			 intelligence and intelligence-related activities of the following elements

			 authorized personnel ceilings as of September 30, 2014, for the conduct of
			 the intelligence activities of the elements listed in paragraphs (1)
			 through (16) of section 101, are those specified in the classified
			 Schedule of Authorizations prepared to accompany the bill S. 1681 of the
			 One Hundred Thirteenth Congress.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HF2D995CE46B447B689B104DF854E5300"><enum>(b)</enum><header display-inline="yes-display-inline">Availability of classified Schedule of Authorizations</header><paragraph commented="no" display-inline="no-display-inline" id="H411391557F804C018708782AFD0F8675"><enum>(1)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">The classified Schedule of Authorizations referred to in subsection (a) shall be made available to
			 the Committee on Appropriations of the Senate, the Committee on
			 Appropriations of the House of Representatives, and to the President.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1DFD8C151CCB47EFA48816451BAFF89C"><enum>(2)</enum><header display-inline="yes-display-inline">Distribution by the President</header><text display-inline="yes-display-inline">Subject to paragraph (3), the President shall provide for suitable distribution of the classified
			 Schedule of Authorizations, or of appropriate portions of the Schedule,
			 within the executive branch.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3D0D53C9CEA6463D8A02CE178C73016D"><enum>(3)</enum><header display-inline="yes-display-inline">Limits on disclosure</header><text display-inline="yes-display-inline">The President shall not publicly disclose the classified Schedule of Authorizations or any portion
			 of such Schedule except—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCFCDBA99E7B2486F90398103DD55C3F1"><enum>(A)</enum><text display-inline="yes-display-inline">as provided in section 601(a) of the Implementing Recommendations of the 9/11 Commission Act of
			 2007 (<external-xref legal-doc="usc" parsable-cite="usc/50/3306">50 U.S.C. 3306(a)</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0375A16CAA0945AD8255BB7DCB9C3890"><enum>(B)</enum><text display-inline="yes-display-inline">to the extent necessary to implement the budget; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9AEE0E0419F34753BFA65FF9F23775CE"><enum>(C)</enum><text display-inline="yes-display-inline">as otherwise required by law.</text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9ECCC2BA87564E86A59629F8C2D903A5" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Personnel ceiling adjustments</header><subsection commented="no" display-inline="no-display-inline" id="H1EB381977D334EBEB4AFB86BF9661128"><enum>(a)</enum><header display-inline="yes-display-inline">Authority for increases</header><text display-inline="yes-display-inline">The Director of National Intelligence may authorize employment of civilian personnel in excess of
			 the number authorized for fiscal year 2014 by the classified Schedule of
			 Authorizations referred to in section 102(a) if the Director of National
			 Intelligence determines that such action is necessary to the performance
			 of important intelligence functions, except that the number of personnel
			 employed in excess of the number authorized under such section may not,
			 for any element of the intelligence community, exceed 3 percent of the
			 number of civilian personnel authorized under such Schedule for such
			 element.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HCF244DDE75CE4262A211A86375B7A20B"><enum>(b)</enum><header display-inline="yes-display-inline">Treatment of certain personnel</header><text display-inline="yes-display-inline">The Director of National Intelligence shall establish guidelines that govern, for each element of
			 the intelligence community, the treatment under the personnel levels
			 authorized under section 102(a), including any exemption from such
			 personnel levels, of employment or assignment in—</text><paragraph commented="no" display-inline="no-display-inline" id="HD133651777874B768722718121295089"><enum>(1)</enum><text display-inline="yes-display-inline">a student program, trainee program, or similar program;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A83529C7384485B91AD844B3947333E"><enum>(2)</enum><text display-inline="yes-display-inline">a reserve corps or as a reemployed annuitant; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3FCF71068760463F8AEBA50EDF9AED9C"><enum>(3)</enum><text display-inline="yes-display-inline">details, joint duty, or long term, full-time training.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H771E8459FDDB4FF196B210FB42B7BBBB"><enum>(c)</enum><header display-inline="yes-display-inline">Notice to congressional intelligence committees</header><text display-inline="yes-display-inline">The Director of National Intelligence shall notify the congressional intelligence committees in
			 writing at least 15 days prior to each exercise of an authority described
			 in subsection (a).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id7E73B0EEE6974E16A935396253B9B7DC" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Intelligence Community Management Account</header><subsection commented="no" display-inline="no-display-inline" id="HF2C166314F624F018925821F7F52085A"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the Intelligence Community Management Account of the
			 Director of National Intelligence for fiscal year 2014 the sum of
			 $528,229,000. Within such amount, funds identified in the classified
			 Schedule of Authorizations referred to in
			 section 102(a) for advanced research and development shall remain
			 available until September 30, 2015.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H28BF48BE8B0A403DA9FCF9C808A0507D"><enum>(b)</enum><header display-inline="yes-display-inline">Authorized personnel levels</header><text display-inline="yes-display-inline">The elements within the Intelligence Community Management Account of the Director of National
			 Intelligence are authorized 855 positions as of September 30, 2014.
			 Personnel serving in such elements may be permanent employees
			 of the Office of the Director of National Intelligence or personnel
			 detailed from other elements of the United States Government.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HD68E0EC7619C4FF1AF1F7B1058932948"><enum>(c)</enum><header display-inline="yes-display-inline">Classified authorizations</header><paragraph commented="no" display-inline="no-display-inline" id="H873A5F63F79446968D9A269FA3A67F68"><enum>(1)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts authorized to be appropriated for the Intelligence Community Management
			 Account by subsection (a), there are authorized to be appropriated for the
			 Community Management Account for fiscal year 2014 such additional amounts
			 as are specified in the classified Schedule of Authorizations referred to
			 in section 102(a). Such additional amounts for advanced research and
			 development shall remain available until September 30, 2015.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H255742F9142C426AB05899A374DD9B9B"><enum>(2)</enum><header display-inline="yes-display-inline">Authorization of personnel</header><text display-inline="yes-display-inline">In addition to the personnel authorized by subsection (b) for elements of the Intelligence
			 Community Management Account as of September 30, 2014, there are
			 authorized such additional personnel for the Community Management Account
			 as of that date as are specified in the classified Schedule of
			 Authorizations referred to in section 102(a).</text></paragraph></subsection></section></title><title commented="no" id="H27FAF07F2C8A4EB2B58EB08AF417D6BA" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Central Intelligence Agency Retirement and Disability System</header><section commented="no" display-inline="no-display-inline" id="idD72EC4FA8657411A8753D0357C98B762" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for the Central Intelligence Agency Retirement and
			 Disability Fund for fiscal year 2014 the sum of $514,000,000.</text></section><section commented="no" display-inline="no-display-inline" id="idC3990915C47E47F5B0841F38C982C881" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">CIARDS and FERS special retirement credit for service on detail to another agency</header><subsection commented="no" display-inline="no-display-inline" id="H4615FD6590344758866F6E8EA5D0E6E7"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 203(b) of the Central Intelligence Agency Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2013">50 U.S.C. 2013(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HA779FF299A8D43BC83E71C8D2BF9161D"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>service in the Agency performed</quote> and inserting <quote>service performed by an Agency employee</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H363889F20B3044FEBFFB0F41205D9460"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>Agency activities</quote> and inserting <quote>intelligence activities</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6F1C98C97E7349B1ABA6250A0A51B9F0"><enum>(b)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall be applied to retired or deceased officers of the
			 Central Intelligence Agency who were designated at any time under section
			 203 of the Central Intelligence Agency Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2013">50 U.S.C. 2013</external-xref>) prior to the date of the enactment of this Act.</text></subsection></section></title><title commented="no" id="HE4394D616F1E4AB2B13A5F8B89D463AC" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">General provisions</header><subtitle commented="no" id="H41C7D2ADE9DF470EBCA9B5FD3AAAC219" level-type="subsequent"><enum>A</enum><header display-inline="yes-display-inline">General matters</header><section commented="no" display-inline="no-display-inline" id="id4F25A7FAACC7405E8B50D6A2E5A6DACD" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Increase in employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for salary, pay, retirement, and other benefits for Federal
			 employees may be increased by such additional or supplemental amounts as
			 may be necessary for increases in such compensation or benefits authorized
			 by law.</text></section><section commented="no" display-inline="no-display-inline" id="idB31B49B46DFD4E7C975112E1D1FA905B" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Restriction on conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this Act shall not be deemed to constitute authority for the
			 conduct of any intelligence activity which is not otherwise authorized by
			 the Constitution or the laws of the United States.</text></section><section commented="no" display-inline="no-display-inline" id="id59331bfbb4eb4e7e8ee18237a8ac3131" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Specific authorization of funding for High Performance Computing Center 2</header><text display-inline="no-display-inline">Funds appropriated for the construction of the High Performance Computing Center 2 (HPCC 2), as
			 described in the table entitled Consolidated Cryptologic Program (CCP) in
			 the classified annex to accompany the Consolidated and Further Continuing
			 Appropriations Act, 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/113/6">Public Law 113–6</external-xref>; 127 Stat. 198), in excess of
			 the amount specified for such activity in the tables in the classified
			 annex prepared to accompany the Intelligence Authorization Act for Fiscal
			 Year 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/112/277">Public Law 112–277</external-xref>; 126 Stat. 2468) shall be specifically
			 authorized by Congress for the purposes of section 504 of the National
			 Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3094">50 U.S.C. 3094</external-xref>).</text></section><section commented="no" display-inline="no-display-inline" id="id93A68BC469764C8CB78DBBE7BEE35FCB" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Clarification of exemption from Freedom of Information Act of identities of employees submitting
			 complaints to the Inspector General of the Intelligence Community</header><text display-inline="no-display-inline">Section 103H(g)(3)(A) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3033">50 U.S.C. 3033(g)(3)(A)</external-xref>) is amended by striking <quote>undertaken;</quote> and inserting <quote>undertaken, and this provision shall qualify as a withholding statute pursuant to subsection (b)(3)
			 of <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>);</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idA3859A965FD44FEE92C3C73E3DBCD098" section-type="subsequent-section"><enum>305.</enum><header display-inline="yes-display-inline">Functional managers for the intelligence community</header><subsection commented="no" display-inline="no-display-inline" id="id3BF12C6248064531AEE6B785C7723679"><enum>(a)</enum><header display-inline="yes-display-inline">Functional managers authorized</header><text display-inline="yes-display-inline">Title I of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3021">50 U.S.C. 3021 et seq.</external-xref>) is amended by inserting after
