			 procedures followed by the Federal Communications Commission, and for
			 other purposes.</official-title></form><legis-body style="OLC"><section id="H553DF70B2AA94510A582F4204275ECA4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Communications Commission Process Reform Act of 2014</short-title></quote>.</text></section><section id="HCDEADF71B10D498EAC50A4A9445A5014"><enum>2.</enum><header>FCC process reform</header><subsection id="H0B8E1B4A5B2348219F06A0ED8538717E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title I of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) is amended by adding at the end
			 the following:</text><quoted-block display-inline="no-display-inline" id="H329015F77ADC45B48F2D0AF41980813C" style="OLC"><section id="H749A8223545E45E6A44DEEBFF2D15914"><enum>13.</enum><header>Transparency and efficiency</header><subsection id="HCD5D0BE12B20469E9F5F38D899535249"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3824E40F9E3A44418A7B30B6F2B3B0ED"><enum>(1)</enum><header>Amendment</header><text>The term <term>amendment</term> includes, when used with respect to an existing rule, the deletion of the rule.</text></paragraph><paragraph id="H1DD48D28041D4B60BD0B4CDD98BA1AB9"><enum>(2)</enum><header>Bipartisan majority</header><text>The term <term>bipartisan majority</term> means, when used with respect to a group of Commissioners, that the group—</text><subparagraph id="H3C69CD19D5E54EEBB2822FD3AD1E9D37"><enum>(A)</enum><text>is a group of 3 or more Commissioners; and</text></subparagraph><subparagraph id="H4B48CD4FADDA470399F8E50D8EFA1AD5"><enum>(B)</enum><text>includes—</text><clause id="idAC8C2B0430AE41F5A685E4B7A3E996E4"><enum>(i)</enum><text>for each political party of which any Commissioner is a member, not less than 1 Commissioner who is
			 a member of that political party; and</text></clause><clause id="id5FC86133A4664DA39199380C5A2F64B3"><enum>(ii)</enum><text>if any Commissioner has no political party affiliation, not less than 1 unaffiliated Commissioner.</text></clause></subparagraph></paragraph><paragraph id="H64FF793974CD4C9A978F4FEE9521DADB"><enum>(3)</enum><header>Performance measure</header><text display-inline="yes-display-inline">The term <term>performance measure</term> means an objective and quantifiable outcome measure or output measure (as those terms are defined
			 in <external-xref legal-doc="usc" parsable-cite="usc/31/1115">section 1115</external-xref> of title 31, United States Code).</text></paragraph><paragraph id="H8AEAB685535045A2A8F5E22CCA7071A9"><enum>(4)</enum><header>Program activity</header><text>The term <term>program activity</term>—</text><subparagraph id="id123C956A958A4F7FBBA272F1706D77B7"><enum>(A)</enum><text>has the meaning given the term in <external-xref legal-doc="usc" parsable-cite="usc/31/1115">section 1115</external-xref> of title 31, United States Code; and</text></subparagraph><subparagraph id="id4B7119B55CAA4BF7AABF49A4CA294C82"><enum>(B)</enum><text>includes any annual collection or distribution or related series of collections or distributions by
			 the Commission of an amount that is not less than $100,000,000.</text></subparagraph></paragraph><paragraph id="H15E5B7A1014A4BA5B8798FA7BF3762AE"><enum>(5)</enum><header>Other definitions</header><text>The terms <term>agency action</term>, <term>ex parte communication</term>, and <term>rule</term> have the meanings given the terms in <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551</external-xref> of title 5, United States Code.</text></paragraph></subsection><subsection id="H6FEDDCE951324F6B94905E94D2D6FF2B"><enum>(b)</enum><header>Initial rulemaking and inquiry</header><paragraph id="H0AA1FC987637432AB640B67D30427403"><enum>(1)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Federal Communications Commission Process Reform Act of 2014</short-title>, the Commission shall complete a rulemaking proceeding and adopt procedural changes to the rules
			 of the Commission to maximize opportunities for public participation and
