			 by <sponsor name-id="S314">Mr. Tester</sponsor>, with amendments</action-desc><action-instruction>Omit the part struck through and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To repeal the Act of May 31, 1918, and for other purposes.</official-title></form><legis-body><section id="idD3A7739F6347412AB822D7EB36A901DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>May 31, 1918 Act Repeal Act</short-title></quote>.</text></section><section id="idF49EDC0A605E44C284FEE266F80968E7"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id95A99B59F1AA4F54B6D8A8AB6D3D3010"><enum>(1)</enum><header>1918 Act</header><text>The term <term>1918 Act</term> means the Act of May 31, 1918 (40 Stat. 592, chapter 88).</text></paragraph><paragraph changed="added" committee-id="SLIA00" id="id7BF22BED84924DB7B59FF4E34B7F860F" reported-display-style="italic"><enum>(2)</enum><header>Fort Hall Townsite</header><text>The term <term>Fort Hall Townsite</term> means the  land that was taken out of trust by being set aside or set apart under the 1918 Act on
			 the Fort Hall Reservation, consisting of approximately 120 acres in the
			 East Half of the Northeast Quarter in Section 35 and the West Half of the
			 West Half of the Northwest Quarter in Section 36, Township 4 South, Range
			 34 East, Boise Meridian, Idaho, based upon a survey completed on May 19,
			 1921, and depicted on the document entitled  <quote>Plat of the Townsite of Fort Hall</quote> on file with Bingham County, Idaho and the Tribes.</text></paragraph><paragraph id="id7BF21A8B7ACA41109EA8D10C13D98FFD"><enum><deleted-phrase committee-id="SLIA00" reported-display-style="strikethrough">(2)</deleted-phrase><italic> (3)</italic></enum><header>Tribes</header><text>The term <term>Tribes</term> means the Shoshone-Bannock Tribes of the Fort Hall <deleted-phrase committee-id="SLIA00" reported-display-style="strikethrough">Indian</deleted-phrase> Reservation.</text></paragraph></section><section id="idEDA882DFA7694727BA63995B410B4A78"><enum>3.</enum><header>Repeal</header><text display-inline="no-display-inline">The 1918 Act is repealed.</text></section><section id="idDAC0A692D1CC4710A980A72E46A74C00"><enum>4.</enum><header>Right of first refusal</header><subsection id="id337B8B9C36BE4678976E1C7910FE91EC"><enum>(a)</enum><header>In general</header><text>The Tribes shall have the exclusive right of first refusal to purchase at fair market value any
			 land—</text><paragraph id="id084AB3806C854C3290451978A2E2B19E"><enum>(1)</enum><text><deleted-phrase committee-id="SLIA00" reported-display-style="strikethrough">set aside or set apart under the 1918 Act</deleted-phrase><added-phrase committee-id="SLIA00" reported-display-style="italic">within the Fort Hall Townsite</added-phrase>; and</text></paragraph><paragraph id="id62CA6BF489AA4AF7B254961B72430BC5"><enum>(2)</enum><text>offered for sale.</text></paragraph></subsection><subsection id="idF0C543F7D7364D69A951854698F066DE"><enum>(b)</enum><header>Acquired land held in trust</header><text>The United States shall hold in
			 trust for the benefit of the Tribes or a member of the Tribes, as
			 applicable—</text><paragraph id="id7426227704BE4D27BD6A33924F229DBA"><enum>(1)</enum><text>any land <added-phrase committee-id="SLIA00" reported-display-style="italic">owned or</added-phrase> acquired by the Tribes or a member of the Tribes <added-phrase committee-id="SLIA00" reported-display-style="italic">within the Fort Hall Townsite</added-phrase> before the date of enactment of this Act;
			 and</text></paragraph><paragraph changed="deleted" committee-id="SLIA00" id="id2DE4D5A6DC794E349FAFEFA775A72E08" reported-display-style="strikethrough"><enum>(2)</enum><text>any land—</text><subparagraph id="idFDF4433BAF4F4A85BA32D0852DD9ED6C"><enum>(A)</enum><text>acquired by the Tribes or a member of the Tribes on or after the date of enactment of this Act; and</text></subparagraph><subparagraph id="id61BF564D862D4DD981D9F7E0723541A4"><enum>(B)</enum><text>set aside or set apart under the 1918 Act.</text></subparagraph></paragraph><paragraph changed="added" committee-id="SLIA00" id="idDECA5F4B25A04E2C8570B13D68A7FFCE" reported-display-style="italic"><enum>(2)</enum><text>any land owned or acquired by the Tribes or a member of the Tribes within the Fort Hall Townsite on
			 or after the date of enactment of this Act.</text></paragraph></subsection></section><section id="id6E13408CE88A474EB4B17EDCD9E73711"><enum>5.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in this Act affects any valid right to any land set aside or set apart under the 1918 Act.</text></section></legis-body><endorsement><action-date>August 26, 2014</action-date><action-desc>Reported with amendments</action-desc></endorsement></bill>
