			 title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bureau of Reclamation Transparency
			 Act</short-title></quote>.</text></section><section changed="deleted" committee-id="SSEG00" id="idD8AB4B76240F45EB85D2C85190661D29" reported-display-style="strikethrough"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="idde3372f334774e5183987066247bdc2e"><enum>(1)</enum><text>the water resources infrastructure of the Bureau of Reclamation provides important benefits related
			 to irrigated agriculture, hydropower, and recreation in the 17 Reclamation
			 States;</text></paragraph><paragraph id="idca472672aa654c9dae0a8b06b8a3edc8"><enum>(2)</enum><text>as of 2013, the combined replacement value of the infrastructure assets of the Bureau of
			 Reclamation was $94,500,000,000;</text></paragraph><paragraph id="id6a7ba09fa1d748fe8ab74e59e9d703e0"><enum>(3)</enum><text>the majority of the water resources infrastructure facilities of the Bureau of Reclamation are at
			 least 60 years old;</text></paragraph><paragraph id="id836ebc598dde461584c22c6a466e160c"><enum>(4)</enum><text>the Bureau of Reclamation has previously undertaken efforts to better manage the assets of the
			 Bureau of Reclamation, including an annual review of  asset maintenance
			 activities of the Bureau of Reclamation known as the  <quote>Asset Management Plan</quote>; and</text></paragraph><paragraph id="idd6c48b5976474d95aafa72a5168540a9"><enum>(5)</enum><text>actionable information on infrastructure conditions at the project level, including information on
			 maintenance needs and potential public safety threats at individual
			 projects due to aging infrastructure, is needed for Congress to conduct
			 oversight of Reclamation facilities and meet the needs of the public.</text></paragraph></section><section changed="deleted" committee-id="SSEG00" id="idB95063829FA64125BDF4006AE461D4A8" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ida8e003ff3fa24ba7944b746c71fbdae2"><enum>(1)</enum><header>Asset Management Report</header><text>The term <term>Asset Management Report</term> means—</text><subparagraph id="id08C662A6B33E49DB93FEF3393032C08D"><enum>(A)</enum><text>the annual plan prepared by the Bureau of Reclamation known as the <quote>Asset Management Plan</quote>; and</text></subparagraph><subparagraph id="id017C55AF98BC4EBFB6FD5805780068AC"><enum>(B)</enum><text>any publicly available information relating to the plan described in subparagraph (A) that 
			 summarizes the efforts of the Bureau of Reclamation to evaluate and manage
			 infrastructure assets of the Bureau of Reclamation.</text></subparagraph></paragraph><paragraph id="id6ca761893cb0403586cdf766a2b61ee9"><enum>(2)</enum><header>Major repair and rehabilitation need</header><text>The term <quote>major repair and rehabilitation need</quote> means a significant maintenance need at a Reclamation facility, including maintenance related to
			 the safety of dams, extraordinary operations at and maintenance of dams,
			 deferred maintenance, and all other significant repairs and extraordinary
			 maintenance.</text></paragraph><paragraph id="id8BDB3B9578EA4DFC95F127DEFE5288C8"><enum>(3)</enum><header>Reclamation
			 facility</header><text>The term <term>Reclamation facility</term> means each of the
			 infrastructure assets that are owned by the Bureau of Reclamation 
			 at a Reclamation project.</text></paragraph><paragraph id="id9E55D9DEA0164D2D97FC52C053C66E62"><enum>(4)</enum><header>Reclamation project</header><text>The term <quote>Reclamation project</quote> means a project that is owned by the Bureau of Reclamation, including all reserved works and
			 transferred works owned by the Bureau of Reclamation.</text></paragraph><paragraph id="id48821E326941402EA2285F01A15B8143"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section><section changed="deleted" committee-id="SSEG00" id="id7B39255E1E9A43088F39EE21FCC2E8EA" reported-display-style="strikethrough"><enum>4.</enum><header>Asset management
			 report enhancements</header><subsection id="idD497AEE4B58849CF890C9CB117F885F7"><enum>(a)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to
			 Congress a report
