			 provide for reforms and rates of pay for border patrol agents.</official-title></form><legis-body><section changed="deleted" committee-id="SSGA00" id="idA752956B91A4429F8C6F313622871ACD" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Patrol Agent Pay Reform Act of 2013</short-title></quote>.</text></section><section changed="deleted" committee-id="SSGA00" id="id8D065BEC5FDB40F7B8C7B6BCCBF158E1" reported-display-style="strikethrough"><enum>2.</enum><header>Border patrol rate of pay</header><subsection id="id5904B4E06E2E4AC8BE7E93A592153A60"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purposes of this Act are—</text><paragraph id="idEA9ADB5553D54B459E949ACE3BB4B5E4"><enum>(1)</enum><text display-inline="yes-display-inline">to strengthen U.S. Customs and Border Protection and ensure border patrol agents are sufficiently
			 ready to conduct necessary work and that agents will perform overtime
			 hours in excess of a 40-hour work week based on the needs of the employing
			 agency; and</text></paragraph><paragraph id="idE5C847863CE5462F8568A309D69A400E"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure U.S. Customs and Border Protection has the flexibility to cover shift changes and retains
			 the right to assign scheduled and unscheduled work for mission
			 requirements and planning based on operational need.</text></paragraph></subsection><subsection id="idA07F2D3D08334889AFAA26BE69A5708F"><enum>(b)</enum><header>Rates of pay</header><text>Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended by inserting after section
			 5549 the following:</text><quoted-block changed="deleted" committee-id="SSGA00" display-inline="no-display-inline" id="idB13C943D084F48CEAD5EBEA79B83D9B0" reported-display-style="strikethrough" style="USC"><section id="id411774EA009C48BFBF2F8049DCF10537"><enum>5550.</enum><header>Border patrol rate of pay</header><subsection id="id548FC95FFAD9458D9A0FD5F6E6A1E79A"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id7491b4cc4a434343a3c61a31fa9bd448"><enum>(1)</enum><text>the term <term>available to work</term> means a border patrol agent is generally and reasonably accessible by U.S. Customs and Border
			 Protection to perform unscheduled duty based on the needs of U.S. Customs
			 and Border Protection;</text></paragraph><paragraph id="idebe21323a6ce41cbb20b5f5efe518d64"><enum>(2)</enum><text>the term <term>border patrol agent</term> means an individual who is performing functions included under position classification series 1896
			 (Border Patrol Enforcement) of the Office of Personnel Management, or any
			 successor thereto, including performing covered border patrol activities;</text></paragraph><paragraph id="id6ACF561C5F224996B292DFD6F81FB38E"><enum>(3)</enum><text>the term <term>covered border patrol activities</term> means a border patrol agent is—</text><subparagraph id="id48bbaae14894442480ba1e67846ba925"><enum>(A)</enum><text>detecting and preventing illegal entry and smuggling of aliens, commercial goods, narcotics,
			 weapons, or contraband into the United States;</text></subparagraph><subparagraph id="id28D34C8A0E9D4B538B0F6880D0072021"><enum>(B)</enum><text>arresting individuals suspected of conduct described in subparagraph (A);</text></subparagraph><subparagraph id="id6A4D1A6387C54A1E88201C7340068CE8"><enum>(C)</enum><text>attending training authorized by U.S. Customs and Border Protection;</text></subparagraph><subparagraph id="id8df65b81e78a4597b36b457a6059cdd1"><enum>(D)</enum><text>on approved annual, sick, or administrative leave;</text></subparagraph><subparagraph id="idb2ef19aaf2d4427b886caff077fe2bc6"><enum>(E)</enum><text>on ordered travel status;</text></subparagraph><subparagraph id="id0e5cbd18271f49d387498061d29671b4"><enum>(F)</enum><text>on official time, within the meaning of section 7131;</text></subparagraph><subparagraph id="idf5bb76bba0654cb3bd48de4da002f06a"><enum>(G)</enum><text>on excused absence with pay for relocation purposes;</text></subparagraph><subparagraph id="id1f4c922af9e949ae89ca24ec12825926"><enum>(H)</enum><text>on light duty due to injury or disability;</text></subparagraph><subparagraph id="idb8078ce565964ccea8c7df8e321cd4d8"><enum>(I)</enum><text>performing administrative duties or mission critical work assignments while maintaining law
			 enforcement authority;</text></subparagraph><subparagraph id="ide26d1e41d521458284ed670490d84dde"><enum>(J)</enum><text>caring for the canine assigned to the border patrol agent, which may not exceed 1 hour per day; or</text></subparagraph><subparagraph id="id215FE1A4053D431CA11B8C64460DC445"><enum>(K)</enum><text>engaged in an activity similar to an activity described in subparagraphs (A) through (J) while
			 temporarily away from the regular duty assignment of the border patrol
			 agent;</text></subparagraph></paragraph><paragraph id="id3250E6DB626C4D1B93C7069FA33F7B73"><enum>(4)</enum><text>the term <term>level 1 border patrol rate of pay</term> means the hourly rate of pay equal to 1.25 times the otherwise applicable hourly rate of basic pay
			 of the applicable border patrol agent;</text></paragraph><paragraph id="idDFC9CC8F76C44425A4E174445BE7C7A3"><enum>(5)</enum><text>the term <term>level 2 border patrol rate of pay</term> means the hourly rate of pay equal to 1.125 times the otherwise applicable hourly rate of basic
			 pay of the applicable border patrol agent; and</text></paragraph><paragraph id="id4890cc770b254517b0eac7e3a82abe84"><enum>(6)</enum><text>the term <term>work period</term> means a 14-day biweekly pay period.</text></paragraph></subsection><subsection id="id8ACB3A6AB0A1475B8D1A48F77996A31B"><enum>(b)</enum><header>Receipt of border patrol rate of pay</header><paragraph id="id71650DF413054484A21CA8EB82D5ABAD"><enum>(1)</enum><header>Voluntary election</header><subparagraph id="idC7FF59F2FBD34FD9A218B35065756DDE"><enum>(A)</enum><header>In general</header><text>Not later than 30 days before the first day of each year beginning after the date of enactment of
			 this section, a border patrol agent shall make an election whether the
			 border patrol agent shall, for the following year—</text><clause id="idC7DFA29A870E4162B904CAF95B9FA54C"><enum>(i)</enum><text>be assigned to the level 1 border patrol rate of pay;</text></clause><clause id="id11055D557EED471E9733966AEA4E85A9"><enum>(ii)</enum><text>be assigned the level 2 border patrol rate of pay; or</text></clause><clause id="id9E60B46B31304AE4BB418AB35895D32B"><enum>(iii)</enum><text>decline to be assigned the level 1 border patrol rate of pay or the level 2 border patrol rate of
			 pay.</text></clause></subparagraph><subparagraph id="id9411B7C6967749358274D911788C5E7E"><enum>(B)</enum><header>Procedures</header><text>The Director of the Office of Personnel Management shall establish procedures for elections under
			 subparagraph (A).</text></subparagraph><subparagraph id="id77E48B7FC8F744E1AFFB5D62BA53D2D3"><enum>(C)</enum><header>Information regarding election</header><text>Not later than 60 days before the first day of each year beginning after the date of enactment of
			 this section, U.S. Customs and Border Protection shall provide each border
			 patrol agent with information regarding each type of election available
			 under subparagraph (A) and how to make such an election.</text></subparagraph><subparagraph id="id0E4102EC916E4814846AB7D3B163E602"><enum>(D)</enum><header>Failure to elect</header><text>A border patrol agent who fails to make a timely election under subparagraph (A) shall be deemed to
			 have made an election to be assigned to the level 1 border patrol rate of
			 pay under subparagraph (A)(i).</text></subparagraph><subparagraph id="idC27B348813CD4CC2BE7F912D02F1FABC"><enum>(E)</enum><header>Sense of Congress</header><text>It is the sense of Congress that U.S. Customs and Border Protection should take such action as is
			 necessary to ensure that not more than 10 percent of the border patrol
			 agents stationed at a location decline to be assigned to the level 1
			 border patrol rate of pay or the level 2 border patrol rate of pay.</text></subparagraph></paragraph><paragraph id="id708BDFA0F427432B93047FDD61FFCBB1"><enum>(2)</enum><header>Level 1 border patrol rate of pay</header><text>For a border patrol agent who has in effect an election under paragraph (1)(A)(i)—</text><subparagraph id="id72AE99AD2B5F4E7A95B7BC45C3986FFC"><enum>(A)</enum><text>the border patrol agent shall be scheduled to work, for 5 days per week—</text><clause id="id7AEC8D9B19F346B9A05CF86BD2FE177E"><enum>(i)</enum><text>8 hours of regular time per day; and</text></clause><clause id="idE03C65835B2E479E9A5FB75B563165DF"><enum>(ii)</enum><text>2 additional hours of scheduled overtime during each day the border patrol agent is scheduled to
