			 Atlantic Fisheries, as adopted at Lisbon on September 28, 2007.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title; references to the Northwest Atlantic Fisheries Convention Act of 1995</header><subsection id="idFE936D8A45C54872BB7B6F9B266EBBE6"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Northwest Atlantic Fisheries Convention Amendments Act</short-title></quote>.</text></subsection><subsection id="id319A3DA7D1784947B663914FC806C6D6"><enum>(b)</enum><header>References to the Northwest Atlantic Fisheries Convention Act of 1995</header><text>Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in
			 terms of an amendment to, or repeal of, a section or other provision, the
			 reference shall be considered to be made to a section or other provision
			 of the Northwest Atlantic Fisheries Convention Act of 1995 (16 U.S.C. 5601
			 et seq.).</text></subsection></section><section id="id0C2DD7B939714098942F5ED2799DBF9F"><enum>2.</enum><header>Representation of the United States under Convention</header><text display-inline="no-display-inline">Section 202 (<external-xref legal-doc="usc" parsable-cite="usc/16/5601">16 U.S.C. 5601</external-xref>) is amended—</text><paragraph id="id8F9E7BCA7FA94A3580A65CCFB1A842D1"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>General Council and the Fisheries</quote>;</text></paragraph><paragraph id="idA2BD4F5875F448E0866D29AEA93C2326"><enum>(2)</enum><text>in subsection (b)(1), by striking <quote>at a meeting of the General Council or the Fisheries Commission</quote>;</text></paragraph><paragraph id="id99308D5C35DD48AF8E171197DE2D6F50"><enum>(3)</enum><text>in subsection (b)(2), by striking <quote>, at any meeting of the General Council or the Fisheries Commission for which the alternate
			 Commission is designated</quote>;</text></paragraph><paragraph id="idDA8CCB1720B34DAAB7A54C7AAB3E007A"><enum>(4)</enum><text>in subsection (d)(1), by striking <quote>at a meeting of the Scientific Council</quote>; and</text></paragraph><paragraph id="idB633EEF57E58418982743AE55ABE9FBF"><enum>(5)</enum><text>in subsection (d)(2), by striking <quote>, at any meeting of the Scientific Council for which the Alternative Representative is designated</quote>.</text></paragraph></section><section id="id20D0EE8C0E4F42208E4057A19459FA5E"><enum>3.</enum><header>Requests for scientific advice</header><text display-inline="no-display-inline">Section 203 (<external-xref legal-doc="usc" parsable-cite="usc/16/5602">16 U.S.C. 5602</external-xref>) is amended—</text><paragraph id="idE11570D9687A4C02B0FCDFC84B5D0E95"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id3F2EF01B9049413988E52C975A7B0E62"><enum>(A)</enum><text>by striking <quote>The Representatives may</quote> and inserting <quote>A Representative may</quote>;</text></subparagraph><subparagraph id="id0F10D27142D64C57A97EBEDFCC10B2AF"><enum>(B)</enum><text>by striking <quote>described in subsection (b)(1) or (2)</quote> and inserting <quote>described in paragraph (1) or (2) of subsection (b)</quote>; and</text></subparagraph><subparagraph id="id190F24A5B8D847C4BAE4CDBAC37D549E"><enum>(C)</enum><text>by striking <quote>the Representatives have</quote> and inserting <quote>the Representative has</quote>;</text></subparagraph></paragraph><paragraph id="id7D744DAC2C564A49820E0D2FA715537B"><enum>(2)</enum><text>by striking <quote>VII(1)</quote> each place it appears and inserting <quote>VII(10)(b)</quote>; and</text></paragraph><paragraph id="id8CE9D005347A4B728A7FA43CC0B4D53A"><enum>(3)</enum><text>in subsection (b)(2), by striking <quote>VIII(2)</quote> and inserting <quote>VII(11)</quote>.</text></paragraph></section><section id="id6C85B4DEC5204EC3BED8C0246A1E9FC5"><enum>4.</enum><header>Authorities of Secretary of State with respect to Convention</header><text display-inline="no-display-inline">Section 204 (<external-xref legal-doc="usc" parsable-cite="usc/16/5603">16 U.S.C. 5603</external-xref>) is amended by striking <quote>Fisheries Commission</quote> each place it appears and inserting <quote>Commission consistent with the procedures detailed in Articles XIV and XV of the Convention</quote>.</text></section><section id="id4D04606F49494B2AAF72E8536A5FBF4C"><enum>5.</enum><header>Interagency cooperation</header><text display-inline="no-display-inline">Section 205(a) (<external-xref legal-doc="usc" parsable-cite="usc/16/5604">16 U.S.C. 5604(a)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="id90776B3ADF9B485B9EB081D6C638C9A2" style="OLC"><subsection id="id5A27CAA7C7C84983A7F75FFBE3E468E3"><enum>(a)</enum><header>Authorities of the Secretary</header><text>In carrying out the provisions of the Convention and this Act, the Secretary may arrange for
