		<legis-type>A BILL</legis-type>
		<official-title>To amend the Fair Labor Standards Act of 1938 to establish salary thresholds for and limitations on
			 executive,
			 administrative, and professional employees and address highly compensated
			 employees, for purposes of the requirements
			 for exemption from the Federal minimum wage and maximum hour provisions,
			 and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the
		  <quote><short-title>Restoring Overtime Pay for Working Americans Act</short-title></quote>.</text>
		</section><section id="id28c5bdc116c144ed95bcab83f4bf6bf5"><enum>2.</enum><header>Salary
			 thresholds, highly compensated employees, and primary duties</header>
			<subsection id="idF3F0990692424A5999F544C786744B38"><enum>(a)</enum><header>Salary
			 thresholds for executive, administrative, and professional
			 employees</header><text display-inline="yes-display-inline">Section 13 of the
			 Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213</external-xref>) is amended—</text>
				<paragraph id="id9c44b157130041ce92dff9e0ccde7f87"><enum>(1)</enum><text>in subsection
			 (a)(1), by inserting before <quote>; or</quote> the following: <quote>, subject
			 to the requirement that any employee whom the Secretary determines is
			 required
			 to be paid on a salary (or equivalent fee basis) in order to be exempt
			 under this
			 subsection
			 shall, in order to be so exempt, receive compensation at a rate of not
			 less than
			 the
			 salary rate (or equivalent fee basis) determined under subsection (k)</quote>;
			 and</text>
				</paragraph><paragraph id="id364E269D3C9B43D7AF55CE0C39FC366B"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idAEB217FB58384957807271FBA0C8F902" style="OLC"><subsection id="id5EA32B88299A4577B7C868D80C4E6157"><enum>(k)</enum><header>Salary
				rate (or equivalent fee basis)</header>
							<paragraph id="id78311D8037324DB8B6C7A72EF5F09A2A"><enum>(1)</enum><header>In
				general</header><text>The salary rate (or equivalent fee basis) determined
				under this subsection for purposes of subsection (a)(1) shall be—</text>
								<subparagraph id="id834DB333326E42718970E801E338AD01"><enum>(A)</enum><text>beginning 1 year
				after the first day of the first month that begins after the date
			 of enactment
				of the Restoring Overtime Pay for Working Americans Act, $665 per
			 week;</text>
								</subparagraph><subparagraph id="id84F46EDA05094B489F2CC7C983FDF42E"><enum>(B)</enum><text>beginning 2 years
				after such first day, $865 per week;</text>
								</subparagraph><subparagraph id="id0DAC909C2B3F42BAA69561B3333CFE98"><enum>(C)</enum><text>beginning 3 years
				after such first day, $1,090 per week; and</text>
								</subparagraph><subparagraph id="id2F8086C8BCFB427A9C41D318148C8404"><enum>(D)</enum><text>beginning on the
				date that is 4 years after such first day, and on such first day in
			 each
				succeeding year, an adjusted amount that is—</text>
									<clause id="id8DFDAC41042A4C5EACBA233E7F6DC719"><enum>(i)</enum><text>not less than the
				amount in effect under this paragraph on the day before the date
			 of such adjustment;</text>
									</clause><clause id="id07097BACADAB4B2AB4A9A819D6FDBD83"><enum>(ii)</enum><text>increased from
				such amount by the annual percentage increase in the Consumer Price
			 Index for
				Urban Wage Earners and Clerical Workers; and</text>
									</clause><clause id="id5714F9856D674531BC8640DFC440F3E7"><enum>(iii)</enum><text>rounded to the
				nearest multiple of $1.00.</text>
									</clause></subparagraph></paragraph><paragraph id="idD90E62FB952046B3B980CE38D79F8297"><enum>(2)</enum><header>Special
				rule</header><text>Notwithstanding paragraph (1), for any employee for whom the
				minimum wage would otherwise be determined pursuant to section
			 8103(b) of the
				Fair Minimum Wage Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206</external-xref> note), the Secretary
			 may
				determine, through regulations, the salary rate (or equivalent fee
				basis).</text></paragraph></subsection><subsection id="id90615E8609B64A99B3642AD7701565E0"><enum>(l)</enum><header>Primary duty</header><text>In any case where an employer classifies an employee as an employee employed in a bona fide
			 executive, administrative, or professional capacity, for the purpose of
			 subsection (a)(1), or in a position described in subsection (a)(17), for
			 the purpose of such subsection, such employee shall not spend more than 50
			 percent of such employee's work hours in a workweek on duties that are not
			 exempt under	paragraph (1) or (17) of subsection (a), respectively.</text></subsection><subsection id="id8B88BE9249C0429D8772F1606D265658"><enum>(m)</enum><header>Definitions</header><text>For the purposes of this section:</text>
							<paragraph id="idEDA75806162D483BA4C6FF863679EE28"><enum>(1)</enum><header>Annual
				percentage increase</header><text>The term
				<term>annual percentage increase</term>, when used in reference to the Consumer
				Price Index for Urban Wage Earners and Clerical Workers, means the
			 annual
				percentage increase calculated by the Secretary by comparing such
			 Consumer Price Index  for the most
			 recent month,
				quarter, or year available (as selected by the Secretary prior to
			 the first
				year for which a minimum wage is in effect pursuant to this
			 subsection) with
				such Consumer Price Index for the same month in the preceding year,
			 the same
				quarter in the preceding year, or the preceding year,
