			<enum>1.</enum>
			<header>Short title</header>
			<text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Good Samaritan Health Professionals Act of 2014</short-title></quote>.</text>

			<enum>2.</enum>
			<header>Limitation on
			 liability for volunteer health care professionals</header>
			<subsection id="H6139DBD4BDDA4C1EB426BBBCA2DFFEDA">
				<enum>(a)</enum>
				<header>In
			 general</header>
				<text display-inline="yes-display-inline">Title II of the
			 Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/202">42 U.S.C. 202 et seq.</external-xref>) is amended by inserting
			 after
			 section 224 the following:</text>

						<enum>224A.</enum>
						<header>Limitation on
				liability for volunteer health care professionals</header>
						<subsection id="H7847E34079FA42AE94AA74CE81B7DF30">
							<enum>(a)</enum>
							<header>Limitation on
				liability</header>
							<text display-inline="yes-display-inline">Except as provided
				in subsection (b), a health care professional shall not be liable
			 under Federal
				or State law for any harm caused by an act or omission of the
			 professional
				if—</text>
							<paragraph id="HFB086AE830694C9CB68240EA43660D15">
								<enum>(1)</enum>
								<text>the professional
				is serving as a volunteer for purposes of responding to a disaster;
			 and</text>
							</paragraph><paragraph id="H02563F06EEBD4E0F86B81BA019E7656B">
								<enum>(2)</enum>
								<text>the act or
				omission occurs—</text>
								<subparagraph commented="no" id="H3C87D5CE4D8B4D7F9C21F85C4A0EEFFA">
									<enum>(A)</enum>
									<text>during the period
				of the disaster, as determined under the laws listed in subsection
				(f)(1);</text>
								</subparagraph><subparagraph id="H371EFF169AD04B8BA7D2B962B51B60E5">
									<enum>(B)</enum>
									<text>in the health care
				professional’s capacity as such a volunteer; and</text>
								</subparagraph><subparagraph commented="no" id="HBF372D8708AA4DCF9939888CEFA3E1CC">
									<enum>(C)</enum>
									<text display-inline="yes-display-inline">in a good faith belief that the individual
				being treated is in need of health care services.</text>
								</subparagraph></paragraph></subsection><subsection id="H1DEEA6641A384F4AA92DF835E4CC872B">
							<enum>(b)</enum>
							<header>Exceptions</header>
							<text>Subsection
				(a) does not apply if—</text>
							<paragraph id="HB68050E6293347AF9BAE70DA14247F80">
								<enum>(1)</enum>
								<text>the harm was
				caused by an act or omission constituting willful or criminal
			 misconduct, gross
				negligence, reckless misconduct, or a conscious flagrant
			 indifference to the
				rights or safety of the individual harmed by the health care
			 professional;
				or</text>
							</paragraph><paragraph commented="no" id="H998185CE544C42008682C21B5F02630B">
								<enum>(2)</enum>
								<text>the health care
				professional rendered the health care services under the influence
			 (as
				determined pursuant to applicable State law) of intoxicating
			 alcohol or an
				intoxicating drug.</text>
							</paragraph></subsection><subsection commented="no" id="HF8EC58185D7D4E41B8B1892EDB2827AE">
							<enum>(c)</enum>
							<header>Standard of
				proof</header>
							<text>In any civil action or proceeding against a health care
				professional claiming that the limitation in subsection (a)
			 applies, the
				plaintiff shall have the burden of proving by clear and convincing
			 evidence the
				extent to which limitation does not apply.</text>
						</subsection><subsection commented="no" id="H6227FC49D8D6437A900DC16F18F3E81A">
							<enum>(d)</enum>
							<header>Preemption</header>
							<paragraph commented="no" id="H1D8DEB8AC8C9462093665173E4000060">
								<enum>(1)</enum>
								<header>In
				general</header>
								<text display-inline="yes-display-inline">This section preempts
				the laws of a State or any political subdivision of a State to the
			 extent that
				such laws are inconsistent with this section, unless such laws
			 provide greater
				protection from liability.</text>
							</paragraph><paragraph commented="no" id="HF26A5EEC5A63428EB884364D6B072522">
								<enum>(2)</enum>
								<header>Volunteer
				Protection Act</header>
								<text>Protections afforded by this section are in
				addition to those provided by the Volunteer Protection Act of 1997.</text>
							</paragraph></subsection><subsection commented="no" id="id60B82F20B02C4B889EA84459CD522E8A"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section shall supplant any other provision of Federal, State, local, or tribal law
			 that establish liability schemes or liability protections that exceed
			 those provided by this section, including without limitation the
			 provisions of chapter 171 of title
			 28, United States Code (commonly known as the Federal Tort Claims Act).</text></subsection><subsection id="H4F126178CF934121972C18C9C5DFF569">
							<enum>(f)</enum>
							<header>Definitions</header>
							<text>In
				this section:</text>
							<paragraph id="HE6C42746DB5D47FB846D0DCF288ACEA6">
								<enum>(1)</enum>
								<text>The term
				<term>disaster</term> means—</text>
								<subparagraph id="H26D8EECA4BC74280BABD571D7BF49D36">
									<enum>(A)</enum>
									<text>a national
				emergency declared by the President under the National Emergencies
			 Act;</text>
								</subparagraph><subparagraph id="H025189D9B15645F0876397736CA14AB1">
									<enum>(B)</enum>
									<text>an emergency or
				major disaster declared by the President under the Robert T.
