			 <quote><short-title>Clean Estuaries Act of 2014</short-title></quote>.</text></section><section changed="deleted" committee-id="SSEV00" id="id103b0355-59dd-4142-bb12-5d8472fd2d35" reported-display-style="strikethrough"><enum>2.</enum><header>National estuary program
			 amendments</header><subsection id="idd743ad47-00b9-4ac1-abc0-d261befe88ac"><enum>(a)</enum><header>Purposes of
			 Conference</header><paragraph id="id47397cfd-10e8-421a-bc20-9947f56e0d2d"><enum>(1)</enum><header>Development of
			 comprehensive conservation and management plans</header><text>Section 320(b) of
			 the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(b)</external-xref>) is amended by
			 striking paragraph (4) and inserting the following:</text><quoted-block changed="deleted" committee-id="SSEV00" display-inline="no-display-inline" id="id1fbdaebf-9227-45d0-8de0-6964d05bee56" reported-display-style="strikethrough" style="OLC"><paragraph id="idb0de54fa-30aa-47d4-9bad-8fcbb7305c3b"><enum>(4)</enum><text>develop and submit to the
				Administrator a comprehensive conservation and management plan
			 that—</text><subparagraph id="id68f64103-36d9-464e-9ad8-f992257cd667"><enum>(A)</enum><text>identifies the estuary
				and the associated upstream waters of the estuary to be addressed
			 by the plan,
				with consideration given to hydrological boundaries;</text></subparagraph><subparagraph id="id5a0e3839-09d5-4690-979a-a15ae2e549e1"><enum>(B)</enum><text>recommends priority
				protection, conservation, and corrective actions and compliance
			 schedules that
				address point and nonpoint sources of pollution—</text><clause id="idcf09501b-20a7-48cd-95e3-c148994cd04a"><enum>(i)</enum><text>to restore and maintain
				the chemical, physical, and biological integrity of the estuary,
				including—</text><subclause id="id52c0a445-1cda-4961-bb8c-a90600a36eb7"><enum>(I)</enum><text>restoration and
				maintenance of water quality, including wetlands and natural
			 hydrological
				flows;</text></subclause><subclause id="idaac43ea2-b1c0-4e59-89fc-68d6cde58d33"><enum>(II)</enum><text>a resilient and diverse
				indigenous population of shellfish, fish, and wildlife; and</text></subclause><subclause id="idf9a49dc8-c05d-4ee1-9d5c-8283eb481199"><enum>(III)</enum><text>recreational activities
				in the estuary; and</text></subclause></clause><clause id="idca61ae79-af1e-4a49-bcba-19115f88692c"><enum>(ii)</enum><text>to ensure that the
				designated uses of the estuary are protected;</text></clause></subparagraph><subparagraph id="idbd54ffb2-6055-42c9-ad65-01b549393b88"><enum>(C)</enum><text>identifies healthy
				and impaired watershed components by carrying out integrated
			 assessments that include
				assessments of—</text><clause id="id11e1c4f5-401d-414d-87b3-bfa7ceb4a709"><enum>(i)</enum><text>aquatic habitat and
				biological integrity;</text></clause><clause id="id5da295d9-8b44-4b51-ba78-36fa047487eb"><enum>(ii)</enum><text>water quality;
				and</text></clause><clause id="idb8d72d80-0786-48a1-815b-d5aee48632d1"><enum>(iii)</enum><text>natural hydrological
				flows;</text></clause></subparagraph><subparagraph id="id908b6f4d-ec31-4df7-aea6-c9f18782c321"><enum>(D)</enum><text>considers current and
				future sustainable commercial activities in the estuary;</text></subparagraph><subparagraph id="idbf3e9773-1606-489d-8517-068eecb63454"><enum>(E)</enum><text>addresses the effects of climate variability on the estuary, including—</text><clause id="id2ea264a0-7f3d-4657-94b3-1b5238f89787"><enum>(i)</enum><text>the identification and
				assessment of vulnerabilities in the estuary;</text></clause><clause id="id11539e7c-5e94-4a59-bd15-b18508ab30d5"><enum>(ii)</enum><text>the development and
				implementation of adaptation strategies; and</text></clause><clause id="idca6b1ad0-aaeb-49d8-bbb3-39eb7dbd40a8"><enum>(iii)</enum><text>the potential impacts
				of changes in sea level on estuarine water quality, estuarine
			 habitat, and
				infrastructure located in the estuary;</text></clause></subparagraph><subparagraph id="id94122ded-14fb-4510-aae5-3618553cfeff"><enum>(F)</enum><text>increases public
				education and awareness with respect to—</text><clause id="id0c81df90-ae66-40f7-9982-37ca3311b9c2"><enum>(i)</enum><text>the ecological health of
				the estuary;</text></clause><clause id="id660af967-12af-4ad0-a047-f740b13f3bf5"><enum>(ii)</enum><text>the water quality
				conditions of the estuary; and</text></clause><clause id="id370f3b6e-50f1-4ae6-b879-fd8fbebbd732"><enum>(iii)</enum><text>ocean, estuarine, land,
				and atmospheric connections and interactions;</text></clause></subparagraph><subparagraph id="idee155651-16c3-46ea-b866-fff9306f43b0"><enum>(G)</enum><text>includes performance
				measures and goals to track implementation of the plan; and</text></subparagraph><subparagraph id="id8161ac67-d68d-4862-a329-61335802e666"><enum>(H)</enum><text>includes a coordinated
				monitoring strategy for Federal, State, and local governments and
			 other
				entities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id58a4540f-66a9-465a-b3d6-d7c565e9c06e"><enum>(2)</enum><header>Monitoring and making
			 results available</header><text>Section 320(b) of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(b)</external-xref>) is amended by striking paragraph (6) and
			 inserting the following:</text><quoted-block changed="deleted" committee-id="SSEV00" display-inline="no-display-inline" id="ide1e6c0b3-b1f6-4058-9706-d67ddfd0fec1" reported-display-style="strikethrough" style="OLC"><paragraph id="id07b009a9-d31f-4a19-a93f-cd93cd276ba5"><enum>(6)</enum><text>monitor (and make results
				available to the public regarding)—</text><subparagraph id="id68d669c6-4f27-41c7-b46e-80f0da03e613"><enum>(A)</enum><text>water quality conditions
				in the estuary and the associated upstream waters of the estuary
			 identified
				under paragraph (4)(A);</text></subparagraph><subparagraph id="id29a38264-e4e9-4e76-8a54-aa44dce72bef"><enum>(B)</enum><text>watershed and habitat
				conditions that relate to the ecological health and water quality
			 conditions of
				the estuary; and</text></subparagraph><subparagraph id="id0a4e513a-d8b7-4336-a99b-0b4a9557190b"><enum>(C)</enum><text>the effectiveness of
				actions taken pursuant to the comprehensive conservation and
			 management plan
				developed for the estuary under this
				subsection;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id34f2e358-de26-4648-8065-54c67d0a7c50"><enum>(3)</enum><header>Information and
			 educational activities</header><text>Section 320(b) of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(b)</external-xref>) is amended—</text><subparagraph id="id0dca6f23-7194-4eb1-b431-f3c73e227e6f"><enum>(A)</enum><text>by redesignating
			 paragraph (7) as paragraph (8); and</text></subparagraph><subparagraph id="id32adb1e6-46b4-4fc9-bc3e-1758d5e10b46"><enum>(B)</enum><text>by inserting after