			 work under clause (i);</text></clause></subparagraph><subparagraph id="id19E39731A0CB49129264B6E811D475CF"><enum>(B)</enum><text>for the hours of regular time work described in subparagraph (A)(i), the border patrol agent shall
			 receive pay at the level 1 border patrol rate of pay;</text></subparagraph><subparagraph id="id850663D418624649B8F83D3FAAE7E1D3"><enum>(C)</enum><text>for the hours of regularly scheduled overtime work described in subparagraph (A)(ii), the border
			 patrol agent shall not receive—</text><clause id="idA3186A9F533247F9AF3D7DF72AF751DA"><enum>(i)</enum><text>additional compensation under this section or any other provision of law; or</text></clause><clause id="id44BEA160EAD6447A8B6802D553F7F344"><enum>(ii)</enum><text>compensatory time off;</text></clause></subparagraph><subparagraph id="id0BD73DFDFF2A4DA6ACBDDAAFA692DE07"><enum>(D)</enum><text>any hours during which the border patrol agent is available to work during a work period shall be
			 included in the hours of regular time or regularly scheduled overtime
			 scheduled under subparagraph (A);</text></subparagraph><subparagraph id="idB98AC93615CC48D6A379A9DCF1E068AC"><enum>(E)</enum><text>shall receive compensatory time off or pay at the overtime hourly rate of pay for hours of work in
			 excess of 100 hours during a work period, as determined in accordance with
			 section 5542(a)(7); and</text></subparagraph><subparagraph id="id00f65e1fa9484766a2f7d176fcd64bfb"><enum>(F)</enum><text>shall be charged leave in increments of 8 hours for 1 shift of leave, regardless of the length of
			 the shift.</text></subparagraph></paragraph><paragraph id="idDB7AC57D88854E018E606CA72BCCC637"><enum>(3)</enum><header>Level 2 border patrol rate of pay</header><text>For a border patrol agent who has in effect an election under paragraph (1)(A)(ii)—</text><subparagraph id="id9CC739ED03474B5492FCF0FD2B453697"><enum>(A)</enum><text>the border patrol agent shall be scheduled to work, for 5 days per week—</text><clause id="id2D1BA0C34B37449F8921E20E2C30826E"><enum>(i)</enum><text>8 hours of regular time per day; and</text></clause><clause id="id8BA07C6AEF7C4A888A20E17E3FF7ED0E"><enum>(ii)</enum><text>1 additional hour of scheduled overtime during each day the border patrol agent is scheduled to
			 work under clause (i);</text></clause></subparagraph><subparagraph id="id31A3AAD4515E4C0A961CF672FCB48546"><enum>(B)</enum><text>for the hours of regular time work described in subparagraph (A)(i), the border patrol agent shall
			 receive pay at the level 2 border patrol rate of pay;</text></subparagraph><subparagraph id="idDAB5F6FF8A894454BE6E08F0DED5579B"><enum>(C)</enum><text>for the hours of regularly scheduled overtime work described in subparagraph (A)(ii), the border
			 patrol agent shall not receive—</text><clause id="id6F363D7FE19547989FACDE8551478C10"><enum>(i)</enum><text>additional compensation under this section or any other provision of law; or</text></clause><clause id="id930D11EBFE81440BA0D52108F9851308"><enum>(ii)</enum><text>compensatory time off;</text></clause></subparagraph><subparagraph id="id6B7D935BDB174795A9FA31055F6D6EA9"><enum>(D)</enum><text>any hours during which the border patrol agent is available to work during a work period shall be
			 included in the hours of regular time or regularly scheduled overtime
			 scheduled under subparagraph (A);</text></subparagraph><subparagraph id="id4792E6C2453842ABB01A81128B21FAF7"><enum>(E)</enum><text>shall receive compensatory time off or pay at the overtime hourly rate of pay for hours of work in
			 excess of 90 hours during a work period, as determined in accordance with
			 section 5542(a)(7); and</text></subparagraph><subparagraph id="idD445A9F22497408AA30F7F38A8FDFD7B"><enum>(F)</enum><text>shall be charged leave in increments of 8 hours for 1 shift of leave, regardless of the length of
			 the shift.</text></subparagraph></paragraph><paragraph id="idC7352844360647C785FB82979F830807"><enum>(4)</enum><header>Basic border patrol rate of pay</header><text>For a border patrol agent who has in effect an election under paragraph (1)(A)(iii)—</text><subparagraph id="id343A0EA64298436FB129E9C242588A4C"><enum>(A)</enum><text>the border patrol agent shall be scheduled to work 8 hours of regular time per day and 5 days per
			 week;</text></subparagraph><subparagraph id="id8F03BD5773F54E139C2B211CE75B66FC"><enum>(B)</enum><text>any hours during which the border patrol agent is available to work during a work period shall be
			 included in the hours of regular time scheduled under subparagraph (A);
			 and</text></subparagraph><subparagraph id="id9940855AB6514C3DBD0216B400ECB312"><enum>(C)</enum><text>the border patrol agent shall receive compensatory time off or pay at the overtime hourly rate of
			 pay for hours of work in excess of 80 hours during a work period, as
			 determined in accordance with section 5542(a)(7).</text></subparagraph></paragraph></subsection><subsection id="id5B294E6799CF4E3D8AB0CC06BD2C2586"><enum>(c)</enum><header>Eligibility for other premium pay</header><text>A border patrol agent—</text><paragraph id="idC8CB09DCAC454E0DBC0C9DA72D1588D7"><enum>(1)</enum><text>shall receive premium pay for night work in accordance with subsections (a) and (b) of section 5545
			 and Sunday and holiday pay in accordance with section 5546, without regard
			 to the election of the border patrol agent under subsection (b)(1)(A),
			 except that section 5546(d) shall not apply and eligibility for pay for,
			 and the rate of pay for, any overtime work shall be determined in
			 accordance with this section and section 5542(a)(7); and</text></paragraph><paragraph id="idD6E3CF132AA74F5AB93707FE0B6895BA"><enum>(2)</enum><text>shall not be eligible for any other form of premium pay under this title, except as provided in
			 section 5542(a)(7).</text></paragraph></subsection><subsection id="id24A413FBA7044836BAD3A0A682D05194"><enum>(d)</enum><header>Treatment as basic pay</header><text>Any pay received at the level 1 border patrol rate of pay or the level 2 border patrol rate of pay
			 or pay described in subsection (b)(3)(B) shall be treated as part of basic
			 pay for—</text><paragraph id="idD87655EDA70042468D58C9DE78A380BB"><enum>(1)</enum><text>purposes of sections 5595(c), 8114(e), 8331(3), and 8704(c);</text></paragraph><paragraph id="idAF21E649C11D4054B8A32B1CE9FF05C5"><enum>(2)</enum><text>any other purpose that the Office of Personnel Management may by regulation prescribe; and</text></paragraph><paragraph id="idF9C9535F72D24CA38283983CCD8D5F77"><enum>(3)</enum><text>any other purpose expressly provided for by law.</text></paragraph></subsection><subsection id="idA5488D0FD69D4CE9A77726732EF5E538"><enum>(e)</enum><header>Authority To require overtime work</header><text>Nothing in this section shall be construed to limit the authority of U.S. Customs and Border
			 Protection to require a border patrol agent to perform hours of overtime
			 work in accordance with the needs of U.S. Customs and Border Protection,
			 including if needed in the event of a local or national emergency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id62DB853ABC774F0B90CFD997DFDD6B2C"><enum>(c)</enum><header>Overtime work</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5542">Section 5542(a)</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSGA00" display-inline="no-display-inline" id="idE911E2F303384B9FA87B5AEF7DD3CDE3" reported-display-style="strikethrough" style="OLC"><paragraph id="idD965B1504D0440AD9199EDFCA410C896" indent="up1"><enum>(7)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id49A2714E9B9D4A1684EF78392DBB42E8"><enum>(A)</enum><text>In this paragraph, the term <term>border patrol agent</term> has the meaning given that term in section 5550.</text></subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="idFA2A07FE3C5B4851921EB3C7519B0E29" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>Notwithstanding the matter preceding paragraph (1) or paragraphs (1) and (2), for a border patrol
			 agent who has in effect an election to be assigned to the level 1 border
			 patrol rate of pay under section 5550(b)(1)(A)(i)—</text><clause id="idD9A057B1A927462BB3BF24F36F5A81F5"><enum>(i)</enum><text>except as provided in subparagraph (E), hours of work in excess of 100 hours during a 14-day
