			 River along the boundary of the Fort Hall Indian Reservation, and for
			 other purposes.</official-title></form><legis-body id="HDF5C935B69B0429081DFC2CBA03B325E"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blackfoot River Land Exchange Act of 2014</short-title></quote>.</text></section><section id="idb051996ba7e943058be690883ed560a0"><enum>2.</enum><header>Findings; purposes</header><subsection id="id086c3deacbc44ee69524c1cbe87e72f2"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="id21a3c74030b04a11a1b0496a60fb07d1"><enum>(1)</enum><text>the Shoshone-Bannock Tribes, a federally recognized Indian tribe with tribal headquarters at Fort
			 Hall, Idaho—</text><subparagraph id="id10a641729cc1450d9f77a21a48f8ad5d"><enum>(A)</enum><text>adopted a tribal constitution and bylaws on March 31, 1936, that were approved by the Secretary of
			 the Interior on April 30, 1936, pursuant to the Act of June 18, 1934 (25
			 U.S.C. 461 et seq.) (commonly known as the <quote>Indian Reorganization Act</quote>);</text></subparagraph><subparagraph id="id17e4d57a8d3047378a44bc5cd76ba553"><enum>(B)</enum><text>has entered into various treaties with the United States, including the Second Treaty of Fort
			 Bridger, executed on July 3, 1868; and</text></subparagraph><subparagraph id="idce0839ac459f4ff787584efa4e61772b"><enum>(C)</enum><text>has maintained a continuous government-to-government relationship with the United States since the
			 earliest years of the Union;</text></subparagraph></paragraph><paragraph id="id73321e3cc76b46d2b1a716ab6cd189d4"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB38FA262E928463F8AB059E98B9962E1"><enum>(A)</enum><text>in 1867, President Andrew Johnson designated by Executive order the Fort Hall Reservation for
			 various bands of Shoshone and Bannock Indians;</text></subparagraph><subparagraph id="ide91a6d367ac34b398dd1c3396e15ad9a" indent="up1"><enum>(B)</enum><text>the Reservation is located near the cities of Blackfoot and Pocatello in southeastern Idaho; and</text></subparagraph><subparagraph id="idba154af083e34a6691cd99b005a2109b" indent="up1"><enum>(C)</enum><text>article 4 of the Second Treaty of Fort Bridger secured the Reservation as a <quote>permanent home</quote> for the Shoshone-Bannock Tribes;</text></subparagraph></paragraph><paragraph id="idb1c301b3ff0e41d9ac92764cf32901d4"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id176086A466D5418288A01614E58EA248"><enum>(A)</enum><text>according to the Executive order referred to in paragraph (2)(A), the Blackfoot River, as the river
			 existed in its natural state—</text><clause id="id7804f860054043e89c091b2a14a9e354" indent="up1"><enum>(i)</enum><text>is the northern boundary of the Reservation; and</text></clause><clause id="id4eee953e14f34fd49060d683fcbeda64" indent="up1"><enum>(ii)</enum><text>flows in a westerly direction along that northern boundary; and</text></clause></subparagraph><subparagraph id="id2982a44066064f3f8ab91d078cc7c097" indent="up1"><enum>(B)</enum><text>within the Reservation, land use in the River watershed is dominated by—</text><clause id="idfe6511f1e54f4f8e8c7da3c53314c777"><enum>(i)</enum><text>rangeland;</text></clause><clause id="id73ae8a042fb64cb48d07bbff7e2d43ee"><enum>(ii)</enum><text>dry and irrigated farming; and</text></clause><clause id="id6e9fb3873e9a453c941b5f45e94aa960"><enum>(iii)</enum><text>residential development;</text></clause></subparagraph></paragraph><paragraph id="id84713d22f30c4b9bbff03ddcedb45095"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id676E6CAF88DD42638E73BEC9ADFEB1E2"><enum>(A)</enum><text>in 1964, the Corps of Engineers completed a local flood protection project on the River—</text><clause id="idd4b74af6f0a74dd68ed89df4bd86779e" indent="up1"><enum>(i)</enum><text>authorized by section 204 of the Flood Control Act of 1950 (64 Stat. 170); and</text></clause><clause id="id2b4bca19149a4398a61f6a2d175a7b12" indent="up1"><enum>(ii)</enum><text>sponsored by the Blackfoot River Flood Control District No. 7;</text></clause></subparagraph><subparagraph id="id42b9f8d73d924d5baad65d843e8eaad2" indent="up1"><enum>(B)</enum><text>the project consisted of building levees, replacing irrigation diversion structures, replacing