			 paragraph (6) the following:</text><quoted-block changed="deleted" committee-id="SSEV00" display-inline="no-display-inline" id="idd48d7de0-017b-419d-a16d-93f42d6fe04f" reported-display-style="strikethrough" style="OLC"><paragraph id="id6808bbc7-d242-4e7c-8c3e-769b2cc15e4f"><enum>(7)</enum><text>provide information and
				educational activities on the ecological health and water quality
			 conditions of
				the estuary;
				and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id562faa59-c38f-40c6-b5b9-027f83915889"><enum>(4)</enum><header>Conforming
			 amendment</header><text>The sentence following section 320(b)(8) of the Federal
			 Water Pollution Control Act (as so redesignated) (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(b)(8)</external-xref>) is
			 amended by striking <quote>paragraph (7)</quote> and inserting <quote>paragraph
			 (8)</quote>.</text></paragraph></subsection><subsection id="idb3b114ff-366c-4c93-989f-a9d4fe41ab5b"><enum>(b)</enum><header>Members of Conference;
			 Collaborative Processes</header><paragraph id="ida058da23-5598-48a8-b762-dcccfe68e514"><enum>(1)</enum><header>Members of
			 conference</header><text>Section 320(c)(5) of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(c)(5)</external-xref>) is amended by inserting
			 <quote>not-for-profit organizations,</quote> after
			 <quote>institutions,</quote>.</text></paragraph><paragraph id="ida48c6cdd-07ba-4e8a-8134-a6f425c7f18a"><enum>(2)</enum><header>Collaborative
			 processes</header><text>Section 320(d) of the Federal Water Pollution Control
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(d)</external-xref>) is amended—</text><subparagraph id="id8d802338-b95d-4d89-b711-78c528d42940"><enum>(A)</enum><text>by striking
			 <quote>(d)</quote> and all that follows through <quote>In developing</quote>

				data</header><text>In developing</text></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id1148df8f-8357-4977-b5c3-268615c977d5"><enum>(B)</enum><text>by adding at the end the
			 following:</text><quoted-block changed="deleted" committee-id="SSEV00" display-inline="no-display-inline" id="id15434c22-aa27-421d-b0b4-7a7381942026" reported-display-style="strikethrough" style="OLC"><paragraph id="id60237306-c96b-4e73-9d3c-83b4da77c61a"><enum>(2)</enum><header>Use of collaborative
				processes</header><text>In updating a plan under subsection (f)(4) or
				developing a new plan under subsection (b), a management conference
			 shall make
				use of collaborative processes—</text><subparagraph id="idedbc6833-ba9f-4c60-b908-636167dbf3d4"><enum>(A)</enum><text>to ensure equitable
				inclusion of affected interests;</text></subparagraph><subparagraph id="id40508741-704b-4099-8846-975b065654ca"><enum>(B)</enum><text>to engage with members of
				the management conference, including through—</text><clause id="idbbe5c34e-f647-4606-add6-3f0b303dc9c5"><enum>(i)</enum><text>the use of
				consensus-based decision rules; and</text></clause><clause id="id62df5f39-2766-4f70-9f51-ba9e655bd838"><enum>(ii)</enum><text>assistance from
				impartial facilitators, as appropriate;</text></clause></subparagraph><subparagraph id="id7ca19139-0f85-4650-9d78-a047cdbd4c42"><enum>(C)</enum><text>to ensure relevant
				information, including scientific, technical, and cultural
			 information, is
				accessible to members;</text></subparagraph><subparagraph id="id89c742b8-6788-47bb-b9db-5f183baf5ab8"><enum>(D)</enum><text>to promote accountability
				and transparency by ensuring members are informed in a timely
			 manner of—</text><clause id="idb851b3d7-c43c-4388-b9f2-07431427280a"><enum>(i)</enum><text>the purposes and
				objectives of the management conference; and</text></clause><clause id="id84cafca7-644a-4ff4-917a-508e1069c5b4"><enum>(ii)</enum><text>the results of an
				evaluation conducted under subsection (f)(6);</text></clause></subparagraph><subparagraph id="id73b2271f-a2e3-4a71-ab10-bc1d93df4046"><enum>(E)</enum><text>to identify the roles and
				responsibilities of members—</text><clause id="id2f690399-d8ec-4d83-884b-3208c72cab97"><enum>(i)</enum><text>in the management
				conference proceedings; and</text></clause><clause id="idf0624c49-69b9-458c-ae28-ac4abb74f80a"><enum>(ii)</enum><text>in the implementation of
				the plan; and</text></clause></subparagraph><subparagraph id="ida8a3b0f2-babd-4c46-9fc2-b61158ce9042"><enum>(F)</enum><text>to seek resolution of
				conflicts or disputes as
				necessary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="ida66eae45-2396-4d19-a95e-d04db4f31b53"><enum>(c)</enum><header>Administration of
			 Plans</header><text>Section 320 of the Federal Water Pollution Control Act (33
			 U.S.C. 1330) is amended by striking subsection (f) and inserting the
			 following:</text><quoted-block changed="deleted" committee-id="SSEV00" display-inline="no-display-inline" id="id4c160cae-6224-40f0-8a9f-4b5e280b3098" reported-display-style="strikethrough" style="OLC"><subsection id="id3209e4c8-471c-4519-ba43-6b1ddf576213"><enum>(f)</enum><header>Administration of
				Plans</header><paragraph id="id3b5a70d6-dcce-41f3-a8ed-d225a111a565"><enum>(1)</enum><header>Approval</header><text>Not
				later than 120 days after the date on which a management conference
			 submits to
				the Administrator a comprehensive conservation and management plan
			 under this
				section, and after providing for public review and comment, the
			 Administrator
				shall approve the plan, if—</text><subparagraph id="idef9ed187-0080-475e-8552-7243b11beaa9"><enum>(A)</enum><text>the Administrator
				determines that the plan meets the requirements of this section;
			 and</text></subparagraph><subparagraph id="id68ef4a11-a7b9-49b0-956d-bbee61baffdd"><enum>(B)</enum><text>each affected Governor
				concurs.</text></subparagraph></paragraph><paragraph id="id6bd09aff-cf80-4de9-8fa4-bf593fdd4970"><enum>(2)</enum><header>Completeness</header><subparagraph id="id5df815a0-7cbc-4dd4-ba38-2ad60e4ad793"><enum>(A)</enum><header>In
				general</header><text>If the Administrator determines that a plan is incomplete
				under paragraph (1) or (7), the Administrator shall—</text><clause id="idbdd9b12e-0298-4470-a76f-90c35bab115a"><enum>(i)</enum><text>provide the management
				conference with written notification of the basis of that finding;
			 and</text></clause><clause id="id2f569900-eb31-4803-94c3-e9b3d285f5b5"><enum>(ii)</enum><text>allow the management
				conference to resubmit a revised plan that addresses, to the
			 maximum extent
				practicable, the comments contained in the written notification of
			 the
				Administrator described in clause (i).</text></clause></subparagraph><subparagraph id="id84838e0c-edf5-4dd1-8d3a-f0d0eac5273b"><enum>(B)</enum><header>Resubmission</header><text>If
				the Administrator determines that a revised plan submitted under
			 subparagraph
				(A)(ii) remains incomplete under paragraph (1) or (7), the
			 Administrator shall
				allow the management conference to resubmit a revised plan in
			 accordance with
				subparagraph (A).</text></subparagraph><subparagraph id="id604f05c9-0598-452b-939c-7fddab3d9066"><enum>(C)</enum><header>Scope of
