			 purpose</header><subsection id="id12ed12f38c9e48c4b1c3b35e2939436d"><enum>(a)</enum><header>Findings</header><text>Congress
			 makes the following findings:</text><paragraph id="ide8ade120758d4c2db246f505b0382fe8"><enum>(1)</enum><text>Beginning with
			 enactment of the Act to Prevent Pollution from Ships in 1980 (22 U.S.C.
			 1901 et
			 seq.), the United States Coast Guard has been the principal Federal
			 authority
			 charged with administering, enforcing, and prescribing regulations
			 relating to
			 the discharge of pollutants from vessels engaged in maritime commerce and
			 transportation.</text></paragraph><paragraph id="id4e74c32582d04984b048c653eee327ab"><enum>(2)</enum><text>The Coast Guard
			 estimates there are approximately 21,560,000 State-registered recreational
			 vessels, 75,000 commercial fishing vessels, and 33,000 freight and tank
			 barges
			 operating in United States waters.</text></paragraph><paragraph id="idf4f389656c544581b39b69a44b69ca03"><enum>(3)</enum><text>From 1973 to
			 2005, certain discharges incidental to the normal operation of a vessel
			 were
			 exempted by regulation from otherwise applicable permitting
			 requirements.</text></paragraph><paragraph id="id163a688da312404c943158b83552a859"><enum>(4)</enum><text>Over the 32 years
			 during which this regulatory exemption was in effect, Congress enacted
			 statutes
			 on a number of occasions dealing with the regulation of discharges
			 incidental
			 to the normal operation of a vessel, including—</text><subparagraph id="id92ebcf727e8844ab8419f81d2edc8a8d"><enum>(A)</enum><text>the Act to
			 Prevent Pollution from Ships (<external-xref legal-doc="usc" parsable-cite="usc/33/1901">33 U.S.C. 1901 et seq.</external-xref>) in 1980;</text></subparagraph><subparagraph id="idcab24d0b26324e2d913b540c1be05892"><enum>(B)</enum><text>the Nonindigenous
			 Aquatic Nuisance Prevention and Control Act of 1990 (16 U.S.C. 4701 et
			 seq.);</text></subparagraph><subparagraph id="idde4d2c56296b419ab9b31d3d8298d41e"><enum>(C)</enum><text>the National
			 Invasive Species Act of 1996 (110 Stat. 4073);</text></subparagraph><subparagraph id="id8a94f75e7e2c4b3ab91cc6869e651cf9"><enum>(D)</enum><text>section 415 of
			 the Coast Guard Authorization Act of 1998 (112 Stat. 3434) and section 623
			 of
			 the Coast Guard and Maritime Transportation Act of 2004 (33 U.S.C. 1901
			 note),
			 which established interim and permanent requirements, respectively, for
			 the
			 regulation of vessel discharges of certain bulk cargo
			 residue;</text></subparagraph><subparagraph id="id10d71be2dfb24c8597687507cabf9fa6"><enum>(E)</enum><text>title XIV of
			 division B of Appendix D of the Consolidated Appropriations Act, 2001 (114
			 Stat. 2763), which prohibited or limited certain vessel discharges in
			 certain
			 areas of Alaska;</text></subparagraph><subparagraph id="id089f64b6fdd44c4d8c2224324d6c1a44"><enum>(F)</enum><text>section 204 of
			 the Maritime Transportation Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/33/1902a">33 U.S.C. 1902a</external-xref>), which
			 established requirements for the regulation of vessel discharges of
			 agricultural cargo residue material in the form of hold washings; and</text></subparagraph><subparagraph id="idd40dd4653c2c47fa8423b10e1b395e35"><enum>(G)</enum><text>title X of the
			 Coast Guard Authorization Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/33/3801">33 U.S.C. 3801 et seq.</external-xref>), which
			 provided
			 for the implementation of the International Convention on the Control of
			 Harmful Anti-Fouling Systems on Ships, 2001.</text></subparagraph></paragraph></subsection><subsection id="idcb885133bf704ef9945e1831018c4025"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to provide for the establishment of nationally
			 uniform
			 and environmentally sound standards and requirements for the management of
			 discharges incidental to the normal
			 operation of a vessel.</text></subsection></section><section id="ideff7e372bba040dc8b115daf9663646a"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id4c7ddb84b9994faa9438aad27fcf1180"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Environmental
			 Protection Agency.</text></paragraph><paragraph id="id49e03a0a7e994eeeb6e592426d89dfcd"><enum>(2)</enum><header>Aquatic
			 nuisance species</header><text>The term <term>aquatic nuisance species</term>
			 means a nonindigenous species (including a pathogen) that threatens the
			 diversity or abundance of native species or the ecological stability of
			 navigable waters or commercial, agricultural, aquacultural, or
			 recreational
			 activities dependent on such waters.</text></paragraph><paragraph id="ida68cc6b258d74f4ca0a17b0c09e41700"><enum>(3)</enum><header>Ballast
			 water</header><subparagraph id="idADECDADF8E7A48DE9FF1394B8CACD54E"><enum>(A)</enum><header>In
			 general</header><text>The term <term>ballast water</term> means any water,
			 including any sediment suspended in such water, taken aboard a vessel—</text><clause id="id498a19cd014a4dc89135dd214ea3495a"><enum>(i)</enum><text>to
			 control trim, list, draught, stability, or stresses of the vessel; or</text></clause><clause id="idbd6acb28aa7c4486bbb5d50fdc514a9a"><enum>(ii)</enum><text>during the
			 cleaning, maintenance, or other operation of a ballast water treatment
			 technology of the vessel.</text></clause></subparagraph><subparagraph id="id06e9f02f6e334c2fa8cda3e5f436cc74"><enum>(B)</enum><header>Exclusions</header><text>The
			 term <term>ballast water</term> does not include any pollutant that is added to
			 water described in subparagraph (A) that is not directly related to the
			 operation of a properly functioning ballast water treatment technology
			 under
			 this Act.</text></subparagraph></paragraph><paragraph commented="no" id="id91a2ab67c462425eba61ab31386dd594"><enum>(4)</enum><header>Ballast water
			 performance standard</header><text>The term <term>ballast water performance
			 standard</term> means the numerical ballast water discharge standard set
			 forth in <external-xref legal-doc="regulation" parsable-cite="cfr/33/151.2030">section 151.2030</external-xref> of title 33, Code of Federal Regulations or
			 <external-xref legal-doc="regulation" parsable-cite="cfr/33/151.1511">section 151.1511</external-xref> of title 33, Code of Federal Regulations, as applicable,
			 or a revised numerical ballast water performance standard established
			 under
			 subsection (a)(1)(B), (b),  or (c) of section 5  of this Act.</text></paragraph><paragraph id="idda9c5c86986246cb8c7f60590a428998"><enum>(5)</enum><header>Ballast water
			 treatment technology or treatment technology</header><text>The term
			 <term>ballast water treatment technology</term> or <term>treatment
			 technology</term> means any mechanical, physical, chemical, or biological
			 process used, alone or in combination, to remove, render harmless, or