			 efficient decisionmaking.</text></paragraph><paragraph id="HAE7C4618C1F14BE0B940236B769FA903"><enum>(2)</enum><header>Requirements for rulemaking</header><text display-inline="yes-display-inline">The rules adopted under paragraph (1) shall—</text><subparagraph id="HD2C829F14B8944819466113CE2D09EE0"><enum>(A)</enum><text display-inline="yes-display-inline">set minimum comment periods for comment and reply comment, subject to a determination by the
			 Commission that good cause exists for departing from the minimum comment
			 periods, for—</text><clause commented="no" id="H4E087F328271407B85F3CB2A8F300AF7"><enum>(i)</enum><text display-inline="yes-display-inline">significant regulatory actions, as defined in Executive Order 12866 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to
			 regulatory planning and review); and</text></clause><clause commented="no" id="H70CD5A7C30E745C8BF4BC5C5C00DB7C2"><enum>(ii)</enum><text>all other rulemaking proceedings;</text></clause></subparagraph><subparagraph id="HB8D5A6FB1CE74BC583383FA3749CA2A8"><enum>(B)</enum><text display-inline="yes-display-inline">establish policies concerning the submission of extensive new comments, data, or reports towards
			 the end of a comment period;</text></subparagraph><subparagraph id="H843BEC4C79C446D08F8AD1769242C242"><enum>(C)</enum><text display-inline="yes-display-inline">establish policies regarding treatment of comments, ex parte communications, and data or reports
			 (including statistical reports and reports to Congress) submitted after a
			 comment period to ensure that the public has adequate notice of and
			 opportunity to respond to the submissions before the Commission relies on
			 the submissions in any order, decision, report, or action;</text></subparagraph><subparagraph id="HD0064043EAC74726A42BDE5BA5004734"><enum>(D)</enum><text display-inline="yes-display-inline">establish procedures for publishing the status of open rulemaking proceedings and proposed orders,
			 decisions, reports, or actions on circulation for review by the
			 Commissioners, including which Commissioners have not cast a vote on an
			 order, decision, report, or action that has been on circulation for more
			 than 60 days;</text></subparagraph><subparagraph id="HAAA88885C4D14B7A98B3C39359F7D257"><enum>(E)</enum><text display-inline="yes-display-inline">establish deadlines (relative to the date of filing) for—</text><clause id="H6C30BD7AE8DF4B83813D73468111AEBE"><enum>(i)</enum><text>in the case of a petition for a declaratory ruling under <external-xref legal-doc="usc" parsable-cite="usc/47/1">section 1.2</external-xref> of title 47, Code of Federal
			 Regulations, issuing a public notice of the petition;</text></clause><clause id="HBEBB22E36FD34A669325D60EAE39259E"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a petition for rulemaking under <external-xref legal-doc="usc" parsable-cite="usc/47/1">section 1.401</external-xref> of title 47, Code of Federal
			 Regulations, issuing a public notice of the petition; and</text></clause><clause id="HF8081C54AA754A2494FB26E45DF94BDE"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of a petition for reconsideration under section <external-xref legal-doc="usc" parsable-cite="usc/47/1">1.106</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/47/1">1.429</external-xref> of title 47, Code of
			 Federal Regulations, or an application for review under section 1.115 of
			 such title, issuing a public notice of a decision on the petition or
			 application by the Commission or under delegated authority (as the case
			 may be);</text></clause></subparagraph><subparagraph id="HE9E0751A13E54C57B901104EF01BB80E"><enum>(F)</enum><text>establish guidelines (relative to the date of filing) for the disposition of petitions filed under
			 <external-xref legal-doc="regulation" parsable-cite="cfr/47/1.2">section 1.2</external-xref> of title 47, Code of Federal Regulations;</text></subparagraph><subparagraph id="H002837B1321F4829A117FC9ECA0BF184"><enum>(G)</enum><text display-inline="yes-display-inline">establish procedures for the inclusion of the specific language of the proposed rule or the
