		  <quote><short-title>Runaway and Homeless Youth and Trafficking Prevention Act</short-title></quote>.</text></section><section changed="deleted" committee-id="SSJU00" id="idf9d2478990c44748a61031ab7689e0e4" reported-display-style="strikethrough"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise specifically provided, whenever in this Act an amendment or repeal is expressed
			 in terms of an amendment to, or repeal of, a provision, the amendment or
			 repeal shall be considered to be made to a provision of the Runaway and
			 Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5701">42 U.S.C. 5701 et seq.</external-xref>).</text></section><section changed="deleted" committee-id="SSJU00" id="idED412FB1B37148559E423052E844F85C" reported-display-style="strikethrough"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Section 302 (<external-xref legal-doc="usc" parsable-cite="usc/42/5701">42 U.S.C. 5701</external-xref>) is amended—</text><paragraph id="idBBEAD15679E14663B578D921403E1FE0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>age, gender, and culturally and</quote> before <quote>linguistically appropriate</quote>;</text></paragraph><paragraph id="id0FD11E29BC7D409C8C769B4007BB0611"><enum>(2)</enum><text>in paragraph (4), by striking <quote>outside the welfare system and the law enforcement system</quote>  and inserting <quote>, in collaboration with public assistance systems, the law enforcement system, and the child
			 welfare system</quote>;</text></paragraph><paragraph id="idE5E958A487CF4AC8B5DB13F253EC7BD1"><enum>(3)</enum><text>in paragraph (5)—</text><subparagraph id="id8833912C301A493B85522EBCBEAC3A1C"><enum>(A)</enum><text>by inserting <quote>a safe place to live and</quote> after <quote>youth need</quote>; and</text></subparagraph><subparagraph id="id3150CD59D14D41E39B2EF211B427F1D6"><enum>(B)</enum><text>by striking <quote>and</quote> at the end;</text></subparagraph></paragraph><paragraph id="idF93670A11B39475F9F1863CEEE891366"><enum>(4)</enum><text>in paragraph (6), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id4C8E4195B00F48C2AF7507323D8BB65A"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id2FBA01458E1B495698197CD799C15549" reported-display-style="strikethrough" style="OLC"><paragraph id="id4E3F443BB27B49A5B58F826ADC9E37DC"><enum>(7)</enum><text>runaway and homeless youth are at a high risk of becoming victims of sexual exploitation and
			 trafficking in persons.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section changed="deleted" committee-id="SSJU00" id="id6CC2EA94894A42B5A7073EEAEB95CECD" reported-display-style="strikethrough"><enum>4.</enum><header>Basic center grant program</header><subsection id="id459704c9669f42b2b411d992e2ba8603"><enum>(a)</enum><header>Grants for centers and services</header><text>Section 311(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/5711">42 U.S.C. 5711(a)</external-xref>) is amended—</text><paragraph id="id534d2b0eb60c455996a9c3f2f6ebd57d"><enum>(1)</enum><text>in paragraph (1), by striking <quote>services</quote> and all that follows through the period and inserting <quote>safe shelter and services, including trauma-informed services, for runaway and homeless youth and,
			 if appropriate,
			 services for the families of such youth, including (if appropriate)
			 individuals identified by such youth as family.</quote>; and</text></paragraph><paragraph id="id3a541cdd489e434288b78c02d1e6eefa"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="idD08A73EE7720457FB33B17F815CA25D0"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>mental health,</quote>;</text></subparagraph><subparagraph id="id08f1a95a39fa49fe9320d1ef7bda10e7"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="idE95988B67FBB410FA6DA65DCA7FDCCA9"><enum>(i)</enum><text>in clause (i), by striking <quote>21 days; and</quote> and inserting <quote>30 days;</quote>;</text></clause><clause id="id9500953B1B364848A75D88AB454C4588"><enum>(ii)</enum><text>in clause (ii)—</text><subclause id="ide67f07e5c5664df083fd0e31df32d129"><enum>(I)</enum><text>by inserting <quote>age, gender, and culturally and linguistically appropriate</quote> before <quote>individual</quote>;</text></subclause><subclause id="id52551FBE0F2B4B04999790FED6998BB9"><enum>(II)</enum><text>by inserting <quote>, as appropriate,</quote> after <quote>group</quote>; and</text></subclause><subclause id="idb2ea959f89334d9aa543b8e04806778b"><enum>(III)</enum><text>by striking <quote>as appropriate</quote> and inserting <quote>including (if appropriate) counseling for individuals identified by such youth as family</quote>; and</text></subclause></clause><clause id="idBFAF9B2355B542248E36CD42690AC403"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id55A94453CE6A4BF1A7852EA8758C41F5" reported-display-style="strikethrough" style="OLC"><clause id="id90749A0F44A64CE792A162AD7D81A3B1"><enum>(iii)</enum><text>suicide prevention services; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id639d3b452505409193426cea16e4b9b9"><enum>(C)</enum><text>in subparagraph (C)—</text><clause id="id73A92F9929354175B99DCC8EB52A661B"><enum>(i)</enum><text>in clause (ii), by inserting <quote>age, gender, and culturally and linguistically appropriate</quote> before <quote>home-based services</quote>;</text></clause><clause id="idFEC522695C944753AC0BB76FC19DD4ED"><enum>(ii)</enum><text>in clause (iii), by striking <quote>and</quote> at the end;</text></clause><clause id="id657E97E1D43842EDA229876D03B0BC2A"><enum>(iii)</enum><text>in clause (iv), by striking <quote>diseases.</quote> and inserting <quote>infections;</quote>; and</text></clause><clause id="id7EF62E9892B34CE48C2446F0AA91E5D3"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id963395F49E50486B9EF63F063622B3AF" reported-display-style="strikethrough" style="OLC"><clause id="id10b85a51aa2d414eb2843fa8b84e24f1"><enum>(v)</enum><text>trauma-informed and gender-responsive services for runaway or homeless youth, including such youth
			 who are victims of trafficking in persons or sexual exploitation; and</text></clause><clause id="id179FAA4C86F04D608566AE2F009646A1"><enum>(vi)</enum><text>an assessment of family engagement in support and reunification (if reunification is appropriate),
			 interventions, and services for parents or legal guardians of such youth,
			 or (if appropriate) individuals identified by such youth as family.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="idca6b136321e94cd48df8c26fee99f65f"><enum>(b)</enum><header>Eligibility; plan requirements</header><text display-inline="yes-display-inline">Section 312 (<external-xref legal-doc="usc" parsable-cite="usc/42/5712">42 U.S.C. 5712</external-xref>) is amended—</text><paragraph id="id68b902270939400eaff35e20cf4cdd50"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id4693837717BF450D8C134DF2DD29DCFE"><enum>(A)</enum><text>in paragraph (5), by inserting <quote>, or (if appropriate) individuals identified by such youth as family,</quote> after <quote>parents or legal guardians</quote>;</text></subparagraph><subparagraph id="ide16f41df18dd47beb536a6b0e5392391"><enum>(B)</enum><text>in paragraph (6), by striking <quote>cultural minority and persons with limited ability to speak English</quote> and inserting <quote>cultural minority, persons with limited ability to speak English, and runaway or homeless youth who
			 are victims of trafficking in persons or sexual exploitation</quote>;</text></subparagraph><subparagraph id="id90862f7af4bb4c20a04c649aa0193e69"><enum>(C)</enum><text>by striking paragraph (7) and inserting the following:</text><quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idE604AC20564A42178E8A75BCD15F3D5D" reported-display-style="strikethrough" style="OLC"><paragraph id="idA8B026997884406696F5AF707033168D"><enum>(7)</enum><text>shall keep adequate statistical records profiling the youth and family members of such youth whom
			 the applicant serves, including demographic information on and the number
			 of—</text><subparagraph id="idDB05453A8788493E936044E95AE44934"><enum>(A)</enum><text>such youth who are not referred to out-of-home shelter services;</text></subparagraph><subparagraph id="id2CDC5531E48E403CB4E44C1E1AE97DDC"><enum>(B)</enum><text>such youth who are members of vulnerable or underserved populations;</text></subparagraph><subparagraph id="idC19418C9195E42FFB1321FC592DC6EF8"><enum>(C)</enum><text>such youth who are victims of trafficking in persons or sexual exploitation, disaggregated by—</text><clause id="idB4781ACEA5FD4D249979EACBE849E770"><enum>(i)</enum><text>such youth who have been coerced or forced into a commercial sex act, as defined in section 103 of
			 the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>);</text></clause><clause id="id2BD147C0955D46B2883F5B4127F077CE"><enum>(ii)</enum><text>such youth who have been coerced or forced into other forms of labor; and</text></clause><clause id="id2EB4A8F480CE4A95B3F8419EB3914339"><enum>(iii)</enum><text>such youth who have engaged in a commercial sex act, as so defined, for any reason other than by
			 coercion or force;</text></clause></subparagraph><subparagraph id="id7954BA6303E44BACADCD1643C766E2BE"><enum>(D)</enum><text>such youth who are pregnant or parenting;</text></subparagraph><subparagraph id="id85C8308B628C44AC91EC2B7A9E4F3D08"><enum>(E)</enum><text>such youth who have been involved in  the child welfare system; and</text></subparagraph><subparagraph id="id66FCC18C64F7409C85AB43F72577E8ED"><enum>(F)</enum><text>such youth who have been involved in the juvenile justice system;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id3B46E523C1D64F29BD6A94BEB93B2273"><enum>(D)</enum><text>by redesignating paragraphs (8) through (13) as paragraphs (9) through (14);</text></subparagraph><subparagraph id="id3E32ECD0C57245128F48F4050570F376"><enum>(E)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idED64D32F47654CC09BA4943061EB77AA" reported-display-style="strikethrough" style="OLC"><paragraph id="id0FAD1E45E3BC4E4F8CA6C920587D0D85"><enum>(8)</enum><text>shall ensure that—</text><subparagraph id="idB0A457A606754445AE5C8EA98C977869"><enum>(A)</enum><text>the records described in paragraph (7), on an individual runaway or homeless youth, shall not be
			 disclosed
			 without the consent of the individual youth and parent or legal guardian
			 of such youth, or (if appropriate) an individual identified by such youth
			 as family, to anyone other than another agency compiling statistical
			 records or a government agency involved
			 in the disposition of criminal charges against an individual runaway or
			 homeless youth; and</text></subparagraph><subparagraph id="id8DBF006586AF4E629DBADC05E5E97E60"><enum>(B)</enum><text>reports or other  documents based on the statistics described in paragraph (7) shall not disclose
			 the identity of any individual runaway or homeless youth;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="ida3b692eddd7445718bb0e1f16e3a6e3f"><enum>(F)</enum><text>in paragraph (9), as so redesignated, by striking <quote>statistical summaries</quote> and inserting <quote>statistics</quote>;</text></subparagraph><subparagraph id="id8953F46F596A4F00BC0ED1CB6B1DF00B"><enum>(G)</enum><text>in paragraph (13)(C), as so redesignated—</text><clause commented="no" id="idCB28D05BD5054DD2BC52D0C8D6E276D9"><enum>(i)</enum><text>by striking clause (i) and inserting:</text><quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idF0FA887B6D264B2D9B2BB640D6697A44" reported-display-style="strikethrough" style="OLC"><clause id="id36E16B6D04B84A1ABF8E4B3DBF9B3EE7"><enum>(i)</enum><text>the number and characteristics of runaway and homeless youth, and youth at risk of family
			 separation, who participate in the project, including such information on—</text><subclause id="id739D04252F9541ADA92B251DCA3C93D1"><enum>(I)</enum><text>such youth (including both types of such participating youth) who are victims of trafficking in
			 persons or sexual exploitation, disaggregated by—</text><item id="idFB5AF1934FEA4DC7B411280078F5DD7B"><enum>(aa)</enum><text>such youth who
			 have been coerced or forced into a commercial sex act, as defined in
			 section 103 of the Trafficking Victims Protection Act of 2000 (22 U.S.C.
