	<legis-body><section id="ideb6b6e912a4f4d8b977f189fd197a7bd" section-type="section-one"><enum>1.</enum><header>Equal treatment of unaccompanied alien children</header><text display-inline="no-display-inline">Section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008
			 (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232</external-xref>) is amended—</text><paragraph id="id54351CAAADC44826AAC89B09EC96C440"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idE29050799A4E49DDB77BF450DFEDEB0E"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="id82515DD534994C8C91395D162F294A0B"><enum>(i)</enum><text>by amending the paragraph heading to read as follows: <quote><header-in-text level="paragraph" style="OLC">Rules for unaccompanied alien children</header-in-text></quote>;</text></clause><clause id="id01243316D0154402ACE5AEC7E160DD14"><enum>(ii)</enum><text>in subparagraph (A), by striking <quote>who is a national or habitual resident of a country that is contiguous with the United States</quote>;</text></clause><clause id="id285FBB9A79D8418E941BBB7A6E54D137"><enum>(iii)</enum><text>in subparagraph (B)—</text><subclause id="idA23C4990E6F248A6B00885C3E1D77353"><enum>(I)</enum><text>in the matter preceding clause (i), by striking <quote>may</quote> and inserting <quote>shall</quote>; and</text></subclause><subclause id="id9EE124CD7B15443D8B5EDE4A0B8454D5"><enum>(II)</enum><text>in clause (ii), by inserting <quote>not later than 72 hours after the child is screened under paragraph (4) by placing the child on the
			 next available flight to such country, subject to determinations of cost,
			 feasibility and any repatriation agreements with such country</quote> before the period at the end; and</text></subclause></clause><clause id="id82D66187058C4B0893B03A3BE58AAA14"><enum>(iv)</enum><text>in subparagraph (C), by striking <quote>countries contiguous to the United States</quote> and inserting <quote>countries from which large numbers of unaccompanied alien children are unlawfully entering the
			 United States</quote>;</text></clause></subparagraph><subparagraph id="idB1FB65A90B064F1D802057F504A8FA44"><enum>(B)</enum><text>in paragraph (4)—</text><clause id="id37DB13864B4D40689CED93E893AD5E3D"><enum>(i)</enum><text>by striking <quote>Within 48 hours of</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id0B78EF776DEB4F5895F59CAFF9DAAE23" style="OLC"><subparagraph id="id1737602B35BC419AB4C85EDC9DFB440D"><enum>(A)</enum><header>In general</header><text>Not later than 48 hours after</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id6CB61DF56FF540E9AE936CFA27192054"><enum>(ii)</enum><text>by striking <quote>Nothing in this paragraph</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="idE3BF463EF03441F68E2EFB10B43B5630" style="OLC"><subparagraph id="id8716891344D04A30B65EE59CBB8DF711"><enum>(B)</enum><header>Gang affiliation</header><text>If an immigration officer determines that an unaccompanied alien child is, or has been, affiliated
			 with a criminal street gang (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/521">section 521(a)</external-xref> of title 18,
			 United States Code), the child shall be treated in accordance with
			 paragraph (2)(B).</text></subparagraph><subparagraph id="id45030898974B45E491D54351E81A24E8"><enum>(C)</enum><header>Savings provision</header><text>Nothing in this paragraph</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idCEC3A0652CD14EB6AAAAB419660970D8"><enum>(C)</enum><text>in paragraph (5)(D), by striking <quote>from a contiguous country subject to exceptions under subsection (a)(2)</quote> and inserting <quote>described in paragraph (2)(A)</quote>; and</text></subparagraph></paragraph><paragraph id="id6F0D8D216B8549F9B4900CE84B8919BE"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id38331CD2171544ACA6C0D95A15580C14"><enum>(A)</enum><text>by striking paragraphs (2) through (4);</text></subparagraph><subparagraph id="idCCF0ECE58927472EA39DD2EDDBF21D8E"><enum>(B)</enum><text>by redesignating paragraphs (5) and (6) as paragraphs (3) and (4), respectively; and</text></subparagraph><subparagraph id="id57A7AD436E9843328595F1DF44EC2F22"><enum>(C)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="id39D165DC677C41F6B22B1867CB35907F" style="OLC"><paragraph id="id4130B47F8AD44FC3A75FFE9B13DEBBC5"><enum>(2)</enum><header>Mandatory detention for unaccompanied alien children</header><text>An
			 unaccompanied alien child who is apprehended by U.S. Border Patrol or U.S.
