			 fourteen</enrolled-dateline><legis-num display="yes">S. 1691</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title 5, United States Code, to improve the security of the United States border and to
			 provide for reforms and rates of pay for border patrol agents.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section commented="no" display-inline="no-display-inline" id="id884a05e397b345a6bf1b2bcc6bb09189" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Patrol Agent Pay Reform Act of 2014</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idc62472558a3b4cc0b838cfa37966a718" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Border patrol rate of pay</header><subsection commented="no" display-inline="no-display-inline" id="id643ee7277a6547fa937999fa200b88a1"><enum>(a)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purposes of this Act are—</text><paragraph commented="no" display-inline="no-display-inline" id="idb0e3bb979e7540a28853ea8a97771d50"><enum>(1)</enum><text display-inline="yes-display-inline">to strengthen U.S. Customs and Border Protection and ensure that border patrol agents are
			 sufficiently ready to conduct necessary work and will perform overtime
			 hours in excess of a 40-hour workweek based on the needs of U.S. Customs
			 and Border Protection; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09caef36bf3e4d02a18d5741122d5a24"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure U.S. Customs and Border Protection has the flexibility to cover shift changes and retains
			 the right to assign scheduled and unscheduled work for mission
			 requirements and planning based on operational need.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb3b9f611bd3f4ee0ba7e763071f16451"><enum>(b)</enum><header display-inline="yes-display-inline">Rates of pay</header><text display-inline="yes-display-inline">Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended by inserting after section
			 5549 the following:</text><quoted-block display-inline="no-display-inline" id="id824ca67895e847d4b1774a95d71e2d92" style="USC"><section commented="no" display-inline="no-display-inline" id="idddc4f0e9ab984abfa85d03b0dec61e58" section-type="subsequent-section"><enum>5550.</enum><header display-inline="yes-display-inline">Border patrol rate of pay</header><subsection commented="no" display-inline="no-display-inline" id="id91903a2d45bb4c1ca7f8686cd8eadb4f"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id448956057BFD4EF4A9C04DBF40F4294C"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>basic border patrol rate of pay</term> means the hourly rate of basic pay of the applicable border patrol, as determined without regard
			 to this section;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c257089a55e48739790c2877c683bfb"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>border patrol agent</term> means an individual who is  appointed to a position assigned to the Border Patrol Enforcement
			 classification series 1896 or any successor series, consistent with
			 classification standards established by the Office of Personnel
			 Management;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id63851430fb42448692d7f8062011e079"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>level 1 border patrol rate of pay</term> means the hourly rate of pay equal to 1.25 times the otherwise applicable hourly rate of basic pay
			 of the applicable border patrol agent;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide61053f887b2425988d88fc729d9521b"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>level 2 border patrol rate of pay</term> means the hourly rate of pay equal to 1.125 times the otherwise applicable hourly rate of basic
			 pay of the applicable border patrol agent; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id162122a93f06496681f25b03e6756de5"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>work period</term> means a 14-day biweekly pay period.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida2a9e8b14b1840f1b0b6eea268fa1788"><enum>(b)</enum><header display-inline="yes-display-inline">Receipt of border patrol rate of pay</header><paragraph commented="no" display-inline="no-display-inline" id="idb02a0e94048c46ae9ed783a0dce7e838"><enum>(1)</enum><header display-inline="yes-display-inline">Voluntary election</header><subparagraph commented="no" display-inline="no-display-inline" id="id7ea6df3823d34993bc4c50b5929de5c2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 days before the first day of each year beginning after the date of enactment of
			 this section, a border patrol agent shall make an election whether the
			 border patrol agent shall, for that year, be assigned to—</text><clause commented="no" display-inline="no-display-inline" id="id4ab0f3133e324d6e93ef14d8de882e95"><enum>(i)</enum><text display-inline="yes-display-inline">the level 1 border patrol rate of pay;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2c55af817c8247dca6f84e3e51868fe5"><enum>(ii)</enum><text display-inline="yes-display-inline">the level 2 border patrol rate of pay; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id95dcbff333eb4255a9d522b029f2173c"><enum>(iii)</enum><text display-inline="yes-display-inline">the basic border patrol rate of pay, with additional overtime assigned as needed by
			 U.S. Customs and Border Protection.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3070e7f94423454b9ddc45a478f83453"><enum>(B)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall promulgate regulations
			 establishing procedures for elections under subparagraph (A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4521b96a1934439599d8a8a13203924c"><enum>(C)</enum><header display-inline="yes-display-inline">Information regarding election</header><text display-inline="yes-display-inline">Not later than 60 days before the first day of each year beginning after the date of enactment of
			 this section, U.S. Customs and Border Protection shall provide each border
			 patrol agent with information regarding each type of election available
			 under subparagraph (A) and how to make such an election.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2118e390c92c40b5b1a58fec151b6316"><enum>(D)</enum><header display-inline="yes-display-inline">Assignment in lieu of election</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="iddc8a83460e81417d9a901214f4666f5c"><enum>(i)</enum><text display-inline="yes-display-inline">a border patrol agent who fails to make a timely election under subparagraph (A) shall be assigned
			 to the level 1 border patrol rate of pay;</text></clause><clause commented="no" display-inline="no-display-inline" id="id31b7407edaea4e38b70269aeb9d01f39"><enum>(ii)</enum><text display-inline="yes-display-inline">a border patrol agent who is assigned a canine shall be assigned to the level 1 border patrol rate
			 of pay;</text></clause><clause commented="no" display-inline="no-display-inline" id="id49f5a1fcb2b148c08e9f8721ce69c461"><enum>(iii)</enum><text display-inline="yes-display-inline">if at any time U.S. Customs and Border Protection concludes that a border patrol agent is unable to
			 perform overtime on a
			 daily basis in accordance with this section, U.S. Customs and Border
			 Protection shall assign the
			 border patrol agent to the basic border patrol rate of pay until such time
			 as U.S. Customs and Border Protection
			 determines that the border patrol agent is able to perform scheduled
			 overtime on a
			 daily basis;</text></clause><clause commented="no" display-inline="no-display-inline" id="id340A1185E41A460AA21F669D11A9F475"><enum>(iv)</enum><text display-inline="yes-display-inline">unless the analysis conducted under section 2(e) of the <short-title>Border Patrol Agent Pay Reform Act of 2014</short-title> indicates that,  in order to more adequately fulfill the operational
			 requirements of U.S. Customs and Border Protection, such border patrol
			 agents should be allowed to elect or be assigned to the level 1 border
			 patrol rate of pay or the level 2 border patrol rate of pay, a
			 border patrol agent shall be assigned to the basic border patrol rate of
			 pay if the agent works—</text><subclause commented="no" display-inline="no-display-inline" id="id6286CAB946694AAEBD4131565244F0FE"><enum>(I)</enum><text display-inline="yes-display-inline">at U.S. Customs and Border Protection headquarters;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idBAAFCAA2F1EC4F82A349EC072E6E5C85"><enum>(II)</enum><text display-inline="yes-display-inline">as a training instructor at a U.S. Customs and Border Protection training facility;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idDC915DF1A400412CB3CFBAE10EDD3755"><enum>(III)</enum><text display-inline="yes-display-inline">in an administrative position; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idCFFC58F6F53E44E98A4F7C930FF2924B"><enum>(IV)</enum><text display-inline="yes-display-inline">as a fitness instructor; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idc249435c716d4d3399b1fb92160b6f95"><enum>(v)</enum><text display-inline="yes-display-inline">a border patrol agent may be assigned to the level 1 border patrol rate of pay	or the level 2
			 border patrol rate of pay in accordance with subparagraph (E).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id34249B44EBC1409388997E80EC0FF1D2"><enum>(E)</enum><header display-inline="yes-display-inline">Flexibility</header><clause commented="no" display-inline="no-display-inline" id="idEBE406387981405281D51C2B0084E021"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clauses (ii) and (iii), and notwithstanding any other provision of law,  U.S.
