		<official-title>To amend the Internal Revenue Code of 1986 to permit the Secretary of the Treasury to disclose
			 certain return information related to identity theft, and for other
			 purposes.</official-title>

			<enum>1.</enum>
			<header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Social Security Identity Defense Act of 2014</short-title></quote>.</text>
		</section><section id="H0A82B1BAB21C4169A4C38A5F828C6805">
			<enum>2.</enum>
			<header>Disclosure of
			 certain return information with respect to identity theft</header>
			<subsection id="HD679E15B3F9D47A2B64A1FD42A0157D3">
				<enum>(a)</enum>
				<header>In
			 general</header>
				<text display-inline="yes-display-inline">Subsection (l) of
			 <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103</external-xref> of the Internal Revenue Code of 1986 is amended by adding at
			 the
			 end the following new paragraph:</text>

					<paragraph id="H5DC60DACCB2B47598F70653FBC1AEDD4">
						<enum>(23)</enum>
						<header>Disclosure of
				return information in certain cases of identity theft</header>
						<subparagraph id="HEDB3FCEC533641BAAE7B0189D7F964A6">
							<enum>(A)</enum>
							<header>In
				general</header>
							<text display-inline="yes-display-inline">If the Secretary
				determines that there is a substantial likelihood that there has
			 been a
				fraudulent use of a social security account number on a statement
			 described in
				section 6051—</text>
							<clause id="H0AAC938AF61F426C8328E2CDBBF8665E">
								<enum>(i)</enum>
								<text>the Secretary
				shall disclose to the individual who was validly assigned such
			 social security
				account number—</text>
								<subclause id="HE3F08A0DF65D47D1AB310C9E1730937B">
									<enum>(I)</enum>
									<text>that the Secretary
				has reason to believe that the social security account number
			 assigned to such
				individual has been fraudulently used in the employment context,</text>
								</subclause><subclause id="H981461EEF5074C4CBC17118594D2C7AA">
									<enum>(II)</enum>
									<text>that the
				Secretary has made the disclosure described in clause (ii) to the
			 Director of
				the Federal Bureau of Investigation with respect to such fraudulent
			 use,
				and</text>
								</subclause><subclause id="H1B9E99940B30408385002FFDB559C746">
									<enum>(III)</enum>
									<text>such other
				information (other than return information) as the Secretary
			 determines, in
				consultation with Federal Trade Commission, would be helpful and
			 appropriate to
				provide to a victim of identity theft, and</text>
								</subclause></clause><clause id="H9193E01A8E87429B9B05AEED8BC34099">
								<enum>(ii)</enum>
								<text>the Secretary
				shall disclose to the Director of the Federal Bureau of
			 Investigation—</text>
								<subclause id="HCA43DA89CD724B03969B36E1CBC7FFAC">
									<enum>(I)</enum>
									<text>such social
				security account number,</text>
								</subclause><subclause id="H34C02954862E47C794BACBBB87390287">
									<enum>(II)</enum>
									<text>that the
				Secretary has reason to believe that such social security account
			 number has
				been fraudulently used in the employment context, and</text>
								</subclause><subclause id="H284DB523F2DB4B6FB63851CBBE76E3C9">
									<enum>(III)</enum>
									<text>the taxpayer
				identity information of the individual who was assigned such social
			 security
				account number, the individual believed to have fraudulently used
			 such social
				security account number, and the employer who made the statement
			 described in
				section 6051 which included such social security account number.</text>
								</subclause></clause></subparagraph><subparagraph id="HC8BE6B19DA904B9380C98880D885F918">
							<enum>(B)</enum>
							<header>Restriction on
				disclosure to law enforcement</header>
							<clause id="H96CA0865DA7F49E78284587A515C2D73">
								<enum>(i)</enum>
								<header>Disclosure to
				other law enforcement officials</header>
								<text>The Director of the Federal
				Bureau of Investigation may disclose information received under
			 subparagraph
				(A)(ii) to appropriate Federal, State, and local law enforcement
				officials.</text>
							</clause><clause id="H50FC7163C22148DB903BE2BF4727F031">
								<enum>(ii)</enum>
								<header>Restriction on
				use of disclosed information</header>
								<text>Return information disclosed under
				subparagraph (A)(ii) may be used by Federal, State, and local law
			 enforcement
				officials only for purposes of carrying out criminal investigations
			 or
				prosecutions.</text></clause><clause id="id4B3C09F35D3B41E2A31CAE29E32CE891"><enum>(iii)</enum><header>Memorandum of understanding</header><text>For purposes of this paragraph, any return information disclosed under subparagraph (A)(ii) may not
			 be provided to any State or local law enforcement official until such
			 official has entered into a memorandum of understanding with the Secretary
			 that includes the following terms and conditions:</text><subclause id="id23DF3BDBCFD7423884A6A795EC2B7BD8"><enum>(I)</enum><text>Confidentiality of returns and return information and prohibitions on disclosure described in
			 subsection (a)(3).</text></subclause><subclause id="idDAFB4F3E5DA84A4ABD9230276F9716F6"><enum>(II)</enum><text>Safeguards, restrictions on access, and recordkeeping requirements described in subsection (p)(4).</text></subclause><subclause id="id96AEDD93E04E41AA8294E7238D6CF29C"><enum>(III)</enum><text>Application of penalties for unauthorized disclosure of returns and return information under
			 section 7213(a)(2).</text></subclause><subclause id="idDB278C9C31A740CE840FF0DB29C7D814"><enum>(IV)</enum><text>Any additional terms and conditions deemed appropriate by the Secretary.</text>
								</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5877D3D4286F4F4B8FDB4DF819EBC381">
				<enum>(b)</enum>
				<header>Prevention of
			 use of W–2 statements To carry out identity theft</header>
				<text>Section 6051 of
			 such Code is amended by adding at the end the following new subsection:</text>