			 biweekly pay period shall be overtime work; and</text></clause><clause id="id7FDBD22EC92F440AA90FDC249BFCF350"><enum>(ii)</enum><text>the border patrol agent—</text><subclause id="idDAA1C59C82074A89B9775A914896A787"><enum>(I)</enum><text>shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs
			 (1) and (2)) for hours of overtime work that are officially ordered or
			 approved in advance of the work assignment; and</text></subclause><subclause id="idA9170C33961B4E48BB2CED224339D705"><enum>(II)</enum><text>shall receive compensatory time off for any hours of overtime work that are not hours of overtime
			 work described in subclause (I).</text></subclause></clause></subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="idCA3B7361F82E4448B4A0400840DB8B2B" indent="up1" reported-display-style="strikethrough"><enum>(C)</enum><text>Notwithstanding the matter preceding paragraph (1) or paragraphs (1) and (2), for a border patrol
			 agent who has in effect an election to be eligible for the level 2 border
			 patrol rate of pay under section 5550(b)(1)(A)(ii)—</text><clause id="idC568E08AEA2F48D8A44F0907BB0BBDF8"><enum>(i)</enum><text>except as provided in subparagraph (E), hours of work in excess of 90 hours during a 14-day
			 biweekly pay period shall be overtime work; and</text></clause><clause id="id766476A5B38748429BB0B760F47005B4"><enum>(ii)</enum><text>the border patrol agent—</text><subclause id="idF156477F62064AF3B14F94B4DB56E042"><enum>(I)</enum><text>shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs
			 (1) and (2)) for hours of overtime work that are officially ordered or
			 approved in advance of the work assignment; and</text></subclause><subclause id="id69C3C84DB7964E1C90224A130D4296F4"><enum>(II)</enum><text>shall receive compensatory time off for any hours of overtime work that are not hours of overtime
			 work described in subclause (I).</text></subclause></clause></subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="idFDA7B6FDC2AA4607AC36806ABB4F8081" indent="up1" reported-display-style="strikethrough"><enum>(D)</enum><text>Notwithstanding the matter preceding paragraph (1) or paragraphs (1) and (2), for a border patrol
			 agent who has in effect an election under section 5550(b)(1)(A)(iii)—</text><clause id="idD927931EFA534FF9836E7DFCADA3EC61"><enum>(i)</enum><text>except as provided in subparagraph (E), hours of work in excess of 80 hours during a 14-day
			 biweekly pay period shall be overtime work; and</text></clause><clause id="idCF9C25BDE44749DBA5B69AE3046E016C"><enum>(ii)</enum><text>the border patrol agent—</text><subclause id="id3FA54EC6FC3F4B958135839279BABDA5"><enum>(I)</enum><text>shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs
			 (1) and (2)) for hours of overtime work that are officially ordered or
			 approved in advance of the work assignment; and</text></subclause><subclause id="id3E0E51157FC74130801A0EE7E9C96AAC"><enum>(II)</enum><text>shall receive compensatory time off for any hours of overtime work that are not hours of overtime
			 work described in subclause (I).</text></subclause></clause></subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="id1EB87F97B4F84437BD45574116C7F44C" indent="up1" reported-display-style="strikethrough"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="id8E347984C34E441B881D9C0D560CF27F"><enum>(i)</enum><text>Except as provided in clause (ii), during a 14-day biweekly pay period, a border patrol agent shall
			 not perform and may not receive compensatory time off for more than 8
			 hours of overtime work.</text></clause><clause changed="deleted" committee-id="SSGA00" id="id1e8a93ec093e41e9822d7589d9b0b89a" indent="up1" reported-display-style="strikethrough"><enum>(ii)</enum><text>U.S. Customs and Border Protection may, as it determines appropriate, waive the limitation under
			 clause (i) for hours of overtime work, but such waiver must be approved in
			 advance of any work being performed that would be subject to compensatory
			 time under subsection (B)(ii)(II), (C)(ii)(II), or (D)(ii)(II).</text></clause></subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="id78CF199F70A54E85881CABF551C87FC9" indent="up1" reported-display-style="strikethrough"><enum>(F)</enum><text>A border patrol agent—</text><clause id="id32CDE42911D449F9A69A29D80DF7C9E8"><enum>(i)</enum><text>may not earn more than 240 hours of compensatory time off during a year; and</text></clause><clause id="idB7FB069F56734F0CBAAE4B9C59B06502"><enum>(ii)</enum><text>shall use any hours of compensatory time off not later than 1 year after the date on which the
			 compensatory time off is accrued.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9FC2DB5F54F447BBADEE14529991E55F"><enum>(d)</enum><header>Technical and conforming amendments</header><paragraph id="id0B464AC22A86405B9DA217EB0A001120"><enum>(1)</enum><text>Section 13(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)</external-xref>) is amended—</text><subparagraph id="id5BA548BE44294A5C8198AD2A69B5E990"><enum>(A)</enum><text>in paragraph (16), by striking <quote>or</quote> after the semicolon;</text></subparagraph><subparagraph id="idF9924EADE6EF4B7F867462DA140A63CA"><enum>(B)</enum><text>in paragraph (17), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="id0504EB10248F4096A07A7618655D3EE1"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSGA00" display-inline="no-display-inline" id="idB14F11085AB344B1B641A0E71E5957CA" reported-display-style="strikethrough" style="OLC"><paragraph id="idA296A8AF2905440088696CCE6EDBFFD8"><enum>(18)</enum><text>any employee who is a border patrol agent, as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/5550">section 5550(a)</external-xref> of title 5, United States
			 Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA6A0DB3408DE4D75A315F6B79C4412C9"><enum>(2)</enum><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended by inserting after

Border patrol rate of pay.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section changed="added" committee-id="SSGA00" id="id884a05e397b345a6bf1b2bcc6bb09189" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Patrol Agent Pay Reform Act of 2014</short-title></quote>.</text></section><section changed="added" committee-id="SSGA00" id="idc62472558a3b4cc0b838cfa37966a718" reported-display-style="italic"><enum>2.</enum><header>Border patrol rate of pay</header><subsection id="id643ee7277a6547fa937999fa200b88a1"><enum>(a)</enum><header>Purpose</header><text>The purposes of this Act are—</text><paragraph id="idb0e3bb979e7540a28853ea8a97771d50"><enum>(1)</enum><text>to strengthen U.S. Customs and Border Protection and ensure that border patrol agents are
			 sufficiently ready to conduct necessary work and will perform overtime
			 hours in excess of a 40-hour workweek based on the needs of U.S. Customs
			 and Border Protection; and</text></paragraph><paragraph id="id09caef36bf3e4d02a18d5741122d5a24"><enum>(2)</enum><text>to ensure U.S. Customs and Border Protection has the flexibility to cover shift changes and retains
			 the right to assign scheduled and unscheduled work for mission
			 requirements and planning based on operational need.</text></paragraph></subsection><subsection id="idb3b9f611bd3f4ee0ba7e763071f16451"><enum>(b)</enum><header>Rates of pay</header><text>Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended by inserting after section
			 5549 the following:</text><quoted-block changed="added" committee-id="SSGA00" display-inline="no-display-inline" id="id824ca67895e847d4b1774a95d71e2d92" reported-display-style="italic" style="USC"><section id="idddc4f0e9ab984abfa85d03b0dec61e58"><enum>5550.</enum><header>Border patrol rate of pay</header><subsection id="id91903a2d45bb4c1ca7f8686cd8eadb4f"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id448956057BFD4EF4A9C04DBF40F4294C"><enum>(1)</enum><text>the term <term>basic border patrol rate of pay</term> means the hourly rate of basic pay of the applicable border patrol, as determined without regard
			 to this section;</text></paragraph><paragraph id="id4c257089a55e48739790c2877c683bfb"><enum>(2)</enum><text>the term <term>border patrol agent</term> means an individual who is  appointed to a position assigned to the Border Patrol Enforcement
			 classification series 1896 or any successor series, consistent with
			 classification standards established by the Office of Personnel