				respectively.</text>
							</paragraph><paragraph id="id7C5D0DD793A44151B6F0DA547EA690E5"><enum>(2)</enum><header>Consumer Price Index for Urban Wage Earners and Clerical Workers</header><text>The term
				<term>Consumer Price Index for Urban Wage Earners and Clerical Workers</term>
				means the Consumer Price Index for Urban Wage Earners and Clerical
			 Workers
				(United States city average, all items, not seasonally adjusted),
			 or its
				successor publication, as determined by the Bureau of Labor
			 Statistics.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id479F2AC89B4B4C969A9C8F908A679899"><enum>(b)</enum><header>Highly
			 compensated employees</header>
				<paragraph id="id9C05C19887B84072B716FD299C2FECED"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">If the Secretary of
			 Labor, in the discretion of such Secretary, determines that an employee
			 may be
			 exempt
			 for purposes of section 13(a)(1) of the Fair Labor Standards Act of 1938
			 (29
			 U.S.C. 213(a)(1)), as a highly compensated employee (as such term is
			 defined
			 and delimited by the Secretary), then the level of total annual
			 compensation
			 necessary for such exemption shall be—</text>
					<subparagraph id="id3512669D959A430B8A285419F58C4514"><enum>(A)</enum><text>beginning 1 year
				after the first day of the first month that begins after the date
			 of enactment
				of this Act, $108,000;</text></subparagraph><subparagraph id="id67046F50C1DF4C8DA78A5AE0873D525F"><enum>(B)</enum><text>beginning 2 years
				after such first day, $116,000;</text>
					</subparagraph><subparagraph id="id587125CF99AB4055A3B2953D25D23DE6"><enum>(C)</enum><text>beginning 3 years
				after such first day, $125,000; and</text></subparagraph><subparagraph id="idCF7ED59E6D924A0089645D6E57575CC5"><enum>(D)</enum><text>beginning on the date that is 4 years after such first day, and for each
			 succeeding calendar year, an adjusted amount that is—</text>
						<clause id="idDE0FA409B71147F7BD1B74AADEFA07EA"><enum>(i)</enum><text>not
			 less than the amount in effect under this paragraph on the day before the
			 date
			 of such adjustment;</text>
						</clause><clause id="idCFCCA2EBA0AE480AADAF38B07A6C8496"><enum>(ii)</enum><text>increased from
			 such amount by the annual percentage increase in the Consumer Price Index
			 for
			 Urban Wage Earners and Clerical Workers; and</text>
						</clause><clause id="idB7A90BA67D354E6A8835AE6CDFCEB64C"><enum>(iii)</enum><text>rounded to the
			 nearest multiple of $1.00.</text>
						</clause></subparagraph></paragraph><paragraph id="id1216F8CC9CD2429DB65A5482C043DE0C"><enum>(2)</enum><header>Rule of
			 construction</header><text>Nothing in this subsection or the regulations
			 promulgated by the Secretary of Labor under this subsection shall override
			 any
			 provision of a collective bargaining agreement that provides for overtime
			 employment compensation, or rights to such compensation, that exceed the
			 requirements of the Fair Labor Standards Act of 1938 (29 U.S.C. 201 et
			 seq.).</text>
				</paragraph><paragraph id="id5960D585408949F5843B5C9D345AFD68"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">For
			 purposes of this subsection, the terms <term>annual percentage increase</term>
			 and <term>Consumer Price Index for Urban Wage Earners and Clerical
			 Workers</term> have the meanings given the terms in section 13(m) of the Fair
			 Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(m)</external-xref>), as added by subsection
			 (a).</text></paragraph></subsection><subsection id="idACCAE3726AB54A7AB2BEEFCBF80C0E43"><enum>(c)</enum><header>Publication of
			 notice</header><paragraph id="idF8644C4E5CC448AA85C527ECF2B4A966"><enum>(1)</enum><header>In general</header><text>Not later than 60 days before the effective  date of any adjustment in the
			 salary rate (or equivalent fee basis) required under section 13(k)(1)(D)
			 of the
			 Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(k)(1)(D)</external-xref>), as added by
			 subsection (a),
			 or
			 any adjustment in the amount of compensation required for the highly
			 compensated
			 employee exemption required under subsection (b), the
			 Secretary of
			 Labor shall publish, in the Federal Register and on the website of the
			 Department of Labor, a notice announcing the adjusted salary rate (or
			 equivalent fee basis) or adjusted amount of compensation,
			 respectively.</text></paragraph><paragraph id="id807A9A694CDF4D14A6EFC73748FC11DD"><enum>(2)</enum><header>Nonapplicability of rulemaking requirements</header><text>The provisions of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States
			 Code,
			 shall not apply to any notice required under this subsection.</text>
				</paragraph></subsection><subsection id="id932ACD17886E4F81A8C39738936762E6"><enum>(d)</enum><header>Penalties</header><text>Section 16(e)(2) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216(e)(2)</external-xref>) is amended by
			 inserting <quote>or section 11(c), relating to the records that each employer is  required to make, keep, and
			 preserve,</quote> after <quote>relating to wages,</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idFB2E4E2F1D544135B375E078BA55B8E3"><enum>(e)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">This Act, and the
			 amendments made by this Act, shall take effect on the date that is 1
			 year
			 after the first day of the first  month that begins after the date of
			 enactment
			 of this Act.</text>