			 cooperation with—</text><paragraph id="id5465A02A456D4F9B8982039FA4EC4ACE"><enum>(1)</enum><text>any department, agency, or instrumentality of the United States;</text></paragraph><paragraph id="idB50E39CCEF264C3CA41364BACC47E0C1"><enum>(2)</enum><text>a State;</text></paragraph><paragraph id="id1A6A6A67E8DA4723A4899BDC9C53FC6A"><enum>(3)</enum><text>a Council; or</text></paragraph><paragraph id="id06C534EDD4F544138D0F130DF920963B"><enum>(4)</enum><text>a private institution or an organization.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id6207647296594AAAB95A521041563408"><enum>6.</enum><header>Prohibited acts and penalties</header><text display-inline="no-display-inline">Section 207 (<external-xref legal-doc="usc" parsable-cite="usc/16/5606">16 U.S.C. 5606</external-xref>) is amended by striking <quote>fish</quote> wherever it appears and inserting <quote>fishery resources</quote>.</text></section><section id="id720D000528C6493F9CF49A080E2F3E95"><enum>7.</enum><header>Consultative committee</header><text display-inline="no-display-inline">Section 208 (<external-xref legal-doc="usc" parsable-cite="usc/16/5607">16 U.S.C. 5607</external-xref>) is amended by striking <quote>General Council or the Fisheries</quote> wherever it appears.</text></section><section id="id86AF566E2346404F8A0FC30A6452BDB8"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 210 (<external-xref legal-doc="usc" parsable-cite="usc/16/5609">16 U.S.C. 5609</external-xref>) is amended to read as follows—</text><quoted-block act-name="" id="idC12B9746E2114D5DA5E6A5C7E807C5E8" style="OLC"><section id="id71D6986D8B9948A989FF387195437139"><enum>210.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="idB680D53711DB47B3A85D3DA8D0545A7D"><enum>(1)</enum><header>1982 Convention</header><text display-inline="yes-display-inline">The term <term>1982 Convention</term> means the United Nations Convention on the Law of the Sea of 10 December 1982.</text></paragraph><paragraph id="idFE41D2F27CB84744992F5C4766DF1579"><enum>(2)</enum><header>Authorized enforcement officer</header><text display-inline="yes-display-inline">The term <term>authorized enforcement officer</term> means a person authorized to enforce this Act, any regulation issued under this Act, or any
			 measure that is legally binding on the United States under the Convention.</text></paragraph><paragraph id="id534438DA02504086ABB173E753126EAC"><enum>(3)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the body provided for by Articles V, VI, XIII, XIV, and XV of the Convention.</text></paragraph><paragraph id="id5407748314C4420FAC1BEF58148C13E6"><enum>(4)</enum><header>Commissioner</header><text display-inline="yes-display-inline">The term <term>Commissioner</term> means a United States Commissioner to the Northwest Atlantic Fisheries Organization appointed
			 under section 202.</text></paragraph><paragraph id="idB404300A805B411581CDF392205FC464"><enum>(5)</enum><header>Convention</header><text display-inline="yes-display-inline">The term <term>Convention</term> means the Convention on Cooperation in the Northwest Atlantic Fisheries, as adopted at Lisbon on
			 September 28, 2007.</text></paragraph><paragraph id="idF3CCBAFF6B95440D8E63BA9659F2E6CD"><enum>(6)</enum><header>Convention Area</header><text display-inline="yes-display-inline">The term <term>Convention Area</term> means the waters of the Northwest Atlantic Ocean north of 35°00' N and west of a line extending
			 due north from 35°00' N and 42°00' W to 59°00' N, thence due west to
			 44°00' W, and thence due north to the coast of Greenland, and the waters
			 of the Gulf of St. Lawrence, Davis Strait and Baffin Bay south of 78°10'
			 N.</text></paragraph><paragraph id="id9E12D3C56E2547D589CCCF6BB23BE94C"><enum>(7)</enum><header>Council</header><text display-inline="yes-display-inline">The term <term>Council</term> means the New England Fishery Management Council or the Mid-Atlantic Fishery Management Council.</text></paragraph><paragraph id="id19B574D6409B48CE93C5B27A29BFD1DE"><enum>(8)</enum><header>Fishery resources</header><subparagraph id="id7E28F4A4B3BB42EE8C7890B4DFDFABF8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>fishery resources</term> means all fish, mollusks, and crustaceans within the Convention Area.</text></subparagraph><subparagraph id="id2F88C35483DC4A7CB8A53DA40F051169"><enum>(B)</enum><header>Exclusions</header><text>The term <term>fishery resources</term> does not include—</text><clause id="idD2B95926679B4FEA8A9D5EC41B359F8E"><enum>(i)</enum><text display-inline="yes-display-inline">sedentary species over which coastal States may exercise sovereign rights consistent with Article
			 77 of the 1982 Convention; or</text></clause><clause id="id6CFD34F6E51740F7A6300F9931F80315"><enum>(ii)</enum><text display-inline="yes-display-inline">in so far as they are managed under other international treaties, anadromous and catadromous stocks
			 and highly migratory species listed in Annex I of the 1982 Convention.</text></clause></subparagraph></paragraph><paragraph id="id3463EA59038A49BAA295E864414AD18B"><enum>(9)</enum><header>Fishing activities</header><subparagraph id="idAFABA95CD56A48B1A490D09177D9102A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>fishing activities</term> means harvesting or processing fishery resources, or transhipping of fishery resources or products