			 avoid the
			 uptake or discharge of aquatic nuisance species within ballast water.</text></paragraph><paragraph id="id79b4c67d30674c41ad2a0e59fa087bb0"><enum>(6)</enum><header>Biocide</header><text>The
			 term <term>biocide</term> means a substance or organism, including a virus or
			 fungus, that is introduced into or produced by a ballast water treatment
			 technology to reduce or eliminate aquatic nuisance species as part of the
			 process used to comply with a ballast water performance standard under
			 this
			 Act.</text></paragraph><paragraph id="id3392bc6acffc4a36b6ba15b45ffeea25"><enum>(7)</enum><header>Discharge
			 incidental to the normal operation of a vessel</header><subparagraph id="idE13AB4964D3E4A13876688ACD8CA957E"><enum>(A)</enum><header>In
			 general</header><text>The term <term>discharge incidental to the normal
			 operation of a vessel</term> means—</text><clause id="id826573390C314513901CFA289B5C47EE"><enum>(i)</enum><text>a
			 discharge into navigable waters from a vessel of—</text><subclause id="id065EDC30183942A5A2A3EF019A475A68"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="idCE7936A6E0B540E1828E4DCC0EBEABC1"><enum>(aa)</enum><text>ballast water,
			 graywater, bilge water, cooling water, oil water separator effluent,
			 anti-fouling hull coating leachate, boiler or economizer blowdown,
			 byproducts
			 from cathodic protection, controllable pitch propeller and thruster
			 hydraulic
			 fluid, distillation and reverse osmosis brine, elevator pit effluent,
			 firemain
			 system effluent, freshwater layup effluent, gas turbine wash water, motor
			 gasoline and compensating effluent, refrigeration and air condensate
			 effluent,
			 seawater pumping biofouling prevention substances, boat engine wet
			 exhaust,
			 sonar dome effluent, exhaust gas scrubber washwater, or stern tube packing
			 gland effluent; or</text></item><item id="idA36B7FED38F44A598703C012FE7CAE35" indent="up1"><enum>(bb)</enum><text>any other pollutant associated with
			 the operation of a marine propulsion system, shipboard maneuvering system,
			 habitability system, or installed major equipment, or from a protective,
			 preservative, or absorptive application to the hull of a vessel;</text></item></subclause><subclause id="id0620DBB5C183432096F8E21D443F1DA7"><enum>(II)</enum><text>weather deck
			 runoff, deck wash, aqueous film forming foam effluent, chain locker
			 effluent,
			 non-oily machinery wastewater, underwater ship husbandry effluent,
			 welldeck
			 effluent, or fish hold and fish hold cleaning effluent; or</text></subclause><subclause id="id37B9F0DAE0B448A99CE011C54BEE14AF"><enum>(III)</enum><text>any effluent
			 from a properly functioning marine engine; or</text></subclause></clause><clause id="idC0ADBDA8D2044DD88DC5340FF4950E67"><enum>(ii)</enum><text>a
			 discharge of a pollutant into navigable waters in connection with the
			 testing,
			 maintenance, or repair of a system, equipment, or engine described in
			 subclause
			 (I)(bb) or (III) of clause (i) whenever the vessel is waterborne.</text></clause></subparagraph><subparagraph id="id76C94670B8D24DB58AD5F7CFB157EE7D"><enum>(B)</enum><header>Exclusions</header><text>The
			 term <term>discharge incidental to the normal operation of a vessel</term> does
			 not include—</text><clause id="idbc243f0514444c34a91734ac03b3c262"><enum>(i)</enum><text>a
			 discharge into navigable waters from a vessel of—</text><subclause id="id877faa9e63014a28918733b6422db64e"><enum>(I)</enum><text>rubbish, trash,
			 garbage, incinerator ash, or other such material discharged overboard;</text></subclause><subclause id="id80c4491b8fcc405ca38ebf53c76852d8"><enum>(II)</enum><text>oil or a
			 hazardous substance as those terms are defined in section 311 of the
			 Federal
			 Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321</external-xref>);</text></subclause><subclause id="idf0b86feffe184e93948b6f4990f08036"><enum>(III)</enum><text>sewage as
			 defined in section 312(a)(6) of the Federal Water Pollution Control Act
			 (33
			 U.S.C. 1322(a)(6)); or</text></subclause><subclause id="idF353CBF8630A4BA999927D4E7ED0EF40"><enum>(IV)</enum><text>graywater
			 referred to in section 312(a)(6) of the Federal Water Pollution Control
			 Act (33
			 U.S.C. 1322(a)(6));</text></subclause></clause><clause id="id06b55e4359924f89ae7fae47336b500e"><enum>(ii)</enum><text>an
			 emission of an air pollutant resulting from the operation onboard a vessel
			 of a
			 vessel propulsion system, motor driven equipment, or incinerator; or</text></clause><clause id="id5fe51fe092d141bbb4e5f1e835feb757"><enum>(iii)</enum><text>a
			 discharge into navigable waters from a vessel when the vessel is operating
			 in a
			 capacity other than as a means of transportation on water.</text></clause></subparagraph></paragraph><paragraph id="id75927413a4b844e4aea24217f6db81bc"><enum>(8)</enum><header>Geographically
			 limited area</header><text>The term <term>geographically limited area</term>
			 means an area—</text><subparagraph id="id6f3013c31f224a8ba64d2bcdca7530e6"><enum>(A)</enum><text>with a physical
			 limitation, including limitation by physical size and limitation by
			 authorized
			 route, that prevents a vessel from operating outside the area, as
			 determined by
			 the Secretary; or</text></subparagraph><subparagraph id="id2a32d444ede54cdf8f2a306e010d0b8e"><enum>(B)</enum><text>that is
			 ecologically homogeneous, as determined by the Secretary, in consultation
			 with
			 the heads of other Federal departments or agencies as the Secretary
			 considers
			 appropriate.</text></subparagraph></paragraph><paragraph id="ide4a0fb2f795f437eb7fd949d31ba729b"><enum>(9)</enum><header>Manufacturer</header><text>The
			 term <term>manufacturer</term> means a person engaged in the manufacture,
			 assemblage, or importation of ballast water treatment technology.</text></paragraph><paragraph id="idc9d62c7dc38f4691973177c0bd5a0eae"><enum>(10)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the department in which the
			 Coast Guard is operating.</text></paragraph><paragraph id="id5dcfd54627e246e09e01c590572bd885"><enum>(11)</enum><header>Vessel</header><text>The
			 term <term>vessel</term> means every description of watercraft or other
			 artificial contrivance used, or practically or otherwise capable of being
			 used,
			 as a means of transportation on water.</text></paragraph></section><section id="id0161f205ab674b8daf64d408a18d08eb"><enum>4.</enum><header>Regulation and
			 enforcement</header><subsection id="idaa3fc96e729f4c1a8ad35b7b6cf06f38"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, in consultation with the Administrator,
			 shall establish and implement enforceable uniform national standards and
			 requirements for the
			 regulation of discharges incidental to the normal operation of a vessel.
