			 integrity of background investigations, to update guidelines for position
			 designation, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="ide4c6d2eaeec84e16bf4fdd7ec0c14675" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Security Clearance Accountability, Reform, and Enhancement Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id15166071085b453f8c0dd064a17e9e0f" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="id136357358eab4a9eafc06e77f2b55ef7"><enum>(1)</enum><text display-inline="yes-display-inline">the  term  <term>agency</term>  has  the  meaning given the	term in Executive
			 Order 13467 (73 Fed. Reg. 38103);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDA8B969916394AEC899E6CEC0526A1EA"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>appropriate agency</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idCFDB78A5E3FA44AC85D997D4FD715CE2"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a prime contractor for a covered contract, the agency with which the prime
			 contractor entered the covered
			 contract; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3877B434D06B4879BCE955ABE4EE919D"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a subcontractor for a covered contract,	any agency on whose behalf the
			 subcontractor is performing work under the covered contract;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2B902F8E029142D2B4F44B8560B53684"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idFA38D56D75CA4EECA558B5081858D9AE"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs and the Select Committee on
			 Intelligence of the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8A40DE08E83442788675F80EFFC89F3E"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Government Reform and the Permanent Select Committee on Intelligence
			 of the House of Representatives;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9EB42C6623844050ADDE9124326B6C33"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>background investigation</term> means any investigation required for the purpose of determining the—</text><subparagraph commented="no" display-inline="no-display-inline" id="id67097731012A43F2AA369A701DFC2D17"><enum>(A)</enum><text display-inline="yes-display-inline">eligibility of a covered individual for logical and physical access to federally controlled
			 facilities or information systems;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5417E1D637444C9081AE661EFBC58779"><enum>(B)</enum><text display-inline="yes-display-inline">suitability  or fitness of a covered individual for Federal employment;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id735CECF3DC98474A8AC6FFA75437FB05"><enum>(C)</enum><text display-inline="yes-display-inline">eligibility of a covered individual for access to classified information or to hold a national
			 security sensitive
			 position; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBA6E70B125244207AE812796243EA187"><enum>(D)</enum><text display-inline="yes-display-inline">fitness of a covered individual to perform work for or on behalf of the United States
			 Government as a contractor employee;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3bc785d652d44f268861e24a819dd088"><enum>(5)</enum><text display-inline="yes-display-inline">the  term  <term>covered contract</term> means	a  contract to conduct background investigations—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0775e2290af54a1ca0da892a30191a8f"><enum>(A)</enum><text display-inline="yes-display-inline">between an  agency and	a  prime  contractor;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idba19a72eab174bf59e35e999223a081e"><enum>(B)</enum><text display-inline="yes-display-inline">between a prime contractor and a subcontractor, if the prime contractor has a contract with an
			 agency; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbe296d2d744a45469473f3ff6977eb15"><enum>(C)</enum><text display-inline="yes-display-inline">between subcontractors, if one of the subcontractors has a contract with a prime contractor  that
			 has a contract with an agency;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaae0612b20064ba3913039a74ddbb4d8"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>covered individual</term> means an individual who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9C7366D2DC444EE29791177350EB7D96"><enum>(A)</enum><text display-inline="yes-display-inline">performs work for or on behalf of an agency;  or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE8C269F0A2504B8487665B509B182AC4"><enum>(B)</enum><text display-inline="yes-display-inline">seeks to perform
			 work for or on behalf of an agency;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbab1b807e9c744de9b2d8cad4506396c"><enum>(7)</enum><text display-inline="yes-display-inline">the term  <term>covered misconduct</term> means misconduct affecting the integrity of a background investigation conducted  by or for  an
			 agency
			 with investigative authority to conduct background
