	<legis-body><section id="id210909009DF242D996CC62404DA1153F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Removing Repeated Executive Delays to Transboundary Approvals of Pipelines and Engineering Act</short-title></quote>.</text></section><section id="id0ECDD93B8B43441982181D828C7B2D6B" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id045c546b2e454c8fb3544389333aed0c"><enum>(1)</enum><text>the American Society of Civil Engineers recently assessed the infrastructure system of the United
			 States and gave the system an overall grade of D+;</text></paragraph><paragraph id="ida8cbafdfe2804a4193e0e403e67df078"><enum>(2)</enum><text>recent critical infrastructure decisions  have become unacceptably politicized;</text></paragraph><paragraph id="ide2aacf7c02cb43f890de666e8b6975d9"><enum>(3)</enum><text>permit applications for the Keystone XL Pipeline have been under review for over 5<fraction>1/2</fraction> years; and</text></paragraph><paragraph id="id7ba4ee7cb66e469b84c53b2d8489eb8c"><enum>(4)</enum><text>Congress can alleviate political interference in critical infrastructure decisions by—</text><subparagraph id="idD76F6E1254924457B7EF4F6EAA108B0F"><enum>(A)</enum><text>directly
			 delegating to the Secretary of State the authority to expedite review of
			 permits necessary to accelerate the completion of energy production and
			 transmission projects; and</text></subparagraph><subparagraph id="id1729272FB4FD400A8EEEFF86E73B6A87"><enum>(B)</enum><text>providing a systematic method for evaluating and
			 permitting the constructing and maintenance of certain other border
			 crossings
			 for land transportation (including motor and rail vehicles) and other
			 facilities.</text></subparagraph></paragraph></section><section id="idDC917E797F0345D996631D1C49977872"><enum>3.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of State.</text></section><section id="id2DEAED7E92664ECB973E6FB51122D3F4"><enum>4.</enum><header>Constitutional authority</header><text display-inline="no-display-inline">In accordance with clause 3 of section 8 of article I of the Constitution (delegating to Congress
			 the power to regulate commerce with foreign nations), Congress has the
			 power to regulate the approval of infrastructure connecting the United
			 States with a foreign country.</text></section><section id="idCA38B563AE844906A9DC0B28AA00C3AE"><enum>5.</enum><header>Delegation of authority to the Department of State</header><subsection id="idf1837f6391cb4a1c974392c3aa0b2864"><enum>(a)</enum><header>In general</header><text>The Secretary is designated and empowered to receive all applications for permits for the
			 construction, connection, operation, or maintenance, at the borders of the
			 United States (other than applications received by the Secretary of Energy
			 under laws in existence on the date of enactment of this Act), of—</text><paragraph id="idFE31BFDB8D0448EDBC3EB8F9BDA76884"><enum>(1)</enum><text>facilities for the exportation or importation of
			 petroleum, petroleum products, coal, or other fuels to or from a foreign
			 country;</text></paragraph><paragraph id="id50618e3859a24eb38adc924fc0062bb7"><enum>(2)</enum><text>pipelines, conveyor belts, and similar facilities for the exportation or importation of products
			 (other than the products described in paragraph (1))  to or from a foreign
			 country;</text></paragraph><paragraph id="idc93ecd7212944e088b6ddc5129023027"><enum>(3)</enum><text>facilities for the exportation or importation of water or sewage to or from a foreign country;</text></paragraph><paragraph id="id56958537401b4e648acb2beb45f02d21"><enum>(4)</enum><text>facilities for the transportation of persons, things, or both persons and things to or from a
			 foreign country;</text></paragraph><paragraph id="id1379a8ade598494eb7b6e321c3a4739c"><enum>(5)</enum><text>bridges, to the extent that congressional authorization is not otherwise required under law;</text></paragraph><paragraph id="id28ea143e1386477f8a2aa630088ff368"><enum>(6)</enum><text>facilities similar to the facilities otherwise described in this subsection that are located above
			 or below ground; and</text></paragraph><paragraph id="id8f774da6d4ec46f3bf646067b430b9a3"><enum>(7)</enum><text>border crossings for land transportation, including motor and rail vehicles, to or from a foreign
			 country, whether or not in conjunction with the facilities described in
			 paragraph (4).</text></paragraph></subsection><subsection id="id410543a24fe74603854e491de31c950e"><enum>(b)</enum><header>Requests for information</header><paragraph id="id36833CE99EB64BCD8C4CCC2CC9C1BE4D"><enum>(1)</enum><header>In general</header><text>On receipt of a completed application under subsection (a), the Secretary shall—</text><subparagraph id="id896f5e8e5bbb485d98f1d44893956b4e"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idA7F526A4B95E4DD9872723C8D0D0D793"><enum>(i)</enum><text>request any additional information needed from the applicant, as appropriate; and</text></clause><clause id="id6FBAB6984DF14633A6ED29DE0257A6C6" indent="up1"><enum>(ii)</enum><text>refer the application to other agencies pursuant to paragraph (2);</text></clause></subparagraph><subparagraph id="id812f2f5e890a4c81a87e38f47cde6866"><enum>(B)</enum><text>refer the application and pertinent information to, and request the views of—</text><clause id="id72E3F3EB6DD94871996CF616B6411A27"><enum>(i)</enum><text>the Secretary of Defense, the Attorney General, the Secretary of the Interior, the Secretary of