					<subsection id="H7E2CF1D1D6674CA5A8ED2157D9C2BB18">
						<enum>(g)</enum>
						<header>Prevention of
				identity theft</header>
						<text display-inline="yes-display-inline">Except as
				otherwise provided by the Secretary, if an employer is notified by
			 the
				Secretary with respect to any employee that the Secretary has
			 reason to believe
				that the social security account number included on the statement
			 described in
				subsection (a) with respect to such employee is not the social
			 security account
				number of such employee, such employer—</text>
						<paragraph id="H7B367332C52A40748DA774F3E4E332F4">
							<enum>(1)</enum>
							<text>shall cease to
				include such social security account number on statements provided
			 to the
				employee under subsection (a), but</text>
						</paragraph><paragraph id="HEFDA03363DC94AF9975B3D80EF445860">
							<enum>(2)</enum>
							<text>shall continue to
				include such social security account number on duplicates of such
			 statements
				provided to the Secretary under subsection
				(d).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA6E9F5FB9BC2467F8EDBFE444462185E">
				<enum>(c)</enum>
				<header>Conforming
			 amendments related to disclosure</header>
				<paragraph id="H6ACF466BDC3C4A85B6B8622E3CF29B06">
					<enum>(1)</enum>
					<header>Confidentiality</header>
					<text>Paragraph
			 (3) of section 6103(a) of such Code is amended by striking <quote>or
			 (21)</quote> and inserting <quote>(21), or (23)</quote>.</text>
				</paragraph><paragraph id="H18508E43B42648159560781F05CFC305">
					<enum>(2)</enum>
					<header>Procedures and
			 recordkeeping related to disclosures</header>
					<text>Paragraph (4) of section
			 6103(p) of such Code is amended by striking <quote>or (20)</quote> each place
			 it appears and inserting <quote>(20), or (23)</quote>.</text>

					<enum>(3)</enum>
					<header>Unauthorized
			 disclosure or inspection</header>
					<text>Paragraph (2) of section 7213(a) of such
			 Code is amended by striking <quote>or (21)</quote> and inserting <quote>(21),