			 Immigration and Customs Enforcement shall be detained and remain in
			 the custody of the Department of Homeland Security until the child—</text><subparagraph id="id8A09403C2A3C45AFA91D3E6708682735"><enum>(A)</enum><text>voluntarily departs from the United States in accordance with section 240B of the Immigration and
			 Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229c">8 U.S.C. 1229c</external-xref>);</text></subparagraph><subparagraph id="id30000DD2F3A444C8858D2F9F426D5C06"><enum>(B)</enum><text>is expeditiously removed from the United States in accordance with—</text><clause id="idEEA1B6F4C6884FA38DC8DFB933F3C6DE"><enum>(i)</enum><text>an order of removal issued in accordance with section 235(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)</external-xref>);
			 or</text></clause><clause id="id32CF43AC9DBA41288A85062A74EE8CDD"><enum>(ii)</enum><text>a final order of removal issued at the conclusion of special removal proceedings conducted pursuant
			 to section 240 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a</external-xref>); or</text></clause></subparagraph><subparagraph id="id36DE43E172174132A011A243FBE380BB"><enum>(C)</enum><text>is legally admitted into the United States as—</text><clause id="idC8B654C29F59411F92C6AE3DC95134A5"><enum>(i)</enum><text>a refugee under section 207 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>); or</text></clause><clause id="idCC05A2E601EA43829898AB0C71368DBB"><enum>(ii)</enum><text>an asylee under section 208 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="id74733254ED3D453AA33AD4E3EF047716"><enum>2.</enum><header>Expedited due process and screening of unaccompanied alien children</header><subsection id="idCEE5B4E9138F4070AED39DC6DF07F268"><enum>(a)</enum><header>In general</header><text>Chapter 4 of the Immigration and Nationality Act is amended by inserting after section 235A the
			 following:</text><quoted-block display-inline="no-display-inline" id="idb3d1997e54764ba296c1f7fb67986f19" style="OLC"><section id="idaa5ad225494342c0aa6c97646603f9f9"><enum>235B.</enum><header>Humane and expedited inspection and screening for unaccompanied alien children</header><subsection id="id69C0F24F1B6B4B5CAB7C2691083EF5FA"><enum>(a)</enum><header>Defined term</header><text>In this section, the term <term>asylum officer</term> means an immigration officer who—</text><paragraph id="id4CC09FA2B8E84948B6ADE17F7AE6B648"><enum>(1)</enum><text>has had professional training in country conditions, asylum law, and interview techniques
			 comparable to that provided to full-time adjudicators of applications
			 under section 208, and</text></paragraph><paragraph id="id6458996489724216ADD21BB561BA8643"><enum>(2)</enum><text>is supervised by an officer who—</text><subparagraph id="idE13D120D1A864CD7A2BD617D6E63683A"><enum>(A)</enum><text>meets the condition described in paragraph (1); and</text></subparagraph><subparagraph id="idA122506DE97447789C0BA07BB26DAA6D"><enum>(B)</enum><text>has had substantial experience adjudicating asylum applications.</text></subparagraph></paragraph></subsection><subsection id="id9b2895c306ad4e878a24dcbc1336a144"><enum>(b)</enum><header>Proceeding</header><paragraph id="ida6f154ad5dc44b2e95a689d95510e5c8"><enum>(1)</enum><header>In general</header><text>Not later than 7 days after the screening of an unaccompanied alien child under section 235(a)(4)
			 of the <short-title>William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/8/1232">8 U.S.C. 1232(a)(4)</external-xref>), an immigration judge shall conduct a proceeding to inspect, screen, and
			 determine the status of an unaccompanied alien child who is an applicant
			 for admission to the United States.</text></paragraph><paragraph id="idc4b436f99d614109a1392dc74485ad69"><enum>(2)</enum><header>Biometric data collection</header><text>The inspection and screening required under paragraph (1) shall include the collection of biometric