			 Customs and Border Protection shall take such
			 action as is necessary, including the unilateral assignment of border
			 patrol agents to the level 1 border patrol rate of pay  or the level 2
			 border patrol rate of pay, to ensure
			 that not more than 10 percent of the border patrol agents stationed at a
			 location are assigned to the level 2
			 border patrol rate of pay or the basic border patrol rate of pay.</text></clause><clause commented="no" display-inline="no-display-inline" id="id63570a11e5214c16991e342364d2076c"><enum>(ii)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">U.S. Customs and Border Protection may waive the limitation under clause (i) on the percent of
			 border patrol agents stationed at a location who are assigned to the level
			 2 border patrol rate of pay or the basic border patrol rate of pay if,
			 based on the analysis conducted under section 2(e) of the <short-title>Border Patrol Agent Pay Reform Act of 2014</short-title>, U.S. Customs and Border Protection determines it may do so and adequately fulfill its operational
			 requirements.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0DCAE53189EB49EABC8651752E499150"><enum>(iii)</enum><header display-inline="yes-display-inline">Certain locations</header><text display-inline="yes-display-inline">Clause (i) shall not apply to border patrol agents working at
			 the headquarters of U.S. Customs and Border Protection or a  training
			 location of U.S. Customs and Border Protection.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7fca1b24782e4260856ee867ec2cb707"><enum>(F)</enum><header display-inline="yes-display-inline">Canine care</header><text display-inline="yes-display-inline">For a border patrol agent assigned to provide care for a canine and assigned to the level 1
			 border patrol rate of pay in accordance with subparagraph (D)(ii)—</text><clause commented="no" display-inline="no-display-inline" id="id1B6AA0FE68264F59990C7D2B184CF505"><enum>(i)</enum><text display-inline="yes-display-inline">that
			 rate
			 of pay covers all such care;</text></clause><clause commented="no" display-inline="no-display-inline" id="id66FAA95E5D3F4DB698894AF33C7C4E11"><enum>(ii)</enum><text display-inline="yes-display-inline">for the purposes of scheduled overtime
			 under paragraph (2)(A)(ii), such care shall be counted as 1 hour of
			 scheduled
			 overtime on each regular workday without regard to the actual duration of
			 such care or whether such care occurs on the regular workday; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id74EBC09EDD03444BBFF75F8C334D0B48"><enum>(iii)</enum><text display-inline="yes-display-inline">no other pay shall be
			 paid to the border patrol agent for such care.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcbfe883811a04083a4339d7d7f7e4f79"><enum>(G)</enum><header display-inline="yes-display-inline">Pay assignment continuity</header><clause commented="no" display-inline="no-display-inline" id="id27f5cfd63120413b98e14bf3f06ae25a"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Border Patrol Agent Pay Reform Act of 2014</short-title>, and in consultation with the Office of Personnel Management, U.S. Customs and Border Protection
			 shall develop and implement a plan to ensure, to the greatest extent
			 practicable, that the assignment of a border patrol agent under this
			 section during the 3 years of service before the border patrol agent
			 becomes eligible for immediate retirement are consistent with the average
			 border patrol rate of pay level to which the border patrol agent has been
			 assigned during the course of the career of the border patrol agent.</text></clause><clause commented="no" display-inline="no-display-inline" id="id8cef5d98627f43418d9900644a22ff16"><enum>(ii)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, U.S. Customs and  Border Protection may take such
			 action as is necessary, including the unilateral assignment of border
			 patrol agents to the level 1 border patrol rate of pay, the level 2
			 border patrol rate of pay, or the basic border patrol rate of pay, to
			 implement the plan developed under this
			 subparagraph.</text></clause><clause commented="no" display-inline="no-display-inline" id="id53f2db5addc34085878592f58f16dda4"><enum>(iii)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">U.S. Customs and Border Protection shall submit the plan developed under clause (i) to the
			 appropriate committees of Congress.</text></clause><clause commented="no" display-inline="no-display-inline" id="id2a34b50a89884dae9d8b3e345e6effcb"><enum>(iv)</enum><header display-inline="yes-display-inline">GAO review</header><text display-inline="yes-display-inline">Not later than 6 months after U.S. Customs and Border Protection issues the plan required under
			 clause (i), the Comptroller General of the United States shall submit to
			 the appropriate committees of Congress a report on the effectiveness of
			 the plan in ensuring that border patrol agents are not able to
			 artificially enhance their retirement annuities.</text></clause><clause commented="no" display-inline="no-display-inline" id="idE4EC90AD3955405A975554F03395DD20"><enum>(v)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>appropriate committees of Congress</term> means—</text><subclause commented="no" display-inline="no-display-inline" id="id2D73FC6533B5492FA86BF7A617C859B2"><enum>(I)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of
			 the Senate; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idBA0E06106C834236BF85C55DE920D9F9"><enum>(II)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security, the Committee on Oversight and Government Reform, and the
			 Committee on Appropriations of the House of Representatives.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id8B07A437695D40A78C8B600B36D65A23"><enum>(vi)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subparagraph shall be construed to limit the ability of U.S. Customs and Border
			 Protection to assign border patrol agents to border patrol rates of pay as
			 necessary to meet operational requirements.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a62ee237f454cbdbda9df56d3309f1d"><enum>(2)</enum><header display-inline="yes-display-inline">Level 1 border patrol rate of pay</header><text display-inline="yes-display-inline">For a border patrol agent who is assigned to the level 1 border patrol rate of pay—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3d3b7d05ad8e4c5692a15dbe78b1e388"><enum>(A)</enum><text display-inline="yes-display-inline">the border patrol agent shall have a regular tour of duty consisting of 5 workdays per week with—</text><clause commented="no" display-inline="no-display-inline" id="idab0fa43b82024d57a2bfb817fcff7e01"><enum>(i)</enum><text display-inline="yes-display-inline">8 hours of regular time per workday, which may be interrupted by an unpaid off-duty meal break; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8502071ce67f4cf1a3ed78037f085183"><enum>(ii)</enum><text display-inline="yes-display-inline">2 additional hours of scheduled overtime during each day the agent performs work under clause (i);</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5313ee6125b743908ccafc1c5ea1e573"><enum>(B)</enum><text display-inline="yes-display-inline">for paid hours of regular time described in subparagraph (A)(i), the border patrol agent shall
			 receive pay at the level 1 border patrol rate of pay;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2eafbd3db63f46b0babf4b1e5920e64a"><enum>(C)</enum><text display-inline="yes-display-inline">compensation for the hours of regularly scheduled overtime work described in subparagraph (A)(ii)
			 is provided indirectly through the 25 percent supplement within the level
			 1 border patrol rate of pay, and the border patrol agent may not receive
			 for such hours—</text><clause commented="no" display-inline="no-display-inline" id="idab3bc9b0727d418581778508d2254cab"><enum>(i)</enum><text display-inline="yes-display-inline">any compensation in addition to the compensation under subparagraph (B) under this section or any
			 other provision of law; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ideec9f82017424c929767feb68f744942"><enum>(ii)</enum><text display-inline="yes-display-inline">any compensatory time off;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc030e11c6ca74d6b84e168c52f3b95b0"><enum>(D)</enum><text display-inline="yes-display-inline">the border patrol agent shall receive compensatory time off or pay at the overtime hourly rate of
			 pay for hours of work in excess of 100 hours during a work period, as
			 determined in accordance with section 5542(g);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id850671c5f6934ec5841c1caa34f3e19f"><enum>(E)</enum><text display-inline="yes-display-inline">the border patrol agent shall be charged corresponding amounts
			 of paid leave,  compensatory time off, or other paid time off	for each
			 hour (or part thereof) the agent is absent from work during regular time  
			 (except that full days off for military leave shall be charged when