			 proposed amendment of an existing rule in a notice of proposed rulemaking;</text></subparagraph><subparagraph id="H2F9702C742814B6A8DF8EAA2AB292957"><enum>(H)</enum><text display-inline="yes-display-inline">require each notice of proposed rulemaking or order adopting a rule or amending an existing rule
			 that  creates (or proposes to create) a program activity to contain
			 performance measures for evaluating the effectiveness of the program
			 activity; and</text></subparagraph><subparagraph id="idCAC869212DE544919F76F54E81F0863A"><enum>(I)</enum><text>require each notice of proposed rulemaking or order adopting a rule or amending an existing rule
			 that  substantially changes (or proposes to substantially change) a
			 program activity to contain—</text><clause id="H3B73D1C862B84449B17B610CFFAFEECA"><enum>(i)</enum><text>performance measures for evaluating the effectiveness of the program activity as changed (or
			 proposed to be changed); or</text></clause><clause id="HFA1CF9A49D08475384548783FAD1A508"><enum>(ii)</enum><text>a finding that existing performance measures will effectively evaluate the program activity as
			 changed (or proposed to be changed).</text></clause></subparagraph></paragraph><paragraph id="H9DBF0EAA94E64A38B4A3406412FA8CD1"><enum>(3)</enum><header>Inquiry</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Federal Communications Commission Process Reform Act of 2014</short-title>, the Commission shall complete an inquiry to seek public comment on whether and how the Commission
			 should—</text><subparagraph id="HB9A5DC8687644D34B117D401D090E05D"><enum>(A)</enum><text display-inline="yes-display-inline">establish procedures for allowing a bipartisan majority of Commissioners to place an order,
			 decision, report, or action on the agenda of an open meeting;</text></subparagraph><subparagraph id="H1338E659C82C4E1C82A42662FD610AC3"><enum>(B)</enum><text display-inline="yes-display-inline">establish procedures for informing all Commissioners of a reasonable number of options available to
			 the Commission for resolving a petition, complaint, application,
			 rulemaking, or other proceeding;</text></subparagraph><subparagraph id="H7847DE69524545E49F411FFD9F2126EC"><enum>(C)</enum><text display-inline="yes-display-inline">establish procedures for ensuring that all Commissioners have adequate time, prior to being
			 required to decide a petition, complaint, application, rulemaking, or
			 other proceeding (including at a meeting held under section 5(d)), to
			 review the proposed Commission decision document, including the specific
			 language of any proposed rule or any proposed amendment of an existing
			 rule;</text></subparagraph><subparagraph id="H258BDF369DC64BB1A59C6B20BDFD37B5"><enum>(D)</enum><text display-inline="yes-display-inline">establish procedures for publishing the text of agenda items to be voted on at an open meeting in
			 advance of the meeting so that the public has the opportunity to read the
			 text before a vote is taken;</text></subparagraph><subparagraph id="H109341DB00AD4B7A969A749F8A819A1D"><enum>(E)</enum><text display-inline="yes-display-inline">establish deadlines (relative to the date of filing) for disposition of applications for a license
			 under <external-xref legal-doc="regulation" parsable-cite="cfr/47/1.913">section 1.913</external-xref> of title 47, Code of Federal Regulations;</text></subparagraph><subparagraph id="H5910C8A40FF540808CB05B08ED12D933"><enum>(F)</enum><text>assign resources needed to meet the deadlines described in subparagraph (E), including whether the
			 ability of the Commission to meet those deadlines would be enhanced by
			 assessing a fee from applicants for a license described in subparagraph
			 (E); and</text></subparagraph><subparagraph id="HF133912DF9CC496D901FD96CD8F2179F"><enum>(G)</enum><text display-inline="yes-display-inline">publish each order, decision, report, or action not later than 30 days after the date of the
