	<legis-body id="H7A8BC763D3E145DBB6BFC432A162E6F3" style="OLC"><section id="id6B5E73D902D9433D80F2E4BFFB509A1D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Driver Safety Act of 2014</short-title></quote>.</text></section><section id="idA11954D5E9E646549599853133AEF08E" section-type="subsequent-section"><enum>2.</enum><header>Distracted driving incentive grants</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/23/405">Section 405(e)</external-xref> of title 23, United States Code, is amended—</text><paragraph id="id3227BFBC400F4B809EA0EAEA4EE4D4BD"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>includes distracted driving issues as part of the State’s driver’s license examination and</quote> after <quote>any State that</quote>;</text></paragraph><paragraph id="id4CBB3535D8C547F28062D00C23A979B9"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text><subparagraph id="id2F37D447BED54636B47AD9389AC59089"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>and</quote> at the end;</text></subparagraph><subparagraph id="id02A40F6F66B145C99C29F4258B7137B0"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subparagraph (C); and</text></subparagraph><subparagraph id="id816E6BAA1F8C4F448205B7AB98F3C3AA"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (D) as subparagraph (C);</text></subparagraph></paragraph><paragraph id="idF2F1CF68E72F455AA5EEB4F10915CCED"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (4)(C), by striking <quote>section 31152</quote> and inserting <quote>section 31136</quote>; and</text></paragraph><paragraph id="idCF285B8CF7C545A08B48BD72BB301A61"><enum>(4)</enum><text display-inline="yes-display-inline">by amending paragraph (6) to read as follows:</text><quoted-block display-inline="no-display-inline" id="id4DE47255C7EA481A842C7AAFFABD7738" style="OLC"><paragraph id="id005EC661F37E4385977D4690FAE29BCF"><enum>(6)</enum><header>Distracted driving enforcement grants</header><subparagraph id="idECC7FCAE13ED44B7B13B7464E5996F27"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may use up to 50 percent of the amounts available for grants under this subsection to
			 award grants to any State that—</text><clause id="idE3F7F3D7CE464A7F8F7A3909C95E5A12"><enum>(i)</enum><text display-inline="yes-display-inline">in fiscal year 2015—</text><subclause id="id7B7CB6980E964806931430945F7BB9F0"><enum>(I)</enum><text display-inline="yes-display-inline">has a basic text messaging statute, as determined by the Secretary, that—</text><item id="idC7D9002376B2478D9785CF861AA8B98E"><enum>(aa)</enum><text display-inline="yes-display-inline">is applicable to drivers
			 of all ages; and</text></item><item id="id0CD89E84AC4C468CB9D69FC345CEB312"><enum>(bb)</enum><text display-inline="yes-display-inline">makes violation of the basic text messaging statute a primary offense;</text></item></subclause><subclause id="idCC6D7E799F7945AAA843CBEB322F51CE"><enum>(II)</enum><text display-inline="yes-display-inline">participates in the annual distracted driving law enforcement mobilization coordinated by the
			 Secretary; and</text></subclause><subclause id="idDC73E59AF23F48258F20D23ACB993E6B"><enum>(III)</enum><text display-inline="yes-display-inline">is otherwise ineligible for a grant under this subsection;</text></subclause></clause><clause id="id06417F56B19140E79AD84CF285FC6E71"><enum>(ii)</enum><text display-inline="yes-display-inline">in fiscal year 2016—</text><subclause id="id583BF082AA654128920F2C99732AA23C"><enum>(I)</enum><text display-inline="yes-display-inline">meets the requirements of clause (i);</text></subclause><subclause id="id5E6EA724826A4418839F30176C29B7C3"><enum>(II)</enum><text display-inline="yes-display-inline">imposes increased fines for repeat violations; and</text></subclause><subclause id="id576EF5170EEA4E1BBA53344F5182BBAC"><enum>(III)</enum><text display-inline="yes-display-inline">has a statute that prohibits a driver who is younger than 18 years of age from using a
			 personal wireless communications device while driving.</text></subclause></clause></subparagraph><subparagraph id="id819AF3F2B23043078B6BC6F9B0C96AB4"><enum>(B)</enum><header>Use of grant funds</header><clause id="id5D5CD17828414D61B92AFB29FC460317"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to clauses (ii) and (iii), amounts received by a State under subparagraph (A) may be used
			 for activities related to the enforcement of distracted driving laws.</text></clause><clause id="id9A261455E11F429C89A69EF1AD9AEBB5"><enum>(ii)</enum><header>Fiscal year 2015</header><text display-inline="yes-display-inline">In fiscal year 2015, up to 15 percent of the amounts received by a State under subparagraph (A) may
			 be used for any eligible project or activity under section 402.</text></clause><clause id="id6E7FCEB0546945C3BF6589B109873515"><enum>(iii)</enum><header>Fiscal year 2016</header><text display-inline="yes-display-inline">In fiscal year 2016, up to 25 percent of the amounts received by a State under subparagraph (A) may
			 be used for any eligible project or activity under section 402.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idcbefc7014b4e4a62b3792a9c1189b8c7"><enum>3.</enum><header>Barriers to data collection report</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the National Highway Traffic
			 Safety Administration shall submit a report to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>, the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> that—</text><paragraph id="ide6e63298aa1a48e39334d3b9b22ee590"><enum>(1)</enum><text>identifies any legal and technical barriers to capturing adequate data on the prevalence of
			 wireless communications devices while driving; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd95e68166878449c838de17d186ffa02"><enum>(2)</enum><text>provides recommendations on how to address such barriers.</text>
