		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the
		  <quote><short-title>Technology and Research Accelerating National Security and Future Economic Resiliency Act of 2014</short-title></quote> or the <quote><short-title>TRANSFER Act</short-title></quote>.</text></section><section id="H44B7FA0CC9A54829A46F390F15DC1A5C"><enum>2.</enum><header>Innovative approaches to technology transfer grant program</header><text display-inline="no-display-inline">Section 9(jj) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(jj)</external-xref>) is amended to read as follows:</text>

				<subsection id="HA98EC27DA2B54021B6A3356CD054AE1F"><enum>(jj)</enum><header>Innovative approaches to technology transfer</header>
					<paragraph id="HA8AD879ACE8946E896A92F594BD22B5B"><enum>(1)</enum><header>Grant program</header>
						<subparagraph id="H457E2852F5C94BE7AA49B69604020BEA"><enum>(A)</enum><header>Definitions</header><text>In this subsection—</text><clause id="idF06778979C86452083F0533990681E4E"><enum>(i)</enum><text>the term <term>covered agency</term> means a Federal agency that is required to establish an STTR program under subsection (n);</text></clause><clause id="idFC14F3D1B89D4680B90437812AD3D096"><enum>(ii)</enum><text>the term <term>eligible institution</term> means—</text><subclause id="idEB76A408806C448F94A7CA1156305F36"><enum>(I)</enum><text>an institution of higher education;</text></subclause><subclause id="id653E921C41944C8D9DDE38E076997FEF"><enum>(II)</enum><text>a technology transfer organization that facilitates the commercialization of technologies developed
			 by 1 or more institutions of higher education;</text></subclause><subclause id="idBD059EEC21734475B49A79A798CB0FA4"><enum>(III)</enum><text>a Federal laboratory;</text></subclause><subclause id="id97DD5E7278EA43DEBD474B9964EDD956"><enum>(IV)</enum><text>a public or private nonprofit entity; or</text></subclause><subclause id="idA71D834D94344C5C98DFB83C98E46B42"><enum>(V)</enum><text>a consortium of any of the entities described under subclause (I), (II), (III), or (IV);</text></subclause></clause><clause id="id277C0517F79E488AA53DF8E398CB07D3"><enum>(iii)</enum><text>the term <term>Federal laboratory</term> has the meaning given that term under section 4(6) of the Stevenson-Wydler Technology Innovation
			 Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3703">15 U.S.C. 3703(6)</external-xref>);</text></clause><clause id="idB5A80B4594D441958A923955537329DF"><enum>(iv)</enum><text>the term <term>institution of higher education</term> has the meaning given that term under section 101(a) of the Higher Education Act of 1965 (20
			 U.S.C. 1001(a)); and</text></clause><clause id="idE7591E660774477280B448D33E09541F"><enum>(v)</enum><text>the term <term>program</term> means an Innovative Approaches to Technology Transfer Grant Program 
			 established by a covered agency under subparagraph (B).</text></clause></subparagraph><subparagraph id="idA1BA25E930AC4EAC98D4BA78935B9958"><enum>(B)</enum><header>Establishment of program</header><text>The head of each covered agency shall establish a grant
			 program, to be known as the Innovative Approaches to Technology Transfer
			 Grant Program of the covered agency, to make grants to eligible
			 institutions to improve or accelerate
			 the commercialization of high quality and commercially viable federally
			 funded research and technology by small
			 business concerns.</text>
						</subparagraph><subparagraph id="HF63E97F92DEB4DF99ECD93308B8E9372"><enum>(C)</enum><header>Use of Funds</header><text>Grants awarded under a program may be used to—</text><clause id="H64ED7244EB8C4DC7913580FEA4A66800"><enum>(i)</enum><text>provide early-stage proof of concept funding for translational research;</text>
							</clause><clause id="H7B2C84F2C02D43E9831324CD3ED46C35"><enum>(ii)</enum><text>identify research and technology that have the potential for accelerated
			 commercialization;</text>
							</clause><clause id="HF5A00E70078B4DDA8B976EE57EF1EA79"><enum>(iii)</enum><text>support technology maturation activities, including prototype construction, experiment
			 analysis, product comparison, and the collection of performance data;</text>
							</clause><clause id="HD5F431711C1142C0BFF10ADA79DD2BA0"><enum>(iv)</enum><text>provide funding for technical validations, market research, clarifying intellectual property rights
			 position and
			 strategy, and investigating commercial and business opportunities;</text>