				review</header><text>In determining whether to approve a comprehensive
				conservation and management plan under paragraph (1) or (7), the
				Administrator—</text><clause id="id61511e68-3cfd-484a-9f92-5abb10704c65"><enum>(i)</enum><text>shall limit the scope of
				review to a determination of whether the plan meets the minimum
			 requirements of
				this section; and</text></clause><clause id="idaba44435-24bf-40ec-8f05-c499f9dee187"><enum>(ii)</enum><text>may not impose, as a
				condition of approval, any additional requirements.</text></clause></subparagraph></paragraph><paragraph id="idb1333b23-2aa6-4ac6-bcd9-c3c29859bcff"><enum>(3)</enum><header>Failure of the
				Administrator to respond</header><text>If, by the date that is 120 days after
				the date on which a plan is submitted or resubmitted under
			 paragraph (1), (2),
				or (7) the Administrator fails to respond to the submission or
			 resubmission in
				writing, the plan shall be considered approved.</text></paragraph><paragraph id="id65aab724-8f2b-4dfa-8ae7-a8480aa21021"><enum>(4)</enum><header>Failure to submit a
				plan</header><text>If, by the date that is 3 years after the date on which a
				management conference is convened, that management conference fails
			 to submit a
				comprehensive conservation and management plan or to secure
			 approval for the
				comprehensive conservation and management plan under this
			 subsection, the
				Administrator shall terminate the management conference convened
			 under this
				section.</text></paragraph><paragraph id="idfee220db-2d15-4e47-9aea-408fa60c6a67"><enum>(5)</enum><header>Implementation</header><subparagraph id="idb4bca3a9-2948-408e-a4ef-226011cbd02a"><enum>(A)</enum><header>In
				general</header><text>On the approval of a comprehensive conservation and
				management plan under this section, the plan shall be implemented.</text></subparagraph><subparagraph id="id387bd4ad-7136-42d2-801d-1a396df4bfa9"><enum>(B)</enum><header>Use of authorized
				amounts</header><text>Amounts authorized to be appropriated under titles II and
				VI and section 319 may be used in accordance with the applicable
			 requirements
				of this Act to assist States with the implementation of a plan
			 approved under
				paragraph (1).</text></subparagraph></paragraph><paragraph id="ide8056528-6e71-47af-a124-e39944ab1f31"><enum>(6)</enum><header>Evaluation</header><subparagraph id="idade2e022-795f-4973-8d85-2597dbc1d8fa"><enum>(A)</enum><header>In
				general</header><text>Not later than 5 years after the date of enactment of
				this paragraph, and every 5 years thereafter, the Administrator
			 shall carry out
				an evaluation of the implementation of each comprehensive
			 conservation and
				management plan developed under this section to determine the
			 degree to which
				the goals of the plan have been met.</text></subparagraph><subparagraph id="id0c50dea4-ffa9-466f-97d7-e8433c08d787"><enum>(B)</enum><header>Review and comment by
				management conference</header><text>In completing an evaluation under
				subparagraph (A), the Administrator shall submit the results of the
			 evaluation
				to the appropriate management conference for review and comment.</text></subparagraph><subparagraph id="iddef1a6e8-4a0b-4f87-a4c6-df15d2a9430d"><enum>(C)</enum><header>Report</header><clause id="id493f8949-bf10-4138-8270-600bd0f04dde"><enum>(i)</enum><header>In
				general</header><text>In completing an evaluation under subparagraph (A), and
				after providing an opportunity for a management conference to
			 submit comments
				under subparagraph (B), the Administrator shall issue a report on
			 the results
				of the evaluation, including the findings and recommendations of
			 the
				Administrator and any comments received from the management
			 conference.</text></clause><clause id="idcca3b75a-e7aa-4ba1-a123-43ca85f1277d"><enum>(ii)</enum><header>Availability to
				public</header><text>The Administrator shall make a report issued under this
				subparagraph available to the public, including through publication
			 in the
				Federal Register and on the Internet.</text></clause></subparagraph><subparagraph id="id939ac6e0-c31e-48d9-a17d-95e5a0bacf83"><enum>(D)</enum><header>Special rule for new
				plans</header><text>Notwithstanding subparagraph (A), if a management
				conference submits a new comprehensive conservation and management
			 plan to the
				Administrator after the date of enactment of this paragraph, the
			 Administrator
				shall complete the evaluation of the implementation of the plan
			 required by
				subparagraph (A) not later than 5 years after the date of such
			 submission and
				every 5 years thereafter.</text></subparagraph></paragraph><paragraph id="id0e0f6d9a-60f0-4bc8-b827-9cd0b144baf4"><enum>(7)</enum><header>Updates</header><subparagraph id="id48201328-b31a-4ce0-b104-a4f3787bcb0e"><enum>(A)</enum><header>Requirement</header><text>Not
				later than 18 months after the date on which the Administrator
			 makes an
				evaluation of the implementation of a comprehensive conservation
			 and management
				plan available to the public under paragraph (6)(C), a management
			 conference
				convened under this section shall submit to the Administrator an
			 update of the
				plan that reflects, to the maximum extent practicable, the results
			 of the
				program evaluation.</text></subparagraph><subparagraph id="id033a11b1-4515-4090-a266-abb4bf956e5d"><enum>(B)</enum><header>Approval of
				updates</header><text>Not later than 120 days after the date on which a
				management conference submits to the Administrator an updated
			 comprehensive
				conservation and management plan under subparagraph (A), and after
			 providing
				for public review and comment, the Administrator shall approve the
			 updated
				plan, if the Administrator determines that the updated plan meets
			 the
				requirements of this section.</text></subparagraph></paragraph><paragraph id="ideb793746-cbb6-40c9-8f1c-bb8e3a2ccb23"><enum>(8)</enum><header>Probationary
				status</header><text>The Administrator may consider a management conference
				convened under this section to be in probationary status, if the
			 management
				conference has not received approval for an updated comprehensive
			 conservation
				and management plan under paragraph (7)(B) on or before the last
			 day of the
				5-year period beginning on the date on which the Administrator
			 makes an
				evaluation of the plan available to the public under paragraph

				comprehensive conservation and management plan by the
			 Administrator, any
				Federal action or activity affecting the estuary shall be
			 conducted, to the
				maximum extent practicable, in a manner consistent with the plan.</text></paragraph><paragraph id="idfd53b609-bc69-498b-bbe1-26c4ecd6d29f"><enum>(2)</enum><header>Coordination and
				cooperation</header><subparagraph id="idac203b32-b5cc-475b-a572-875d312fdc2c"><enum>(A)</enum><header>In
				general</header><text>The Secretary of the Army (acting through the Chief of