			 The
			 standards and requirements shall—</text><paragraph id="id54B2F332EEA649209F121E9CB1DBF995"><enum>(1)</enum><text>be based upon the
			 best available technology economically achievable; and</text></paragraph><paragraph id="id3123AF90480B4B678E947CA15E66516A"><enum>(2)</enum><text>supersede any
			 permitting requirement or prohibition on discharges incidental to the
			 normal
			 operation of a vessel under any other provision of law.</text></paragraph></subsection><subsection id="idF803E63479D04C16BCDAC762DF073F8B"><enum>(b)</enum><header>Administration
			 and enforcement</header><text>The Secretary shall administer and enforce the uniform national standards and
			 requirements under this Act. Each State may enforce the uniform national
			 standards and
			 requirements under this Act.</text></subsection></section><section id="ide4918c75804b476ebc0bf80bc8315a0c"><enum>5.</enum><header>Uniform national standards and requirements for the
			 regulation of discharges incidental to the normal operation of a vessel</header><subsection id="idE32FD5E8B31349B38FF1DE519447ADCC"><enum>(a)</enum><header>Requirements</header><paragraph id="id28359AA4545F40709045BA8A47881F03"><enum>(1)</enum><header>Ballast water management requirements</header><subparagraph id="idA8D94D5B03D04FCF98FBFCD383D39D5B"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of law, the requirements set forth in the final rule, Standards
			 for Living Organisms in Ships’ Ballast Water Discharged in U.S. Waters (77
			 Fed. Reg. 17254 (March 23, 2012), as corrected at 77 Fed. Reg. 33969 (June
			 8, 2012)), shall be the management requirements for a ballast water
			 discharge incidental to the normal operation of a vessel until the
			 Secretary revises the ballast water performance standard under subsection
			 (b) or adopts a more stringent State standard under subparagraph (B) of
			 this paragraph.</text></subparagraph><subparagraph id="id8B6439F690FB4467A7454EA7F763650A"><enum>(B)</enum><header>Adoption of more stringent State standard</header><text>If the Secretary makes a determination in favor of a State petition under section 10, the Secretary
			 shall adopt the more stringent ballast water performance standard
			 specified in the statute or regulation that is the subject of that State
			 petition in lieu of the ballast water performance standard in the final
			 rule described under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id758CD78B02C44F088BA035A56D8F0656"><enum>(2)</enum><header>Initial
			 management requirements for discharges other than ballast water</header><text>Not later than 2
			 years after the date of enactment of this Act, the Secretary, in
			 consultation
			 with the Administrator, shall issue a final rule establishing best
			 management
			 practices for discharges incidental to the normal operation of a vessel
			 other
			 than ballast water.</text></paragraph></subsection><subsection id="id940b5ad545c44f62b5a47d6bb7b1aff8"><enum>(b)</enum><header>Revised ballast
			 water performance standard; 8-Year review</header><paragraph id="id80FE4E833F6D4BE3BF426A53835FE2E2"><enum>(1)</enum><header>In
			 general</header><text>Subject to the feasibility review under paragraph (2), not
			 later than January 1, 2022, the Secretary, in consultation with the
			 Administrator, shall issue a final rule revising the ballast water
			 performance
			 standard under subsection (a)(1) so that a ballast water discharge
			 incidental
			 to the normal operation of a vessel will contain—</text><subparagraph id="id7df89eeadeec4325a06c07a5ac4cafb6"><enum>(A)</enum><text>less than 1
			 living organism per 10 cubic meters that is 50 or more micrometers in
			 minimum
			 dimension;</text></subparagraph><subparagraph id="id01e0be45669445e0a09d8bdd6292a7a8"><enum>(B)</enum><text>less than 1
			 living organism per 10 milliliters that is less than 50 micrometers in
			 minimum
			 dimension and more than 10 micrometers in minimum dimension;</text></subparagraph><subparagraph id="id30bee1fca84d4c0186bcf785a4943568"><enum>(C)</enum><text>concentrations of
			 indicator microbes that are less than—</text><clause id="idac6d5519ba54442a8ca5b43a454ba1e8"><enum>(i)</enum><text>1
			 colony-forming unit of toxicogenic Vibrio cholera (serotypes O1 and O139)
			 per
			 100 milliliters or less than 1 colony-forming unit of that microbe per
			 gram of
			 wet weight of zoological samples;</text></clause><clause id="id880fc864be084e4dbd2ab24ec7386dd1"><enum>(ii)</enum><text>126
			 colony-forming units of escherichia coli per 100 milliliters; and</text></clause><clause id="id4af7b897d1aa4c3c8c791f583831780c"><enum>(iii)</enum><text>33
			 colony-forming units of intestinal enterococci per 100 milliliters; and</text></clause></subparagraph><subparagraph id="id612f579d5f284a50a1775731e661b009"><enum>(D)</enum><text>concentrations of
			 such additional indicator microbes and of viruses as may be specified in
			 regulations issued by the Secretary in consultation with the Administrator
			 and
			 such other Federal agencies as the Secretary and the Administrator
			 consider
			 appropriate.</text></subparagraph></paragraph><paragraph id="id609ec849f1c641c58aabfa825a9007ad"><enum>(2)</enum><header>Feasibility
			 review</header><subparagraph id="id746AE2C1AD8B4634A0992BC0BDD51A44"><enum>(A)</enum><header>In
			 general</header><text>Not less than 2 years before January 1, 2022, the
			 Secretary, in consultation with the Administrator, shall complete a review
			 to
			 determine the feasibility of achieving the revised ballast water
			 performance
			 standard under paragraph (1).</text></subparagraph><subparagraph id="id90fa750ec2c94f829516470c9efed125"><enum>(B)</enum><header>Criteria for
			 review of ballast water performance standard</header><text>In conducting a review under
			 subparagraph (A), the Secretary shall consider whether revising the
			 ballast
			 water performance standard will result in a scientifically demonstrable
			 and
			 substantial reduction in the risk of introduction or establishment of
			 aquatic
			 nuisance species, taking into account—</text><clause id="id80b493ce8b9d4dfbb1a6d9c10107bbb6"><enum>(i)</enum><text>improvements in
			 the scientific understanding of biological and ecological processes that
			 lead
			 to the introduction or establishment of aquatic nuisance species;</text></clause><clause id="id750c56405a0048c2af715b35de391f43"><enum>(ii)</enum><text>improvements in
			 ballast water treatment technology, including—</text><subclause id="id3e4d1711d9bf41108748817e1255e561"><enum>(I)</enum><text>the capability of
			 such treatment technology to achieve a revised ballast water performance
