Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To protect surface water from contamination by chemical storage facilities, and for other purposes.</official-title></form><legis-body><section id="id8CABB1C1542F462997828AC5D9138229" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chemical Safety and Drinking Water Protection Act of 2014</short-title></quote>.</text></section><section id="idBD3B9F3E7DDB47CFB704952855195845" section-type="subsequent-section"><enum>2.</enum><header>Protection of surface water from contamination by chemical storage facilities</header><subsection id="idC1B494B1DC5B4E14BE49E9E175EE15D5"><enum>(a)</enum><header>In general</header><text>The Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id0763ab1245354827b47187418270bbb2" style="OLC"><part id="id4CF3E08C902F465BA8F7CCD7354DB4A8" style="OLC"><enum>G<?LEXA-Enum G?></enum><header>Protection of surface water from contamination by chemical storage facilities</header><section id="idC9EB784FB485426DB14AF7F9ADB545C7"><enum>1471.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text><paragraph id="idEBD730079F754279B4C63A35A0271F18"><enum>(1)</enum><header>Covered chemical storage facility</header><subparagraph id="id179566109B634C34BEBBB36FF7AC862C"><enum>(A)</enum><header>In general</header><text>The term <term>covered chemical storage facility</term> means a facility at which a chemical  is stored and the Administrator or State, as applicable, determines that a release of  the chemical from the facility poses a risk of harm to a public water system.</text></subparagraph><subparagraph id="idB31DECD8E65E44D99AF0E357D49BBCD7"><enum>(B)</enum><header>Exclusions</header><text>The term <term>covered chemical storage facility</term> does not include a facility that is subject to a procedure, method, or other requirement for equipment to address hazardous substances pursuant to section 311(j)(1)(C) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321(j)(1)(C)</external-xref>).</text></subparagraph><subparagraph id="id861caff152584a978542f2fa29fc6c85"><enum>(C)</enum><header>Considerations</header><text>In determining risk of harm posed by a chemical storage facility under subparagraph (A), the Administrator or State, as applicable, may consider the requirements of applicable Federal or State laws (including regulations).</text></subparagraph></paragraph><paragraph id="idCF95F872396B4D259A49E14DEB18C356"><enum>(2)</enum><header>State program</header><text>The term <term>State program</term> means a chemical storage facility source water protection program established under section 1472.</text></paragraph></section><section id="idAF7EA4E51A6E4AFD8DBB0317571DFCC5"><enum>1472.</enum><header>Establishment of State programs</header><subsection id="idcf9f856697894f66a047c7314150cd1a"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this part, the Administrator or each  State exercising primary enforcement responsibility for public water systems, as applicable, shall carry out, directly or through delegation, a chemical storage facility source water protection program   to provide for the protection of public water systems from a release of a chemical from a covered chemical storage facility.</text></subsection><subsection id="idc9d81e548c3243efab9815c04ef619eb"><enum>(b)</enum><header>Program requirements</header><paragraph id="idBEECB076B8EE49DFAAED89B431EB5092"><enum>(1)</enum><header>In general</header><text>A State program under subsection (a) shall provide for oversight and inspection of each covered  chemical storage facility in accordance with the requirements described in paragraph (2) to prevent the release of chemicals into the water supply in watersheds with public water systems that rely on surface water, including a covered chemical storage facility located in a source water area  identified under section 1453.