			 data from each unaccompanied alien child, including photographs and
			 fingerprints.</text></paragraph><paragraph id="idACA835E8450D4CDD86ABC365E0CBC5C5"><enum>(3)</enum><header>Time limit</header><text>Not later than 72 hours after the conclusion of a proceeding with respect to an unaccompanied alien
			 child under this section, the immigration judge who conducted such
			 proceeding shall issue an order pursuant to subsection (e).</text></paragraph></subsection><subsection id="ide6753ff5a78f49d3aab0d718d003fd1b"><enum>(c)</enum><header>Conduct of proceeding</header><paragraph id="id15dff962018f4166bd81fd228dcbe7b3"><enum>(1)</enum><header>Authority of immigration judge</header><text>The immigration judge conducting a proceeding under this section—</text><subparagraph id="idA415552A04484D75BB251720AAB9C5B9"><enum>(A)</enum><text>shall administer oaths, receive evidence, and interrogate, examine, and cross-examine the alien and
			 any witnesses;</text></subparagraph><subparagraph id="id3DEEA73EA09C4FA68385F81DB5FC81E0"><enum>(B)</enum><text>may issue subpoenas for the attendance of witnesses and presentation of evidence; and</text></subparagraph><subparagraph id="id76912F6563814145A986B22930CF78D2"><enum>(C)</enum><text>is authorized to sanction by civil money penalty any action (or inaction) in contempt of the
			 judge’s proper exercise of authority under this Act.</text></subparagraph></paragraph><paragraph id="id066be637ed854b418626054872dd5b52"><enum>(2)</enum><header>Form of proceeding</header><text>A proceeding under this section may take place—</text><subparagraph id="id4d8531a150f54485b351d0b71a3d416f"><enum>(A)</enum><text>in person;</text></subparagraph><subparagraph id="ide6adb3eaa3a241db9936af3c20bb62d2"><enum>(B)</enum><text>at a location agreed to by the parties, in the absence of the alien;</text></subparagraph><subparagraph id="id7958030d6cf04ce58d2fdc5a95eed4c1"><enum>(C)</enum><text>through video conference; or</text></subparagraph><subparagraph id="idae4ce20c6b424d3bac6db53b7703a209"><enum>(D)</enum><text>through telephone conference.</text></subparagraph></paragraph><paragraph id="id95de6b69e638496b911a4c0a11816bcc"><enum>(3)</enum><header>Presence of alien</header><text>If it is impracticable by reason of an alien's mental incompetency for the alien to be present at
			 the proceeding, the Attorney General shall prescribe safeguards to protect
			 the rights and privileges of the alien.</text></paragraph><paragraph id="id6048ff753a9345b296e736e6c3a10dda"><enum>(4)</enum><header>Rights of the alien</header><text>In a proceeding under this section—</text><subparagraph id="idaec82e42a8f04f0cb15f8fcaae7306b6"><enum>(A)</enum><text>the alien shall be given the privilege of being represented, at no expense to the Government, by
			 counsel of the alien’s choosing who is authorized to practice in such
			 proceedings;</text></subparagraph><subparagraph id="idaead5d04d1d14ccc84e3ff31556e5653"><enum>(B)</enum><text>the alien shall be given a reasonable opportunity—</text><clause id="id9C215A32A672495C9531F0BDEE8E0339"><enum>(i)</enum><text>to examine the evidence against the alien;</text></clause><clause id="id1531A7984EE64C139D84F7471B5C40B5"><enum>(ii)</enum><text>to present evidence on the alien’s own behalf; and</text></clause><clause id="id38FD18E9363C42BDBBA47E79373E2CA9"><enum>(iii)</enum><text>to cross-examine witnesses presented by the Government;</text></clause></subparagraph><subparagraph id="id1A93788A15C5463ABA26FB0A85B3A3CE"><enum>(C)</enum><text>the rights set forth in subparagraph (B) shall not entitle the alien—</text><clause id="id10EF7C5A6A284117948D0D02D6D61114"><enum>(i)</enum><text>to examine such national security information as the Government may proffer in opposition to the