							</clause><clause id="HE48AC82E8577487B9E266878D742A59E"><enum>(v)</enum><text>provide advice, mentoring, entrepreneurial education, project management, and
			 technology and business development expertise to innovators and recipients
			 of technology transfer licenses to maximize commercialization potential;
			 and</text>
							</clause><clause id="H0444E0A5AE8042A9A6FDFDFC24439CB1"><enum>(vi)</enum><text display-inline="yes-display-inline">conduct outreach to small business concerns as potential licensees of federally funded research
			 and technology to provide technology transfer services to those small
			 business concerns.</text>
							</clause></subparagraph><subparagraph id="H4F2842DF40CB4BCDB71BDEA549F7E487"><enum>(D)</enum><header>Application</header><clause id="id110FE09945F448758A4A4A4B093C24EA"><enum>(i)</enum><header>In general</header><text>An eligible institution desiring a grant under the program shall submit an application to a
			 covered agency at such time, in such manner, and containing such
			 information as the
			 covered agency may require.</text>
							</clause><clause id="id124F07646A9F473FB071D77A5AD835CE"><enum>(ii)</enum><header>Required information</header><text>An application submitted for a grant under the program shall include—</text><subclause id="H316EB66DB9824FFAADD475F29ACB0236"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="idA702DEC7636340A0BCF4B9E5DDBF18F9"><enum>(aa)</enum><text>a description of innovative approaches to technology transfer, technology development, and
			 commercial readiness that have the potential to increase or accelerate
			 technology transfer outcomes and can be adopted by other eligible
			 institutions; or</text></item><item id="idB5BAEEB800834000A79B8C9075CB87E1" indent="up1"><enum>(bb)</enum><text>a demonstration of, or a plan to implement, proven technology transfer and
			 commercialization strategies that can achieve greater
			 commercialization of federally funded research and technology with
			 a grant under the program;</text></item></subclause><subclause id="H720C30EECEBB46FE969B34EBCA55F4AA"><enum>(II)</enum><text>a description of how the eligible institution will contribute to local and regional economic
			 development efforts;</text>
								</subclause><subclause id="HE4E25587603F40349887ACB75CDA97D1"><enum>(III)</enum><text>a plan for sustainability after grant amounts have been expended; and</text>
								</subclause><subclause id="idCE32C1D2A2F241729B60B047C4C3171F"><enum>(IV)</enum><text>a plan to assemble an oversight board in accordance with subparagraph (F).</text></subclause></clause></subparagraph><subparagraph id="id345D990565DA4289B11D13D005AFEBCE"><enum>(E)</enum><header>Competitive basis</header><text>A covered agency shall award grants to eligible institutions under the	program of the covered
			 agency on a competitive
			 basis.</text></subparagraph><subparagraph id="id658D308F4AEC4E469E8186227E85CA9F"><enum>(F)</enum><header>Oversight board</header><clause id="id65DEF9F58D154CC5BD1A0C3534CD1DB9"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible institution that receives a grant under the program shall assemble an oversight board
			 to—</text><subclause id="id00D5B3B53CF54F0AA6A5ED4C6E7D8C05"><enum>(I)</enum><text>establish award programs for individual projects, including an
			 application process;</text>
								</subclause><subclause id="id635DADEABE334713A4D5ECE242DC0F18"><enum>(II)</enum><text>provide rigorous evaluation of project applications;</text>
								</subclause><subclause id="id96BFECBC10B143F9AAA4C591A960A628"><enum>(III)</enum><text>determine which projects should receive awards from the eligible institution;</text>
								</subclause><subclause id="idE86A6CBE5DCF49EEA00E38931B68B3FB"><enum>(IV)</enum><text>establish milestones and associated award amounts for projects that reach certain milestones;</text>
								</subclause><subclause id="id1F35C660DB4C445F851A2CE852BC98AD"><enum>(V)</enum><text>determine whether a project is reaching the established milestones; and</text>
								</subclause><subclause id="id5437FA032D9042CC967084F2F8270DFF"><enum>(VI)</enum><text>develop a process to reallocate outstanding award amounts from projects that are not reaching
			 milestones to other projects with more potential to reach those
			 milestones.</text></subclause></clause><clause id="id48CD665901204A1D8DDC3DA705DC423B"><enum>(ii)</enum><header>Membership and qualifications</header><subclause id="id674DCA9CE41B4A9F819A6F939B1D511B"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">An oversight board assembled under clause (i) shall be composed of members who shall have