			 Commerce, the Secretary of Transportation, the Secretary of Energy, the
			 Secretary of Homeland Security, the Administrator of the Environmental
			 Protection Agency (or the heads of successor agencies); and</text></clause><clause id="idE690480CA2394EA780E73B3B7CCFE49F"><enum>(ii)</enum><text>for applications concerning the border with Mexico, the United States Commissioner of the
			 International Boundary and Water Commission; and</text></clause></subparagraph><subparagraph id="idabf5f226cb8f408ab2f37e31035e7bd2"><enum>(C)</enum><text>refer the application and pertinent information to, and request the views of, such other Federal
			 department and agency heads as the Secretary determines appropriate.</text></subparagraph></paragraph><paragraph id="id96b9bc95617b4c9694fdaf8fdbdafd7d"><enum>(2)</enum><header>Additional consultations</header><text>The Secretary—</text><subparagraph id="id577E53EB65F84FB98D26EF09995CA43C"><enum>(A)</enum><text>may consult with State, tribal, and local government officials and foreign governments, as the
			 Secretary determines appropriate, with respect to an application under
			 subsection (a); and</text></subparagraph><subparagraph id="id832AA6B7FDC04092974C2280B2B1593E"><enum>(B)</enum><text>shall request responses in a timely manner, not to exceed 90 days from the date of the request.</text></subparagraph></paragraph><paragraph id="id603130a723ea45e0960ffeb84eede327"><enum>(3)</enum><header>Further consideration</header><text>On receiving the views and assistance requested under paragraphs (1) and (2), the Secretary shall
			 consider, in light of any statutory or other requirements or other
			 considerations, whether additional information is necessary to evaluate
			 the application and, as appropriate, request the additional information
			 from the applicant.</text></paragraph><paragraph id="idF5C460B048F84517BE4D4CD470F3385B"><enum>(4)</enum><header>Public comment</header><text>The Secretary may provide for—</text><subparagraph id="idA43FB1AD9166478B97EF2063CCBF0C90"><enum>(A)</enum><text>the publication in the Federal Register of notice of receipt of applications;</text></subparagraph><subparagraph id="id42CD08CF3201431C85A5B4F548821E1B"><enum>(B)</enum><text>the receipt of public comments on applications; and</text></subparagraph><subparagraph id="id6CD2B3AC3A8345298F2D9078FC2689A8"><enum>(C)</enum><text>notices related to the issuance or denial of applications.</text></subparagraph></paragraph></subsection><subsection id="id6bb4c7f4f7424d8ba46cd4c768707fa9"><enum>(c)</enum><header>Compliance</header><paragraph id="id99FFA041C87347D7A5ADC97ED73BADE8"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), a Federal agency consulted by the Secretary under subsection (b)(1) shall
			 comply with the request of the Secretary (consistent with the authority of
			 the Federal agency) as soon as practicable but not later than 90 days
			 after the date on which the request is submitted.</text></paragraph><paragraph id="id9ce953d6fdfe4c83801c0c22cf768363"><enum>(2)</enum><header>Timing</header><text>If a Federal agency consulted by the Secretary under subsection (b)(1) requests from the Secretary
			 additional information that is necessary to carry out the request, the
			 compliance deadline under paragraph (1) shall not begin until the date on
			 which the additional information is received.</text></paragraph></subsection><subsection id="idc8d884bbdfe5457696f110b6982f2c6c"><enum>(d)</enum><header>National interest determination</header><paragraph id="id687EAEAC508E49FAAAFB11BD270B1F07"><enum>(1)</enum><header>In general</header><text>After consideration of the views, assistance, and public comment received under subsection (b), if
			 the Secretary finds that issuance of a permit to the applicant would serve
			 the national interest, the Secretary shall—</text><subparagraph id="idEA2D98B18CA44CABB75816EA40814E84"><enum>(A)</enum><text>prepare a permit, in such form and with such terms and conditions as the national interest
			 requires, as determined by the Secretary; and</text></subparagraph><subparagraph id="id918F206F8A1E4B36BB8464D653B87A09"><enum>(B)</enum><text>notify the officials required to be consulted under subsection (b)(1)(B) of the proposed
			 determination that a permit be issued.</text></subparagraph></paragraph><paragraph id="id30dcd0cb74fc4c4a92179a1f797a3440"><enum>(2)</enum><header>Proposed denial</header><text>After consideration of the views, assistance, and public comment received under subsection (b), if
			 the Secretary finds that issuance of a permit to the applicant would not
			 serve the national interest, the Secretary shall notify the officials
			 required to be consulted under subsection (b)(1)(B) of the proposed
			 determination that the application be denied.</text></paragraph></subsection><subsection id="id519927d70d9c48f1a47d135ddbf0de58"><enum>(e)</enum><header>Issuance or denial</header><text>The Secretary shall issue or deny the permit in accordance with the proposed determination under
