			 United States Merchant Marine Academy, and for other purposes.</official-title></form><legis-body><section id="id3D9C9DDE50494F74894CDBDEB6D77BED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>U.S. Merchant Marine Academy Board of Visitors Enhancement Act</short-title></quote>.</text></section><section id="id89ef25b3d307472ab40aa79967985577"><enum>2.</enum><header>United States Merchant Marine Academy Board of Visitors</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/51312">Section 51312</external-xref> of title 46, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="idAB502A2202F442BCB714765342897E1A" style="USC"><section id="idb54953d5243e42f8965a915f88d82a23"><enum>51312.</enum><header>Board of Visitors</header><subsection id="id8c091bc035fa46a4bf6890192f405c2c"><enum>(a)</enum><header>In general</header><text>A Board of Visitors to the United States Merchant Marine Academy (referred to in this section as
			 the <quote>Board</quote> and the <quote>Academy</quote>, respectively) shall be established to provide independent advice  and recommendations on matters
			 relating to
			 the United States Merchant Marine Academy.</text></subsection><subsection id="id237fe75603e84512b2313e121277c9dd"><enum>(b)</enum><header>Appointment and membership</header><paragraph id="idf9784b960a2f4b00b43af414643c67d0"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of the <short-title>U.S. Merchant Marine Academy Board of Visitors Enhancement Act</short-title>, the Board shall be composed of—</text><subparagraph id="id641B7FCAAE864A7EBC797E71D2DE37D5"><enum>(A)</enum><text>2 Senators appointed by the chairman, in consultation with the ranking member, of the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>;</text></subparagraph><subparagraph id="id1d4d7df0e9df40b2a7f0acaac3b2c4de"><enum>(B)</enum><text>3 members of the House of Representatives appointed by the chairman, in consultation with the
			 ranking member, of the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>;</text></subparagraph><subparagraph id="id68d12b4fae33408f8711bc4b16df95f2"><enum>(C)</enum><text>1 Senator appointed by the Vice President, who shall be a member of the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name>;</text></subparagraph><subparagraph id="id0166d642a1f642fe8fe4de8a5bba781d"><enum>(D)</enum><text>2 members of the House of Representatives appointed by the Speaker of the House of
			 Representatives,
			 in consultation with the Minority Leader, at least 1 of whom shall be a
			 member of the <committee-name committee-id="">Committee on Appropriations of the House of Representatives</committee-name>;</text></subparagraph><subparagraph id="id0899d5a4868c437f862c4e0d86781693"><enum>(E)</enum><text>the Commander of the United States Transportation Command;</text></subparagraph><subparagraph id="ide706c914b19f452c836d119245accf38"><enum>(F)</enum><text>the Commander of the Military Sealift Command;</text></subparagraph><subparagraph id="idee434de564da447984ac1bd1630de6da"><enum>(G)</enum><text>the Assistant Commandant for Prevention Policy of the United States Coast Guard;</text></subparagraph><subparagraph id="idF2E63E25AD85492DB920EE9CEE49C029"><enum>(H)</enum><text>4 individuals appointed by the President; and</text></subparagraph><subparagraph id="idbd6b7c50f8b6410b8950de8ab8e41f50"><enum>(I)</enum><text>as ex officio members—</text><clause id="idA7EFFA68F582482EA6C463419E1C0014"><enum>(i)</enum><text>the chairman of the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>;</text></clause><clause id="id7CA5548B9C5541B9B8FB39983A34C585"><enum>(ii)</enum><text>the chairman of the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>;</text></clause><clause id="id7a8e7db4bd624b03bdae065e2a40291d"><enum>(iii)</enum><text>the chairman of the Advisory Board to the Academy established under
			 section 51313; and</text></clause><clause id="idE3DC45E6144A466E87CA2177EB9E744B"><enum>(iv)</enum><text>the member of the House of Representatives in whose
			 congressional district the Academy is located, as a non-voting member,
			 unless such member of the House of
			 Representatives is appointed as  a voting member of the Board under 
