			 penalties</header>
			<subsection commented="no" id="id552890FFA24942ACBE68AC6927EE8457"><enum>(a)</enum><header>In
			 general</header><text>Part I of title 18, United States Code, is amended by
			 inserting after chapter 101 the following:</text>

						</toc>
						<section commented="no" id="id126E694D0CFF4310802310B0158BA04B"><enum>2081.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text>
							<paragraph id="id6FEFF896509347C0907126C65A218E67"><enum>(1)</enum><text>the term
				<term>appropriate Federal agency</term> means an agency with jurisdiction over
				a covered product, covered service, or business practice;</text></paragraph><paragraph id="id1263C45AC4844895A9C7FF2D5FC2B7B4"><enum>(2)</enum><text>the term
				<term>business entity</term> means a corporation, company, association, firm,
				partnership, sole proprietor, or other business entity;</text>
							</paragraph><paragraph id="id2B83BF22D51E4D4EBCD7BB8D86082503"><enum>(3)</enum><text>the term
				<term>business practice</term> means a method or practice of—</text>
								<subparagraph id="id06A1DCB3D9914CAEA20DF51DE80AEFA2"><enum>(A)</enum><text>manufacturing,
				assembling, designing, researching, importing, or distributing a
			 covered
				product;</text>
								</subparagraph><subparagraph id="id8CD1A253E2304DAC8D12829F00352903"><enum>(B)</enum><text>conducting,
				providing, or preparing to provide a covered service; or</text>
								</subparagraph><subparagraph id="id3AF2FE632E114ABC93E06D1047E17F16"><enum>(C)</enum><text>otherwise
				carrying out business operations relating to covered products or
			 covered
				services;</text>
								</subparagraph></paragraph><paragraph id="idF4B3734D7FC440AF8E33F4145553FEBE"><enum>(4)</enum><text>the term
				<term>covered product</term> means a product manufactured, assembled, designed,
				researched, imported, or distributed by a business entity that
			 enters
				interstate commerce;</text>
							</paragraph><paragraph id="id4ADA32F7780043E98218388251721851"><enum>(5)</enum><text>the term
				<term>covered service</term> means a service conducted or provided by a
				business entity that enters interstate commerce;</text>
							</paragraph><paragraph id="id673F4008278F44BBA81C1202C5D2B21D"><enum>(6)</enum><text>the term <term>responsible corporate officer</term> means a
				person who—</text>
								<subparagraph id="id889D0154F81C4360BF9531C2CF7F77AD"><enum>(A)</enum><text>is an employer,
				director, or officer of a business entity;</text>
								</subparagraph><subparagraph id="idADD28893A79E4146B8F841231FCE568D"><enum>(B)</enum><text>has the
				responsibility and authority, by reason of his or her position in
			 the business
				entity and in accordance with the rules or practice of the business
			 entity, to
				acquire knowledge of any serious danger associated with a covered
			 product (or
				component of a covered product), covered service, or business
			 practice of the
				business entity; and</text>
								</subparagraph><subparagraph id="id57BF37B0EC194AA4B132BA4B31D6EFB2"><enum>(C)</enum><text>has the
				responsibility, by reason of his or her position in the business
			 entity, to
				communicate information about the serious danger to—</text>
									<clause id="id44CD5933E5424DDFBE690F2002C84760"><enum>(i)</enum><text>an appropriate
				Federal agency;</text>
									</clause><clause id="id8625D4E9B578424D8D782629A3CA7C88"><enum>(ii)</enum><text>employees of the
				business entity; or</text>
									</clause><clause id="id1B83AE4D59F54A25B613B1475439AF69"><enum>(iii)</enum><text>individuals,
				other than employees of the business entity, who may be exposed to
			 the serious
				danger;</text>
									</clause></subparagraph></paragraph><paragraph id="id61FB3023D02F44CA9E4AE25BA4A142C0"><enum>(7)</enum><text>the term
				<term>serious bodily injury</term> means an impairment of the physical
				condition of an individual, including as a result of trauma,