			 alien’s admission to the United States; or</text></clause><clause id="id55567D5EFC054374BBBC863EE1B2F410"><enum>(ii)</enum><text>to an application by the alien for discretionary relief under this Act; and</text></clause></subparagraph><subparagraph id="id909400c6d46e43bc9f8408e48495ac4f"><enum>(D)</enum><text>a complete record shall be kept of all testimony and evidence produced at the proceeding.</text></subparagraph></paragraph><paragraph id="idc473f91be8e24d6cb554b6b64e8e8eb6"><enum>(5)</enum><header>Withdrawal of application for admission</header><text>In the discretion of the Attorney General, an alien applying for admission to the United States
			 may,  and at any time, be permitted to withdraw such application and
			 immediately be returned to the alien’s country of nationality or country
			 of last habitual residence.</text></paragraph></subsection><subsection id="idb3f9f4bba9e94809ab4e1998f57b1e53"><enum>(d)</enum><header>Decision and burden of proof</header><paragraph id="id67b4223d6e64450d8c828d1a3586f8df"><enum>(1)</enum><header>Decision</header><subparagraph id="idd5c27c012f4b40379d37ec1ab5247266"><enum>(A)</enum><header>In general</header><text>At the conclusion of a proceeding under this section, the immigration judge shall determine whether
			 an unaccompanied alien child is likely to be—</text><clause id="idC38F03C00EA342DBAE0D79C124590435"><enum>(i)</enum><text>admissible to the United States; or</text></clause><clause id="id225A3D0E351A49EE95837EFF61C6DCCE"><enum>(ii)</enum><text>eligible for any form of relief from removal under this Act.</text></clause></subparagraph><subparagraph id="id102D5E44981D4B558C86DF90E7209F48"><enum>(B)</enum><header>Evidence</header><text>The determination of the immigration judge under subparagraph (A) shall be based only on the
			 evidence produced at the hearing.</text></subparagraph></paragraph><paragraph id="id553931976dc84bf3af2efaa7d6404844"><enum>(2)</enum><header>Burden of proof</header><subparagraph id="idE21E275C1CFE42529A37A181343F8D87"><enum>(A)</enum><header>In general</header><text>In a proceeding under this section, an alien who is an applicant for admission has the burden of
			 establishing, by a preponderance of the evidence, that the alien—</text><clause id="id1B310DCF49894712BBE0B4BB12C704A4"><enum>(i)</enum><text>is likely to be entitled to be lawfully admitted to the United States or eligible for any form of
			 relief from removal under this Act; or</text></clause><clause id="idbaac587bac89456086f24170bd587c6d"><enum>(ii)</enum><text>is lawfully present in the United States pursuant to a prior admission.</text></clause></subparagraph><subparagraph id="ida3bad0ca789648639ec84de34d10250a"><enum>(B)</enum><header>Access to documents</header><text>In meeting the burden of proof under subparagraph (A)(ii), the alien shall be given access to—</text><clause id="id381657314E0C4DA0A579F2AF438D5B7E"><enum>(i)</enum><text>the alien’s visa or other entry document, if any; and</text></clause><clause id="idD6F19A2E58E44C779D61084C73E92EBA"><enum>(ii)</enum><text>any other records and documents, not considered by the Attorney General to be confidential,
			 pertaining to the alien’s admission or presence in the United States.</text></clause></subparagraph></paragraph></subsection><subsection id="id3bbe5d7874fe428080f9c5356bacf8ca"><enum>(e)</enum><header>Orders</header><paragraph id="id9b7fa626540949eba503a692f5a9c1d1"><enum>(1)</enum><header>Placement in further proceedings</header><text>If an immigration judge determines that the unaccompanied alien child has met the burden of proof
			 under subsection
			 (d)(2), the judge shall order the alien to be placed in further
			 proceedings in accordance with section 240.</text></paragraph><paragraph id="id1d575be54490413bb53e45794422aa9c"><enum>(2)</enum><header>Orders of removal</header><text>If an immigration judge determines that the unaccompanied alien child has not met the burden of