			 Management;</text></paragraph><paragraph id="id63851430fb42448692d7f8062011e079"><enum>(3)</enum><text>the term <term>level 1 border patrol rate of pay</term> means the hourly rate of pay equal to 1.25 times the otherwise applicable hourly rate of basic pay
			 of the applicable border patrol agent;</text></paragraph><paragraph id="ide61053f887b2425988d88fc729d9521b"><enum>(4)</enum><text>the term <term>level 2 border patrol rate of pay</term> means the hourly rate of pay equal to 1.125 times the otherwise applicable hourly rate of basic
			 pay of the applicable border patrol agent; and</text></paragraph><paragraph id="id162122a93f06496681f25b03e6756de5"><enum>(5)</enum><text>the term <term>work period</term> means a 14-day biweekly pay period.</text></paragraph></subsection><subsection id="ida2a9e8b14b1840f1b0b6eea268fa1788"><enum>(b)</enum><header>Receipt of border patrol rate of pay</header><paragraph id="idb02a0e94048c46ae9ed783a0dce7e838"><enum>(1)</enum><header>Voluntary election</header><subparagraph id="id7ea6df3823d34993bc4c50b5929de5c2"><enum>(A)</enum><header>In general</header><text>Not later than 30 days before the first day of each year beginning after the date of enactment of
			 this section, a border patrol agent shall make an election whether the
			 border patrol agent shall, for that year, be assigned to—</text><clause id="id4ab0f3133e324d6e93ef14d8de882e95"><enum>(i)</enum><text>the level 1 border patrol rate of pay;</text></clause><clause id="id2c55af817c8247dca6f84e3e51868fe5"><enum>(ii)</enum><text>the level 2 border patrol rate of pay; or</text></clause><clause id="id95dcbff333eb4255a9d522b029f2173c"><enum>(iii)</enum><text>the basic border patrol rate of pay, with additional overtime assigned as needed by
			 U.S. Customs and Border Protection.</text></clause></subparagraph><subparagraph id="id3070e7f94423454b9ddc45a478f83453"><enum>(B)</enum><header>Regulations</header><text>The Director of the Office of Personnel Management shall promulgate regulations
			 establishing procedures for elections under subparagraph (A).</text></subparagraph><subparagraph id="id4521b96a1934439599d8a8a13203924c"><enum>(C)</enum><header>Information regarding election</header><text>Not later than 60 days before the first day of each year beginning after the date of enactment of
			 this section, U.S. Customs and Border Protection shall provide each border
			 patrol agent with information regarding each type of election available
			 under subparagraph (A) and how to make such an election.</text></subparagraph><subparagraph id="id2118e390c92c40b5b1a58fec151b6316"><enum>(D)</enum><header>Assignment in lieu of election</header><text>Notwithstanding subparagraph (A)—</text><clause id="iddc8a83460e81417d9a901214f4666f5c"><enum>(i)</enum><text>a border patrol agent who fails to make a timely election under subparagraph (A) shall be assigned
			 to the level 1 border patrol rate of pay;</text></clause><clause id="id31b7407edaea4e38b70269aeb9d01f39"><enum>(ii)</enum><text>a border patrol agent who is assigned a canine shall be assigned to the level 1 border patrol rate
			 of pay;</text></clause><clause id="id49f5a1fcb2b148c08e9f8721ce69c461"><enum>(iii)</enum><text>if at any time U.S. Customs and Border Protection concludes that a border patrol agent is unable to
			 perform overtime on a
			 daily basis in accordance with this section, U.S. Customs and Border
			 Protection shall assign the
			 border patrol agent to the basic border patrol rate of pay until such time
			 as U.S. Customs and Border Protection
			 determines that the border patrol agent is able to perform scheduled
			 overtime on a
			 daily basis;</text></clause><clause id="id340A1185E41A460AA21F669D11A9F475"><enum>(iv)</enum><text>unless the analysis conducted under section 2(e) of the <short-title>Border Patrol Agent Pay Reform Act of 2014</short-title> indicates that,  in order to more adequately fulfill the operational
			 requirements of U.S. Customs and Border Protection, such border patrol
			 agents should be allowed to elect or be assigned to the level 1 border
			 patrol rate of pay or the level 2 border patrol rate of pay, a
			 border patrol agent shall be assigned to the basic border patrol rate of
			 pay if the agent works—</text><subclause id="id6286CAB946694AAEBD4131565244F0FE"><enum>(I)</enum><text>at U.S. Customs and Border Protection headquarters;</text></subclause><subclause id="idBAAFCAA2F1EC4F82A349EC072E6E5C85"><enum>(II)</enum><text>as a training instructor at a U.S. Customs and Border Protection training facility;</text></subclause><subclause id="idDC915DF1A400412CB3CFBAE10EDD3755"><enum>(III)</enum><text>in an administrative position; or</text></subclause><subclause id="idCFFC58F6F53E44E98A4F7C930FF2924B"><enum>(IV)</enum><text>as a fitness instructor; and</text></subclause></clause><clause id="idc249435c716d4d3399b1fb92160b6f95"><enum>(v)</enum><text>a border patrol agent may be assigned to the level 1 border patrol rate of pay	or the level 2
			 border patrol rate of pay in accordance with subparagraph (E).</text></clause></subparagraph><subparagraph id="id34249B44EBC1409388997E80EC0FF1D2"><enum>(E)</enum><header>Flexibility</header><clause id="idEBE406387981405281D51C2B0084E021"><enum>(i)</enum><header>In general</header><text>Except as provided in clauses (ii) and (iii), and notwithstanding any other provision of law,  U.S.
			 Customs and Border Protection shall take such
			 action as is necessary, including the unilateral assignment of border
			 patrol agents to the level 1 border patrol rate of pay  or the level 2
			 border patrol rate of pay, to ensure
			 that not more than 10 percent of the border patrol agents stationed at a
			 location are assigned to the level 2
			 border patrol rate of pay or the basic border patrol rate of pay.</text></clause><clause id="id63570a11e5214c16991e342364d2076c"><enum>(ii)</enum><header>Waiver</header><text>U.S. Customs and Border Protection may waive the limitation under clause (i) on the percent of
			 border patrol agents stationed at a location who are assigned to the level
			 2 border patrol rate of pay or the basic border patrol rate of pay if,
			 based on the analysis conducted under section 2(e) of the <short-title>Border Patrol Agent Pay Reform Act of 2014</short-title>, U.S. Customs and Border Protection determines it may do so and adequately fulfill its operational
			 requirements.</text></clause><clause id="id0DCAE53189EB49EABC8651752E499150"><enum>(iii)</enum><header>Certain locations</header><text>Clause (i) shall not apply to border patrol agents working at
			 the headquarters of U.S. Customs and Border Protection or a  training
			 location of U.S. Customs and Border Protection.</text></clause></subparagraph><subparagraph id="id7fca1b24782e4260856ee867ec2cb707"><enum>(F)</enum><header>Canine care</header><text>For a border patrol agent assigned to provide care for a canine and assigned to the level 1
			 border patrol rate of pay in accordance with subparagraph (D)(ii)—</text><clause id="id1B6AA0FE68264F59990C7D2B184CF505"><enum>(i)</enum><text>that
			 rate
			 of pay covers all such care;</text></clause><clause id="id66FAA95E5D3F4DB698894AF33C7C4E11"><enum>(ii)</enum><text>for the purposes of scheduled overtime
			 under paragraph (2)(A)(ii), such care shall be counted as 1 hour of
			 scheduled
			 overtime on each regular workday without regard to the actual duration of
			 such care or whether such care occurs on the regular workday; and</text></clause><clause id="id74EBC09EDD03444BBFF75F8C334D0B48"><enum>(iii)</enum><text>no other pay shall be
			 paid to the border patrol agent for such care.</text></clause></subparagraph><subparagraph id="idcbfe883811a04083a4339d7d7f7e4f79"><enum>(G)</enum><header>Pay assignment continuity</header><clause id="id27f5cfd63120413b98e14bf3f06ae25a"><enum>(i)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Border Patrol Agent Pay Reform Act of 2014</short-title>, and in consultation with the Office of Personnel Management, U.S. Customs and Border Protection
			 shall develop and implement a plan to ensure, to the greatest extent
			 practicable, that the assignment of a border patrol agent under this
			 section during the 3 years of service before the border patrol agent
			 becomes eligible for immediate retirement are consistent with the average
			 border patrol rate of pay level to which the border patrol agent has been
			 assigned during the course of the career of the border patrol agent.</text></clause><clause id="id8cef5d98627f43418d9900644a22ff16"><enum>(ii)</enum><header>Implementation</header><text>Notwithstanding any other provision of law, U.S. Customs and  Border Protection may take such
