			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Dry-Redwater Regional Water Authority System Act of 2014</short-title></quote>.</text></section><section id="ID4d6e4d0a577b40e0b785eda9d8426b9c"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to ensure a safe
			 and adequate municipal, rural, and industrial water supply for the
			 citizens
			 of—</text><paragraph id="idB0B03C55A3D84EB2B4FA3ED6D7818651"><enum>(1)</enum><text>Dawson, Garfield,
			 McCone, Prairie, and Richland Counties of the State; and</text></paragraph><paragraph id="idF2F30490BED84E7482731770A26918D5"><enum>(2)</enum><text>McKenzie County,
			 North Dakota.</text></paragraph></section><section id="ID4110673e6b0f4c91a4518435c667e138"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ID91f862fd980043a8aaa88988ff2f0f82"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Western Area
			 Power Administration.</text></paragraph><paragraph id="id95FE0F5137CF4E13BC720D3463EED789"><enum>(2)</enum><header>Authority</header><text>The
			 term <term>Authority</term> means—</text><subparagraph id="id0CAF7E6135584296A9F35044662E6779"><enum>(A)</enum><text>the Dry-Redwater
			 Regional Water Authority, which is a publicly owned nonprofit water
			 authority
			 formed in accordance with Mont. Code Ann. § 75–6–302 (2007); and</text></subparagraph><subparagraph id="id68E4C1E34A834623891E6A372B221998"><enum>(B)</enum><text>any nonprofit
			 successor entity.</text></subparagraph></paragraph><paragraph id="ID47fd058a8ccb4749acf0176e65e59170"><enum>(3)</enum><header>Integrated
			 system</header><text>The term <term>integrated system</term> means the
			 transmission system owned by the Western Area Power Administration Basin
			 Electric Power District and the Heartland Consumers Power District.</text></paragraph><paragraph id="id87EE8B6DD3B7465EB3C73550260D779C"><enum>(4)</enum><header>Non-Federal
			 distribution system</header><text>The term <term>non-Federal distribution
			 system</term> means a non-Federal utility that provides electricity to the
			 counties covered by the Water System.</text></paragraph><paragraph id="id42210AC6537B4718B1E1863459F6BDF4"><enum>(5)</enum><header>Pick-Sloan
			 program</header><text>The term <term>Pick-Sloan program</term> means the
			 Pick-Sloan Missouri River Basin Program (authorized by section 9 of the
			 Act of
			 December 22, 1944 (commonly known as the <quote>Flood Control Act of
			 1944</quote>) (58 Stat. 891, chapter 665)).</text></paragraph><paragraph id="ID4d221c574cd040baaa7fa293172d019b"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id126775BE7CC74A43868D2F99882CC071"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Montana.</text></paragraph><paragraph id="idF5B6D9FE9705435889319FA0FB348126"><enum>(8)</enum><header>Water
			 System</header><text>The term <term>Water System</term> means the Dry-Redwater
			 Regional Water Authority System authorized under section 4 with a project
			 service area that includes—</text><subparagraph id="id15AAB7CEF9E8411C9B571B7214CFA5AC"><enum>(A)</enum><text>the Garfield and
			 McCone Counties of the State;</text></subparagraph><subparagraph id="id5FF3E3896BD8467C852A6DAA5C752F14"><enum>(B)</enum><text>the area west of
			 the Yellowstone River in Dawson and Richland Counties of the State;</text></subparagraph><subparagraph id="id9B6D96BBB2AC40B5AA8D78519324117F"><enum>(C)</enum><text>Township 15N
			 (including the area north of the Township) in Prairie County of the State;
			 and</text></subparagraph><subparagraph id="idDA4AE0392BF24933A1A33962075EF61B"><enum>(D)</enum><text>the portion of
			 McKenzie County, North Dakota that includes all land that is located west
			 of
			 the Yellowstone River in the State of North Dakota.</text></subparagraph></paragraph></section><section id="IDf7028b199df947ec90edf238916c3656"><enum>4.</enum><header>Dry-Redwater