			 required);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2770df12aeda4f41b8430fd056c5a595"><enum>(F)</enum><text display-inline="yes-display-inline">if the border patrol agent is absent during scheduled overtime described in subparagraph (A)(ii)—</text><clause commented="no" display-inline="no-display-inline" id="idADA0A48D28964A40BFDD817D22944D72"><enum>(i)</enum><text display-inline="yes-display-inline">the border patrol agent
			 shall accrue an obligation to perform other overtime work for each hour
			 (or part thereof) the border patrol agent is absent; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id206B63C33B2F4AC4B42965E41D09CE82"><enum>(ii)</enum><text display-inline="yes-display-inline">any overtime
			 work applied toward the obligation under clause (i) shall not be credited
			 as overtime work
			 under any other provision of law; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idde678245b1234ce9b32aa68a1b07afad"><enum>(G)</enum><text display-inline="yes-display-inline">for the purposes of advanced training, the border patrol agent—</text><clause commented="no" display-inline="no-display-inline" id="idF572C57AEEF5489AB00B46E57EE35829"><enum>(i)</enum><text display-inline="yes-display-inline">shall be paid at the level 1 border patrol rate of pay for the
			 first 60 days of advanced training in a calendar year; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id42005099DAD647D2B0928F5A9DE5DEBE"><enum>(ii)</enum><text display-inline="yes-display-inline">for any advanced training in addition to the advanced training described in clause (i), shall be
			 paid at the basic border
			 patrol rate of pay.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida36821ccbb7249e4868af3532a30fbe8"><enum>(3)</enum><header display-inline="yes-display-inline">Level 2 border patrol rate of pay</header><text display-inline="yes-display-inline">For a border patrol agent who is assigned to the level 2 border patrol rate of pay—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddfcf43a327ac49baaf0e942edc82a3d9"><enum>(A)</enum><text display-inline="yes-display-inline">the border patrol agent shall have a regular tour of duty consisting of 5 workdays per week with—</text><clause commented="no" display-inline="no-display-inline" id="id05553432eb624ea7b2a2521edda140c6"><enum>(i)</enum><text display-inline="yes-display-inline">8 hours of regular time per workday, which may be interrupted by an unpaid off-duty meal break; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd126187ae29a4bba9f3dcd82ea4fddba"><enum>(ii)</enum><text display-inline="yes-display-inline">1 additional hour of scheduled overtime during each day the agent performs work under clause (i);</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b6129885ebe47c48329d8e29a527d5d"><enum>(B)</enum><text display-inline="yes-display-inline">for paid hours of regular time described in subparagraph (A)(i), the border patrol agent shall
			 receive pay at the level 2 border patrol rate of pay;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0e025cbad664483b9852b677ee16f46a"><enum>(C)</enum><text display-inline="yes-display-inline">compensation for the hours of regularly scheduled overtime work described in subparagraph (A)(ii)
			 is provided indirectly through the 12.5 percent supplement within the
			 level 2 border patrol rate of pay, and the border patrol agent may not
			 receive for such hours—</text><clause commented="no" display-inline="no-display-inline" id="id4dbb3c45b5594f1aafac8c6dc5a1f3a7"><enum>(i)</enum><text display-inline="yes-display-inline">any compensation in addition to the compensation under subparagraph (B) under this section or any
			 other provision of law; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id0411f4b134a0492faab4b1a1fef18e78"><enum>(ii)</enum><text display-inline="yes-display-inline">any compensatory time off;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9c5880621e054e9fb978884b98b2bc10"><enum>(D)</enum><text display-inline="yes-display-inline">the border patrol agent shall receive compensatory time off or pay at the overtime hourly rate of
			 pay for hours of work in excess of 90 hours during a work period, as
			 determined in accordance with section 5542(g);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2ccaa835b3d94f1697f4715dbc0d6c73"><enum>(E)</enum><text display-inline="yes-display-inline">the border patrol agent shall be charged corresponding amounts
			 of paid leave, compensatory time off, or other paid time off for each hour
			 (or part thereof) the agent is excused from work during regular time
			 (except that full days off for military leave shall be charged when
			 required);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8d195f0eba42449b8cd468ce5cc27c68"><enum>(F)</enum><text display-inline="yes-display-inline">if the border patrol agent is absent during scheduled overtime described in subparagraph (A)(ii)—</text><clause commented="no" display-inline="no-display-inline" id="idD01431E752B24A44B18361BFE6B2B216"><enum>(i)</enum><text display-inline="yes-display-inline">the border patrol agent
			 shall accrue an obligation to perform other overtime work for each hour
			 (or part thereof) the border patrol agent is absent; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id37B89BA3D15948B4BE0ABD05AB6D5B39"><enum>(ii)</enum><text display-inline="yes-display-inline">any overtime
			 work applied toward the obligation under clause (i) shall not be credited
			 as overtime work
			 under any other provision of law; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1717DD8CA0E8407D9F06AD781938CF53"><enum>(G)</enum><text display-inline="yes-display-inline">for the purposes of advanced training, the border patrol agent—</text><clause commented="no" display-inline="no-display-inline" id="id64D75730481A4B3DAB1DDADB97F1C633"><enum>(i)</enum><text display-inline="yes-display-inline">shall be paid at the level 2 border patrol rate of pay for the
			 first 60 days of advanced training in a calendar year; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idC5F7919B7D4D4499BFDC113EA55A3B1D"><enum>(ii)</enum><text display-inline="yes-display-inline">for any advanced training in addition to the advanced training described in clause (i), shall be
			 paid at the basic border
			 patrol rate of pay.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id371e5c231e614dfaa3dde96796af1575"><enum>(4)</enum><header display-inline="yes-display-inline">Basic border patrol rate of pay</header><text display-inline="yes-display-inline">For a border patrol agent who is assigned to the basic border patrol rate of pay—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7aca23294aa24005b91747ca182df703"><enum>(A)</enum><text display-inline="yes-display-inline">the border patrol agent shall have a regular tour of duty consisting of 5 workdays per week with 8
			 hours of regular time per workday; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id08a4cfa5bd924538a5ad9e157234a1af"><enum>(B)</enum><text display-inline="yes-display-inline">the border patrol agent shall receive compensatory time off or pay at the overtime hourly rate of
			 pay for hours of work in excess of 80 hours during a work period, as
			 determined in accordance with section 5542(g).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6910f3e339c447e28ce361f0a325eed1"><enum>(c)</enum><header display-inline="yes-display-inline">Eligibility for other premium pay</header><text display-inline="yes-display-inline">A border patrol agent—</text><paragraph commented="no" display-inline="no-display-inline" id="id33a9d957c31a4c548bd3b832076d34a4"><enum>(1)</enum><text display-inline="yes-display-inline">shall receive premium pay for nightwork in accordance with subsections (a) and (b) of section 5545
			 and Sunday and holiday pay in accordance with section 5546, without regard
			 to the rate of pay to which the border patrol agent is assigned under this
			 section, 
			 except that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc9e44a5c2bc44fd08e6aa6c9a116f63c"><enum>(A)</enum><text display-inline="yes-display-inline">no premium pay for night, Sunday, or holiday work shall be provided for hours of regularly
			 scheduled
			 overtime work described in paragraph (2)(A)(ii) or (3)(A)(ii) of
			 subsection (b),
			 consistent with the requirements of paragraph (2)(C) or (3)(C) of
			 subsection (b); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida63955ace5a44161b1d094679832ee0b"><enum>(B)</enum><text display-inline="yes-display-inline">section 5546(d) shall not apply and instead eligibility for pay for, and the rate of pay for, any
			 overtime work on a Sunday or a designated holiday shall be determined in
			 accordance with this section and section 5542(g);</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4BD57E48A6434BDD879111EA25EC9371"><enum>(2)</enum><text display-inline="yes-display-inline">except as provided in paragraph (3) or section 5542(g), shall not be eligible for any other form of
			 premium pay under this title; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC83603C30C2B426AB35590E09C22A9C3"><enum>(3)</enum><text display-inline="yes-display-inline">shall be eligible for hazardous duty pay in accordance with section
			 5545(d).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0deef1102c08456894d4835351638b58"><enum>(d)</enum><header display-inline="yes-display-inline">Treatment as basic pay</header><text display-inline="yes-display-inline">Any pay in addition to the basic border patrol rate of pay for a border patrol agent resulting from