			 subparagraph (B) or (D).</text></clause></subparagraph></paragraph><paragraph id="id4fcc54e822824aeb9cbe2201f43536de"><enum>(2)</enum><header>Presidential appointees</header><text>Of the individuals appointed by the President under paragraph (1)(H)—</text><subparagraph id="iddaaa43ca359c4fd98388681ae30bb278"><enum>(A)</enum><text>at least 2 shall be graduates of the Academy;</text></subparagraph><subparagraph id="id36273485f9e84936ae9b4abe44ec2ff4"><enum>(B)</enum><text>at least 1 shall be a senior corporate officer from a United States maritime shipping company
			 that
			 participates in the Maritime Security Program, or in any Maritime
			 Administration program providing incentives for companies to register
			 their vessels in the United States, and this appointment shall rotate
			 biennially among such companies; and</text></subparagraph><subparagraph id="idc86d552f0c2743ca8b50f91cbb5952f9"><enum>(C)</enum><text>1 or more may be a Senate-confirmed Presidential appointee, a member of the Senior Executive
			 Service, or an officer of flag-rank who from the United States Coast
			 Guard, the National Oceanic and Atmospheric Administration, or any of the
			 military services that commission graduates of the Academy, exclusive of
			 the Board members described in subparagraph (E), (F), or (G) of paragraph
			 (1).</text></subparagraph></paragraph><paragraph id="id8783cf583c2d4360935f45f72abf39e1"><enum>(3)</enum><header>Term of service</header><text>Each member of the Board shall serve for a term of 2 years commencing at the beginning of each
			 Congress, except that any member whose term on the Board has expired shall
			 continue to serve until a successor is designated.</text></paragraph><paragraph id="ide804f26b0e4645ebad7963404375f1e1"><enum>(4)</enum><header>Vacancies</header><text>If  a member of the Board  is no longer able to serve on the Board or resigns, the Designated
			 Federal Officer selected under subsection
			 (g)(2) shall immediately notify the official who appointed such member.
			   Not later than 60 days after that notification, such official shall
			 designate a replacement to serve the remainder of such member's term.</text></paragraph><paragraph id="idb1b12747154b4576a56cbea62d0f2fe8"><enum>(5)</enum><header>Current members</header><text>Each member of the Board serving as a member of the Board on the date of the enactment of
			 the <short-title>U.S. Merchant Marine Academy Board of Visitors Enhancement Act</short-title> shall continue to serve on the Board for the remainder of such member’s term.</text></paragraph><paragraph id="id9e6ed17bddef48a886033d3a5f0ff1c3"><enum>(6)</enum><header>Designation and responsibility of substitute Board members</header><subparagraph id="idAEA34A4CF214413F98F88AE8A7437439"><enum>(A)</enum><header>Authority to designate</header><text>A member of the Board described in subparagraph (E), (F), or (G) of paragraph (1) or
			 subparagraph (B) or (C) of paragraph (2) may, if unable to attend or
			 participate in an activity described in subsection (d), (e), or (f),
			 designate another individual to serve as a substitute member of the Board,
			 on a temporary basis, to attend or participate in such activity.</text></subparagraph><subparagraph id="id86F848E2DF3C41EA8E7E802B823E8396"><enum>(B)</enum><header>Requirements</header><text>A substitute member of the Board designated under subparagraph (A) shall be—</text><clause id="id1BB9F835D31D491BBDC4313CB7A700C2"><enum>(i)</enum><text>an individual who has been
			 appointed by the President and confirmed by the Senate;</text></clause><clause id="idA5A35E4960A24CAF818972B614ABAE15"><enum>(ii)</enum><text>a member of the
			 Senior Executive
			 Service; or</text></clause><clause id="id5393BA54D53445DDB15A878F908243ED"><enum>(iii)</enum><text>an officer of flag-rank who is employed by—</text><subclause id="idA76A42404E8C4D65AC0B8A42728BD6DF"><enum>(I)</enum><text>the United States Coast Guard;</text></subclause><subclause id="idAA88B3F4A5844E78893118BC5C737577"><enum>(II)</enum><text>the United States Transportation Command; or</text></subclause><subclause id="id8485c2cf7c584a729bf4cc7cab20cbd5"><enum>(III)</enum><text>the Military Sealift Command.</text></subclause></clause></subparagraph><subparagraph id="id0D68C504A548458C90F2613D9BAD1D72"><enum>(C)</enum><header>Participation</header><text>A substitute member of the Board designated under subparagraph (A)—</text><clause id="id8E0D86DC3EA7471C856D74038160A7CA"><enum>(i)</enum><text>shall be permitted to fully participate in the proceedings and activities