</text></paragraph><paragraph id="id305c457fc1d54c05a074f74f8a611c87"><enum>(2)</enum><header>Minimum requirements</header><text>At a minimum, a State program shall include—</text><subparagraph id="id17086e2ab12c4e65b037b6d2e3cb9f96"><enum>(A)</enum><text>requirements for covered chemical storage facilities, including—</text><clause id="id57fee205bbbb46ec81125bdb70cf3977"><enum>(i)</enum><text>acceptable standards of good design, construction, or maintenance;</text></clause><clause id="ide218e7ed561f4bbeb952ed20acabffec"><enum>(ii)</enum><text>leak detection;</text></clause><clause id="id3e93c95c6c854d9da3a35d1931a45574"><enum>(iii)</enum><text>spill and overfill control;</text></clause><clause id="id1bae6c1ffcb14da288525053ee598dd6"><enum>(iv)</enum><text>inventory control;</text></clause><clause id="id36cb4a43e1154a70ac52b004149c51bf"><enum>(v)</enum><text>an emergency response and communication plan;</text></clause><clause id="id492adf3d3c254204ad373ac269bfd8b6"><enum>(vi)</enum><text>an employee training and safety plan;</text></clause><clause id="ide456c436ea0a4423baa9b950fdde0dfc"><enum>(vii)</enum><text>an inspection of the integrity of each covered chemical storage facility;</text></clause><clause id="id8526BD8CD9C84A618C5E52C6CCCF5D4A"><enum>(viii)</enum><text>lifecycle maintenance, including corrosion protection;</text></clause><clause id="id4A8B51B4376B46ECA3289398B9CF28B7"><enum>(ix)</enum><text>notice to the Administrator, the appropriate State agency, and applicable public water systems of—</text><subclause id="idE666EE47BC1940ED8AE0F8F9F57B0414"><enum>(I)</enum><text>the potential toxicity of the stored chemicals to humans and the environment; and</text></subclause><subclause id="idF4E8A31E06CB43B1AD38D9308DAB4DB8"><enum>(II)</enum><text>safeguards or other precautions that can be taken to detect, mitigate, or otherwise limit the adverse effects of a release of the stored chemicals; and</text></subclause></clause><clause id="ida900583a33a64a528e48c56d61f6266d"><enum>(x)</enum><text>financial responsibility requirements, including proof of insurance, bond, or other similar instrument;</text></clause></subparagraph><subparagraph id="idb86dca794783443fab51a85de793b8d0"><enum>(B)</enum><text>inspections of covered chemical storage facilities, which shall occur—</text><clause id="id99a5d4a6144e4b5ead6d44f963108f4f"><enum>(i)</enum><text>for a covered chemical storage facility identified in a source water assessment area under section 1453, not less frequently than once every 3 years; and</text></clause><clause id="id616e7c8b640045cb8dcf4cb6403f136f"><enum>(ii)</enum><text>for any other covered chemical storage facility, not less frequently than once every 5 years; and</text></clause></subparagraph><subparagraph id="idf4c5209f9bbd4737b67a014b01650397"><enum>(C)</enum><text>a comprehensive inventory of the covered chemical storage facilities  in each State.</text></subparagraph></paragraph></subsection><subsection id="idb350ede22d184882a9b4ae7bba8490d7"><enum>(c)</enum><header>National primary drinking water regulations</header><text>For purposes of primary enforcement responsibility,  a State program and any requirements under this part shall be—</text><paragraph id="id59C5AA90E9034E899C4C9F29363CCEFF"><enum>(1)</enum><text>considered to be a part of the national primary drinking water regulations established under section 1412; and</text></paragraph><paragraph id="id7E83F0847C0A456380F209ABF1001815"><enum>(2)</enum><text>implemented and enforced in accordance with the procedures under sections 1413 and 1414 and part E.</text></paragraph></subsection><subsection id="idD28B324C67914A0CB17BBE882AB4375C"><enum>(d)</enum><header>Administration</header><text>A State program shall be carried out—</text><paragraph id="idABF5C8ABC01E4C468C779777C4F04B49"><enum>(1)</enum><text>if the State exercises  primary enforcement responsibility for public water systems in that State under this Act, by the State; and</text></paragraph><paragraph id="id4ABD947BD47049818893D57164E7B388"><enum>(2)</enum><text>if the State does not exercise primary enforcement responsibility for public water systems in that State under this Act, by the Administrator.</text></paragraph></subsection><subsection id="id0E789DC503C94E3981E55DD136BD1984"><enum>(e)</enum><header>Guidance</header><text>The Administrator may issue guidance or provide other technical assistance to State programs in carrying out activities under this part.</text></subsection></section><section id="idFFB866460FD9491084996D91163DF722"><enum>1473.</enum><header>Corrective action orders</header><text display-inline="no-display-inline">The Administrator under section 1472(d)(2) or the State under section 1472(d)(1), as applicable,  may issue an order to the owner or operator of a covered chemical storage facility to carry out this part.