			 application of the level 1 border patrol rate of pay or the
			 level 2 border patrol rate of pay—</text><paragraph commented="no" display-inline="no-display-inline" id="idDB8F12AE38F94F96B514DCEE267F15D3"><enum>(1)</enum><text display-inline="yes-display-inline">subject to paragraph (2), shall be treated as part of
			 basic pay solely for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7efc9a8a14d64fdbaedb00266eb6f245"><enum>(A)</enum><text display-inline="yes-display-inline">purposes of sections 5595(c), 8114(e), 8331(3)(I), and 8704(c);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9c42effd4dff49f095d38ed0792f179b"><enum>(B)</enum><text display-inline="yes-display-inline">any other purpose that the Director of the Office of Personnel Management may by regulation
			 prescribe; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89f5a577c4384b618432355a399dc76a"><enum>(C)</enum><text display-inline="yes-display-inline">any other purpose expressly provided for by law; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB6879BB08B2F45D194EB703F369ABCF7"><enum>(2)</enum><text display-inline="yes-display-inline">shall not be treated as part of basic pay for the purposes of
			 calculating overtime pay, night pay, Sunday pay, or holiday pay under
			 section 5542, 5545, or 5546.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7eced1379d5641d981b49914a9c4b6bf"><enum>(e)</enum><header display-inline="yes-display-inline">Travel time</header><text display-inline="yes-display-inline">Travel time to and from home and duty station by a border patrol agent shall not be considered
			 hours of work under any
			 provision of law.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id87c29a28b296437da15c6cd9b857b4a7"><enum>(f)</enum><header display-inline="yes-display-inline">Leave without pay and substitution of hours</header><paragraph commented="no" display-inline="no-display-inline" id="id749B44568DBB40DDA3DEBB62CE8B0F82"><enum>(1)</enum><header display-inline="yes-display-inline">Regular time</header><subparagraph commented="no" display-inline="no-display-inline" id="id9F47A52813724EA483BC106086E752FB"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For a period of leave without pay during the regular time of a border patrol agent (as described in
			 paragraph (2)(A)(i), (3)(A)(i), or (4)(A) of subsection (b)) within a
			 work
			 period,  an equal period of work outside the regular time of the border
			 patrol agent, but in
			 the same work period—</text><clause commented="no" display-inline="no-display-inline" id="id7A56813E3E5A46059DD98A855237CF2E"><enum>(i)</enum><text display-inline="yes-display-inline">shall be substituted and paid for at the rate
			 applicable for the regular time; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id18253D4B01674007A4CA82AE5F2BE214"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not be credited as overtime
			 hours for any purpose.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDE00C341BECB49A792EBABA6B2C3B8E1"><enum>(B)</enum><header display-inline="yes-display-inline">Priority for same day work</header><text display-inline="yes-display-inline">In substituting hours of work under subparagraph (A),  work performed on the same day as the period
			 of
			 leave without pay shall be substituted first.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA1838F6DC4464623AFCC3C57CDDA60B8"><enum>(C)</enum><header display-inline="yes-display-inline">Priority for regular time substitution</header><text display-inline="yes-display-inline">Hours of work shall be substituted for regular time work under this paragraph before being
			 substituted
			 for scheduled overtime under paragraphs (2), (3), and (4).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1DE926D87E034C18972E2D57D48E93E2"><enum>(2)</enum><header display-inline="yes-display-inline">Overtime work</header><subparagraph commented="no" display-inline="no-display-inline" id="id473ED5B267B94074B562E54D42A6938C"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For a period of absence during scheduled overtime (as described in paragraph (2)(F) or (3)(F) of
			 subsection (b)) within a work period, an equal period of additional work
			 in the
			 same work period—</text><clause commented="no" display-inline="no-display-inline" id="id3D0C1A53A84E44C09C148C0E363CD599"><enum>(i)</enum><text display-inline="yes-display-inline">shall be substituted and credited as scheduled overtime;
			 and</text></clause><clause commented="no" display-inline="no-display-inline" id="id61BAD21B780B429581CFFC28BC533BC5"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not be credited as overtime hours under any other provision of
			 law.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBE30BA8323E74E5DBD6D57A59F720F7D"><enum>(B)</enum><header display-inline="yes-display-inline">Priority for same day work</header><text display-inline="yes-display-inline">In substituting hours of work under subparagraph (A), work performed on the same day as the period
			 of absence shall be substituted first.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id487EA81EDC3046B495CA06FBC6202D86"><enum>(3)</enum><header display-inline="yes-display-inline">Application of compensatory time</header><text display-inline="yes-display-inline">If a border patrol agent does not have sufficient additional work in a work period to substitute
			 for all periods of absence during scheduled overtime (as described in
			 paragraph (2)(F) or (3)(F) of subsection (b)) within that work period, any
			 accrued
			 compensatory time off under section 5542(g) shall be applied to satisfy
			 the hours obligation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3C59B931FC6F487982948F92110B50E7"><enum>(4)</enum><header display-inline="yes-display-inline">Insufficient hours</header><text display-inline="yes-display-inline">If a border patrol agent has a remaining hours obligation of scheduled overtime after applying
			 paragraphs (2) and (3), any additional work in subsequent work periods
			 that
			 would otherwise be credited under section 5542(g) shall be applied
			 towards the hours obligation until that obligation is satisfied.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc76c963456114cd6a3bdfcc02381fb33"><enum>(g)</enum><header display-inline="yes-display-inline">Authority To require overtime work</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to limit the authority of U.S. Customs and Border
			 Protection to require a border patrol agent to perform hours of overtime
			 work in accordance with the needs of U.S. Customs and Border Protection,
			 including if needed in the event of a local or national emergency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id49e80d2f68914749aed3d415ab1667e2"><enum>(c)</enum><header display-inline="yes-display-inline">Overtime work</header><paragraph commented="no" display-inline="no-display-inline" id="idE062E6B7DEF940CCBE02703546CE6720"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5542  of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id74268eccbab340fa8bd8e96f4eafd820" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id9a21e1127f86498089c13b9a9d11f5bd"><enum>(g)</enum><text display-inline="yes-display-inline">In applying subsection (a) with respect to a border patrol agent covered by section 5550, the
			 following rules apply:</text><paragraph commented="no" display-inline="no-display-inline" id="id7e65f66d6ebd42069a2067fa183afe37"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding the matter preceding paragraph (1) in subsection (a), for a border patrol agent who
			 is assigned to the level 1 border patrol rate of pay under section 5550—</text><subparagraph commented="no" display-inline="no-display-inline" id="ideadd23fb64aa4cadad41517bf0fa8e1d"><enum>(A)</enum><text display-inline="yes-display-inline">hours of work in excess of 100 hours during a 14-day biweekly pay period shall be overtime work;
			 and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id94fcbdad7d6a4f87b789b2cf6140e684"><enum>(B)</enum><text display-inline="yes-display-inline">the border patrol agent—</text><clause commented="no" display-inline="no-display-inline" id="id9b0be6f152db4cc781d315c9ec59b3fe"><enum>(i)</enum><text display-inline="yes-display-inline">shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs
			 (1) and (2) of subsection (a)) for hours of overtime work that are
			 officially ordered
			 or approved in advance of the workweek; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf408934ccb8d4c6280a7926bc53443ca"><enum>(ii)</enum><text display-inline="yes-display-inline">except as provided in
			 paragraphs (4) and (5), shall receive compensatory time off for an equal
			 amount of time spent performing overtime work that
			 is not overtime work described in clause (i).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68612be0e8474d35ac408f4dd9949b60"><enum>(2)</enum><text display-inline="yes-display-inline">Notwithstanding the matter preceding paragraph (1) in subsection (a), for a border patrol agent who
