			<enum>1.</enum>
			<header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Online Competition and Consumer Choice Act of 2014</short-title></quote>.</text>

			<enum>2.</enum>
			<header>FCC regulations prohibiting certain preferential treatment or prioritization of Internet traffic</header>
			<subsection id="H1564099B466F4985AAA4551B19781739">
				<enum>(a)</enum>
				<header>In general</header>
				<text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Commission shall promulgate
			 regulations that—</text>
				<paragraph id="H05540E6043C04DE5922DACE641E45E3B">
					<enum>(1)</enum>
					<text display-inline="yes-display-inline">prohibit a broadband provider from entering into an agreement with an edge provider under which the
			 broadband provider agrees, for consideration, in transmitting network
			 traffic over the broadband Internet access service of an end user, to give
			 preferential treatment or priority to the traffic of such edge provider
			 over the traffic of other edge providers; and</text>
				</paragraph><paragraph id="HE1E50DADB549414386B191E9432E5283">
					<enum>(2)</enum>
					<text display-inline="yes-display-inline">prohibit a broadband provider, in transmitting network traffic over the broadband Internet access
			 service of an end user, from giving preferential treatment or priority to
			 the traffic of content, applications, services, or devices that are
			 provided or operated by such broadband provider, or an affiliate of such
			 broadband provider, over the traffic of other content, applications,
			 services, or devices.</text>
				</paragraph></subsection><subsection commented="no" id="HAD6DE030F6BD447A930A37DCB946E615">
				<enum>(b)</enum>
				<header>Rules of construction</header>
				<paragraph id="H13E2CE20CC304A2F93172E0EFE0E8E46">
					<enum>(1)</enum>
					<header>Certain traffic not affected</header>
					<text>Nothing in this section shall be construed as superseding any obligation or authorization a
			 broadband provider may have to address the needs of emergency
			 communications or law enforcement, public safety, or national security
			 authorities, consistent with or as permitted by applicable law, or as
			 limiting the ability of the provider to do so.</text>
				</paragraph><paragraph id="H6966E1C483E94A7B8869844AB22B7C0C">
					<enum>(2)</enum>
					<header>Clarification of authority</header>
					<text>Nothing in this section shall be construed as limiting the authority of the Commission under any
			 other provision of law, including the authority to promulgate regulations
			 prohibiting or limiting preferential treatment or prioritization of the
			 traffic of an edge provider by a broadband provider under GN Docket No.
			 14–28 (relating to the matter of protecting and promoting the open
			 Internet).</text>
				</paragraph></subsection><subsection commented="no" id="HD7A5AFCB864F4668802DFA9031CA2913">
				<enum>(c)</enum>
				<header>Enforcement</header>
				<text display-inline="yes-display-inline">For purposes of sections 503(b) and 504 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503(b)</external-xref>; 504),
			 this section shall be considered to be a part of such Act. With respect to
			 enforcement under this section only, the following modifications of such
			 section 503(b) shall apply:</text>

					<enum>(1)</enum>
					<text>Paragraph (5) shall not apply.</text>
				</paragraph><paragraph commented="no" id="HF53CB952ECC543CCA9BE236CAA152BE2">
					<enum>(2)</enum>
					<text>Paragraph (6) shall be applied by substituting the following: <quote>No forfeiture penalty shall be determined or imposed against any person under this subsection if
			 the violation charged occurred more than 3 years prior to the date of
			 issuance of the required notice or notice of apparent liability.</quote>.</text>
				</paragraph></subsection><subsection id="H100AC63877674B4CB0C91D1E70F6685D">
				<enum>(d)</enum>
				<header>Definitions</header>
				<text>In this section:</text>
				<paragraph id="HD6215DAA291C41568CD6DF93C04AD1BB">
					<enum>(1)</enum>
					<header>Affiliate</header>
					<text display-inline="yes-display-inline">The term <quote>affiliate</quote> has the meaning given such term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text>
				</paragraph><paragraph id="HED2464EAE146436C8E79E0C3CE4BFE86">
					<enum>(2)</enum>
					<header>Broadband Internet access service</header>
					<text>The term <quote>broadband Internet access service</quote> has the meaning given such term in <external-xref legal-doc="regulation" parsable-cite="cfr/47/8.11">section 8.11</external-xref> of title 47, Code of Federal Regulations.</text>
				</paragraph><paragraph id="H2A63429334B04733B5A14C3815D1F87F">
					<enum>(3)</enum>
					<header>Broadband provider</header>
					<text display-inline="yes-display-inline">The term <quote>broadband provider</quote> means a provider of broadband Internet access service.</text>
				</paragraph><paragraph id="HA9A8205360944049848928D0FDC22F2B">
					<enum>(4)</enum>
					<header>Commission</header>
					<text>The term <quote>Commission</quote> means the Federal Communications Commission.</text>
				</paragraph><paragraph id="HFDC3DAE43D234C809D13B71B8E55F49D">
					<enum>(5)</enum>
					<header>Edge provider</header>
					<text display-inline="yes-display-inline">The term <quote>edge provider</quote> means an individual, institution, or other entity that provides—</text>
					<subparagraph id="H2212C705C7C844F5AD991A0A53F46F8D">
						<enum>(A)</enum>
						<text>any content, application, or service over the Internet; or</text>
					</subparagraph><subparagraph id="H62B1D9574068492CAF1351A3BBEAAB5E">
						<enum>(B)</enum>
						<text>a device used for accessing any content, application, or service over the Internet.</text>
					</subparagraph></paragraph><paragraph id="H743C06822D6F4396BC70532E5B53DB0B">
					<enum>(6)</enum>
					<header>End user</header>
					<text display-inline="yes-display-inline">The term <quote>end user</quote> means an individual, institution, or other entity that uses a broadband Internet access service.</text>