</text></section><section id="idfeff674dc24a4e5e874cc3c0cc0c6c08"><enum>1474.</enum><header>Cost recovery</header><text display-inline="no-display-inline">If costs have been incurred by the Administrator or the State, as applicable, for undertaking a response action under this part relating to the release of a chemical, the owner or operator of the covered chemical storage facility shall be liable to the Administrator or the State for those costs.</text></section><section id="id312d5826ad43468f9b85b7f8eb3a4d2a"><enum>1475.</enum><header>Transfer of covered chemical storage facilities</header><text display-inline="no-display-inline">Notwithstanding the inspection schedule under section 1472(b)(2)(B), no person shall transfer a covered chemical storage facility unless—</text><paragraph id="idcb1f8a628dc440eb9518b6b3d3947dda"><enum>(1)</enum><text>prior to the closing or completion of the transfer, the transferor submits to the transferee the results of a pretransfer inspection of the integrity of the covered chemical storage facility, which shall be conducted pursuant to any requirements set by the Administrator under section 1472(d)(2) or the State under section 1472(d)(1), as applicable; and</text></paragraph><paragraph id="id971c79f01e3a4449993e70851cbd1ee9"><enum>(2)</enum><text>the transferor or the transferee agrees to take appropriate measures to address the results of the pretransfer inspection prior to the date that is 30 days after the date on which the covered chemical storage facility closes or is transferred.</text></paragraph></section><section id="id4f0c998d4f7148bb8cfb27065364450c"><enum>1476.</enum><header>Information sharing</header><subsection id="id8b783e4d3eea4e3dac95a4a2a3a8656c"><enum>(a)</enum><header>Information for public water systems</header><text>The Administrator or State, as applicable, shall provide  public water systems with information relating to—</text><paragraph id="id41e6d391e0934dc9a0242c9ccd56d317"><enum>(1)</enum><text>emergency response plans for covered chemical storage facilities located within the same watershed as the public water system; and</text></paragraph><paragraph id="id549772cada0143d1913ff0368c3e57fb"><enum>(2)</enum><text>an inventory of each chemical held at the covered chemical storage facilities described in  paragraph  (1).</text></paragraph></subsection><subsection id="idfde6ee4af6494a58bdb918ee146f3a06"><enum>(b)</enum><header>Emergency response plans</header><text>A copy of each  emergency response plan submitted under section 1472(b)(2)(A) shall be provided to—</text><paragraph id="idF765D1A0F8FF4535A25ED296CEAB59A7"><enum>(1)</enum><text>the Administrator (if the State exercises primary responsibility for public water systems in that State); and</text></paragraph><paragraph id="id6F6EDA5A8F164AFBB82A785D020DA17F"><enum>(2)</enum><text>the Secretary of Homeland Security.</text></paragraph></subsection><subsection id="id4cadfe8e85ae417298faaf18840dfa6e"><enum>(c)</enum><header>Information</header><paragraph id="idb515b2d276424ba3824b5a8e23884898"><enum>(1)</enum><header>In general</header><text>The Administrator or a State, as applicable, may keep confidential information the Administrator or the State  determines to be sensitive and present a security risk to a covered chemical storage facility.</text></paragraph><paragraph id="id43f51d9e37b341a79cfb0d32f08568f9"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not—</text><subparagraph id="ida171692a17f9430cbfebde790a8355a2"><enum>(A)</enum><text>apply to public health information; or</text></subparagraph><subparagraph id="ide473f809f8cb4b9cabd694636a14a6af"><enum>(B)</enum><text>prevent the sharing of information with the Administrator, the Secretary of Homeland Security, a public water system, or a public agency involved in emergency response.