			 Regional Water Authority System</header><subsection id="ID88571e1948ae40c99bc68531d92789fa"><enum>(a)</enum><header>Authorization</header><paragraph id="IDfa0ae669f4534785935f013c487bbf2c"><enum>(1)</enum><header>In
			 general</header><text>If the Secretary, acting through the Commissioner of the
			 Bureau of Reclamation, determines that the project is feasible, the
			 Secretary
			 is authorized to carry out the project entitled <quote>Dry-Redwater Regional
			 Water Authority System</quote> in a manner that is substantially in accordance
			 with the plans, and subject to the conditions, described in the
			 <quote>Dry-Redwater Regional Water System Feasibility Study</quote>, including revisions of the study, which
			 received funding from the Bureau of Reclamation on September 1, 2010, and
			 is to
			 be completed in accordance with section 106(a) of the Rural Water Supply
			 Act of
			 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/2405">43 U.S.C. 2405(a)</external-xref>).</text></paragraph><paragraph id="id976B310E01B04617AC464CE3D78C441F"><enum>(2)</enum><header>Cooperative
			 agreement</header><text>The Secretary shall enter into a cooperative agreement
			 with the Authority to provide Federal assistance for the planning, design,
			 and
			 construction of the Water System.</text></paragraph></subsection><subsection id="IDf38337475e3f4f85898d90676cd98754"><enum>(b)</enum><header>Cost
			 sharing</header><paragraph id="ID9934954a1b9b49268043f5994096ea80"><enum>(1)</enum><header>Federal
			 share</header><subparagraph id="idD30DF6BB5CFC4D6BB6BDB8F32C5A48DB"><enum>(A)</enum><header>In
			 general</header><text>The Federal share of the costs relating to the planning,
			 design, and construction of the Water System shall not exceed—</text><clause id="id01E73579E3BB4F188E30443F9A4D424C"><enum>(i)</enum><text>75 percent
			 of the
			 total cost of the Water System; or</text></clause><clause id="idC3FD6E6453CB49DB957816BA451A68BA"><enum>(ii)</enum><text>such other lesser amount as may be determined by the Secretary, acting through the Commissioner of
			 Reclamation in a feasibility report.</text></clause></subparagraph><subparagraph id="idD914C48F2389419CB338369039E47766"><enum>(B)</enum><header>Limitation</header><text>Amounts
			 made available under subparagraph (A) shall not be returnable or
			 reimbursable
			 under the reclamation laws.</text></subparagraph></paragraph><paragraph id="IDc1697274a4374ff1ba00c5e2aa670986"><enum>(2)</enum><header>Use of Federal
			 funds</header><subparagraph id="idE13F21FAA6EF4C9A9794325C0C55FA2C"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), Federal funds made available
			 to carry out this section may be used for—</text><clause id="IDc125f439c85b486eb57e083b4f9f8b83"><enum>(i)</enum><text>facilities
			 relating to—</text><subclause id="id2E06A220290244A2BCA903829A28B5F7"><enum>(I)</enum><text>water
			 intake;</text></subclause><subclause id="idDE209D393CC0434D9EE8091550D601EF"><enum>(II)</enum><text>water
			 pumping;</text></subclause><subclause id="id943672777E304B8BA7AF590FF24E3555"><enum>(III)</enum><text>water
			 treatment; and</text></subclause><subclause id="id62EB9E4BF679496DB0822D77325419A5"><enum>(IV)</enum><text>water
			 storage;</text></subclause></clause><clause id="ID45ba7cf0149b47c29724b1365eea5f80"><enum>(ii)</enum><text>transmission
			 pipelines and pumping stations;</text></clause><clause id="ID09ae8abbf36f4a3e9dc24e3e3010a3c2"><enum>(iii)</enum><text>appurtenant
			 buildings, maintenance equipment, and access roads;</text></clause><clause id="ID49c63c2a6e964a4f90d4c2756956d7f0"><enum>(iv)</enum><text>any
			 interconnection facility that connects a pipeline of the Water System to a
			 pipeline of a public water system;</text></clause><clause id="ID436e157ec9644bf197319d1aba2d1e4a"><enum>(v)</enum><text>distribution,
