		<official-title>To reinstate the 10-year statute of limitations period applicable to collection of amounts paid to
			 Social Security beneficiaries by administrative offset, and prevent
			 recovery of overpayments from individuals under 18 years of age.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the
		  <quote><short-title>Social Security Overpayments Fairness Act of 2014</short-title></quote>.</text>
		</section><section id="idD7BD2DD9DF3D4FC282E4379C378EE4A7"><enum>2.</enum><header>Statute of limitation on recovery by administrative offset for amounts paid to	Social Security
			 beneficiaries</header><subsection id="id8252A731EED04E41B244375008DFEBF6"><enum>(a)</enum><header>In general</header><text>Paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/31/3716">section 3716(e)</external-xref> of title 31, United States
Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="id2852651F8C38499BB6CFFDBD289E0FF8" style="OLC"><paragraph id="idEBFABBC073D74200B79F793ED90BA727" indent="up1"><enum>(2)</enum><text>This section does not apply—</text><subparagraph id="idB71D31691C0C40F59BB3882A7B3BA12B"><enum>(A)</enum><text>to a claim under this subchapter relating to any payments made to an individual under title II or
			 title XVI of the Social Security Act that has been outstanding for more
			 than 10 years; or</text></subparagraph><subparagraph id="id87F816F209024407B610ED9385458FFE"><enum>(B)</enum><text>when a statute explicitly prohibits using administrative offset or setoff to collect the claim or
			 type of claim involved.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id08886D44F5424985BC954320DD4B6764"><enum>(b)</enum><header>Effective date</header><text>The amendment made by
subsection (a) shall apply to any debt outstanding on or after
the date of the enactment of this Act.</text>
			</subsection></section><section id="idA94F7AA842FB4F1EB11B9747FF575EF9"><enum>3.</enum><header>Elimination of recovery of overpayments made to or on behalf of a minor</header><subsection id="id3D7AB03A0333426C9ADE7C98D6DAA203"><enum>(a)</enum><header>In general</header><text>Section 204(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/404">42 U.S.C. 404(a)</external-xref>) is amended by adding at the end the
			 following new paragraph:</text><quoted-block display-inline="no-display-inline" id="id5970D6C4A43D4092B0C1BC8550CDD6E6" style="OLC"><paragraph id="id6592F385E3274A598359CD084D261658" indent="up1"><enum>(3)</enum><text>Notwithstanding any other provision of this section, in the case of any payment under this title or
			 title XVI of more than the correct amount that is made to or on behalf of
			 an individual who has not attained 18 years of age at the time of such
			 payment, such
			 individual shall not be liable for the
			 repayment of the amount of such payment in excess of the correct amount.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3EF6840AB9BC4B23A53BA2AB836F8603"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id36BCD79825284EE9AD4C5355449AAB54"><enum>(1)</enum><header>Cross-program recovery of overpayments</header><text>Subsection (a) of the undesignated section following section 1146 of the Social Security Act (42
			 U.S.C. 1320b–17) is amended by striking <quote>Subject to subsection (b)</quote> and inserting <quote>Subject to section 204(a)(3) and subsection (b)</quote>.</text></paragraph><paragraph id="id1ABD273BE1AB484EBBBD3A5F9AFBB0B3"><enum>(2)</enum><header>Overpayment of disability benefits</header><text>Section 1631(b)(1)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1383">42 U.S.C. 1383(b)(1)(A)</external-xref>) is amended by striking <quote>Whenever</quote> and inserting <quote>Subject to section 204(a)(3), whenever</quote>.</text></paragraph></subsection><subsection id="id78B0078619DC44ABAB2CF9494573851A"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to payments made on or after the date of the
			 enactment of this Act.</text></subsection></section></legis-body>
