A)(i); and</text></subclause><subclause id="idB4327C7475104A22BF9BF4A7C1BC02AA"><enum>(II)</enum><text>be in addition to the funds obligated to the urbanized area under subparagraph (A)(i); and</text></subclause></clause></subparagraph><subparagraph id="idA2535F42209B4A939E3DAD57FCE4B443"><enum>(D)</enum><text>any funds not obligated under subparagraph (C) for a fiscal year shall be obligated under this
			 section in any area of the State
			 under subparagraph (B).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idF1AC83970011408D88C1A9994E80AABC"><enum>(b)</enum><header>Transportation</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/5303">Section 5303</external-xref> of title 49, United States Code, is amended—</text><paragraph id="id99BF334C57BA46DDBF54D0AABA4E2EA7"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph id="idC873654F4C57415A824D904458C9BDF5"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (7) as paragraphs (2) through (8), respectively; and</text></subparagraph><subparagraph id="idD8CF03C24EB549CD8A3B8C1D072FDC1C"><enum>(B)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text><quoted-block display-inline="no-display-inline" id="idBFF1384997DF4ED89420EA20A23A50C1" style="OLC"><paragraph id="id455B707E089D41558ED6A0D091CA834E"><enum>(1)</enum><header>Consolidated metropolitan planning organization</header><text>The term <term>consolidated metropolitan planning organization</term> means a single metropolitan planning organization that serves a metropolitan statistical area.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD5614CEC9DFF470AA202BEDC510E2705"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d), by striking paragraph (6) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idB4028DB6D0634A96AB2718BEFBDCC937" style="OLC"><paragraph id="id65B0C9D18CD74D8D8861772E2B572AE1"><enum>(6)</enum><header>Consolidation of metropolitan planning organizations in urbanized areas</header><subparagraph id="idFD5D329616E64E3A886946CB714A12F1"><enum>(A)</enum><header>Limitation on new metropolitan planning organizations</header><text display-inline="yes-display-inline">A metropolitan planning organization shall not be designated—</text><clause id="idADC6C9CFA71A476495BB1A002DE33513"><enum>(i)</enum><text display-inline="yes-display-inline">within a metropolitan statistical area if another metropolitan planning organization already exists
			 within the boundaries of the metropolitan statistical area; or</text></clause><clause id="id8217BFD6F2514B64A6A6E13EFCBA500A"><enum>(ii)</enum><text display-inline="yes-display-inline">outside the boundaries of a metropolitan statistical area.</text></clause></subparagraph><subparagraph id="idC0732F44094C4230AABE5AAFC229828F"><enum>(B)</enum><header>Multiple existing metropolitan planning organizations</header><text>If more than 1 existing metropolitan planning organizations are designated within a metropolitan
			 statistical area—</text><clause id="idE009B1348E1749CC9A1F2C3AA6CC3B38"><enum>(i)</enum><text>each metropolitan planning organization may—</text><subclause id="id80BFE715BE5C4EF9A9DE7BC2D627D0D3"><enum>(I)</enum><text>retain the designation as a metropolitan planning organization; or</text></subclause><subclause id="idCC69D4E399DA4EF79B03F8F66FB6CBB2"><enum>(II)</enum><text>agree to be consolidated with the other metropolitan planning organizations;</text></subclause></clause><clause id="id27527011E8C844C4B24658BFF3C9889F"><enum>(ii)</enum><text>the existing metropolitan planning organizations and the applicable Governors may—</text><subclause id="idE4F78C9E988644D19665DE571AE7DF07"><enum>(I)</enum><text>beginning on January 1, 2022, and once every 10 years thereafter, revisit the agreement described
			 in clause (i)(II); and</text></subclause><subclause id="id4B3FEEB6E4C64FE29D160C5663A550C8"><enum>(II)</enum><text>submit to the Secretary a justification of the continued necessity of that agreement; and</text></subclause></clause><clause id="idF9B71BBE09EB41BC9E7C4DE64717C73C"><enum>(iii)</enum><text>each metropolitan planning organization shall cooperate with every other metropolitan planning
			 organization to—</text><subclause id="id57D461B6CBE74D719A61A6817F4E76A0"><enum>(I)</enum><text>develop a single transportation improvement plan and a single long-range plan to be used by each
			 metropolitan planning organization when developing individual plans of the
			 metropolitan planning organization; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idEFC439F1C80241C883C0CE07B614D62F"><enum>(II)</enum><text>establish a single set of performance targets that address the performance measures described in
			 <external-xref legal-doc="usc" parsable-cite="usc/23/150">section 150(c)</external-xref> of title 23 to be used in developing individual performance
			 targets of the metropolitan planning organization in accordance with
			 subsection (h)(2)(B) and sections 5326(c)(2) and 5329(d).</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7122136C829D4EC0B3044E8E1BE10C27"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idBEDB0C8D073F4A729A8CDFBC64B189F5" style="OLC"><subsection id="id52CED065C002443EB334CD80BBE19A8D"><enum>(r)</enum><header>High performing metropolitan planning organizations</header><paragraph id="id26F3B460555C4936B766C5259CD528BF"><enum>(1)</enum><header>In general</header><text>A metropolitan planning organization designated for  an urbanized area with a population of more
			 than 200,000 individuals may request that the Secretary designate the
			 metropolitan planning organization as a high performing metropolitan
			 planning organization.</text></paragraph><paragraph id="id7A986A5D56D049E9B5BBE4B99A3DD9B2"><enum>(2)</enum><header>Criteria</header><text>In making a designation under paragraph (1), the Secretary shall consider—</text><subparagraph id="id08CDE641BFAD42B6A118E5E2EA3E56FC"><enum>(A)</enum><text>the extent to which the metropolitan planning organization has an equitable and regional approach
			 to decisionmaking;</text></subparagraph><subparagraph id="id776F98A7D3B148028367DCC580F66206"><enum>(B)</enum><text>the extent to which the metropolitan planning organization has incorporated the performance targets
			 established pursuant to <external-xref legal-doc="usc" parsable-cite="usc/23/150">section 150</external-xref> of title 23 and sections 5303(h)(2),
			 5326(c) and
			 5329(d) into the planning process;</text></subparagraph><subparagraph id="idAE15225E97C349B58E989A409BD51F7F"><enum>(C)</enum><text>whether the metropolitan planning organization is a consolidated metropolitan planning
			 organization;</text></subparagraph><subparagraph id="id39B2151E7A864714BC499A2EE2F90203"><enum>(D)</enum><text>if the metropolitan planning organization is not a consolidated metropolitan planning organization,
			 the extent to which the metropolitan planning organization is coordinating
			 with all other metropolitan planning organizations designated for the same
			 metropolitan statistical area;</text></subparagraph><subparagraph id="idA90051CEA5AD4026AD0446CE107FBD1A"><enum>(E)</enum><text>the technical capacity of the metropolitan planning organization; and</text></subparagraph><subparagraph id="idF01924F075E643ACB80E3B2E4F7640F0"><enum>(F)</enum><text>any other guidance established by the Secretary.</text></subparagraph></paragraph><paragraph id="idD7ADF775E1F8473889DBFD184323EE09"><enum>(3)</enum><header>Review</header><text>A designation under paragraph (1) shall be effective for the period beginning on the date on which
			 the designation is made and ending on the date that is 10 years after the
			 date on which the designation is made.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body>