			 section 103I the following new section:</text><quoted-block display-inline="no-display-inline" id="id9F886E7A8969437CB4E998D3DA9355F2" style="OLC"><section commented="no" display-inline="no-display-inline" id="id30A85A95DEA44C2EAD3CA745EF1BF554" section-type="subsequent-section"><enum>103J.</enum><header display-inline="yes-display-inline">Functional managers for the intelligence  community</header><subsection commented="no" display-inline="no-display-inline" id="idEDF9C9517DF14C8FA3EF8CA677D51452"><enum>(a)</enum><header display-inline="yes-display-inline">Functional managers authorized</header><text display-inline="yes-display-inline">The Director of National Intelligence may establish within the intelligence community one or more
			 positions of manager of an intelligence function. Any position so
			 established may be known as the <quote>Functional Manager</quote> of the intelligence function concerned.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idCBED006F405F4D38B729123F3C708986"><enum>(b)</enum><header display-inline="yes-display-inline">Personnel</header><text display-inline="yes-display-inline">The Director shall designate individuals to serve as manager of intelligence functions established
			 under subsection (a) from among officers and employees of elements of the
			 intelligence community.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idDB09A2978FB6483389915220949A8FAB"><enum>(c)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">Each manager of an intelligence function established under subsection (a) shall have the duties as
			 follows:</text><paragraph commented="no" display-inline="no-display-inline" id="id73047975A045460CAF1A3A9CC2612AE3"><enum>(1)</enum><text display-inline="yes-display-inline">To act as principal advisor to the Director on the intelligence function.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6692D17DFE4D4F0C80865F0E13708B7B"><enum>(2)</enum><text display-inline="yes-display-inline">To carry out such other responsibilities with respect to the intelligence function as the Director
			 may specify for purposes of this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id0FE40EB22AE449F7A1939E6BF51752C6"><enum>(b)</enum><header display-inline="yes-display-inline">Table of contents amendment</header><text display-inline="yes-display-inline">The table of contents in the first section of the National Security Act of 1947 is amended by

Functional managers for the intelligence community.</toc-entry></toc><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="id1F40FD74D246489C8EAF3A7ECE28E053" section-type="subsequent-section"><enum>306.</enum><header display-inline="yes-display-inline">Annual assessment of intelligence community performance by function</header><subsection commented="no" display-inline="no-display-inline" id="id700638CFF1B64668A6C18A3FECB49BEE"><enum>(a)</enum><header display-inline="yes-display-inline">Annual assessments required</header><text display-inline="yes-display-inline">Title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) is amended by inserting after
			 section 506I the following new section:</text><quoted-block display-inline="no-display-inline" id="id3CF3C2C89B594A2ABAE1772893A9201E" style="OLC"><section commented="no" display-inline="no-display-inline" id="id31C5EF8B275E4C6BB56A671AAFE792AD" section-type="subsequent-section"><enum>506J.</enum><header display-inline="yes-display-inline">Annual assessment of intelligence community performance by function</header><subsection commented="no" display-inline="no-display-inline" id="id75637048839b4924a47821fa3cbea96b"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than April 1, 2016, and each year thereafter, the Director of National Intelligence
			 shall, in consultation with the Functional Managers, submit to  the
			 congressional intelligence committees a report on covered intelligence
			 functions during the preceding year.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3400F68DC01345A1947334CFA0D41508"><enum>(b)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include for each covered intelligence function for the year
			 covered by such report the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id7dfcc835f72346ee9958b03a6af6b2fa"><enum>(1)</enum><text display-inline="yes-display-inline">An identification of the capabilities, programs, and activities of such intelligence function,
			 regardless of the element of the intelligence community that carried out
			 such capabilities, programs, and activities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6b542a5bd63d4785bc44cbb4a432f548"><enum>(2)</enum><text display-inline="yes-display-inline">A description of the investment and allocation of resources for such intelligence function,
			 including an analysis of the allocation of resources within the context of
			 the National Intelligence Strategy, priorities for recipients of
			 resources, and areas of risk.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93f51e3e663a4781a81e7e4b9e0063a9"><enum>(3)</enum><text display-inline="yes-display-inline">A description and assessment of the performance of such intelligence function.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id65fb94d9400e48d18bb69eae11906e1d"><enum>(4)</enum><text display-inline="yes-display-inline">An identification of any issues related to the application of technical interoperability standards
			 in the capabilities, programs, and activities of such intelligence
			 function.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideea66994685d4687bf50cd5ec3a876cd"><enum>(5)</enum><text display-inline="yes-display-inline">An identification of the operational overlap or need for de-confliction, if any, within such
			 intelligence function.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b3c16a558b046898186d41de88d3508"><enum>(6)</enum><text display-inline="yes-display-inline">A description of any efforts to integrate such intelligence function with other intelligence
			 disciplines as part of an integrated intelligence enterprise.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id445c6704f8284cd1abda03add3952d99"><enum>(7)</enum><text display-inline="yes-display-inline">A description of any efforts to establish consistency in tradecraft and training within such
			 intelligence function.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3377d7d22e414adbad320bd1e54c24e5"><enum>(8)</enum><text display-inline="yes-display-inline">A description and assessment  of developments in technology that bear on the future of such
			 intelligence function.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id16F2E99478F1403583B7655CC486B29B"><enum>(9)</enum><text display-inline="yes-display-inline">Such other matters relating to such intelligence function as the Director may specify for purposes
			 of this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8BCE80056CE943B4B56CF42CE9186311"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id1CC75E2EB0E5477E8E531046297C6520"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>covered intelligence functions</term> means each intelligence function for which a Functional Manager has been established under section
			 103J during the year covered by a report under this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id72CC1F8DB2564A6F97F4B9F5C1C3ABFA"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>Functional Manager</term> means the manager of an intelligence function established under section 103J.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id212BACD9E9134D96BA9867A7D93B56B6"><enum>(b)</enum><header display-inline="yes-display-inline">Table of contents amendment</header><text display-inline="yes-display-inline">The table of contents in the first section of the National Security Act of 1947 is amended by

			 section 108 the following new section:</text><quoted-block display-inline="no-display-inline" id="H91ABD5FD72AA4F1AADA5B95B222202B8" style="OLC"><section commented="no" display-inline="no-display-inline" id="HD8ABB50E25AA49D7954D57982A5767FE" section-type="subsequent-section"><enum>109.</enum><header display-inline="yes-display-inline">Software licensing</header><subsection commented="no" display-inline="no-display-inline" id="HF4FB8748A252427E9AB0454180E8CC1B"><enum>(a)</enum><header display-inline="yes-display-inline">Requirement for inventories of software licenses</header><text display-inline="yes-display-inline">The chief information officer of each element of the intelligence community, in consultation with
			 the Chief Information Officer of the Intelligence Community, shall
			 biennially—</text><paragraph commented="no" display-inline="no-display-inline" id="H4F8B087D5D8148C7A35CDBA939090A63"><enum>(1)</enum><text display-inline="yes-display-inline">conduct an inventory of all existing software licenses of such element, including utilized and
			 unutilized licenses;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2790D660A21D4892BD5A87E0AD6505BA"><enum>(2)</enum><text display-inline="yes-display-inline">assess the actions that could be carried out by such element to achieve the greatest possible
			 economies of scale and associated cost savings in software procurement and
			 usage; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9D42641E32934562AEC6B86F0AA22158"><enum>(3)</enum><text display-inline="yes-display-inline">submit to the Chief Information Officer of the Intelligence Community each inventory required by
			 paragraph (1) and each assessment required by paragraph (2).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD1D8F6D2799E41948735E209622CF7C8"><enum>(b)</enum><header display-inline="yes-display-inline">Inventories by the Chief Information Officer of the Intelligence Community</header><text display-inline="yes-display-inline">The Chief Information Officer of the Intelligence Community, based on the inventories and
			 assessments required by subsection (a), shall biennially—</text><paragraph commented="no" display-inline="no-display-inline" id="H351A5B576C734B0B803144C33163D18F"><enum>(1)</enum><text display-inline="yes-display-inline">compile an inventory of all existing software licenses of the intelligence community, including
			 utilized and unutilized licenses; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE8BAB9292A9E4AEBAE4D386573288E57"><enum>(2)</enum><text display-inline="yes-display-inline">assess the actions that could be carried out by the intelligence community to achieve the greatest
			 possible economies of scale and associated cost savings in software
			 procurement and usage.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H476109B1A20F434AB283F055D514A4DB"><enum>(c)</enum><header display-inline="yes-display-inline">Reports to Congress</header><text display-inline="yes-display-inline">The Chief Information Officer of the Intelligence Community shall submit to the congressional
			 intelligence committees a copy of each inventory compiled under subsection
			 (b)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H26629C65DAE54F92B7B964C10B50DB54"><enum>(b)</enum><header display-inline="yes-display-inline">Initial inventory</header><paragraph commented="no" display-inline="no-display-inline" id="H1E151BA323BC42CD8A11D003614053CA"><enum>(1)</enum><header display-inline="yes-display-inline">Intelligence community elements</header><subparagraph commented="no" display-inline="no-display-inline" id="HF33D88E2AFAB417C854FD1E6213BD168"><enum>(A)</enum><header display-inline="yes-display-inline">Date</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the chief information officer
			 of each element of the intelligence community shall complete the initial
			 inventory, assessment, and submission required under section 109(a) of the
			 National Security Act of 1947, as added by subsection (a) of this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5CA1C59E709A43C08D8311BFF6934142"><enum>(B)</enum><header display-inline="yes-display-inline">Basis</header><text display-inline="yes-display-inline">The initial inventory conducted for each element of the intelligence community under section
			 109(a)(1) of the National Security Act of 1947, as added by subsection (a)
			 of this section, shall be based on the inventory of software licenses
			 conducted pursuant to section 305 of the Intelligence Authorization Act

			 writing a plan to respond to the unauthorized public disclosure of that
			 type of activity.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id56664B0623814296B247A644F2BFF511" section-type="subsequent-section"><enum>309.</enum><header display-inline="yes-display-inline">Auditability</header><subsection commented="no" display-inline="no-display-inline" id="H381D1627BDC64C709EB30E20F0C1772D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) is amended by adding at the
			 end the following new section:</text><quoted-block display-inline="no-display-inline" id="HA506C914E7E24BE6A7D2B69C4C315ED3" style="OLC"><section commented="no" display-inline="no-display-inline" id="H1D91A823841C46908F9E3A70CCDE681F" section-type="subsequent-section"><enum>509.</enum><header display-inline="yes-display-inline">Auditability of certain elements of the intelligence community</header><subsection commented="no" display-inline="no-display-inline" id="H73FECE70D2004FFFB9EFC73CE013F7E9"><enum>(a)</enum><header display-inline="yes-display-inline">Requirement for annual audits</header><text display-inline="yes-display-inline">The head of each covered entity shall ensure that there is a full financial audit of such covered
			 entity each year beginning with fiscal year 2014. Such audits may be
			 conducted by an internal or external independent accounting or auditing
			 organization.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HC77118030E304D50B348E97AB3587C07"><enum>(b)</enum><header display-inline="yes-display-inline">Requirement for unqualified opinion</header><text display-inline="yes-display-inline">Beginning as early as practicable, but in no event later than the audit required under subsection
