		<official-title>To promote competition and help consumers save money by giving them the freedom to choose where
			 they buy prescription pet medications, and for other purposes.</official-title>

		<section id="H3AE87BA4607A454BA923A71A3F09A74B" section-type="section-one">
			<enum>1.</enum>
			<header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness to Pet Owners Act of 2014</short-title></quote>.</text>
		</section><section commented="no" id="H73FCC7B157C24B589495161E479CC734">
			<enum>2.</enum>
			<header>Applicability</header>
			<text display-inline="no-display-inline">This Act shall only apply to medication for a domesticated household animal that the Federal
			 Government prevents consumers from purchasing without a prescription.</text>
		</section><section id="H2AF2FF8D9064492E98F2CA91FCC12A96">
			<enum>3.</enum>
			<header>Rules on veterinary prescriptions</header>
			<text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Federal Trade Commission
			 shall promulgate rules in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United
			 States Code, that include the following requirements with regard to a
			 veterinary prescription:</text>
			<paragraph id="HBE4E93165E5B4974BD37687BA6A7BB14">
				<enum>(1)</enum>
				<header>In general</header>
				<text>A requirement that the prescriber of an animal drug shall—</text>
				<subparagraph id="H0AACB555E3FA4F7CAAB9E5F22FDBC8B8">
					<enum>(A)</enum>
					<text>whether or not requested by the pet owner, provide to the pet owner, before offering to fill or
			 dispensing, a veterinary prescription, a copy of the veterinary
			 prescription, including by electronic or other means;</text>
				</subparagraph><subparagraph id="HA1F46833DB534CA395528A12D532F4FE">
					<enum>(B)</enum>
					<text>provide a copy of the prescription by electronic or other means consistent with applicable State
			 law, if requested by a pharmacy or any other person designated to act on
			 behalf of the pet owner; and</text>
				</subparagraph><subparagraph id="id0A05A950A6FA48B494037FC4DF768824"><enum>(C)</enum><text>upon request by a pharmacy or any other person designated to act on behalf of the pet owner, verify
			 the prescription.</text></subparagraph></paragraph><paragraph id="HE1D9827179B542638AD10EF4FB1E597A">
				<enum>(2)</enum>
				<header>Purchase, payment, and waiver</header>
				<text>A requirement that the prescriber of an animal drug—</text>
				<subparagraph id="H5131F6BF77254342A19B4B19B1298C1A">
					<enum>(A)</enum>
					<text>may not—</text>
					<clause id="HD799B65B4C9645ADA629FB8D0EA3A40D">
						<enum>(i)</enum>
						<text>require purchase of the animal drug for which the veterinary prescription was written from the
			 prescriber or from another person as a condition of providing a copy of
			 the veterinary prescription or verifying such prescription under paragraph
			 (1);</text>
					</clause><clause id="H4F7F311AAB394DBDB4975512EA8C602D">
						<enum>(ii)</enum>
						<text>require payment in addition to, or as part of, the fee for an examination and evaluation as a
			 condition of providing a copy of the veterinary prescription or verifying
			 such prescription under paragraph (1); or</text>
					</clause><clause id="H341E8E57F6AF49F1B501D7700FD5C63D">
						<enum>(iii)</enum>
						<text>require the pet owner to sign a waiver or disclaim liability, or deliver to the pet owner a notice
			 waiving or disclaiming liability of the prescriber for the accuracy of the
			 veterinary prescription, as a condition of providing a copy of such
			 prescription or verifying such prescription under paragraph (1); and</text>
					</clause></subparagraph><subparagraph commented="no" id="H6B95119F4179453597D707B76B695098">
					<enum>(B)</enum>
					<text>may require payment of fees for an examination and evaluation before providing a veterinary
			 prescription, but only if the prescriber requires immediate payment in the
			 case of an examination that reveals no requirement for an animal drug.</text>
				</subparagraph></paragraph></section><section id="HC1FF3B756A4B4BF5821B6D5933A7C2C3">
			<enum>4.</enum>
			<header>Enforcement</header><subsection id="id5419A95D9B354790A4EA2D332847D8EF"><enum>(a)</enum><header>Unfair or deceptive act or practice</header><text display-inline="yes-display-inline">A violation of a rule prescribed pursuant to section 3 of this Act shall be treated as a violation
			 of a rule defining an unfair or deceptive act or practice prescribed under
			 section 18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C.
			 57a(a)(1)(B)).</text></subsection><subsection id="idC43800F31C0A4BD18ED617CC40E14C96"><enum>(b)</enum><header>Powers of Commission</header><paragraph id="idF39B6DC1D6BB4FE0B2E2848C3339DCD5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Trade Commission shall enforce this Act in the
			 same manner, by the same means, and with the same jurisdiction as though
			 all applicable terms and provisions of the Federal Trade Commission Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>)
			 were incorporated into and made a part of this Act.</text>
				</paragraph><paragraph id="idC90724E2ED2D40339962ECC5FD905569"><enum>(2)</enum><header>Privileges and immunities</header><text>Any person who violates a rule prescribed pursuant to section 3 of this Act shall be subject to the
			 penalties and entitled to the privileges and immunities provided in the
			 Federal Trade Commission Act  (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></paragraph></subsection></section><section id="H91958418BE484708900AB8937AC666FF">
			<enum>5.</enum>
			<header>Definitions</header>
			<text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H03BE304012534F59B5F840AA27B2087D">
				<enum>(1)</enum>
				<header>Animal drug</header>
				<text>The term <term>animal drug</term> means a drug intended to be administered to an animal that may not be dispensed without a
			 prescription.</text>
			</paragraph><paragraph id="H876BA08016744F309C9322CF964A5CA8">
				<enum>(2)</enum>
				<header>Domesticated household animal</header>
				<text>The term <term>domesticated household animal</term> means a companion animal permitted under applicable State and local law to be kept in a home for
			 noncommercial purposes.</text>
			</paragraph><paragraph id="H2383255EB46C44969AECC5A4E240B590">
				<enum>(3)</enum>
				<header>Pet owner</header>
				<text>The term <term>pet owner</term> means the legal owner of a domesticated household animal or a person designated by such owner to
			 present such animal to the prescriber for care.</text>
			</paragraph><paragraph id="HA4F54989EACF46D2B8B1A2B5B03C3F4F">
				<enum>(4)</enum>
				<header>Prescriber</header>
				<text>The term <term>prescriber</term> means a health care practitioner who is licensed to practice veterinary medicine or other person
			 permitted under State law to issue prescriptions for animal drugs.</text>
			</paragraph><paragraph id="H1FB0684448FE48AA89D76FB115047639">
				<enum>(5)</enum>
				<header>Veterinary prescription</header>
				<text>The term <term>veterinary prescription</term>—</text>
				<subparagraph id="HEA688AA70D014347938D7954E80C0EBE">
					<enum>(A)</enum>
					<text>means a written, oral, or electronic order from a prescriber authorizing the dispensing of an
			 animal drug for use by a domesticated household animal and normally
			 administered to the animal by its owner, issued in accordance with State
			 and Federal law; and</text>
				</subparagraph><subparagraph id="HE95A97409C8A40C6BCCE5D6A7C6C36B3">
					<enum>(B)</enum>
					<text>does not include an animal drug administered by the veterinarian in the course of providing acute
			 care.</text>