			 7102);</text></item><item id="idF3FD139534D5452B84DF0510B67B6E58"><enum>(bb)</enum><text>such youth who
			 have been coerced or forced into other forms of labor; and</text></item><item id="idDFD8AEFDB61D416EB317A72AFBD317FA"><enum>(cc)</enum><text>such youth who
			 have engaged in a commercial sex act, as so defined, for any reason other
			 than by coercion or force;</text></item></subclause><subclause id="idCA285660E69C4FF1AF57EC33E2290D89"><enum>(II)</enum><text>such youth who are pregnant or parenting;</text></subclause><subclause id="idDC6F6CCFAC214C2EBEF5B8D702E88F5D"><enum>(III)</enum><text>such youth who have been involved in the child welfare system; and</text></subclause><subclause id="idFF5C305A92354780A55C6E941E833945"><enum>(IV)</enum><text>such youth who have been involved in the juvenile justice system; and</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id801C489C107448A480B1BE9467A7D152"><enum>(ii)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></clause></subparagraph><subparagraph id="id06E743EEC9EC445C96CB79C2EACC78C4"><enum>(H)</enum><text>in paragraph (14), as so redesignated, by striking the period and inserting <quote>for natural disasters, inclement weather, and mental health emergencies;</quote>; and</text></subparagraph><subparagraph id="id496897619ab54e748603b58bd08498c0"><enum>(I)</enum><text>by adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id60EAAD84CF4B4EEFB7B7F358EE2AAA1F" reported-display-style="strikethrough" style="OLC"><paragraph id="id8ACBE5AFD3264B82B5032F92A79EBA44"><enum>(15)</enum><text>shall provide age, gender, and culturally and
			 linguistically appropriate services to runaway and homeless youth; and</text></paragraph><paragraph id="id8FC9319020204A97BFC7219F7176FEFC"><enum>(16)</enum><text>shall assist youth in completing the Free Application for Federal Student Aid described in section
			 483 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id74e72c26432e4678bc6df9570f63b0e2"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="id057574f62dcc4bcbaa631f9816aea708"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id4C9C48F9EDEE4C9E8A08C6CE8E02DCD6"><enum>(i)</enum><text>by inserting <quote>age, gender, and culturally and linguistically appropriate</quote> after <quote>provide</quote>;</text></clause><clause id="id9F5831A787DA4BF99C0366B592BE8EB8"><enum>(ii)</enum><text>by striking <quote>families (including unrelated individuals in the family households) of such youth</quote> and inserting <quote>families of such youth (including unrelated individuals in the family households of such youth and,
			 if appropriate, individuals identified by such youth as family)</quote>; and</text></clause><clause id="idD682137FAD80456C8F12618F9CF8B739"><enum>(iii)</enum><text>by inserting <quote>suicide prevention,</quote> after <quote>physical health care,</quote>; and</text></clause></subparagraph><subparagraph id="id987e9763580d4476851a3775cc9f17c1"><enum>(B)</enum><text>in paragraph (4), by inserting <quote>, including training on trauma-informed and youth-centered care</quote> after <quote>home-based services</quote>.</text></subparagraph></paragraph></subsection><subsection id="id897301F75DEE4E7EA0752AFB0B68AF69"><enum>(c)</enum><header>Approval of applications</header><text>Section 313(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/5713">42 U.S.C. 5713(b)</external-xref>) is amended—</text><paragraph id="id1BF53C3B157A46A6892B974F83115475"><enum>(1)</enum><text>by striking <quote>priority to</quote> and all that follows through <quote>who</quote> and inserting <quote>priority to eligible applicants who</quote>;</text></paragraph><paragraph id="id190C391E0ADC45A3BE8DE303117A34A7"><enum>(2)</enum><text>by striking <quote>; and</quote> and inserting a period; and</text></paragraph><paragraph id="id4C53837A28A14DE8B59D6CE815C557D3"><enum>(3)</enum><text>by striking paragraph (2).</text></paragraph></subsection></section><section changed="deleted" committee-id="SSJU00" id="ide4aa452159c74e3c9b2df7d38bccac9b" reported-display-style="strikethrough"><enum>5.</enum><header>Transitional living grant program</header><text display-inline="no-display-inline">Section 322(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/5714-2">42 U.S.C. 5714–2(a)</external-xref>) is amended—</text><paragraph id="id8072243CAEA2476A88B90C34745FCDA1"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id163071d6c8794fb388eed8ee97cdf2f3"><enum>(A)</enum><text>by inserting <quote>age, gender, and culturally and linguistically appropriate</quote> before <quote>information and counseling services</quote>; and</text></subparagraph><subparagraph id="idb3c755c7f44148268f403d2e17173d9e"><enum>(B)</enum><text>by striking <quote>job attainment skills, and mental and physical health care</quote> and inserting <quote>job attainment skills, mental and physical health care, and suicide prevention services</quote>;</text></subparagraph></paragraph><paragraph id="idDB77F641F34B4B88914D67B7D7204DEB"><enum>(2)</enum><text>by redesignating paragraphs (3) through (8) and (9) through (16) as paragraphs (5) through (10) and
			 (12) through (19), respectively;</text></paragraph><paragraph id="id1A014A1C607B4F839B943CFA80214DBE"><enum>(3)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id3CFD8BA148074653903DD37DAF905FB6" reported-display-style="strikethrough" style="OLC"><paragraph id="id56a3a0705a0e4d40889049e34a428a89"><enum>(3)</enum><text>to provide counseling to homeless youth and to encourage, if appropriate, the involvement in such
			 counseling of their parents or legal guardians, or (if appropriate)
			 individuals identified by such youth as family;</text></paragraph><paragraph id="id3D5C5AE2ED6C4BA5B1D4E2FDFD82B0B3"><enum>(4)</enum><text>to provide aftercare services, if possible, to homeless youth who have received shelter and
			 services from a
			 transitional living youth project, including (to the extent practicable)
			 such youth who, after receiving such shelter and services, relocate to a
			 State other than the State
			 in which such project is located;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="ida9f1de88cefc436c8c753b6986c25579"><enum>(4)</enum><text>in paragraph (9), as so redesignated—</text><subparagraph id="idaae0d0d9ea864f79a5a2b30a8e9da7ac"><enum>(A)</enum><text>by inserting <quote>age, gender, and culturally and linguistically appropriate</quote> after <quote>referral of homeless youth to</quote>;</text></subparagraph><subparagraph id="idA9A56220227F4525ACE36D93778DA21B"><enum>(B)</enum><text>by striking <quote>and health care programs</quote> and inserting <quote>mental health service and health care programs, including programs providing comprehensive services
			 to

			 cooperative agreements, or other assistance administered by the
			 Administration for Children and Families of the Department of Health and
			 Human Services.</text></subsection><subsection id="idE0E513D9D4804BE1B6BDB2FA37B2413E"><enum>(b)</enum><header>Disqualification</header><text>Any State, locality, organization, agency, or entity that violates the requirements of subsection
			 (a) shall not be eligible to receive any grant, assistance, or funding
			 provided under

			 expressed
			 in terms of an amendment to, or repeal of, a provision, the amendment or
			 repeal shall be considered to be made to a provision of the Runaway and
			 Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5701">42 U.S.C. 5701 et seq.</external-xref>).</text></section><section id="id95613ac4-3d87-440b-8820-01ecdc608a9d"><enum>102.</enum><header>Findings</header><text display-inline="no-display-inline">Section 302 (<external-xref legal-doc="usc" parsable-cite="usc/42/5701">42 U.S.C. 5701</external-xref>) is amended—</text><paragraph id="idb79a2568-e3c1-4441-8636-ade92c7f05e9"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>age, gender, and culturally and</quote> before <quote>linguistically appropriate</quote>;</text></paragraph><paragraph id="id7d2b3df3-0f13-41cc-88e1-c7e6603eb998"><enum>(2)</enum><text>in paragraph (4), by striking <quote>outside the welfare system and the law enforcement system</quote>  and inserting <quote>, in collaboration with public assistance systems, the law enforcement system, and the child

			 trafficking in persons.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id9ebb89cd-e5f7-40eb-b8d2-1f67069e73ac"><enum>103.</enum><header>Basic center grant program</header><subsection id="ida14554a0-3de4-4281-acdc-30900758e064"><enum>(a)</enum><header>Grants for centers and services</header><text>Section 311(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/5711">42 U.S.C. 5711(a)</external-xref>) is amended—</text><paragraph id="id78cf8e80-444e-4869-8cd7-769e0302a381"><enum>(1)</enum><text>in paragraph (1), by striking <quote>services</quote> and all that follows through the period and inserting <quote>safe shelter and  services, including trauma-informed services, for runaway and homeless youth and,
			 if appropriate,
			 services for the families of such youth, including (if appropriate)

			 who are victims of trafficking in persons or sexual exploitation; and</text></clause><clause id="id49ac4c09-169f-4646-a749-05a51861b057"><enum>(vi)</enum><text>an assessment of family engagement in support and reunification (if reunification is appropriate),
			 interventions, and services for parents or legal guardians of such youth,
			 or (if appropriate) individuals identified by such youth as family.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="idbf95c6a9-543a-4ca1-b2e7-a69c1cf5fb5e"><enum>(b)</enum><header>Eligibility; plan requirements</header><text display-inline="yes-display-inline">Section 312 (<external-xref legal-doc="usc" parsable-cite="usc/42/5712">42 U.S.C. 5712</external-xref>) is amended—</text><paragraph id="id4ff05b16-e8da-4194-8185-ae98c55cd820"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="iddc4716dc-3ea4-41f5-b359-e03fdbe49ced"><enum>(A)</enum><text>in paragraph (5), by inserting <quote>, or (if appropriate) individuals identified by such youth as family,</quote> after <quote>parents or legal guardians</quote>;</text></subparagraph><subparagraph id="id5734173b-620f-4d04-9d0d-ee6292782808"><enum>(B)</enum><text>in paragraph (6), by striking <quote>cultural minority and persons with limited ability to speak English</quote> and inserting <quote>cultural minority, persons with limited ability to speak English, and runaway or homeless youth who
			 are victims of trafficking in persons or sexual exploitation</quote>;</text></subparagraph><subparagraph id="idb6ba0761-258d-4489-a2cf-c2f474659caa"><enum>(C)</enum><text>by striking paragraph (7) and inserting the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idd7da2eec-8df4-49e3-9d84-df9427d948e8" reported-display-style="italic" style="OLC"><paragraph id="id45c14d49-4262-42b8-9f07-6725d33fc4e6"><enum>(7)</enum><text>shall keep adequate statistical records profiling the youth and family members of such youth whom
			 the applicant serves, including demographic information on and the number
			 of—</text><subparagraph id="id9dbdecdd-0d7b-426d-86b8-4fd773141590"><enum>(A)</enum><text>such youth who are not referred to out-of-home shelter services;</text></subparagraph><subparagraph id="id132b0110-6361-4e82-89fb-80690aa2c8c0"><enum>(B)</enum><text>such youth who are members of vulnerable or underserved populations;</text></subparagraph><subparagraph id="idfe8be959-0f4f-4a75-8719-80a286b009a9"><enum>(C)</enum><text>such youth who are victims of trafficking in persons or sexual exploitation, disaggregated by—</text><clause id="iddad4640b-c580-4581-aa5c-e7f5b84f18fe"><enum>(i)</enum><text>such youth who have been coerced or forced into a commercial sex act, as defined in section 103 of
			 the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>);</text></clause><clause id="idf1dbd6a0-701b-4b59-b10a-3cdfdf9b4e18"><enum>(ii)</enum><text>such youth who have been coerced or forced into other forms of labor; and</text></clause><clause id="id42a735f8-5f14-4d4d-ac9b-96c73dfcca2c"><enum>(iii)</enum><text>such youth who have engaged in a commercial sex act, as so defined, for any reason other than by
			 coercion or force;</text></clause></subparagraph><subparagraph id="id80082f18-f5f3-4124-b933-1447dbb86105"><enum>(D)</enum><text>such youth who are pregnant or parenting;</text></subparagraph><subparagraph id="idda3a9232-66fe-4b2a-b1b3-73a3f983cc09"><enum>(E)</enum><text>such youth who have been involved in  the child welfare system; and</text></subparagraph><subparagraph id="id1255e3ec-20bb-49ff-9c4d-63b78e5a9e73"><enum>(F)</enum><text>such youth who have been involved in the juvenile justice system;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idfbc6be00-8820-498c-8211-449d384a3bff"><enum>(D)</enum><text>by redesignating paragraphs (8) through (13) as paragraphs (9) through (14);</text></subparagraph><subparagraph id="id5da07ed9-3087-4275-973a-77656efdcfca"><enum>(E)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idce7adbfd-f525-46ef-8d70-062909d0b6da" reported-display-style="italic" style="OLC"><paragraph id="idc660a76b-f406-445d-adda-a217a301a869"><enum>(8)</enum><text>shall ensure that—</text><subparagraph id="idc1885915-dfc4-44d3-b10b-1f87af32b94b"><enum>(A)</enum><text>the records described in paragraph (7), on an individual runaway or homeless youth, shall not be
			 disclosed
			 without the consent of the individual youth, and parent or legal guardian
			 of such youth	or (if appropriate) an individual identified by such youth
			 as family, to anyone other than another agency compiling statistical
			 records or a government agency involved
			 in the disposition of criminal charges against an individual runaway or
			 homeless youth; and</text></subparagraph><subparagraph id="id69b85db6-dfc3-4d9a-b1f4-2754c148cdfb"><enum>(B)</enum><text>reports or other  documents based on the statistics described in paragraph (7) shall not disclose
			 the identity of any individual runaway or homeless youth;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id65cc791b-3dea-425e-9cef-0e099a95d5d9"><enum>(F)</enum><text>in paragraph (9), as so redesignated, by striking <quote>statistical summaries</quote> and inserting <quote>statistics</quote>;</text></subparagraph><subparagraph id="id4563f3b7-42f0-4af3-98cf-6e18cd490f38"><enum>(G)</enum><text>in paragraph (13)(C), as so redesignated—</text><clause commented="no" id="id087ba0a2-aaf6-497f-aec7-1947c7bfe9bd"><enum>(i)</enum><text>by striking clause (i) and inserting:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id69342129-e95b-4ce4-a861-a50a174d9b80" reported-display-style="italic" style="OLC"><clause id="id4e93a367-ea20-47ef-b1ae-bda55d856e8b"><enum>(i)</enum><text>the number and characteristics of runaway and homeless youth, and youth at risk of family

			 persons or sexual exploitation, disaggregated by—</text><item id="id1bc4d4dc-a60b-4d44-89ec-ed10590ea964"><enum>(aa)</enum><text>such youth who
			 have been coerced or forced into a commercial sex act, as defined in
			 section 103 of the Trafficking Victims Protection Act of 2000 (22 U.S.C.