			 repetitive motion,
				or disease, that—</text>
								<subparagraph id="id6DCEAD8A3E944CA3BAD6D7CD22415B80"><enum>(A)</enum><text>creates a
				substantial risk of death; or</text>
								</subparagraph><subparagraph id="id3A66EB3EB8494050B0A02CA1C5FE6AB6"><enum>(B)</enum><text>causes—</text>
									<clause id="id448DC5E1521549719B34BD1B91AC60D4"><enum>(i)</enum><text>serious permanent
				disfigurement;</text>
									</clause><clause id="idFB509026A50F46408474AC05FB597115"><enum>(ii)</enum><text>unconsciousness;</text>
									</clause><clause id="id6731E2A8E23D479A979B1D3D5B46B5E8"><enum>(iii)</enum><text>extreme pain;
				or</text>
									</clause><clause id="idDC9E7AEF54834873A321466E8336CB80"><enum>(iv)</enum><text>permanent or
				protracted loss or impairment of the function of any bodily member,
			 organ,
				bodily system, or mental faculty;</text>
									</clause></subparagraph></paragraph><paragraph id="id0C95EC962C57493C87B3B103A0EEB40E"><enum>(8)</enum><text>the term
				<term>serious danger</term> means a danger, not readily apparent to a
				reasonable person, that the normal or reasonably foreseeable use
			 of, or the
				exposure of an individual to, a covered product, covered service,
			 or business
				practice has an imminent risk of causing death or serious bodily
			 injury to an
				individual; and</text>
							</paragraph><paragraph id="id2009A82DE73A4BD382FC7F2AC2AA5EE3"><enum>(9)</enum><text>the term
				<term>warn affected employees</term> means take reasonable steps to give, to
				each individual who is exposed or may be exposed to a serious
			 danger in the
				course of work for a business entity, a description of the serious
			 danger that
				is sufficient to make the individual aware of the serious danger.</text>
							</paragraph></section><section id="id4796FC372B5D49A38D1C1C6931C4B444"><enum>2082.</enum><header>Failure to
				inform and warn</header>
							<subsection id="id9e1012ae29b94c8f86caec04c2303a49"><enum>(a)</enum><header>Requirement</header><text>After acquiring actual knowledge of a serious danger associated with a covered product (or
			 component of a covered product), covered service, or business practice of
			 a business entity, a business entity and any responsible corporate officer
			 with respect to the covered product, covered service, or business
			 practice, shall—</text><paragraph id="id929aaf244507423399b03ef810be11d9"><enum>(1)</enum><text>as soon as practicable and not later than 24 hours after acquiring such knowledge, verbally inform
			 an appropriate Federal agency of the serious
			 danger, unless the business entity or responsible corporate officer has
			 actual knowledge that an appropriate Federal agency has been so informed;</text></paragraph><paragraph id="id0800dbd3b8454217892e7d8315af97da"><enum>(2)</enum><text>not later than 15 days after acquiring such knowledge, inform an appropriate Federal agency in
			 writing of the serious danger;</text></paragraph><paragraph id="id54a7668c5d0443919dcc0d08d2a79518"><enum>(3)</enum><text>as soon as practicable, warn affected employees in writing, unless the business entity or
			 responsible corporate officer has actual knowledge that affected employees
			 have been so warned; and</text></paragraph><paragraph id="id9ef9d65a9a0c47c58a317d78d3bbe550"><enum>(4)</enum><text>as soon as practicable, inform individuals, other than affected employees, who may be exposed to
			 the serious danger of the serious danger if such individuals can
			 reasonably be identified.</text></paragraph></subsection><subsection id="id269A3908ADBE40D1B1997E0744804C49"><enum>(b)</enum><header>Penalty</header>
								<paragraph id="idDF8166BDC263422E8F13EBDEA3C389B7"><enum>(1)</enum><header>In
				general</header><text>Whoever knowingly violates subsection (a) shall be fined
				under this title, imprisoned for not more than 5 years, or both.</text>
								</paragraph><paragraph id="id921A2ACC1A624078A69BA28A0B0FA629"><enum>(2)</enum><header>Prohibition of
