			 greater flexibility and information for Governors to address such
			 emergencies in the future.</official-title></form><legis-body><section changed="deleted" committee-id="SSCM00" id="id41C5434DC6174D89BC32D6785EFB8FA8" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reliable Home Heating Act</short-title></quote>.</text></section><section changed="deleted" committee-id="SSCM00" id="id553C4ED7E1AE4A82881D5B14C793D82F" reported-display-style="strikethrough" section-type="subsequent-section"><enum>2.</enum><header>Authority to extend emergency declarations for purposes of temporarily exempting motor carriers
			 providing emergency relief from certain safety regulations</header><subsection id="id0A0FD11A5EBA45B083DA82E48268E4B8"><enum>(a)</enum><header>Defined term</header><text display-inline="yes-display-inline">In this Act, the term <term>residential heating fuel</term> includes—</text><paragraph id="idBD0216BE91CB428B8BF7E833B76D2D53"><enum>(1)</enum><text display-inline="yes-display-inline">heating oil;</text></paragraph><paragraph id="idA1E9273C94104A4E8E4CAEBD0CEAC09A"><enum>(2)</enum><text>natural gas; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9186A3FD6A5C461794A20CFD98428C96"><enum>(3)</enum><text>propane.</text></paragraph></subsection><subsection id="idCDFB8044B94147F49A083ECB673855D8"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">If the Governor of a State declares a state of emergency caused by a shortage of residential
			 heating fuel and, at the conclusion of the initial
			 30-day emergency period (or a second 30-day emergency period authorized
			 under this subsection), the Governor determines that the emergency
			 shortage has not ended, any extension
			 of such state of emergency by the Governor, up to 2 additional 30-day
			 periods,
			 shall be recognized by the Federal Motor Carrier Safety Administration as
			 a period during which parts 390 through 399 of chapter III of title 49,
			 Code of Federal Regulations, shall not apply to any motor carrier or
			 driver operating a commercial motor vehicle to provide residential heating
			 fuel in
			 the geographic area so designated as under a state of emergency.</text></subsection><subsection id="id057F59B454064F1CAD373167C7B80189"><enum>(c)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">The Secretary of Transportation shall amend <external-xref legal-doc="usc" parsable-cite="usc/49/390">section 390.23(a)(1)(ii)</external-xref> of title 49, Code of Federal
			 Regulations, to conform to the provision set forth in subsection (b).</text></subsection><subsection id="id9BE9248085BB4AA2ADB7AA6630625046"><enum>(d)</enum><header>Savings provision</header><text>Nothing in this section may be construed to modify the authority granted to  the Federal Motor
			 Carrier Safety Administration’s Field Administrator under section
			 390.23(a) of title 49, Code of Federal Regulations, to offer temporary
			 exemptions from parts 390 through 399 of such title.</text></subsection></section><section changed="deleted" committee-id="SSCM00" id="idaec49da89b3640f6994c6816ac8873d1" reported-display-style="strikethrough"><enum>3.</enum><header>Energy Information Administration notification requirement</header><text display-inline="no-display-inline">The Administrator of the Energy Information Administration, using data compiled from the
			 Administration’s Weekly Petroleum Status Reports, shall notify the
			 Governor of each State in a Petroleum Administration for Defense District
			 if the inventory of residential heating fuel within such district has been
			 below the most recent 5-year average for more than 3 consecutive weeks.</text></section><section changed="deleted" committee-id="SSCM00" id="H253541FB4713469FAC724678822E2430" reported-display-style="strikethrough"><enum>4.</enum><header>Propane and home heating fuel emergency transportation</header><subsection id="H438C7E62B2674D38B6B5B3B6F737317F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a covered emergency exemption issued by the Federal
			 Motor Carrier Safety Administration shall remain in effect until May 31,
			 2014, unless the Secretary of Transportation, after consultation with the
			 Governors of affected States, determines that the emergency for which the
			 exemption was provided ends before that date.</text></subsection><subsection id="H0B4D6F125C2E4D2086D1D44BAA501C2E"><enum>(b)</enum><header>Covered emergency exemption defined</header><text>In this section, the term <term>covered emergency exemption</term> means an exemption issued under <external-xref legal-doc="regulation" parsable-cite="cfr/49/390.23">section 390.23</external-xref> of title 49, Code of Federal Regulations, or