			 bridges, and channel realignment; and</text></subparagraph><subparagraph id="id10888210bba642579feaca50c518f3cd" indent="up1"><enum>(C)</enum><text>the channel realignment portion of the project severed various parcels of land located contiguous
			 to the River along the boundary of the Reservation, resulting in Indian
			 land being located north of the Realigned River and non-Indian land being
			 located south of the Realigned River;</text></subparagraph></paragraph><paragraph id="id20210860a5074e4bb0cfdc04284df76d"><enum>(5)</enum><text>beginning in 1999, the Cadastral Survey Office of the Bureau of Land Management conducted surveys
			 of—</text><subparagraph id="id3beb48f9a1864e9db6b88a08c89c4ff1"><enum>(A)</enum><text>25 parcels of Indian land; and</text></subparagraph><subparagraph id="id1c1b3210312f475084279507fab18314"><enum>(B)</enum><text>19 parcels of non-Indian land; and</text></subparagraph></paragraph><paragraph id="idb8fcad1e05ee4dd7ae3e5924b814fdfa"><enum>(6)</enum><text>the enactment of this Act and separate agreements of the parties would represent a resolution of
			 the disputes described in subsection (b)(1) among—</text><subparagraph id="id1f8b67330d4347d0a4f2927ab9cf0f91"><enum>(A)</enum><text>the Tribes;</text></subparagraph><subparagraph id="idee59edb0f28641b4bb84bb3831f9e196"><enum>(B)</enum><text>the allottees; and</text></subparagraph><subparagraph id="id35226f9385ee4d018c3faa3a3225934b"><enum>(C)</enum><text>the non-Indian landowners.</text></subparagraph></paragraph></subsection><subsection id="ide1ac956c9e0b4feca156ce696037ba16"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text><paragraph id="idb2554557690c453ca3a906a5382366f4"><enum>(1)</enum><text>to resolve the land ownership and land use disputes resulting from realignment of the River by the
			 Corps of Engineers during calendar year 1964 pursuant to the project
			 described in subsection (a)(4)(A); and</text></paragraph><paragraph id="idfd90d31a1fa14949baf51829f7626746"><enum>(2)</enum><text>to achieve a final and fair solution to resolve those disputes.</text></paragraph></subsection></section><section id="id4cde3fb1ef8942e1b5b7ff2ec7ac0a52"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idb252d32a57d641ba97196fb4361cbdb0"><enum>(1)</enum><header>Allottee</header><text>The term <term>allottee</term> means an heir of an original allottee of the Reservation who owns an interest in a parcel of land
			 that is—</text><subparagraph id="id2364db65ef1142a98e98a60af274e26e"><enum>(A)</enum><text>held in trust by the United States for the benefit of the allottee; and</text></subparagraph><subparagraph id="idfe477e216be748e78510eb84377bfcbd"><enum>(B)</enum><text>located north of the Realigned River within the exterior boundaries of the Reservation.</text></subparagraph></paragraph><paragraph id="id0e86634b87bf4130a062dfd39c5b1825"><enum>(2)</enum><header>Blackfoot River Flood Control District No. 7</header><text>The term <term>Blackfoot River Flood Control District No. 7</term> means the governmental subdivision in the State of Idaho, located at 75 East Judicial, Blackfoot,
			 Idaho, that—</text><subparagraph id="id86142401A0644E7C91585D745AED7D5D"><enum>(A)</enum><text>is responsible for maintenance and repair of the Realigned River; and</text></subparagraph><subparagraph id="idA363577F6C10496E9DDA33B5A0D6DEE7"><enum>(B)</enum><text>represents the non-Indian landowners relating to the resolution of the disputes described in
			 section 2(b)(1) in accordance with this Act.</text></subparagraph></paragraph><paragraph id="idc256ffb9cb83443f959caf32ad2c1f9c"><enum>(3)</enum><header>Indian land</header><text>The term <term>Indian land</term> means any parcel of land that is—</text><subparagraph id="id307ea9de84fa4467a9679bdfdd4264d3"><enum>(A)</enum><text>held in trust by the United States for the benefit of the Tribes or the allottees;</text></subparagraph><subparagraph id="id18656805e54b4e76803b2fc63cdc9b69"><enum>(B)</enum><text>located north of the Realigned River; and</text></subparagraph><subparagraph id="idc043f334b404459bb12791ec8cdc1c6a"><enum>(C)</enum><text>identified in exhibit A of the survey of the Bureau of Land Management entitled <quote>Survey of the Blackfoot River of 2002 to 2005</quote>, which is located at—</text><clause id="id9c8b912bff4b49df8d864d006eb123b2"><enum>(i)</enum><text>the Fort Hall Indian Agency office of the Bureau of Indian Affairs; and</text></clause><clause id="ide4d5ddebcf3942c5a8608c22cb8c735d"><enum>(ii)</enum><text>the Blackfoot River Flood Control District No. 7.