</text></subparagraph></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idA9DD7DA83D5D476EB34B7583D098EB11"><enum>(b)</enum><header>Emergency powers</header><text display-inline="yes-display-inline">Section 1431 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300i">42 U.S.C. 300i</external-xref>) is amended—</text><paragraph id="idC40820354AA54876BAF846A7914DEFE6"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph id="idCE68FBA067344CCB9BA47EDEB33C78FC"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block display-inline="no-display-inline" id="id9bd0e24e46f242159db8e4bf6882e7ac" style="OLC"><subsection id="id2e15f04934ac46e5a3164fd4fb10639a"><enum>(b)</enum><header>Petitions</header><paragraph id="id2E2656994E674CF7BEC62E9E42043747"><enum>(1)</enum><header>In general</header><text>In any case in which the Administrator is authorized to act under subsection (a), the owner or operator of a public water system may—</text><subparagraph id="idb48abf2f168f4538b94a59c2ae2c0e8a"><enum>(A)</enum><text>commence a civil action for appropriate equitable relief, including a restraining order or permanent or temporary injunction, to address any activity or facility that may present an imminent and substantial endangerment to the health of persons who are supplied by that public water system; or</text></subparagraph><subparagraph id="ida09ea068b4bb4afdaf1c9112a24798be"><enum>(B)</enum><text>petition the Administrator to issue an order or commence a civil action under subsection (a).</text></subparagraph></paragraph><paragraph id="idCF0B95AC29B64C5EAA6E8789F1AFA64F"><enum>(2)</enum><header>Response</header><subparagraph id="id5003C961D42A47C1835E1C4156061249"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), not later than 30 days after the date on which the Administrator receives a petition under paragraph (1), the Administrator shall respond to the petition and initiate such action as the Administrator determines to be appropriate.</text></subparagraph><subparagraph id="idFB0E5D1980834029A72AA8676C0E26F0"><enum>(B)</enum><header>Special rule for emergencies</header><text>If the owner or  operator of a public water system submits the petition under paragraph (1) in response to an emergency, the Administrator shall respond not later than 72 hours after receipt of the petition.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idD876624EAA2D4C1AA9586A627D9493ED"><enum>(c)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 1414 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-3">42 U.S.C. 300g–3</external-xref>) is amended—</text><paragraph id="idC80525EDC7254C04838FC0FF4394E0B0"><enum>(1)</enum><text display-inline="yes-display-inline">in subsections (a), (b), (e), (f), and (g)—</text><subparagraph id="id0249E40C83C049DF8F8DEA615C6FFEC0"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting after <quote>public water system</quote> each place it appears <quote>or a covered chemical storage facility</quote>; and</text></subparagraph><subparagraph id="id56EC2B927029470381F6A9173ADF815D"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after <quote>public water systems</quote> each place it appears <quote>or a covered chemical storage facility</quote>; and</text></subparagraph></paragraph><paragraph id="idD71960C5339A49BCA652CAD64FAB9079"><enum>(2)</enum><text>in  subsection (i)—</text><subparagraph id="id33B9852D012541729C99D90E11113CE0"><enum>(A)</enum><text>by redesignating paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="id859A83628C2C4E12BFE10D679DFB2DF4"><enum>(B)</enum><text>by striking the heading designation and all that follows through <quote>means—</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id4EA6BAB63E8046F3AEB6B7A2CB1F5FBA" style="OLC"><subsection id="idA3496DD6438648ACB6AB32EECA5E8B2D"><enum>(i)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id6F84F93CE94B4DE5B85A4150A3200AA9"><enum>(1)</enum><header>Applicable requirement</header><text>The term <term>applicable requirement</term> means—</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="id73C8638B5886486D9121BDA04FD1B1FD"><enum>(C)</enum><text>in paragraph (1)(A) (as so redesignated)—</text><clause id="id544816809D9849BFB2174EB2159D1270"><enum>(i)</enum><text>by inserting a comma after <quote>1417</quote>; and</text></clause><clause id="idF6091E6A9DCD42EA9E25757F7E848B13"><enum>(ii)</enum><text>by striking <quote>or 1445</quote> and inserting <quote>1445, or part G</quote>; and</text></clause></subparagraph><subparagraph id="id2BE5C0432262425BB4CA6A78BECAA2A3"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" chemical storage facility</term> has the meaning given the term in section