			 that—</text><paragraph id="id934478DC94FD4B6AB7A741EE2F637354"><enum>(1)</enum><text>describes the efforts of the Bureau of Reclamation—</text><subparagraph id="id6996B826D1E94065A34787CB4BC61295"><enum>(A)</enum><text>to manage all Reclamation facilities; and</text></subparagraph><subparagraph id="id2c747a5745d045bf805eee9a051f6179"><enum>(B)</enum><text>to standardize and streamline data reporting and processes across regions and areas for the purpose
			 of managing Reclamation facilities; and</text></subparagraph></paragraph><paragraph id="id205A23EB6C17491C973B2ECC46B76A43"><enum>(2)</enum><text>expands on the information otherwise provided in Asset Management Reports, in accordance with
			 subsection (b).</text></paragraph></subsection><subsection id="id1848085AF70440E288B50A6392548DB8"><enum>(b)</enum><header>Infrastructure
			 Maintenance Needs Assessment</header><paragraph id="id1900085449564F7BA7C6F423B8B85A76"><enum>(1)</enum><header>In
			 general</header><text>The report submitted under subsection (a) shall
			 include—</text><subparagraph id="idA8DE1C7B83294652973BE6E551134A4D"><enum>(A)</enum><text>a detailed
			 assessment of major repair and rehabilitation needs at all Reclamation
			 projects;
			 and</text></subparagraph><subparagraph id="id4B6ECFEF47124683BCC3F790A37F3772"><enum>(B)</enum><text>to the extent
			 practicable, an itemized list of  major repair and rehabilitation needs of
			 individual Reclamation facilities at each Reclamation project.</text></subparagraph></paragraph><paragraph id="id05A330A7E71C43CD88A14B7152BC093A"><enum>(2)</enum><header>Inclusions</header><text>To
			 the extent practicable, the itemized list of major repair and
			 rehabilitation needs under paragraph (1)(B) shall include—</text><subparagraph id="id9e1f90d6cd77485abb33d36b9809db23"><enum>(A)</enum><text>a cost estimate
			 of the expenditures needed to complete each item; and</text></subparagraph><subparagraph id="ide4d8fb47d434439d90679419b86c5c9d"><enum>(B)</enum><text>an assignment of a categorical rating of 1, 2, 3, 4, or 5 for each item, consistent with paragraph
			 (3).</text></subparagraph></paragraph><paragraph id="idBF4FB6D794EA41889D9AD34908BBDCAE"><enum>(3)</enum><header>Rating requirements</header><subparagraph id="idE54E3BC15BA44ED5BF41175EF3C89A30"><enum>(A)</enum><header>In general</header><text>The system for assigning ratings  under paragraph (2)(B) shall be—</text><clause id="id64713DBD14744970839FAABA55ADBCFA"><enum>(i)</enum><text>consistent with existing uniform categorization systems for the safety of dams projects; and</text></clause><clause id="id5ECE0F019881437DBBF8D7E27455B373"><enum>(ii)</enum><text>subject to any regulations issued under subparagraph (B).</text></clause></subparagraph><subparagraph id="id53827077EEA5401F99942C7AC680D4B1"><enum>(B)</enum><header>Regulations</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall issue
			 regulations that describe the applicability of the rating system
			 applicable under paragraph (2)(B) to Reclamation facilities.</text></subparagraph></paragraph><paragraph id="id3677007647e249b9bc9661a363e90dca"><enum>(4)</enum><header>Public
			 availability</header><text>Except as provided in paragraph (5), the Secretary
			 shall make publically available, including on the Internet, the report
			 required
			 under subsection (a).</text></paragraph><paragraph id="id793f8a8c999c4fe4830977c1ef54359d"><enum>(5)</enum><header>Confidentiality</header><text>Subject to the discretion of the Secretary,  the Secretary may exclude from the public version of
			 the report made available under paragraph (4) any information that the
			 Secretary identifies as sensitive or classified, but shall make
			 available to the Committee on Energy and Natural Resources of the Senate
			 and
			 the Committee on Natural Resources of the House of Representatives a
			 version of
			 the report containing the sensitive or classified information.</text></paragraph></subsection><subsection id="id5F885D2D9C4E44BFAA1D7048295241B1"><enum>(c)</enum><header>Updates</header><text>Not later than 2 years after the date on which the report is submitted under subsection (a) and
			 biennially thereafter, the Secretary shall update the report, subject to