			 7102);</text></item><item id="id39a067f5-2b32-487b-88a5-e262016a1e2f"><enum>(bb)</enum><text>such youth who
			 have been coerced or forced into other forms of labor; and</text></item><item id="id29d396b4-9180-4eb2-a157-a65fd22d2896"><enum>(cc)</enum><text>such youth who
			 have engaged in a commercial sex act, as so defined, for any reason other
			 than by coercion or force;</text></item></subclause><subclause id="idcfdbbf43-e38c-4a5a-81af-992d006a8955"><enum>(II)</enum><text>such youth who are pregnant or parenting;</text></subclause><subclause id="id8ef2f3f5-16c0-45c6-9ace-22b0b3b1fed0"><enum>(III)</enum><text>such youth who have been involved in the child welfare system; and</text></subclause><subclause id="id49c8ed98-15cd-4e52-928f-5beed73b3c98"><enum>(IV)</enum><text>such youth who have been involved in the juvenile justice system; and</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="ide23a920e-c471-483a-aedf-c0f461edd138"><enum>(ii)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></clause></subparagraph><subparagraph id="id98df18c6-3ed8-451c-b223-fef27f967f52"><enum>(H)</enum><text>in paragraph (14), as so redesignated, by striking the period and inserting <quote>for natural disasters, inclement weather, and mental health emergencies;</quote>; and</text></subparagraph><subparagraph id="id7bf8ed63-2f09-419e-8de9-cbce4df7cd56"><enum>(I)</enum><text>by adding at the end the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id0932a347-5bd6-4470-a4d2-ffb8174f75b4" reported-display-style="italic" style="OLC"><paragraph id="idfe3e9205-8351-4c65-a349-895541588878"><enum>(15)</enum><text>shall provide age, gender, and culturally and

			 483 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1090">20 U.S.C. 1090</external-xref>).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idca85ef01-c86f-4527-bf3e-76665a53d961"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph id="id1b190fff-0af8-4380-9196-a38da57fcaab"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id5d66d49b-cc46-442d-9502-6dee87cb3afd"><enum>(i)</enum><text>by inserting <quote>age, gender, and culturally and linguistically appropriate</quote> after <quote>provide</quote>;</text></clause><clause id="id72e7285f-63ff-4410-b643-f9c426996319"><enum>(ii)</enum><text>by striking <quote>families (including unrelated individuals in the family households) of such youth</quote> and inserting <quote>families of such youth (including unrelated individuals in the family households of such youth and,

			 services from a
			 transitional living youth project, including (to the extent practicable)
			 such youth who, after receiving such shelter and services, relocate to a
			 State other than the State
			 in which such project is located;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id79a0ae00-5ffe-401f-8b92-33aaf45c9db5"><enum>(4)</enum><text>in paragraph (9), as so redesignated—</text><subparagraph id="idfebc1817-f9dc-4b30-962c-154f8c9f954f"><enum>(A)</enum><text>by inserting <quote>age, gender, and culturally and linguistically appropriate</quote> after <quote>referral of homeless youth to</quote>;</text></subparagraph><subparagraph id="id3ae49601-8cfd-4070-94bf-fba2d45107c5"><enum>(B)</enum><text>by striking <quote>and health care programs</quote> and inserting <quote>mental health service and health care programs, including programs providing comprehensive services

			 described in section

			 that such applicant has systems in place to ensure that such applicant can
			 provide age, gender, and culturally and linguistically appropriate
			 services to all youth described in subsection (a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id8beb0dc2-1bb6-4f88-ac92-7f27367b0540"><enum>107.</enum><header>General provisions</header><subsection id="ideeb338a6-2bd3-4c10-b400-38316583d16a"><enum>(a)</enum><header>Reports</header><text>Section 382(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/5715">42 U.S.C. 5715(a)</external-xref>) is amended—</text><paragraph id="id0f9c4821-6d1a-4b4a-abda-ae97b7ec877c"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="idb9a7d005-06cc-44e8-9250-67d4c66136e9"><enum>(A)</enum><text>by redesignating subparagraphs (B) through (D) as subparagraphs (C) through (E), respectively; and</text></subparagraph><subparagraph id="id0a4d9244-fd12-4acc-9e7f-aaedad32f066"><enum>(B)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id9a7718aa-c568-4156-bf9f-b7f324f1f719" reported-display-style="italic" style="OLC"><subparagraph id="idfc944df5-ad39-4722-a3a7-4d52932e97d4"><enum>(B)</enum><text>collecting data on trafficking in persons and sexual exploitation of runaway and homeless youth;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idb716347d-5449-456c-bd0b-4e43aee8aa3f"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="id7e044c84-6d50-426b-b815-608ae86c6d56"><enum>(A)</enum><text>by striking subparagraph (A) and inserting the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id9d0c6c8a-d27b-4dec-bf18-4f492fd8c3c8" reported-display-style="italic" style="OLC"><subparagraph id="ida1c028cc-b981-4b8d-9dc4-bba4f776c22c"><enum>(A)</enum><text>the number and characteristics of homeless youth served by such projects, including—</text><clause id="id27ad51ef-739c-4850-b7a9-951e76fa1f2c"><enum>(i)</enum><text>such youth who are victims of trafficking in persons or sexual exploitation;</text></clause><clause id="id82c3b00f-8cdd-4c95-82f5-c749a085166b"><enum>(ii)</enum><text>such youth who are pregnant or parenting;</text></clause><clause id="id774beba8-8bb9-40ac-af42-81651a3310f5"><enum>(iii)</enum><text>such youth who have been involved in the child welfare system; and</text></clause><clause id="idab92f7db-391d-4c60-b5a5-63ec883ec065"><enum>(iv)</enum><text>such youth who have been involved in the juvenile justice system;</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id1ef7d78b-c338-46d2-9d94-5b1e85075cd4"><enum>(B)</enum><text>in subparagraph (F), by striking <quote>intrafamily problems</quote>  and inserting  <quote>problems within the family, including (if appropriate) individuals identified by such youth as
			 family,</quote>.</text></subparagraph></paragraph></subsection><subsection id="id18d79695-534e-47c1-b1cc-64ac28963c96"><enum>(b)</enum><header>Nondiscrimination</header><text>Part F is amended by inserting after
			 section 386A (<external-xref legal-doc="usc" parsable-cite="usc/42/5732-1">42 U.S.C. 5732–1</external-xref>) the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="iddf2206ba-4027-4a7b-8203-840d53034905" reported-display-style="italic" style="OLC"><section id="id6ee71768-7e83-45c8-9924-9e0215067139"><enum>386B.</enum><header>Nondiscrimination</header><subsection id="ideba6bf16-8ee1-40ef-89f7-7be3c7cc6069"><enum>(a)</enum><header>In general</header><text>No person in the United States shall, on the basis of actual or perceived race, color, religion,
			 national origin, sex, gender identity (as defined in section 249(c)(4) of
			 title 18, United States Code), sexual orientation, or disability, be
			 excluded from participation in, denied the benefits of, or subjected to
			 discrimination under any program or activity funded in whole or in part
			 with funds made available under this title, or any other program or
			 activity funded in whole or in part with amounts appropriated for grants,
			 cooperative agreements, or other assistance administered by the
			 Administration for Children and Families of the Department of Health and
			 Human Services.</text></subsection><subsection id="id9140b865-247a-40d9-a00b-bac783c2499d"><enum>(b)</enum><header>Disqualification</header><text>Any State, locality, organization, agency, or entity that violates the requirements of subsection
			 (a) shall not be eligible to receive any grant, assistance, or funding
			 provided under
			 this title.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id16af4a9635214e51ae64d460835b0e2c" section-type="subsequent-section"><enum>386C.</enum><header display-inline="yes-display-inline">Accountability</header><subsection commented="no" display-inline="no-display-inline" id="id6F0D0A150E7F40AF8182AC83B919B1D2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">All grants awarded by the Secretary under this title shall be subject to the
			 following accountability provisions:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id2d9873a8a4b44cd58763941f68b354f2"><enum>(1)</enum><header display-inline="yes-display-inline">Audit requirement</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="idb93b379e1f8f4e6a8a1e3e4f26dc2788"><enum>(A)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this paragraph, the term
			 <term>unresolved audit finding</term> means an audit report finding in the
			 final audit report of the Inspector General of the Department of Health
			 and Human Services
			 that
			 the grantee has used grant funds for an unauthorized expenditure or
			 otherwise
			 unallowable cost that is not closed or resolved during the 12-month period
			 beginning on the date on which the final audit report is issued.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a3639a3b8934fccaa17338cdd41662a"><enum>(B)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">Beginning in the first fiscal year
			 beginning after the date of enactment of the Runaway and Homeless Youth
			 and Trafficking Prevention Act, and in each fiscal year
			 thereafter, the Inspector General of the Department of Health and Human
			 Services shall
			 conduct
			 audits of recipients of grants under this title to prevent waste, fraud,
			 and abuse of funds by grantees. The Inspector
			 General
			 shall determine the appropriate number of grantees to be audited each
			 year.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd9324140aa8a4930823f0b91073136a4"><enum>(C)</enum><header display-inline="yes-display-inline">Mandatory exclusion</header><text display-inline="yes-display-inline">A recipient of grant funds under this title
			 that is found to have an unresolved audit
			 finding shall not be eligible to receive grant funds under this title
			 during the first 2 fiscal years beginning after the
			 end
			 of the 12-month period described in subparagraph (A).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide6b6721108dd4832b02a652584401cd9"><enum>(D)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In awarding grants under this title, the Secretary shall give priority to
			 eligible
			 applicants that did not have an unresolved audit finding during the 3
			 fiscal
			 years before submitting an application for a grant under this title.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id201fe46059d34cdf9d85730af8ae488c"><enum>(E)</enum><header display-inline="yes-display-inline">Reimbursement</header><text display-inline="yes-display-inline">If an entity is awarded grant funds under
			 this title during the 2-fiscal-year period
			 during which the entity is barred from receiving grants under subparagraph
			 (C),
			 the Secretary shall—</text>
										<clause commented="no" display-inline="no-display-inline" id="id5cf72be3d77f442b9d365a769194933a"><enum>(i)</enum><text display-inline="yes-display-inline">deposit an amount equal to the amount of
			 the grant funds that were improperly awarded to the grantee into the
			 General
			 Fund of the Treasury; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id51844a11170e47f7ba31ab960cc8f10d"><enum>(ii)</enum><text display-inline="yes-display-inline">seek to recoup the costs of the repayment
			 to the fund from the grant recipient that was erroneously awarded grant
			 funds.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7dafc5ea30b14e69bfb82f728ed49372"><enum>(2)</enum><header display-inline="yes-display-inline">Nonprofit organization
			 requirements</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id6de3a879fb444c51a7b232800ccad800"><enum>(A)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">For purposes of this paragraph and the
			 grant programs under this title, the term
			 <term>nonprofit organization</term> means an organization that is described in
			 <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and is exempt from
			 taxation under section 501(a) of such Code.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7fb9b2ebc5224a3085833d6cee5f01df"><enum>(B)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">The Secretary may not award a grant
