		<official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">chapter 81</external-xref> of title 5, United States Code, to establish a presumption that a disability or
			 death of a Federal employee in fire protection activities caused by
			 certain diseases is the result of the performance of the duties of the
			 employee.</official-title>

			<enum>1.</enum>
			<header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Firefighters Fairness Act of 2014</short-title></quote>.</text>

			<enum>2.</enum>
			<header>Certain diseases presumed to be work-related cause of disability or death of Federal employees in
			 fire protection activities</header>
			<subsection id="H75FEF6CCD03B47EA91AAF94A9F279AEF">
				<enum>(a)</enum>
				<header>Definition</header>
				<text><external-xref legal-doc="usc" parsable-cite="usc/5/8101">Section 8101</external-xref> of title 5, United States Code, is amended—</text><paragraph id="id52CAB73481984B6E96D521DB95EDA85A"><enum>(1)</enum><text>in paragraph (18), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="idE859F7D058C7477284C653ACACAA6909"><enum>(2)</enum><text>in paragraph (19), by striking	<quote>and</quote> at the end;</text></paragraph><paragraph id="idCEF618C0917C4B2F81AA8E8AD2FAE551"><enum>(3)</enum><text>in paragraph (20), by striking the period at the end and inserting <quote>and</quote>; and</text></paragraph><paragraph id="id3E941FB5E2E84BD88C0A7686ECE83F4E"><enum>(4)</enum><text>by adding at the end the following:</text>