			 is assigned to the level 2 border patrol rate of pay under section 5550—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd9546aa418ea4555914f5842801412eb"><enum>(A)</enum><text display-inline="yes-display-inline">hours of work in excess of 90 hours during a 14-day biweekly pay period shall be overtime work; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ae05d921f4e4e1698eec82d17f99398"><enum>(B)</enum><text display-inline="yes-display-inline">the border patrol agent—</text><clause commented="no" display-inline="no-display-inline" id="ide16f32d95e25460082cfa262ac61e20c"><enum>(i)</enum><text display-inline="yes-display-inline">shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs
			 (1) and (2) of subsection (a)) for hours of overtime work that are
			 officially ordered
			 or approved in advance of the workweek; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id657b4df37b284ea8accd7954637bb12d"><enum>(ii)</enum><text display-inline="yes-display-inline">except as provided in
			 paragraphs (4) and (5), shall receive compensatory time off for an equal
			 amount of time spent performing overtime work that
			 is not overtime work described in clause (i).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idde9e95587b2941fd86aed949539903da"><enum>(3)</enum><text display-inline="yes-display-inline">Notwithstanding the matter preceding paragraph (1) in subsection (a), for a border patrol agent who
			 is assigned to the basic border patrol rate of pay under section 5550—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9c0370f7737d4fea8f307a629b346dea"><enum>(A)</enum><text display-inline="yes-display-inline">hours of work in excess of 80 hours during a 14-day biweekly pay period shall be overtime work; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ebe66662f304a7f964f00af584cc2fe"><enum>(B)</enum><text display-inline="yes-display-inline">the border patrol agent—</text><clause commented="no" display-inline="no-display-inline" id="id020eac1a42c14410995f239a9851d44a"><enum>(i)</enum><text display-inline="yes-display-inline">shall receive pay at the overtime hourly rate of pay (as determined in accordance with paragraphs
			 (1) and (2) of subsection (a)) for hours of overtime work that are
			 officially ordered
			 or approved in advance of the workweek; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id422cafc261fd4f96888bb79ea85693f8"><enum>(ii)</enum><text display-inline="yes-display-inline">except as provided in
			 paragraphs (4) and (5), shall receive compensatory time off for an equal
			 amount of time spent performing overtime work that
			 is not overtime work described in clause (i).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddd9f532c549649c397143f62dccd5b04"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD33F385C0F4A44A1B75641BA58BAA617"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (B), during a 14-day biweekly pay period, a border patrol agent 
			 may not earn compensatory time off for more than 10 hours of overtime
			 work.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id892B1C1B45674166BCA97644C61CEF2C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">U.S. Customs and Border Protection may, as it determines appropriate, waive
			 the limitation under subparagraph (A) for an individual border patrol
			 agent for hours of irregular or occasional
			 overtime work, but such waiver must be approved in writing in advance of
			 the performance of any such work for which compensatory time off is earned
			 under paragraph (1)(B)(ii), (2)(B)(ii), or (3)(B)(ii).  If a
			 waiver request by a border patrol agent is denied, the border patrol agent
			 may not be ordered to perform the
			 associated overtime work.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f5db9e6ac254cde81f7d9655775db37"><enum>(5)</enum><text display-inline="yes-display-inline">A border patrol agent—</text><subparagraph commented="no" display-inline="no-display-inline" id="idef5f044949cc418f83deb1266ca77355"><enum>(A)</enum><text display-inline="yes-display-inline">may not earn more than 240 hours of compensatory time off during a leave year;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6e5c24f565c94096bfd8487807b040c6"><enum>(B)</enum><text display-inline="yes-display-inline">shall use any hours of compensatory time off not later than the end of the 26th pay period after
			 the pay period during which the compensatory time off was earned;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8832a0c8afc04e34ac6e977aa6f980b6"><enum>(C)</enum><text display-inline="yes-display-inline">shall be required to use 1 hour of compensatory time off for each hour of regular time	not
worked for which the border patrol agent is not on paid leave or other paid time off or does
			 not substitute time in accordance with section 5550(f);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4da3b11bd1b44eb1a027299f57f1cb50"><enum>(D)</enum><text display-inline="yes-display-inline">shall forfeit any compensatory time off not used in accordance with this paragraph and, regardless
			 of circumstances, shall not be entitled to any cash value for compensatory
			 time earned under section 5550;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id11D8A838A4914DAE97BA4FDF268BE421"><enum>(E)</enum><text display-inline="yes-display-inline">shall not receive credit towards the computation of the annuity of the border patrol agent for
			 compensatory time, whether used or
			 not;
			 and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7e87ab4d68fa4b74a1d4f381fe0c5ccb"><enum>(F)</enum><text display-inline="yes-display-inline">shall not be credited with compensatory time off if the value of such time off would cause the
			 aggregate premium pay of the border patrol agent to exceed the limitation
			 established under
			 section 5547 in the period in which it was earned.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf573c038091b4db8bb08698de79e9c3d"><enum>(2)</enum><header display-inline="yes-display-inline">Minimization of overtime</header><text display-inline="yes-display-inline">U.S. Customs and Border Protection shall, to the maximum extent practicable, avoid the use of
			 scheduled overtime work by border patrol agents.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id893ac50ba8be4f32b7a2859d24fa3ee4"><enum>(d)</enum><header display-inline="yes-display-inline">Retirement</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/8331">Section 8331(3)</external-xref> of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id722d23504fb346bf8850c1a92ffa56cf"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (G), by striking <quote>and</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd26bed8cfac84d5f91c9e38d8d5926d9"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (H), by inserting <quote>and</quote> after the semicolon;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id290ccb2696f9466b9967f43fce1a3d58"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting a new subparagraph after subparagraph (H) as follows:</text><quoted-block display-inline="no-display-inline" id="id13a44bf506a249048528dd6e7aa81108" style="OLC"><subclause commented="no" display-inline="no-display-inline" id="idf726e4887f7e4478afdda2a08c7f310b"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to a border patrol agent, the amount of supplemental pay received through application

			 provided in section 5550;</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id936efc1f68e54cdd899a83e3ec9feb08"><enum>(4)</enum><text display-inline="yes-display-inline">in the undesignated matter following subparagraph (H), by striking <quote>subparagraphs (B) through (H)</quote> and inserting <quote>subparagraphs (B) through (I)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1184103A2F1E4C40A7FA707A6C543E52"><enum>(e)</enum><header display-inline="yes-display-inline">Comprehensive staffing analysis</header><paragraph commented="no" display-inline="no-display-inline" id="id6bf8808593d04bf0b07c64868a7123b8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, U.S. Customs and Border Protection
			 shall conduct a comprehensive analysis, and submit to the Comptroller
			 General of the United States a report, that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idDCC28CAC18CC434B8B37EEAD996AFAC3"><enum>(A)</enum><text display-inline="yes-display-inline">examines  the staffing requirements for U.S. Border Patrol to most effectively meet its operational
			 requirements at each Border Patrol duty station;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4206D5CACEE44329A01B109703EAFF3A"><enum>(B)</enum><text display-inline="yes-display-inline">estimates the cost of the staffing requirements at each Border Patrol duty station; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id719e604b1a17436da81d95c0a885c45e"><enum>(C)</enum><text display-inline="yes-display-inline">includes—</text><clause commented="no" display-inline="no-display-inline" id="id5E22FE56E3A44B958F3C3691450FBB80"><enum>(i)</enum><text display-inline="yes-display-inline">a position-by-position review at each Border Patrol station to determine—</text><subclause commented="no" display-inline="no-display-inline" id="id6B2F8CEBF9F548E194BD1F75323E122C"><enum>(I)</enum><text display-inline="yes-display-inline">the duties assigned to each position;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id73acaf6934054c698a42dd02e2ebd6d4"><enum>(II)</enum><text display-inline="yes-display-inline">how the duties relate to the operational requirements of U.S. Border Patrol; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9BDAC363DB03440A8ADA7D7B81C8E413"><enum>(III)</enum><text display-inline="yes-display-inline">the number of  hours border patrol agents in that position would need to work each pay period to