			 under this title to a nonprofit
			 organization
			 that holds money in offshore accounts for the purpose of avoiding paying
			 the
			 tax described in <external-xref legal-doc="usc" parsable-cite="usc/26/511">section 511(a)</external-xref> of the Internal Revenue Code of 1986.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30a64bd59ed64ce7a7f11dfa655182e5"><enum>(C)</enum><header display-inline="yes-display-inline">Disclosure</header><text display-inline="yes-display-inline">Each nonprofit organization that is awarded
			 a grant under this title and uses the
			 procedures prescribed in regulations to create a rebuttable presumption of
			 reasonableness for the compensation of its officers, directors, trustees,
			 and
			 key employees, shall disclose to the Secretary, in the application
			 for
			 the grant, the process for determining such compensation, including the
			 independent persons involved in reviewing and approving such compensation,
			 the
			 comparability data used, and contemporaneous substantiation of the
			 deliberation
			 and decision. Upon request, the Secretary shall make the
			 information
			 disclosed under this subparagraph available for public inspection.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id030b6a54d2ce429b8b545dcc2d45ca82"><enum>(3)</enum><header display-inline="yes-display-inline">Conference expenditures</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id9b8baf8c3f914970bb719593d57e6587"><enum>(A)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">No amounts authorized to be appropriated to
			 the Department of Health and Human Services under this title
			 may
			 be used by the Secretary, or by any individual or entity awarded
			 discretionary funds through a cooperative agreement under this title, to
			 host or support any expenditure for conferences
			 that
			 uses more than $20,000 in funds made available to the Department of
			 Health and Human Services,
			 unless the Deputy Secretary or the appropriate Assistant Secretary,
			 Director, or principal deputy (as designated by the Deputy
			 Secretary) provides prior written authorization that the funds may be
			 expended to
			 host the conference.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide476df3ef92247dc90a2b1dfc170bbfa"><enum>(B)</enum><header display-inline="yes-display-inline">Written approval</header><text display-inline="yes-display-inline">Written approval under subparagraph (A)
			 shall include a written estimate of all costs associated with the
			 conference,
			 including the cost of all food, beverages, audio-visual equipment,
			 honoraria
			 for speakers, and entertainment.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id70eeb693895b42df966d8d857fe950fb"><enum>(C)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Deputy Secretary shall submit an
			 annual report to the Committee on the Judiciary of the Senate and the
			 Committee
			 on Education and the Workforce of the House of Representatives
							 on all conference
			 expenditures
			 approved under this paragraph.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08bd237205a847e1924a5d6dcfff12fb"><enum>(4)</enum><header display-inline="yes-display-inline">Annual certification</header><text display-inline="yes-display-inline">Beginning in the first fiscal year
			 beginning after the date of enactment of the Runaway and Homeless Youth
			 and Trafficking Prevention Act, the Secretary
			 shall
			 submit, to the Committee on the Judiciary and the Committee on
			 Appropriations
			 of the Senate and the Committee on Education and the Workforce and the
			 Committee on
			 Appropriations of the House of Representatives, an annual certification
			 indicating whether—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id5a7697a77bf942a2be5647c16493f7b3"><enum>(A)</enum><text display-inline="yes-display-inline">all audits issued by the Office of the
			 Inspector General under paragraph (1) have been completed and reviewed by
			 the
			 appropriate Assistant Secretary or Director;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11f5402b9fa744e0885134d4d21a48b5"><enum>(B)</enum><text display-inline="yes-display-inline">all mandatory exclusions required under
			 paragraph (1)(C) have been issued;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbaacbc53fbdb470c895d997b9c7883ee"><enum>(C)</enum><text display-inline="yes-display-inline">all reimbursements required under paragraph
			 (1)(E) have been made; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9657502110b94d25ad18e6a4a4dae71e"><enum>(D)</enum><text display-inline="yes-display-inline">includes a list of any grant recipients
			 excluded under paragraph (1) from the previous year.</text></subparagraph></paragraph><paragraph id="id13E24839A9FD42868206D08595E9738D"><enum>(5)</enum><header>Prohibition on lobbying activity</header><subparagraph id="idBA3AC4EF344A443E86A5F4915B7A77F4"><enum>(A)</enum><header>In general</header><text>Amounts authorized to be appropriated under this title may not be utilized by any grant recipient
			 to—</text><clause id="id4AEE8563D41F418AA99242CE17E91CD0"><enum>(i)</enum><text>lobby any representative of the Department of Health and Human Services regarding the award of
			 grant funding; or</text></clause><clause id="idF3AA6A5385D949A79E7E339B9D3498F3"><enum>(ii)</enum><text>lobby any representative of a Federal, State, local, or tribal government regarding the award of
			 grant funding.</text></clause></subparagraph><subparagraph id="id1139BAFE41504E3CAAB96FB6604D0364"><enum>(B)</enum><header>Penalty</header><text>If the Secretary determines that any recipient of a grant under this title has violated
			 subparagraph (A), the Secretary shall—</text><clause id="idF05E777B455F44A59645BE9241E7F0A1"><enum>(i)</enum><text>require the grant recipient to repay the grant amount in full; and</text></clause><clause id="id7BA7542DA74C46D894267AC5EE1FA8A4"><enum>(ii)</enum><text>prohibit the grant recipient from receiving another grant under this title  for not less than 5
			 years.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC3FDE9B1D08B43D5ACCCC78D63F90B19"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>grant</term> includes a contract or agreement for Federal financial assistance.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idaa819cf9-7bb4-4831-9720-b3097cbedbe9"><enum>(c)</enum><header>Definitions</header><text>Section 387 (<external-xref legal-doc="usc" parsable-cite="usc/42/5732a">42 U.S.C. 5732a</external-xref>) is amended—</text><paragraph id="id32B9F071D13A4C36A8AFBBDE83FA3559"><enum>(1)</enum><text>by redesignating paragraphs (1) through (6), and (7) and (8), as paragraphs (2) through (7), and

			 title</header><text display-inline="no-display-inline">This title may be cited as
			 the <quote><short-title>Justice for Victims of Trafficking
			 Act of 2014</short-title></quote>.</text></section><section id="idCA2D4257D72243E0A52DC9E31C07B4D1"><enum>202.</enum><header>Domestic
			 trafficking victims' fund</header><subsection id="id0427E339594C4E7D935B06381040EF49"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/201">Chapter 201</external-xref> of title 18, United States Code, is amended
			 by adding at the end the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idD82225D8E17042DC895F442346FAFC8E" reported-display-style="italic" style="USC"><section id="id45F5C465A9704F92B651E3BEC60512BB"><enum>3014.</enum><header>Additional
				special assessment</header><subsection id="id2AAFDA4C2F6F439482E07C1E4A300557"><enum>(a)</enum><text>In addition to
				the assessment imposed under section 3013, the court shall assess
			 an amount of
				$5,000 on any non-indigent person or entity convicted of an offense
			 under—</text><paragraph id="idA7849487EDF64128AADBE4A823977290"><enum>(1)</enum><text>chapter 77
				(relating to peonage, slavery, and trafficking in persons);</text></paragraph><paragraph id="id530910B6AB904EAE893CD1D17B415C91"><enum>(2)</enum><text>chapter 109A
				(relating to sexual abuse);</text></paragraph><paragraph id="id423D28CE7A5E44C7872A3B70C5F53A9D"><enum>(3)</enum><text>chapter 110
				(relating to sexual exploitation and other abuse of children);</text></paragraph><paragraph id="idEF8CCBC13057444FB17473F9FCBC72F2"><enum>(4)</enum><text>chapter 117
				(relating to transportation for illegal sexual activity and related
			 crimes);
				or</text></paragraph><paragraph id="idA156633C170649C299941BEAB2E82D0F"><enum>(5)</enum><text>section 274 of
				the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324</external-xref>) (relating to
			 human
				smuggling), unless the person induced, assisted, abetted, or aided
			 only an individual who at the time of such action was the alien’s spouse,
			 parent, son, or daughter (and no other individual) to enter the United
			 States in violation of law.</text></paragraph></subsection><subsection id="idD801AE004D7348C69C46DBD75744C8A7"><enum>(b)</enum><text>An assessment
				under subsection (a) shall not be payable until the person subject
			 to the
				assessment has satisfied all outstanding court-ordered fines and
			 orders of restitution arising from the
				criminal convictions on which the special assessment is based.</text></subsection><subsection id="id78ECB56F582B447C98E25614504FEC39"><enum>(c)</enum><text>There is
				established in the Treasury of the United States a fund, to be
			 known as the
				<quote>Domestic Trafficking Victims' Fund</quote> (referred to in this section
				as the <term>Fund</term>), to be administered by the Attorney General, in
				consultation with the Secretary of Homeland Security and the
			 Secretary of
				Health and Human Services.</text></subsection><subsection id="id81BFAE1B6688414191328EC9D8B0970C"><enum>(d)</enum><text>Notwithstanding
				<external-xref legal-doc="usc" parsable-cite="usc/31/3302">section 3302</external-xref> of title 31, United States Code, or any other law
			 regarding the
				crediting of money received for the Government, there shall be
			 deposited in the
				Fund an amount equal to the amount of the assessments collected
			 under this
				section, which shall remain available until expended.</text></subsection><subsection id="id07A8B6CBC387425184DF0E2CEE4A5411"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id08F9869409E240ECBEEA1BB59F137C6D"><enum>(1)</enum><text>From amounts in the
				Fund, in addition to any other amounts available, and without
			 further appropriation, the Attorney General, in
			 coordination
				with the Secretary of Health and Human Services shall, for each of
			 fiscal years
				2015 through 2019, use amounts available in the Fund to award
			 grants or enhance
				victims' programming under—</text><subparagraph changed="added" committee-id="SSJU00" id="idFA75F480C93F4584B703610A06EAF3D2" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>sections 202, 203, and 204 of the
				Trafficking Victims Protection Reauthorization Act of 2005 (42
			 U.S.C. 14044a,
				14044b, and 14044c);</text></subparagraph><subparagraph changed="added" committee-id="SSJU00" id="id90954465F0C24BB28B811F38108487E7" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>subsections
				(b)(2) and (f) of section 107 of the Trafficking Victims Protection
			 Act of 2000
				(<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105</external-xref>); and</text></subparagraph><subparagraph changed="added" committee-id="SSJU00" id="id0b84a9b5aadb4a80b5c64d36302341cf" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>section 214(b) of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13002">42 U.S.C. 13002(b)</external-xref>).</text></subparagraph></paragraph><paragraph changed="added" committee-id="SSJU00" id="id8adab123fd184525add56a070e4340a3" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Of the amounts in the Fund used under paragraph (1), not less than $2,000,000 shall be used for
			 grants to provide services for child pornography victims under section
			 214(b) of the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13002">42 U.S.C. 13002(b)</external-xref>).</text></paragraph></subsection><subsection id="id3dc0ca2a221b4d32af0208b598bbe3a8"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id5DA4B880C4B54E6C94B11DD7ABFA9ADB"><enum>(1)</enum><text>Effective on the day