			 action as is necessary, including the unilateral assignment of border
			 patrol agents to the level 1 border patrol rate of pay, the level 2
			 border patrol rate of pay, or the basic border patrol rate of pay, to
			 implement the plan developed under this
			 subparagraph.</text></clause><clause id="id53f2db5addc34085878592f58f16dda4"><enum>(iii)</enum><header>Reporting</header><text>U.S. Customs and Border Protection shall submit the plan developed under clause (i) to the
			 appropriate committees of Congress.</text></clause><clause id="id2a34b50a89884dae9d8b3e345e6effcb"><enum>(iv)</enum><header>GAO review</header><text>Not later than 6 months after U.S. Customs and Border Protection issues the plan required under
			 clause (i), the Comptroller General of the United States shall submit to
			 the appropriate committees of Congress a report on the effectiveness of
			 the plan in ensuring that border patrol agents are not able to
			 artificially enhance their retirement annuities.</text></clause><clause id="idE4EC90AD3955405A975554F03395DD20"><enum>(v)</enum><header>Definition</header><text>In this subparagraph, the term <term>appropriate committees of Congress</term> means—</text><subclause id="id2D73FC6533B5492FA86BF7A617C859B2"><enum>(I)</enum><text>the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of
			 the Senate; and</text></subclause><subclause id="idBA0E06106C834236BF85C55DE920D9F9"><enum>(II)</enum><text>the Committee on Homeland Security, the Committee on Oversight and Government Reform, and the
			 Committee on Appropriations of the House of Representatives.</text></subclause></clause><clause id="id8B07A437695D40A78C8B600B36D65A23"><enum>(vi)</enum><header>Rule of construction</header><text>Nothing in this subparagraph shall be construed to limit the ability of U.S. Customs and Border
			 Protection to assign border patrol agents to border patrol rates of pay as
			 necessary to meet operational requirements.</text></clause></subparagraph></paragraph><paragraph id="id1a62ee237f454cbdbda9df56d3309f1d"><enum>(2)</enum><header>Level 1 border patrol rate of pay</header><text>For a border patrol agent who is assigned to the level 1 border patrol rate of pay—</text><subparagraph id="id3d3b7d05ad8e4c5692a15dbe78b1e388"><enum>(A)</enum><text>the border patrol agent shall have a regular tour of duty consisting of 5 workdays per week with—</text><clause id="idab0fa43b82024d57a2bfb817fcff7e01"><enum>(i)</enum><text>8 hours of regular time per workday, which may be interrupted by an unpaid off-duty meal break; and</text></clause><clause id="id8502071ce67f4cf1a3ed78037f085183"><enum>(ii)</enum><text>2 additional hours of scheduled overtime during each day the agent performs work under clause (i);</text></clause></subparagraph><subparagraph id="id5313ee6125b743908ccafc1c5ea1e573"><enum>(B)</enum><text>for paid hours of regular time described in subparagraph (A)(i), the border patrol agent shall
			 receive pay at the level 1 border patrol rate of pay;</text></subparagraph><subparagraph id="id2eafbd3db63f46b0babf4b1e5920e64a"><enum>(C)</enum><text>compensation for the hours of regularly scheduled overtime work described in subparagraph (A)(ii)
			 is provided indirectly through the 25 percent supplement within the level
			 1 border patrol rate of pay, and the border patrol agent may not receive
			 for such hours—</text><clause id="idab3bc9b0727d418581778508d2254cab"><enum>(i)</enum><text>any compensation in addition to the compensation under subparagraph (B) under this section or any
			 other provision of law; or</text></clause><clause id="ideec9f82017424c929767feb68f744942"><enum>(ii)</enum><text>any compensatory time off;</text></clause></subparagraph><subparagraph id="idc030e11c6ca74d6b84e168c52f3b95b0"><enum>(D)</enum><text>the border patrol agent shall receive compensatory time off or pay at the overtime hourly rate of
			 pay for hours of work in excess of 100 hours during a work period, as
			 determined in accordance with section 5542(g);</text></subparagraph><subparagraph id="id850671c5f6934ec5841c1caa34f3e19f"><enum>(E)</enum><text>the border patrol agent shall be charged corresponding amounts
			 of paid leave,  compensatory time off, or other paid time off	for each
			 hour (or part thereof) the agent is absent from work during regular time  
			 (except that full days off for military leave shall be charged when
			 required);</text></subparagraph><subparagraph id="id2770df12aeda4f41b8430fd056c5a595"><enum>(F)</enum><text>if the border patrol agent is absent during scheduled overtime described in subparagraph (A)(ii)—</text><clause id="idADA0A48D28964A40BFDD817D22944D72"><enum>(i)</enum><text>the border patrol agent
			 shall accrue an obligation to perform other overtime work for each hour
			 (or part thereof) the border patrol agency is absent; and</text></clause><clause id="id206B63C33B2F4AC4B42965E41D09CE82"><enum>(ii)</enum><text>any overtime
			 work applied toward the obligation under clause (i) shall not be credited
			 as overtime work
			 under any other provision of law; and</text></clause></subparagraph><subparagraph id="idde678245b1234ce9b32aa68a1b07afad"><enum>(G)</enum><text>for the purposes of advanced training, the border patrol agent—</text><clause id="idF572C57AEEF5489AB00B46E57EE35829"><enum>(i)</enum><text>shall be paid at the level 1 border patrol rate of pay for the
			 first 60 days of advanced training in a calendar year; and</text></clause><clause id="id42005099DAD647D2B0928F5A9DE5DEBE"><enum>(ii)</enum><text>for any advanced training in addition to the advanced training described in clause (i), shall be
			 paid at the basic border
			 patrol rate of pay.</text></clause></subparagraph></paragraph><paragraph id="ida36821ccbb7249e4868af3532a30fbe8"><enum>(3)</enum><header>Level 2 border patrol rate of pay</header><text>For a border patrol agent who is assigned to the level 2 border patrol rate of pay—</text><subparagraph id="iddfcf43a327ac49baaf0e942edc82a3d9"><enum>(A)</enum><text>the border patrol agent shall have a regular tour of duty consisting of 5 workdays per week with—</text><clause id="id05553432eb624ea7b2a2521edda140c6"><enum>(i)</enum><text>8 hours of regular time per workday, which may be interrupted by an unpaid off-duty meal break; and</text></clause><clause id="idd126187ae29a4bba9f3dcd82ea4fddba"><enum>(ii)</enum><text>1 additional hour of scheduled overtime during each day the agent performs work under clause (i);</text></clause></subparagraph><subparagraph id="id8b6129885ebe47c48329d8e29a527d5d"><enum>(B)</enum><text>for paid hours of regular time described in subparagraph (A)(i), the border patrol agent shall
			 receive pay at the level 2 border patrol rate of pay;</text></subparagraph><subparagraph id="id0e025cbad664483b9852b677ee16f46a"><enum>(C)</enum><text>compensation for the hours of regularly scheduled overtime work described in subparagraph (A)(ii)
			 is provided indirectly through the 12.5 percent supplement within the
			 level 2 border patrol rate of pay, and the border patrol agent may not
			 receive for such hours—</text><clause id="id4dbb3c45b5594f1aafac8c6dc5a1f3a7"><enum>(i)</enum><text>any compensation in addition to the compensation under subparagraph (B) under this section or any
			 other provision of law; or</text></clause><clause id="id0411f4b134a0492faab4b1a1fef18e78"><enum>(ii)</enum><text>any compensatory time off;</text></clause></subparagraph><subparagraph id="id9c5880621e054e9fb978884b98b2bc10"><enum>(D)</enum><text>the border patrol agent shall receive compensatory time off or pay at the overtime hourly rate of
			 pay for hours of work in excess of 90 hours during a work period, as
			 determined in accordance with section 5542(g);</text></subparagraph><subparagraph id="id2ccaa835b3d94f1697f4715dbc0d6c73"><enum>(E)</enum><text>the border patrol agent shall be charged corresponding amounts
			 of paid leave, compensatory time off, or other paid time off for each hour
			 (or part thereof) the agent is excused from work during regular time
			 (except that full days off for military leave shall be charged when
			 required);</text></subparagraph><subparagraph id="id8d195f0eba42449b8cd468ce5cc27c68"><enum>(F)</enum><text>if the border patrol agent is absent during scheduled overtime described in subparagraph (A)(ii)—</text><clause id="idD01431E752B24A44B18361BFE6B2B216"><enum>(i)</enum><text>the border patrol agent