			 adoption of the order, decision, report, or action.</text></subparagraph></paragraph><paragraph id="H52F33AC901F54669BF3AD7E897CB13D9"><enum>(4)</enum><header>Data for performance measures</header><text>The Commission shall develop a performance measure or proposed performance measure required under
			 this subsection to rely, where possible, on data already collected by the
			 Commission.</text></paragraph></subsection><subsection id="HBD2011791877454FAE673C9180519A02"><enum>(c)</enum><header>Periodic review</header><text display-inline="yes-display-inline">On the date that is 5 years after the completion of the rulemaking proceeding under subsection
			 (b)(1), and every 5 years thereafter, the Commission shall initiate a new
			 rulemaking proceeding to continue to consider any procedural changes to
			 the rules of the Commission that may be in the public interest to maximize
			 opportunities for public participation and efficient decisionmaking.</text></subsection><subsection id="HA3600D1E51DF457BB8CC359917EDEBBB"><enum>(d)</enum><header>Nonpublic collaborative discussions</header><paragraph id="H290D249ADDA84349AE9DC9F5E6144968"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5, United States Code, a bipartisan majority of Commissioners
			 may hold a meeting that is closed to the public to discuss official
			 business if—</text><subparagraph id="HB06D4FE0C24640DF93FCE40FD34C1C9E"><enum>(A)</enum><text>a vote or any other agency action is not taken at the meeting;</text></subparagraph><subparagraph id="H7DDD706472F34F46B9365A8F6B4ADDEA"><enum>(B)</enum><text display-inline="yes-display-inline">each person present at the meeting is a Commissioner, an employee of the Commission, a member of a
			 joint board or conference established under section 410, or a person on
			 the staff of such a joint board or conference or of a member of such a
			 joint board or conference; and</text></subparagraph><subparagraph id="HDE57B947CB814C3CBD03B2D87405089B"><enum>(C)</enum><text>an attorney from the Office of General Counsel of the Commission is present at the meeting.</text></subparagraph></paragraph><paragraph id="H971B641A4CAF4E0597307589D163EBA7"><enum>(2)</enum><header>Disclosure of nonpublic collaborative discussions</header><text>Not later than 2 business days after the conclusion of a meeting held under paragraph (1), the
			 Commission shall publish a disclosure of the meeting, including—</text><subparagraph id="H9C01EE0B4D874579A41C801070EC1D0A"><enum>(A)</enum><text>a list of the persons who attended the meeting; and</text></subparagraph><subparagraph id="H744C0C2C06984784A714B1132C044188"><enum>(B)</enum><text>a summary of the matters discussed at the meeting, except for any matters that the Commission
			 determines may be withheld under <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b(c)</external-xref> of title 5, United States
			 Code.</text></subparagraph></paragraph><paragraph id="HB56AF060F1674CF8945CB4C8665D4CA0"><enum>(3)</enum><header>Preservation of open meetings requirements for agency action</header><text display-inline="yes-display-inline">Nothing in this subsection shall limit the applicability of <external-xref legal-doc="usc" parsable-cite="usc/5/552b">section 552b</external-xref> of title 5, United States
			 Code, with respect to a meeting of Commissioners other than that described
			 in paragraph (1).</text></paragraph></subsection><subsection id="H33A26BDB06934AF7809FDEA644788E70"><enum>(e)</enum><header>Access to certain information on Commission’s website</header><text display-inline="yes-display-inline">The Commission shall provide direct access from the homepage of the website of the Commission to—</text><paragraph id="H69F137C2BB264F75A0CAD7A5D701BE50"><enum>(1)</enum><text>detailed information regarding—</text><subparagraph id="HE74EC75CFFB0460B886AA6069FE0A406"><enum>(A)</enum><text>the budget of the Commission for the current fiscal year;</text></subparagraph><subparagraph id="H1ADB64D50DBD4F60B1950D7B89C3EF13"><enum>(B)</enum><text>the appropriations for the Commission for the current fiscal year; and</text></subparagraph><subparagraph id="H24B9572E9F204562B8647FE43B5736AA"><enum>(C)</enum><text display-inline="yes-display-inline">the total number of full-time equivalent employees of the Commission; and</text></subparagraph></paragraph><paragraph id="HA2592B6A5A1240729B32753FBD63FE42"><enum>(2)</enum><text>the performance plan most recently made available by the Commission under section 1115(b) of title