				Engineers), the Administrator of the National Oceanic and
			 Atmospheric
				Administration, the Director of the United States Fish and Wildlife
			 Service,
				the Secretary of the Department of Agriculture, the Director of the
			 United
				States Geological Survey, the Secretary of the Department of
			 Transportation,
				the Secretary of the Department of Housing and Urban Development,
			 and the heads
				of other appropriate Federal agencies, as determined by the
			 Administrator,
				shall, to the maximum extent practicable, cooperate and coordinate
			 activities,
				including monitoring activities, related to the implementation of a
				comprehensive conservation and management plan approved by the
				Administrator.</text></subparagraph><subparagraph id="idfabe1e6c-8d77-4399-acfa-5f135e845ac4"><enum>(B)</enum><header>Lead coordinating
				agency</header><text>The Environmental Protection Agency shall serve as the
				lead coordinating agency under this paragraph.</text></subparagraph></paragraph><paragraph id="idb6d994f0-e09e-4244-b00d-f99087fb1739"><enum>(3)</enum><header>Consideration of plans
				in agency budget requests</header><text>In making an annual budget request for
				a Federal agency referred to in paragraph (2), the head of such
			 agency shall
				consider the responsibilities of the agency under this section,
			 including under
				comprehensive conservation and management plans approved by the
				Administrator.</text></paragraph><paragraph id="id7abd9a20-71b2-40cd-ae17-ed4bff957bc9"><enum>(4)</enum><header>Monitoring</header><text>The
				heads of the Federal agencies referred to in paragraph (2) shall
			 collaborate on
				the development of tools and methodologies for monitoring the
			 ecological health
				and water quality conditions of estuaries covered by a management
			 conference
				convened under this
				section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id75258de2-b3eb-4375-bb33-42c69db20543"><enum>(e)</enum><header>Grants</header><paragraph id="id976921a4-ed00-40d5-834c-0663945b81e9"><enum>(1)</enum><header>In
			 general</header><text>Subsection (h) (as redesignated by subsection (d)) of
			 section 320 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>) is
			 amended—</text><subparagraph id="id4561d0d1-d0f7-48fc-8f66-01dd933cc366"><enum>(A)</enum><text>in paragraph (1), by
			 striking <quote>other public</quote> and all that follows before the period at
			 the end and inserting <quote>and other public or nonprofit private agencies,

				determined by the Administrator, grants for the implementation of a
				comprehensive conservation and management plan developed by a
			 management
				conference convened under this section, if the Administrator
			 determines that
				the management conference is in probationary status under
			 subsection
				(f)(8).</text></subparagraph><subparagraph id="id364d7182-0343-4eae-8a6f-6d1a347acdb0"><enum>(B)</enum><header>Termination of
				management conferences</header><text>The Administrator shall terminate a
				management conference convened under this section, and cease
			 funding for the
				implementation of the comprehensive conservation and management
			 plan developed
				by the management conference, if the Administrator determines that
			 the
				management conference has been in probationary status for 2
			 consecutive
				years.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ide9046d09-adc5-4e38-a9b3-ee2949ded92d"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 320(i) the Federal Water Pollution Control Act
			 (as redesignated by subsection (d)) is amended by striking <quote>subsection
			 (g)</quote> and inserting <quote>subsection (h)</quote>.</text></paragraph></subsection><subsection id="id58bd7692-4bc3-4bfb-9beb-9b0c89dea8cc"><enum>(f)</enum><header>Authorization of

				percent of the amount appropriated under this subsection;</text></subparagraph><subparagraph id="id730fd5b4-8863-487f-b971-475c2b85f12c"><enum>(B)</enum><text>making grants under
				subsection (h); and</text></subparagraph><subparagraph id="id9db6fc37-19f2-484a-9b8e-2bca59b62581"><enum>(C)</enum><text>monitoring the
				implementation of a conservation and management plan by the
			 management
				conference, or by the Administrator in any case in which the
			 conference has
				been terminated.</text></subparagraph></paragraph><paragraph id="id8a327f7d-dba4-45e6-be09-20158749891c"><enum>(2)</enum><header>Allocations</header><text>The
				Administrator shall provide at least 80 percent of the amounts
			 appropriated
				under this subsection per fiscal year for the development,
			 implementation, and
				monitoring of each conservation and management plan eligible for
			 grant
				assistance under subsection (h).</text></paragraph><paragraph id="idDE1565EFAAD449A08504427DA6590EE1"><enum>(3)</enum><header>Requirement</header><text>The
				Administrator shall include in the annual budget request of the
			 Environmental
				Protection Agency a clear description of the amounts requested by
			 the
				Administrator to make grants under paragraph
				(1)(B).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id25f2396e-6c20-43b7-a237-99fa6f495043"><enum>(g)</enum><header>Research</header><text>Section
			 320(k)(1)(A) of the Federal Water Pollution Control Act (as redesignated
			 by
			 subsection (d)) is amended—</text><paragraph id="idf079ddd9-95e8-4397-a42f-c0983a91d3ae"><enum>(1)</enum><text>by striking
			 <quote>paramenters</quote> and inserting <quote>parameters</quote>; and</text></paragraph><paragraph id="idebe60f32-d612-4b17-996a-67128de0abc4"><enum>(2)</enum><text>by inserting
			 <quote>(including monitoring of both pathways and ecosystems to track the
			 introduction and establishment of nonnative species)</quote> before <quote>, to
			 provide the Administrator</quote>.</text></paragraph></subsection><subsection id="id89f8e1f6-ae73-4cfb-bf1b-0468a4e8bb7a"><enum>(h)</enum><header>National Estuary
			 Program Evaluation</header><text>Section 320 of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>) is amended by inserting after subsection (k)
			 (as
			 redesignated by subsection (d)) the following:</text><quoted-block changed="deleted" committee-id="SSEV00" display-inline="no-display-inline" id="id9a0f2a79-991b-4be4-af65-a1007cc77f36" reported-display-style="strikethrough" style="OLC"><subsection id="ida56261f7-51ab-4838-9305-aaf8efe830f5"><enum>(l)</enum><header>National Estuary
				Program Evaluation</header><paragraph id="id81f169a2-a02f-4d3b-b172-75de1d0ab19a"><enum>(1)</enum><header>In
				general</header><text>Not later than 5 years after the date of enactment of
				this paragraph, and every 5 years thereafter, the Administrator
			 shall complete
				an evaluation of the national estuary program established under
			 this
				section.</text></paragraph><paragraph id="id817ba9f7-8086-4b7c-bcf7-5852f0fbd14f"><enum>(2)</enum><header>Specific
				assessments</header><text>In conducting an evaluation under this subsection,