				after the date of enactment of the <short-title>Justice for Victims of Trafficking Act of 2014</short-title>, on September 30 of each
				fiscal year, all unobligated balances in the Fund shall be
			 transferred to the
				Crime Victims Fund established under section 1402 of the Victims of
			 Crime Act
				of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/42/10601">42 U.S.C. 10601</external-xref>).</text></paragraph><paragraph changed="added" committee-id="SSJU00" id="id0E00E06909004E2097E4743D9DA3232E" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Amounts transferred under paragraph
				(1)—</text><subparagraph id="idD1D3D75875984105B2F5C8A33C5C9DE5"><enum>(A)</enum><text>shall be available for any authorized
				purpose of the Crime Victims Fund; and</text></subparagraph><subparagraph id="id93A4DB48285A44E688EA8FD496ABEA23"><enum>(B)</enum><text>shall remain available until
				expended.</text></subparagraph></paragraph></subsection><subsection id="id8695604682FB40C5B18D78E71600273B"><enum>(g)</enum><text>The amount
				assessed under subsection (a) shall, subject to subsection (b), be
			 collected in the manner that fines are
				collected in criminal cases.</text></subsection><subsection id="id810CDD9ECFAD4E50A0D61B41FD6A7545"><enum>(h)</enum><text>The obligation to
				pay an assessment imposed on or after the date of enactment of the
				<short-title>Justice for Victims of Trafficking Act of 2014</short-title> shall not cease until the assessment is paid in
				full.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idCC8158EF68124ABCA711298054CC790F"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The table of sections for chapter 201 of
			 title 18, United States Code, is amended by inserting after the item
			 relating

			 American victims of human trafficking</header><text display-inline="no-display-inline">Section 107(f) of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7105">22 U.S.C. 7105</external-xref>) is amended by
			 adding at the end the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idca26cb666d1444e7aba9f4165d96ed78" reported-display-style="italic" style="OLC"><paragraph id="id7d392617e7ce41e5b6f3836414980dd6"><enum>(4)</enum><header>Official recognition of american victims of human trafficking</header><subparagraph id="id73a76c79a83c433791f6165141593648"><enum>(A)</enum><header>In general</header><text>Upon receiving credible information that establishes by a preponderance of the evidence that a
			 covered individual is a victim of a severe form of trafficking and at the
			 request of the covered individual, the Secretary of Health and Human
			 Services shall promptly issue a determination	that the covered individual
			  is a victim of a severe form of trafficking. The Secretary shall have
			 exclusive authority to make such  a determination.</text></subparagraph><subparagraph id="idf9da4469f92643a28becfe08912a406d"><enum>(B)</enum><header>Covered individual defined</header><text>In this subsection, the term <term>covered individual</term> means—</text><clause id="iddca9725fed134789a517fb40ddeb7e84"><enum>(i)</enum><text>a citizen of the United States; or</text></clause><clause id="id622c9595eaf74266b7400f2195bc5ff2"><enum>(ii)</enum><text>an alien lawfully admitted for permanent residence (as that term is defined in section 101(20) of
			 the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(20)</external-xref>)).</text></clause></subparagraph><subparagraph id="id69a596c5b6684ac9ab271bee84a30bdd"><enum>(C)</enum><header>Procedure</header><text>For purposes of this paragraph, in determining whether a covered individual has provided credible
			 information that the covered individual is a victim of a severe form of
			 trafficking, the Secretary of Health and Human Services shall consider all
			 relevant and credible evidence, and if  appropriate, consult with the
			 Attorney General, the Secretary of Homeland Security, or the Secretary of
			 Labor.</text></subparagraph><subparagraph id="id39b649ebef1d42078a5171b093094eda"><enum>(D)</enum><header>Presumptive evidence</header><text>For purposes of this paragraph, the following forms of evidence shall receive deference in 
			 determining whether a covered individual has established that the covered
			 individual is	a victim of a severe form of trafficking:</text><clause id="idb711778b093a4b3dbd45e85a7140e7d2"><enum>(i)</enum><text>A sworn statement by the covered individual  or a representative of the covered individual  if the
			 covered individual  is present at the time of such statement but not able
			 to competently make such sworn statement.</text></clause><clause id="id8e9162bfdca0472b9df48ee3b1599b49"><enum>(ii)</enum><text>Police, government agency, or court records or files.</text></clause><clause id="idb453a15f2e7e405ca003a5e43f9e090a"><enum>(iii)</enum><text>Documentation from a social services, trafficking, or domestic violence program, child welfare or
			 runaway and homeless youth program, or a legal, clinical, medical, or
			 other professional from whom the covered individual has sought assistance
			 in dealing with the crime.</text></clause><clause id="id6a813b2cdc3a42aa8dff06c88d4ac28d"><enum>(iv)</enum><text>A statement from any other individual with knowledge of the circumstances that provided the basis
			 for the claim.</text></clause><clause id="id6c5ef8c173d04ebf92280db9c0a0df1e"><enum>(v)</enum><text>Physical evidence.</text></clause></subparagraph><subparagraph id="id233c516e8f4242efa700f72c901a5578"><enum>(E)</enum><header>Regulations required</header><text>Not later than 18 months after the date of enactment of the <short-title>Justice for Victims of Trafficking Act of 2014</short-title>, the Secretary of Health and Human Services shall adopt
			 regulations to implement this paragraph.</text></subparagraph><subparagraph id="id9b2e2c9cee7d49d796779f8751c15478"><enum>(F)</enum><header>Rule of construction; official recognition optional</header><text>Nothing in this paragraph shall be construed to require a covered individual to   obtain a
			 determination	under this paragraph in order to be defined or classified
			 as a victim of a severe form of trafficking under this section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="idD9414939A3FA4903B8F0EE3A6DD31A7E"><enum>204.</enum><header>Victim-centered
			 human trafficking deterrence block grant program</header><subsection commented="no" id="idDC8521FAA58C4FFD8263D417BB9E76A0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 203 of the Trafficking Victims
			 Protection Reauthorization Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/14044b">42 U.S.C. 14044b</external-xref>) is amended to
			 read as
			 follows:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id85C270FF8F32490BB0415D9A8EE9424B" reported-display-style="italic" style="OLC"><section id="id2BCCD7B660404A878A79227B30A6B380"><enum>203.</enum><header>Victim-centered
				child human trafficking deterrence block grant program</header><subsection id="id8CBD496FD86947D9BE2F24B25ACE876F"><enum>(a)</enum><header>Grants
				authorized</header><text>The Attorney General may make block grants to an
				eligible entity to develop, improve, or expand comprehensive
			 domestic child human
				trafficking deterrence programs that assist law enforcement
			 officers,
				prosecutors, judicial officials, and qualified victims' services
			 organizations
				in collaborating to rescue and restore the lives of victims, while
				investigating and prosecuting offenses involving child human
			 trafficking.</text></subsection><subsection id="id9A40DF8A01DB42FA9A1D696FA5C1C4C6"><enum>(b)</enum><header>Authorized
				activities</header><text>Grants awarded under subsection (a) may be used
				for—</text><paragraph id="id580f3509618a44cfa0b87a023dcebc2a"><enum>(1)</enum><text>the establishment
				or enhancement of specialized training programs for law enforcement
			 officers,
				first responders, health care officials, child welfare officials,
			 juvenile
				justice personnel, prosecutors, and judicial personnel to—</text><subparagraph id="id857c8f71c651485f9dbd418c2dc13cff"><enum>(A)</enum><text>identify victims
				and acts of child human trafficking;</text></subparagraph><subparagraph id="idde0125e85ff3453890636692252f8031"><enum>(B)</enum><text>address the
				unique needs of child victims of human	trafficking;</text></subparagraph><subparagraph id="id1965d96b717c452487a00a407c68f9e4"><enum>(C)</enum><text>facilitate the
				rescue of child victims of  human trafficking;</text></subparagraph><subparagraph id="id964f93d007514052bdb0af7800cc2b9d"><enum>(D)</enum><text>investigate and
				prosecute acts of  human trafficking, including the soliciting,
			 patronizing, or
				purchasing of commercial sex acts from children, as well as
			 training to build
				cases against complex criminal networks involved in child human
			 trafficking;</text></subparagraph><subparagraph id="idb26fff67add74baaa67b97914bd01874"><enum>(E)</enum><text>use laws that
				prohibit acts of child human  trafficking, child sexual abuse, and
			 child rape,  and to assist in the development of
				State and local laws to prohibit, investigate, and prosecute acts
			 of child human trafficking; and</text></subparagraph><subparagraph id="id7add5ccbe5f7456d879f5b41b913a9bf"><enum>(F)</enum><text>implement and provide education on safe harbor laws enacted by States, aimed at preventing the
			 criminalization and prosecution of child sex trafficking victims for
			 prostitution offenses;</text></subparagraph></paragraph><paragraph id="id53fac74e436844d4ac6cd31c9d1e6380"><enum>(2)</enum><text>the establishment
				or enhancement of dedicated anti-trafficking law enforcement units
			 and task
				forces to investigate child human trafficking offenses and to
			 rescue victims,
				including—</text><subparagraph id="idda9b16035cf448c4beff7ff252e1fd5e"><enum>(A)</enum><text>funding salaries,
				in whole or in part, for law enforcement officers, including patrol
			 officers,
				detectives, and investigators, except that the percentage of the
			 salary of the
				law enforcement officer paid for by funds from a grant awarded
			 under this
				section shall not be more than the percentage of the officer’s time
			 on duty
				that is dedicated to working on cases involving child human
			 trafficking;</text></subparagraph><subparagraph id="id51e3aba2fb274cf0876e65812e374f77"><enum>(B)</enum><text>investigation
				expenses for cases involving child human trafficking, including—</text><clause id="idc9e7143b2fe746dc99ae7fc3779eda89"><enum>(i)</enum><text>wire taps;</text></clause><clause id="id9a20c8ab5be94fd0b99d29fae6343e05"><enum>(ii)</enum><text>consultants with
				expertise specific to cases involving child human trafficking;</text></clause><clause id="id1e596b0881574f619eae2ae15dfa332d"><enum>(iii)</enum><text>travel;
				and</text></clause><clause id="id7ee4878955334470b76f7bea836bdd47"><enum>(iv)</enum><text>other technical
				assistance expenditures;</text></clause></subparagraph><subparagraph id="id0d6f609d3b574c58933875ff4b6c5ebd"><enum>(C)</enum><text>dedicated
				anti-trafficking prosecution units, including the funding of
			 salaries for State
				and local prosecutors, including assisting in paying trial expenses
			 for
				prosecution of child human trafficking offenders, except that the
			 percentage of
				the total salary of a State or local prosecutor that is paid using
			 an award
				under this section shall be not more than the percentage of the
			 total number of
				hours worked by the prosecutor that is spent working on cases
			 involving child
				human  trafficking;</text></subparagraph><subparagraph id="id61cee2440fb44028a131ef10d90bfe3f"><enum>(D)</enum><text>the establishment
				of child human trafficking victim witness safety, assistance, and
			 relocation
				programs that encourage cooperation with law enforcement
			 investigations of
				crimes of child human trafficking by leveraging existing resources
			 and delivering
				child human trafficking victims’ services through coordination
			 with—</text><clause id="idc104783c2da2441fb1d36e328b2791be"><enum>(i)</enum><text>child advocacy