			 investigations, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida55988bc362c4404a2d10c471cd28914"><enum>(A)</enum><text display-inline="yes-display-inline">falsification of any information relating to a background investigation; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide9e47f0f40ed4ff3ac42bd9b44881482"><enum>(B)</enum><text display-inline="yes-display-inline">other  serious	misconduct  that   compromises	the  integrity	of a  background  investigation;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21bbd552f4cb4a43b94f44da267c5deb"><enum>(8)</enum><text display-inline="yes-display-inline">the  term  <term>prime contractor</term> means an individual  who enters into a contract with an agency; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf3e7b668d23a4250894ff933bb4496e0"><enum>(9)</enum><text display-inline="yes-display-inline">the  term  <term>subcontractor</term> means	an individual  who has contracted with a prime contractor or with another subcontractor to
			 perform
			 a contract on behalf of an agency.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id7e3126f47f594bcabd53aafaf7972872" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Accountability of individuals involved in misconduct affecting the integrity of  agency background
			 investigations</header><subsection commented="no" display-inline="no-display-inline" id="idb6395b37b3374bccabc5a21142e81bea"><enum>(a)</enum><header display-inline="yes-display-inline">Misconduct by Federal employees</header><paragraph commented="no" display-inline="no-display-inline" id="idEF4285F39B504AF98B064010C1CBA0DF"><enum>(1)</enum><header display-inline="yes-display-inline">Unfit	for	Federal employment</header><text display-inline="yes-display-inline">If an agency determines that an  employee of the agency has	engaged   in  covered misconduct,
			 the employee  shall  be
			  found unfit  for Federal employment.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id528EBFAE39C841A9BD754377E9DECC52"><enum>(2)</enum><header display-inline="yes-display-inline">Fitness determinations</header><text display-inline="yes-display-inline">An agency shall make a determination under paragraph (1) in accordance with any statutory,
			 regulatory,
			 or internal agency procedures applicable to investigating alleged
			 misconduct by employees of the agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2A6C6A6D5E194C17BBC556D3BCC882D3"><enum>(3)</enum><header display-inline="yes-display-inline">Prohibition on reemployment to conduct background investigations</header><text display-inline="yes-display-inline">If an agency determines under paragraph (1) that an individual is unfit for Federal
			 employment, the individual shall not be appointed to or continue to occupy
			 a
			 position, as an employee of any agency, that requires its occupant to
			 perform background investigations.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id88bf9857481344eb907c921b4e7c1ce6"><enum>(b)</enum><header display-inline="yes-display-inline">Misconduct by employees under contract</header><paragraph commented="no" display-inline="no-display-inline" id="id027e117ae5ff40cba1f2ccfb724ada90"><enum>(1)</enum><header display-inline="yes-display-inline">Ineligibility for performance of work under a covered contract</header><text display-inline="yes-display-inline">If an appropriate agency, prime contractor, or subcontractor determines that an individual
			 performing work under a covered contract has engaged in covered
			 misconduct, the individual shall be ineligible to perform background
			 investigations under a covered contract.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21036F8C7A2F43FFA5474E508F8EA740"><enum>(2)</enum><header display-inline="yes-display-inline">Mandatory    disclosure</header><text display-inline="yes-display-inline">A  covered  contract shall  include a  provision
			 requiring  a  prime contractor   or 
			 subcontractor	to  disclose to each appropriate agency any allegation of 
			 covered
			 misconduct by an  employee of	the prime contractor  or
			 subcontractor 
			 not later than 24 hours after the prime contractor or subcontractor
			 discovers the alleged covered misconduct.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a89b66dbd3b4798b49cd53e45ccdaf3"><enum>(3)</enum><header display-inline="yes-display-inline">Investigation of covered misconduct</header><subparagraph commented="no" display-inline="no-display-inline" id="id12F3F075F724492C945FD25D5A674C15"><enum>(A)</enum><header display-inline="yes-display-inline">Contractor investigation</header><text display-inline="yes-display-inline">A  covered  contract shall  include a  provision
			 requiring that,  not later than 5 business days after the date on which a
			 prime contractor or subcontractor discloses an allegation under paragraph
			 (2), the prime contractor or  subcontractor shall refer the allegation of
			 covered misconduct to the agency for investigation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF393AFF0BDF643EAB265659B54FFAD74"><enum>(B)</enum><header display-inline="yes-display-inline">Agency investigation</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) shall  be construed to prohibit an appropriate agency from conducting