			 shall accrue an obligation to perform other overtime work for each hour
			 (or part thereof) the border patrol agency is absent; and</text></clause><clause id="id37B89BA3D15948B4BE0ABD05AB6D5B39"><enum>(ii)</enum><text>any overtime
			 work applied toward the obligation under clause (i) shall not be credited
			 as overtime work
			 under any other provision of law; and</text></clause></subparagraph><subparagraph id="id1717DD8CA0E8407D9F06AD781938CF53"><enum>(G)</enum><text>for the purposes of advanced training, the border patrol agent—</text><clause id="id64D75730481A4B3DAB1DDADB97F1C633"><enum>(i)</enum><text>shall be paid at the level 2 border patrol rate of pay for the
			 first 60 days of advanced training in a calendar year; and</text></clause><clause id="idC5F7919B7D4D4499BFDC113EA55A3B1D"><enum>(ii)</enum><text>for any advanced training in addition to the advanced training described in clause (i), shall be
			 paid at the basic border
			 patrol rate of pay.</text></clause></subparagraph></paragraph><paragraph id="id371e5c231e614dfaa3dde96796af1575"><enum>(4)</enum><header>Basic border patrol rate of pay</header><text>For a border patrol agent who is assigned to the basic border patrol rate of pay—</text><subparagraph id="id7aca23294aa24005b91747ca182df703"><enum>(A)</enum><text>the border patrol agent shall have a regular tour of duty consisting of 5 workdays per week with 8
			 hours of regular time per workday; and</text></subparagraph><subparagraph id="id08a4cfa5bd924538a5ad9e157234a1af"><enum>(B)</enum><text>the border patrol agent shall receive compensatory time off or pay at the overtime hourly rate of
			 pay for hours of work in excess of 80 hours during a work period, as
			 determined in accordance with section 5542(g).</text></subparagraph></paragraph></subsection><subsection id="id6910f3e339c447e28ce361f0a325eed1"><enum>(c)</enum><header>Eligibility for other premium pay</header><text>A border patrol agent—</text><paragraph id="id33a9d957c31a4c548bd3b832076d34a4"><enum>(1)</enum><text>shall receive premium pay for nightwork in accordance with subsections (a) and (b) of section 5545
			 and Sunday and holiday pay in accordance with section 5546, without regard
			 to the rate of pay to which the border patrol agent is assigned under this
			 section, 
			 except that—</text><subparagraph id="idc9e44a5c2bc44fd08e6aa6c9a116f63c"><enum>(A)</enum><text>no premium pay for night, Sunday, or holiday work shall be provided for hours of regularly
			 scheduled
			 overtime work described in paragraph (2)(A)(ii) or (3)(A)(ii) of
			 subsection (b),
			 consistent with the requirements of paragraph (2)(C) or (3)(C) of
			 subsection (b); and</text></subparagraph><subparagraph id="ida63955ace5a44161b1d094679832ee0b"><enum>(B)</enum><text>section 5546(d) shall not apply and instead eligibility for pay for, and the rate of pay for, any
			 overtime work on a Sunday or a designated holiday shall be determined in
			 accordance with this section and section 5542(g);</text></subparagraph></paragraph><paragraph id="id4BD57E48A6434BDD879111EA25EC9371"><enum>(2)</enum><text>except as provided in paragraph (3) or section 5542(g), shall not be eligible for any other form of
			 premium pay under this title; and</text></paragraph><paragraph id="idC83603C30C2B426AB35590E09C22A9C3"><enum>(3)</enum><text>shall be eligible for hazardous duty pay in accordance with section
			 5545(d).</text></paragraph></subsection><subsection id="id0deef1102c08456894d4835351638b58"><enum>(d)</enum><header>Treatment as basic pay</header><text>Any pay in addition to the basic border patrol rate of pay for a border patrol agent resulting from
			 application of the level 1 border patrol rate of pay or the
			 level 2 border patrol rate of pay—</text><paragraph id="idDB8F12AE38F94F96B514DCEE267F15D3"><enum>(1)</enum><text>subject to paragraph (2), shall be treated as part of
			 basic pay solely for—</text><subparagraph id="id7efc9a8a14d64fdbaedb00266eb6f245"><enum>(A)</enum><text>purposes of sections 5595(c), 8114(e), 8331(3)(I), and 8704(c);</text></subparagraph><subparagraph id="id9c42effd4dff49f095d38ed0792f179b"><enum>(B)</enum><text>any other purpose that the Director of the Office of Personnel Management may by regulation
			 prescribe; and</text></subparagraph><subparagraph id="id89f5a577c4384b618432355a399dc76a"><enum>(C)</enum><text>any other purpose expressly provided for by law; and</text></subparagraph></paragraph><paragraph id="idB6879BB08B2F45D194EB703F369ABCF7"><enum>(2)</enum><text>shall not be treated as part of basic pay for the purposes of
			 calculating overtime pay, night pay, Sunday pay, or holiday pay under
			 section 5542, 5545, or 5546.</text></paragraph></subsection><subsection id="id7eced1379d5641d981b49914a9c4b6bf"><enum>(e)</enum><header>Travel time</header><text>Travel time to and from home and duty station by a border patrol agent shall not be considered
			 hours of work under any
			 provision of law.</text></subsection><subsection id="id87c29a28b296437da15c6cd9b857b4a7"><enum>(f)</enum><header>Leave without pay and substitution of hours</header><paragraph id="id749B44568DBB40DDA3DEBB62CE8B0F82"><enum>(1)</enum><header>Regular time</header><subparagraph id="id9F47A52813724EA483BC106086E752FB"><enum>(A)</enum><header>In general</header><text>For a period of leave without pay during the regular time of a border patrol agent (as described in
			 paragraph (2)(A)(i), (3)(A)(i), or (4)(A) of subsection (b)) within a
			 work
			 period,  an equal period of work outside the regular time of the border
			 patrol agent, but in
			 the same work period—</text><clause id="id7A56813E3E5A46059DD98A855237CF2E"><enum>(i)</enum><text>shall be substituted and paid for at the rate
			 applicable for the regular time; and</text></clause><clause id="id18253D4B01674007A4CA82AE5F2BE214"><enum>(ii)</enum><text>shall not be credited as overtime
			 hours for any purpose.</text></clause></subparagraph><subparagraph id="idDE00C341BECB49A792EBABA6B2C3B8E1"><enum>(B)</enum><header>Priority for same day work</header><text>In substituting hours of work under subparagraph (A),  work performed on the same day as the period
			 of
			 leave without pay shall be substituted first.</text></subparagraph><subparagraph id="idA1838F6DC4464623AFCC3C57CDDA60B8"><enum>(C)</enum><header>Priority for regular time substitution</header><text>Hours of work shall be substituted for regular time work under this paragraph before being
			 substituted
			 for scheduled overtime under paragraphs (2), (3), and (4).</text></subparagraph></paragraph><paragraph id="id1DE926D87E034C18972E2D57D48E93E2"><enum>(2)</enum><header>Overtime work</header><subparagraph id="id473ED5B267B94074B562E54D42A6938C"><enum>(A)</enum><header>In general</header><text>For a period of absence during scheduled overtime (as described in paragraph (2)(F) or (3)(F) of
			 subsection (b)) within a work period, an equal period of additional work
			 in the
			 same work period—</text><clause id="id3D0C1A53A84E44C09C148C0E363CD599"><enum>(i)</enum><text>shall be substituted and credited as scheduled overtime;
			 and</text></clause><clause id="id61BAD21B780B429581CFFC28BC533BC5"><enum>(ii)</enum><text>shall not be credited as overtime hours under any other provision of
			 law.</text></clause></subparagraph><subparagraph id="idBE30BA8323E74E5DBD6D57A59F720F7D"><enum>(B)</enum><header>Priority for same day work</header><text>In substituting hours of work under subparagraph (A), work performed on the same day as the period
			 of absence shall be substituted first.</text></subparagraph></paragraph><paragraph id="id487EA81EDC3046B495CA06FBC6202D86"><enum>(3)</enum><header>Application of compensatory time</header><text>If a border patrol agent does not have sufficient additional work in a work period to substitute
			 for all periods of absence during scheduled overtime (as described in
			 paragraph (2)(F) or (3)(F) of subsection (b)) within that work period, any
			 accrued
			 compensatory time off under section 5542(g) shall be applied to satisfy
			 the hours obligation.</text></paragraph><paragraph id="id3C59B931FC6F487982948F92110B50E7"><enum>(4)</enum><header>Insufficient hours</header><text>If a border patrol agent has a remaining hours obligation of scheduled overtime after applying
			 paragraphs (2) and (3), any additional work in subsequent work periods
			 that
			 would otherwise be credited under section 5542(g) shall be applied