			 standard;</text></subclause><subclause id="idf1b1e5717a604adc84408ecb77b30ff2"><enum>(II)</enum><text>the
			 effectiveness and reliability of such treatment technology in the
			 shipboard
			 environment;</text></subclause><subclause id="id057f0afd9de0492c8f3f5fe514f7fe1c"><enum>(III)</enum><text>the
			 compatibility of such treatment technology with the design and operation
			 of a
			 vessel by class, type, and size;</text></subclause><subclause id="idf7fc52235d2541b0b97a3c2a9dad188a"><enum>(IV)</enum><text>the commercial
			 availability of such treatment technology; and</text></subclause><subclause id="id5794482019274fc7822d753193dbfc9f"><enum>(V)</enum><text>the safety of
			 such treatment technology;</text></subclause></clause><clause id="id5d48a69c710047e3bfa68e214356144f"><enum>(iii)</enum><text>improvements in
			 the capabilities to detect, quantify, and assess the viability of aquatic
			 nuisance species at the concentrations under consideration;</text></clause><clause id="ida9761640c9ca4f919812fc0367def6fe"><enum>(iv)</enum><text>the impact of
			 ballast water treatment technology on water quality; and</text></clause><clause id="idc376384426db4a93980398166bacd6c3"><enum>(v)</enum><text>the
			 costs, cost-effectiveness, and impacts of—</text><subclause id="id6506e2290b4447ea81fefcb49a747efc"><enum>(I)</enum><text>a revised ballast
			 water performance standard, including the potential impacts on shipping,
			 trade,
			 and other uses of the aquatic environment; and</text></subclause><subclause id="id83551e5e395646abb16dbadce195a37c"><enum>(II)</enum><text>maintaining the
			 existing ballast water performance standard, including the potential
			 impacts on
			 water-related infrastructure, recreation, propagation of native fish,
			 shellfish, and wildlife, and other uses of navigable waters.</text></subclause></clause></subparagraph><subparagraph id="idb3889ab039c8456186ee28da587cd113"><enum>(C)</enum><header>Lower revised
			 performance standard</header><clause id="id6AE5101700F341A9B49B8822F875DAB1"><enum>(i)</enum><header>In
			 general</header><text>If the Secretary, in consultation with the Administrator,
			 determines on the basis of the feasibility review and after an opportunity
			 for
			 a public hearing that no ballast water treatment technology can be
			 certified
			 under section 6 to comply with the revised ballast water performance
			 standard
			 under paragraph (1), the Secretary shall require the use of the treatment
			 technology that achieves the performance levels of the best treatment
			 technology available.</text></clause><clause id="idd6cfaf26a5c7457aa6605369967903ce"><enum>(ii)</enum><header>Implementation
			 deadline</header><text>If the Secretary, in consultation with the
			 Administrator, determines that the treatment technology under clause (i)
			 cannot
			 be implemented before the implementation deadline under paragraph (3) with
			 respect to a class of vessels, the Secretary shall extend the
			 implementation
			 deadline for that class of vessels for not more than 36 months.</text></clause><clause id="id9b283bd5c015408281289df2ce86da42"><enum>(iii)</enum><header>Compliance</header><text>If
			 the implementation deadline under paragraph (3) is extended, the Secretary
			 shall recommend action to ensure compliance with the extended
			 implementation
			 deadline under clause (ii).</text></clause></subparagraph><subparagraph id="id4f9f91c7c15d401e93b37d43d95f3984"><enum>(D)</enum><header>Higher revised
			 performance standard</header><clause id="id22351104A0C0464BBB81CC4117276A6F"><enum>(i)</enum><header>In
			 general</header><text>If the Secretary, in consultation with the Administrator,
			 determines that ballast water treatment technology exists that exceeds the
			 revised ballast water performance standard under paragraph (1) with
			 respect to
			 a class of vessels, the Secretary shall revise the ballast water
			 performance
			 standard for that class of vessels to incorporate the higher performance
			 standard.</text></clause><clause id="idc32775bce433446192747ec1921ed107"><enum>(ii)</enum><header>Implementation
			 deadline</header><text>If the Secretary, in consultation with the
			 Administrator, determines that the treatment technology under clause (i)
			 can be
			 implemented before the implementation deadline under paragraph (3) with
			 respect
			 to a class of vessels, the Secretary shall accelerate the implementation
			 deadline for that class of vessels. If the implementation deadline under
			 paragraph (3) is accelerated, the Secretary shall provide not less than 24
			 months notice before the accelerated deadline takes effect.</text></clause></subparagraph></paragraph><paragraph id="idbb17b446b0c04a2a85e5f687ec3e9dd5"><enum>(3)</enum><header>Implementation deadline</header><text>The
			 revised ballast water performance standard under paragraph (1) shall apply
			 to a
			 vessel beginning on the date of the first drydocking of the vessel on or
			 after
			 January 1, 2022, but not later than December 31, 2024.</text></paragraph><paragraph id="id100654BDE3E146A6ABB10C1B2DC9396C"><enum>(4)</enum><header>Revised performance standard compliance deadlines</header><subparagraph id="idD7842E39C0A64D87A2C310B7453A5CEB"><enum>(A)</enum><header>In general</header><text>The Secretary may establish a compliance deadline for compliance by a vessel (or a class, type, or
			 size of vessel) with a revised ballast water performance standard under
			 this subsection.</text></subparagraph><subparagraph id="id0675D29B2DF645F5BACCFE627862DB8C"><enum>(B)</enum><header>Process for granting extensions</header><text>In issuing regulations under this subsection, the Secretary shall establish a process for an owner
			 or operator to submit a petition to the Secretary for an extension of a
			 compliance deadline with respect to the vessel of the owner or operator.</text></subparagraph><subparagraph id="id609DA7A83D3B4E4D93CBCB2F5405F62F"><enum>(C)</enum><header>Period of extensions</header><text>An extension issued under subparagraph (B) may—</text><clause id="id73A373930D4A438A88B6B3BBDB75B37B"><enum>(i)</enum><text>apply for a period of not to exceed 18 months from the date of the applicable deadline under
			 subparagraph (A); and</text></clause><clause id="id895A58035CAE4C279BC5137F4D5AE51C"><enum>(ii)</enum><text>be renewable for an additional period of not to exceed 18 months.</text></clause></subparagraph><subparagraph id="id95DB2090D36F4D9A941D99DF01F28397"><enum>(D)</enum><header>Factors</header><text>In issuing a compliance deadline or reviewing a petition under this paragraph, the Secretary shall
			 consider, with respect to the ability of an owner or operator to meet a