			 (a) for fiscal year 2016, the head of each covered entity shall take all
			 reasonable steps necessary to ensure that each audit required under
			 subsection (a) contains an unqualified opinion on the financial statements
			 of such covered entity for the fiscal year covered by such audit.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H32A47F181AB640BFAD243BE89A18BB0A"><enum>(c)</enum><header display-inline="yes-display-inline">Reports to Congress</header><text display-inline="yes-display-inline">The chief financial officer of each covered entity shall provide to the congressional intelligence
			 committees an annual audit report from an accounting or auditing
			 organization on each audit of the covered entity conducted pursuant to
			 subsection (a).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HDA8D8B51BDD74AB6A947ED5F3901C6FA"><enum>(d)</enum><header display-inline="yes-display-inline">Covered entity defined</header><text display-inline="yes-display-inline">In this section, the term <quote>covered entity</quote> means the Office of the Director of National Intelligence, the Central Intelligence Agency, the
			 Defense Intelligence Agency, the National Security Agency, the National
			 Reconnaissance Office, and the National Geospatial-Intelligence Agency.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H9B389B00EF574C1DA2A6506AF1B8FF0C"><enum>(b)</enum><header display-inline="yes-display-inline">Table of contents amendment</header><text display-inline="yes-display-inline">The table of contents in the first section of the National Security Act of 1947 is amended by

			 representation items, the Secretary of Homeland Security may use funds
			 made available to the Secretary through the National Intelligence Program
			 for necessary expenses for intelligence analysis and operations
			 coordination activities for official representation items in support of
			 the Coast Guard
			 Attaché Program.</text></section><section commented="no" display-inline="no-display-inline" id="idCF412AB520344D32B1512881389A560B" section-type="subsequent-section"><enum>313.</enum><header display-inline="yes-display-inline">Declassification review of certain items collected during the mission that killed Osama bin Laden
			 on May 1, 2011</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Director of National
			 Intelligence shall—</text><paragraph commented="no" display-inline="no-display-inline" id="H28B6908D7B8E4A48911E8C0F9C3EFA1B"><enum>(1)</enum><text display-inline="yes-display-inline">in the manner described in the classified annex to this Act—</text><subparagraph commented="no" display-inline="no-display-inline" id="H76606C25FEE84AD0A72A71330F89A8C1"><enum>(A)</enum><text display-inline="yes-display-inline">complete a declassification review of documents collected in Abbottabad, Pakistan, during the
			 mission that killed Osama bin Laden on May 1, 2011; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HABF7E95A2D8B45A0AE212CA324B1BAA8"><enum>(B)</enum><text display-inline="yes-display-inline">make publicly available any information declassified as a result of the declassification review
			 required under paragraph (1); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H32E8E56AE1CB4B6C9C9EF05AEE4B1037"><enum>(2)</enum><text display-inline="yes-display-inline">report to the congressional intelligence committees—</text><subparagraph commented="no" display-inline="no-display-inline" id="H737C66D8440C48059A0BD0AA8B1D6021"><enum>(A)</enum><text display-inline="yes-display-inline">the results of the declassification review required under paragraph (1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6F6808F70B8849F4BE4C4A3FE1C64DF3"><enum>(B)</enum><text display-inline="yes-display-inline">a justification for not declassifying any information required to be included in such
			 declassification review that remains classified.</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id89c27a22803a49369055f40300f95c82" section-type="subsequent-section"><enum>314.</enum><header display-inline="yes-display-inline">Merger of the Foreign Counterintelligence Program and the General Defense Intelligence Program</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Director of National Intelligence shall carry out
			 the merger of the Foreign Counterintelligence Program into the General
			 Defense Intelligence Program as directed in the classified annex to this
			 Act.  The merger shall go into effect no earlier than 30 days after
			 written notification of the merger is provided to the congressional
			 intelligence committees.</text></section></subtitle><subtitle commented="no" id="H92C54778408341FFA0FAF9C66533425D" level-type="subsequent" style="OLC"><enum>B</enum><header display-inline="yes-display-inline">Reporting</header><section commented="no" display-inline="no-display-inline" id="id6C4A2D846DB241D6B032B509FE10B3AA" section-type="subsequent-section"><enum>321.</enum><header display-inline="yes-display-inline">Significant interpretations of law concerning intelligence activities</header><subsection commented="no" display-inline="no-display-inline" id="idaeceadcc32a94d59a6448a4d89879bf3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3021">50 U.S.C. 3021 et seq.</external-xref>), as added by section 309 of
			 this Act, is further amended by adding at the end the following new
			 section:</text><quoted-block display-inline="no-display-inline" id="id7a712f14e6d544a4ab8cdcf807654212" style="OLC"><section commented="no" display-inline="no-display-inline" id="id532e5f9bddf64af4839d105d0ea29e8c" section-type="subsequent-section"><enum>510.</enum><header display-inline="yes-display-inline">Significant interpretations of law concerning intelligence activities</header><subsection commented="no" display-inline="no-display-inline" id="idcd276603ca56464288b4b40c5c293e72"><enum>(a)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">Except as provided in subsection (c) and to the extent consistent with due regard for the
			 protection from unauthorized disclosure of classified information relating
			 to sensitive intelligence sources and methods or other exceptionally
			 sensitive matters, the General Counsel of each element of the intelligence
			 community shall notify the congressional intelligence committees, in
			 writing, of any significant legal interpretation of the United States
			 Constitution or Federal law affecting intelligence activities conducted by
			 such element by not later than 30 days after the date of the commencement
			 of  any intelligence activity pursuant to such interpretation.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0f1827ba4ae1475591ed0a287ecf2560"><enum>(b)</enum><header display-inline="yes-display-inline">Content</header><text display-inline="yes-display-inline">Each notification under subsection (a) shall provide a summary of the significant legal
			 interpretation and the intelligence activity or activities conducted
			 pursuant to such interpretation.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id19d51d94079744c284b6586c73cd8b1e"><enum>(c)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">A notification under subsection (a) shall not be required for a significant legal interpretation
			 if—</text><paragraph commented="no" display-inline="no-display-inline" id="id04144b88c7fb49c49ede542f66ab0780"><enum>(1)</enum><text display-inline="yes-display-inline">notice of the significant legal interpretation was previously provided to the congressional
			 intelligence committees under subsection (a); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8f090026806a4321863cdc4aca47c5a8"><enum>(2)</enum><text display-inline="yes-display-inline">the significant legal interpretation was made before the date of the enactment of the <short-title>Intelligence Authorization Act for Fiscal Year 2014</short-title>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8fc85222bd55468a8f62ccde3b7fee38"><enum>(d)</enum><header display-inline="yes-display-inline">Limited access for covert action</header><text display-inline="yes-display-inline">If the President determines that it is essential to limit access to a covert action finding under
			 section 503(c)(2), the President may limit access to information
			 concerning such finding that is subject to notification under this section
			 to those members of Congress who have been granted access to the
			 relevant finding under section 503(c)(2).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id5E1697B2159A4294A54B7AEBD9272791"><enum>(b)</enum><header display-inline="yes-display-inline">Table of contents amendment</header><text display-inline="yes-display-inline">The table of contents in the first section of the National Security Act of 1947 is amended by

			 Justice concerning intelligence activities</header><subsection commented="no" display-inline="no-display-inline" id="ide43d3b02ec5740dcae805af6bf4c3755"><enum>(a)</enum><header display-inline="yes-display-inline">Process for review for official publication</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Attorney General shall, in
			 coordination with the Director of National Intelligence, establish a
			 process for the regular review  for official publication of significant
			 opinions of the Office of Legal Counsel of the Department of Justice that
			 have been provided to an element of the intelligence community.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="iddaef9852c1e04c07bdd0d6696d96e32f"><enum>(b)</enum><header display-inline="yes-display-inline">Factors</header><text display-inline="yes-display-inline">The process of review of opinions established under subsection (a) shall include consideration of
			 the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id634db4c3c4a046728d020b0d260cf5f2"><enum>(1)</enum><text display-inline="yes-display-inline">The potential importance of an	opinion to other agencies or officials in the Executive branch.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8814091c2df448b5a590b2c8c64d32fd"><enum>(2)</enum><text display-inline="yes-display-inline">The likelihood that similar questions addressed in an opinion may arise in the future.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d409c4931a74477afd05b7e98833a2e"><enum>(3)</enum><text display-inline="yes-display-inline">The historical importance of an opinion or the context in which it arose.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77e7d11ded5b49bda58f1096e4575a58"><enum>(4)</enum><text display-inline="yes-display-inline">The potential significance of an opinion to the overall jurisprudence of the Office of Legal
			 Counsel.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC29D05EF00B4470599BD3EDFEFA7BDAE"><enum>(5)</enum><text display-inline="yes-display-inline">Such other factors as the Attorney General and the Director of National Intelligence consider
			 appropriate.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5a94b871614c43f98eaa9fbd2ee01433"><enum>(c)</enum><header display-inline="yes-display-inline">Presumption</header><text display-inline="yes-display-inline">The process of review established under subsection (a) shall apply a presumption that significant
			 opinions of the Office of Legal Counsel should be published when
			 practicable,  consistent with national security and other confidentiality
			 considerations.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idaa795c7227ed435ab7928e383d9d92ca"><enum>(d)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this section shall require the official publication of any opinion of the Office of
			 Legal Counsel, including publication under any circumstance as follows:</text><paragraph commented="no" display-inline="no-display-inline" id="idcd8b50410ffe4a9383cec975833490ac"><enum>(1)</enum><text display-inline="yes-display-inline">When publication would reveal classified or other sensitive information relating to national
			 security.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6720126607eb4d91abe7a78a3119b2c2"><enum>(2)</enum><text display-inline="yes-display-inline">When publication could reasonably be anticipated to interfere with Federal law enforcement efforts
			 or is prohibited by law.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ee15314ae564bb7a33ebc19415f9534"><enum>(3)</enum><text display-inline="yes-display-inline">When publication would conflict with preserving internal Executive branch deliberative processes or
			 protecting other information properly subject to privilege.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide23bb58093b6427b8b5ea6546afb1aa6"><enum>(e)</enum><header display-inline="yes-display-inline">Requirement To provide classified opinions to Congress</header><paragraph commented="no" display-inline="no-display-inline" id="idc7061f6577c94a6f876eb3fff331fdec"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any opinion of the Office of Legal Counsel that would have been selected for publication under the
			 process of review established under subsection (a) but for the fact that
			 publication would reveal classified or other sensitive information
			 relating to national security shall be provided or made available to the
			 appropriate committees of Congress.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6d570de9e0914086975a355105eff8d0"><enum>(2)</enum><header display-inline="yes-display-inline">Exception for covert action</header><text display-inline="yes-display-inline">If the President determines that it is essential to limit access to a covert action finding under
			 section 503(c)(2) of the National Security Act of 1947 (50 U.S.C.