				payment by business entities</header><text>If a final judgment
				is rendered and a fine is imposed on an individual
				under this subsection, the fine may not be paid, directly or
			 indirectly, out of
				the assets of any business entity on behalf of the individual.</text>
								</paragraph></subsection><subsection id="id2A311ECB36DA43C2BB7F4C4D2E7D4D4E"><enum>(c)</enum><header>Civil action To
				protect against retaliation</header>
								<paragraph id="id19E34E16DA0C4754ABF194A5AA8ABB95"><enum>(1)</enum><header>Prohibition</header><text>It
				shall be unlawful to knowingly discriminate against any person in
			 the terms or
				conditions of employment, in retention in employment, or in hiring
			 because the
				person informed a Federal agency, warned employees, or informed
			 other
				individuals of a serious danger associated with a covered product,
			 covered
				service, or business practice, as required under this section.</text>
								</paragraph><paragraph id="id56D076750A54463CA55E1A8EA67B517C"><enum>(2)</enum><header>Enforcement
				action</header>
									<subparagraph id="id4748F1E87AEF49C88FF404FF1A1CA08F"><enum>(A)</enum><header>In
				general</header><text>A person who alleges discharge or other discrimination by
				any person in violation of paragraph (1) may seek relief under
			 paragraph (3),
				by—</text>
										<clause id="idA5A7703459364205A4A2CA3AB7482852"><enum>(i)</enum><text>filing a
				complaint with the Secretary of Labor; or</text>
										</clause><clause id="id3560EFECD75545ECBBA7DBC8A68883B2"><enum>(ii)</enum><text>if the Secretary
				has not issued a final decision within 180 days of the filing of
			 the complaint
				and there is no showing that such delay is due to the bad faith of
			 the
				claimant, bringing an action at law or equity for de novo review in
			 the
				appropriate district court of the United States, which shall have
			 jurisdiction
				over such an action without regard to the amount in controversy.</text>
										</clause></subparagraph><subparagraph id="id499485CCD5AE44F9A22C7A3C65ED0436"><enum>(B)</enum><header>Procedure</header>
										<clause id="id3D82C95172FA493897EAC90ED3BAB385"><enum>(i)</enum><header>In
				general</header><text>An action under subparagraph (A)(i) shall be governed
				under the rules and procedures set forth in section 42121(b) of
			 title
				49.</text>
										</clause><clause id="id4639A46B7899418ABE038A9763092731"><enum>(ii)</enum><header>Exception</header><text>Notification
				made under <external-xref legal-doc="usc" parsable-cite="usc/49/42121">section 42121(b)(1)</external-xref> of title 49 shall be made to the
			 person named in
				the complaint and to the employer.</text>
										</clause><clause id="idC9C438292A6F4DD2881F418B8197295A"><enum>(iii)</enum><header>Burdens of
				proof</header><text>An action brought under subparagraph (A)(ii) shall be
				governed by the legal burdens of proof set forth in section
			 42121(b) of title
				49.</text>
										</clause><clause id="id60AC81C9527F449E8A138F030B05A5FC"><enum>(iv)</enum><header>Statute of
				limitations</header><text>An action under subparagraph (A) shall be commenced
				not later than 180 days after the date on which the violation
			 occurs, or after
				the date on which the employee became aware of the violation.</text>
										</clause><clause id="id0E526E45167C42649F0284AB2F8931D2"><enum>(v)</enum><header>Jury
				trial</header><text>A party to an action brought under subparagraph (A)(ii)
				shall be entitled to trial by jury.</text>
										</clause></subparagraph></paragraph><paragraph id="id2EA6B37331E3499DAE0990AA30C815B6"><enum>(3)</enum><header>Remedies</header>
									<subparagraph id="id196150880CA4487CB6678D15494BD48E"><enum>(A)</enum><header>In
				general</header><text>An employee prevailing in any action under paragraph
				(2)(A) shall be entitled to all relief necessary to make the
			 employee
