<distribution-code display="yes">II</distribution-code><congress>113th CONGRESS</congress><session>2d Session</session><legis-num>S. 1951</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20140116">January 16, 2014</action-date><action-desc><sponsor name-id="S353">Mr. Schatz</sponsor> (for himself and <cosponsor name-id="S176">Mr. Rockefeller</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to make responsible parties liable for certain costs relating to the release of pollutants or contaminants.</official-title></form><legis-body><section id="id7204BA79E2E24914AF3DED7CCAF884A9" section-type="section-one"><enum>1.</enum><header>Environmental liability</header><text display-inline="no-display-inline">Section 107(a) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9607">42 U.S.C. 9607(a)</external-xref>) is amended—</text><paragraph id="idE850ED6A539B433B91AAE3879DEE98BE"><enum>(1)</enum><text>by inserting <quote>(or pollutant or contaminant if the President takes any response measure under section 104(a) with respect to the pollutant or contaminant)</quote> after <quote>hazardous substance</quote> each place it appears;</text></paragraph><paragraph id="idC46758A857FA40A1A6FFA6D93FAA41AD"><enum>(2)</enum><text>by inserting <quote>(or pollutants or contaminants if the President takes any response measure under section 104(a) with respect to the pollutants or contaminants)</quote> after <quote>hazardous substances</quote> each place it appears; and</text></paragraph><paragraph id="id1222E9F11E6E45A8B4B853EE2CE414B2"><enum>(3)</enum><text>in paragraph (4)—</text><subparagraph id="idF27726DB748047A5A3E8098FDEDD528B"><enum>(A)</enum><text>by striking subparagraph (C);</text></subparagraph><subparagraph id="id41643201275C461DB000D325649FB73B"><enum>(B)</enum><text>by redesignating subparagraph (D) as subparagraph (C);</text></subparagraph><subparagraph id="idE067F14A13DE4A8FAFE4B81E328EAC26"><enum>(C)</enum><text>in subparagraph (C) (as so redesignated) by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id8A237BCCC0494E1BB2DBAB44D1A50988"><enum>(D)</enum><text>by adding at the following:</text><quoted-block display-inline="no-display-inline" id="id11B8CAE973A941399656ABD5598AF1C3" style="OLC"><subparagraph id="id619ED32F8CE641FFB7883120B6157779"><enum>(D)</enum><text>except a person described in paragraphs (2) through this  paragraph who engages in conduct prohibited under those paragraphs with respect to pollutants or contaminants, damages for injury to, destruction of, or loss of natural resources, including the reasonable costs of assessing the injury, destruction, or loss resulting from the release.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
