<distribution-code display="yes">II</distribution-code><congress>113th CONGRESS</congress><session>2d Session</session><legis-num>S. 1941</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20140116">January 16, 2014</action-date><action-desc><sponsor name-id="S338">Mr. Manchin</sponsor> (for himself, <cosponsor name-id="S236">Mr. Inhofe</cosponsor>, <cosponsor name-id="S319">Mr. Begich</cosponsor>, and <cosponsor name-id="S321">Mr. Johanns</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish requirements for the adoption of any new or revised requirement providing for the screening, testing, or treatment of an airman or an air traffic controller for a sleep disorder, and for other purposes.</official-title></form><legis-body id="HB7E451E0FF1D46B2A4934B64BA6524B1" style="OLC"><section id="HB5EDFD93DC784D188C0F62B6AC735A35" section-type="section-one"><enum>1.</enum><header>Medical certification requirements for airmen and air traffic controllers relating to sleep disorders</header><subsection id="H8F4E12A350524768B6A10F1C01EB19CB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation may, consistent with accepted medical standards and practices, implement or enforce a requirement providing for the screening, testing, or treatment (including consideration of all possible treatment alternatives) of an airman or an air traffic controller for a sleep disorder—</text><paragraph id="H9BB17ED30D854117897857B09CFC7216"><enum>(1)</enum><text display-inline="yes-display-inline">in the case of an airman, only if the requirement is adopted pursuant to a rulemaking proceeding; and</text></paragraph><paragraph id="H2DF5D3E8D483412DAEAB7343F6A8B146"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of an air traffic controller, only if the Federal Aviation Administration meets its obligations pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/71">chapter 71</external-xref> of title 5, United States Code.</text></paragraph></subsection><subsection id="H70D8826176414C708B500CCE649DD75B"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to a requirement that was in force before November 1, 2013.</text></subsection><subsection id="HBCDD34FC95104DC7819672AF88A766E1"><enum>(c)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text><paragraph id="H12A539AC3B4F47CFBE987337B7917D1E"><enum>(1)</enum><header>Airman</header><text display-inline="yes-display-inline">The term <quote>airman</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/49/40102">section 40102(a)</external-xref> of title 49, United States Code.</text></paragraph><paragraph id="HAADAB94A94FB4DAF98753D6B766BC419"><enum>(2)</enum><header>Air traffic controller</header><text display-inline="yes-display-inline">The term <quote>air traffic controller</quote> means a civilian employee of the Department of Transportation described in <external-xref legal-doc="usc" parsable-cite="usc/5/2109">section 2109</external-xref> of title 5, United States Code.</text></paragraph><paragraph id="H740516EDE0A447D8A259D2EF2E2569EC"><enum>(3)</enum><header>Sleep disorder</header><text display-inline="yes-display-inline">The term <quote>sleep disorder</quote> includes obstructive sleep apnea.</text></paragraph></subsection></section></legis-body></bill>