			 towards the hours obligation until that obligation is satisfied.</text></paragraph></subsection><subsection id="idc76c963456114cd6a3bdfcc02381fb33"><enum>(g)</enum><header>Authority To require overtime work</header><text>Nothing in this section shall be construed to limit the authority of U.S. Customs and Border
			 Protection to require a border patrol agent to perform hours of overtime
			 work in accordance with the needs of U.S. Customs and Border Protection,
			 including if needed in the event of a local or national emergency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id49e80d2f68914749aed3d415ab1667e2"><enum>(c)</enum><header>Overtime work</header><paragraph id="idE062E6B7DEF940CCBE02703546CE6720"><enum>(1)</enum><header>In general</header><text>Section 5542  of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block changed="added" committee-id="SSGA00" display-inline="no-display-inline" id="id74268eccbab340fa8bd8e96f4eafd820" reported-display-style="italic" style="OLC"><subsection id="id9a21e1127f86498089c13b9a9d11f5bd"><enum>(g)</enum><text>In applying subsection (a) with respect to a border patrol agent covered by section 5550, the
			 following rules apply:</text><paragraph id="id7e65f66d6ebd42069a2067fa183afe37"><enum>(1)</enum><text>Notwithstanding the matter preceding paragraph (1) in subsection (a), for a border patrol agent who
			 is assigned to the level 1 border patrol rate of pay under section 5550—</text><subparagraph id="ideadd23fb64aa4cadad41517bf0fa8e1d"><enum>(A)</enum><text>hours of work in excess of 100 hours during a 14-day biweekly pay period shall be overtime work;
			 and</text></subparagraph><subparagraph id="id94fcbdad7d6a4f87b789b2cf6140e684"><enum>(B)</enum><text>the border patrol agent—</text><clause id="id9b0be6f152db4cc781d315c9ec59b3fe"><enum>(i)</enum><text>shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs
			 (1) and (2) of subsection (a)) for hours of overtime work that are
			 officially ordered
			 or approved in advance of the workweek; and</text></clause><clause id="idf408934ccb8d4c6280a7926bc53443ca"><enum>(ii)</enum><text>except as provided in
			 paragraphs (4) and (5), shall receive compensatory time off for an equal
			 amount of time spent performing overtime work that
			 is not overtime work described in clause (i).</text></clause></subparagraph></paragraph><paragraph id="id68612be0e8474d35ac408f4dd9949b60"><enum>(2)</enum><text>Notwithstanding the matter preceding paragraph (1) in subsection (a), for a border patrol agent who
			 is assigned to the level 2 border patrol rate of pay under section 5550—</text><subparagraph id="idd9546aa418ea4555914f5842801412eb"><enum>(A)</enum><text>hours of work in excess of 90 hours during a 14-day biweekly pay period shall be overtime work; and</text></subparagraph><subparagraph id="id3ae05d921f4e4e1698eec82d17f99398"><enum>(B)</enum><text>the border patrol agent—</text><clause id="ide16f32d95e25460082cfa262ac61e20c"><enum>(i)</enum><text>shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs
			 (1) and (2) of subsection (a)) for hours of overtime work that are
			 officially ordered
			 or approved in advance of the workweek; and</text></clause><clause id="id657b4df37b284ea8accd7954637bb12d"><enum>(ii)</enum><text>except as provided in
			 paragraphs (4) and (5), shall receive compensatory time off for an equal
			 amount of time spent performing overtime work that
			 is not overtime work described in clause (i).</text></clause></subparagraph></paragraph><paragraph id="idde9e95587b2941fd86aed949539903da"><enum>(3)</enum><text>Notwithstanding the matter preceding paragraph (1) in subsection (a), for a border patrol agent who
			 is assigned to the basic border patrol rate of pay under section 5550—</text><subparagraph id="id9c0370f7737d4fea8f307a629b346dea"><enum>(A)</enum><text>hours of work in excess of 80 hours during a 14-day biweekly pay period shall be overtime work; and</text></subparagraph><subparagraph id="id6ebe66662f304a7f964f00af584cc2fe"><enum>(B)</enum><text>the border patrol agent—</text><clause id="id020eac1a42c14410995f239a9851d44a"><enum>(i)</enum><text>shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs
			 (1) and (2) of subsection (a)) for hours of overtime work that are
			 officially ordered
			 or approved in advance of the workweek; and</text></clause><clause id="id422cafc261fd4f96888bb79ea85693f8"><enum>(ii)</enum><text>except as provided in
			 paragraphs (4) and (5), shall receive compensatory time off for an equal
			 amount of time spent performing overtime work that
			 is not overtime work described in clause (i).</text></clause></subparagraph></paragraph><paragraph id="iddd9f532c549649c397143f62dccd5b04"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD33F385C0F4A44A1B75641BA58BAA617"><enum>(A)</enum><text>Except as provided in subparagraph (B), during a 14-day biweekly pay period, a border patrol agent 
			 may not earn compensatory time off for more than 10 hours of overtime
			 work.</text></subparagraph><subparagraph changed="added" committee-id="SSGA00" id="id892B1C1B45674166BCA97644C61CEF2C" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>U.S. Customs and Border Protection may, as it determines appropriate, waive
			 the limitation under subparagraph (A) for an individual border patrol
			 agent for hours of irregular or occasional
			 overtime work, but such waiver must be approved in writing in advance of
			 the performance of any such work for which compensatory time off is earned
			 under paragraph (1)(B)(ii), (2)(B)(ii), or (3)(B)(ii).  If a
			 waiver request by a border patrol agent is denied, the border patrol agent
			 may not be ordered to perform the
			 associated overtime work.</text></subparagraph></paragraph><paragraph id="id9f5db9e6ac254cde81f7d9655775db37"><enum>(5)</enum><text>A border patrol agent—</text><subparagraph id="idef5f044949cc418f83deb1266ca77355"><enum>(A)</enum><text>may not earn more than 240 hours of compensatory time off during a leave year;</text></subparagraph><subparagraph id="id6e5c24f565c94096bfd8487807b040c6"><enum>(B)</enum><text>shall use any hours of compensatory time off not later than the end of the 26th pay period after
			 the pay period during which the compensatory time off was earned;</text></subparagraph><subparagraph id="id8832a0c8afc04e34ac6e977aa6f980b6"><enum>(C)</enum><text>shall be required to use 1 hour of compensatory time off for each hour of regular time	not
worked for which the border patrol agent is not on paid leave or other paid time off or does
			 not substitute time in accordance with section 5550(f);</text></subparagraph><subparagraph id="id4da3b11bd1b44eb1a027299f57f1cb50"><enum>(D)</enum><text>shall forfeit any compensatory time off not used in accordance with this paragraph and, regardless
			 of circumstances, shall not be entitled to any cash value for compensatory
			 time earned under section 5550;</text></subparagraph><subparagraph id="id11D8A838A4914DAE97BA4FDF268BE421"><enum>(E)</enum><text>shall not receive credit towards the computation of the annuity of the border patrol agent for
			 compensatory time, whether used or
			 not;
			 and</text></subparagraph><subparagraph id="id7e87ab4d68fa4b74a1d4f381fe0c5ccb"><enum>(F)</enum><text>shall not be credited with compensatory time off if the value of such time off would cause the
			 aggregate premium pay of the border patrol agent to exceed the limitation
			 established under
			 section 5547 in the period in which it was earned.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idf573c038091b4db8bb08698de79e9c3d"><enum>(2)</enum><header>Minimization of overtime</header><text>U.S. Customs and Border Protection shall, to the maximum extent practicable, avoid the use of
			 scheduled overtime work by border patrol agents.</text></paragraph></subsection><subsection id="id893ac50ba8be4f32b7a2859d24fa3ee4"><enum>(d)</enum><header>Retirement</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8331">Section 8331(3)</external-xref> of title 5, United States Code, is amended—</text><paragraph id="id722d23504fb346bf8850c1a92ffa56cf"><enum>(1)</enum><text>in subparagraph (G), by striking <quote>and</quote>;</text></paragraph><paragraph id="idd26bed8cfac84d5f91c9e38d8d5926d9"><enum>(2)</enum><text>in subparagraph (H), by inserting <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="id290ccb2696f9466b9967f43fce1a3d58"><enum>(3)</enum><text>by inserting a new subparagraph after subparagraph (H) as follows:</text><quoted-block changed="added" committee-id="SSGA00" display-inline="no-display-inline" id="id13a44bf506a249048528dd6e7aa81108" reported-display-style="italic" style="OLC"><subclause id="idf726e4887f7e4478afdda2a08c7f310b"><enum>(I)</enum><text>with respect to a border patrol agent, the amount of supplemental pay received through application