			 3093(c)(2)), the President may limit access to information concerning such
			 finding that would otherwise be provided or made available under this
			 subsection to those members of Congress who have been granted access to
			 such finding under such section 503(c)(2).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcfbf8eac354948cd9dfe29b336f434ef"><enum>(f)</enum><header display-inline="yes-display-inline">Judicial review</header><text display-inline="yes-display-inline">The determination whether an opinion of the Office of Legal Counsel is appropriate for official
			 publication under the process of review established under subsection (a)
			 is discretionary and is not subject to judicial review.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id25FF64C42B3743D69A25DBA87D827AFB" section-type="subsequent-section"><enum>323.</enum><header display-inline="yes-display-inline">Submittal to Congress by heads of elements of intelligence community of plans for orderly shutdown
			 in event of absence of appropriations</header><subsection commented="no" display-inline="no-display-inline" id="H980F78EAE4074CF5BD53797C679A1F28"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Whenever the head of an applicable agency submits a plan to the Director of the Office of
			 Management and Budget in accordance with section 124 of Office of
			 Management and Budget Circular A–11, pertaining to agency operations in
			 the absence of appropriations, or any successor circular of the Office
			 that requires the head of an applicable agency to submit to the Director a
			 plan for an orderly shutdown in the event of the absence of
			 appropriations, such head shall submit a copy of such plan to the

			 Defense, to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id88165A910D0B4C9BB708CB8CC7C44A29"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Armed Services of the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id134B5736CBDC4266BF9D492E83B683F2"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0CF2B73B25EF4569AFC62B22DD9F15A6"><enum>(b)</enum><header display-inline="yes-display-inline">Head of an applicable agency defined</header><text display-inline="yes-display-inline">In this section, the term <term>head of an applicable agency</term> includes the following:</text><paragraph commented="no" display-inline="no-display-inline" id="H5E9697FB24B34B76A398F958F69A2CE7"><enum>(1)</enum><text display-inline="yes-display-inline">The Director of National Intelligence.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H693850C8288B47568C59DBEA04362E94"><enum>(2)</enum><text display-inline="yes-display-inline">The Director of the Central Intelligence Agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H05D8032E02B844F28412292BEC68A768"><enum>(3)</enum><text display-inline="yes-display-inline">Each head of each element of the intelligence community that is within the Department of Defense.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idFB2A3ED6E98C45C3BD4E1F596518AD91" section-type="subsequent-section"><enum>324.</enum><header display-inline="yes-display-inline">Reports on chemical weapons in Syria</header><subsection commented="no" display-inline="no-display-inline" id="H34E081CEC7264F45B91C0FD03FE7192D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Director of National
			 Intelligence shall submit to Congress a
			 report on the Syrian chemical weapons program.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H66A7D4672EF5481A9EE06CC597B31AEC"><enum>(b)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The report required under subsection (a) shall include the following elements:</text><paragraph commented="no" display-inline="no-display-inline" id="H6B05FC8BC53E476BB7328443140C4193"><enum>(1)</enum><text display-inline="yes-display-inline">A comprehensive assessment of chemical weapon stockpiles in Syria, including names, types, and
			 quantities of chemical weapons agents, types of munitions, and location
			 and form of storage, production, and research and development facilities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9025DF62E1C0418B96BB518EDA6E9645"><enum>(2)</enum><text display-inline="yes-display-inline">A listing of key personnel associated with the Syrian chemical weapons program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAD411B47C2ED46838717DCBF4FD46605"><enum>(3)</enum><text display-inline="yes-display-inline">An assessment of undeclared chemical weapons stockpiles, munitions, and facilities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB44CF53DB86D40C1B1020A849B10DA8C"><enum>(4)</enum><text display-inline="yes-display-inline">An assessment of how these stockpiles, precursors, and delivery systems were obtained.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFF77A0D20BF1427D960769C467271AFB"><enum>(5)</enum><text display-inline="yes-display-inline">A description of key intelligence gaps related to the Syrian chemical weapons program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9D4234F40F104EF7AB602046CF46A21E"><enum>(6)</enum><text display-inline="yes-display-inline">An assessment of any denial and deception efforts on the part of the Syrian regime related to its
			 chemical weapons program.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF659CF43583E4B779FFF93F8A6254C0F"><enum>(c)</enum><header display-inline="yes-display-inline">Progress reports</header><text display-inline="yes-display-inline">Every 90 days until the date that is 18 months after the date of the enactment of this Act, the
			 Director of National Intelligence shall submit to Congress a progress
			 report providing any material updates to the report required under
			 subsection (a).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id123C6028D7F14D15A96CED20E40083C2" section-type="subsequent-section"><enum>325.</enum><header display-inline="yes-display-inline">Reports to the intelligence community on penetrations of networks and information systems of
			 certain contractors</header><subsection commented="no" display-inline="no-display-inline" id="H707A151B5B7D4DA28CFD14EF237C1670"><enum>(a)</enum><header display-inline="yes-display-inline">Procedures for reporting penetrations</header><text display-inline="yes-display-inline">The Director of National Intelligence shall establish procedures that require each cleared
			 intelligence contractor to report to an element of the intelligence
			 community designated by the Director for purposes of such procedures when
			 a network or information system of such contractor that meets the criteria
			 established pursuant to subsection (b) is successfully penetrated.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HD69286FEC41B4DBC95DA3229BC3B5E9D"><enum>(b)</enum><header display-inline="yes-display-inline">Networks and information systems subject to reporting</header><text display-inline="yes-display-inline">The Director of National Intelligence shall, in consultation with appropriate officials, establish
			 criteria for covered networks to be subject to the procedures for
			 reporting system penetrations under subsection (a).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HCB6656D2AE8E4C928251EDB3D8C5F8DE"><enum>(c)</enum><header display-inline="yes-display-inline">Procedure requirements</header><paragraph commented="no" display-inline="no-display-inline" id="H0C93FB9055F4498EA1A8E78BE0DD6669"><enum>(1)</enum><header display-inline="yes-display-inline">Rapid reporting</header><text display-inline="yes-display-inline">The procedures established pursuant to subsection (a) shall require each cleared intelligence
			 contractor to rapidly report to an element of the intelligence community
			 designated pursuant to subsection (a) of each successful penetration of
			 the network or information systems of such contractor that meet the
			 criteria established pursuant to subsection (b). Each such report shall
			 include the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="HD6F89F2F71F24586A41D5D5DE4ED20D5"><enum>(A)</enum><text display-inline="yes-display-inline">A description of the technique or method used in such penetration.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAB0A4A40BAE04531B1E8D144DE12BEA0"><enum>(B)</enum><text display-inline="yes-display-inline">A sample of the malicious software, if discovered and isolated by the contractor, involved in such
			 penetration.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCD24076EFD384370BF6E8885DC1C321A"><enum>(C)</enum><text display-inline="yes-display-inline">A summary of information created by or for such element in connection with any program of such
			 element that has been potentially compromised due to such penetration.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC1F699F520E34C438D13CA0FB38172EB"><enum>(2)</enum><header display-inline="yes-display-inline">Access to equipment and information by intelligence community personnel</header><text display-inline="yes-display-inline">The procedures established pursuant to subsection (a) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="H44D1173A3F6A4C1AA518C0DAD9EF3F52"><enum>(A)</enum><text display-inline="yes-display-inline">include mechanisms for intelligence community personnel to, upon request, obtain access to
			 equipment or information of a cleared intelligence contractor necessary to
			 conduct forensic analysis in addition to any analysis conducted by such
			 contractor;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEA4B01A5E9C64DE08D9E7E7E6C1F9E54"><enum>(B)</enum><text display-inline="yes-display-inline">provide that a cleared intelligence contractor is only required to provide access to equipment or
			 information as described in subparagraph (A) to determine whether
			 information created by or for an element of the intelligence community in
			 connection with any intelligence community program was successfully
			 exfiltrated from a network or information system of such contractor and,
			 if so, what information was exfiltrated; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCC6102EFB2354F789A781D5F04136ADA"><enum>(C)</enum><text display-inline="yes-display-inline">provide for the reasonable protection of trade secrets, commercial or financial information, and
			 information that can be used to identify a specific person (other than the
			 name of the suspected perpetrator of the penetration).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDF3B432545804252A0C51AB8967370B6"><enum>(3)</enum><header display-inline="yes-display-inline">Limitation on dissemination of certain information</header><text display-inline="yes-display-inline">The procedures established pursuant to subsection (a) shall prohibit the dissemination outside the
			 intelligence community of information obtained or derived through such
			 procedures that is not created by or for the intelligence community
			 except—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3A986084577F44E8B7DC9E24EDA4D647"><enum>(A)</enum><text display-inline="yes-display-inline">with the approval of the contractor providing such information;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF979D1A4902A45CD8D96D884746D1DF3"><enum>(B)</enum><text display-inline="yes-display-inline">to the congressional intelligence committees or the Subcommittees on Defense of the Committees on
			 Appropriations of the House of Representatives and the Senate for such
			 committees and such Subcommittees to perform oversight; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD38E3787F905494C9E5024E577E09B2D"><enum>(C)</enum><text display-inline="yes-display-inline">to law enforcement agencies to investigate a penetration reported under this section.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6406FAFE52E2493B8FC48B3D5D03E31F"><enum>(d)</enum><header display-inline="yes-display-inline">Issuance of procedures and establishment of criteria</header><paragraph commented="no" display-inline="no-display-inline" id="H6B572E703070469DB156A309B9828A67"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Director of National
			 Intelligence shall establish the procedures required under subsection (a)
			 and the  criteria required under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H87DEC10EC23B40149300F168FE732F50"><enum>(2)</enum><header display-inline="yes-display-inline">Applicability date</header><text display-inline="yes-display-inline">The requirements of this section shall apply on the date on which the Director of National
			 Intelligence establishes the procedures required under this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE941FA0DC88D41239F44CBCFB1CB53DA"><enum>(e)</enum><header display-inline="yes-display-inline">Coordination with the Secretary of Defense To prevent duplicate reporting</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National
			 Intelligence and the Secretary of Defense shall establish procedures to
			 permit a contractor that is a cleared intelligence contractor and a
			 cleared defense contractor under section 941 of the National Defense
			 Authorization Act for Fiscal Year 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/112/239">Public Law 112–239</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2224">10 U.S.C. 2224</external-xref> note) to submit a single report that satisfies the requirements of this section and such section
			 941 for an incident of penetration of network or information system.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H00216298825541C5831A977C5123145D"><enum>(f)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H0950F4483BE2494C9279CF10A53DD675"><enum>(1)</enum><header display-inline="yes-display-inline">Cleared intelligence contractor</header><text display-inline="yes-display-inline">The term <term>cleared intelligence contractor</term> means a private entity granted clearance by the Director of National Intelligence or the head of
			 an element of the intelligence community to access, receive, or store
			 classified information for the purpose of bidding for a contract or
			 conducting activities in support of any program of an element of the
			 intelligence community.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H486D47D0B64C427BA04CB32892DE8569"><enum>(2)</enum><header display-inline="yes-display-inline">Covered network</header><text display-inline="yes-display-inline">The term <quote>covered network</quote> means a network or information system of a cleared intelligence contractor that contains or
			 processes information created by or for an element of the intelligence
			 community with respect to which such contractor is required to apply
			 enhanced protection.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HD09B167D50634B3B930EB7FCC75741AF"><enum>(g)</enum><header display-inline="yes-display-inline">Savings clauses</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to alter or limit any otherwise authorized access by
			 government personnel to networks or information systems owned or operated
			 by a contractor that processes or stores government data.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id81CE84AF513E4AD9ABAE245D380BEC46" section-type="subsequent-section"><enum>326.</enum><header display-inline="yes-display-inline">Report on electronic waste</header><subsection commented="no" display-inline="no-display-inline" id="H938DF36094B24F28B80B736709DB8A6E"><enum>(a)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Director of National
			 Intelligence shall submit to the congressional intelligence committees a
			 report on the extent to which the intelligence community has implemented
			 the recommendations of the Inspector General of the Intelligence Community
			 contained in the report entitled <quote>Study of Intelligence Community Electronic Waste Disposal Practices</quote> issued in May 2013. Such report shall include an assessment of the extent to which the policies,
			 standards, and guidelines of the intelligence community governing the
			 proper disposal of electronic waste are applicable to covered commercial
			 electronic waste that may contain classified information.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H4871733EC7F245F9B9FC11C2602B7275"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H8D536EAF9EEA45579A1621DFB84623BE"><enum>(1)</enum><header display-inline="yes-display-inline">Covered commercial electronic waste</header><text display-inline="yes-display-inline">The term <quote>covered commercial electronic waste</quote> means electronic waste of a commercial entity that contracts with an element of the intelligence
			 community.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9824AB0F35C94C83A5E12589F35501EE"><enum>(2)</enum><header display-inline="yes-display-inline">Electronic waste</header><text display-inline="yes-display-inline">The term <quote>electronic waste</quote> includes any obsolete, broken, or irreparable electronic device, including a television, copier,
			 facsimile machine, tablet, telephone, computer, computer monitor, laptop,
			 printer, scanner, and associated electrical wiring.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idfa3ef63963a44425b4ebe8c276f13379" section-type="subsequent-section"><enum>327.</enum><header display-inline="yes-display-inline">Promoting STEM education to meet the future workforce needs of the intelligence community</header><subsection commented="no" display-inline="no-display-inline" id="ida436633afdf8482a8461e1f5d18b93b6"><enum>(a)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National
			 Intelligence shall submit to the Secretary of Education and the
			 congressional intelligence committees a report describing the anticipated
			 hiring needs of the intelligence community in the fields of science,
			 technology, engineering, and mathematics, including cybersecurity and
			 computer literacy.   The report shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idAE19D4AC1D7F4F1DBAFD32FE1DE0933B"><enum>(1)</enum><text display-inline="yes-display-inline">describe the extent to which
			 competitions, challenges, or internships at elements of the intelligence
			 community that do not involve access to classified information may be
			 utilized to promote education in the fields of science, technology,
			 engineering, and mathematics, including cybersecurity and computer
			 literacy, within high schools or institutions of higher education in the
			 United States;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCC638BCC5E464FC996C53363CCB2C149"><enum>(2)</enum><text display-inline="yes-display-inline">include cost estimates for carrying out
			 such competitions, challenges, or internships; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id722A1D738F7C43138392562AA50854A6"><enum>(3)</enum><text display-inline="yes-display-inline">include strategies for conducting expedited security clearance investigations and adjudications for
			 students at institutions of higher education for purposes of offering
			 internships at elements of the intelligence community.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9ad4da239f184ff19d4f4aba887d4a48"><enum>(b)</enum><header display-inline="yes-display-inline">Consideration of existing programs</header><text display-inline="yes-display-inline">In developing the report under subsection (a), the Director shall take into consideration existing
			 programs of the intelligence community, including the education programs
			 of the National Security Agency and the Information Assurance Scholarship
			 Program of the Department of Defense, as appropriate.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id718dee800f9e4fe1adf0c8c7e0c0198d"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id62b62ea30f5b44c19fb4446060628437"><enum>(1)</enum><header display-inline="yes-display-inline">High school</header><text display-inline="yes-display-inline">The term <term>high school</term> mean a school that awards a secondary school diploma.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id713f7c9da504494a98c15ad1fd18ce05"><enum>(2)</enum><header display-inline="yes-display-inline">Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (20 U.S.C.