			 meet the operational requirements of U.S. Border Patrol;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id6ba2f02ec764454f90240d73294e6cca"><enum>(ii)</enum><text display-inline="yes-display-inline">the metrics used to determine the number of hours of work performed at each Border Patrol station,
			 broken down by the type of hours worked;</text></clause><clause commented="no" display-inline="no-display-inline" id="idee0497b06ac34665a264385fec4367d4"><enum>(iii)</enum><text display-inline="yes-display-inline">a cost analysis of the most recent full fiscal year by the type of full-time equivalent hours
			 worked;</text></clause><clause commented="no" display-inline="no-display-inline" id="id38d22b8b01494959babd088f3308762e"><enum>(iv)</enum><text display-inline="yes-display-inline">a cost estimate by the type of full-time equivalent hours expected to be worked during the first
			 full fiscal year after the date of enactment of this Act; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9868d01fc21148ee96b68745a675e1b4"><enum>(v)</enum><text display-inline="yes-display-inline">an analysis that compares the cost of assigning the full-time equivalent hours needed to meet the
			 operational requirements of U.S. Border Patrol to existing border patrol
			 agents through higher rates of pay versus recruiting, hiring, training,
			 and deploying additional border patrol agents.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ca908f4f1ec4d3798b43fae349b7833"><enum>(2)</enum><header display-inline="yes-display-inline">Independent validator</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Comptroller General receives the report under
			 paragraph (1), the Comptroller General shall submit to the appropriate
			 committees of Congress a report that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1270C1AE4CE748FEA0F9EF24404324E8"><enum>(A)</enum><text display-inline="yes-display-inline">examines the methodology used by U.S. Customs and Border Protection to carry  out the analysis; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD2E5D0BAF9F84CD188638583B08F3757"><enum>(B)</enum><text display-inline="yes-display-inline">indicates whether the Comptroller General concurs with the findings in the report under paragraph
			 (1).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide11b217297004476a731e09923e3fe95"><enum>(3)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>appropriate committees of Congress</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7FA54F8DD03743588FE5FD268259ABEB"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of
			 the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88441E7090734ADF8EF77E11611F4073"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Government  Reform and the Committee on Appropriations of
			 the House of Representatives.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id90CCBABAA69747EE8FC588961DA9AB65"><enum>(f)</enum><header display-inline="yes-display-inline">Rules of construction</header><text display-inline="yes-display-inline">Nothing in this section or the amendments made by this section shall be construed to—</text><paragraph commented="no" display-inline="no-display-inline" id="idce2150a4afd64638b511e1790c8470ec"><enum>(1)</enum><text display-inline="yes-display-inline">limit the right of U.S. Customs and Border Protection to
			 assign both scheduled
			 and unscheduled work to a border patrol agent based on the needs of U.S.
			 Customs and Border Protection in
			 excess of the hours of work normally applicable under the election of the
			 border patrol agent, regardless of what the border patrol agent might
			 otherwise have elected;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42a8d03bc16846dcb46f73ef14e6757d"><enum>(2)</enum><text display-inline="yes-display-inline">require compensation of a border patrol agent other than
			 for hours during which the border patrol agent is actually performing work
			 or using approved
			 paid leave or other paid time off;  or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c8493396c6b46aeb858070e5fa41fae"><enum>(3)</enum><text display-inline="yes-display-inline">exempt a border patrol agent from any limitations on pay, earnings, or
			 compensation, including the limitations under

			 incumbent performs, manages, or supervises functions that execute the
			 responsibilities of the Department relating to cybersecurity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62C88B8D42784EC68BF1AD65DDF47340"><enum>(6)</enum><header display-inline="yes-display-inline">Senior executive service</header><text display-inline="yes-display-inline">The term <term>Senior Executive Service</term> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/2101a">section 2101a</external-xref> of title 5, United States Code.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8a2d9de1b2e84619bc961a198db2c8b2"><enum>(b)</enum><header display-inline="yes-display-inline">General authority</header><paragraph commented="no" display-inline="no-display-inline" id="id46ecda24f44946e9b4b2404bd4fb8feb"><enum>(1)</enum><header display-inline="yes-display-inline">Establish positions, appoint personnel, and fix rates of pay</header><subparagraph commented="no" display-inline="no-display-inline" id="id43ea89325a8740c5b08e3f4e66331075"><enum>(A)</enum><header display-inline="yes-display-inline">General authority</header><text display-inline="yes-display-inline">The Secretary may—</text><clause commented="no" display-inline="no-display-inline" id="id245ed952582f44a39585a52a0e276b80"><enum>(i)</enum><text display-inline="yes-display-inline">establish, as positions in the excepted service, such qualified positions in the Department as the
			 Secretary determines necessary to carry out the responsibilities of the
			 Department relating to cybersecurity, including positions formerly
			 identified as—</text><subclause commented="no" display-inline="no-display-inline" id="ida5c9045ac42f4f00add7b0f42703be89"><enum>(I)</enum><text display-inline="yes-display-inline">senior level positions designated under <external-xref legal-doc="usc" parsable-cite="usc/5/5376">section 5376</external-xref> of title 5, United States Code; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2b2c500466c3453692b92c3845e1f92c"><enum>(II)</enum><text display-inline="yes-display-inline">positions in the Senior Executive Service;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3646b2b43556456089a5cad866b3635c"><enum>(ii)</enum><text display-inline="yes-display-inline">appoint an individual to a qualified position (after taking into consideration the availability of
			 preference eligibles for appointment to the position); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idca16ba9869ba4aa59088a535e9f06097"><enum>(iii)</enum><text display-inline="yes-display-inline">subject to the requirements of paragraphs (2) and (3), fix the compensation of	an individual for
			 service in a qualified position.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida810a9c5af5d4692b4c68df92d848887"><enum>(B)</enum><header display-inline="yes-display-inline">Construction with other laws</header><text display-inline="yes-display-inline">The authority of the Secretary under this subsection applies without regard to the provisions of
			 any other law relating to the appointment, number, classification, or
			 compensation of employees.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc6b467f8b11a492bad44f55ef0e4c633"><enum>(2)</enum><header display-inline="yes-display-inline">Basic pay</header><subparagraph commented="no" display-inline="no-display-inline" id="id080f5166ae9f416a8f02a5c6a4da73b9"><enum>(A)</enum><header display-inline="yes-display-inline">Authority to fix rates of basic pay</header><text display-inline="yes-display-inline">In accordance with this section, the Secretary shall fix the rates of basic pay for any qualified
			 position established under paragraph (1) in relation to the rates of pay
			 provided for employees in comparable positions in the Department of
			 Defense and subject to the same limitations on maximum rates of pay
			 established for such employees by law or regulation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4bd7d6f861e041c69b80fce64e737d7c"><enum>(B)</enum><header display-inline="yes-display-inline">Prevailing rate systems</header><text display-inline="yes-display-inline">The Secretary may, consistent with <external-xref legal-doc="usc" parsable-cite="usc/5/5341">section 5341</external-xref> of title 5, United States Code, adopt such
			 provisions of that title as provide for prevailing rate systems of basic
			 pay and may apply those provisions to qualified positions for employees in
			 or under which the Department may employ individuals described by section