			 derived from fishery resources, or any other activity in preparation for,
			 in support of, or related to the harvesting of fishery resources.</text></subparagraph><subparagraph id="idC28A25EF86FE48E1AAADD14F7D301705"><enum>(B)</enum><header>Inclusions</header><text>The term <term>fishing activities</term> includes—</text><clause id="idC86CE5771B7545A39DC2DD69F5F1C98F"><enum>(i)</enum><text display-inline="yes-display-inline">the actual or attempted searching for or catching or taking of fishery resources;</text></clause><clause id="id73EDAD8D02FA4E4493DB662B00C19F22"><enum>(ii)</enum><text display-inline="yes-display-inline">any activity that can reasonably be expected to result in locating, catching, taking, or harvesting
			 of fishery resources for any purpose; and</text></clause><clause id="id04F0303891C649F7A177258A41239402"><enum>(iii)</enum><text display-inline="yes-display-inline">any operation at sea in support of, or in preparation for, any activity described in this
			 paragraph.</text></clause></subparagraph><subparagraph id="id80FF23C5F88C4662B4D3B0C153EB8F61"><enum>(C)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The term <term>fishing activities</term> does not include any operation related to emergencies
			 involving the health and safety of crew members or the safety of a vessel.</text></subparagraph></paragraph><paragraph id="id49B78068DE024CCA8C7DD9E730364900"><enum>(10)</enum><header>Fishing vessel</header><subparagraph id="id3DBA4065E68A400D9C6DBF0FE9834A3E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>fishing vessel</term> means a vessel that is or has been engaged in fishing activities.</text></subparagraph><subparagraph id="id3047B805C1B545DE968DA4FA86271FC7"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>fishing vessel</term>  includes a fish processing
			 vessel or a vessel engaged in transshipment or any other activity in
			 preparation for or related to fishing activities, or in experimental or
			 exploratory fishing activities.</text></subparagraph></paragraph><paragraph id="idDE4755CD52F6436FB17236EC5B5C7917"><enum>(11)</enum><header>Organization</header><text display-inline="yes-display-inline">The term <term>Organization</term> means the Northwest Atlantic Fisheries Organization provided for by Article V of the Convention.</text></paragraph><paragraph id="id1A952E1454EA40B9A9E185364A157B65"><enum>(12)</enum><header>Person</header><text display-inline="yes-display-inline">The term <term>person</term> means any individual (whether or not a citizen or national of the United States), and any
			 corporation, partnership, association, or other entity (whether or not
			 organized or existing under the laws of any State).</text></paragraph><paragraph id="id16B165371908482CB48CFD8F9F397FB0"><enum>(13)</enum><header>Representative</header><text display-inline="yes-display-inline">The term <term>Representative</term> means a United States Representative to the Northwest Atlantic Fisheries Scientific Council
			 appointed under section 202.</text></paragraph><paragraph id="idE2DB9972DCB84E54AF8004704457D146"><enum>(14)</enum><header>Scientific Council</header><text display-inline="yes-display-inline">The term <term>Scientific Council</term> means the Scientific Council provided for by Articles V, VI, and VII of the Convention.</text></paragraph><paragraph id="id71232F4E89874BAE8B6F7D5A13ECA979"><enum>(15)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph><paragraph id="idB2A9A9BB583C4FCFA603EC0651F2F864"><enum>(16)</enum><header>State</header><text>The term <term>State</term> means each of the several States of the United States, the District of Columbia, and any other
			 commonwealth, territory, or possession of the United States.</text></paragraph><paragraph id="idC17C3FB03D3B4CEA9C80CF063F77B135"><enum>(17)</enum><header>Transshipment</header><text display-inline="yes-display-inline">The term <term>transshipment</term> means the unloading of all or any of the fishery resources on board a fishing vessel to another
			 fishing vessel either at sea or in port.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id37B19D3C8F47490B9EF177A4D2B74727"><enum>9.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 211 (<external-xref legal-doc="usc" parsable-cite="usc/16/5610">16 U.S.C. 5610</external-xref>) is amended—</text><paragraph id="idC31468B79177431D91E13C179CBEB4A4"><enum>(1)</enum><text>by striking <quote>XVI</quote> and inserting <quote>IX</quote>; and</text></paragraph><paragraph id="idADEC895BF2C04815B7662D4A65CCEE9E"><enum>(2)</enum><text>by striking <quote>through fiscal year 2012</quote>.</text></paragraph></section><section id="id9A6571D3AD0F4ACD9C1C99E2DB8A8FF0"><enum>10.</enum><header>Quota allocation practice</header><text display-inline="no-display-inline">Section 213 (<external-xref legal-doc="usc" parsable-cite="usc/16/5612">16 U.S.C. 5612</external-xref>) is repealed.</text></section></legis-body><endorsement><action-date>December 8, 2014</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