			 proof required
			 under subsection (d)(2), the judge shall order the alien removed from the
			 United States without further hearing or review unless the alien claims—</text><subparagraph id="id3A1BDCA90D1E4A8697BE56723F2A66CF"><enum>(A)</enum><text>an intention to apply for asylum under section 208; or</text></subparagraph><subparagraph id="id2DFD5BD00533495DAE45CE661553F114"><enum>(B)</enum><text>a substantiated fear of persecution.</text></subparagraph></paragraph><paragraph id="id34fc8e613fbb42d5872f0effcb8d5d34"><enum>(3)</enum><header>Claims for asylum</header><text>If an unaccompanied alien child described in paragraph (2) claims an intention to apply for asylum
			 under section 208 or a substantiated fear of persecution, the officer
			 shall order the
			 alien referred for an interview by an asylum officer under subsection (f).</text></paragraph></subsection><subsection id="id964d604b9f6e4e7abb51f6bdd9ed335a"><enum>(f)</enum><header>Asylum interviews</header><paragraph id="id464acb589b4e4cb7be385787da9ca23e"><enum>(1)</enum><header>Defined term</header><text>In this subsection, the term <term>substantiated fear of persecution</term> means, after taking into account the credibility of the statements made by the alien in support of
			 the alien’s claim and such other facts as are known to the officer, there
			 is a significant possibility that the alien could establish eligibility
			 for asylum under section 208.</text></paragraph><paragraph id="id6882416b6e4141d3a03d53f0f6dff493"><enum>(2)</enum><header>Conduct by asylum officer</header><text>An asylum officer shall conduct interviews of aliens referred under subsection (e)(3).</text></paragraph><paragraph id="idaa39088d8a09430983f70af93e30c8dc"><enum>(3)</enum><header>Referral of certain aliens</header><text>If the officer determines at the time of the interview that an alien has a substantiated fear of
			 persecution, the alien shall be held in the custody of the Secretary of
			 Health and Human Services pursuant to section 235(b) of the William
			 Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 (8
			 U.S.C. 1232(b)) during further consideration of the application for
			 asylum.</text></paragraph><paragraph id="id6e25fae6fe6841399a53dc458973f5df"><enum>(4)</enum><header>Removal without further review if no substantiated fear of persecution</header><subparagraph id="id7eadad536ec84a44b45ba52e36ab0d06"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (C), if the asylum officer determines that an alien does not have a
			 substantiated fear of persecution, the officer shall order the alien
			 removed
			 from the United States without further hearing or review.</text></subparagraph><subparagraph id="id87ec5ade33394ba2824c579a6efd07ab"><enum>(B)</enum><header>Record of determination</header><text>The officer shall prepare a written record of a determination under subparagraph (A), which shall
			 include—</text><clause id="idF6041848B5C84A688AB541727B63295B"><enum>(i)</enum><text>a summary of the material facts as stated by the applicant;</text></clause><clause id="id886B2FAD786B46B1964FE838432B0D42"><enum>(ii)</enum><text>such additional facts (if any) relied upon by the officer;</text></clause><clause id="id75A402CCFAB04F459F2E4C73DCA35EE9"><enum>(iii)</enum><text>the officer's analysis of why, in light of such facts, the alien has not established a
			 substantiated
			 fear of persecution; and</text></clause><clause id="id54459DF5FFE0489BAA02572FB2B04024"><enum>(iv)</enum><text>a copy of the officer’s interview notes.</text></clause></subparagraph><subparagraph id="id189fd3347c864742834d845df7a8bdef"><enum>(C)</enum><header>Review of determination</header><clause id="id6777E6DD9E1049F2ADD307BADD3F7EDE"><enum>(i)</enum><header>Rulemaking</header><text>The Attorney General shall establish, by regulation, a process by which an immigration judge will