			 5342(a)(2)(A) of that title.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9d97134eb9664d04b58f4a0cb438423c"><enum>(3)</enum><header display-inline="yes-display-inline">Additional compensation, incentives, and allowances</header><subparagraph commented="no" display-inline="no-display-inline" id="idc13ed2ff60204fd795bf0b5ee4621e75"><enum>(A)</enum><header display-inline="yes-display-inline">Additional compensation based on title 5 authorities</header><text display-inline="yes-display-inline">The Secretary may provide employees in qualified positions compensation (in addition to basic pay),
			 including benefits, incentives, and allowances, consistent with, and not
			 in excess of the level authorized for, comparable positions authorized by
			 title 5, United States Code.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7b35e146a37244eb94ef92b4b5f2f187"><enum>(B)</enum><header display-inline="yes-display-inline">Allowances in nonforeign areas</header><text display-inline="yes-display-inline">An employee in a qualified position whose rate of basic pay is fixed under paragraph (2)(A) shall
			 be eligible for an allowance under <external-xref legal-doc="usc" parsable-cite="usc/5/5941">section 5941</external-xref> of title 5, United States
			 Code, on the same basis and to the same extent as if the employee was an
			 employee covered by such section 5941, including eligibility conditions,
			 allowance rates, and all other terms and conditions in law or regulation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id812412529e07459499c4f2c3f76d93a5"><enum>(4)</enum><header display-inline="yes-display-inline">Plan for execution of authorities</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this section, the Secretary shall submit a
			 report to the appropriate committees of Congress with a plan for the use
			 of the authorities provided under this subsection.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1c9df13df17b47b18198aa8b0a0276ed"><enum>(5)</enum><header display-inline="yes-display-inline">Collective bargaining agreements</header><text display-inline="yes-display-inline">Nothing in paragraph (1) may be construed to impair the continued effectiveness of a collective
			 bargaining agreement with respect to an office, component, subcomponent,
			 or equivalent of the Department that is a successor to an office,
			 component, subcomponent, or equivalent of the Department covered by the
			 agreement before the succession.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idda78f4b672ea4a2bbbd36f77e39b002b"><enum>(6)</enum><header display-inline="yes-display-inline">Required regulations</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Director of the Office of Personnel Management, shall
			 prescribe regulations for the administration of this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idccd6336ea6de4497b59c71143864c7cf"><enum>(c)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, and every year thereafter for 4
			 years, the Secretary shall submit to the appropriate committees of
			 Congress a detailed report that—</text><paragraph commented="no" display-inline="no-display-inline" id="id499608dde8da48f0a43fbc438906d6d3"><enum>(1)</enum><text display-inline="yes-display-inline">discusses the process used by the Secretary in accepting applications, assessing candidates,
			 ensuring adherence to veterans’ preference, and selecting applicants for
			 vacancies to be filled by an individual for a qualified position;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida489d44b31c546caa3d81a36782d0f89"><enum>(2)</enum><text display-inline="yes-display-inline">describes—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide3355ee729da424a89b1a1096b6f4ca9"><enum>(A)</enum><text display-inline="yes-display-inline">how the Secretary plans to fulfill the critical need of the Department to recruit and retain
			 employees in qualified positions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id74829378e3b74c46839ce72c1906bdd8"><enum>(B)</enum><text display-inline="yes-display-inline">the measures that will be used to measure progress; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48470003cd1a459ca5913bbed92c93f3"><enum>(C)</enum><text display-inline="yes-display-inline">any actions taken during the reporting period to fulfill such critical need;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcba2b6a4247f4b21b8ac4c8d1bb20658"><enum>(3)</enum><text display-inline="yes-display-inline">discusses how the planning and actions taken under paragraph (2) are integrated into the strategic
			 workforce planning of the Department;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1eb5dcde4c6941ec938328728d125cc9"><enum>(4)</enum><text display-inline="yes-display-inline">provides metrics on actions occurring during the reporting period, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide1ec1194d66645f0ac88dddb91f4b52c"><enum>(A)</enum><text display-inline="yes-display-inline">the number of employees in qualified positions hired by occupation and grade and level or pay band;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd4a905f771184bcb880af670d485c484"><enum>(B)</enum><text display-inline="yes-display-inline">the placement of employees in qualified positions by directorate and office within the Department;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21486583cfe54999b42ef2f8565841bd"><enum>(C)</enum><text display-inline="yes-display-inline">the total number of veterans hired;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd2c1ea799cb4f64aa737d070a5ea34f"><enum>(D)</enum><text display-inline="yes-display-inline">the number of separations of employees in qualified positions by occupation and grade and level or
			 pay band;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbe5112cee3cb4b6fa4c349676779d96b"><enum>(E)</enum><text display-inline="yes-display-inline">the number of retirements of employees in qualified positions by occupation and grade and level or
			 pay band; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0a84517726d143c781ba4074f1664f97"><enum>(F)</enum><text display-inline="yes-display-inline">the number and amounts of recruitment, relocation, and retention incentives paid to employees in
			 qualified positions by occupation and grade and level or pay band; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45797e55d38d4e3c9a25b230be486171"><enum>(5)</enum><text display-inline="yes-display-inline">describes the training provided to supervisors of employees in qualified positions at the
			 Department on the use of the new authorities.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id373e56fb8e0b49919ec980ec804b7272"><enum>(d)</enum><header display-inline="yes-display-inline">Three-Year Probationary Period</header><text display-inline="yes-display-inline">The probationary period for all employees hired under the authority established in this section
			 shall be 3 years.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idda1b11abbe0546968679f1e3b3aa6a93"><enum>(e)</enum><header display-inline="yes-display-inline">Incumbents of existing competitive service positions</header><paragraph commented="no" display-inline="no-display-inline" id="idC5B554615A0B4657A299ED63A263CB35"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An individual serving in a position on the date of enactment of this section that is selected to be
			 converted to a position in the excepted service under this section shall
			 have the right to refuse such conversion.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3339C2C1DEDA4A1CBAEF63734021B69E"><enum>(2)</enum><header display-inline="yes-display-inline">Subsequent conversion</header><text display-inline="yes-display-inline">After the date on which an individual who refuses a conversion under paragraph (1) stops serving in
			 the position selected to be converted, the position may be converted to a
			 position in the excepted service.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id94ffce26587f461286e3bba3a24ff512"><enum>(f)</enum><header display-inline="yes-display-inline">Study and report</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this section, the National Protection and
			 Programs Directorate shall submit a report regarding the availability of,
			 and benefits (including cost savings and security) of using, cybersecurity
			 personnel and facilities outside of the National Capital Region (as
			 defined in <external-xref legal-doc="usc" parsable-cite="usc/10/2674">section 2674</external-xref> of title 10, United States Code) to serve the
			 Federal and national need to—</text><paragraph commented="no" display-inline="no-display-inline" id="idF604FAD349C345E4A96B23EB0CEF8E64"><enum>(1)</enum><text display-inline="yes-display-inline">the Subcommittee on Homeland Security of the Committee on Appropriations and the Committee on
			 Homeland Security and Governmental Affairs of the Senate; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0346C94792B406D8000E22EC9DA7736"><enum>(2)</enum><text display-inline="yes-display-inline">the  Subcommittee on Homeland Security of the Committee on Appropriations and the Committee on
			 Homeland Security of the House of Representatives.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idf882bd6ec2244c0fa6de066e196dfe5c"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/3132">Section 3132(a)(2)</external-xref> of title 5, United States Code, is amended in the matter following subparagraph