				centers;</text></clause><clause id="idbaaee5f6f7804d99aab9f325aa0e49d2"><enum>(ii)</enum><text>social service
				agencies;</text></clause><clause id="id8f9318d88bdc403b970798a6a84034c7"><enum>(iii)</enum><text>State governmental health service
				agencies;</text></clause><clause id="idf7c3c3465d7341d4aa8b01dc25518610"><enum>(iv)</enum><text>housing
				agencies;</text></clause><clause id="id22d25553aa5e41468b1da230e849e9cf"><enum>(v)</enum><text>legal services
				agencies; and</text></clause><clause id="id71c01bf922bc428d882f5a1500c6970a"><enum>(vi)</enum><text>non-governmental
				organizations and shelter service providers with substantial
			 experience in
				delivering comprehensive services to victims of child human 
			 trafficking;
				and</text></clause></subparagraph><subparagraph id="id54D953402B534C79A5E1D0FF528FF356"><enum>(E)</enum><text>the establishment or enhancement of other necessary victim assistance programs or personnel, such
			 as victim or child advocates, child-protective services, child forensic
			 interviews, or other necessary service providers; and</text></subparagraph></paragraph><paragraph id="id1d1ac15fd1ad48f5929153e8c452a489"><enum>(3)</enum><text>the establishment
				or enhancement of problem solving court programs for trafficking
			 victims that
				include—</text><subparagraph id="id0ab7a1532e764392a2a4f114522fa027"><enum>(A)</enum><text>mandatory and
				regular training requirements for judicial officials involved in
			 the
				administration or operation of the court program described under
			 this
				paragraph;</text></subparagraph><subparagraph id="id1997fa7120804c2ea6b6c6d131780728"><enum>(B)</enum><text>continuing
				judicial supervision of victims of child human trafficking who have
			 been
				identified by a law enforcement or judicial officer as a potential
			 victim of
				child human trafficking, regardless of whether the victim has been
			 charged with a
				crime related to human trafficking;</text></subparagraph><subparagraph id="id74b9926275c046d7b2230de87372b79a"><enum>(C)</enum><text>the development
				of a specialized and individualized, court-ordered treatment
			 program for
				identified victims of child human trafficking, including—</text><clause id="id9bc9875d270248aa9c44c3ac5e78cfb6"><enum>(i)</enum><text>State-administered outpatient
				treatment;</text></clause><clause id="idc6eb3eee616142609202553580d05827"><enum>(ii)</enum><text>life skills
				training;</text></clause><clause id="idf09dcd60d18c4e23b36de47cea0f7d0a"><enum>(iii)</enum><text>housing
				placement;</text></clause><clause id="ida3c0d29ee34b44d5b72a1a439ae8fd82"><enum>(iv)</enum><text>vocational
				training;</text></clause><clause id="id735e86910ce34e48b745611472740034"><enum>(v)</enum><text>education;</text></clause><clause id="id7457db3a2bc04e90992ac26108ca2ade"><enum>(vi)</enum><text>family support
				services; and</text></clause><clause id="idabdeab095adc4862b7ad1654fc6c3bcf"><enum>(vii)</enum><text>job
				placement;</text></clause></subparagraph><subparagraph id="ida409c4862ad0480e9d7047fa65e07e1e"><enum>(D)</enum><text>centralized case
				management involving the consolidation of all of each child human 
			 trafficking
				victim’s cases and offenses, and the coordination of all
			 trafficking victim
				treatment programs and social services;</text></subparagraph><subparagraph id="idec761acbfb584a80acf58b8a0d512f3d"><enum>(E)</enum><text>regular and
				mandatory court appearances by the victim during the duration of
			 the treatment
				program for purposes of ensuring compliance and effectiveness;</text></subparagraph><subparagraph id="ida928d084000441dc8cb159851e8d4b52"><enum>(F)</enum><text>the ultimate
				dismissal of relevant non-violent criminal charges against the
			 victim, where
				such victim successfully complies with the terms of the
			 court-ordered treatment
				program; and</text></subparagraph><subparagraph id="id7fcbaab4e68d4725ae6c259a86641f29"><enum>(G)</enum><text>collaborative
				efforts with child advocacy centers, child welfare agencies, 
			 shelters, and non-governmental
				organizations to provide comprehensive services to victims and
			 encourage
				cooperation with law enforcement.</text></subparagraph></paragraph></subsection><subsection id="idCD11D951E6B54FF2BB96CBAB3E492BC0"><enum>(c)</enum><header>Application</header><paragraph id="id23190698F80A42A9B3D4BB76EC794CDD"><enum>(1)</enum><header>In
				general</header><text>An eligible entity shall submit an application to the
				Attorney General for a grant under this section in such form and
			 manner as the
				Attorney General may require.</text></paragraph><paragraph id="id5830A7E48BB34FDBB527A8E347B891CE"><enum>(2)</enum><header>Required
				information</header><text>An application submitted under this subsection
				shall—</text><subparagraph id="id700F8A0D31F4453591ED4F9BE747F73D"><enum>(A)</enum><text>describe the
				activities for which assistance under this section is sought;</text></subparagraph><subparagraph id="id5a7b1dacd58e41bd949f4475c4090195"><enum>(B)</enum><text>include a
				detailed plan for the use of funds awarded under the grant; and</text></subparagraph><subparagraph id="id7a035f2b03a349ca9fbdde08a5404911"><enum>(C)</enum><text>provide such
				additional information and assurances as the Attorney General
			 determines to be
				necessary to ensure compliance with the requirements of this
			 section.</text></subparagraph></paragraph><paragraph id="id1ace81bd07ae4319851198e13c6c3454"><enum>(3)</enum><header>Preference</header><text>In reviewing applications submitted in accordance with paragraphs (1) and (2), the 
				Attorney General shall give preference to grant applications if—</text><subparagraph id="id2acdc1abb23641c798b247d5cd408d4c"><enum>(A)</enum><text>the application
				includes a plan to use awarded funds to engage in all activities
			 described
				under paragraphs (1) through (3) of subsection (b); or</text></subparagraph><subparagraph id="idc95779886805411aa0298e8b78cd2fd0"><enum>(B)</enum><text>the application
				includes a plan by the State or unit of local government to
			 continue funding of
				all activities funded by the award after the expiration of the
			 award.</text></subparagraph></paragraph></subsection><subsection id="id1c9762c5e164480fa9f0cbb428029183"><enum>(d)</enum><header>Duration and
				renewal of award</header><paragraph id="id9498719415e9438a95f4ebcc86f355e6"><enum>(1)</enum><header>In
				general</header><text>A grant under this section shall expire 3 years after the
				date of award of the grant.</text></paragraph><paragraph id="id66a2e422dc2c4d4b95ec605a728cd332"><enum>(2)</enum><header>Renewal</header><text>A
				grant under this section shall be renewable not more than 2 times
			 and for a
				period of not greater than2 years.</text></paragraph></subsection><subsection id="idC4B2123BB37A42838F319959A2492363"><enum>(e)</enum><header>Evaluation</header><text>The
				Attorney General shall enter into a contract with a
			 non-governmental organization, including an academic or
			 non-profit
				organization, that has experience in issues related to child human
			 trafficking and
				evaluation of grant programs to conduct periodic evaluations of
			 grants made
				under this section to determine the impact and effectiveness of
			 programs funded
				with grants awarded under this section.</text></subsection><subsection id="ide20e78c58c2744d1a4ebc118d7ae4226"><enum>(f)</enum><header>Mandatory
				exclusion</header><text>An eligible entity awarded funds under this section
				that is found to have used grant funds for any unauthorized
			 expenditure or
				otherwise unallowable cost shall not be eligible for any grant
			 funds awarded
				under the block grant for 2 fiscal years following the year in
			 which the
				unauthorized expenditure or unallowable cost is reported.</text></subsection><subsection id="id27ea229783f54ff3b9beccffd4fd0b53"><enum>(g)</enum><header>Compliance
				Requirement</header><text>An eligible entity shall not be eligible to receive a
				grant under this section if within the 5 fiscal years before
			 submitting an
				application for a grant under this section, the grantee has been
			 found to have
				violated the terms or conditions of a Government grant program by
			 utilizing
				grant funds for unauthorized expenditures or otherwise unallowable
				costs.</text></subsection><subsection id="idede6f3869c4340c486103016983f9478"><enum>(h)</enum><header>Administrative
				Cap</header><text>The cost of administering the grants authorized by this
				section shall not exceed 5 percent of the total amount expended
			 to carry
				out this section.</text></subsection><subsection id="id2325bd1bf7a54b2d86315c0feb934a59"><enum>(i)</enum><header>Federal
				share</header><text>The Federal share of the cost of a program funded by a
				grant awarded under this section shall be—</text><paragraph id="idF7961D520B8946B78AF2FF3EA033DF89"><enum>(1)</enum><text>70 percent in the
				first year;</text></paragraph><paragraph id="idB411C41D03EB4402B6F764BF3AA3F789"><enum>(2)</enum><text>60 percent in the
				second year; and</text></paragraph><paragraph id="id75FD9E4718A240C1A998990A9FFC4B0D"><enum>(3)</enum><text>50 percent in the
				third year, and all subsequent years.</text></paragraph></subsection><subsection id="id66168e15e2114194870c245bef74ef0a"><enum>(j)</enum><header>Authorization
				of funding; fully offset</header><text>For purposes of carrying out this
				section, the Attorney General, in consultation with the Secretary
			 of Health and
				Human Services, is authorized to award not more than $7,000,000 of
			 the funds
				available in the Domestic Trafficking Victims’ Fund, established
			 under section
				3014 of title 18, United States Code, for each of fiscal years 2015
			 through
				2019.</text></subsection><subsection id="id0eaef3f730b9436bb66cc7a65026cb15"><enum>(k)</enum><header>Definitions</header><text>In
				this section—</text><paragraph id="id5871dd6c90d04ecd80ed1703846686cd"><enum>(1)</enum><text>the term
				<term>child</term> means a person under the age of 18;</text></paragraph><paragraph id="id609e36fc5e47458cb8ee7f71cd368628"><enum>(2)</enum><text>the term
				<term>child advocacy center</term> means a center created under subtitle A of
				the Victims of Child Abuse Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13001">42 U.S.C. 13001 et seq.</external-xref>);</text></paragraph><paragraph id="id291eecc35b0d42abba58cc7a810f0f41"><enum>(3)</enum><text>the term <term>child human trafficking</term> means 1 or more severe forms of trafficking in persons (as defined in section 103 of the 
			 Trafficking Victims Protection Act of 2000 (22 U.S.C.	7102)) involving a
			 victim who is a child; and</text></paragraph><paragraph id="idb05e4faefd3241d6b7fe15da85eb3d4d"><enum>(4)</enum><text>the term
				<term>eligible entity</term> means a State or unit of local government
				that—</text><subparagraph id="id68e0752aa9114fdca67deab98fc57a43"><enum>(A)</enum><text>has significant
				criminal activity involving child human trafficking;</text></subparagraph><subparagraph id="id13e05e569c974b77a183998e1f7eac21"><enum>(B)</enum><text>has demonstrated
				cooperation between Federal, State, local, and, where applicable,
			 tribal law
				enforcement agencies, prosecutors, and social service providers in
			 addressing
				child human trafficking;</text></subparagraph><subparagraph id="idaf1b90468c044eaa89dab3ca5add2914"><enum>(C)</enum><text>has developed a
				workable, multi-disciplinary plan to combat child human
			 trafficking,
				including—</text><clause id="id2aca9260db1d41a892829ddb3498a309"><enum>(i)</enum><text>the establishment
				of a shelter for victims of child human trafficking, through
			 existing or new
				facilities;</text></clause><clause id="id0b3657f051e04c0196bb4fdef1c7de1d"><enum>(ii)</enum><text>the provision of
				trauma-informed, gender-responsive  rehabilitative care to victims
			 of child
				human trafficking;</text></clause><clause id="idde0549d131c34807857a937b453f5c5d"><enum>(iii)</enum><text>the provision
				of specialized training for law enforcement officers and social
			 service
				providers for all forms of human trafficking, with a focus on
			 domestic child human