			 1001(a)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf7c5c12077f241b685466055e16fe2a7"><enum>(3)</enum><header display-inline="yes-display-inline">Secondary school</header><text display-inline="yes-display-inline">The term <term>secondary school</term> has the meaning given the term in section 9101 of the Elementary and Secondary Education Act of
			 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idDAA4C80F03E144EE828A11A45FF55CC8" section-type="subsequent-section"><enum>328.</enum><header display-inline="yes-display-inline">Repeal of the termination of notification requirements regarding the authorized disclosure of
			 national intelligence</header><text display-inline="no-display-inline">Section 504 of the Intelligence Authorization Act for Fiscal Year 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/112/277">Public Law 112–277</external-xref>; 126

			 105th Congress, agreed to May 14, 1997, is repealed.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA576EEEB90A147CDA520432235764B3D"><enum>(b)</enum><header display-inline="yes-display-inline">Modification of reporting requirements</header><paragraph commented="no" display-inline="no-display-inline" id="HB21CD474C0DE4857818CE5E6AA65E45C"><enum>(1)</enum><header display-inline="yes-display-inline">Intelligence advisory committees</header><text display-inline="yes-display-inline">Section 410(b) of the Intelligence Authorization Act for Fiscal Year 2010 (<external-xref legal-doc="usc" parsable-cite="usc/50/3309">50 U.S.C. 3309</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H49B43A7CA22A448E83E5904ABB28D085" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="HACE87562A91C498A92A098907F9C82F8"><enum>(b)</enum><header display-inline="yes-display-inline">Notification of establishment of advisory committee</header><text display-inline="yes-display-inline">The Director of National Intelligence and the Director of the Central Intelligence Agency shall
			 each notify the congressional intelligence committees each time each such
			 Director creates an advisory committee. Each notification shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="HE0E86F3201BE4C51AA023B2F7B9186C8"><enum>(1)</enum><text display-inline="yes-display-inline">a description of such advisory committee, including the subject matter of such committee;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H81A25399DE0B4DD68312E0EBE512EB14"><enum>(2)</enum><text display-inline="yes-display-inline">a list of members of such advisory committee; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A84EE1DC9DE40E1822DC6FE8CBE19B1"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of an advisory committee created by the Director of National Intelligence, the reasons

			 performing such duties on October 1, 2014; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23A6B21FE5BB4E889BE3B31AA6E2A53D"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of section 402—</text><subparagraph commented="no" display-inline="no-display-inline" id="idC19C59BA29BC4978883AEFB1781DD085"><enum>(A)</enum><text display-inline="yes-display-inline">the date of the
			 first nomination by the President of an individual to serve as the
			 Inspector General of the National Security Agency that occurs on or after

			 of the National Security Agency or the 
			 Inspector General
			 of the National Security Agency on the date that the President first
			 nominates an individual for such position on or after October 1, 2014, may
			 continue to perform in that position after such date of nomination and
			 until the individual appointed to the position, by and with the advice and
			 consent of the Senate, assumes the
			 duties

			 performing such duties on October 1, 2014; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20ACFAE7959D4B8D92D3483C5CD687EC"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of section 412—</text><subparagraph commented="no" display-inline="no-display-inline" id="id69A3CAA970B842DFB06B357D1B70162F"><enum>(A)</enum><text display-inline="yes-display-inline">the date of the
			 first nomination by the President of an individual to serve as the
			 Inspector General of the National Reconnaissance Office that occurs on or
			 after October 1, 2014; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id742CC9B3CF7D458890C0620DC1570AC2"><enum>(B)</enum><text display-inline="yes-display-inline">the date of the
			 cessation of the performance of the duties of the Inspector General of
				the National Reconnaissance Office by the
			 individual
			 performing such duties on October 1, 2014.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEE13BEF3439146D9BD755610D45D4B42"><enum>(b)</enum><header display-inline="yes-display-inline">Exception for initial nominations</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1)(A) or (2)(A) of subsection (a), an individual serving as the Director
			 of
				the National Reconnaissance Office or the 
			 Inspector General
			 of the National Reconnaissance Office on the date that the President first
			 nominates an individual for such position on or after October 1, 2014, may
			 continue to perform in that position after such date of nomination and
			 until the individual appointed to the position, by and with the advice and
			 consent of the Senate, assumes the
			 duties
			 of the position.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idE6ACEAEE229A4948917B7E5B050328B8"><enum>(c)</enum><header display-inline="yes-display-inline">Incumbent Inspector General</header><text display-inline="yes-display-inline">The individual serving as Inspector General of the National Reconnaissance Office on the date of
			 the
			 enactment of this Act shall be eligible to be appointed by the President
			 to a new term of service under section 3 of the Inspector General Act of
			 1978 (5 U.S.C. 			 presentation of an event designed to raise funds and does not include the
			 direct solicitation of money by any other means.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></subtitle></title><title commented="no" id="H805C2FAE050F48259038B76EF2F36618" level-type="subsequent"><enum>V</enum><header display-inline="yes-display-inline">Security clearance reform</header><section commented="no" display-inline="no-display-inline" id="idB0DF8B5B36EC4174ABA235677918E018" section-type="subsequent-section"><enum>501.</enum><header display-inline="yes-display-inline">Continuous evaluation and sharing of derogatory information regarding personnel with access to
			 classified information</header><text display-inline="no-display-inline">Section 102A(j) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3024">50 U.S.C. 3024(j)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H4B01573B576E4780832C0BA121D3D3BC"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="subsection" style="OLC">Sensitive Compartmented Information</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Classified Information</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF6D89572167B4F9AA106114989A8E2FD"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB608A8F2F2E749499E15A2779EFE5CEA"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking the period and inserting a semicolon; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC0EFF86BEFCE4A86AE5ED44B9A65F9D3"><enum>(4)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraphs:</text><quoted-block display-inline="no-display-inline" id="H52D54FE8AAC74AF99F930F08464C5749" style="traditional"><paragraph commented="no" display-inline="no-display-inline" id="H2FE64F0836354502AD2430E188DCBAF6"><enum>(5)</enum><text display-inline="yes-display-inline">ensure that the background of each employee or officer of an element of the intelligence community,
			 each contractor to an element of the intelligence community, and each
			 individual employee of such a contractor who has been determined to be
			 eligible for access to classified information is monitored on a continual
			 basis under standards developed by the Director, including with respect to
			 the frequency of evaluation, during the period of eligibility of such
			 employee or officer of an element of the intelligence community, such
			 contractor, or such individual employee to such a contractor to determine
			 whether such employee or officer of an element of the intelligence
			 community, such contractor, and such individual employee of such a
			 contractor continues to meet the requirements for eligibility for access
			 to classified information; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFAE7741EAB3F4A63BA37D86E21268949"><enum>(6)</enum><text display-inline="yes-display-inline">develop procedures to require information sharing between elements of the intelligence community
			 concerning potentially derogatory security information regarding an
			 employee or officer of an element of the intelligence community, a
			 contractor to an element of the intelligence community, or an individual
			 employee of such a contractor that may impact the eligibility of such
			 employee or officer of an element of the intelligence community, such
			 contractor, or such individual employee of such a contractor for a
			 security clearance.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="idB94C625ADB4142229C8B30F0D0292B9B" section-type="subsequent-section"><enum>502.</enum><header display-inline="yes-display-inline">Requirements for intelligence community contractors</header><subsection commented="no" display-inline="no-display-inline" id="H8AEC4694992D42B2BFE6516D76DF7E37"><enum>(a)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Section 102A of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3024">50 U.S.C. 3024</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H8BAEE98D49E449EDB8DF778F72CE53E5" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="HBF54F414B2EE4F0A8927D663133145EB"><enum>(x)</enum><header display-inline="yes-display-inline">Requirements for intelligence community contractors</header><text display-inline="yes-display-inline">The Director of National Intelligence, in consultation with the head of each department of the
			 Federal Government that contains an element of the intelligence community
			 and the Director of the Central Intelligence Agency, shall—</text><paragraph commented="no" display-inline="no-display-inline" id="H739BB81655D74FA9AECFDCD11879DD06"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCC02091188774621B2A9DEBEC16D3F11"><enum>(A)</enum><text display-inline="yes-display-inline">any contractor to an element of the intelligence community with access to a classified network or
			 classified information develops and operates a security plan that is
			 consistent with standards established by the Director of National
			 Intelligence for intelligence community networks; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAC2B2550621449D291C265FA9364E73B"><enum>(B)</enum><text display-inline="yes-display-inline">each contract awarded by an element of the intelligence community includes provisions requiring the
			 contractor comply with such plan and such standards;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H56F5957188964EA19C2E6AC3F5A0CCB8"><enum>(2)</enum><text display-inline="yes-display-inline">conduct periodic assessments of each security plan required under paragraph (1)(A) to ensure such
			 security plan complies with the requirements of such paragraph; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0FD9D4ED6BE749C1B56F262D07864A99"><enum>(3)</enum><text display-inline="yes-display-inline">ensure that the insider threat detection capabilities and insider threat policies of the
			 intelligence community apply to facilities of contractors with access to a
			 classified network.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H6B0EA3BB989340228B2A2C216070AA9F"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to contracts entered into or renewed
			 after the date of the enactment of this Act.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id3D877D8470F245A98ECE427B8065CE3F" section-type="subsequent-section"><enum>503.</enum><header display-inline="yes-display-inline">Technology improvements to security clearance processing</header><subsection commented="no" display-inline="no-display-inline" id="HE97E650FF1384DE5AC869EFAA30AF111"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director of National Intelligence, in consultation with the Secretary of Defense and the
			 Director of the Office of Personnel Management, shall conduct an analysis
			 of the relative costs and benefits of potential improvements to the
			 process for investigating persons who are proposed for access to
			 classified information and adjudicating whether such persons satisfy the
			 criteria for obtaining and retaining access to such information.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HB32EBDDDFA924AD79D2351FC43F9E86A"><enum>(b)</enum><header display-inline="yes-display-inline">Contents of analysis</header><text display-inline="yes-display-inline">In conducting the analysis required by subsection (a), the Director of National Intelligence shall
			 evaluate the costs and benefits associated with—</text><paragraph commented="no" display-inline="no-display-inline" id="H30A8F52115114C7DA1E5FA027676D7C1"><enum>(1)</enum><text display-inline="yes-display-inline">the elimination of manual processes in security clearance investigations and adjudications, if
			 possible, and automating and integrating the elements of the investigation
			 process, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC3FB1D35F3F04CF18361AD1AF65E5C77"><enum>(A)</enum><text display-inline="yes-display-inline">the clearance application process;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HED1598E1E0374A969B93543E15632476"><enum>(B)</enum><text display-inline="yes-display-inline">case management;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5556A7FFF7C646AAA401A674CCB07644"><enum>(C)</enum><text display-inline="yes-display-inline">adjudication management;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H644CB795E03643FB98D8B3A68D6129DD"><enum>(D)</enum><text display-inline="yes-display-inline">investigation methods for the collection, analysis, storage, retrieval, and transfer of data and
			 records; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE61E2EF81E304E8D92C4E95F78E933CC"><enum>(E)</enum><text display-inline="yes-display-inline">records management for access and eligibility determinations;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD3CE55EB307A407E8F31D73103527BBE"><enum>(2)</enum><text display-inline="yes-display-inline">the elimination or reduction, if possible, of the use of databases and information sources that
			 cannot be accessed and processed automatically electronically, or
			 modification of such databases and information sources, to enable