							<enum>(21)</enum>
							<text>
								<quote>employee in fire protection activities</quote> means a firefighter, paramedic, emergency medical technician, rescue worker, ambulance personnel,
			 or hazardous material worker, who—</text>
							<subparagraph id="H969CAD82B2324211A808F060636202C0">
								<enum>(A)</enum>
								<text>is trained in fire suppression;</text>
							</subparagraph><subparagraph id="H9B6E17998D6943B19751DDD7FB3A805C">
								<enum>(B)</enum>
								<text>has the legal authority and responsibility to engage in fire suppression;</text>
							</subparagraph><subparagraph id="H8A952012403C44E3B9409D1FC093EF49">
								<enum>(C)</enum>
								<text>is engaged in the prevention, control, and extinguishment of fires or response to emergency
			 situations where life, property, or the environment is at risk; and</text>
							</subparagraph><subparagraph id="H3D36793E414D40FD906C774155A750C0">
								<enum>(D)</enum>
								<text>performs such activities as a primary responsibility of the job of the individual.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H4402BA34E1DD40D0ADA051CB72A7D5D0">
				<enum>(b)</enum>
				<header>Presumption relating to employees in fire protection activities</header>
				<text><external-xref legal-doc="usc" parsable-cite="usc/5/8102">Section 8102</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="HA59BACF3863A4A59AD25B5EB675AA6B2" style="OLC">
					<subsection id="H9D6A7A684E494F6FB5D5E0E6CC20E73E"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB1790EFA1BA84205B4740AC5E5EED3A8"><enum>(1)</enum><text>With regard to an employee in fire protection activities, a disease specified in paragraph (3)
			 shall be presumed to be proximately caused by the employment of such
			 employee, subject to the length of service requirements specified. The
			 disability or death of an employee in fire protection activities due to
			 such a disease shall be presumed to result from personal injury sustained
			 while in the performance of such employee’s duty. Such presumptions may be
			 rebutted by a preponderance of the evidence.</text></paragraph><paragraph id="H2BCB42A0C61F4806B416E1E155FF7395" indent="up1"><enum>(2)</enum><text>Such presumptions apply only if the employee in fire protection activities is diagnosed with the
			 disease for which presumption is sought within 10 years of the last active
			 date of employment as an employee in fire protection activities.</text></paragraph><paragraph id="H98BF0A149DE14BE5AC45235B08200FA3" indent="up1"><enum>(3)</enum><text>The following diseases shall be presumed to be proximately caused by the employment of the employee
			 in fire protection activities:</text><subparagraph id="HBB14FA960A27491DBDC11F5E008B4684"><enum>(A)</enum><text>If the employee has been employed for a minimum of 5 years in aggregate as an employee in fire
			 protection activities:</text><clause id="H0EC42750986D4AE0BEA65A6383979407"><enum>(i)</enum><text>Heart disease.</text></clause><clause id="HF771ED607C7547AE8D02C7B796C2B9D4"><enum>(ii)</enum><text>Lung disease.</text></clause><clause id="H1193EE15B3604367B522527509B74946"><enum>(iii)</enum><text>The following cancers:</text><subclause id="H5E0A79F9C69D4FAFAB690DA2C67BF413"><enum>(I)</enum><text>Brain cancer.</text></subclause><subclause id="HB196514760BB45399545DA3289B60145"><enum>(II)</enum><text>Cancer of the blood or lymphatic systems.</text></subclause><subclause id="HB9C61360783640BA97BE6E2FC001F048"><enum>(III)</enum><text>Leukemia.</text></subclause><subclause id="H6535FC31B549428EB7ADA74AC7E81C43"><enum>(IV)</enum><text>Lymphoma (except Hodgkin’s disease).</text></subclause><subclause id="H21519DE18C604A408FFD8AA94F4E8D93"><enum>(V)</enum><text>Multiple myeloma.</text></subclause><subclause id="HA99138602F5B4523B553201E10377363"><enum>(VI)</enum><text>Bladder cancer.</text></subclause><subclause id="HCC7C6401F9FB4F3F984110A4E74F0F08"><enum>(VII)</enum><text>Kidney cancer.</text></subclause><subclause id="H3DDB13092EA24C2EAF706547528A1E2D"><enum>(VIII)</enum><text>Testicular cancer.</text></subclause><subclause id="H09C9BABD72164195AFDDE131FDCAA259"><enum>(IX)</enum><text>Cancer of the digestive system.</text></subclause><subclause id="H8E7EFFDF46C04B3796259146E1C2F18E"><enum>(X)</enum><text>Colon cancer.</text></subclause><subclause id="H7C408C164050448E98C968893F4F6A24"><enum>(XI)</enum><text>Liver cancer.</text></subclause><subclause id="HBB3C16E42C224EAFAEAF509832CDCD9B"><enum>(XII)</enum><text>Skin cancer.</text></subclause><subclause id="H3782250EFCEA4A419703ABB2B4C3B932"><enum>(XIII)</enum><text>Lung cancer.</text></subclause></clause><clause id="H8ACA3FC296C44ADE8E58FE7A2C31A120"><enum>(iv)</enum><text>Any other cancer the contraction of which the Secretary of Labor through regulations determines to
			 be related to the hazards to which an employee in fire protection
			 activities may be subject.</text></clause></subparagraph><subparagraph id="HA2F4231699414D3DB329AA03AC56EC25"><enum>(B)</enum><text>Regardless of the length of time an employee in fire protection activities has been employed, any
			 uncommon infectious disease, including but not limited to tuberculosis,
			 hepatitis A, B, or C, the human immunodeficiency virus (HIV), and any
			 other uncommon infectious disease the contraction of which the Secretary
			 of Labor through regulations determines to be related to the hazards to
			 which an employee in fire protection activities may be subject.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8378BB55D3424A80A0DCA6DEE990EFBE">
				<enum>(c)</enum>
				<header>Report</header>
				<text>Not later than 5 years after the date of enactment of this Act, the National Institute of
			 Occupational Safety and Health in the Centers for Disease Control and
			 Prevention shall examine the implementation of the amendments made by this
			 Act and appropriate
			 scientific and medical data related to the health risks associated with
			 firefighting and submit to Congress a report that shall include—</text>
				<paragraph id="H0EDCDE145A044D27B66F284FF32799F9">
					<enum>(1)</enum>
					<text>an analysis of the injury claims made pursuant to the amendments made by this Act;</text>
				</paragraph><paragraph id="H0B074251CBF24591B89624FEC7C1053E">
					<enum>(2)</enum>
					<text>an analysis of the available research related to the health risks associated with firefighting; and</text>
				</paragraph><paragraph id="H4389D9B75B7148D2B8465B58363B5680">
					<enum>(3)</enum>
					<text>recommendations for any administrative or legislative actions necessary to ensure that 
			 diseases most associated with firefighting are included in the presumption
			 established under this Act.</text>
				</paragraph></subsection><subsection id="HC942D261BEB04D5C9A3017775DD46423">
				<enum>(d)</enum>
				<header>Effective date</header>
				<text>The amendments made by this Act shall apply to an injury that is first diagnosed or a death that
			 occurs, on or after the date of enactment of this Act.</text>