				trafficking;</text></clause><clause id="idc408c70204af4296bc4a7dc51f1bd671"><enum>(iv)</enum><text>prevention,
				deterrence, and prosecution of offenses involving child human
			 trafficking,
				including soliciting, patronizing, or purchasing human acts with
			 children;</text></clause><clause id="idcd0b8d56d30b4dc699c5915e850286fa"><enum>(v)</enum><text>cooperation or
				referral agreements with organizations providing outreach or other
			 related
				services to runaway and homeless youth;</text></clause><clause id="idf6c0112534c14f93a95a654066ed3437"><enum>(vi)</enum><text>law enforcement
				protocols or procedures to screen all individuals arrested for
			 prostitution,
				whether adult or child, for victimization by sex trafficking and by
			 other
				crimes, such as sexual assault and domestic violence; and</text></clause><clause id="idf786e0a8589e4ecc98095ee0ddf1a8df"><enum>(vii)</enum><text>cooperation or referral agreements with State child welfare agencies and child advocacy centers;
			 and</text></clause></subparagraph><subparagraph id="idf597bf03156444348198055007fba3c8"><enum>(D)</enum><text>provides an
				assurance that, under the plan under subparagraph (C), a victim of
			 child human
				trafficking shall not be required to collaborate with law
			 enforcement officers
				to have access to any shelter or services provided with a grant
			 under this
				section.</text></subparagraph></paragraph></subsection><subsection id="id95c24095b8064204adb00b05f06b95fc"><enum>(l)</enum><header>Grant accountability; specialized victims’ service requirement</header><text>No grant funds under this section may be awarded or transferred to any entity unless such entity 
			 has demonstrated substantial experience providing services to victims of
			 human trafficking or related populations (such as runaway and homeless
			 youth), or employs staff specialized in the treatment of human trafficking
			 victims.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="id2FEE96DC1870458C9C2ADE63ED6225AF"><enum>(b)</enum><header>Table of contents</header><text>The table of contents in section 1(b) of the Trafficking Victims Protection Reauthorization Act of
			 2005 (<external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101</external-xref> note) is amended by striking the item relating to
			 section 203 and inserting the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idC7EB2380D6A9481A8BBDA72A83400726" reported-display-style="italic" style="OLC"><toc changed="added" committee-id="SSJU00" reported-display-style="italic"><toc-entry bold="off" level="section">Sec. 203. 			 U.S.C. 13001 et seq.) is amended—</text><paragraph commented="no" id="idC541C4F35B0E4E47ABCED9B311C3FC10"><enum>(1)</enum><text display-inline="yes-display-inline">in section 212(5) (<external-xref legal-doc="usc" parsable-cite="usc/42/13001a">42 U.S.C. 13001a(5)</external-xref>), by
			 inserting <quote>, including human trafficking and the production of child
			 pornography</quote> before the semicolon at the end; and</text></paragraph><paragraph id="id9171b6313e8b4bb78d8047aa66f164b9"><enum>(2)</enum><text>in section 214 (<external-xref legal-doc="usc" parsable-cite="usc/42/13002">42 U.S.C. 13002</external-xref>)—</text><subparagraph id="idc5adcdbc6cff49af82fe988ae2a3afa5"><enum>(A)</enum><text>by redesignating subsections (b), (c), and (d) as subsections (c), (d), and (e), respectively; and</text></subparagraph><subparagraph id="id3260fba4ce0d47f8a13f780c7193592e"><enum>(B)</enum><text>by inserting after subsection (a) the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="ide2733e705eaa429597f2ea4c1ac6d5fd" reported-display-style="italic" style="OLC"><subsection id="idb845cf338a8f48f380a80dfef05a7571"><enum>(b)</enum><header>Direct services for victims of child pornography</header><text>The Administrator, in coordination with the Director and with the Director of the Office of Victims

			 to identify and provide direct services to victims of child pornography.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section commented="no" id="idE80DB4F03971403688CBE78276F13AB4"><enum>206.</enum><header>Increasing
			 restitution for trafficking victims</header><subsection id="id2d733447c40046caad82b88ba122a170"><enum>(a)</enum><header>Title 18
			 amendments</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1594">Section 1594</external-xref> of title 18, United States Code, is
			 amended—</text><paragraph id="idd8a88bec5cd64a698b1aae3b951cb5b6"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (g); and</text></paragraph><paragraph id="id82c2d4b8c2304d87b2cc940582be76a5"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id20a7f3daacf44e14b67470ef6cf52684" reported-display-style="italic" style="OLC"><subsection id="ida1f83af782b84f6bb442e581dedecb13"><enum>(f)</enum><text>Notwithstanding any other provision of law, the Attorney General shall transfer assets forfeited

			 and inserting <quote>obtaining, patronizing, or soliciting</quote>.</text></subsection><subsection commented="no" id="id31606CB053464253AA79CF4D19D074E2"><enum>(c)</enum><header>Purpose</header><text>The purpose of the amendments made by this section is to clarify the range of conduct punished as
			 sex trafficking.</text></subsection></section><section id="idc55bd785a2a942a7bbb4d587025b68ac"><enum>210.</enum><header>Using existing
			 task forces to target offenders who exploit children</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Attorney General shall ensure that all task
			 forces
			 and working groups within the Innocence Lost National Initiative engage in
			 activities, programs, or operations to increase the investigative
			 capabilities
			 of State and local law enforcement officers in the detection,
			 investigation,
			 and prosecution of persons who patronize, or solicit children for sex.</text></section><section id="id9cd61404f72142e7aa204d0b42e4f89f"><enum>211.</enum><header>Grant Accountability</header><subsection id="idB7E0FD26E079432E87568C9F543956B4"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>covered
			 grant</term> means a grant awarded by the Attorney General under section 203 of
			 the Trafficking Victims Protection Reauthorization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14044b">42 U.S.C. 14044b</external-xref>).</text></subsection><subsection id="id5844848911934092A80B541909FC769A"><enum>(b)</enum><header>Accountability</header><text display-inline="yes-display-inline">All covered grants shall be subject to the
			 following accountability provisions:</text><paragraph id="idf756f30956c1480da1f89d80d23d561a"><enum>(1)</enum><header>Audit requirement</header><subparagraph id="id3af50bfbf6714b21898f02e1d20a013d"><enum>(A)</enum><header>In general</header><text>Beginning in the first fiscal year beginning after the date of the enactment of this Act, and in
			 each fiscal year thereafter, the Inspector General of the Department of
			 Justice shall conduct audits of recipients of a covered grant to prevent
			 waste, fraud, and abuse of funds by grantees. The Inspector General shall
			 determine the appropriate number of grantees to be audited each year.</text></subparagraph><subparagraph id="id97d47f9b5d35412db5fe1d1d9838d627"><enum>(B)</enum><header>Definition</header><text>In this paragraph, the term <term>unresolved audit finding</term> means a finding in the final audit report of the Inspector General of the Department of Justice
			 that the audited grantee has utilized grant funds for an unauthorized
			 expenditure or otherwise unallowable cost that is not closed or resolved
			 within 12 months from the date when the final audit report is issued.</text></subparagraph><subparagraph id="id5f57882a676e479992d5abdf720b7133"><enum>(C)</enum><header>Mandatory exclusion</header><text>A recipient of a covered grant that is found to have an unresolved audit finding shall not be
			 eligible to receive a covered grant during the following 2 fiscal years.</text></subparagraph><subparagraph id="ida4a0a064d16448be8e8ea1edf79f640b"><enum>(D)</enum><header>Priority</header><text>In awarding covered grants the Attorney General shall give priority to eligible entities that did
			 not have an unresolved audit finding during the 3 fiscal years prior to
			 submitting an application for a covered grant.</text></subparagraph><subparagraph id="id6c2248d167bc4d13a5f36fff4969be8b"><enum>(E)</enum><header>Reimbursement</header><text>If an entity is awarded a covered grant during the 2-fiscal-year period in which the entity is
			 barred from receiving grants under subparagraph (C), the Attorney General
			 shall—</text><clause id="id69184565fc034ce38c2d967aab45b12d"><enum>(i)</enum><text>deposit an amount equal to the grant funds that were improperly awarded to the grantee into the
			 General Fund of the Treasury; and</text></clause><clause id="idac8fdcc2fa504d218eabf88cc6755262"><enum>(ii)</enum><text>seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously
			 awarded grant funds.</text></clause></subparagraph></paragraph><paragraph id="idfb96d92cbf974a04b0d4f3f41440c0ac"><enum>(2)</enum><header>Nonprofit organization requirements</header><subparagraph id="id1467071834e7465db96d324bec065b7b"><enum>(A)</enum><header>Definition</header><text>For purposes of this paragraph and covered grants, the term <term>nonprofit organization</term> means an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986
			 and is exempt from taxation under section 501(a) of such Code.</text></subparagraph><subparagraph id="idb70d47b295184390aeb3a7877c1272e0"><enum>(B)</enum><header>Prohibition</header><text>The Attorney General may not award a covered grant to a nonprofit organization that holds money in
			 offshore accounts for the purpose of avoiding paying the tax described in
			 <external-xref legal-doc="usc" parsable-cite="usc/26/511">section 511(a)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph><subparagraph id="id402ded203c31442eb2e355d04ed5e768"><enum>(C)</enum><header>Disclosure</header><text>Each nonprofit organization that is awarded a covered grant and uses the procedures prescribed in
			 regulations to create a rebuttable presumption of reasonableness for the
			 compensation of its officers, directors, trustees and key employees, shall
			 disclose to the Attorney General, in the application for the grant, the
			 process for determining such compensation, including the independent
			 persons involved in reviewing and approving such compensation, the
			 comparability data used, and contemporaneous substantiation of the
			 deliberation and decision. Upon request, the Attorney General shall make
			 the information disclosed under this subsection available for public
			 inspection.</text></subparagraph></paragraph><paragraph id="idcb96f4ce42fb4d61abbc4d178848b10e"><enum>(3)</enum><header>Conference expenditures</header><subparagraph id="idbba0b903c78e419e9e53916a87640eda"><enum>(A)</enum><header>Limitation</header><text>No amounts authorized to be appropriated to the Department of Justice under this Act, or the
			 amendments made by this Act, may be used by the Attorney General, or by
			 any individual or organization awarded discretionary funds through a
			 cooperative agreement under this Act, or the amendments made by this Act,
			 to host or support any expenditure for conferences that uses more than
			 $20,000 in Department funds, unless the Deputy Attorney General or such
			 Assistant Attorney Generals, Directors, or principal deputies as the
			 Deputy Attorney General may designate, provides prior written
			 authorization that the funds may be expended to host a conference.</text></subparagraph><subparagraph id="ide3d46e800d034165a1c7cdf9f91b41ed"><enum>(B)</enum><header>Written approval</header><text>Written approval under subparagraph (A) shall include a written estimate of all costs associated
			 with the conference, including the cost of all food and beverages,
			 audiovisual equipment, honoraria for speakers, and any entertainment.</text></subparagraph><subparagraph id="id9b1502069ae14975911d3e184718b13a"><enum>(C)</enum><header>Report</header><text>The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the
			 Senate and the Committee on the Judiciary of the House of Representatives