</text></clause></subparagraph></paragraph><paragraph id="id297546e5f85f429ab39095a27ab9c9bd"><enum>(4)</enum><header>Non-Indian land</header><text>The term <term>non-Indian land</term> means any parcel of fee land that is—</text><subparagraph id="id5c27c3538c1b4af08074cc7da10925ea"><enum>(A)</enum><text>located south of the Realigned River; and</text></subparagraph><subparagraph id="id300c1f7027b940ac8be01146163d4d82"><enum>(B)</enum><text>identified in exhibit B, which is located at the areas described in clauses (i) and (ii) of
			 paragraph (3)(C).</text></subparagraph></paragraph><paragraph id="id4781e7af1c0549d1a27c55f46d1c776c"><enum>(5)</enum><header>Non-Indian landowner</header><text>The term <term>non-Indian landowner</term> means any individual who holds fee title to non-Indian land and is represented by the Blackfoot
			 River Flood Control District No. 7 for purposes of this Act.</text></paragraph><paragraph id="id5f439355554645ab827632e3d4bb0ac4"><enum>(6)</enum><header>Realigned River</header><text>The term <term>Realigned River</term> means that portion of the River that was realigned by the Corps of Engineers during calendar year
			 1964 pursuant to the project described in section 2(a)(4)(A).</text></paragraph><paragraph id="idac08f7c53262415c8d44b01d2e15f551"><enum>(7)</enum><header>Reservation</header><text>The term <term>Reservation</term> means the Fort Hall Reservation established by Executive order during calendar year 1867 and
			 confirmed by treaty during calendar year 1868.</text></paragraph><paragraph id="id9984c6f524a0481bbb25e421423aab5f"><enum>(8)</enum><header>River</header><text>The term <term>River</term> means the Blackfoot River located in the State of Idaho.</text></paragraph><paragraph id="id97f452ade1be4b16a4d436aee28c6b61"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id92dcc990e2854ad3b9a6ffd619913720"><enum>(10)</enum><header>Tribes</header><text>The term <term>Tribes</term> means the Shoshone-Bannock Tribes.</text></paragraph></section><section id="id055a8b044e16475fab39422f86bb83a9"><enum>4.</enum><header>Release of claims to certain indian and non-indian owned lands</header><subsection id="id125fbfaddaf2423b83af4afe3ccd8a8d"><enum>(a)</enum><header>Release of claims</header><text>Effective on the date of enactment of this Act—</text><paragraph id="idf9003a6452a8401191adfbb65b3f2e8f"><enum>(1)</enum><text>all existing and future claims with respect to the Indian land and the non-Indian land and all
			 right, title, and interest that the Tribes, allottees, non-Indian
			 landowners, and the Blackfoot River Flood Control District No. 7 may have
			 had to that land shall be extinguished;</text></paragraph><paragraph id="id2673ca80094149499e9b39efa24f2fed"><enum>(2)</enum><text>any interest of the Tribes, the allottees, or the United States, acting as trustee for the Tribes
			 or allottees, in the Indian land shall be extinguished under section 2116
			 of the Revised Statutes (commonly known as the <quote>Indian Trade and Intercourse Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>); and</text></paragraph><paragraph id="idf49e262180ed44718d6e3a101d6ccc47"><enum>(3)</enum><text>to the extent any interest in non-Indian land transferred into trust pursuant to section 5 violates
			 section 2116 of the Revised Statutes (commonly known as the <quote>Indian Trade and Intercourse Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/25/177">25 U.S.C. 177</external-xref>), that transfer shall be valid, subject to the condition that the transfer is
			 consistent with all other applicable Federal laws (including regulations).</text></paragraph></subsection><subsection id="ida119bb3bce094c7ebf7a68cf9c62a23e"><enum>(b)</enum><header>Documentation</header><text>The Secretary may execute and file any appropriate documents (including a plat or map of the
			 transferred Indian land) that are suitable for filing with the Bingham
			 County clerk or other appropriate county official, as the Secretary