			 the requirements of subsection (b).</text></subsection><subsection id="idD8847C4F22B8495EB31CE1DC40046564"><enum>(d)</enum><header>Consultation</header><text>The Secretary shall consult with the Secretary of the Army (acting through the Chief of Engineers)
			 to the extent that the consultation would assist the Secretary in
			 preparing the report under subsection (a) and updates to the report under
			 subsection (c).</text></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section changed="added" committee-id="SSEG00" id="id37aa4a8a-81ea-4172-abf3-f68335760869" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bureau of Reclamation Transparency
			 Act</short-title></quote>.</text></section><section changed="added" committee-id="SSEG00" id="id7d3a9170-87e0-4ba1-8b27-c5e395f33c06" reported-display-style="italic"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="idc3753ffd-3035-4bfb-a6a3-488cadc8d02e"><enum>(1)</enum><text>the water resources infrastructure of the Bureau of Reclamation provides important benefits related
			 to irrigated agriculture, municipal and industrial water, hydropower,
			 flood control, fish and wildlife, and recreation in the 17 Reclamation
			 States;</text></paragraph><paragraph id="idfc166063-e405-4cac-91f7-3319d784feba"><enum>(2)</enum><text>as of 2013, the combined replacement value of the infrastructure assets of the Bureau of
			 Reclamation was $94,500,000,000;</text></paragraph><paragraph id="idc8e562e3-c5b8-4b12-b5b7-23bc83b5ee30"><enum>(3)</enum><text>the majority of the water resources infrastructure facilities of the Bureau of Reclamation are at

			 maintenance needs at individual
			 assets due to aging infrastructure, is needed for Congress to conduct
			 oversight of Reclamation facilities and meet the needs of the public.</text></paragraph></section><section changed="added" committee-id="SSEG00" id="idf22a3aa4-6205-4672-8402-f9d1e38c72c4" reported-display-style="italic" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="iddbc3e741a0734dc1921ea16c22ae87a3"><enum>(1)</enum><header>Asset</header><subparagraph id="idCBA109789B5241F7A0722156915B529E"><enum>(A)</enum><header>In general</header><text>The term <quote>asset</quote> means any of the following assets that are used to achieve the mission of the Bureau of
			 Reclamation to
			 manage, develop, and protect water and related resources in an
			 environmentally and economically sound manner in the interest of the
			 people of the United States:</text><clause id="id9A54691EC0A94D399E717BBBB887D412"><enum>(i)</enum><text>Capitalized facilities, buildings, structures, project features, power
			 production equipment, recreation facilities, or quarters.</text></clause><clause id="id5699BA2265DA4864A22CDB87C21AE6A9"><enum>(ii)</enum><text>Capitalized and noncapitalized heavy equipment and other
			 installed equipment.</text></clause></subparagraph><subparagraph id="id59D9CB45E80A4EC289326CF4A3ABEECE"><enum>(B)</enum><header>Inclusions</header><text>The term <quote>asset</quote> includes assets described in subparagraph (A) that are considered to be mission critical.</text></subparagraph></paragraph><paragraph id="idb5930a0f-9a57-4e70-a408-cc8d4b9cda45"><enum>(2)</enum><header>Asset Management Report</header><text>The term <term>Asset Management Report</term> means—</text><subparagraph id="idedebbd39-1fdb-488b-9870-8db3afff1875"><enum>(A)</enum><text>the annual plan prepared by the Bureau of Reclamation known as the <quote>Asset Management Plan</quote>; and</text></subparagraph><subparagraph id="id83b82434-e4ab-4a57-ba77-240bd8248217"><enum>(B)</enum><text>any publicly available information relating to the plan described in subparagraph (A) that 
			 summarizes the efforts of the Bureau of Reclamation to evaluate and manage
			 infrastructure assets of the Bureau of Reclamation.</text></subparagraph></paragraph><paragraph id="idde4c9909-7e55-4992-8c26-8365810501a7"><enum>(3)</enum><header>Major repair and rehabilitation need</header><text>The term <quote>major repair and rehabilitation need</quote> means major nonrecurring maintenance at a Reclamation facility, including maintenance related to
			 the safety of dams, extraordinary  maintenance of dams, deferred major