			 compliance deadline, the following factors:</text><clause id="id17A707075AB74CCD851B8AF07B31A669"><enum>(i)</enum><text>Whether the treatment technology to be installed is available in sufficient quantities to meet the
			 compliance deadline.</text></clause><clause id="idEC9DC09649174CA985329EC797EAF8F3"><enum>(ii)</enum><text>Whether there is sufficient shipyard or other installation facility capacity.</text></clause><clause id="idF28B5A5BB5F5472481788E6A4EDDEBF4"><enum>(iii)</enum><text>Whether there is sufficient availability of engineering and design resources.</text></clause><clause id="id821E46AED73C48C091103E84E43BAAFB"><enum>(iv)</enum><text>Vessel characteristics, such as engine room size, layout, or a lack of installed piping.</text></clause><clause id="id8B49D1846D5E435C8C46C58383E15B04"><enum>(v)</enum><text>Electric power generating capacity aboard the vessel.</text></clause><clause id="id9C37419B6BE64449BA96EF8DC83F57E2"><enum>(vi)</enum><text>Safety of the vessel and crew.</text></clause></subparagraph><subparagraph id="id8365E686532A4DB98855D23525CB18D8"><enum>(E)</enum><header>Consideration of petitions</header><clause id="idF9AFD39D6359434FBA15A78C5ADB20D9"><enum>(i)</enum><header>Determinations</header><text>The Secretary shall approve or deny a petition for an extension of a compliance deadline submitted
			 by an owner or operator under this paragraph.</text></clause><clause id="id66B9086E4F05436C88E74369ECA9C056"><enum>(ii)</enum><header>Deadline</header><text>If the Secretary does not approve or deny a petition referred to in clause (i) on or before the
			 last day of the 90-day period beginning on the date of submission of the
			 petition, the petition shall be deemed approved.</text></clause></subparagraph></paragraph></subsection><subsection id="idC74D0F7481F546659F635B5F44FEB83F"><enum>(c)</enum><header>Future
			 revisions of vessel incidental discharge standards; decennial reviews</header><paragraph id="idED21BB5F1ABB427EA0FE3FA34F31A7D3"><enum>(1)</enum><header>Revised ballast
			 water performance standards</header><text>The Secretary, in consultation with the Administrator, shall complete a review, 
			 10 years after the
			 issuance of a final rule under subsection (b) and every 10 years
			 thereafter,
			 to determine whether further revision of the ballast water performance
			 standard
			 would result in a scientifically demonstrable and substantial reduction in
			 the
			 risk of the introduction or establishment of aquatic nuisance species.</text></paragraph><paragraph id="idF21DB91C9FB041E7AB3E426C22AFA7E9"><enum>(2)</enum><header>Revised
			 standards for discharges other than ballast water</header><text>The Secretary,
			 in consultation with the Administrator, may include in a decennial review
			 under this subsection best management practices for discharges covered by
			 subsection
			 (a)(2). The Secretary shall initiate a rulemaking to revise 1 or more
			 best management practices for such discharges after a decennial review if
			 the
			 Secretary, in consultation with the Administrator, determines that
			 revising 1
			 or more of such practices would substantially reduce the impacts on
			 navigable
			 waters of discharges incidental to the normal operation of a vessel other
			 than
			 ballast water.</text></paragraph><paragraph id="id1C0B52E3D304488D93F42F77C77EDE76"><enum>(3)</enum><header>Considerations</header><text>In
			 conducting a review under paragraph (1), the Secretary, the Administrator,
			 and
			 the heads of other appropriate Federal agencies as determined by the
			 Secretary,
			 shall consider the criteria under section 5(b)(2)(B).</text></paragraph><paragraph id="id18a7d23b5e244bcd9913ed78c2c614d0"><enum>(4)</enum><header>Revision after
			 decennial review</header><text>The Secretary shall initiate a rulemaking to
			 revise the current ballast water performance standard after a decennial
			 review
			 if the Secretary, in consultation with the Administrator, determines that
			 revising the current ballast water performance standard would result in a
			 scientifically demonstrable and substantial reduction in the risk of the
			 introduction or establishment of aquatic nuisance species.</text></paragraph></subsection></section><section id="id85f6483549ae465e9b2e9ceb63ba70e8"><enum>6.</enum><header>Treatment
			 technology certification</header><subsection id="id0B71F98618054D1894683BE9FD11633C"><enum>(a)</enum><header>Certification
			 required</header><text>Beginning 60 days after the date that the requirements
			 for testing protocols are issued under subsection (i), no manufacturer of
			 a
			 ballast water treatment technology shall sell, offer for sale, or
			 introduce or
			 deliver for introduction into interstate commerce, or import into the
			 United
			 States for sale or resale, a ballast water treatment technology for a
			 vessel
			 unless the treatment technology has been certified under this section.</text></subsection><subsection id="ide0e16d55043d4affb88bf216d43294d4"><enum>(b)</enum><header>Certification
			 process</header><paragraph id="idd8351f6d322f45c09db28a155fb75513"><enum>(1)</enum><header>Evaluation</header><text>Upon
			 application of a manufacturer, the Secretary shall evaluate a ballast
			 water
			 treatment technology with respect to—</text><subparagraph id="iddcc8d0772e264cf5ac20a379e0f9335b"><enum>(A)</enum><text>the effectiveness
			 of the treatment technology in achieving the current ballast water
			 performance
			 standard when installed on a vessel (or a class, type, or size of
			 vessel);</text></subparagraph><subparagraph id="id5cb2b49a0c484bb3aa66d6c4463fe30c"><enum>(B)</enum><text>the compatibility
			 with vessel design and operations;</text></subparagraph><subparagraph id="id4e56793ec3184104b462002a78a86b5f"><enum>(C)</enum><text>the effect of the
			 treatment technology on vessel safety;</text></subparagraph><subparagraph id="id7a0a18da4d8d4c00b0ecf9dce4a905a4"><enum>(D)</enum><text>the impact on the
			 environment;</text></subparagraph><subparagraph id="idac62fbf17f6b487c812455b729662a34"><enum>(E)</enum><text>the cost
			 effectiveness; and</text></subparagraph><subparagraph id="id08B7B7006F2B45A7B4EC4DD5C6900DBA"><enum>(F)</enum><text>any other
			 criteria the Secretary considers appropriate.</text></subparagraph></paragraph><paragraph id="id2cb8a915b1ac446da7a9475eb61af64d"><enum>(2)</enum><header>Approval</header><text>If
			 after an evaluation under paragraph (1) the Secretary determines that the
			 treatment technology meets the criteria, the Secretary may certify the
			 treatment technology for use on a vessel (or a class, type, or size of