			 31, United States Code.</text></paragraph></subsection><subsection id="H6AA5DA895D7C47D7B50E199CF09DFC18"><enum>(f)</enum><header>Federal Register publication</header><paragraph id="HE568BF9E87464380BC242ABFEC6784EE"><enum>(1)</enum><header>In general</header><text>In the case of any document adopted by the Commission that the Commission is required, under any
			 provision of law, to publish in the Federal Register, the Commission
			 shall, not later than the date described in paragraph (2), complete all
			 Commission actions necessary for the document to be so published.</text></paragraph><paragraph id="H095BD6DB9556414F9EE4123B223EAE1A"><enum>(2)</enum><header>Date described</header><text>The date described in this paragraph is the earlier of—</text><subparagraph id="H0C17B5B06309415B85A0ADB902ED656C"><enum>(A)</enum><text display-inline="yes-display-inline">the date that is 45 days after the date of the release of the document described in paragraph (1);
			 or</text></subparagraph><subparagraph id="H08CBFC94AE814BC7B050C27CC9C33317"><enum>(B)</enum><text>the date by which the actions  described in paragraph (1) must be completed to comply with any
			 deadline under any other provision of law.</text></subparagraph></paragraph><paragraph id="HD967EA7E3E06499CA6521477D526E790"><enum>(3)</enum><header>No effect on deadlines for publication in other form</header><subparagraph id="id1D5AA22614D04B9D9C189A1A1D13FDCC"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a deadline that does not specify that the form of publication is publication in the
			 Federal Register, the Commission may comply with the deadline by
			 publishing the document in another form.</text></subparagraph><subparagraph id="idD4DFBD50002143ADA9E0C8485F65A74C"><enum>(B)</enum><header>Applicability of Federal Register publication requirements</header><text display-inline="yes-display-inline">Publication of a document in another form as described in subparagraph (A) shall not relieve the
			 Commission of any Federal Register publication requirement applicable to
			 the document, including the requirement under paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="H09A7DD44827D4030A5D4D1D59E98C5F2"><enum>(g)</enum><header>Consumer complaint database</header><paragraph id="HC2A1557C16C644C1B2611B2080838372"><enum>(1)</enum><header>In general</header><text>In evaluating and processing consumer complaints, the Commission shall present information about
			 the complaints in a publicly available, searchable database on the website
			 of the Commission that—</text><subparagraph id="HC72B1F62698E4A72A8856F46E2714B89"><enum>(A)</enum><text>facilitates easy use by consumers; and</text></subparagraph><subparagraph id="H2BA93C2422324D52A6E0E1EDE9BFDCF6"><enum>(B)</enum><text>to the extent practicable, is sortable and accessible by—</text><clause id="H550A427AF8344AAD855A0FD539FE5181"><enum>(i)</enum><text>the date of the filing of the complaint;</text></clause><clause id="H3CF37D3743274824992FA5AD3A102A1D"><enum>(ii)</enum><text>the topic of the complaint;</text></clause><clause id="H7673C8BC62604FD9930062A07ADAC1A8"><enum>(iii)</enum><text>the party complained of; and</text></clause><clause id="HD4BF0435A8404E14ACA911001DDEC78F"><enum>(iv)</enum><text>other elements that the Commission considers in the public interest.</text></clause></subparagraph></paragraph><paragraph id="HF12F02F15C0A40EBB540FFCC94BB281E"><enum>(2)</enum><header>Duplicative complaints</header><text>In the case of multiple complaints arising from the same alleged misconduct, the Commission may
			 satisfy the requirement under paragraph (1) by including  information
			 concerning only 1 such complaint in the database described in paragraph