			 maintenance activities, and all other significant repairs and
			 extraordinary maintenance.</text></paragraph><paragraph id="ide5d964a0-f963-4dad-8761-256c5a7b4e9b"><enum>(4)</enum><header>Reclamation
			 facility</header><text>The term <term>Reclamation facility</term> means each of the
			 infrastructure assets that are owned by the Bureau of Reclamation 
			 at a Reclamation project.</text></paragraph><paragraph id="idf9322d89-341d-4ba1-b5be-fa21c873dd1d"><enum>(5)</enum><header>Reclamation project</header><text>The term <quote>Reclamation project</quote> means a project that is owned by the Bureau of Reclamation, including all reserved works and
			 transferred works owned by the Bureau of Reclamation.</text></paragraph><paragraph id="id6640c9a0eccf448ea8298cef439f4c4f"><enum>(6)</enum><header>Reserved works</header><text>The term <term>reserved works</term> means buildings, structures, facilities, or equipment that are owned by the Bureau of Reclamation
			 for which
			 operations and maintenance are performed by employees of the Bureau of
			 Reclamation or through a contract entered into by the Bureau of
			 Reclamation, regardless of  the source of funding for the operations and
			 maintenance.</text></paragraph><paragraph id="idbae13cbb-8e38-4a9c-aa2e-0148578b3221"><enum>(7)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id390b6ba5b3ce4476abd2dbc34471c128"><enum>(8)</enum><header>Transferred works</header><text>The term <term>transferred works</term> means a Reclamation facility at which operations and maintenance of the facility is carried out by
			 a
			 non-Federal entity under the provisions of a formal operations and
			 maintenance transfer contract or other legal agreement with the Bureau of 
			 Reclamation.</text></paragraph></section><section changed="added" committee-id="SSEG00" id="id3dde4389-c571-46cf-877b-1270b4fb4bf0" reported-display-style="italic"><enum>4.</enum><header>Asset management
			 report enhancements for reserved works</header><subsection id="id76dd6017-944c-4016-bf30-0fd895c9a9b6"><enum>(a)</enum><header>In
			 general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall submit to
			 Congress an Asset Management Report
			 that—</text><paragraph id="id463b547b-7314-4652-8774-9fb29a5eb302"><enum>(1)</enum><text>describes the efforts of the Bureau of Reclamation—</text><subparagraph id="id1f72e238-4e74-4788-80ca-61359d6839a9"><enum>(A)</enum><text>to maintain in a reliable manner all reserved works at Reclamation facilities; and</text></subparagraph><subparagraph id="id5d22be21-f03a-4384-869b-f8dc7e6876c8"><enum>(B)</enum><text>to standardize and streamline data reporting and processes across regions and areas for the purpose
			 of maintaining reserved works at Reclamation facilities; and</text></subparagraph></paragraph><paragraph id="id9cb80aa6-2aaf-481c-80a5-1ef53eba6cf3"><enum>(2)</enum><text>expands on the information otherwise provided in an Asset Management Report, in accordance with
			 subsection (b).</text></paragraph></subsection><subsection id="idaed1aa04-6bac-4491-afd5-cb8c18af1d59"><enum>(b)</enum><header>Infrastructure
			 Maintenance Needs Assessment</header><paragraph id="id2d9c8d61-4633-4ef7-8642-cc2ea286e6e5"><enum>(1)</enum><header>In
			 general</header><text>The Asset Management Report submitted under subsection (a) shall
			 include—</text><subparagraph id="id2e60b27e-8425-4f0d-acf1-3836eb839fe9"><enum>(A)</enum><text>a detailed
			 assessment of major repair and rehabilitation needs for all reserved works
			 at all Reclamation
			 projects;
			 and</text></subparagraph><subparagraph id="id11f83c46-6e7a-4b4e-b17e-83d077df6b0d"><enum>(B)</enum><text>to the extent
			 practicable, an itemized list of  major repair and rehabilitation needs of
			 individual Reclamation facilities at each Reclamation project.</text></subparagraph></paragraph><paragraph id="id008bf33e-6826-45ae-8764-859a19ce4d6b"><enum>(2)</enum><header>Inclusions</header><text>To
			 the extent practicable, the itemized list of major repair and
			 rehabilitation needs under paragraph (1)(B) shall include—</text><subparagraph id="id9c171d0d-8795-4633-998f-7a8f1b4cc52e"><enum>(A)</enum><text>a budget level cost estimate