			 vessel).</text></paragraph><paragraph id="id98a0304475014b1395d5b6a077e9f5ec"><enum>(3)</enum><header>Suspension and
			 revocation</header><text>The Secretary shall establish, by regulation, a
			 process to suspend or revoke a certification issued under this section.</text></paragraph></subsection><subsection id="id8ce586eedeac4809ab10f6c2c3a1ce86"><enum>(c)</enum><header>Certification
			 conditions</header><paragraph id="idfbf651846e9943a0aae0936f4b13ef76"><enum>(1)</enum><header>Imposition of
			 conditions</header><text>In certifying a ballast water treatment technology
			 under this section, the Secretary, in consultation with the Administrator,
			 may
			 impose any condition on the subsequent installation, use, or maintenance
			 of the
			 treatment technology onboard a vessel as is necessary for—</text><subparagraph id="iddd8eb6b3872040058f192d2b3b515b91"><enum>(A)</enum><text>the safety of the
			 vessel, the crew of the vessel, and any passengers aboard the vessel;</text></subparagraph><subparagraph id="id77cfca8da79d4cc5bc59adb9cd9628a8"><enum>(B)</enum><text>the protection of
			 the environment; or</text></subparagraph><subparagraph id="id47c7285445b54197a806c4ea75f085bc"><enum>(C)</enum><text>the effective
			 operation of the treatment technology.</text></subparagraph></paragraph><paragraph id="id54c0d92b79dc44aa90b6dad5a611f337"><enum>(2)</enum><header>Failure to
			 comply</header><text>The failure of an owner or operator to comply with a
			 condition imposed under paragraph (1) shall be considered a violation of
			 this
			 section.</text></paragraph></subsection><subsection id="id5038e9fa11bf41aeba90bb032c152c27"><enum>(d)</enum><header>Period for use
			 of installed treatment equipment</header><text>Notwithstanding anything to the
			 contrary in this Act or any other provision of law, the Secretary shall
			 allow a
			 vessel on which a system is installed and operated to meet a ballast water
			 performance standard under this Act to continue to use that system,
			 notwithstanding any revision of a ballast water performance standard
			 occurring
			 after the system is ordered or installed until the expiration of the
			 service
			 life of the system, as determined by the Secretary, so long as the
			 system—</text><paragraph id="id440a51458bdb40999210585bfd326e90"><enum>(1)</enum><text>is maintained in
			 proper working condition; and</text></paragraph><paragraph id="id1814dac142204ff0a758a5b3720346d9"><enum>(2)</enum><text>is maintained and
			 used in accordance with the manufacturer’s specifications and any
			 treatment
			 technology certification conditions imposed by the Secretary under this
			 section.</text></paragraph></subsection><subsection id="id179d7fea2fad422fbf1a5a77b5fda58b"><enum>(e)</enum><header>Certificates of
			 type approval for the treatment technology</header><paragraph id="idaa9ea882215d4b258942df934f8e596d"><enum>(1)</enum><header>Issuance</header><text>If
			 the Secretary approves a ballast water treatment technology for
			 certification
			 under subsection (b), the Secretary shall issue a certificate of type
			 approval
			 for the treatment technology to the manufacturer in such form and manner
			 as the
			 Secretary determines appropriate.</text></paragraph><paragraph id="idefb28b90b6034e6d9728e485a3529982"><enum>(2)</enum><header>Certification
			 conditions</header><text>A certificate of type approval issued under paragraph
			 (1) shall specify each condition imposed by the Secretary under subsection
			 (c).</text></paragraph><paragraph id="idfdebbd999e7142f999e93c5dd0e93b0a"><enum>(3)</enum><header>Owners and
			 operators</header><text>A manufacturer that receives a certificate of type
			 approval for the treatment technology under this subsection shall provide
			 a
			 copy of the certificate to each owner and operator of a vessel on which
			 the
			 treatment technology is installed.</text></paragraph></subsection><subsection id="idee5b44310ea149a7b2d01ef205f1cd84"><enum>(f)</enum><header>Inspections</header><text>An
			 owner or operator who receives a copy of a certificate under subsection
			 (e)(3)
			 shall retain a copy of the certificate onboard the vessel and make the
			 copy of
			 the certificate available for inspection at all times while the owner or
			 operator is utilizing the treatment technology.</text></subsection><subsection id="ideb311e8ef31b46b59788c088b16fcb1f"><enum>(g)</enum><header>Biocides</header><text>The
			 Secretary may not approve a ballast water treatment technology under
			 subsection
			 (b) if—</text><paragraph id="id4fbfde122f5443489c75c1e50b2f8933"><enum>(1)</enum><text>it uses a biocide
			 or generates a biocide that is a pesticide, as defined in section 2 of the
			 Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref>), unless
			 the
			 biocide is registered under that Act or the Secretary, in consultation
			 with
			 Administrator, has approved the use of the biocide in such treatment
			 technology; or</text></paragraph><paragraph id="id14486449c030450ba9bc34478a4d7e3a"><enum>(2)</enum><text>it uses or
			 generates a biocide the discharge of which causes or contributes to a
			 violation
			 of a water quality standard under section 303 of the Federal Water
			 Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1313">33 U.S.C. 1313</external-xref>).</text></paragraph></subsection><subsection id="id07173fa70afa4eb787bee613b591abf7"><enum>(h)</enum><header>Prohibition</header><paragraph id="id01d1428dcb884f54bb693688bf1bdfdf"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the use of a ballast
			 water treatment technology by an owner or operator of a vessel shall not
			 satisfy the requirements of this Act unless it has been approved by the
			 Secretary under subsection (b).</text></paragraph><paragraph id="ida6d909b5e946463f863701ed1112ce42"><enum>(2)</enum><header>Exceptions</header><subparagraph id="idff7e29afd5e44c7eb75272f588385047"><enum>(A)</enum><header>Coast guard
			 shipboard technology evaluation program</header><text>An owner or operator may
			 use a ballast water treatment technology that has not been certified by
			 the
			 Secretary to comply with the requirements of this section if the
			 technology is
			 being evaluated under the Coast Guard Shipboard Technology Evaluation
			 Program.</text></subparagraph><subparagraph id="id1aadff4eb58642968846e421483c7e12"><enum>(B)</enum><header>Ballast water
			 treatment technologies certified by foreign entities</header><text>An owner or
			 operator may use a ballast water treatment technology that has not been
			 certified by the Secretary to comply with the requirements of this section
			 if
			 the technology has been certified by a foreign entity and the
			 certification