			 (1).</text></paragraph></subsection><subsection id="HAEBE4A83AE71432888DC3573DAF65FD1"><enum>(h)</enum><header>Form of publication</header><paragraph id="H03C6C57AC1324F42AFA7A70BAE844752"><enum>(1)</enum><header>In general</header><text>In complying with a requirement under this section to publish a document, the Commission shall
			 publish the document on the website of the Commission, in addition to
			 publishing the document in any other form that the Commission is required
			 to use or is permitted to and chooses to use.</text></paragraph><paragraph id="H97232F41F75740AA87E7A3DC7A0942B8"><enum>(2)</enum><header>Exception</header><text>The Commission shall by rule establish procedures for redacting documents required to be published
			 under this section so that the published versions of the documents do not
			 contain—</text><subparagraph id="H246E07B4328F47D9B21B0829570D699D"><enum>(A)</enum><text>information the publication of which would be detrimental to national security, homeland security,
			 law enforcement, or public safety; or</text></subparagraph><subparagraph id="H25421D411CF1463086A9CF05AED6D95E"><enum>(B)</enum><text>information that is proprietary or confidential.</text></subparagraph></paragraph></subsection><subsection id="H74562E8A7B494509B0F8F9FDB725ED0B"><enum>(i)</enum><header>Transparency relating to performance in meeting FOIA requirements</header><text display-inline="yes-display-inline">The Commission shall take additional steps to inform the public about the performance and
			 efficiency of the Commission in meeting the disclosure and other
			 requirements under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code (commonly
			 referred to as the <quote>Freedom of Information Act</quote>), including by—</text><paragraph id="H19CDF0CA91AE4BD28CC20F88B2FCE02C"><enum>(1)</enum><text display-inline="yes-display-inline">publishing on the  website of the Commission the logs used by the Commission for tracking,
			 responding to, and managing requests submitted under such section,
			 including the Commission’s fee estimates, fee categories, and fee request
			 determinations;</text></paragraph><paragraph id="H4921EA197DB44BC69E102BF3F676895D"><enum>(2)</enum><text display-inline="yes-display-inline">releasing to the public all decisions made by the Commission (including decisions made by the
			 Bureaus and Offices of the Commission) granting or denying requests filed
			 under such section, including any such decisions pertaining to the
			 estimate and application of fees assessed under such section;</text></paragraph><paragraph id="H7A8071ECEEE64498BDA79CAF5D8C53EA"><enum>(3)</enum><text display-inline="yes-display-inline">publishing on the website of the Commission electronic copies of documents released under such
			 section; and</text></paragraph><paragraph id="HAEE7E73EA0D447E5B87F73A6C5904157"><enum>(4)</enum><text display-inline="yes-display-inline">presenting, in the annual budget estimates of the Commission submitted to Congress and the annual
			 performance and financial reports of the Commission, information about the
			 handling by the Commission of requests under such section, including—</text><subparagraph id="id1A94F3C9F8C64EC9810CD5BAB38B36D0"><enum>(A)</enum><text display-inline="yes-display-inline">the number of requests under such section the Commission received during the most recent fiscal
			 year;</text></subparagraph><subparagraph id="id5BF2AB9DA5064BF8815110889748DAFC"><enum>(B)</enum><text display-inline="yes-display-inline">the number of requests described in subparagraph (A) granted and denied;</text></subparagraph><subparagraph id="id5E6FCC65B53F45A2AAE7EB2BB6D02095"><enum>(C)</enum><text display-inline="yes-display-inline">a comparison of the processing of  requests described in subparagraph (A) by the Commission during
			 a period of not less than the 3 preceding fiscal years; and</text></subparagraph><subparagraph id="idFF422E9CAA834AA18C057F6170FE3A44"><enum>(D)</enum><text display-inline="yes-display-inline">a comparison of the results of the Commission in processing requests described in subparagraph (A)