			 conduct a prompt review, upon the alien’s request,  of a determination
			 under subparagraph (A) that the alien does not have a substantiated fear
			 of
			 persecution.</text></clause><clause id="id78D3EDDD8C5E40D7B2C5EE786783E8AA"><enum>(ii)</enum><header>Mandatory components</header><text>The review described in clause (i)—</text><subclause id="idE8C9DA49A161412D8689CCBE43056E03"><enum>(I)</enum><text>shall include an opportunity for the alien to be heard and questioned by the immigration judge,
			 either in person or by telephonic or video connection; and</text></subclause><subclause id="idD915890094044E2F9A552841685CF28A"><enum>(II)</enum><text>shall be conducted—</text><item id="id808B06F6AA3C4E999B31493E0F811F21"><enum>(aa)</enum><text>as expeditiously as possible;</text></item><item id="id47AF9A7D4FA54BB28370E60EBAA309FE"><enum>(bb)</enum><text>within the 24-hour period beginning at the time the asylum officer makes a determination under
			 subparagraph (A), to the maximum extent practicable; and</text></item><item id="id573E20B62B414D368D229C0F1997D840"><enum>(cc)</enum><text>in no case later than 7 days after such determination.</text></item></subclause></clause></subparagraph><subparagraph id="id36acab3d13a84dcbb7235715aa479105"><enum>(D)</enum><header>Mandatory protective custody</header><text>Any alien subject to the procedures under this paragraph shall be held in the custody of the
			 Department of Homeland Security—</text><clause id="id651439F54592409FA7409E9092FF9E5C"><enum>(i)</enum><text>pending a final determination of substantiated fear of persecution; and</text></clause><clause id="id65ECB4FF20D54150BF96DACD4667122D"><enum>(ii)</enum><text>after a determination that the alien does not have such a fear, until the alien is removed.</text></clause></subparagraph></paragraph></subsection><subsection id="idccef80bd629049ef99a1264f4ef77525"><enum>(g)</enum><header>Limitation on administrative review</header><paragraph id="idDCA216AE8CA24D3C93EAA50DC44587B4"><enum>(1)</enum><header>In general</header><text>Except as provided in subsection (f)(4)(C) and paragraph (2), a removal order entered in accordance
			 with subsection (e)(2) or (f)(4)(A) is not subject to administrative
			 appeal.</text></paragraph><paragraph id="id6C8D8F07EF93499496F69A6A92DCBA2D"><enum>(2)</enum><header>Rulemaking</header><text>The Attorney General shall establish, by regulation, a process for the prompt review of an order
			 under subsection (e)(2) against an alien who claims under oath, or as
			 permitted under penalty of perjury under <external-xref legal-doc="usc" parsable-cite="usc/28/1746">section 1746</external-xref> of title 28, United
			 States Code, after having been warned of the penal ties for falsely making
			 such claim under such conditions to have been—</text><subparagraph id="id23B2094EF5294C2F9E73126C0F2B6C44"><enum>(A)</enum><text>lawfully admitted for permanent residence;</text></subparagraph><subparagraph id="id1917F5455E3B411897BD6A8731396B9D"><enum>(B)</enum><text>admitted as a refugee under section 207; or</text></subparagraph><subparagraph id="id5AAD70241C864502973C81954360CB60"><enum>(C)</enum><text>granted asylum under section 208.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idF3DBA1D052704C48BF9C8B0EC2C29C2A"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended
			 by inserting after the item relating to section 235A the following:</text><quoted-block id="id1f4d939b-f4fa-4361-be22-a938441f8785" style="OLC"><toc><toc-entry idref="idaa5ad225494342c0aa6c97646603f9f9" level="section">Sec. 235B. Humane and expedited inspection and screening for unaccompanied alien children.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id2BBB137C913C48109DAE2A39251D1E58"><enum>3.</enum><header>Asylum seekers</header><subsection id="id739abcb9adb7483fbf9dc3e1307e04c3"><enum>(a)</enum><header>Refugee defined</header><text>Section 101(a)(42) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(42)</external-xref>) is amended—</text><paragraph id="idE36D7A4FBDAF4F6D97E7F54AF973B407"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>because of persecution or a well-founded fear of persecution