			 demonstrated relevant technical, scientific, or business expertise, of
			 whom three-fifths shall
			 be drawn from relevant industries, start-up companies, venture capital
			 or other equity investment mechanisms, technical enterprises, financial
			 institutions, and business development organizations with a track record
			 of success in commercializing innovations.</text></subclause><subclause commented="no" id="id628466D02EED40AF950F5DAF9F7BCEAD"><enum>(II)</enum><header>Conflicts of interest</header><text>An oversight board assembled under clause (i) shall adopt policies that—</text><item commented="no" id="id1DD85872A17446DFB129E2B9E9B09852"><enum>(aa)</enum><text>prohibit conflicts of interest among members of the oversight board;</text></item><item commented="no" id="id0BB54A4FEE2643EDA286936D043BF418"><enum>(bb)</enum><text>ensure that relevant
			 relationships are disclosed; and</text></item><item commented="no" id="idA588432D7B5D4975A8FEC00EE729A8D9"><enum>(cc)</enum><text>establish proper re­cus­al procedures in the event of a conflict of interest.</text></item></subclause></clause><clause id="idD877FFCCF8D6406AA1E8C000E0C3AA00"><enum>(iii)</enum><header>Use of existing oversight boards</header><text>An eligible institution  may use oversight
			 boards in existence on the date of the enactment of the <short-title>Technology and Research Accelerating National Security and Future Economic Resiliency Act of 2014</short-title> that meet the requirements of this
			 subparagraph.</text></clause></subparagraph><subparagraph id="H1BC73C66F09248B38D1C5A6E86C101E0"><enum>(G)</enum><header>Grant and award amounts</header>
							<clause id="H826C79EB22B54703A060C8DC1DEAE598"><enum>(i)</enum><header>Grant amounts</header><text display-inline="yes-display-inline">The amount of a grant made by a covered agency under the program of the covered agency shall be not
			 more than $3,000,000.</text>
							</clause><clause id="H20E438C1AB4C49288154D4BD902D52D2"><enum>(ii)</enum><header>Award amounts</header><text display-inline="yes-display-inline">An eligible institution that receives a grant under a program shall make awards for individual
			 projects that support the activities of clauses (i), (iii) and (iv) of
			 subparagraph (C), which—</text><subclause id="idA98E37DCDB6E4F7BBB50333EF68E0F0C"><enum>(I)</enum><text display-inline="yes-display-inline">shall not be more than $100,000; and</text></subclause><subclause id="id41271444D8844804B5081D97DA71C81A"><enum>(II)</enum><text>shall be provided in phased amounts, based on whether the project is reaching the milestones
			 established by the oversight board of the eligible institution.</text></subclause></clause></subparagraph><subparagraph id="H66DD3F9819D542358F9260348145F04E"><enum>(H)</enum><header>Authorized expenditures for the program</header>
							<clause id="H70F140D2CB9840688E2E2FDCCC776447"><enum>(i)</enum><header>Expenditure amounts</header><text display-inline="yes-display-inline">The percentage of the extramural budget for research, or research and development, required to be
			 expended by a covered agency for the program of the covered agency shall
			 be—</text>
								<subclause id="H65043114297D4107B3D104E767100542"><enum>(I)</enum><text>0.05 percent for fiscal year 2015; and</text>
								</subclause><subclause id="HB6484F863B034D5C8979D25E8AB58BC5"><enum>(II)</enum><text>0.1 percent for each of fiscal years 2016 and 2017.</text>
								</subclause></clause><clause id="HF262915F017B4445BEDAF3EDCFEBE2E1"><enum>(ii)</enum><header>Treatment of expenditures</header><text>Any portion of the extramural budget expended by a covered agency for the program of the covered
			 agency shall apply
			 toward the
			 STTR expenditure requirements of the covered agency under subsection (n).</text>
							</clause></subparagraph></paragraph><paragraph id="H9C5349C47C8E45F1B36536E89DCCBC81"><enum>(2)</enum><header>Program evaluation and data collection and dissemination</header>
						<subparagraph id="HACDD4FD7026E41CEBCE6F2F0B41CC3AD"><enum>(A)</enum><header>Evaluation plan and data collection</header><clause id="id723799DD64AC40749D190B68DDC773DC"><enum>(i)</enum><header>In general</header><text>Each covered agency shall develop a program evaluation plan
			 to collect data to identify outcomes resulting from the transfer of