			 electronic access and processing;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E346CECC2694E54BA0D3924544153E6"><enum>(3)</enum><text display-inline="yes-display-inline">the use of government-developed and commercial technology for continuous monitoring and evaluation
			 of government and commercial data sources that can identify and flag
			 information pertinent to adjudication guidelines and eligibility
			 determinations;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB49C4E8FD1FB450EB972BF3D28590A9F"><enum>(4)</enum><text display-inline="yes-display-inline">the standardization of forms used for routine reporting required of cleared personnel (such as
			 travel, foreign contacts, and financial disclosures) and use of continuous
			 monitoring technology to access databases containing such reportable
			 information to independently obtain and analyze reportable data and
			 events;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA424941EADCA4AE59122C3ADD5B353A2"><enum>(5)</enum><text display-inline="yes-display-inline">the establishment of an authoritative central repository of personnel security information that is
			 accessible electronically at multiple levels of classification and
			 eliminates technical barriers to rapid access to information necessary for
			 eligibility determinations and reciprocal recognition thereof;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1A6A46840A154081A6C06067546DCA0A"><enum>(6)</enum><text display-inline="yes-display-inline">using digitally processed fingerprints, as a substitute for ink or paper prints, to reduce error
			 rates and improve portability of data;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H534CFBD64A014F0BA8C9752BE44D7846"><enum>(7)</enum><text display-inline="yes-display-inline">expanding the use of technology to improve an applicant’s ability to discover the status of a
			 pending security clearance application or reinvestigation; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7FB76F966FC049AFB4F284014A3A3628"><enum>(8)</enum><text display-inline="yes-display-inline">using government and publicly available commercial data sources, including social media, that
			 provide independent information pertinent to adjudication guidelines to
			 improve quality and timeliness, and reduce costs, of investigations and
			 reinvestigations.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H57C31B4987F44FC6833B976B964487A9"><enum>(c)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than 6 months after the date of the enactment of this Act, the Director of National
			 Intelligence shall submit to the appropriate committees of Congress a
			 report on the analysis required by subsection (a).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idEC17464D0B1040AB805F6A089CA29AE9" section-type="subsequent-section"><enum>504.</enum><header display-inline="yes-display-inline">Report on reciprocity of security clearances</header><text display-inline="no-display-inline">The head of the entity selected pursuant to section 3001(b) of the Intelligence Reform and
			 Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341(b)</external-xref>) shall submit to the appropriate committees of Congress a report each year through 2017 that
			 describes for the preceding year—</text><paragraph commented="no" display-inline="no-display-inline" id="HF7718B0E914D48F2AEB4724233850D8E"><enum>(1)</enum><text display-inline="yes-display-inline">the periods of time required by authorized adjudicative agencies for accepting background
			 investigations and determinations completed by an authorized investigative
			 entity or authorized adjudicative agency;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDB044C11E2A847B290ADA6A40749E825"><enum>(2)</enum><text display-inline="yes-display-inline">the total number of cases in which a background investigation or determination completed by an
			 authorized investigative entity or authorized adjudicative agency is
			 accepted by another agency;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H568DA1F8F55347B69842C2D5D9F9D54E"><enum>(3)</enum><text display-inline="yes-display-inline">the total number of cases in which a background investigation or determination completed by an
			 authorized investigative entity or authorized adjudicative agency is not
			 accepted by another agency; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H043CD7F757CA43929B1062745BFB76FC"><enum>(4)</enum><text display-inline="yes-display-inline">such other information or recommendations as the head of the entity selected pursuant to such
			 section 3001(b) considers appropriate.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id0B63572D9C1B4700A3F6FF9E02FDC884" section-type="subsequent-section"><enum>505.</enum><header display-inline="yes-display-inline">Improving the periodic reinvestigation process</header><subsection commented="no" display-inline="no-display-inline" id="HC8846D8CE7D34F1E976596C1A51BEADF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter until
			 December 31, 2017, the Director of National Intelligence, in consultation
			 with the Secretary of Defense and the Director of the Office of Personnel
			 Management, shall transmit to the appropriate committees of Congress a
			 strategic plan for updating the process for periodic reinvestigations
			 consistent with a continuous evaluation program.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H627E20C4B5FA41F2BDCDF35B8001D854"><enum>(b)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The plan required by subsection (a) shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="HDA17FF0124F846619B7DED04CA183EDF"><enum>(1)</enum><text display-inline="yes-display-inline">an analysis of the costs and benefits associated with conducting periodic reinvestigations;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA13E35B58C55433B9CEC4AAB83E4D79D"><enum>(2)</enum><text display-inline="yes-display-inline">an analysis of the costs and benefits associated with replacing some or all periodic
			 reinvestigations with a program of continuous evaluation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H259CDE578D0D448F8F953EBF38C1C46F"><enum>(3)</enum><text display-inline="yes-display-inline">a determination of how many risk-based and ad hoc periodic reinvestigations are necessary on an
			 annual basis for each component of the Federal Government with employees
			 with security clearances;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC8ADC86DE6C44EA291C800126F9961C0"><enum>(4)</enum><text display-inline="yes-display-inline">an analysis of the potential benefits of expanding the Government's use of continuous evaluation
			 tools as a means of improving the effectiveness and efficiency of
			 procedures for confirming the eligibility of personnel for continued
			 access to classified information; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7909D94B974A4660AF0A25723E9BC034"><enum>(5)</enum><text display-inline="yes-display-inline">an analysis of how many personnel with out-of-scope background investigations are employed by, or
			 contracted or detailed to, each element of the intelligence community.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H014EC510590745F9B40042BC4CAEFF35"><enum>(c)</enum><header display-inline="yes-display-inline">Periodic reinvestigations defined</header><text display-inline="yes-display-inline">In this section, the term <term>periodic reinvestigations</term> has the meaning given that term in section 3001(a) of the Intelligence Reform and Terrorism

			 of title 5, United States Code, that contains an intelligence community
			 element, except the Federal Bureau of Investigation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2251358c89664c8cb0c52c69ef795e06"><enum>(2)</enum><header display-inline="yes-display-inline">Covered intelligence community element</header><text display-inline="yes-display-inline">The term <term>covered intelligence community element</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id83c06cc9eff04b19a20fc3946dec3943"><enum>(A)</enum><text display-inline="yes-display-inline">means—</text><clause commented="no" display-inline="no-display-inline" id="id7f688a44a8734c389bc8d7925e7d69ee"><enum>(i)</enum><text display-inline="yes-display-inline">the Central Intelligence Agency, the Defense Intelligence Agency, the National
			 Geospatial-Intelligence Agency, the National Security Agency, the Office
			 of the Director of National Intelligence, and the National Reconnaissance
			 Office; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id76de4a26a4bd41f1938f0c5b60e3d0a4"><enum>(ii)</enum><text display-inline="yes-display-inline">any executive agency or unit thereof determined by the President under section 2302(a)(2)(C)(ii) of

			 of foreign intelligence or counterintelligence activities; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2f34adb28c954e0bb3a331eb200a4ef1"><enum>(B)</enum><text display-inline="yes-display-inline">does not include the Federal Bureau of Investigation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4d7311c7b3c4a95bf6f71eb2bcf3f36"><enum>(3)</enum><header display-inline="yes-display-inline">Personnel action</header><text display-inline="yes-display-inline">The term <term>personnel action</term> means, with respect to an employee in a position in a covered intelligence community element
			 (other than a position excepted from the competitive service due to its
			 confidential, policy-determining,
			 policymaking, or policy-advocating character)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7e3336784bb64a0693785bc48dd89e1b"><enum>(A)</enum><text display-inline="yes-display-inline">an appointment;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd1631f6cfdf040ac999e963c0627cfa0"><enum>(B)</enum><text display-inline="yes-display-inline">a promotion;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6fad56d80fec4464947fd98df79d9acd"><enum>(C)</enum><text display-inline="yes-display-inline">a disciplinary or corrective action;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb6fa888e3f0e40a48ce430ee38234b33"><enum>(D)</enum><text display-inline="yes-display-inline">a detail, transfer, or reassignment;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id83939B7B77CA4421AB837BFE4563F8DC"><enum>(E)</enum><text display-inline="yes-display-inline">a demotion, suspension, or termination;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2AB71475699042519058892968C4157C"><enum>(F)</enum><text display-inline="yes-display-inline">a reinstatement or restoration;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idef62ae1567a748ecb36fc76e7af9e0c2"><enum>(G)</enum><text display-inline="yes-display-inline">a performance evaluation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbd4f9502dca540aa869eeaab81b23b19"><enum>(H)</enum><text display-inline="yes-display-inline">a decision concerning pay, benefits, or awards;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id310644aea60147799716c8242461e11a"><enum>(I)</enum><text display-inline="yes-display-inline">a decision concerning education or training if such education or training may reasonably be
			 expected to lead to an appointment, promotion, or performance evaluation;
			 or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0da5e83415c949a5952c38573a558ef2"><enum>(J)</enum><text display-inline="yes-display-inline">any other significant change in duties, responsibilities, or working conditions.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3ee737c5de0c433faa02436d996c3599"><enum>(b)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any employee of an agency who has authority to take, direct others to take, recommend, or approve
			 any personnel action, shall not, with respect to such authority, take or
			 fail to take a personnel action with respect to any employee of a covered
			 intelligence community element as a reprisal for a lawful disclosure of
			 information by the employee to the Director of National Intelligence (or
			 an employee
			 designated by the Director of National Intelligence for such purpose), the
			 Inspector General of the Intelligence Community, the head of the employing
			 agency (or an employee designated by the head of that agency for such
			 purpose), the appropriate inspector general of the employing agency, a
			 congressional intelligence committee, or a member of a congressional
			 intelligence committee, which the employee reasonably believes evidences—</text><paragraph commented="no" display-inline="no-display-inline" id="id76c32a3b196e4978816242d521bd0ab3"><enum>(1)</enum><text display-inline="yes-display-inline">a violation of any Federal law, rule, or regulation; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida400989adfbc4498b52ba9b34aeb59ba"><enum>(2)</enum><text display-inline="yes-display-inline">mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger
			 to public health or safety.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0f13e9f7859a44e4819ec225d16f7538"><enum>(c)</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="yes-display-inline">The President shall provide for the enforcement of this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id93c7a88ec87448528091df090f00d55d"><enum>(d)</enum><header display-inline="yes-display-inline">Existing rights preserved</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to—</text><paragraph commented="no" display-inline="no-display-inline" id="id6cb13c9c5a04452a95f332c48df7a49b"><enum>(1)</enum><text display-inline="yes-display-inline">preempt or preclude any employee, or applicant for employment, at the Federal Bureau of

			 while such challenge is pending; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8503939342434f399d72e0659139e98c"><enum>(B)</enum><text display-inline="yes-display-inline">developing and implementing uniform and consistent policies and procedures to ensure proper
			 protections during the process for denying, suspending, or revoking a
			 security clearance or access to classified information, including the
			 ability to appeal such a denial, suspension, or revocation, except that
			 there shall be no appeal of an agency’s suspension of a security clearance
			 or access determination for purposes of conducting an investigation, if
			 that suspension lasts no longer than 1 year or the head of the agency or a
			 designee of the head of the agency certifies that a longer suspension is
			 needed before a final decision on denial or revocation to prevent imminent
			 harm to the national security.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF6E6EB05D68A4A2AB6EA51729BBDAD5F"><enum>(2)</enum><header display-inline="yes-display-inline">Required elements of policies and procedures</header><text display-inline="yes-display-inline">The policies and procedures for appeal developed under paragraph (7) of section 3001(b) of the
			 Intelligence Reform and Terrorism Prevention Act of 2004, as added by
			 subsection (a), shall	provide for the Inspector General of the