				the Administrator shall—</text><subparagraph id="ida157f6de-e92f-43b5-a559-7ed425b0f0bc"><enum>(A)</enum><text>assess the effectiveness
				of the national estuary program in improving water quality, natural
			 resources,
				and sustainable uses of the estuaries covered by management
			 conferences
				convened under this section;</text></subparagraph><subparagraph id="id3c575914-089e-4ecd-a2b5-23504fa02af8"><enum>(B)</enum><text>identify best practices
				for improving water quality, natural resources, and sustainable
			 uses of the
				estuaries covered by management conferences convened under this
			 section,
				including those practices funded through the use of technical
			 assistance from
				the Environmental Protection Agency and other Federal agencies;</text></subparagraph><subparagraph id="idffecb36e-40f5-4bd5-ac64-959511a22b6d"><enum>(C)</enum><text>assess the reasons why
				the best practices described in subparagraph (B) resulted in the
			 achievement of
				program goals;</text></subparagraph><subparagraph id="idbde26a67-4178-44a7-a9a5-e3e40ec39ac6"><enum>(D)</enum><text>identify any redundant
				requirements for reporting by recipients of a grant under this
			 section;
				and</text></subparagraph><subparagraph id="id6eefb240-e0d4-4a07-9691-9e9ba2981076"><enum>(E)</enum><text>develop and recommend a
				plan for eliminating any redundancies.</text></subparagraph></paragraph><paragraph id="id42b14f8a-262c-4290-8e2e-dddea0eaeb11"><enum>(3)</enum><header>Report</header><text>In
				completing an evaluation under this subsection, the Administrator
			 shall issue a
				report on the results of the evaluation, including the findings and
				recommendations of the Administrator.</text></paragraph><paragraph id="id226204e5-8624-4ad7-9711-c969cf9ccc74"><enum>(4)</enum><header>Availability</header><text>The
				Administrator shall make a report issued under this subsection
			 available to
				management conferences convened under this section and the public,
			 including
				through publication in the Federal Register and on the
				Internet.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id5387b087-4631-410d-9927-3b5dfb112685"><enum>(i)</enum><header>Convening of
			 conference</header><text>Section 320(a)(2) of the Federal Water Pollution

			 Conference</header><paragraph id="idbd443fa9-4281-4f4c-9918-334a93cb3f07"><enum>(1)</enum><header>Development of
			 comprehensive conservation and management plans</header><text>Section 320(b) of
			 the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(b)</external-xref>) is amended by
			 striking paragraph (4) and inserting the following:</text><quoted-block changed="added" committee-id="SSEV00" display-inline="no-display-inline" id="idc82d2a18-0bda-4961-8a0a-40a73453757f" reported-display-style="italic" style="OLC"><paragraph id="id4c7be330-9079-481a-92ef-75ac84d3c699"><enum>(4)</enum><text>develop and submit to the
				Administrator a comprehensive conservation and management plan
			 that—</text><subparagraph id="idf2987151-7701-4690-ad6f-409129182c06"><enum>(A)</enum><text>identifies the estuary
				and estuary resources to be considered
			 within the plan;</text></subparagraph><subparagraph id="id9366659a-27d8-4b7e-b19c-fe09661e6a07"><enum>(B)</enum><text>recommends priority
				protection, conservation, and corrective actions and compliance
			 schedules that
				address point and nonpoint sources of pollution—</text><clause id="idced6f200-6c3e-4f73-9ab5-6c63dab83eca"><enum>(i)</enum><text>to restore and maintain
				the chemical, physical, and biological integrity of the estuary,
				including—</text><subclause id="id467819cf-3466-4dc0-bef7-f1d0db7350bf"><enum>(I)</enum><text>restoration and
				maintenance of water quality, including wetlands and natural
			 hydrological
				flows;</text></subclause><subclause id="ide12b0b60-5698-410f-aeda-b0688f08ac39"><enum>(II)</enum><text>a resilient and diverse
				indigenous population of shellfish, fish, and wildlife; and</text></subclause><subclause id="id3ba7c9be-8ae9-4d81-b914-5fdfe1c433ad"><enum>(III)</enum><text>recreational activities
				in the estuary; and</text></subclause></clause><clause id="idb72da03f-a59c-4e88-84b8-5d6643e1da80"><enum>(ii)</enum><text>to ensure that the
				designated uses of the estuary are protected;</text></clause></subparagraph><subparagraph id="id9e680520-44bc-4798-a03a-6ae184e8a6a6"><enum>(C)</enum><text>identifies healthy
				and impaired watershed components by carrying out integrated
			 assessments that include
				assessments of—</text><clause id="ide24d404c-3b9e-4adb-a377-2d977bf0ef46"><enum>(i)</enum><text>aquatic habitat and
				biological integrity;</text></clause><clause id="id83914595-bafb-46cb-b546-5a5563810e3e"><enum>(ii)</enum><text>water quality;
				and</text></clause><clause id="idb99df0c0-a28a-49ce-862d-ec41ecb94bc8"><enum>(iii)</enum><text>natural hydrological
				flows;</text></clause></subparagraph><subparagraph id="idce982de8-556b-41c5-8f97-9a021a329447"><enum>(D)</enum><text>considers current and
				future sustainable commercial activities in the estuary;</text></subparagraph><subparagraph id="id0d7c0acb-9cde-4fc7-917f-b3f8ae5a79c1"><enum>(E)</enum><text>considers the effects of ongoing climate, hydrologic, and geologic changes on the estuary,
			 including—</text><clause id="id716c38ed-dfa9-4801-a1ac-179e1fc39de9"><enum>(i)</enum><text>the identification and
				assessment of vulnerabilities in the estuary;</text></clause><clause id="id6877917a-701e-4ff5-aaeb-3bfc5b1820f6"><enum>(ii)</enum><text>the development and
				implementation of adaptation strategies; and</text></clause><clause id="id6acb6734-a8e3-4eeb-bfea-b663e766e454"><enum>(iii)</enum><text>the potential impacts
				of changes in sea level or coastal erosion on estuarine water
			 quality, estuarine
			 habitat, and
				infrastructure located in the estuary;</text></clause></subparagraph><subparagraph id="id5689513e-cb0f-4bec-b0c6-c1af243367f1"><enum>(F)</enum><text>increases public
				education and awareness with respect to—</text><clause id="idda9a3bc3-bbd2-424c-8c05-53c55d168798"><enum>(i)</enum><text>the ecological health of
				the estuary;</text></clause><clause id="id08816ed8-0a78-40aa-9df4-d421fdf99f50"><enum>(ii)</enum><text>the water quality
				conditions of the estuary; and</text></clause><clause id="idd05ad88e-a235-4273-bc18-6324d16610db"><enum>(iii)</enum><text>ocean, estuarine, land,
				and atmospheric connections and interactions;</text></clause></subparagraph><subparagraph id="id52b7b324-d55e-498e-8585-d66330daaad7"><enum>(G)</enum><text>includes performance
				measures and goals to track implementation of the plan; and</text></subparagraph><subparagraph id="idfcb1c7ad-9959-4631-88dc-c00c123f0ebc"><enum>(H)</enum><text>includes a coordinated
				monitoring strategy for Federal, State, and local governments and
			 other
				entities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id98f5ba5f-17b9-45de-878f-4d75848a4546"><enum>(2)</enum><header>Monitoring and making