			 with the most recent average for the United States Government as published
			 on www.foia.gov.</text></subparagraph></paragraph></subsection><subsection id="H96FC35B541164AA494853B3C34BDD26F"><enum>(j)</enum><header>Prompt release of statistical reports and reports to Congress</header><text display-inline="yes-display-inline">Not later than January 15 of each year, the Commission shall identify, catalog, and publish an
			 anticipated release schedule for all statistical reports and reports to
			 Congress that are regularly or intermittently released by the Commission
			 and will be released during the year.</text></subsection><subsection id="HD05DDD9F46CE43EE92FA6F0A4912FAB0"><enum>(k)</enum><header>Annual scorecard reports</header><paragraph id="H30ED345043914BE5A40CF8B7F65DEE49"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For the 1-year period beginning on January 1 of each year, the Commission shall prepare a report on
			 the performance of the Commission in conducting proceedings and meeting
			 the deadlines established under subsection (b)(2)(E) and the guidelines
			 established under subsection (b)(2)(F).</text></paragraph><paragraph id="HA309A7238ECF48CABB81ED58704D00CB"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each report required under paragraph (1) shall contain detailed statistics on the performance of
			 the Commission as described in paragraph (1), including, with respect to
			 each Bureau of the Commission—</text><subparagraph id="H789FDCEAA0B64249B5D63E933683D3EE"><enum>(A)</enum><text>with respect to each type of filing specified in subsection (b)(2)(E) or (b)(2)(F)—</text><clause id="H09DDA32C40D44E33B35C6EACEDB2F1CE"><enum>(i)</enum><text display-inline="yes-display-inline">the number of filings that were pending on the last day of the period covered by the report;</text></clause><clause id="HFB994DA2DBF64F459DCDA2512D9F0F47"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of filings described in clause (i) for which each applicable deadline or guideline
			 established under such subsection was not met and the average length of
			 time those filings have been pending; and</text></clause><clause id="H2332E954CD0D4BD3961F03E56DB2ECB9"><enum>(iii)</enum><text display-inline="yes-display-inline">for filings that were resolved during the period covered by the report, the average time between
			 initiation and resolution and the percentage for which each applicable
			 deadline or guideline established under such subsection was met;</text></clause></subparagraph><subparagraph commented="no" id="HCC7B298789A4488DBAE80AC93303FD47"><enum>(B)</enum><text>with respect to proceedings before an administrative law judge—</text><clause commented="no" id="HB69DCCA790C44677A5BA250CFA94A81E"><enum>(i)</enum><text>the number of proceedings completed during the period covered by the report; and</text></clause><clause commented="no" id="H1133EBF700854340A98267EF8B5D3059"><enum>(ii)</enum><text>the number of proceedings pending on the last day of the period covered by the report; and</text></clause></subparagraph><subparagraph id="H8312EC5DA67F48AEAA12A26BCC7A806C"><enum>(C)</enum><text>the number of independent studies or analyses published by the Commission during the period covered
			 by the report.</text></subparagraph></paragraph><paragraph id="H9E9DF9E5FF1C4A97AC1E4CFDEAC2A4C0"><enum>(3)</enum><header>Publication and submission</header><text display-inline="yes-display-inline">The Commission shall publish and submit to the Committee on Energy and Commerce of the House of
			 Representatives and the Committee on Commerce, Science, and Transportation
			 of the Senate each report required under paragraph (1) not later than the
			 date that is 30 days after the last day of the period covered by the
