			 by <sponsor name-id="S314">Mr. Tester</sponsor>, with an amendment</action-desc><action-instruction>Insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To amend the Act of June 18, 1934, to reaffirm the authority of the Secretary of the Interior to
			 take land into trust for Indian tribes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Reaffirmation of authority</header><subsection id="idd310403e5d844cb2b791370d3e461ecc"><enum>(a)</enum><header>Modification</header><paragraph id="idc993e429b616419c9a9135e7ab2b11fc"><enum>(1)</enum><header>In general</header><text>The first sentence of section 19 of the Act of June 18, 1934 (commonly known as the <quote>Indian Reorganization Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/25/479">25 U.S.C. 479</external-xref>), is amended—</text><subparagraph id="id56d377c2f2c24f8d8ac78dcf2c35bd2a"><enum>(A)</enum><text>by striking <quote>The term</quote> and inserting <quote>Effective beginning on June 18, 1934, the term</quote>; and</text></subparagraph><subparagraph id="iddd89e515609645f38bcf292f1e93f2a6"><enum>(B)</enum><text>by striking <quote>any recognized Indian tribe now under Federal jurisdiction</quote> and inserting <quote>any  federally recognized Indian tribe</quote>.</text></subparagraph></paragraph><paragraph id="idc3aeec44c8b84f5d9c9a9bfd310458f7"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall take effect as if included in the Act of June 18, 1934
			 (commonly known as the <quote>Indian Reorganization Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/25/479">25 U.S.C. 479</external-xref>), on the date of enactment of that Act.</text></paragraph></subsection><subsection id="iddc01c858756240b69bbfbad2ff1daca5"><enum>(b)</enum><header>Ratification and Confirmation of Actions</header><text>Any action taken by the Secretary of the Interior pursuant to the Act of June 18, 1934 (commonly
			 known as the <quote>Indian Reorganization Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/25/461">25 U.S.C. 461 et seq.</external-xref>), for any Indian tribe that was federally recognized on the date of that
			 action is ratified and confirmed, to the extent such action is subjected
			 to challenge based on whether the Indian tribe was federally recognized or
			 under Federal jurisdiction on June 18, 1934, as if the action had, by
			 prior Act of Congress, been specifically authorized and directed.</text></subsection><subsection id="idb5630b26ed3348329c5dac80b0f6abf9"><enum>(c)</enum><header>Effect on Other Laws</header><paragraph id="id07f0e3accef542c08cca06cb21422e37"><enum>(1)</enum><header>In general</header><text>Nothing in this section or the amendments made by this section shall affect—</text><subparagraph id="ida2de951b810b46bb882de3999303cee1"><enum>(A)</enum><text>the application or effect of any Federal law other than the Act of June 18, 1934 (25 U.S.C. 461 et
			 seq.), as amended by subsection (a); or</text></subparagraph><subparagraph id="id5ca04dc45a224de9a2c00456ee1093af"><enum>(B)</enum><text>any limitation on the authority of the Secretary of the Interior under any Federal law or
			 regulation other than the Act of June 18, 1934 (<external-xref legal-doc="usc" parsable-cite="usc/25/461">25 U.S.C. 461 et seq.</external-xref>), as
			 so amended.</text></subparagraph></paragraph><paragraph id="id19530fab996746078c24acf664bb647e"><enum>(2)</enum><header>References in other laws</header><text>An express reference to the Act of June 18, 1934 (<external-xref legal-doc="usc" parsable-cite="usc/25/461">25 U.S.C. 461 et seq.</external-xref>), contained in any other
			 Federal law shall be considered to be a reference to that Act as amended
			 by subsection (a).</text></paragraph></subsection><subsection changed="added" id="idDEC37D31C76F41C6A4E8FFE139EC89C2" reported-display-style="italic"><enum>(d)</enum><header>Study; publication</header><paragraph id="idDD710DEE02854EC3B1EF3AE5B5E3D2E3"><enum>(1)</enum><header>Study</header><text>The Secretary of the Interior shall conduct, and submit to Congress a report describing the results
			 of, a study that—</text><subparagraph id="idC6B268DBAB9242C9BA498D76CC1A25AC"><enum>(A)</enum><text>assesses the effects of the decision of the Supreme Court in the case styled Carcieri v. Salazar
			 (129 S. Ct. 1058) on Indian tribes and tribal land; and</text></subparagraph><subparagraph id="idA2B6F7E9CBEF4CBDBC09B91B045836FD"><enum>(B)</enum><text>includes a list of each Indian tribe and parcel of tribal land affected by that decision.</text></subparagraph></paragraph><paragraph id="id590E221E64314D3FAF45B9E4C60065FD"><enum>(2)</enum><header>Publication</header><text>On completion of the report under paragraph (1) and by not later than 1 year after the date of
			 enactment of this Act, the Secretary of the Interior shall publish the
			 list described in paragraph (1)(B)—</text><subparagraph id="id6CE384ADD6B2492395B1DAD4015080BF"><enum>(A)</enum><text>in the Federal Register; and</text></subparagraph><subparagraph id="id2A1CEFDBE8E64300814AC7FF9C14A142"><enum>(B)</enum><text>on the public website of the Department of the Interior.</text></subparagraph></paragraph></subsection></section></legis-body><endorsement><action-date>August 26, 2014</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