			 on all approved conference expenditures referenced in this paragraph.</text></subparagraph><subparagraph id="id1c52adb20b6e42249b731d58266f5112"><enum>(D)</enum><header>Annual certification</header><text>Beginning in the first fiscal year beginning after the date of the enactment of this Act, the
			 Attorney General shall submit, to the Committee on the Judiciary and the
			 Committee on Appropriations of the Senate and the Committee on the
			 Judiciary and the Committee on Appropriations of the House of
			 Representatives, an annual certification that—</text><clause id="id28913c8740a545fba2c31bc307883406"><enum>(i)</enum><text>all audits issued by the Office of the Inspector General under paragraph (1) have been completed
			 and reviewed by the appropriate Assistant Attorney General or Director;</text></clause><clause id="id71008442d61248d08cc09db266ea1c75"><enum>(ii)</enum><text>all mandatory exclusions required under paragraph (1)(C) have been issued;</text></clause><clause id="id1751882f801e400a870bb6575c71e38a"><enum>(iii)</enum><text>all reimbursements required under paragraph (1)(E) have been made; and</text></clause><clause id="id94b0a11f8d7f42acbb33bf42653a208e"><enum>(iv)</enum><text>includes a list of any grant recipients excluded under paragraph (1) from the previous year.</text></clause></subparagraph></paragraph><paragraph id="id8a78f9b5935a4cdb89c8625d130d4f79"><enum>(4)</enum><header>Prohibition on lobbying activity</header><subparagraph id="iddc29418108214d35a95bd6bbcb601bb2"><enum>(A)</enum><header>In general</header><text>Amounts authorized to be appropriated under this Act, or any amendments made by this Act, may not
			 be utilized by any grant recipient to—</text><clause id="id8f590de8d45f4a5a934c2f026b849f26"><enum>(i)</enum><text>lobby any representative of the Department of Justice regarding the		award of grant
			 funding; or</text></clause><clause id="id9fb72deb8a414e02baac2a2801a8564d"><enum>(ii)</enum><text>lobby any representative of a Federal, state, local, or tribal government		regarding
			 the award of grant funding.</text></clause></subparagraph><subparagraph id="idd2e93b1b8bbc4f4ba79b095c2e6c98b6"><enum>(B)</enum><header>Penalty</header><text>If the Attorney General determines that any recipient of a covered grant has violated subparagraph
			 (A), the Attorney General shall—</text><clause id="idfa4395aa6e974730b91036addcabf8d8"><enum>(i)</enum><text>require the grant recipient to repay the grant in full; and</text></clause><clause id="id240b8fb085d9481eb1888e9c1d42267e"><enum>(ii)</enum><text>prohibit the grant recipient from receiving another covered grant for not	less than 5 years.</text></clause></subparagraph></paragraph></subsection></section></title><title changed="added" committee-id="SSJU00" id="idC620F9B32CC94618ABF0451BE04D9007" reported-display-style="italic" style="OLC"><enum>III</enum><header>Other Matters </header><section id="idF76BADA673814159991E1B25621B0344"><enum>301.</enum><header>Response to missing children and victims of child sex trafficking</header><subsection id="idF61332FDAA694188A8F1E848365C8201"><enum>(a)</enum><header>Missing Children's Assistance Act</header><text>Section 404(b)(1)(P)(iii) of the Missing Children's Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5773">42 U.S.C. 5773(b)(1)(P)(iii)</external-xref>)

			 investigation relating to the missing person.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="id452EABEA9EAF460C9283D7ADA32ED6AD" section-type="subsequent-section"><enum>302.</enum><header>Combat Human Trafficking Act</header><subsection id="idBF8794CD32374E62A47EC98F45350B27"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Combat Human Trafficking Act of 2014</short-title></quote>.</text></subsection><subsection id="idD9322AE6A35A44FBB57C114F073D8E0F"><enum>(b)</enum><header>Bureau of Justice Statistics report on State enforcement of sex trafficking prohibitions</header><paragraph id="idD23727EEC1954182B28F8A63BDA56940"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="idBFCBD46CF8944867993A491CF8A95DEB"><enum>(A)</enum><text>the terms <term>commercial sex act</term>, <term>severe forms of trafficking in persons</term>, <term>State</term>, and <term>Task Force</term> have the meanings given those terms in section 103 of the Trafficking Victims Protection Act
			 of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>);</text></subparagraph><subparagraph id="idA060319968D1409EA3362D4E526D9B2C"><enum>(B)</enum><text>the term <term>covered offense</term> means the provision, obtaining, patronizing, or soliciting of a commercial sex act involving a
			 person subject to severe forms of trafficking in persons; and</text></subparagraph><subparagraph id="id48EB8ABD8A19412E91A225E194A34B72"><enum>(C)</enum><text>the term <term>State law enforcement officer</term> means any officer, agent, or employee of a State authorized by law or by a State government agency
			 to engage in or supervise the prevention, detection, investigation, or
			 prosecution of any violation of criminal law.</text></subparagraph></paragraph><paragraph id="id197A541C1042441883C47EE2AA806887"><enum>(2)</enum><header>Report</header><text>The Director of the Bureau of Justice Statistics shall—</text><subparagraph id="id7522BB5AAACB4983B42F615AAFD809C5"><enum>(A)</enum><text>prepare an annual report on—</text><clause id="idAC683D8D5CD347E0A1E8042E08B8E199"><enum>(i)</enum><text>the rates of—</text><subclause id="idEB695332C4504969883E4D83F188F364"><enum>(I)</enum><text>arrest of individuals by State law enforcement officers for  a covered offense;</text></subclause><subclause id="id6F95570509D843D7B83BB39757577CBE"><enum>(II)</enum><text>prosecution (including specific charges) of individuals in State court systems for  a covered
			 offense; and</text></subclause><subclause id="id04C95381DA0848E78CDEC6B0CA2D36DE"><enum>(III)</enum><text>conviction of individuals in State court systems for  a covered offense; and</text></subclause></clause><clause id="id2BE6D33622B3405BAF902F1DA7CB882A"><enum>(ii)</enum><text>sentences imposed on individuals convicted in State court systems for a covered offense; and</text></clause></subparagraph><subparagraph id="id875A856719EC473287E0374BE5FB2C9D"><enum>(B)</enum><text>submit the annual report prepared under subparagraph (A) to—</text><clause id="id1A354F40261949559461E2C0D9C2FB46"><enum>(i)</enum><text>the Committee on the
			 Judiciary of the House of Representatives;</text></clause><clause id="idE736F9F6FBD5474DA5B6EA05D512F036"><enum>(ii)</enum><text>the Committee on the Judiciary of the Senate;</text></clause><clause id="id78F60311AEEC458AB3642065778C7F1A"><enum>(iii)</enum><text>the Task Force;</text></clause><clause id="idAF23BFFED41D46B39A7E48193B6AA640"><enum>(iv)</enum><text>the Senior Policy Operating Group established under section 105(g) of the Trafficking Victims
			 Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7103">22 U.S.C. 7103(g)</external-xref>); and</text></clause><clause id="id0EE04D971B1349208EE81C02F6CE22B3"><enum>(v)</enum><text>the Attorney General.</text></clause></subparagraph></paragraph></subsection><subsection id="id84647417540E4BCD9B3FB5AF9D501462"><enum>(c)</enum><header>Department of Justice training and policy</header><paragraph id="id7E0A825A3FBD4C3593B4DFDEB3094942"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="idB776A0FABE88467E825C1CF57660DB0F"><enum>(A)</enum><text>the terms <term>commercial sex act</term> and <term>State</term> have the meaning given those terms in section 103 of the Trafficking Victims Protection Act
			 of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>);</text></subparagraph><subparagraph id="id843FAA1F41FF430D8AB9EDDD3B6F745A"><enum>(B)</enum><text>the term <term>Federal law enforcement officer</term> has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/18/115">section 115</external-xref> of title 18, United States Code;</text></subparagraph><subparagraph id="id624CD884C2D143A790669A15BF785486"><enum>(C)</enum><text>the term <term>local law enforcement officer</term> means any officer, agent, or employee of a unit of local government authorized by law or by a
			 local government agency
			 to engage in or supervise the prevention, detection, investigation, or
			 prosecution of any violation of criminal law; and</text></subparagraph><subparagraph id="id32524F200FC04971821D165AC8960D01"><enum>(D)</enum><text>the term <term>State law enforcement officer</term> means any officer, agent, or employee of a State authorized by law or by a State government agency
			 to engage in or supervise the prevention, detection, investigation, or
			 prosecution of any violation of criminal law.</text></subparagraph></paragraph><paragraph id="idD4665F4731254DCBA6708EC5B88FA9A6"><enum>(2)</enum><header>Training</header><text display-inline="yes-display-inline">The Attorney General shall ensure that each anti-human trafficking program operated  by the
			 Department of Justice, including each anti-human trafficking training
			 program for Federal, State, or local law enforcement officers, includes
			 technical training on effective methods for investigating and prosecuting
			 individuals who
			 obtain, patronize, or
			 solicit commercial sex acts.</text></paragraph><paragraph id="idE95ECFF0DE8349138D6A729C97B5A90B"><enum>(3)</enum><header>Policy for Federal law enforcement officers</header><text>The Attorney General shall ensure that Federal law enforcement officers are engaged in activities,
			 programs, or operations involving the detection, investigation, and
			 prosecution of individuals described in paragraph (2).</text></paragraph></subsection><subsection id="id35E69FE348F44A91825D1220A1A1A3D5"><enum>(d)</enum><header>Wiretap authority for human trafficking violations</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2516">Section 2516(1)(c)</external-xref> of title 18, United States Code,  is amended—</text><paragraph id="idD8799467E87F4AFBABFF095CA2B3CE13"><enum><added-phrase committee-id="SSJU00" reported-display-style="italic">(1)</added-phrase></enum><text>by inserting before <quote>section 1591</quote> the following: <quote>section 1581 (peonage), section 1584 (involuntary servitude), section 1589 (forced labor), section
			 1590 (trafficking with respect to peonage, slavery, involuntary servitude,
			 or forced labor),</quote>; and</text></paragraph><paragraph id="idEED4E066CF5645809DEBFF18BF80FB98"><enum><added-phrase committee-id="SSJU00" reported-display-style="italic">(2)</added-phrase></enum><text>by inserting before <quote>section 1751</quote> the following: <quote>section 1592 (unlawful conduct with respect to documents in furtherance of trafficking, peonage,
			 slavery, involuntary servitude, or forced labor),</quote>.</text></paragraph></subsection><subsection id="idAFBF7534CEAA4B07B825026FE6352B94"><enum>(e)</enum><header>Strengthening crime victims' rights</header><paragraph id="id63B3613877EB46A997F603C9D703CABC"><enum>(1)</enum><header>Notification of plea agreement or other agreement</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3771">Section 3771(a)</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idFD955E3356DD422F8B136A1D64D0D329" reported-display-style="italic" style="OLC"><paragraph id="idFD1242BADBC6451DAFB83621CD432B93"><enum>(9)</enum><text>The right to be informed in a timely manner of any plea agreement or deferred prosecution
			 agreement.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id56DDAA744BB048038EC13FC30CA5EF0D"><enum>(2)</enum><header>Appellate review of petitions relating to crime victims' rights</header><subparagraph id="id4C34E7CC3CD342E5B5D55BAD24CB9BBB"><enum>(A)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/3771">Section 3771(d)(3)</external-xref> of title 18, United States Code, is amended by inserting after the fifth
			 sentence the following: <quote>In deciding such application, the court of appeals shall apply ordinary standards of appellate
			 review.</quote>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3DEE1DE98C934A2B811FE36E492311C8"><enum>(B)</enum><header>Application</header><text>The amendment made by paragraph (1) shall apply with respect to any petition for a writ of mandamus
			 filed under <external-xref legal-doc="usc" parsable-cite="usc/18/3771">section 3771(d)(3)</external-xref> of title 18, United States Code, that is