				whole.</text>
									</subparagraph><subparagraph id="idF1AFCB29FA3F4224886790BA8C50DF35"><enum>(B)</enum><header>Compensatory
				damages</header><text>Relief for any action under subparagraph (A) shall
				include—</text>
										<clause id="id922542D4F0CB404E840C127D27CC9C29"><enum>(i)</enum><text>reinstatement
				with the same seniority status that the employee would have had,
			 but for the
				discrimination;</text>
										</clause><clause id="idC5452887FEE44F879FC2FA8C612974B7"><enum>(ii)</enum><text>the amount of
				back pay, with interest; and</text>
										</clause><clause id="id3C503CAF83AF462A80444B8D90606DFD"><enum>(iii)</enum><text>compensation
				for any special damages sustained as a result of the
			 discrimination, including
				litigation costs, expert witness fees, and reasonable attorney
			 fees.</text>
										</clause></subparagraph></paragraph><paragraph id="idE0513EA8D35F4F679E537297CD97C3AC"><enum>(4)</enum><header>Rights retained
				by employee</header><text>Nothing in this subsection shall be deemed to
				diminish the rights, privileges, or remedies of any employee under
			 any Federal
				or State law, or under any collective bargaining agreement.</text>
								</paragraph><paragraph id="id4C629FEA23A246E193ED4E67375076F8"><enum>(5)</enum><header>Nonenforceability
				of certain provisions waiving rights and remedies or requiring
			 arbitration of
				disputes</header>
									<subparagraph id="id278154E1BED84AB58B4B9F4DC81DD020"><enum>(A)</enum><header>Waiver of
				rights and remedies</header><text>The rights and remedies provided for in this
				subsection may not be waived by any agreement, policy form, or
			 condition of
				employment, including by a predispute arbitration agreement.</text>
									</subparagraph><subparagraph id="id3DA71388D0EE41348670EAE62D7DCDB3"><enum>(B)</enum><header>Predispute
				arbitration agreements</header><text>No predispute arbitration agreement shall
				be valid or enforceable, if the agreement requires arbitration of a
			 dispute
				arising under this subsection.</text>
									</subparagraph></paragraph></subsection></section><section id="id18B3EBD357CA40E3AF3653B827A96CE5"><enum>2083.</enum><header>Relationship
				to existing law</header>
							<subsection id="idA6645533B7F94E298FA68CD7FE1E0688"><enum>(a)</enum><header>Rights To
				intervene</header><text>Nothing in this chapter shall be construed to limit the
				right of any individual or group of individuals to initiate,
			 intervene in, or
				otherwise participate in any proceeding before a regulatory agency
			 or court,
				nor to relieve any regulatory agency, court, or other public body
			 of any
				obligation, or affect its discretion to permit intervention or
			 participation by
				an individual or a group or class of consumers, employees, or
			 citizens in any
				proceeding or activity.</text>
							</subsection><subsection id="idE1EF74FB0A3A4AFAB55EB8A33A47498F"><enum>(b)</enum><header>Rule of
				construction</header><text>Nothing in this chapter shall be construed to—</text><paragraph id="id81A304D128AC40868AC595EBE8AFE950"><enum>(1)</enum><text>increase  the time period for informing of a  serious danger or other harm under any other
			 provision of law; or</text></paragraph><paragraph id="id6BA5C226F9FF4449B4175943EED4685A"><enum>(2)</enum><text>limit
				or otherwise reduce the penalties for any violation of Federal or
			 State law
				under any other provision of
				law.</text>
								</paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idECFD96C0F2624A4B9B95F7CB04783A16"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The table of chapters for part I of title
			 18, United States Code, is amended by inserting after the item relating to
			 chapter 101 the following:</text>

			 date</header><text>The amendments made by subsections (a) and (b) shall take
			 effect on the date that is 1 year after the date of enactment of this
			 Act.</text>