			 demonstrates performance and safety of the treatment technology equivalent
			 to
			 the requirements of this section, as determined by the Secretary.</text></subparagraph></paragraph></subsection><subsection id="idc0a51b1c65c64c90a8c606b42c5cccb9"><enum>(i)</enum><header>Testing
			 protocols</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Administrator, in consultation with the Secretary, shall
			 issue
			 requirements for land-based and shipboard testing protocols or criteria
			 for—</text><paragraph id="id9e498a39fc1145c0bf86deb94f02cf46"><enum>(1)</enum><text>certifying the
			 performance of each ballast water treatment technology under this section;
			 and</text></paragraph><paragraph id="id737ddd03297d439c97cc961ea3053886"><enum>(2)</enum><text>certifying
			 laboratories to evaluate such treatment technologies.</text></paragraph></subsection></section><section id="id5169c1dd82d54553a3f19c57f9fe7fef"><enum>7.</enum><header>Exemptions</header><subsection id="id5acefb3c677141238fec360da96e76b5"><enum>(a)</enum><header>In
			 general</header><text>No permit shall be required or prohibition enforced under
			 any other provision of law for, nor shall any standards regarding a
			 discharge
			 incidental to the normal operation of a vessel under this Act apply to—</text><paragraph id="id8e25a5dc615d4e628c7f52d22e3de56c"><enum>(1)</enum><text>a discharge
			 incidental to the normal operation of a vessel if the vessel is less than
			 79
			 feet in length and engaged in commercial service (as defined in section
			 2101(5)
			 of title 46, United States Code);</text></paragraph><paragraph id="idac9259b5834d4c089a9b14519d3251d7"><enum>(2)</enum><text>a discharge
			 incidental to the normal operation of a vessel if the vessel is a fishing
			 vessel, including a fish processing vessel and a fish tender vessel, (as
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101</external-xref> of title 46, United States Code);</text></paragraph><paragraph id="idefb1e5c4453a4e3d9683b016f4f57125"><enum>(3)</enum><text>a discharge
			 incidental to the normal operation of a vessel if the vessel is a
			 recreational
			 vessel (as defined in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101(25)</external-xref> of title 46, United States Code);</text></paragraph><paragraph id="id8bb51068260a45419dee5044ec212148"><enum>(4)</enum><text>the placement,
			 release, or discharge of equipment, devices, or other material from a
			 vessel
			 for the sole purpose of conducting research on the aquatic environment or
			 its
			 natural resources in accordance with generally recognized scientific
			 methods,
			 principles, or techniques;</text></paragraph><paragraph id="id7564bbae8e934c7d81bd53c89a0a103a"><enum>(5)</enum><text>any discharge
			 into navigable waters from a vessel authorized by an on-scene coordinator
			 in
			 accordance with part 300 of title 40, Code of Federal Regulations, or part
			 153
			 of title 33, Code of Federal Regulations;</text></paragraph><paragraph id="id5059e0f5f25a471e80106d3e84c12b56"><enum>(6)</enum><text>any discharge
			 into navigable waters from a vessel that is necessary to secure the safety
			 of
			 the vessel or human life, or to suppress a fire onboard the vessel or at a
			 shoreside facility; or</text></paragraph><paragraph id="id77e61be0e260485795e78adb83096bb7"><enum>(7)</enum><text>a vessel of the
			 armed forces of a foreign nation when engaged in noncommercial service.</text></paragraph></subsection><subsection commented="no" id="idfb6baa9550d945ad9d0302079413aba4"><enum>(b)</enum><header>Ballast water
			 discharges</header><text>No permit shall be required or prohibition enforced
			 under any other provision of law for, nor shall any ballast water
			 performance
			 standards under this Act apply to—</text><paragraph commented="no" id="id1F6E1291CFF647EAA21811C36C9948EE"><enum>(1)</enum><text>a ballast water
			 discharge incidental to the normal operation of a vessel determined by the
			 Secretary to—</text><subparagraph commented="no" id="id211caa5abfa54da09a6a43a70e86d9c2"><enum>(A)</enum><text>operate
			 exclusively within a geographically limited area;</text></subparagraph><subparagraph commented="no" id="id01047E44AF3A44948D3E9699B53FBB88"><enum>(B)</enum><text>take up and
			 discharge ballast water exclusively within 1 Captain of the Port Zone
			 established by the Coast Guard unless the Secretary determines such
			 discharge
			 poses a substantial risk of introduction or establishment of an aquatic
			 nuisance species;</text></subparagraph><subparagraph commented="no" id="ideefa029a8f844956bfa5292d162ef9ad"><enum>(C)</enum><text>operate pursuant
			 to a geographic restriction issued as a condition under section 3309 of
			 title
			 46, United States Code, or an equivalent restriction issued by the country
			 of
			 registration of the vessel; or</text></subparagraph><subparagraph commented="no" id="idF70CE3CF2D3340EEB02CB6EB9743FB81"><enum>(D)</enum><text>continuously take
			 on and discharge ballast water in a flow-through system that does not
			 introduce
			 aquatic nuisance species into navigable waters;</text></subparagraph></paragraph><paragraph commented="no" id="idF2118CE57DBB46DBBEEF92FEB85F719C"><enum>(2)</enum><text>a ballast water
			 discharge incidental to the normal operation of a vessel consisting
			 entirely of
			 water suitable for human consumption; or</text></paragraph><paragraph commented="no" id="id069A5F4983854148BBB0E1791EE81C39"><enum>(3)</enum><text>a ballast water
			 discharge incidental to the normal operation of a vessel in an alternative
			 compliance program established pursuant to section (8).</text></paragraph></subsection><subsection commented="no" id="id6E14D65CE35C4BD5BFEDCBC2447D7C3E"><enum>(c)</enum><header>Vessels with
			 permanent ballast water</header><text>No permit shall be required or
			 prohibition enforced under any other provision of law for, nor shall any
			 ballast water performance standard under this Act apply to, a vessel that
			 carries all of its permanent ballast water in sealed tanks that are not
			 subject
			 to discharge.</text></subsection><subsection id="id2B5E99B524BE4B929DB5F5572551B0A3"><enum>(d)</enum><header>Vessels of the
			 armed forces</header><text>Nothing in this Act shall be construed to apply to
			 a vessel of the Armed Forces, as defined in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)</external-xref> of title 10,
			 United
			 States Code.</text></subsection></section><section id="idA0385F5D88E24C2D92502B9A219E57B5"><enum>8.</enum><header>Alternative
			 compliance program</header><subsection id="idDEC7227E019D4B5BA2634C5BCD5E019D"><enum>(a)</enum><header>In
