		<official-title>To provide debit card holders with consumer protections equivalent to those available to credit
			 card holders, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the
		  <quote><short-title>Consumer Debit Card Protection Act of 2014</short-title></quote>.</text>
		</section><section id="id522340A285554C58A2583FDDECB14420"><enum>2.</enum><header>Amendments to Electronic Fund Transfer Act</header><text display-inline="no-display-inline">The Electronic Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693">15 U.S.C. 1693 et seq.</external-xref>) is amended—</text><paragraph id="idB6A88D2E20B84FA1931FDFA5E753C460"><enum>(1)</enum><text display-inline="yes-display-inline">in section 908(c), by inserting <quote>, or in the case of an electronic debit transaction, as defined in section 920(c)(5), seven
			 business days except as otherwise allowed by the Bureau to protect against
			 fraud,</quote>; and</text></paragraph><paragraph id="id40F9BCD1C4EF4CF89EF52F82895AFDA9"><enum>(2)</enum><text>in section 909—</text><subparagraph id="idDDA7BDBDB06E424D8742C6C66B2DD9B7"><enum>(A)</enum><text>in subsection (a), in the first sentence, by striking <quote>A consumer shall</quote> and inserting <quote>Except as provided in subsection (b), a consumer shall</quote>;</text></subparagraph><subparagraph id="id80263DDBD05C4F2E8E738C67C2101DD1"><enum>(B)</enum><text>by redesignating subsections (b) through (e) as subsections (c) through (f), respectively; and</text></subparagraph><subparagraph id="idDEBD8195115A4DCFA22F3D84DC32C14D"><enum>(C)</enum><text>by inserting the following after subsection (a):</text><quoted-block display-inline="no-display-inline" id="idF75BE620CD4745D28D7E78D856399962" style="OLC"><subsection id="idA9ED811619D944C3857C8449107230F0"><enum>(b)</enum><header>Unauthorized debit card transactions</header><paragraph id="id35357316A7AF4E64AC4F715B05D56016"><enum>(1)</enum><header>Liability of consumer</header><text>A consumer shall be liable for the unauthorized use of a debit card, only if—</text><subparagraph id="id8363C26DCE5440DE98995BA5FB328330"><enum>(A)</enum><text>the debit card is an accepted debit card;</text></subparagraph><subparagraph id="id6C3074CBF8644CB49AFD320E3DFC7A56"><enum>(B)</enum><text>the liability is not in excess of $50;</text></subparagraph><subparagraph id="idAC6F6333C9C44684BC1354F18E02143C"><enum>(C)</enum><text>the issuer has provided the consumer with a description of a means by which the issuer may be
			 notified of loss or theft of the card;</text></subparagraph><subparagraph id="idF0924E85C30F4EABB9A54C2C2D76F284"><enum>(D)</enum><text>the unauthorized use occurs before the issuer has been notified that an unauthorized use of the
			 debit card has occurred or may occur as the result of loss, theft, or
			 otherwise; and</text></subparagraph><subparagraph id="id85ADF4BC678F44E8ABBA66E0161B2CD9"><enum>(E)</enum><text>the issuer has provided a method whereby the user of such card can be identified as the person
			 authorized to use it.</text></subparagraph></paragraph><paragraph id="id961f27cbb8274499bd0e980baaa3dfc5"><enum>(2)</enum><header>Notification</header><text>For purposes of this subsection, an issuer has been notified when such steps as may be reasonably
			 required in the ordinary course of business to provide the issuer with the
			 pertinent information have been taken, whether or not any particular
			 officer, employee, or agent of the issuer does in fact receive such
			 information.</text></paragraph><paragraph id="idd82a1641c57d4cfb832e66d1b2dbdbef"><enum>(3)</enum><header>Burden of proof</header><text>In any action by an issuer to enforce liability for the use of a debit card, the burden of proof is
			 upon the issuer to show that the use was authorized or, if the use was
			 unauthorized, then the burden of proof is upon the issuer to show that the
			 conditions of liability for the unauthorized use of a debit card, as set
			 forth in paragraph (1), have been met.</text></paragraph><paragraph id="id7bbf5307ad8049598e8997d0d694c2e6"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection imposes liability upon a consumer for the unauthorized use of a debit
			 card in excess of his liability for such use under other applicable law or
			 under any agreement with the issuer.</text></paragraph><paragraph id="idb0933095eb224d6a96908022b619b027"><enum>(5)</enum><header>Definitions</header><text>As used in this subsection, the terms <quote>debit card</quote> and <quote>issuer</quote> have the same meaning as in section 920(c).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