			 determines necessary to carry out this Act.</text></subsection></section><section id="id7f42e55ecfcc4eac94878211c27bbd22"><enum>5.</enum><header>Non-Indian land to be placed into trust for Tribes</header><text display-inline="no-display-inline">Effective on the date of enactment of this Act, the non-Indian land shall be considered to be held
			 in trust by the United States for the benefit of the Tribes.</text></section><section id="id79b1150d4a1d43aa888311a90be3396b"><enum>6.</enum><header>Trust land to be converted to fee land</header><subsection id="id84DB49798E5548CBA6220F3180FDFAAC"><enum>(a)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall transfer the
			 Indian land to the Blackfoot River Flood Control District No. 7 for use or
			 sale in accordance with subsection (b).</text></subsection><subsection id="idE1248CF6144E43058797925C4CDD3A55"><enum>(b)</enum><header>Use of land</header><paragraph id="id43D0A3FFDF1E425D846AB1172B56A91A"><enum>(1)</enum><header>In general</header><text>The Blackfoot River Flood Control District No. 7 shall use any proceeds from the sale of land
			 described in subsection (a) according to the following priorities:</text><subparagraph id="id6517972204CA4E5A8B546A48056BA6B4"><enum>(A)</enum><text>To compensate, at fair market value, each non-Indian landowner for the net loss of land to that
			 non-Indian landowner resulting from the implementation of this Act.</text></subparagraph><subparagraph id="id395C024360874EEA9FAD7D6D335D1816"><enum>(B)</enum><text>To compensate the Blackfoot River Flood Control District No. 7 for any administrative or other
			 expenses relating to carrying out this Act.</text></subparagraph></paragraph><paragraph id="id7CE730465262455384FBB6F04E6DDB12"><enum>(2)</enum><header>Remaining land</header><text>If any land remains to be conveyed or proceeds remain after the sale of the land, the Blackfoot
			 River Flood Control District No. 7 may dispose of that remaining land or
			 proceeds as the Blackfoot River Flood Control District No. 7 determines to
			 be appropriate.</text></paragraph></subsection></section><section id="ide4da0584487247f8ae8fb2ffe439eb0f"><enum>7.</enum><header>Effect on original reservation boundary</header><text display-inline="no-display-inline">Nothing in this Act affects the original boundary of the Reservation, as established by Executive
			 order during calendar year 1867 and confirmed by treaty during calendar
			 year 1868.</text></section><section id="id7974c8e1f2b7477c8202682d64d28265"><enum>8.</enum><header>Effect on tribal water rights</header><text display-inline="no-display-inline">Nothing in this Act extinguishes or conveys any water right of the Tribes, as established in the
			 agreement entitled <quote>1990 Fort Hall Indian Water Rights Agreement</quote> and ratified by section 4 of the Fort Hall Indian Water Rights Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/602">Public Law 101–602</external-xref>;
			 104 Stat. 3060).</text></section><section id="idc8cdffe40c0e4b6d8f90905f07810e8c"><enum>9.</enum><header>Disclaimers regarding claims</header><text display-inline="no-display-inline">Nothing in this Act—</text><paragraph id="id4dded55036e447ef8880556f712d4b23"><enum>(1)</enum><text>affects in any manner the sovereign claim of the State of Idaho to title in and to the beds and
			 banks of the River under the equal footing doctrine of the Constitution of
			 the United States;</text></paragraph><paragraph id="idcdfe271c09c64304a716421db08445a9"><enum>(2)</enum><text>affects any action by the State of Idaho to establish the title described in paragraph (1) under
			 <external-xref legal-doc="usc" parsable-cite="usc/28/2409a">section 2409a</external-xref> of title 28, United States Code (commonly known as the <quote>Quiet Title Act</quote>);</text></paragraph><paragraph id="id6cc8aa09ff6a425bb35c340fc8e95479"><enum>(3)</enum><text>affects the ability of the Tribes or the United States to claim ownership of the beds and banks of
			 the River; or</text></paragraph><paragraph id="id7bd87167ceef408fb74555e78fe98d38"><enum>(4)</enum><text>extinguishes or conveys any water rights of non-Indian landowners or the claims of those landowners
			 to water rights in the Snake River Basin Adjudication.</text></paragraph></section></legis-body><endorsement><action-date>August 5 (legislative day, August 1), 2014</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