			 technology under the program of the covered agency,  including—</text><subclause id="HB48DBBEE99E8487C8E25BEE6E9E523B5"><enum>(I)</enum><text display-inline="yes-display-inline">specific follow-on funding identified or obtained, including follow-on funding sources, such as
			 Federal sources or private sources, not later than 3 years after the date
			 on which an eligible institution makes an award for a project under the
			 program;</text>
								</subclause><subclause id="HE4DBC868B1D54543AB2F811FDABE16DA"><enum>(II)</enum><text display-inline="yes-display-inline">the number of projects which, not later than 5 years after receiving an award from an eligible
			 institution under the program, result in a
			 license to a start-up company or an established company with sufficient
			 resources for effective commercialization;</text>
								</subclause><subclause id="H74BC948D13124150B140CBAF621F7A21"><enum>(III)</enum><text display-inline="yes-display-inline">the number of invention disclosures received, United States patent applications filed, and United
			 States patents issued not later than 5 years after the date on which an
			 eligible institution makes an award for a project under the program;</text>
								</subclause><subclause id="H1BB2D4F51C1C499280D2F76391E49F41"><enum>(IV)</enum><text>the number of projects receiving an award from an eligible institution under the program that
			 secure Phase I or Phase II SBIR
			 or
			 STTR awards;</text>
								</subclause><subclause id="H496E9329C7AD4B1FA4A50CB5BD847EA7"><enum>(V)</enum><text display-inline="yes-display-inline">available information on revenue, sales, or other measures of products that have been
			 commercialized
			 as a result of projects receiving an award from an eligible institution
			 under the program not later than 5 years after the date on which the
			 eligible institution made the award;</text>
								</subclause><subclause id="H414A83CD72D0492F99D7F003ABD27205"><enum>(VI)</enum><text display-inline="yes-display-inline">the number and location of jobs created as a result of projects receiving an award from an eligible
			 institution under the program; and</text>
								</subclause><subclause id="H9EFE6908CE694CB482A53E882D65FF99"><enum>(VII)</enum><text display-inline="yes-display-inline">any other data as the covered agency may determine appropriate.</text>
								</subclause></clause></subparagraph><subparagraph id="HA27006D1BD824BBA8DBC8B4D6A9A6E66"><enum>(B)</enum><header>Evaluative report to Congress</header><text>Not later than September 30, 2018, the head of each covered agency shall submit to the Committee on
			 Small Business and
			 Entrepreneurship
			 of the Senate and the Committee on Science, Space,
			 and Technology and the Committee on Small Business of the House of
			 Representatives a report evaluating the activities of the program of the
			 covered agency, which shall include—</text>
							<clause id="H465267FA258C410F892867CF12D1798D"><enum>(i)</enum><text>a detailed description of the implementation of the program;</text>
							</clause><clause id="H50B2A4FD160D4480A229496FFE4E7EC1"><enum>(ii)</enum><text>a detailed description of selection process used by the covered agency to award a grant to an
			 eligible institution under
			 the program;</text>
							</clause><clause id="HE09DF7E8A2C14FD4B002D83920196B4A"><enum>(iii)</enum><text>an accounting of the funds used in the program; and</text>
							</clause><clause id="H38162AAD5600445CB2C36977482788FD"><enum>(iv)</enum><text>a summary of the data collected under subparagraph (A).</text>
							</clause></subparagraph><subparagraph id="H1F353E540B434215A6A72A71E208A032"><enum>(C)</enum><header>Data dissemination</header><text>For purposes of program transparency and the dissemination of best practices, the Administrator
			 shall include on the public database under subsection (k)(1) information
			 on the program of each covered agency,
			 including—</text>
							<clause id="H2C85CD553B574891BCF50B4E3573280B"><enum>(i)</enum><text>the program evaluation plan required under subparagraph (A);</text>
							</clause><clause id="H570F4B322B1948E4B9364057D769098B"><enum>(ii)</enum><text>a list of recipients of awards made by an eligible institution for projects under the program by
			 State; and</text>
							</clause><clause id="H632B86060E8149B384D005BC3458233D"><enum>(iii)</enum><text>information on the use by recipients of awards made by an eligible institution for projects under
			 the program.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