			 subsection (d).</text></subsection><subsection id="idc3fde502f77740f2a903e2db9009a06e"><enum>(f)</enum><header>Regulations</header><text>The Secretary may promulgate such rules and regulations and prescribe such procedures (including
			 rules, regulations, and procedures relating to the International Boundary
			 and Water Commission) as the Secretary determines necessary to carry out
			 this section.</text></subsection><subsection id="idA78C4280893F4FA1BF44FCBBD57C2035"><enum>(g)</enum><header>Pending applications</header><text>Except as provided in section 6, this section shall apply only to applications for permits filed on
			 or after the date of enactment of this Act.</text></subsection><subsection id="id81CCB85BCD0B43AF83C65E818E1F8F59"><enum>(h)</enum><header>Effect</header><text>Except as explicitly provided in this Act, nothing in this section limits the application of, or
			 obligation to comply with, the requirements of any other Federal
			 department or agency.</text></subsection><subsection id="id785a360cf7014635906a0043455f90a4"><enum>(i)</enum><header>Final rule</header><text>The decision made by the Secretary under subsection (e) shall be deemed to be a rule for purposes
			 of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">chapter 8</external-xref> of title 5, United States Code (commonly known as the <quote>Congressional Review Act</quote>).</text></subsection></section><section id="id9FD42F09ECC44582A6149BCFA7F5E9E5"><enum>6.</enum><header>Keystone XL pipeline approval</header><subsection id="id5E3A29FBBDC04426B86037DD957E23D8">
				<enum>(a)</enum>
				<header>In
			 general</header>
				<text>TransCanada Keystone
			 Pipeline, L.P. may construct, connect, operate, and maintain the pipeline
			 and cross-border facilities described in the application  filed on May 4,
			 2012, by TransCanada Corporation to the Department of State (including any
			 subsequent revision to the pipeline route within the State of Nebraska
			 required or authorized by the State of Nebraska).</text>
			</subsection><subsection id="idC325008B308D473CBB557D997310EF0A">
				<enum>(b)</enum>
				<header>Environmental
			 impact statement</header>
				<text>The Final  Supplemental Environmental Impact Statement issued
			 by the Secretary of State in January 2014,
			 regarding the pipeline referred to in subsection (a), and the
			 environmental analysis, consultation, and review described in that
			 document (including appendices) shall be considered
			 to
			 fully satisfy—</text>
				<paragraph id="id829AB470EA9348609A898521C7EDA7CE">
					<enum>(1)</enum>
					<text>all requirements
			 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);
			 and</text>
				</paragraph><paragraph id="id6467EBA4030440AEB564BB1DD4E90992">
					<enum>(2)</enum>
					<text>any other
			 provision of law that requires Federal agency consultation or review
			 (including the consultation or review required under section 7(a) of the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)</external-xref>)) with
			 respect to the pipeline and facilities referred to in subsection (a).</text>
				</paragraph></subsection><subsection id="id069597F72D2C48D5B5A09A66C244BA18">
				<enum>(c)</enum>
				<header>Permits</header>
				<text>Any
			 Federal permit or authorization  issued before the date of enactment of
			 this Act
			 for the pipeline and cross-border facilities referred to in subsection (a)
			 shall remain in effect.</text>
			</subsection><subsection id="id833623BE3129478195B0D8D129D6857B">
				<enum>(d)</enum>
				<header>Federal
			 judicial review</header>
				<text>Any legal challenge to a Federal agency action regarding the pipeline and cross-border facilities
			 described in subsection (a), and the related facilities in the United
			 States,
			 that are approved by this Act, and any permit, right-of-way, or other
			 action taken to construct or complete the project pursuant to Federal law,
			 shall only be subject to judicial review on direct appeal to the United
			 States
			 Court of Appeals for the District of Columbia Circuit.</text>
			</subsection><subsection id="idAFD6717E3E1340C7BE971A80B7306247"><enum>(e)</enum><header>Private property savings clause</header><text>Nothing in this Act alters any Federal, State, or local process or condition in effect on the date
			 of enactment of this Act that is necessary to secure access from an owner
			 of private property to construct the pipeline and cross-border facilities
			 described in subsection (a).</text></subsection></section><section id="id0F9B5683BF514E01B52CAD1B930D7AE0"><enum>7.</enum><header>Review of certain Executive orders</header><text display-inline="no-display-inline">The Comptroller General of the United States shall—</text><paragraph id="idA3C7C744A71D474AB2907BED2CAB93FE"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a review of any Executive order issued by the President that is not based on the exclusive
			 constitutional authority of the President; and</text></paragraph><paragraph id="id879A9770931742B582113B4A8102BF74"><enum>(2)</enum><text>not later than 180 days after the date of enactment of this Act, submit to Congress a report on the
			 results of the review.</text>