			 its own investigation into an allegation of covered misconduct.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCA9844D8037045A6805D5D1443B992D2"><enum>(4)</enum><header display-inline="yes-display-inline">Prohibition on reemployment to conduct background investigations</header><text display-inline="yes-display-inline">If an appropriate agency determines, based on an investigation conducted under paragraph (3), that
			 an individual is ineligible to perform work under a covered contract under
			 paragraph (1), the individual shall be prohibited  from performing
			 background investigations under any covered contract.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id677E3E620DCA46539545F3A0ECEA33EF"><enum>(5)</enum><header display-inline="yes-display-inline">Modification of existing contracts</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, any covered contract that is in
			 effect and was entered into before the date of enactment of this Act shall
			 be modified to include the provisions required under paragraphs (2) and
			 (3).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7fe707b53ad24f99bcb6c0b4e75ca5b3"><enum>(c)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter,  the
			 President shall submit to the appropriate  congressional committees a
			 report providing—</text><paragraph commented="no" display-inline="no-display-inline" id="id2da41abba0ac48b291d8f700e7189e9a"><enum>(1)</enum><text display-inline="yes-display-inline">the number of individuals determined to be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id626F8241E3874AD086A4A0F5308ECA11"><enum>(A)</enum><text display-inline="yes-display-inline">unfit for Federal employment under subsection (a); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0470269B0ABF47218D5D1853566C58CA"><enum>(B)</enum><text display-inline="yes-display-inline">ineligible to perform work under a covered contract under subsection (b); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id811b39109ae54de0a19ba17e321b7c69"><enum>(2)</enum><text display-inline="yes-display-inline">details  of the covered misconduct that  resulted  in	each determination described in paragraph
			 (1).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idd9aaca0b4de542f9848ddaa7292128c2" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Review and update of position designation guidance</header><subsection commented="no" display-inline="no-display-inline" id="idC99AF32E9B2F4689AB972859F4FE22EE"><enum>(a)</enum><header display-inline="yes-display-inline">Guidelines</header><paragraph commented="no" display-inline="no-display-inline" id="id6e2dc7a281f14645acfc2be79e260186"><enum>(1)</enum><header display-inline="yes-display-inline">Initial   review  and	update	 of    guidance</header><text display-inline="yes-display-inline">Not  later  than  180  days  after  the  date  of  enactment  of  this	Act,  the  President shall 
			 review  and, if appropriate, update  the guidance the President issues to
			 assist 
			 agencies in determining—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2144d433cb484508b151b1a625e49541"><enum>(A)</enum><text display-inline="yes-display-inline">position sensitivity designation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf81258e153da401da2d674abf2e51002"><enum>(B)</enum><text display-inline="yes-display-inline">the appropriate background investigation to initiate for each position designation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb66d33afb90b49219717de1f07cd71ff"><enum>(2)</enum><header display-inline="yes-display-inline">Reviews and  revisions of  position designations</header><text display-inline="yes-display-inline">Not less frequently than  every 5 years,  the  President,  acting  through  relevant  agencies 
			 (as determined by the President)  and in accordance  with the guidance
			 described in paragraph  (1),  shall  review and, if necessary, revise the
			 position designation of positions within agencies.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9d8130cc4624443c9cd40a4a7054bfb2"><enum>(b)</enum><header display-inline="yes-display-inline">Reports to Congress</header><text display-inline="yes-display-inline">Not later than 30 days after  completing a  review under  subsection	(a)(2),  the  President 
			 shall	submit	to  the  appropriate  congressional  committees a report
			 on—</text><paragraph commented="no" display-inline="no-display-inline" id="id11DE7F2FB68B4B07BC71270D33A77A59"><enum>(1)</enum><text display-inline="yes-display-inline">any issues identified in the review;  and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFFA79283CB5F475F8699C3369EC61FB2"><enum>(2)</enum><text display-inline="yes-display-inline">the number of position designations revised
			 as a result of the review.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1a3594668a72459abbdb5030282e925e"><enum>(c)</enum><header display-inline="yes-display-inline">No   change    in   authority</header><text display-inline="yes-display-inline">Nothing  in  this section limits or expands the authority  of any agency to  designate a position
			 as sensitive or as requiring its occupant to have access to classified
