<enum>I</enum> <header>Transition period</header> <section id="idC6743835DB1048CBB9F0EA9BDCF1D1FE"> <enum>101.</enum> <header>Phased-in increase in States providing free school lunches and breakfasts</header> <text display-inline="no-display-inline">Section 11 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1759a">42 U.S.C. 1759a</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id957D3DAAF5FE40BA8F3228492A1A8F15" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id77FA9B830E8E4B4683F17E3BAABB1B1F"><enum>(h)</enum><header display-inline="yes-display-inline">Phased-In increase in States providing free school lunches and breakfasts</header><paragraph id="ID6A8537C0133841EE98B3EA722B65B9FB"><enum>(1)</enum><header>In general</header><text>The Secretary shall expand the service of free lunches and breakfasts provided at schools participating in the school lunch program under this Act and the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) in States selected by the Secretary in accordance with paragraph (2).</text></paragraph><paragraph id="id9DF8DA06D7774CF6818B17CE0932A65B"><enum>(2)</enum><header>Selection of States</header><subparagraph id="id56358F2B4E114BE1A33BB567092368E3"><enum>(A)</enum><header>In general</header><text>A State that elects to participate in the program under this subsection shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subparagraph><subparagraph id="idEAD3245EFEE84035B40CA9061425E393"><enum>(B)</enum><header>First year</header><text>For the school year beginning July 1, 2014, the Secretary shall enroll in the program under this subsection any State that, as of April 10, 2014, has enacted a law under which, in compliance with this Act and the Child Nutrition Act of 1966 (42 U.S.C. 1771 et seq.) (as appropriate), school food authorities in the State provide free breakfasts or lunches in lieu of reduced-price breakfasts or lunches in schools statewide.</text></subparagraph><subparagraph id="idC3199283E3E54F549B041697B768023B"><enum>(C)</enum><header>Subsequent years</header><clause id="id8A03222619824F38A3683D5F94B937E7"><enum>(i)</enum><header>In general</header><text>The Secretary shall enroll in the program under this subsection not more than—</text><subclause id="idD5E6181AFE214A478FC067F7B03B54C1"><enum>(I)</enum><text>for the school year beginning July 1, 2015, 5 additional States;</text></subclause><subclause id="id0836B058A0854A9892ACC26F88B37844"><enum>(II)</enum><text>for the school year beginning July 1, 2016, 5 additional States;</text></subclause><subclause id="idBC0DAED48FA1456D92C857F6906FD4E1"><enum>(III)</enum><text>for the school year beginning July 1, 2017, 5 additional States;</text></subclause><subclause id="id20402983A52249659E9832B58DD15938"><enum>(IV)</enum><text>for the school year beginning July 1, 2018, 5 additional States; and</text></subclause><subclause id="id0322090951CF45AAAECD6246BE82E3EB"><enum>(V)</enum><text>for the school year beginning July 1, 2019, 5 additional States.</text></subclause></clause><clause id="id83BDD8F6C1BF4CC7AAB52D6F213ECACC"><enum>(ii)</enum><header>Priority</header><text>In enrolling States, the Secretary shall give priority to States that—</text><subclause id="idE24155F7A5084BD18862799F26EAE1A4"><enum>(I)</enum><text>have enacted a law described in subparagraph (B) after April 10, 2014;</text></subclause><subclause id="id8310F8E37EC64709A3DA7E07C82944FD"><enum>(II)</enum><text>have school food authorities that provide free breakfasts or lunches in lieu of reduced-price breakfasts or lunches in schools in the State; or</text></subclause><subclause id="id5E21C7E78B9D4C8DA60C4D656C46399E"><enum>(III)</enum><text>have high levels of participation in the free or reduced-price lunch program, as determined by the Secretary.</text></subclause></clause></subparagraph></paragraph><paragraph id="ID611766CE56964506B88C3EF5E67F66D9"><enum>(3)</enum><header>Income eligibility</header><text>For any State enrolled in the program under this subsection, the income guidelines for determining eligibility for free lunches or breakfasts in the State shall be 185 percent of the applicable family size income levels contained in the nonfarm income poverty guidelines prescribed by the Office of Management and Budget, as adjusted annually in accordance with section 9(b)(1)(B).</text></paragraph><paragraph id="id8A5769A89EB84E169586739CABC437A2"><enum>(4)</enum><header>Relationship to universal meal service in high poverty areas</header><text>A school for which a local educational agency has elected to receive special assistance payments under subsection (a)(1)(F) may not receive any additional payments under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section><section id="id7DCF76DDE20C41EAA02A18D5528AFA78"> <enum>102.</enum> <header>Period of effectiveness</header> <text display-inline="no-display-inline">The amendments made by section 101 shall be effective only during the period beginning on the date of enactment of this Act and ending on June 30, 2019.</text> </section>

This paragraph shall not apply to punitive damages described in section 104(c).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF30F6685A6734FF4B3E3A9E369DB117B"><enum>(2)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The heading for section 162(g) of such Code is amended by inserting <quote><header-in-text level="subsection" style="OLC">or Punitive Damages</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">Laws</header-in-text></quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB29EFEE7B9294DC79899808FB8A19D2A"><enum>(b)</enum><header display-inline="yes-display-inline">Inclusion in Income of Punitive Damages Paid by Insurer or Otherwise</header><paragraph commented="no" display-inline="no-display-inline" id="ID778D6BE9AF4A40AEA019E46FF0D1C8CD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Part II of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="IDC4CC598FC9A04FB8B092E22A2999D650" style="OLC"><section commented="no" display-inline="no-display-inline" id="ID725922F1DEDC48AC9CBC0AC479A68B61" section-type="subsequent-section"><enum>91.</enum><header display-inline="yes-display-inline">Punitive damages compensated by insurance or otherwise</header><text display-inline="no-display-inline">Gross income shall include any amount paid to or on behalf of a taxpayer as insurance or otherwise by reason of the taxpayer’s liability (or agreement) to pay punitive damages.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID182E1550118A4D58B685F23B62A778B5"><enum>(2)</enum><header display-inline="yes-display-inline">Reporting requirements</header><text display-inline="yes-display-inline">Section 6041 of such Code is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="ID1ACD698B2CB14733844C4BF40FD8DE02" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="IDB47920C64E564F2F8521F2ED9F7CC015"><enum>(h)</enum><header display-inline="yes-display-inline">Section To Apply to Punitive Damages Compensation</header><text display-inline="yes-display-inline">This section shall apply to payments by a person to or on behalf of any corporation, individual, partnership, or other entity, as insurance or otherwise, by reason of such corporation, individual, partnership, or entity’s liability (or agreement) to pay punitive damages.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1EA5A6A2B07945A19AD97CD311283EC1"><enum>(3)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of sections for part II of subchapter B of chapter 1 of such Code is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="ID084609D3B90E4CB4A5D9C8275499C1EC" style="OLC"><toc regeneration="no-regeneration"><toc-entry bold="off" level="section">Sec. 91.