			 of the appropriations needed to complete each item; and</text></subparagraph><subparagraph id="id26c63c80-4887-496a-88a4-dde977953b8a"><enum>(B)</enum><text>an assignment of a categorical rating for each item, consistent with paragraph
			 (3).</text></subparagraph></paragraph><paragraph id="id6e6ef0f8-9a22-4207-8fab-5a336e8a78d9"><enum>(3)</enum><header>Rating requirements</header><subparagraph id="id1304ae3e-44d3-4aa8-8f84-4cc3d791b969"><enum>(A)</enum><header>In general</header><text>The system for assigning ratings  under paragraph (2)(B) shall be—</text><clause id="idf83f19ec-ec87-4228-bb67-5a676e756191"><enum>(i)</enum><text>consistent with existing uniform categorization systems  to inform the annual budget process and
			 agency requirements; and</text></clause><clause id="idab80489e-f6cc-4081-8ce7-bdefd27b8a88"><enum>(ii)</enum><text>subject to the guidance and instructions issued under subparagraph (B).</text></clause></subparagraph><subparagraph id="id6d9d6e7d-232e-468d-80cf-7b0deb116020"><enum>(B)</enum><header>Guidance</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall issue
			 guidance that describes the applicability of the rating system
			 applicable under paragraph (2)(B) to Reclamation facilities.</text></subparagraph></paragraph><paragraph id="id81c2718e-c6a7-4532-85f2-2b8495586fcd"><enum>(4)</enum><header>Public
			 availability</header><text>Except as provided in paragraph (5), the Secretary
			 shall make publically available, including on the Internet, the Asset
			 Management Report
			 required
			 under subsection (a).</text></paragraph><paragraph id="idae304691-1f2f-4e09-9b39-532e6b94e1d2"><enum>(5)</enum><header>Confidentiality</header><text>Subject to the discretion of the Secretary,  the Secretary may exclude from the public version of
			 the Asset Management Report made available under paragraph (4) any
			 information that the
			 Secretary identifies as sensitive or classified, but shall make
			 available to the Committee on Energy and Natural Resources of the Senate
			 and
			 the Committee on Natural Resources of the House of Representatives a
			 version of
			 the report containing the sensitive or classified information.</text></paragraph></subsection><subsection id="id445ddad8-4bd3-4df3-92c2-9909f11dc8ce"><enum>(c)</enum><header>Updates</header><text>Not later than 2 years after the date on which the Asset Management Report is submitted under
			 subsection (a) and
			 biennially thereafter, the Secretary shall update the Asset Management
			 Report, subject to
			 the requirements of section 5(b)(2).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd137d8bb-b6cf-4899-83f4-e0c35c7c78aa"><enum>(d)</enum><header>Consultation</header><text>The Secretary shall consult with the Secretary of the Army (acting through the Chief of Engineers)
			 to the extent that the consultation would assist the Secretary in
			 preparing the Asset Management Report under subsection (a) and updates to
			 the Asset Management Report under
			 subsection (c).</text></subsection></section><section changed="added" commented="no" committee-id="SSEG00" display-inline="no-display-inline" id="id01DF6664CD9B42519DBCE44AF4607B81" reported-display-style="italic"><enum>5.</enum><header>Asset management report enhancements for transferred works</header><subsection id="id57cd1c17fe8f4270bf3eae5ef3547ac2"><enum>(a)</enum><header>In general</header><text>The Secretary shall coordinate with the non-Federal entities responsible for the operation and
			 maintenance of transferred works in developing reporting requirements for
			 Asset Management Reports with respect to the condition of, and planned
			 maintenance for,	 transferred works
			 that are similar to the reporting requirements described in section 4(b)</text></subsection><subsection id="id887A460D5D97422188D44DCEA04E245B"><enum>(b)</enum><header>Guidance</header><paragraph id="id3892D570B253467ABA8970F72DDFF26C"><enum>(1)</enum><header>In general</header><text>After considering input from water and power contractors of the Bureau of Reclamation, the
			 Secretary shall develop and implement a rating system for transferred
			 works that incorporates, to the maximum extent practicable, the rating