Cybersecurity recruitment and retention.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="idC063B9E4BBFC4ABA84E1C1A549BC30F2" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Homeland security cybersecurity workforce assessment</header><subsection commented="no" display-inline="no-display-inline" id="id874B76AD052C42DEA1C2777C72E57BFA"><enum>(a)</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Homeland Security Cybersecurity Workforce Assessment Act</short-title></quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1961642EA0EF4ECBA013183D4882B1AB"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id198F0BC777824EE3A492DD931C16AFCC"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1c23d140cfbd431c8f2cf4c98d6431d0"><enum>(A)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id257a1dfe509e4f9da9b4bd14e9838b5b"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5A3C4A2E2653446C9B23C7AC266C67E4"><enum>(C)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="">Committee on House Administration of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF4012636F9854AA08F5CDE44F82B9264"><enum>(2)</enum><header display-inline="yes-display-inline">Cybersecurity work category; data element code; specialty area</header><text display-inline="yes-display-inline">The terms <term>Cybersecurity Work Category</term>, <term>Data Element Code</term>, and <term>Specialty Area</term> have the meanings given such terms in the Office of Personnel Management’s Guide to Data
			 Standards.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9454194F07B64829B4C86A6B8443AFA7"><enum>(3)</enum><header display-inline="yes-display-inline">Department</header><text display-inline="yes-display-inline">The term <term>Department</term> means the Department of Homeland Security.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id287695A1422841FB933266A13D8F820D"><enum>(4)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office of Personnel Management.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18CFFB16793B48A0BD91AEF76D2C4880"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4d3b3c620c8c47089b43c25bd24766f0"><enum>(c)</enum><header display-inline="yes-display-inline">National Cybersecurity Workforce Measurement Initiative</header><paragraph commented="no" display-inline="no-display-inline" id="id19D282B21DB14D0E94DA6F68399700EF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7F814408991C40E5B486BDCB92603C8C"><enum>(A)</enum><text display-inline="yes-display-inline">identify all cybersecurity workforce positions within the Department;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20F691786EC645E8B81EA7597FF3A0C9"><enum>(B)</enum><text display-inline="yes-display-inline">determine the primary Cybersecurity Work Category and Specialty Area of such positions; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb51c5c3f8d544efa4e9e12836241375"><enum>(C)</enum><text display-inline="yes-display-inline">assign the corresponding Data Element Code, as	set forth in	the Office of Personnel
			 Management’s Guide to Data Standards which is aligned with the National
			 Initiative for Cybersecurity Education’s National Cybersecurity Workforce
			 Framework report, in  accordance with paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94E00221BA594E52B91B16126A300FBD"><enum>(2)</enum><header display-inline="yes-display-inline">Employment codes</header><subparagraph commented="no" display-inline="no-display-inline" id="id4bafacee598647838015ee8b207d9d04"><enum>(A)</enum><header display-inline="yes-display-inline">Procedures</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary shall establish
			 procedures—</text><clause commented="no" display-inline="no-display-inline" id="id0E41CD75E7CE4FC197616FE01EFC87F4"><enum>(i)</enum><text display-inline="yes-display-inline">to identify open positions that include cybersecurity functions (as defined in the OPM Guide to
			 Data Standards); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id18A72A10F2D34C63BF4CBE373DFF569F"><enum>(ii)</enum><text display-inline="yes-display-inline">to assign the appropriate employment code to each such position, using agreed standards and
			 definitions.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1D5DDA3E9EBE4EC2BFAC6CAFE7DE6CF4"><enum>(B)</enum><header display-inline="yes-display-inline">Code assignments</header><text display-inline="yes-display-inline">Not later than 9 months after the date of the enactment of this Act, the Secretary shall assign the
			 appropriate employment code to—</text><clause commented="no" display-inline="no-display-inline" id="id6F0824B6C5CE4073A8B0AA7E39024A64"><enum>(i)</enum><text display-inline="yes-display-inline">each employee within the Department who carries out cybersecurity functions; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide38fdb4c9b13488095dccb8747b2bb5c"><enum>(ii)</enum><text display-inline="yes-display-inline">each open position within the Department that have been identified as having cybersecurity
			 functions.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id60cffb3680ad4a5b8030a7f42226858d"><enum>(3)</enum><header display-inline="yes-display-inline">Progress report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Director shall submit a
			 progress report on the implementation of this subsection to the
			 appropriate congressional committees.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc23852c6a18e4f54a72c66efa61757a5"><enum>(d)</enum><header display-inline="yes-display-inline">Identification of cybersecurity specialty areas of critical need</header><paragraph commented="no" display-inline="no-display-inline" id="id485c9aba305d4cf88efccde41d017c35"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning not later than 1 year after the date on which the employment codes are assigned to
			 employees pursuant to subsection (c)(2)(B), and annually through 2021, the
			 Secretary, in consultation with the Director, shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id92af0f60f1494cc1bf5eef0b4b055386"><enum>(A)</enum><text display-inline="yes-display-inline">identify Cybersecurity Work Categories and Specialty Areas of critical need in the Department’s
			 cybersecurity workforce; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf5742bedfdad4eb58bccb4ddb4da12e2"><enum>(B)</enum><text display-inline="yes-display-inline">submit a report to the Director that—</text><clause commented="no" display-inline="no-display-inline" id="id55CC61A7389E4F30B559D0138D1E1B64"><enum>(i)</enum><text display-inline="yes-display-inline">describes the Cybersecurity Work Categories and Specialty Areas identified under subparagraph (A);
			 and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3C94F15B97F747C3ADB8C3F72D732718"><enum>(ii)</enum><text display-inline="yes-display-inline">substantiates the critical need designations.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18d7ddb06eac44509fad2e3a21d1541c"><enum>(2)</enum><header display-inline="yes-display-inline">Guidance</header><text display-inline="yes-display-inline">The Director shall provide the Secretary with timely guidance for identifying Cybersecurity Work
			 Categories and Specialty Areas of critical need, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1fcdf1bb1288431c9484b306759fb60f"><enum>(A)</enum><text display-inline="yes-display-inline">current Cybersecurity Work Categories and Specialty Areas with acute skill shortages; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8598d0b778634a1390a0bbbf222d44c4"><enum>(B)</enum><text display-inline="yes-display-inline">Cybersecurity Work Categories and Specialty Areas with emerging skill shortages.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e7395c63538459e8ac053a76af28421"><enum>(3)</enum><header display-inline="yes-display-inline">Cybersecurity critical needs report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Secretary, in
			 consultation with the Director, shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc66c0fd6e2f3433f9a0343e908f436b4"><enum>(A)</enum><text display-inline="yes-display-inline">identify Specialty Areas of critical need for cybersecurity workforce across the Department; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8e3b36d6b7c4a42a72437eb1bca186d"><enum>(B)</enum><text display-inline="yes-display-inline">submit a progress report on the implementation of this subsection to the appropriate congressional
			 committees.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDAECD9CE4185412FBE79BAB11FC42737"><enum>(e)</enum><header display-inline="yes-display-inline">Government Accountability Office status reports</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id866C501D134B4FCCA1E441F86205B517"><enum>(1)</enum><text display-inline="yes-display-inline">analyze and monitor the implementation of subsections (c) and (d); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0EBD8DC0A12644D58B1CDE12B2D1B43D"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 3 years after the date of the enactment of this Act, submit a report to the
			 appropriate congressional committees that describes the status of such