			 of the level 1 border patrol rate of pay or the level 2 border patrol rate
			 of pay for scheduled overtime within the regular tour of duty of the
			 border patrol agent  as
			 provided in section 5550;</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id936efc1f68e54cdd899a83e3ec9feb08"><enum>(4)</enum><text>in the undesignated matter following subparagraph (H), by striking <quote>subparagraphs (B) through (H)</quote> and inserting <quote>subparagraphs (B) through (I)</quote>.</text></paragraph></subsection><subsection id="id1184103A2F1E4C40A7FA707A6C543E52"><enum>(e)</enum><header>Comprehensive staffing analysis</header><paragraph id="id6bf8808593d04bf0b07c64868a7123b8"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, U.S. Customs and Border Protection
			 shall conduct a comprehensive analysis, and submit to the Comptroller
			 General of the United States a report, that—</text><subparagraph id="idDCC28CAC18CC434B8B37EEAD996AFAC3"><enum>(A)</enum><text>examines  the staffing requirements for U.S. Border Patrol to most effectively meet its operational
			 requirements at each Border Patrol duty station;</text></subparagraph><subparagraph id="id4206D5CACEE44329A01B109703EAFF3A"><enum>(B)</enum><text>estimates the cost of the staffing requirements at each Border Patrol duty station; and</text></subparagraph><subparagraph id="id719e604b1a17436da81d95c0a885c45e"><enum>(C)</enum><text>includes—</text><clause id="id5E22FE56E3A44B958F3C3691450FBB80"><enum>(i)</enum><text>a position-by-position review at each Border Patrol station to determine—</text><subclause id="id6B2F8CEBF9F548E194BD1F75323E122C"><enum>(I)</enum><text>the duties assigned to each position;</text></subclause><subclause id="id73acaf6934054c698a42dd02e2ebd6d4"><enum>(II)</enum><text>how the duties relate to the operational requirements of U.S. Border Patrol; and</text></subclause><subclause id="id9BDAC363DB03440A8ADA7D7B81C8E413"><enum>(III)</enum><text>the number of  hours border patrol agents in that position would need to work each pay period to
			 meet the operational requirements of U.S. Border Patrol;</text></subclause></clause><clause id="id6ba2f02ec764454f90240d73294e6cca"><enum>(ii)</enum><text>the metrics used to determine the number of hours of work performed at each Border Patrol station,
			 broken down by the type of hours worked;</text></clause><clause id="idee0497b06ac34665a264385fec4367d4"><enum>(iii)</enum><text>a cost analysis of the most recent full fiscal year by the type of full-time equivalent hours
			 worked;</text></clause><clause id="id38d22b8b01494959babd088f3308762e"><enum>(iv)</enum><text>a cost estimate by the type of full-time equivalent hours expected to be worked during the first
			 full fiscal year after the date of enactment of this Act; and</text></clause><clause id="id9868d01fc21148ee96b68745a675e1b4"><enum>(v)</enum><text>an analysis that compares the cost of assigning the full-time equivalent hours needed to meet the
			 operational requirements of U.S. Border Patrol to existing border patrol
			 agents through higher rates of pay versus recruiting, hiring, training,
			 and deploying additional border patrol agents.</text></clause></subparagraph></paragraph><paragraph id="id2ca908f4f1ec4d3798b43fae349b7833"><enum>(2)</enum><header>Independent validator</header><text>Not later than 90 days after the date on which the Comptroller General receives the report under
			 paragraph (1), the Comptroller General shall submit to the appropriate
			 committees of Congress a report that—</text><subparagraph id="id1270C1AE4CE748FEA0F9EF24404324E8"><enum>(A)</enum><text>examines the methodology used by U.S. Customs and Border Protection to carry  out the analysis; and</text></subparagraph><subparagraph id="idD2E5D0BAF9F84CD188638583B08F3757"><enum>(B)</enum><text>indicates whether the Comptroller General concurs with the findings in the report under paragraph
			 (1).</text></subparagraph></paragraph><paragraph id="ide11b217297004476a731e09923e3fe95"><enum>(3)</enum><header>Definition</header><text>In this subsection, the term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id7FA54F8DD03743588FE5FD268259ABEB"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of
			 the Senate; and</text></subparagraph><subparagraph id="id88441E7090734ADF8EF77E11611F4073"><enum><added-phrase committee-id="SSGA00" reported-display-style="italic">(B)</added-phrase></enum><text>the Committee on Oversight and Government  Reform and the Committee on Appropriations of
			 the House of Representatives.</text></subparagraph></paragraph></subsection><subsection id="id90CCBABAA69747EE8FC588961DA9AB65"><enum>(f)</enum><header>Rules of construction</header><text>Nothing in this section or the amendments made by this section shall be construed to—</text><paragraph id="idce2150a4afd64638b511e1790c8470ec"><enum>(1)</enum><text>limit the right of U.S. Customs and Border Protection to
			 assign both scheduled
			 and unscheduled work to a border patrol agent based on the needs of U.S.
			 Customs and Border Protection in
			 excess of the hours of work normally applicable under the election of the
			 border patrol agent, regardless of what the border patrol agent might
			 otherwise have elected;</text></paragraph><paragraph id="id42a8d03bc16846dcb46f73ef14e6757d"><enum>(2)</enum><text>require compensation of a border patrol agent other than
			 for hours during which the border patrol agent is actually performing work
			 or using approved
			 paid leave or other paid time off;  or</text></paragraph><paragraph id="id6c8493396c6b46aeb858070e5fa41fae"><enum>(3)</enum><text>exempt a border patrol agent from any limitations on pay, earnings, or
			 compensation, including the limitations under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/5547">section 5547</external-xref> of title 5, United States Code.</text></paragraph></subsection><subsection id="idbf3aadc023e149938743cfcf6a23fd33"><enum>(g)</enum><header>Technical and conforming amendments</header><paragraph id="id97c3b7d971b94cb8883e50cda16a7a0b"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/5/5547">Section 5547</external-xref> of title 5, United States Code is amended by—</text><subparagraph id="id8c0e2ad239ce4a2c9b7eac963ad1ace4"><enum>(A)</enum><text>in subsection (a), in the matter preceding paragraph (1)—</text><clause id="id373AC5B8C288467B8A49DFC97FE51262"><enum>(i)</enum><text>by striking, <quote>and</quote> before <quote>5546</quote>; and</text></clause><clause id="id970F0886D75240C2B1A12505FD817EF4"><enum>(ii)</enum><text>by inserting <quote>, and 5550</quote> after <quote>5546 (a) and (b)</quote>; and</text></clause></subparagraph><subparagraph id="id2c8a681fcd164cf0822b2b587dcbecbc"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block changed="added" committee-id="SSGA00" display-inline="no-display-inline" id="ided87714330a048e59404f7de2dc1a5c1" reported-display-style="italic" style="OLC"><subsection id="id56034077cd77455a936456c67a5309f2"><enum>(e)</enum><text>Any supplemental pay resulting from receipt of the  level 1 border patrol rate of pay or the level

			 section 5550 shall be considered premium pay in applying this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idb92ef0577ec24b148676ac4d642dd0d1"><enum>(2)</enum><text>Section 13(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)</external-xref>) is amended—</text><subparagraph id="id7b3f935733954fc38f6bcb573fa49c22"><enum>(A)</enum><text>in paragraph (16), by striking <quote>or</quote> after the semicolon;</text></subparagraph><subparagraph id="id6523ec74f8274980ae41aa4702b254df"><enum>(B)</enum><text>in paragraph (17), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="idfed1d950b6fd4026a7ef9c1e3ecdfd6d"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block changed="added" committee-id="SSGA00" display-inline="no-display-inline" id="ida2cc04a04e5942338ca58a3392fb1ded" reported-display-style="italic" style="OLC"><paragraph id="id408ef43fd5b94dceb826206c848c3ca9"><enum>(18)</enum><text>any employee who is a border patrol agent, as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/5550">section 5550(a)</external-xref> of title 5, United States
