		  provide for the reporting of certain hospital payment data under the Medicare program, and for other
		  purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Consumer Learning through
			 Electronically-Accessible and Reasonable Cost Information Act of
			 2013</short-title></quote> or the <quote><short-title>CLEAR Cost Information Act of
			 2013</short-title></quote>.</text></section><section id="idE62DCD5EF78C43138A0477B80F5EE0BD"><enum>2.</enum><header>Reporting of
			 certain hospital payment data</header><subsection id="IDa1e117c31b22461d8abf396b1dbfc41a"><enum>(a)</enum><header>In
			 general</header><text>Section 1866 of the Social Security Act (42 U.S.C.
			 1395cc) is amended—</text><paragraph id="idA1BCC6E2B4184C1B9630EC04DC0A2410"><enum>(1)</enum><text>in subsection
			 (a)(1)—</text><subparagraph id="IDb398092e51024fedaadf0c9f06120bf6"><enum>(A)</enum><text>in subparagraph
			 (V), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="ID692314dcbf8f400aba8a73bd6295350b"><enum>(B)</enum><text>in subparagraph
			 (W), as added by section 3005 of <external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>—</text><clause id="idF353BE29DEC74E2F8784B5F4487D9376"><enum>(i)</enum><text>by
			 moving such subparagraph 2 ems to the left; and</text></clause><clause id="idB87C3F33F5544ED8A09179271AD5B1E4"><enum>(ii)</enum><text>by
			 striking the period at the end and inserting a comma;</text></clause></subparagraph><subparagraph id="id3BA542E04F264D67B415A7F3C3B56ED5"><enum>(C)</enum><text>in subparagraph
			 (W), as added by section 6406(b) of <external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>—</text><clause id="id3C762C21A78847A6A96B595011E9C1C0"><enum>(i)</enum><text>by
			 moving such subparagraph 2 ems to the left;</text></clause><clause id="id310BBED52E474CC9A853BEBB18407414"><enum>(ii)</enum><text>by
			 redesignating such subparagraph as subparagraph (X); and</text></clause><clause id="idD37EA6AED58746CAB91C342601AB9C63"><enum>(iii)</enum><text>by striking the
			 period at the end and inserting <quote>, and</quote>; and</text></clause></subparagraph><subparagraph id="ID9ff0c459348447199056126e763ff5b1"><enum>(D)</enum><text>by inserting
			 after subparagraph (X), as redesignated by subparagraph (C)(ii), the following
			 new subparagraph:</text><quoted-block display-inline="no-display-inline" id="id19200DE6CCCE40AB9149A691AC557FDA" style="OLC"><subparagraph id="ID1a5811aa399248438a33dddf43e39ea7" indent="up1"><enum>(Y)</enum><text>in the case of a subsection (d)
				hospital (as defined in section 1886(d)(1)(B)), to report payment data to the Secretary in accordance
				subsection (l).</text></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id7EE1CACEC4CD403391B9B626E2B1FB4C"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="id1640FF0DAA60480C8DC3B824C4593173" style="OLC"><subsection id="id04B58D7AA69C4C09B1AFB2E42E4E0085"><enum>(l)</enum><header>Reporting of
				certain hospital payment data</header><paragraph id="idF8AB40AC36AD46DB90DD1195ACB5B3AB"><enum>(1)</enum><header>In
				general</header><text>A subsection (d) hospital (as defined in section
				1886(d)(1)(B)) shall submit to the Secretary data on the actual amounts
				collected by the hospital from uninsured and insured patients over the
				preceding 2 years for each of the procedures described in paragraph (2).</text></paragraph><paragraph id="idcec90ea6d4134819a05e9ac3de0c604c"><enum>(2)</enum><header>Procedures
				described</header><text>The procedures described in this paragraph are the 50
				most common diagnosis-related groups and ambulatory payment classification groups for which payment is made under this title, as
				determined by the Secretary based on claims data, in both the inpatient and
				outpatient settings.</text></paragraph><paragraph id="id79269c485b3147bcb616c882a434e468"><enum>(3)</enum><header>Transparency</header><subparagraph id="id7958AA2470794058830D160E16A4CACA"><enum>(A)</enum><header>In
				general</header><text>In order to be beneficial to consumers, the reporting of
				data under this subsection shall be done in a manner that is transparent to the
				general public.</text></subparagraph><subparagraph id="id5d75431ea30f41ef9245dcb8a4f7903a"><enum>(B)</enum><header>Public
				availability of information</header><text>The Secretary shall post data
