			 fieldwork services and investigative support services.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="id2369907f-0877-4e5f-8c97-c225edd4e286" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
		  <quote><short-title>Preventing Conflicts of Interest with Contractors Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id36a2676c-c5b3-48cb-801c-5a86569d36c1" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="id6b265986-6308-4f41-8fed-c95e29ec147c"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>agency</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id33ed9244-edfc-4db8-9574-57d8918c92b7"><enum>(A)</enum><text display-inline="yes-display-inline">an Executive agency (as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5, United States Code);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5bb24ed5-2d16-4bf4-b235-8b5416f50dc3"><enum>(B)</enum><text display-inline="yes-display-inline">a military department (as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/102">section 102</external-xref> of title 5, United States Code);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e555ae2-2ec3-454a-bc34-8f0e311b2a4a"><enum>(C)</enum><text display-inline="yes-display-inline">an element of the intelligence community (as that term is defined in section 3 of the National
			 Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbeaf9175-0da1-438f-b5fd-39710d0caf68"><enum>(D)</enum><text display-inline="yes-display-inline">the United States Postal Service; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4ffd0693-462d-447b-8571-691617b9e404"><enum>(E)</enum><text display-inline="yes-display-inline">the Postal Regulatory Commission;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6fc8edd2-a8ad-4480-9a6c-0a6d9dbd0fe7"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>background investigation fieldwork services</term> means the investigatory fieldwork conducted to determine the eligibility of an individual
			 for logical and physical access to Federally-controlled facilities or
			 information systems, suitability  or fitness for Federal employment,
			 eligibility for access to classified information or to hold a national
			 security sensitive position, or fitness to perform work for or on behalf
			 of the Federal Government as a contractor or employee, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id37c3a43d-a19b-4238-a22f-28e42626feb0"><enum>(A)</enum><text display-inline="yes-display-inline">interviews of the individual, the employer of the individual, former employers of the individual,
			 and friends, family,	and other sources who might have relevant
			 knowledge of the individual; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ecc9208-673e-488f-a577-1f20b3dac977"><enum>(B)</enum><text display-inline="yes-display-inline">reviews of—</text><clause commented="no" display-inline="no-display-inline" id="ida81ad977-6a96-455b-a778-ffd3956ad09a"><enum>(i)</enum><text display-inline="yes-display-inline">educational and employment records;</text></clause><clause commented="no" display-inline="no-display-inline" id="idba433fb0-6a85-46d1-8f13-7551300ba4eb"><enum>(ii)</enum><text display-inline="yes-display-inline">criminal and other legal records; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id37969009-f499-42f9-83cd-0b1b6aafa0f7"><enum>(iii)</enum><text display-inline="yes-display-inline">credit history;</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide03efd75-36db-4864-85de-59862489c8a9"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>background investigation support services</term> means the clerical, administrative, and technical support services provided to various functions
			 critical to the background investigation process, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id03455032-1782-417a-833c-abaae54e7b22"><enum>(A)</enum><text display-inline="yes-display-inline">initial
			 processing and scheduling of investigative requests;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida447a17a-2118-4ecc-a044-1d31310f0786"><enum>(B)</enum><text display-inline="yes-display-inline">information
			 technology and information technology support;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id908235bd-32e1-4d53-a233-549e82d44b5f"><enum>(C)</enum><text display-inline="yes-display-inline">file maintenance;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb2704df0-3533-409a-a237-ba19c06436c9"><enum>(D)</enum><text display-inline="yes-display-inline">imaging or copying of investigation documents; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id885e75c2-de09-4323-8718-b7c7b96c55ee"><enum>(E)</enum><text display-inline="yes-display-inline">mail processing; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb1289b85-1318-4111-b249-1947e90952fb"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>quality review process</term> means performing the final quality review of a background investigation to
			 ensure investigative, administrative, and other required standards have
			 been met
			 before the completed background investigation is delivered to the
			 adjudicating agency.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id1a974d92-71f4-4547-b707-fa00e969593f" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Limitation on contracting to prevent organizational conflicts of interest</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, after the date of enactment of this Act, a contract may
			 not be entered into, and an extension of or option on a contract may not
			 be exercised, with a contractor to conduct a quality review process
			 relating to background investigation fieldwork services or background
			 investigation support services if the contractor is performing the