			 results available</header><text>Section 320(b) of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(b)</external-xref>) is amended by striking paragraph (6) and

				developed for the estuary under this
				subsection;</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="ide28e3276-2b8d-4166-9e36-65d567b38e80"><enum>(3)</enum><header>Information and
			 educational activities</header><text>Section 320(b) of the Federal Water
			 Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330(b)</external-xref>) is amended—</text><subparagraph id="ide9dad780-0e2a-4925-b472-a5e3b7e30932"><enum>(A)</enum><text>by redesignating
			 paragraph (7) as paragraph (8); and</text></subparagraph><subparagraph id="id62e079e3-1733-4d9d-b62f-abeb320cee02"><enum>(B)</enum><text>by inserting after

				the management conference, including through—</text><clause id="id54f1a08a-f6fc-4910-a691-645399336c43"><enum>(i)</enum><text>the use of
				consensus-based decision rules; and</text></clause><clause id="id1784889d-99b2-4db5-ad46-681b782bb96c"><enum>(ii)</enum><text>assistance from
				impartial facilitators, as appropriate;</text></clause></subparagraph><subparagraph id="id3061780a-8e00-4bec-b950-85d2317be9bf"><enum>(C)</enum><text>to ensure relevant
				scientific, technical, and economic
			 information is
				accessible to members;</text></subparagraph><subparagraph id="id29754ac3-6d48-4686-a6b9-06f2280eb613"><enum>(D)</enum><text>to promote accountability
				and transparency by ensuring members are informed in a timely
			 manner of—</text><clause id="ide539af03-d027-4cb0-b5ef-b22bb654d58e"><enum>(i)</enum><text>the purposes and
				objectives of the management conference; and</text></clause><clause id="id058ed632-d5fc-4f1e-8e5c-a5f4f4ce3b2d"><enum>(ii)</enum><text>the results of an
				evaluation conducted under subsection (f)(6);</text></clause></subparagraph><subparagraph id="idbde66229-83a6-4cb2-83a3-69a801ce94e1"><enum>(E)</enum><text>to identify the roles and
				responsibilities of members—</text><clause id="id51588576-a67e-4474-9e6a-22aafada055f"><enum>(i)</enum><text>in the management
				conference proceedings; and</text></clause><clause id="id9ec3770b-26d7-49ea-b432-801ef7c905c6"><enum>(ii)</enum><text>in the implementation of
				the plan; and</text></clause></subparagraph><subparagraph id="idb11c0be7-da2b-44bc-b641-8c0f0a971b60"><enum>(F)</enum><text>to seek resolution of
				conflicts or disputes as
				necessary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id37f016dc-8aa4-41d4-bb70-99b63dc94d7e"><enum>(c)</enum><header>Administration of
			 Plans</header><text>Section 320 of the Federal Water Pollution Control Act (33
			 U.S.C. 1330) is amended by striking subsection (f) and inserting the
			 following:</text><quoted-block changed="added" committee-id="SSEV00" display-inline="no-display-inline" id="ide9d9da38-1c4d-4159-a06b-f542a6173bb7" reported-display-style="italic" style="OLC"><subsection id="id21b21b9a-6e3f-4fe4-9b0a-2041d3afd737"><enum>(f)</enum><header>Administration of
				Plans</header><paragraph id="id96f78cd0-8a1b-4e12-a088-170417abe3e9"><enum>(1)</enum><header>Approval</header><text>Not
				later than 120 days after the date on which a management conference
			 submits to
				the Administrator a comprehensive conservation and management plan
			 under this
				section, and after providing for public review and comment, the
			 Administrator
				shall approve the plan, if—</text><subparagraph id="id3ee9dc25-54f0-4242-9a66-0207560b6ef0"><enum>(A)</enum><text>the Administrator
				determines that the plan meets the requirements of this section;
			 and</text></subparagraph><subparagraph id="id1e5dbf1a-ebd9-478c-afc8-396c64ea4073"><enum>(B)</enum><text>each affected Governor
				concurs.</text></subparagraph></paragraph><paragraph id="id652685e2-f32b-4cc1-8346-03def8cf85f6"><enum>(2)</enum><header>Completeness</header><subparagraph id="id53b300f6-8e11-45b6-9b22-9cd04c57bb99"><enum>(A)</enum><header>In
				general</header><text>If the Administrator determines that a plan is incomplete
				under paragraph (1) or (7), the Administrator shall—</text><clause id="id086c8eb4-928a-4740-8a62-e469d287a158"><enum>(i)</enum><text>provide the management
				conference with written notification of the basis of that finding;
			 and</text></clause><clause id="idf359532f-2333-4556-a353-58a157ed0080"><enum>(ii)</enum><text>allow the management
				conference to resubmit a revised plan that addresses, to the
			 maximum extent
				practicable, the comments contained in the written notification of
			 the
				Administrator described in clause (i).</text></clause></subparagraph><subparagraph id="id73990080-a036-4e28-8846-9a2406a56dfc"><enum>(B)</enum><header>Resubmission</header><text>If
				the Administrator determines that a revised plan submitted under
			 subparagraph
				(A)(ii) remains incomplete under paragraph (1) or (7), the
			 Administrator shall
				allow the management conference to resubmit a revised plan in
			 accordance with
				subparagraph (A).</text></subparagraph><subparagraph id="id8234441f-a430-41b4-a53e-c51cb0caba23"><enum>(C)</enum><header>Scope of
				review</header><text>In determining whether to approve a comprehensive
				conservation and management plan under paragraph (1) or (7), the
				Administrator—</text><clause id="id73cc47ee-d29e-4ab0-aa46-e08b3339410e"><enum>(i)</enum><text>shall limit the scope of
				review to a determination of whether the plan meets the minimum
			 requirements of
				this section; and</text></clause><clause id="id7b57f31c-e352-48d2-b187-f499aabefd57"><enum>(ii)</enum><text>may not impose, as a
				condition of approval, any additional requirements.</text></clause></subparagraph></paragraph><paragraph id="idfc865fa5-519d-4054-aea8-1b317909dd7c"><enum>(3)</enum><header>Failure of the
				Administrator to respond</header><text>If, by the date that is 120 days after
				the date on which a plan is submitted or resubmitted under
			 paragraph (1), (2),
				or (7) the Administrator fails to respond to the submission or
			 resubmission in
				writing, the plan shall be considered approved.</text></paragraph><paragraph id="ide9644982-024e-4420-9658-63bf8f2d43de"><enum>(4)</enum><header>Failure to submit a
				plan</header><text>If, by the date that is 3 years after the date on which a
				management conference is convened, that management conference fails
			 to submit a
				comprehensive conservation and management plan or to secure
			 approval for the
				comprehensive conservation and management plan under this
			 subsection, the
				Administrator shall terminate the management conference convened
			 under this
				section.</text></paragraph><paragraph id="id13a48fdc-04ba-4b69-b45a-706bcc57f5e3"><enum>(5)</enum><header>Implementation</header><subparagraph id="idffb68533-4c2a-48ca-a5e8-b5062e401337"><enum>(A)</enum><header>In
				general</header><text>On the approval of a comprehensive conservation and
				management plan under this section, the plan shall be implemented.</text></subparagraph><subparagraph id="id2300dbab-be68-48da-a5e7-a2e3826c2d9f"><enum>(B)</enum><header>Use of authorized