			 extended under section 390.25 of such title that—</text><paragraph id="HCC6EB250A77A4D0A9B294850A86D81A4"><enum>(1)</enum><text>was issued or extended during the period beginning on February 5, 2014, and ending on the date of
			 enactment of this Act; and</text></paragraph><paragraph id="H477C930ECB3C42FA82A34103064A6B67"><enum>(2)</enum><text>provided regulatory relief for commercial motor vehicle operations providing direct assistance
			 supporting the delivery of propane and home heating fuels.</text></paragraph></subsection><subsection id="H2849493C9B9145478E86E45B592BF641"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in subsection (a) may be construed to prohibit the Federal Motor Carrier Safety
			 Administration from issuing or extending a covered emergency exemption
			 beyond May 31, 2014, under other Federal law.</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section changed="added" committee-id="SSCM00" id="id1f0a2c2c-8c17-40da-8e9e-6ed6d4e10d1a" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reliable Home Heating Act</short-title></quote>.</text></section><section changed="added" committee-id="SSCM00" id="id3158fdfa-fbc3-4076-8bf9-29cc05cbfbc9" reported-display-style="italic" section-type="subsequent-section"><enum>2.</enum><header>Authority to extend emergency declarations for purposes of temporarily exempting motor carriers
			 providing emergency relief from certain safety regulations</header><subsection id="idfc4b3d65-417c-4770-ad38-598d1589ac4b"><enum>(a)</enum><header>Defined term</header><text display-inline="yes-display-inline">In this Act, the term <term>residential heating fuel</term> includes—</text><paragraph id="id5a3c5499-11ae-4357-b1e1-a7c57e1f29bf"><enum>(1)</enum><text display-inline="yes-display-inline">heating oil;</text></paragraph><paragraph id="id53b0a9ff-f4a6-456e-9c11-69787ea13a1b"><enum>(2)</enum><text>natural gas; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf1a86b9c-54ef-4be5-82da-75b9605f5df6"><enum>(3)</enum><text>propane.</text></paragraph></subsection><subsection id="id9b72c8b8-f341-4659-a07f-d8bd58a9cd52"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">If the Governor of a State declares a state of emergency caused by a shortage of residential
			 heating fuel and, at the conclusion of the initial

			 390.23(a) of title 49, Code of Federal Regulations, to offer temporary
			 exemptions from parts 390 through 399 of such title.</text></subsection></section><section changed="added" committee-id="SSCM00" id="idd83f3d0c-dccb-4f14-acd6-597abebaf744" reported-display-style="italic"><enum>3.</enum><header>Energy Information Administration notification requirement</header><text display-inline="no-display-inline">The Administrator of the Energy Information Administration, using data compiled from the
			 Administration’s Weekly Petroleum Status Reports, shall notify the
			 Governor of each State in a Petroleum Administration for Defense District
			 if the inventory of residential heating fuel within such district has been
			 below the most recent 5-year average for more than 3 consecutive weeks.</text></section><section changed="added" committee-id="SSCM00" id="id33a8e7be-363d-4dab-ba57-dfae2d220061" reported-display-style="italic"><enum>4.</enum><header>Review</header><text display-inline="no-display-inline">Not later than 12 months after the date of enactment of 
this Act, the Secretary of Transportation shall conduct a study of, and transmit to the 
Committee on Commerce, Science, and Transportation of the Senate and 
the Committee on Transportation and Infrastructure of the House of 
Representatives, a report on the impacts of safety from the extensions issued by Governors
			 according to this Act. In conducting the study, the Secretary shall
			 review, at a 
minimum—</text><paragraph id="id50BE3F62F63F424E8F8D624B44467830"><enum>(1)</enum><text display-inline="yes-display-inline">the safety implications of extending exemptions; and</text></paragraph><paragraph id="idBFDEBA049E14431E9BFAC5B7DF89F577"><enum>(2)</enum><text display-inline="yes-display-inline">a review of the exemption process to ensure clarity and efficiency during emergencies.</text></paragraph></section></legis-body><endorsement><action-date>May 20, 2014</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