			 general</header><text>The Secretary, in consultation with the Administrator,
			 may promulgate regulations establishing 1 or more compliance programs as
			 an
			 alternative to ballast water management regulations issued under section 5
			 for a
			 vessel that—</text><paragraph id="id90731060A02A45858637ED177EE6D9F4"><enum>(1)</enum><text>has a maximum
			 ballast water capacity of less than 8 cubic meters;</text></paragraph><paragraph id="id9642782E461D4CE582D996D2896F856B"><enum>(2)</enum><text>is less than 3
			 years from the end of the useful life of the vessel, as determined by the
			 Secretary; or</text></paragraph><paragraph id="id3E8E285B42B24529A839E18106C970F6"><enum>(3)</enum><text>discharges
			 ballast water into a facility for the reception of ballast water that
			 meets
			 standards promulgated by the Administrator, in consultation with the
			 Secretary.</text></paragraph></subsection><subsection id="id64F727B13D104CBDAF9F0FCB45FEE9EC"><enum>(b)</enum><header>Promulgation of
			 facility standards</header><text>Not later than 1 year after the date of
			 enactment of this Act, the Administrator, in consultation with the
			 Secretary,
			 shall promulgate standards for—</text><paragraph id="id7C9FBD32DE434B2C87534EE856A61125"><enum>(1)</enum><text>the reception of
			 ballast water from a vessel into a reception facility; and</text></paragraph><paragraph id="idF54A375EB27447EC9909327A1EEE9230"><enum>(2)</enum><text>the disposal or
			 treatment of the ballast water under paragraph (1).</text></paragraph></subsection></section><section id="idA2D86E18A3044FDE9C49A5FECB29066A"><enum>9.</enum><header>Judicial
			 review</header><subsection id="idC94D2DEBFED446AC98F54EFCC78BA6A2"><enum>(a)</enum><header>In
			 general</header><text>An interested person may file a petition for review of a
			 final regulation promulgated under this Act in the United States Court of
			 Appeals for the District of Columbia Circuit.</text></subsection><subsection id="id3840AA2CF8FA43A69986B262F11EAE9C"><enum>(b)</enum><header>Deadline</header><text>A
			 petition shall be filed not later than 120 days after the date that notice
			 of
			 the promulgation appears in the Federal Register.</text></subsection><subsection commented="no" id="idBF984F85AAF14D0CA28A944E246ADC31"><enum>(c)</enum><header>Exception</header><text>Notwithstanding
			 subsection (b), a petition that is based solely on grounds that arise
			 after the
			 deadline to file a petition under subsection (b) has passed may be filed
			 not
			 later than 120 days after the date that the grounds first arise.</text></subsection></section><section commented="no" id="id41637E1342C846A299422BB5F6CEF6D9"><enum>10.</enum><header>Effect on State
			 authority</header><subsection id="id3a66f6ea84fd4cc5a7011b2e7a1353e6"><enum>(a)</enum><header>In
			 general</header><text>No State or political subdivision thereof may adopt or
			 enforce any statute or regulation of the State or political subdivision
			 with
			 respect to a discharge incidental to the normal operation of a vessel
			 after the
			 date of enactment of this Act.</text></subsection><subsection id="id4170f933e8ff41849fee66097c0fc233"><enum>(b)</enum><header>Savings
			 clause</header><text>Notwithstanding subsection (a), a State or political
			 subdivision thereof may enforce a statute or regulation of the State or
			 political subdivision with respect to ballast water discharges incidental
			 to
			 the normal operation of a vessel that specifies a ballast water
			 performance
			 standard that is more stringent than the ballast water performance
			 standard under section 5(a)(1)(A) and is in effect on the date of
			 enactment of this Act if the
			 Secretary, after consultation with the Administrator and any other Federal
			 department or agency the Secretary considers appropriate, makes a
			 determination
			 that—</text><paragraph id="idd3592dd679c64075b2d2db84134cea12"><enum>(1)</enum><text>compliance with
			 any performance standard specified in the statute or regulation can in
			 fact be
			 achieved and detected;</text></paragraph><paragraph id="idb01dd8d41e04411e861e41f89380b859"><enum>(2)</enum><text>the technology
			 and systems necessary to comply with the statute or regulation are
			 commercially
			 available; and</text></paragraph><paragraph id="id9311e54869134d5790a8066f0cd39fe7"><enum>(3)</enum><text>the statute or
			 regulation is consistent with obligations under relevant international
			 treaties
			 or agreements to which the United States is a party.</text></paragraph></subsection><subsection id="id74393a07d1fe4a7e8824c97410290b62"><enum>(c)</enum><header>Petition
			 process</header><paragraph id="idff128e0a50e24f1d94ffa24c386cdf25"><enum>(1)</enum><header>Submission</header><text>The
			 Governor of a State seeking to enforce a statute or regulation under
			 subsection
			 (b) shall submit a petition requesting the Secretary to review the statute
			 or
			 regulation.</text></paragraph><paragraph id="id1234c07ac05944a6a3a2ccb81595ddb0"><enum>(2)</enum><header>Contents;
			 deadline</header><text>A petition shall—</text><subparagraph id="id8434D6389C8A484DB8104F3F2EADEED2"><enum>(A)</enum><text>be accompanied by
			 the scientific and technical information on which the petition is based;
			 and</text></subparagraph><subparagraph id="id2D7B5160D62342C1BB379E7760C7461E"><enum>(B)</enum><text>be submitted to
			 the Secretary not later than 90 days after the date of enactment of this
			 Act.</text></subparagraph></paragraph><paragraph id="idef60826ea17243d690abcd844206eec3"><enum>(3)</enum><header>Determinations</header><text>The
			 Secretary shall make a determination on a petition under this subsection
			 not
			 later than 90 days after the date that the petition is received.</text></paragraph></subsection></section><section id="idF590720C022C4E75BAAE1CCE61722D80"><enum>11.</enum><header>Application
			 with other statutes</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 this Act shall be the exclusive statutory authority for regulation by the
			 Federal Government of discharges incidental to the normal operation of a
			 vessel
			 to which this Act applies. Except as provided under section 5(a)(1)(A),
			 any regulation in effect on the date immediately
			 preceding the effective date of this Act relating to any permitting
			 requirement for or prohibition on discharges incidental to the normal
			 operation of a vessel to which this Act applies shall be deemed to be a
			 regulation issued pursuant to the authority of
			 this Act and shall remain in full force and effect unless or until
			 superseded
			 by new regulations issued hereunder.</text></section></legis-body></bill>