				amounts</header><text>Amounts authorized to be appropriated under titles II and
				VI and section 319 may be used in accordance with the applicable
			 requirements
				of this Act to assist States with the implementation of a plan
			 approved under
				paragraph (1).</text></subparagraph></paragraph><paragraph id="id15e57911-0317-436c-9697-6923fc6f8d30"><enum>(6)</enum><header>Evaluation</header><subparagraph id="ida1b4d27f-e872-4def-aead-22d657d5c59a"><enum>(A)</enum><header>In
				general</header><text>Not later than 5 years after the date of enactment of
				this paragraph, and every 5 years thereafter, the Administrator
			 shall carry out
				an evaluation of the implementation of each comprehensive
			 conservation and
				management plan developed under this section to determine the
			 degree to which
				the goals of the plan have been met.</text></subparagraph><subparagraph id="id204ecb81-a1b5-4485-87ec-3c381b9ad62c"><enum>(B)</enum><header>Review and comment by
				management conference</header><text>In completing an evaluation under
				subparagraph (A), the Administrator shall submit the results of the
			 evaluation
				to the appropriate management conference for review and comment.</text></subparagraph><subparagraph id="id7c3d20f1-c7a2-47cf-a8fd-099974b8ea29"><enum>(C)</enum><header>Report</header><clause id="ida8c96abe-7ec7-45d8-964b-d405e9e09fda"><enum>(i)</enum><header>In
				general</header><text>In completing an evaluation under subparagraph (A), and
				after providing an opportunity for a management conference to
			 submit comments
				under subparagraph (B), the Administrator shall issue a report on
			 the results
				of the evaluation, including the findings and recommendations of
			 the
				Administrator and any comments received from the management
			 conference.</text></clause><clause id="id552ff2ab-1500-4aac-a3e5-b8e11d271896"><enum>(ii)</enum><header>Availability to
				public</header><text>The Administrator shall make a report issued under this
				subparagraph available to the public, including through publication
			 in the
				Federal Register and on the Internet.</text></clause></subparagraph><subparagraph id="id5a00b6b6-3092-4f75-b146-eb4aa383a6bd"><enum>(D)</enum><header>Special rule for new
				plans</header><text>Notwithstanding subparagraph (A), if a management
				conference submits a new comprehensive conservation and management
			 plan to the
				Administrator after the date of enactment of this paragraph, the
			 Administrator
				shall complete the evaluation of the implementation of the plan
			 required by
				subparagraph (A) not later than 5 years after the date of such
			 submission and
				every 5 years thereafter.</text></subparagraph></paragraph><paragraph id="id32b0c7f8-1c2d-4bfb-9736-4f5089beacb6"><enum>(7)</enum><header>Updates</header><subparagraph id="ide604f34c-1bc4-4e04-bcd8-a7a981e19aa8"><enum>(A)</enum><header>Requirement</header><text>Not
				later than 18 months after the date on which the Administrator
			 makes an
				evaluation of the implementation of a comprehensive conservation
			 and management
				plan available to the public under paragraph (6)(C), a management
			 conference
				convened under this section shall submit to the Administrator an
			 update of the
				plan that reflects, to the maximum extent practicable, the results
			 of the
				program evaluation.</text></subparagraph><subparagraph id="id66908150-0347-4069-943b-36fdab6ed85e"><enum>(B)</enum><header>Approval of
				updates</header><text>Not later than 120 days after the date on which a
				management conference submits to the Administrator an updated
			 comprehensive
				conservation and management plan under subparagraph (A), and after
			 providing
				for public review and comment, the Administrator shall approve the
			 updated
				plan, if the Administrator determines that the updated plan meets
			 the
				requirements of this section.</text></subparagraph></paragraph><paragraph id="idd35ff95f-fcb8-4810-94dd-50e3ba560bf0"><enum>(8)</enum><header>Probationary
				status</header><text>The Administrator may consider a management conference
				convened under this section to be in probationary status, if the
			 management
				conference has not received approval for an updated comprehensive
			 conservation
				and management plan under paragraph (7)(B) on or before the last
			 day of the
				5-year period beginning on the date on which the Administrator
			 makes an
				evaluation of the plan available to the public under paragraph
				(6)(C).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id686cee5a-16cb-4282-8e37-cda719cc7c52"><enum>(d)</enum><header>Federal
			 Agencies</header><text>Section 320 of the Federal Water Pollution Control Act
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>) is amended—</text><paragraph id="id51db5fe4-0fdc-45e8-a6e2-373a7402c6f9"><enum>(1)</enum><text>by redesignating
			 subsections (g), (h), (i), (j), and (k) as subsections (h), (i), (j), (k),
			 and
			 (m), respectively; and</text></paragraph><paragraph id="id85f9e262-e010-419d-ab90-975a23c0774f"><enum>(2)</enum><text>by inserting after

				cooperation</header><subparagraph id="id22dedb22-f450-4a0a-92ef-9f940365b8e8"><enum>(A)</enum><header>In
				general</header><text>The Secretary of the Army (acting through the Chief of
				Engineers), the Administrator of the National Oceanic and
			 Atmospheric
				Administration, the Director of the United States Fish and Wildlife
			 Service,
				the Secretary of the Department of Agriculture, the Director of the
			 United
				States Geological Survey, the Secretary of the Department of
			 Transportation,
				the Secretary of the Department of Housing and Urban Development,
			 and the heads
				of other appropriate Federal agencies, as determined by the
			 Administrator,
				shall, to the maximum extent practicable, cooperate and coordinate
			 activities,
				including monitoring activities, related to the implementation of a
				comprehensive conservation and management plan approved by the
				Administrator.</text></subparagraph><subparagraph id="idd9564bc9-f285-4663-8f3f-c943e18ee61d"><enum>(B)</enum><header>Lead coordinating
				agency</header><text>The Environmental Protection Agency shall serve as the
				lead coordinating agency under this paragraph.</text></subparagraph></paragraph><paragraph id="idde8c3ce3-d597-4bec-ad93-9d4884ec5fae"><enum>(2)</enum><header>Consideration of plans
				in agency budget requests</header><text>In making an annual budget request for
				a Federal agency referred to in paragraph (1), the head of such
			 agency shall
				consider the responsibilities of the agency under this section,
			 including under
				comprehensive conservation and management plans approved by the
				Administrator.</text></paragraph><paragraph id="idd7dbb5d3-64f6-4b57-aaef-7b6cae798aab"><enum>(3)</enum><header>Monitoring</header><text>The
				heads of the Federal agencies referred to in paragraph (1) shall