			 pumping, and storage facilities that—</text><subclause id="idB597F5D54FA7406C9852EF35157ECEDA"><enum>(I)</enum><text>serve the needs
			 of citizens who use public water systems;</text></subclause><subclause id="id74BB95276BE9482EB2511C7AC715BC1F"><enum>(II)</enum><text>are in existence
			 on the date of enactment of this Act; and</text></subclause><subclause id="idF7BA7C81023644D0B1C98EF7BE946D45"><enum>(III)</enum><text>may be
			 purchased, improved, and repaired in accordance with a cooperative
			 agreement
			 entered into by the Secretary under subsection (a)(2);</text></subclause></clause><clause id="ID8d01dab99ee64e138ca5f3f5d5f99a4e"><enum>(vi)</enum><text>electrical power
			 transmission and distribution facilities required for the operation and
			 maintenance of the Water System;</text></clause><clause id="IDc6424e9d5e5f413f9c2e02c599997dc9"><enum>(vii)</enum><text>any other
			 facility or service required for the development of a rural water
			 distribution
			 system, as determined by the Secretary; and</text></clause><clause id="ID9824bd73d61347269776d36264a4e788"><enum>(viii)</enum><text>any property
			 or property right required for the construction or operation of a facility
			 described in this subsection.</text></clause></subparagraph><subparagraph id="id26F3270F13F94880B96FF5D4B725A7BD"><enum>(B)</enum><header>Limitation</header><text>Federal
			 funds made available to carry out this section shall not be used for the
			 operation, maintenance, or replacement of the Water System.</text></subparagraph></paragraph></subsection><subsection id="IDee893c67d5134fffab4a0c7ac962e8f9"><enum>(c)</enum><header>Title</header><text>Title
			 to the Water System shall be held by the Authority.</text></subsection></section><section id="IDb54a39083bb542a2b19a63c63149fe0e"><enum>5.</enum><header>Use of power
			 from Pick-Sloan program</header><subsection id="IDc5aad2ca1bf346ff9f4aaa0ea2604a41"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that McCone and Garfield Counties in the State were designated as
			 impact
			 counties during the period in which the Fort Peck Dam was constructed, and
			 as
			 such, were to receive impact mitigation benefits in accordance with the
			 Pick-Sloan program.</text></subsection><subsection id="idF4FEE9547B734CA3A49E482EA01ECE70"><enum>(b)</enum><header>Availability of
			 power</header><paragraph id="id489F64EC344D489F9D184D842B90F8F7"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the Administrator shall make
			 available to the Water System a quantity of power required, of up to
			 1<fraction>½</fraction> megawatt capacity, to meet the pumping and incidental
			 operation requirements of the Water System during the period beginning on
			 May 1
			 and ending on October 31 of each year—</text><subparagraph id="idDBA4C6AC42894B6699984A62D5F2A91A"><enum>(A)</enum><text>from the water
			 intake facilities; and</text></subparagraph><subparagraph id="id381A1684FBEA4C978DEF1992FDCBF7C6"><enum>(B)</enum><text>through all
			 pumping stations, water treatment facilities, reservoirs, storage tanks,
			 and
			 pipelines up to the point of delivery of water by the water supply system
			 to
			 all storage reservoirs and tanks and each entity that distributes water at
			 retail to individual users.</text></subparagraph></paragraph><paragraph id="id326A59E9C4B247F09B1CD37760E5A923"><enum>(2)</enum><header>Eligibility</header><text>The
			 Water System shall be eligible to receive power under paragraph (1) if the
			 Water System—</text><subparagraph id="idBC12709FC7154F2399972B780E4A1B79"><enum>(A)</enum><text>operates on a
			 not-for-profit basis; and</text></subparagraph><subparagraph id="idE1E56088B0B04E2ABDD851A6EDF67EFB"><enum>(B)</enum><text>is constructed
			 pursuant to a cooperative agreement entered into by the Secretary under
			 section
			 4(a)(2).</text></subparagraph></paragraph><paragraph id="id897E4166DB1146E6B82A0A929EDDE4B2"><enum>(3)</enum><header>Rate</header><text>The