			 of the Board;</text></clause><clause id="id212CCE1AA3284C5F8BC80447A301A9AA"><enum>(ii)</enum><text>shall report back to the member on the Board’s activities
			 not later than 15 days following the substitute member’s participation in
			 such
			 activities; and</text></clause><clause id="id402D2541D7F343CAB5239093C2AE3541"><enum>(iii)</enum><text>shall be permitted to participate in the preparation of reports described in paragraph (j) related
			 to any proceedings or activities of the Board in which such substitute
			 member participates.</text></clause></subparagraph></paragraph></subsection><subsection id="idffafaf4e56024dfb98912c2bb65cd341"><enum>(c)</enum><header>Chairperson</header><paragraph id="idA8B841E33B224EF8982FE285FD20D5D2"><enum>(1)</enum><header>In general</header><text>On a biennial basis, the Board shall select from among its members, a member of the House of
			 Representatives or a Senator to serve as the  Chairperson.</text></paragraph><paragraph id="idecef9d1c695549e79240a731fbf7f17d"><enum>(2)</enum><header>Rotation</header><text>A member of the House of Representatives and a member of the Senate shall alternately serve as the
			 Chair of the Board on a biennial basis.</text></paragraph><paragraph id="idBF4D5D92FC6E4BBBB5628A5DF78CE05E"><enum>(3)</enum><header>Term</header><text>An individual may not serve as Chairperson for more than 1 consecutive term.</text></paragraph></subsection><subsection id="idaeebb148889d40438d6237d2675f7a6d"><enum>(d)</enum><header>Meetings</header><paragraph id="idC96632F9F1524E8FBB98AF025B868CE2"><enum>(1)</enum><header>In general</header><text>The Board shall meet several times each year as provided for in the Charter described in paragraph
			 (2)(B),
			 including at least 1 meeting held at the Academy.</text></paragraph><paragraph id="id28a1345ee46a49ea8c2b87923862a89e"><enum>(2)</enum><header>Selection and consideration</header><text>Not later than 60 days after the date of the enactment of the <short-title>U.S. Merchant Marine Academy Board of Visitors Enhancement Act</short-title>, the Designated Federal Officer selected under subsection (g)(2) shall organize a meeting of
			 the Board for the purposes of—</text><subparagraph id="id75f947211b914a278543838e47cead5e"><enum>(A)</enum><text>selecting a Chairperson; and</text></subparagraph><subparagraph id="idad534d05de834c43ba44fe591162c29b"><enum>(B)</enum><text>considering an official Charter for the Board, which shall provide for the meeting of the
			 Board several times each year.</text></subparagraph></paragraph></subsection><subsection id="id82cbbf143e674559af7a06ba3ee7baaf"><enum>(e)</enum><header>Visiting the Academy</header><paragraph id="idb38d3a8e969e4ce0b1dee0267309d9f4"><enum>(1)</enum><header>Annual visit</header><text>The Board shall visit the Academy annually on a date selected by the
			 Board, in consultation with the Secretary of Transportation and the
			 Superintendent of the Academy.</text></paragraph><paragraph id="id4d051d510a004f40ad73de4c82fcbe67"><enum>(2)</enum><header>Other visits</header><text>In cooperation with the Superintendent, the Board or its members may make other visits to the
			 Academy in connection with the duties of the Board.</text></paragraph><paragraph id="id4A8516D94C36437593883D91AAFF0610"><enum>(3)</enum><header>Access</header><text>While visiting the Academy under this subsection, members of the Board shall have reasonable
			 access to
			 the grounds, facilities, midshipmen, faculty, staff, and other personnel
			 of the Academy for the purpose of carrying out the duties of the Board.</text></paragraph></subsection><subsection id="ide0bc811c595b4db3af658520016f831f"><enum>(f)</enum><header>Responsibility</header><text>The Board shall inquire into the state of morale and discipline, the curriculum, instruction,
			 physical equipment, fiscal affairs, academic methods, and other matters
			 relating to the Academy that the Board
