<official-title>To exempt certain 16- and 17-year-old children employed in logging or mechanized operations from child labor laws.</official-title>

<section id="H1DF996EB4C814DF8A942EBCED65E67E6" section-type="section-one"> <enum>1.</enum> <header>Short title</header> <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Future Logging Careers Act</short-title></quote>.</text> </section>
<section id="HA995AFBE080249D5B358B4FC74F477A1"> <enum>2.</enum> <header>Child labor law exemptions for logging and mechanized operations</header> <text display-inline="no-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended—</text> 
<paragraph id="HE79DB709A073438AA76E46CF7FA9197B"> <enum>(1)</enum> <text>in section 3 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref>)—</text> 
<subparagraph id="H36B7F2E987F348EF8E53F9E4808FF4D9"> <enum>(A)</enum> <text>in subsection (l), by adding at the end the following: <quote>, and that employment of employees ages sixteen or seventeen years in a logging or mechanized operation in an occupation that the Secretary of Labor finds and declares to be particularly hazardous for the employment of children of such ages shall not be deemed to constitute oppressive child labor if such employee is employed by his parent or by a person standing in the place of his parent in a logging or mechanized operation owned or operated by such parent or person</quote>; and</text> </subparagraph>
<subparagraph id="H93A378F1199341FDBBD91ECCFF3058FD"> <enum>(B)</enum> <text>by adding at the end the following:</text>

<subsection id="HCD5F4F976C5D45F482E91AB0A960F3A0"> <enum>(z)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HAFE5F909630E493FAF65850315BF452A"><enum>(1)</enum> <text display-inline="yes-display-inline"> <quote>Logging</quote>—</text> 
<subparagraph id="H81122F49DE7B4E0A8598FB517637E30E" indent="up1"> <enum>(A)</enum> <text>means—</text> 
<clause id="HBAE25902624B43FB8DCA6E4C0DB1B75A"> <enum>(i)</enum> <text>the felling of timber in mechanized operations;</text> </clause>
<clause id="HC51FAF3E18944D27A27031D5EE93E563"> <enum>(ii)</enum> <text>the bucking or converting of timber into logs, poles, ties, bolts, pulpwood, chemical wood, excelsior wood, cordwood, fence posts, or similar products;</text> </clause>
<clause id="HAB5517EA03E04031AB28A9965630A869"> <enum>(iii)</enum> <text>the collecting, skidding, yarding, loading, transporting and unloading of such products in connection with logging;</text> </clause>
<clause id="H394DA6388F7740D88065BFC7D19638FD"> <enum>(iv)</enum> <text>the constructing, repairing and maintaining of roads or camps used in connection with logging;</text></clause>
<clause id="H5B01C1A7801949E5B9069C442FBA2277"><enum>(v)</enum><text>the constructing, repairing, and maintenance of machinery or equipment used in logging; and</text> </clause>
<clause id="HEBA36DD2515B4B76887D359C2E581F08"> <enum>(vi)</enum> <text>other work performed in connection with logging; and</text> </clause></subparagraph>
<subparagraph id="H7016B454266E4B38BB6A9B810AE7AEA3" indent="up1"> <enum>(B)</enum> <text>does not include the manual use of chain saws to fell and process timber and the use of cable skidders to bring the timber to the landing.</text> </subparagraph></paragraph>
<paragraph id="H8BF8184ACCB24553B89632CE86FF7B03" indent="up1"> <enum>(2)</enum> <text> <quote>Mechanized operation</quote>—</text> 
<subparagraph id="H6915720534EE434586754CABFB714469"> <enum>(A)</enum> <text>means the felling, skidding, yarding, loading and processing of timber by equipment other than manually operated chainsaws and cable skidders; and</text> </subparagraph>
<subparagraph id="H6B8F84A67EBC4742BA1F22E7F981B4E1"> <enum>(B)</enum> <text display-inline="yes-display-inline">includes whole tree processors, cut-to-length processors, stroke boom delimbers, wheeled and track feller-bunchers, pull thru delimbers, wheeled and track forwarders, chippers, grinders, mechanical debarkers, wheeled and track grapple skidders, yarders, bulldozers, excavators, and log loaders.</text> </subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph id="H4E8F8E4DC062458B99E90C4B2D85C269"> <enum>(2)</enum> <text>in section 13(c) (<external-xref legal-doc="usc" parsable-cite="usc/29/211">29 U.S.C. 211(c)</external-xref>), by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HC9FD01BC36AD4A8F8D04B92B80FA6BE4" style="OLC"> 
<paragraph id="H4520C1B318CF4B8182BD3F20FE4806CD"> <enum>(8)</enum> <text display-inline="yes-display-inline">The provisions of section 12 relating to child labor shall apply to an employee who is 16 or 17 years old employed in a logging or mechanized operation in an occupation that the Secretary of Labor finds and declares to be particularly hazardous for the employment of children ages 16 or 17, except where such employee is employed by his parent or by a person standing in the place of his parent in a logging or mechanized operation owned or operated by such parent or person.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section>