			 Intelligence Community, or the inspector general of the employing agency,
			 to conduct fact-finding and report to the agency head or the designee of
			 the agency head within 180 days unless the employee and the agency agree
			 to an extension or the investigating inspector general determines in
			 writing that a greater period of time is required.  To the fullest extent
			 possible, such fact-finding shall include an opportunity for the employee
			 to present relevant evidence such as witness testimony.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2264cb39504b457d8a8ea7923c9dfb68"><enum>(b)</enum><header display-inline="yes-display-inline">Retaliatory revocation of security clearances and access determinations</header><text display-inline="yes-display-inline">Section 3001 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341</external-xref>) is
			 amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idb31a49c04ce44700967fc4b5b34ba4f4" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id5c07e3a88cea40699898ad020e8e9a75"><enum>(j)</enum><header display-inline="yes-display-inline">Retaliatory revocation of security clearances and access determinations</header><paragraph commented="no" display-inline="no-display-inline" id="idc8939abc017246f09c490442e7615c4a"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Agency personnel with authority over personnel security clearance or access determinations shall
			 not take or fail to take, or threaten to take or fail to take, any action
			 with respect to any employee's security clearance or access determination
			 in retaliation for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8ff4ef2ffa684fa5928e02388e5771de"><enum>(A)</enum><text display-inline="yes-display-inline">any lawful disclosure of information to the Director of National Intelligence (or an employee
			 designated by
			 the Director of National Intelligence for such purpose) or the head of the
			 employing agency (or employee designated by the head of that agency for
			 such purpose) by an employee that the employee reasonably believes
			 evidences—</text><clause commented="no" display-inline="no-display-inline" id="idef8bccd5432d449db04ecaf6011402e9"><enum>(i)</enum><text display-inline="yes-display-inline">a violation of any Federal law, rule, or regulation; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idbeefbccd9675495b8c35634d74e26bc9"><enum>(ii)</enum><text display-inline="yes-display-inline">gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific
			 danger to public health or safety;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0b0a9e7e91ac490c84be9adc6f4c53c3"><enum>(B)</enum><text display-inline="yes-display-inline">any lawful disclosure to the Inspector General of an agency or another employee designated by the
			 head of the
			 agency to receive such disclosures, of information which the employee
			 reasonably believes evidences—</text><clause commented="no" display-inline="no-display-inline" id="id0d1e5d9fc8bb43489edb534c21c13142"><enum>(i)</enum><text display-inline="yes-display-inline">a violation of any Federal law, rule, or regulation; or</text></clause><clause commented="no" display-inline="no-display-inline" id="ida5e5395c98c24cf882a540a622aa0173"><enum>(ii)</enum><text display-inline="yes-display-inline">gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific
			 danger to public health or safety;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id15e3f12e3a664eb1a18ee47489e8dc7f"><enum>(C)</enum><text display-inline="yes-display-inline">any lawful disclosure that complies with—</text><clause commented="no" display-inline="no-display-inline" id="id6e8724658a864fdeab9a208dbb29a2d9"><enum>(i)</enum><text display-inline="yes-display-inline">subsections (a)(1), (d), and (h) of <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /8H">section 8H</external-xref> of the Inspector General Act of 1978 (5 U.S.C.
			 App.);</text></clause><clause commented="no" display-inline="no-display-inline" id="id204a31e0d858464e8f63693993419cbc"><enum>(ii)</enum><text display-inline="yes-display-inline">subparagraphs (A), (D), and (H) of section 17(d)(5) of the Central Intelligence Agency Act of 1949
			 (<external-xref legal-doc="usc" parsable-cite="usc/50/3517">50 U.S.C. 3517(d)(5)</external-xref>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idf1c173f35b1647f1aba1eba00fab57e4"><enum>(iii)</enum><text display-inline="yes-display-inline">subparagraphs (A), (D), and (I) of section 103H(k)(5) of the National Security Act of 1947 (50
			 U.S.C. 3033(k)(5)); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id78c4486b86d04c31b14ca4d670564f89"><enum>(D)</enum><text display-inline="yes-display-inline">if the actions do not result in the employee or applicant unlawfully disclosing information
			 specifically required by Executive order to be kept classified in the
			 interest of national defense or the conduct of foreign affairs, any lawful
			 disclosure in conjunction with—</text><clause commented="no" display-inline="no-display-inline" id="id01ca51169f114e12a7cb601d1f6d8afe"><enum>(i)</enum><text display-inline="yes-display-inline">the exercise of any appeal, complaint, or grievance right granted by any law, rule, or regulation;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf03034eaf2b6491babcca28457b160ea"><enum>(ii)</enum><text display-inline="yes-display-inline">testimony for or otherwise lawfully assisting any individual in the exercise of any right referred
			 to in clause (i); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idc4b415a1dcb149129480d3aba2fac60c"><enum>(iii)</enum><text display-inline="yes-display-inline">cooperation with or disclosing information to the Inspector General of an agency, in accordance
			 with applicable provisions of law in connection with an audit, inspection,
			 or investigation conducted by the Inspector General.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idea4b678148a9406892527ee7e76a356a"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Consistent with the protection of sources and methods, nothing in paragraph (1) shall be construed
			 to authorize the withholding of information from Congress or the taking of
			 any personnel action against an employee who lawfully discloses
			 information to Congress.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0ff083661d894719804a51d9b7910bf8"><enum>(3)</enum><header display-inline="yes-display-inline">Disclosures</header><subparagraph commented="no" display-inline="no-display-inline" id="ide253706ff59449b38b5b2a6f0f35b420"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A disclosure shall not be excluded from paragraph (1) because—</text><clause commented="no" display-inline="no-display-inline" id="ide9a9ba0741864ea18eb7f2623c3d5bf2"><enum>(i)</enum><text display-inline="yes-display-inline">the disclosure was made to a person, including a supervisor, who participated in an activity that
			 the employee reasonably believed to be covered by paragraph (1)(A)(ii);</text></clause><clause commented="no" display-inline="no-display-inline" id="id4271343025ea4614905b0b45644bbc49"><enum>(ii)</enum><text display-inline="yes-display-inline">the disclosure revealed information that had been previously disclosed;</text></clause><clause commented="no" display-inline="no-display-inline" id="id640bc55707cb4cb58232356493f0dd9d"><enum>(iii)</enum><text display-inline="yes-display-inline">the disclosure was not made in writing;</text></clause><clause commented="no" display-inline="no-display-inline" id="id74fb9df25f5341b58f543923502326e1"><enum>(iv)</enum><text display-inline="yes-display-inline">the disclosure was made while the employee was off duty; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id069b764f15bd466892cf75f6fad439bb"><enum>(v)</enum><text display-inline="yes-display-inline">of the amount of time which has passed since the occurrence of the events described in the
			 disclosure.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc0b31a897af84323959eb2fc4b23644d"><enum>(B)</enum><header display-inline="yes-display-inline">Reprisals</header><text display-inline="yes-display-inline">If a disclosure is made during the normal course of duties of an employee, the disclosure shall not
			 be excluded from paragraph (1) if any employee who has authority to take,
			 direct others to take, recommend, or approve any personnel action with
			 respect to the employee making the disclosure, took, failed to take, or
			 threatened to take or fail to take a personnel action with respect to that
			 employee in reprisal for the disclosure.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id104f50aa656d4ed987254af650d2c591"><enum>(4)</enum><header display-inline="yes-display-inline">Agency adjudication</header><subparagraph commented="no" display-inline="no-display-inline" id="idb03dc3eafc864f8c9ea4c15772131ad6"><enum>(A)</enum><header display-inline="yes-display-inline">Remedial procedure</header><text display-inline="yes-display-inline">An employee or former employee who believes that he or she has been subjected to a reprisal
			 prohibited by paragraph (1) may, within 90 days after the issuance of
			 notice of such decision, appeal that decision within the agency of that
			 employee or former employee through proceedings authorized by subsection
			 (b)(7), except that there shall be no appeal of an agency’s suspension of
			 a security clearance or access determination for purposes of conducting an
			 investigation, if that suspension lasts not longer than 1 year (or a
			 longer period in accordance with a certification made under subsection
			 (b)(7)).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2212a4f128084d34bee44beaf9dad97f"><enum>(B)</enum><header display-inline="yes-display-inline">Corrective action</header><text display-inline="yes-display-inline">If, in the course of proceedings authorized under subparagraph (A), it is determined that the
			 adverse security clearance or access determination violated paragraph (1),
			 the agency shall take specific corrective action to return the employee or
			 former employee, as nearly as practicable and reasonable, to the position
			 such employee or former employee would have held had the violation not
			 occurred. Such corrective action may include back pay and related
			 benefits, travel expenses, and compensatory damages not to exceed
			 $300,000.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddfc16a76eaa24e5ab108d6df309c14eb"><enum>(C)</enum><header display-inline="yes-display-inline">Contributing factor</header><text display-inline="yes-display-inline">In determining whether the adverse security clearance  or access determination violated paragraph
			 (1), the agency shall find that paragraph (1) was violated if a disclosure
			 described in paragraph (1) was a contributing factor in the adverse
			 security clearance or access determination taken against the individual,
			 unless the agency demonstrates by a preponderance of the evidence that it
			 would have taken the same action in the absence of such disclosure, giving
			 the utmost deference to the agency’s assessment of the particular threat
			 to the national security interests of the United States in the instant
			 matter.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idec7c7bf832c748b58b0fce6d5984e520"><enum>(5)</enum><header display-inline="yes-display-inline">Appellate review of security clearance access determinations by Director of National Intelligence</header><subparagraph commented="no" display-inline="no-display-inline" id="ida079e490002548c3b2acc17f85da3c9a"><enum>(A)</enum><header display-inline="yes-display-inline">Appeal</header><text display-inline="yes-display-inline">Within 60 days after receiving notice of an adverse final agency determination under a proceeding
			 under paragraph (4), an employee or former employee may appeal that
			 determination in accordance with the procedures established under
			 subparagraph (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5d6e608a804d4c068da72da80027dbc7"><enum>(B)</enum><header display-inline="yes-display-inline">Policies and procedures</header><text display-inline="yes-display-inline">The Director of National Intelligence, in consultation with the Attorney General and the Secretary
			 of Defense, shall develop and implement policies and procedures for
			 adjudicating the appeals authorized by subparagraph (A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27fab1dc27d84f92ad8fe85814733e2c"><enum>(C)</enum><header display-inline="yes-display-inline">Congressional notification</header><text display-inline="yes-display-inline">Consistent with the protection of sources and methods, at the time the Director of National
			 Intelligence issues an order regarding an appeal pursuant to the policies
			 and procedures established by this paragraph, the Director of National
			 Intelligence shall notify the congressional intelligence committees.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f4fc9ad48d341e5b59b99441162c4ce"><enum>(6)</enum><header display-inline="yes-display-inline">Judicial review</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to permit or require judicial review of any—</text><subparagraph commented="no" display-inline="no-display-inline" id="id54e4b5fae52d4a9ab1caf844565eb95d"><enum>(A)</enum><text display-inline="yes-display-inline">agency action under this section; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf1b8fe9d5a5e42b2bdeddf4e7052378e"><enum>(B)</enum><text display-inline="yes-display-inline">action of the appellate review procedures established under paragraph (5).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24ad2db4119b46b3b27882a56105dad2"><enum>(7)</enum><header display-inline="yes-display-inline">Private cause of action</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to permit, authorize, or require a private cause of
			 action to challenge the merits of a security clearance determination.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id95b31cf3a0c744e3b993c93c352c4302"><enum>(c)</enum><header display-inline="yes-display-inline">Access determination defined</header><text display-inline="yes-display-inline">Section 3001(a) of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341(a)</external-xref>)
			 is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idCC9B9A64E7FA4049A03B17FFB8356AF1" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idc2d9a801216c48eabae29e494c2b3bc4"><enum>(9)</enum><header display-inline="yes-display-inline">Access determination</header><text display-inline="yes-display-inline">The term <term>access determination</term> means the determination regarding whether an employee—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5e1f400b94d4442d9f531930d1a2ce67"><enum>(A)</enum><text display-inline="yes-display-inline">is eligible for access to classified information in accordance with Executive Order 12968 (60 Fed.