			 decides to consider.</text></subsection><subsection id="id5f673788a4424ab981a0a42ffa231e26"><enum>(g)</enum><header>Department of Transportation support</header><text>The Secretary of Transportation shall—</text><paragraph id="idf8a4b100c18049c79084d3a80b11ccb5"><enum>(1)</enum><text>provide support as deemed necessary by the Board for the performance of the Board’s functions;</text></paragraph><paragraph id="id9aaa55b423544f28a753f8a29af46493"><enum>(2)</enum><text>not later than	30 days after the date of the enactment of the <short-title>U.S. Merchant Marine Academy Board of Visitors Enhancement Act</short-title>, select a Designated Federal Officer to support the performance of the Board’s functions; and</text></paragraph><paragraph id="id2bcee1662379440cb2712560a98cd7f6"><enum>(3)</enum><text>in cooperation with the Maritime Administrator and the Superintendent of the Academy, advise the
			 Board of any institutional issues, consistent with applicable laws
			 concerning the disclosure of information.</text></paragraph></subsection><subsection id="id42aa01eda3c248b8b3b384a4b3fee52a"><enum>(h)</enum><header>Staff</header><text>Staff  members may be designated to serve without reimbursement as staff for the Board by—</text><paragraph id="idc9e7921332484ecc95eba703988eb763"><enum>(1)</enum><text>the Chairperson of the Board;</text></paragraph><paragraph id="idbac823173187468b85b253d64525e7bc"><enum>(2)</enum><text>the chairman of the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>; and</text></paragraph><paragraph id="id53d964bd1804407cb8237458ee47d339"><enum>(3)</enum><text>the chairman of the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>.</text></paragraph></subsection><subsection id="idede949d07d194bdf8846755291c3191e"><enum>(i)</enum><header>Travel expenses</header><text>While serving away from home or regular place of business, a member of the Board or a staff member
			 designated under subsection (h) shall be allowed travel expenses,
			 including per diem in lieu of subsistence, as	  authorized under section
			 5703 of title 5, United States Code.</text></subsection><subsection id="id7905209ed6f04a3ab8313d81a58b8ace"><enum>(j)</enum><header>Reports</header><paragraph id="idFDA203C6D0F243C2BDBE5D5E11ED7997"><enum>(1)</enum><header>Annual report</header><text>Not later than 60 days after each annual visit required under subsection (e)(1), the Board shall
			 submit to the President a written report of its actions, views, and
			 recommendations pertaining to the Academy.</text></paragraph><paragraph id="ide559184a946a4e2b86542beac25f3463"><enum>(2)</enum><header>Other reports</header><text>If the members of the Board visit the Academy under subsection (e)(2), the Board may—</text><subparagraph id="id52D369157942455DB350F1D750A640EB"><enum>(A)</enum><text>prepare a report on such visit; and</text></subparagraph><subparagraph id="id7E23154651BD4AD4AC5BCB3370BD2F90"><enum>(B)</enum><text>if approved by a majority of the members of the Board, submit such report to the President not
			 later than 60 days after the date of the approval.</text></subparagraph></paragraph><paragraph id="id2845653b1b6943c6be4caeb6e5e1dabe"><enum>(3)</enum><header>Advisors</header><text>The Board may call in advisers—</text><subparagraph id="idCBF1C0AD0D8940C18BCE5586FE73FC24"><enum>(A)</enum><text>for consultation
			 regarding the execution of the Board’s responsibility under subsection
			 (f);
			 or</text></subparagraph><subparagraph id="id257D0D69E7A947688C1D5B6FA93B2BB5"><enum>(B)</enum><text>to assist in the preparation of a report described in paragraph (1) or (2).</text></subparagraph></paragraph><paragraph id="id07cf76d6fe2849f88fc341880dd4e0ff"><enum>(4)</enum><header>Submission</header><text>A report submitted to the President  under paragraph (1) or (2) shall be concurrently submitted to—</text><subparagraph id="id53b8f3a09ab448a4bfa05f8ec10f5257"><enum>(A)</enum><text>the Secretary of Transportation;</text></subparagraph><subparagraph id="ida80858efe77a4ca3ab4530eeb72f3e34"><enum>(B)</enum><text>the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb19196a2cf8e4585992c2d19c2e075f9"><enum>(C)</enum><text>the <committee-name committee-id="">Committee on Armed Services of the House of Representatives</committee-name>.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><endorsement><action-date>May 14, 2014</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