			 collaborate on
				the development of tools and methodologies for monitoring the
			 ecological health
				and water quality conditions of estuaries covered by a management
			 conference
				convened under this
				section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idda6d9dfc-dff3-4043-be67-87439d87e9b8"><enum>(e)</enum><header>Grants</header><paragraph id="id30338cc8-af54-4d59-b786-9f063f0434a0"><enum>(1)</enum><header>In
			 general</header><text>Subsection (h) (as redesignated by subsection (d)) of
			 section 320 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>) is
			 amended by adding at the end the

				conference convened under this section, if the Administrator
			 determines that
				the management conference is in probationary status under
			 subsection
				(f)(8).</text></subparagraph><subparagraph id="id1d3405cf-a0e0-46f6-aae3-63fd6d5a8ff4"><enum>(B)</enum><header>Termination of
				management conferences</header><text>The Administrator shall terminate a
				management conference convened under this section, and cease
			 funding for the
				implementation of the comprehensive conservation and management
			 plan developed
				by the management conference, if the Administrator determines that
			 the
				management conference has been in probationary status for 2
			 consecutive
				years.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idac765b92-6d9c-4707-96d9-f9d2d7b6ba9f"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 320(i) the Federal Water Pollution Control Act
			 (as redesignated by subsection (d)) is amended by striking <quote>subsection
			 (g)</quote> and inserting <quote>subsection (h)</quote>.</text></paragraph></subsection><subsection id="id0b4ae9db-7f5d-4520-a642-2fc5679770ed"><enum>(f)</enum><header>Authorization of
			 Appropriations</header><text>Section 320 of the Federal Water Pollution Control
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>) (as redesignated by subsection (d)) is amended by
			 striking

				administration of grants by the Administrator under this section,
			 including the
				award and oversight of grants, except that such expenses shall not
			 exceed 5
				percent of the amount appropriated under this subsection;</text></subparagraph><subparagraph id="idd22596f5-430d-4be2-8381-66d12274cd7d"><enum>(B)</enum><text>making grants under
				subsection (h); and</text></subparagraph><subparagraph id="id1bd846bb-4009-4fe7-b747-00c3a1deecba"><enum>(C)</enum><text>monitoring the
				implementation of a conservation and management plan by the
			 management
				conference, or by the Administrator in any case in which the
			 conference has
				been terminated.</text></subparagraph></paragraph><paragraph id="idf097c5ea-e9d9-4ea2-8971-239bc66727ce"><enum>(2)</enum><header>Allocations</header><text>The
				Administrator shall provide at least 80 percent of the amounts
			 appropriated
				under this subsection per fiscal year for the development,
			 implementation, and
				monitoring of each conservation and management plan eligible for
			 grant
				assistance under subsection (h).</text></paragraph><paragraph id="id48a7f8ad-2550-4a9b-94af-dc8fb0de17db"><enum>(3)</enum><header>Requirement</header><text>The
				Administrator shall include in the annual budget request of the
			 Environmental
				Protection Agency a clear description of the amounts requested by
			 the
				Administrator to make grants under paragraph
				(1)(B).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8b8a063b-51de-4bbb-bb04-9a3f91431314"><enum>(g)</enum><header>Research</header><text>Section
			 320(k)(1)(A) of the Federal Water Pollution Control Act (as redesignated
			 by
			 subsection (d)) is amended—</text><paragraph id="id9733e853-2dba-411e-b47f-0bed0e89fab2"><enum>(1)</enum><text>by striking
			 <quote>paramenters</quote> and inserting <quote>parameters</quote>; and</text></paragraph><paragraph id="id5d3f16fe-fe63-4769-b6d5-a4ac85b8411a"><enum>(2)</enum><text>by inserting
			 <quote>(including monitoring of both pathways and ecosystems to track the
			 introduction and establishment of nonnative species)</quote> before <quote>, to
			 provide the Administrator</quote>.</text></paragraph></subsection><subsection id="idece06af6-b752-4640-886d-a2362cfed020"><enum>(h)</enum><header>National Estuary
			 Program Evaluation</header><text>Section 320 of the Federal Water Pollution
			 Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1330">33 U.S.C. 1330</external-xref>) is amended by inserting after subsection (k)
			 (as

				an evaluation of the national estuary program established under
			 this
				section.</text></paragraph><paragraph id="id916e9858-1fe2-45f9-b0f0-281a46b6209d"><enum>(2)</enum><header>Specific
				assessments</header><text>In conducting an evaluation under this subsection,
				the Administrator shall—</text><subparagraph id="idd56846ce-d55a-473d-b7b9-7f8d845ea2f8"><enum>(A)</enum><text>assess the effectiveness
				of the national estuary program in improving water quality, natural
			 resources,
				and sustainable uses of the estuaries covered by management
			 conferences
				convened under this section;</text></subparagraph><subparagraph id="id883d0d66-06da-4567-8fa9-72f1d1dce044"><enum>(B)</enum><text>identify best practices
				for improving water quality, natural resources, and sustainable
			 uses of the
				estuaries covered by management conferences convened under this
			 section,
				including those practices funded through the use of technical
			 assistance from
				the Environmental Protection Agency and other Federal agencies;</text></subparagraph><subparagraph id="idfeac0fbf-5ea2-480a-984a-81f3c9277bb3"><enum>(C)</enum><text>assess the reasons why
				the best practices described in subparagraph (B) resulted in the
			 achievement of
				program goals;</text></subparagraph><subparagraph id="id1833dc58-9207-40e8-a198-500402d02785"><enum>(D)</enum><text>identify any redundant
				requirements for reporting by recipients of a grant under this
			 section;
				and</text></subparagraph><subparagraph id="id554d60c7-d256-4508-9a0c-5261d1653545"><enum>(E)</enum><text>develop and recommend a
				plan for eliminating any redundancies.</text></subparagraph></paragraph><paragraph id="id9d035748-f054-493b-a5f8-d8e3cc13f1a4"><enum>(3)</enum><header>Report</header><text>In
				completing an evaluation under this subsection, the Administrator
			 shall issue a
				report on the results of the evaluation, including the findings and
				recommendations of the Administrator.</text></paragraph><paragraph id="id63c755bb-6355-466b-87fc-431fea8f924e"><enum>(4)</enum><header>Availability</header><text>The
				Administrator shall make a report issued under this subsection
			 available to
				management conferences convened under this section and the public,
			 including
				through publication in the Federal Register and on the
				Internet.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id5c75fa10-6317-463f-8b8e-46e78d2ce2af"><enum>(i)</enum><header>Convening of