			 Administrator shall establish the cost of the power described in paragraph
			 (1)
			 at the firm power rate.</text></paragraph><paragraph id="H7CAAAE2BAEC744D4B1C3F1BDCCC6013A"><enum>(4)</enum><header>Additional
			 power</header><subparagraph id="id14E4B937710A488DA267CD561644F773"><enum>(A)</enum><header>In
			 general</header><text>If power, in addition to that made available to the Water
			 System under paragraph (1), is necessary to meet the pumping requirements
			 of
			 the Authority, the Administrator may purchase the necessary additional
			 power at
			 the best available rate.</text></subparagraph><subparagraph id="idA4B582F9F9D24B50A650248E2F585D4F"><enum>(B)</enum><header>Reimbursement</header><text>The
			 cost of purchasing additional power shall be reimbursed to the
			 Administrator by
			 the Authority.</text></subparagraph></paragraph><paragraph id="HD86C40EA7FF1483AAAA50AA17060608C"><enum>(5)</enum><header>Responsibility
			 for power charges</header><text display-inline="yes-display-inline">The
			 Authority shall be responsible for the payment of the power charge
			 described in
			 paragraph (4) and non-Federal delivery costs described in paragraph (6).</text></paragraph><paragraph id="H23C4B8085CB24242A766022CA97EF081"><enum>(6)</enum><header>Transmission
			 arrangements</header><subparagraph id="id40868E298F3348A5972EDAD460023280"><enum>(A)</enum><header>In
			 general</header><text>The Water System shall be responsible for all non-Federal
			 transmission and distribution system delivery and service arrangements.</text></subparagraph><subparagraph id="id086C528AE6484FEDBA445DBAA8FF8EFC"><enum>(B)</enum><header>Upgrades</header><text>The
			 Water System shall be responsible for funding any transmission upgrades,
			 if
			 required, to the integrated system necessary to deliver power to the Water
			 System.</text></subparagraph></paragraph><paragraph id="id90916155A64A4889BEF6738C2A2B1E78"><enum>(7)</enum><header>Construction</header><text>Nothing in this section exempts the Water System from the requirements of the Rural Water Supply
			 Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/2401">43 U.S.C. 2401 et seq.</external-xref>).</text></paragraph></subsection></section><section id="id58624C8D02564ADB90F1D5FE937C8398"><enum>6.</enum><header>Water rights</header><text display-inline="no-display-inline">Nothing in this Act—</text><paragraph id="idCFC9F0D0945B435A95125D9DB999077A"><enum>(1)</enum><text display-inline="yes-display-inline">preempts or affects any State water law; or</text></paragraph><paragraph id="id72EEA190FD7942E38E0387E4DD2E41C9"><enum>(2)</enum><text display-inline="yes-display-inline">affects any authority of a State, as in effect on the date of enactment of this Act, to manage 
			 water resources within that State.</text></paragraph></section><section id="ID1f3c9d00a3684bdd9696d654f53a067e"><enum>7.</enum><header>Authorization of
			 appropriations</header><subsection id="ID0329f98fd2334399a3efc9c41f244e36"><enum>(a)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to carry
			 out the planning, design, and construction of the Water System
			 such sums as are necessary, substantially in accordance with the cost
			 estimate set forth in the feasibility study described in section 4(a).</text></subsection><subsection id="ID7045b8317c954d0dac7521afc2a8e116"><enum>(b)</enum><header>Cost
			 indexing</header><text>The amount authorized to be appropriated under
			 subsection (a) may be increased or decreased in accordance with ordinary
			 fluctuations in development costs incurred after January 1, 2008, as
			 indicated
			 by any available engineering cost indices applicable to construction
			 activities
			 that are similar to the construction of the Water System.</text></subsection></section></legis-body></bill>