			 Stafford Disaster
				Relief and Emergency Assistance Act; or</text>
								</subparagraph><subparagraph id="H0DA0F4491EB945019E1BF189FCA2CB02">
									<enum>(C)</enum>
									<text>a public health
				emergency determined by the Secretary under section 319 of this
			 Act.</text>
								</subparagraph></paragraph><paragraph id="H6C4054EA8E9E4AE685926073925A7672">
								<enum>(2)</enum>
								<text>The term
				<term>harm</term> includes physical, nonphysical, economic, and noneconomic
				losses.</text>
							</paragraph><paragraph id="H1F6CC7BA04234B41B8AA46FFE1BBE588">
								<enum>(3)</enum>
								<text>The term
				<term>health care professional</term> means an individual who is licensed,
				certified, or authorized in one or more States to practice a health
			 care
				profession.</text>
							</paragraph><paragraph id="H61937EE911C440029DD13E04F1C83F0B">
								<enum>(4)</enum>
								<text>The term
				<term>State</term> includes each of the several States, the District of
				Columbia, the Commonwealth of Puerto Rico, the Virgin Islands,
			 Guam, American
				Samoa, the Northern Mariana Islands, and any other territory or
			 possession of
				the United States.</text>
							</paragraph><paragraph id="H704D71B210264188B0CB5AB7664248B1">
								<enum>(5)</enum>
								<subparagraph commented="no" display-inline="yes-display-inline" id="HFA8AA27D97E4411AB8DD136BCCA40103"><enum>(A)</enum>
									<text>The term
				<term>volunteer</term> means a health care professional who, with respect to
				the health care services rendered, does not receive—</text>
									<clause id="H70F40A095638429D877DD5ADBAE586C2">
										<enum>(i)</enum>
										<text>compensation;
				or</text>
									</clause><clause id="HF374C584089448EFA5956379D5F08F4F">
										<enum>(ii)</enum>
										<text display-inline="yes-display-inline">any other thing of value in lieu of
				compensation, in excess of $500 per year.</text>
									</clause></subparagraph><subparagraph id="H9D43896114F445F59D97F0B1AD5E96A8" indent="up1">
									<enum>(B)</enum>
									<text>For purposes of subparagraph (A), the
				term <term>compensation</term>—</text>
									<clause id="HFA2A1ADC575344A6B2CDB5029FF9EA20">
										<enum>(i)</enum>
										<text display-inline="yes-display-inline">includes payment under any insurance policy
				or health plan, or under any Federal or State health benefits
			 program;
				and</text>
									</clause><clause commented="no" id="H7CC9F918D8624FDFA828E206712A2168">
										<enum>(ii)</enum>
										<text display-inline="yes-display-inline">excludes—</text>
										<subclause commented="no" id="HE48AD36994DB439FA19D54FB52BC34A9">
											<enum>(I)</enum>
											<text>reasonable reimbursement or allowance for
				expenses actually incurred;</text>
										</subclause><subclause commented="no" id="HBBECA9FF4A204C5D8BB1585AA59BDA1E">
											<enum>(II)</enum>
											<text>receipt of paid leave; and</text>
										</subclause><subclause commented="no" id="HFAE0A0E0214F4A2FBD33807A10A93452">
											<enum>(III)</enum>
											<text>receipt of items to be used exclusively
				for rendering the health services in the health care professional’s
			 capacity as
				a volunteer described in subsection
				(a)(1).</text>
										</subclause></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HDE406392DFBF46748AD47DDB3B9690AB">
				<enum>(b)</enum>
				<header>Effective
			 date</header>
				<paragraph id="H3D4460A32AE9459EB5507BF22AF3CFA5">
					<enum>(1)</enum>
					<header>In
			 general</header>
					<text>This Act and the amendment made by subsection (a) shall
			 take effect 90 days after the date of the enactment of this Act.</text>
				</paragraph><paragraph id="H1A9090CAFB624B35996C80999227A9E9">
					<enum>(2)</enum>
					<header>Application</header>
					<text>This
			 Act applies to any claim for harm caused by an act or omission of a health
			 care
			 professional where the claim is filed on or after the effective date of
			 this
			 Act, but only if the harm that is the subject of the claim or the conduct
			 that
			 caused such harm occurred on or after such effective date.</text>