			 Reg. 40245; relating to access to classified information), or any
			 successor thereto, and Executive Order 10865 (25 Fed. Reg. 1583; relating
			 to safeguarding classified information with industry), or any successor
			 thereto; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd73e6c382dd64bf294342ee32dd8213d"><enum>(B)</enum><text display-inline="yes-display-inline">possesses a need to know under such an Order.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id3827EAB96AC841C1870D31F162D7F06B"><enum>(d)</enum><header display-inline="yes-display-inline">Existing rights preserved</header><text display-inline="yes-display-inline">Nothing in this section or the amendments made by this section shall be construed to preempt,
			 preclude, or otherwise prevent an individual from exercising rights,
			 remedies, or avenues of redress currently provided under any other law,
			 regulation, or rule.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3f05c3099ec9437f945d933a23d0ef45"><enum>(e)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in section 3001 of the Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C.
			 3341), as amended by this title, shall be construed to require the repeal
			 or replacement of agency appeal procedures implementing Executive Order
			 12968 (60 Fed. Reg. 40245; relating to access to classified information),
			 or any successor thereto, and Executive Order 10865 (25 Fed. Reg. 1583;
			 relating to safeguarding classified information with industry), or any
			 successor thereto, that meet the requirements of paragraph (7) of section
			 3001(b) of such Act, as added by this section.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id48E423F1B90240299861D83E448E3EB7" section-type="subsequent-section"><enum>603.</enum><header display-inline="yes-display-inline">Revisions of other laws</header><subsection commented="no" display-inline="no-display-inline" id="id8cb915a9872c4ed1ac75b26bb229eb79"><enum>(a)</enum><header display-inline="yes-display-inline">Inspector General Act of 1978</header><text display-inline="yes-display-inline">Section 8H of the Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf054948d8d0640eebdf3732acddbcc98"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5900c5dd9de8406ca985f1aa12244ffa"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after <quote>(b)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id07714381a7d34b0bb8be3d09943f0cc1"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idEF588A9EF5E04114AAC8454BC7D52B32" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idD89A40C062224E35A24BCA0BBF31D887" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the head of an establishment determines that a complaint or information transmitted under
			 paragraph (1) would create a conflict of interest for the head of the
			 establishment, the head of the establishment shall return the complaint or
			 information to the Inspector General with that determination and the
			 Inspector General shall make the transmission to the Director of National
			 Intelligence and, if the establishment is within the Department of
			 Defense, to the Secretary of Defense. In such a case, the requirements of
			 this section for the head of the establishment apply to each recipient of
			 the Inspector General’s transmission.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb54383024eb9473490f4abf4048af199"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (h) as subsection (i); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0b2fcca01c4b41b8a640b1655e9b126d"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (g) the following:</text><quoted-block display-inline="no-display-inline" id="id8C5EB2AF9CAA4ECC8BDA7392AFE6F601" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id25fc6afc31544c0b94a63d40122da417"><enum>(h)</enum><text display-inline="yes-display-inline">An individual who has submitted a complaint or information to an Inspector General under this
			 section may notify any member of the Permanent Select Committee on
			 Intelligence of the House of Representatives or the Select Committee on
			 Intelligence of the Senate, or a staff member of either such Committee, of
			 the fact that such individual has made a submission to that particular
			 Inspector General, and of the date on which such submission was made.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id14c423ed09ed4e9d8a07c57af6c04509"><enum>(b)</enum><header display-inline="yes-display-inline">Central Intelligence Agency</header><text display-inline="yes-display-inline">Section 17(d)(5) of the Central Intelligence Agency Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/50/3517">50 U.S.C. 3517(d)(5)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id7b54d4ced4db42b88fd66b9b2f5fdc00"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id205e47cab3084a87a6d9c82a6bb8f01c"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(i)</quote> after <quote>(B)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide9ceb1d50d054113bf5f55d2c5c96203"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id5DA317950F644652B4101D0DB44C81F7" style="OLC"><clause commented="no" display-inline="no-display-inline" id="idEB63A329FE84432886336516BDCA6669" indent="up3"><enum>(ii)</enum><text display-inline="yes-display-inline">If the Director determines that a complaint or information transmitted under paragraph (1) would
			 create a conflict of interest for the Director, the Director shall return
			 the complaint or information to the Inspector General with that
			 determination and the Inspector General shall make the transmission to the
			 Director of National Intelligence. In such a case, the requirements of
			 this subsection for the Director of the Central Intelligence Agency apply
			 to the Director of National Intelligence</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1c407fbe6ec2487ab48227baa1b6fccd"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id4A678FBFE7BC478890F03CE2F7C2462B" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="idbcd6d9dbf63047f5b43538f622893f85" indent="up2"><enum>(H)</enum><text display-inline="yes-display-inline">An individual who has submitted a complaint or information to the Inspector General under this
			 section may notify any member of the Permanent Select Committee on
			 Intelligence of the House of Representatives or the Select Committee on
			 Intelligence of the Senate, or a staff member of either such Committee, of
			 the fact that such individual has made a submission to the Inspector
			 General, and of the date on which such submission was made.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9d39200badeb455a8aca1c8c55ead507"><enum>(c)</enum><header display-inline="yes-display-inline">National Security Act of 1947</header><text display-inline="yes-display-inline">Section 103H(k)(5) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3033">50 U.S.C. 3033(k)(5)</external-xref>) is amended by adding
			 at the end the following:</text><quoted-block display-inline="no-display-inline" id="id6C94B0EA388542979FCA231729C4A93A" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="idd615516902a74fd3939c1ee542918b83" indent="up2"><enum>(I)</enum><text display-inline="yes-display-inline">An individual who has submitted a complaint or information to the Inspector General under this
			 section may notify any member of either of the congressional intelligence
			 committees, or a staff member of either of such committees, of the fact
			 that such individual has made a submission to the Inspector General, and
			 of the date on which such submission was made.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="id06BB1A35A71C41699AC4915A7DAC844A" section-type="subsequent-section"><enum>604.</enum><header display-inline="yes-display-inline">Policies and procedures; nonapplicability to certain terminations</header><subsection commented="no" display-inline="no-display-inline" id="idc616cd6d60dd4647bf2eba6d45ddb34e"><enum>(a)</enum><header display-inline="yes-display-inline">Covered intelligence community element defined</header><text display-inline="yes-display-inline">In this section, the term <term>covered intelligence community element</term>—</text><paragraph commented="no" display-inline="no-display-inline" id="iddf1b635753e843e9a55013a3d82d8e77"><enum>(1)</enum><text display-inline="yes-display-inline">means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5a90620f448f4ae2ba183a88d822637f"><enum>(A)</enum><text display-inline="yes-display-inline">the Central Intelligence Agency, the Defense Intelligence Agency, the National
			 Geospatial-Intelligence Agency, the National Security Agency, the Office
			 of the Director of National Intelligence, and the National Reconnaissance
			 Office; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0e2a70a9f1034370853ac3f497c888f3"><enum>(B)</enum><text display-inline="yes-display-inline">any executive agency or unit thereof determined by the President under section 2302(a)(2)(C)(ii) of
			 title 5, United States Code, to have as its principal function the conduct
			 of foreign intelligence or counterintelligence activities; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id63081bbaae474fa9a6b524d1b29e18aa"><enum>(2)</enum><text display-inline="yes-display-inline">does not include the Federal Bureau of Investigation.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ideb9dcb87805341eb8cdc70c26011f42d"><enum>(b)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">In consultation with the Secretary of Defense, the Director of National Intelligence shall develop
			 policies and procedures to ensure that a personnel action shall not be
			 taken against an employee of a covered intelligence community element as a
			 reprisal for any disclosure of information described in 1104 of the
			 National Security Act of 1947, as added by section 601 of this Act.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6474d77c1e5448708f5b2158393233ba"><enum>(c)</enum><header display-inline="yes-display-inline">Report on the status of implementation of regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Director of National
			 Intelligence shall submit a report on the status of the implementation of
			 the regulations promulgated under subsection (b) to the congressional
			 intelligence committees.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id1395c3c8ef0d49af84df21dce086d147"><enum>(d)</enum><header display-inline="yes-display-inline">Nonapplicability to certain terminations</header><text display-inline="yes-display-inline">Section 1104 of the National Security Act of 1947, as added by	section 601 of this Act, and
			 section 3001 of the Intelligence Reform and Terrorism Prevention Act of
			 2004 (50
			 U.S.C. 3341), as amended by section 602 of this Act, shall not apply if—</text><paragraph commented="no" display-inline="no-display-inline" id="ida271e19f4566492a8813e69a1a66f40d"><enum>(1)</enum><text display-inline="yes-display-inline">the affected employee is concurrently terminated under—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd07a661a0ed8482692f28400ad0eec75"><enum>(A)</enum><text display-inline="yes-display-inline">section 1609 of title 10, United States Code;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48b8e54fe13846bea46ff225bdf030f7"><enum>(B)</enum><text display-inline="yes-display-inline">the authority of the Director of National Intelligence under section 102A(m) of the National
			 Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3024">50 U.S.C. 3024(m)</external-xref>), if the Director determines that
			 the termination is in the interest of the United States;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida8ca800db10f47258ad04e12dc8ec67d"><enum>(C)</enum><text display-inline="yes-display-inline">the authority of the Director of the Central Intelligence Agency under section 104A(e) of the
			 National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3036">50 U.S.C. 3036(e)</external-xref>), if the Director
			 determines that the termination is in the interest of the United States;
			 or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8e257d5444e34b50b290c97508fcd9dc"><enum>(D)</enum><text display-inline="yes-display-inline">section 7532 of title 5, United States Code, if the head of the agency determines that the
			 termination is in the interest of the United States; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9617948d2e174813ac217670e2e4144b"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 30 days after such termination, the head of the agency that employed the affected
			 employee notifies the congressional intelligence committees
			 of the termination.</text></paragraph></subsection></section></title><title commented="no" id="HF29ECBD8A7344A9DBED60FF8C1D548A8" level-type="subsequent"><enum>VII</enum><header display-inline="yes-display-inline">Technical amendments</header><section commented="no" display-inline="no-display-inline" id="id2E2C020498DA4015B7DEE613C37FD17D" section-type="subsequent-section"><enum>701.</enum><header display-inline="yes-display-inline">Technical amendments to the Central Intelligence Agency Act of 1949</header><text display-inline="no-display-inline">Section 21 of the Central Intelligence Agency Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/50/3521">50 U.S.C. 3521</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HB08C359F5D764A498F8C88558868314A"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(1)(D), by striking <quote>section (a)</quote> and inserting <quote>subsection (a)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBCBE445A19CA4BDE88E2D1BDC49453DB"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(2)(E), by striking <quote>provider.</quote> and inserting <quote>provider</quote>.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id16166B88CD11453883D733D3C31A791C" section-type="subsequent-section"><enum>702.</enum><header display-inline="yes-display-inline">Technical amendments to the National Security Act of 1947 relating to the past elimination of