			 report.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="H709E6120A5D047A1B47FA24FBE244622"><enum>(b)</enum><header>Effective dates and implementing rules</header><paragraph commented="no" id="H215822EBC4DF4DC38729719ABC1C4404"><enum>(1)</enum><header>Effective dates</header><subparagraph id="HEA7CAD7E4D124F2F9FC5FBC4D9D83815"><enum>(A)</enum><header>Nonpublic collaborative discussions</header><text>Subsection (d) of section 13 of the Communications Act of 1934, as added by subsection (a), shall
			 apply beginning on the first date on which all of the procedural changes
			 to the rules of the Federal Communications Commission required under
			 subsection (b)(1) of such section have taken effect.</text></subparagraph><subparagraph commented="no" id="H9A7F7C19463645F0B68952BC789FBF11"><enum>(B)</enum><header>Schedules and reports</header><text>Subsections (j) and (k) of section 13 of the Communications Act of 1934, as added by subsection
			 (a), shall apply with respect to 2015 and any year thereafter.</text></subparagraph></paragraph><paragraph commented="no" id="HF4F00754A8334A0CB9142F4337A27DC1"><enum>(2)</enum><header>Rules</header><text>Except as otherwise provided in section 13 of the Communications Act of 1934, as added by
			 subsection (a), the Federal Communications Commission shall promulgate any
			 rules necessary to carry out such section not later than 1 year after the
			 date of enactment of this Act.</text></paragraph></subsection></section><section id="H378EA2AF7AC4410DA8C24E45FB242226"><enum>3.</enum><header>Categorization of TCPA inquiries and complaints in quarterly report</header><text display-inline="no-display-inline">In compiling its quarterly report with respect to informal consumer inquiries and complaints, the
			 Federal Communications Commission may not categorize an inquiry or
			 complaint with respect to section 227 of the Communications Act of 1934
			 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) as being a wireline inquiry or complaint or a wireless
			 inquiry or complaint unless the party whose conduct is the subject of the
			 inquiry or complaint is a wireline carrier or a wireless carrier,
			 respectively.</text></section><section id="H84E225921AEE41BC88CB90F65F216335"><enum>4.</enum><header>Effect on other laws</header><text display-inline="no-display-inline">Nothing in this Act or the amendments made by this Act shall relieve the Federal Communications
			 Commission from any obligations under title 5, United States Code, except
			 where otherwise expressly provided.</text></section><section id="H6376F0B131D947ED9E2CCAC1F1916089"><enum>5.</enum><header>Application of Antideficiency Act to Universal Service Program</header><subsection id="H963893C636EE496EBD6EE0A4A252EB3E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 254 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254</external-xref>) is amended by adding at the end the
			 following:</text><quoted-block display-inline="no-display-inline" id="H0C36FF9DB50C4573938104E2CDC2D8A2" style="OLC"><subsection id="H630DC6A54BD244ED880897072915BE0B"><enum>(m)</enum><header>Application of Antideficiency Act</header><text display-inline="yes-display-inline">Section 1341 and subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/15">chapter 15</external-xref> of title 31, United States Code, shall not apply to—</text><paragraph id="HA8F80D2C413A459787D6E19D7B9A31CD"><enum>(1)</enum><text>any amount collected or received as Federal universal service contributions required under this
			 section, including any interest earned on such contributions; or</text></paragraph><paragraph id="H737F2FAFE1954C00BA5456D0B4FD38C3"><enum>(2)</enum><text>the expenditure or obligation of amounts attributable to contributions described in paragraph (1)
			 for universal service support programs established under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA2D94E65EB8D425FAFAA5AA6FE8D50A1"><enum>(b)</enum><header>Repeal of temporary provision</header><text>The Universal Service Antideficiency Temporary Suspension Act (title III of <external-xref legal-doc="public-law" parsable-cite="pl/108/494">Public Law 108–494</external-xref>; 118
			 Stat. 3997) is repealed.</text></subsection></section></legis-body></bill>