			 on account of</quote> and inserting <quote>the alien’s life or freedom would be threatened in that country because of the alien’s</quote>; and</text></paragraph><paragraph id="id565719C26C9246D1BA3D177DD3735471"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>who is
			 persecuted or who has a well-founded fear of persecution on account of</quote> and inserting <quote>the person’s life or freedom is threatened if the person remains in that country because of the
			 person’s</quote>.</text>
				</paragraph></subsection><subsection id="ida1402bad9faa423abb77c2732ac9ea8f"><enum>(b)</enum><header>Mandatory detention</header><text>Section 208(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(d)</external-xref>) is amended by adding at
			 the end the following:</text><quoted-block display-inline="no-display-inline" id="idD6F4C28F77F6414F8C93E203D6C4EF81" style="OLC"><paragraph id="id5EE611ECB996493A9380AC6D0A272FF8"><enum>(8)</enum><header>Detention</header><text>The Secretary of Homeland Security shall detain any alien seeking asylum under this section until
			 the alien—</text><subparagraph id="id59962A18870C4C6C94EB3ED328D12B2A"><enum>(A)</enum><text>is removed from the United States in accordance with—</text><clause id="idE5BE835FD98C455EAF6AFA6E52F1B663"><enum>(i)</enum><text>an order of removal issued in accordance with section 235(b)(1); or</text></clause><clause id="id07C5CD05A62A435EBEA755693DFE9389"><enum>(ii)</enum><text>a final order of removal issued at the conclusion of special removal proceedings conducted pursuant
			 to section 240; or</text></clause></subparagraph><subparagraph id="id639FA001FAEC4E97B930B2F102136D8A"><enum>(B)</enum><text>granted asylum under subsection (b).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id62ba7a05f40d47e99e0737c432bbb028"><enum>4.</enum><header>Extension of bar to reentry</header><text display-inline="no-display-inline">Section 212(a)(9) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)</external-xref>) is amended—</text><paragraph id="id423A8EB9C07C4C10B7E40153E8602473"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)(i) by striking <quote>5 years</quote> and inserting <quote>10 years</quote>; and</text></paragraph><paragraph id="idB4B7DEC2DA2949B59637D988D804097C"><enum>(2)</enum><text>in subparagraph (B)(i)(I), by striking <quote>3 years</quote> and inserting <quote>10 years</quote>.</text></paragraph></section><section id="idD067BFB599884B7D9B2AA0A88B485D47"><enum>5.</enum><header>Reporting requirement</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall submit an annual report to Congress that identifies, for
			 the previous 12-month period—</text><paragraph id="idD1571671BEED485E9D3089FB2E169FF9"><enum>(1)</enum><text>the number of aliens unlawfully present in the United States who were apprehended by, or placed in
			 the physical custody of, U.S. Border Patrol or U.S. Immigration and
			 Customs Enforcement;</text></paragraph><paragraph id="id1CB623F6A9AB4C7DB69139EFD719135E"><enum>(2)</enum><text>the number of aliens described in paragraph (1) who were deported from the United States pursuant
			 to a final order of removal;</text></paragraph><paragraph id="idA5CC08991AC34FBBAC845BDBD77BFA95"><enum>(3)</enum><text>the number of aliens described in paragraph (1) who departed from the United States without an
			 order of removal (voluntary departures); and</text></paragraph><paragraph id="id6B65590433174E8DBD2C2F46A8520DB0"><enum>(4)</enum><text>the number of aliens who were granted refugee status or asylum.</text></paragraph></section></legis-body>