				submitted under paragraph (1) on a publicly accessible and searchable Internet
				website in a form and manner that—</text><clause id="idEC14AABA135646DFB2B651AD4DB0556F"><enum>(i)</enum><text>allows for
				meaningful comparisons of hospital collections and related policies by zip
				code; and</text></clause><clause id="id028B282479B54C2DA1E98C51AE1DDA63"><enum>(ii)</enum><text>is readily
				understandable by a typical consumer.</text></clause></subparagraph><subparagraph id="idd41eefab354f4d1eba69be6dfd0a5c1f"><enum>(C)</enum><header>Linking of
				data</header><text>A subsection (d) hospital shall include a link to the data
				posted under subparagraph (B) on the home Internet website of the
				hospital.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idE33D807A003A4F5C9EA72774A00A2CF0"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall
		apply to contracts entered into, or renewed, on or after the date of the enactment of this Act.</text></subsection></section><section id="idF8B7EFFAC19D4AD79ADAE1837E8155AA"><enum>3.</enum><header>Inclusion of
		information on charity care furnished by hospitals in MedPAC's annual
		report</header><text display-inline="no-display-inline">Each annual report
		submitted to Congress after the date of the enactment of this Act by the
		Medicare Payment Advisory Commission under section 1805 of the Social Security
		Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395b-6">42 U.S.C. 1395b–6</external-xref>) shall contain information on the percentage that
		charity care makes up of the total care furnished by hospitals and critical
		access hospitals.</text></section><section id="id72998D6C05AD4F4DADDE4AEC61C367D7"><enum>4.</enum><header>Public
		availability of report on trends in levels of charity care provided by certain
		hospitals</header><subsection id="id94955C0AC63A444A83937BFC817C7739"><enum>(a)</enum><header>Posting of
		data</header><text display-inline="yes-display-inline">Section 9007(e)(2) of
		the Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>; 124 Stat.
		858) is amended by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="id696F0BBD730B42E0BDC59ABA85A121A8" style="OLC"><subparagraph id="id5CC00A06BA4441D5BD48A3D4857BCC33"><enum>(C)</enum><header>Public
		  availability</header><text>The Secretary of the Treasury, in consultation with
		  the Secretary of Health and Human Services, shall post the data contained in
		  the report under subparagraph (B) on a publicly accessible and searchable website that—</text><clause id="idD926D4B07D9746BE939C2ACFA9EDDE24"><enum>(i)</enum><text>allows for
		  meaningful comparisons of the data by zip code; and</text></clause><clause id="id12439FD0A5AB4C68A2296286F4E19DA5"><enum>(ii)</enum><text>is
		  readily understandable by a typical
		  consumer.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id06743A7C9F8746F5B4333CC8C577E272"><enum>(b)</enum><header>Medicare
		requirement for hospitals To provide a link to the data on the hospital's home
		webpage</header><paragraph id="idD359C369454742708B2FE013EA1F202B"><enum>(1)</enum><header>In
		general</header><text>Section 1866(a)(1) of the Social Security Act (42 U.S.C.
		1395cc(a)(1)), as amended by section 2, is amended—</text><subparagraph id="id084028EA51FB4F1FBA2CCB482343C34E"><enum>(A)</enum><text>in subparagraph
		(X), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="idE02502502AE94905BF54211683AB0B51"><enum>(B)</enum><text>in subparagraph
		(Y), by striking the period at the end and inserting <quote>, and</quote>;
		and</text></subparagraph><subparagraph id="id7041668A937E4DE2A18F9BFBC1C83DD1"><enum>(C)</enum><text>by inserting
		after subparagraph (Y) the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="id94E9F9343C47407A944289FC811A84E1" style="OLC"><subparagraph id="id5B6A31D32F6F4F2894DE022239DBC840"><enum>(Z)</enum><text>in the case of
		  hospitals and critical access hospitals, to include a link on the home Internet
		  website of the hospital or critical access hospital to the data posted under
		  section 9007(e)(2)(C) of the Patient Protection and Affordable Care
		  Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idDD58CFEC1E46400BA7C97554F5437FE2"><enum>(2)</enum><header>Effective
		date</header><text>The amendments made by paragraph (1) shall
		apply to contracts entered into, or renewed, on or after the date of the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
