			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Oregon Eastside Forests
			 Restoration, Old Growth Protection, and Jobs Act of
			 2013</short-title></quote>.</text></section><section changed="deleted" committee-id="SSEG00" id="ID472e2a09acdd4a64a0cb8cc0de09f3d2" reported-display-style="strikethrough"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text><paragraph commented="no" display-inline="no-display-inline" id="ID5a6664f0f1bf47fc9cc4a3f76b8910be"><enum>(1)</enum><text>to conserve and
			 restore the eastside National Forests of the State;</text></paragraph><paragraph id="IDf283df9b71b3423cb9bc637618e3d195"><enum>(2)</enum><text>to create an
			 immediate, predictable, and increased timber flow to support locally based
			 restoration economies in the communities of the eastside National Forests
			 of
			 the State;</text></paragraph><paragraph id="IDe8a65e9bbd7a447da44e67c21630ea5c"><enum>(3)</enum><text>to make the
			 eastside National Forests of the State more resistant and resilient to,
			 and to
			 mitigate the effects of, climate change;</text></paragraph><paragraph id="IDe93d32f1950d4fb1ba6fdd54d61d0dd8"><enum>(4)</enum><text>to protect,
			 restore, and increase old-growth forest stands and trees in the eastside
			 National Forests of the State;</text></paragraph><paragraph id="ID0632684f59c64715953b65edd79af059"><enum>(5)</enum><text>to promote
			 collaboration in the communities of the eastside National Forests of the
			 State
			 to respond to critical threats to forest and watershed health and to
			 support
			 natural resource- and restoration-based economies;</text></paragraph><paragraph id="ID5166a9433c8c42a89a08756b2083fac0"><enum>(6)</enum><text>to prioritize,
			 strategically target, and accelerate projects to improve forest health and
			 watershed health in old growth forests located in the eastside National
			 Forests
			 of the State; and</text></paragraph><paragraph id="ID7a4bdcb177b74e31a63de5f0b3eb4e07"><enum>(7)</enum><text>to provide the
			 Secretary, collaborative groups, and the public with independent
			 scientific
			 advice for restoring forest health and watershed health in the eastside
			 National Forests of the State.</text></paragraph></section><section changed="deleted" committee-id="SSEG00" id="IDd12f1a3c8f07483cb404b64c812ef30d" reported-display-style="strikethrough"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ID4f9af5d658b7457e97ed649ea083c745"><enum>(1)</enum><header>Advisory
			 panel</header><text>The term <term>advisory panel</term> means the Eastside
			 Forest Scientific and Technical Advisory Panel established under section
			 6(a).</text></paragraph><paragraph id="ID27925a3063ca48efae92dd532d8ba9fd"><enum>(2)</enum><header>Collaborative
			 group</header><text>The term <term>collaborative group</term> means a group of
			 individuals that meets the requirements of section 8(a)(2).</text></paragraph><paragraph id="ID2fe14d4dc1344ec4bc3f7030fa4db94b"><enum>(3)</enum><header>Covered
			 area</header><text>The term <term>covered area</term> means the area selected
			 by the Secretary under section 4(a)(1) that is—</text><subparagraph id="IDacbf9f6dbb884165a99b41c0a5dd8fa1"><enum>(A)</enum><text>within the State;
			 and</text></subparagraph><subparagraph id="IDd23eec0e04a646088310045fa82e982f"><enum>(B)</enum><text>not within the
			 area covered by the Record of Decision for Amendments to Forest Service
			 and
			 Bureau of Land Management Planning Documents Within the Range of the
			 Northern
			 Spotted Owl, dated April 1994.</text></subparagraph></paragraph><paragraph id="idc8699667052441bb9d18c918650967aa"><enum>(4)</enum><header>Decision
			 notice</header><text>The term <term>Decision Notice</term> means the decision
			 notice entitled <term>Decision Notice for the Revised Continuation of Interim
			 Management Direction Establishing Riparian, Ecosystem and Wildlife
			 Standards
			 for Timber Sales, United States Forest Service Region 6, Colville,
			 Deschutes,
			 Fremont, Malheur, Ochoco, Okanogan, Umatilla, Wallowa-Whitman and Winema
			 National Forests in Oregon and Washington</term> and approved by the Pacific
			 Northwest Regional Forester on June 6, 1995.</text></paragraph><paragraph id="IDfa2bd355c81841ada6f6e53460f8077a"><enum>(5)</enum><header>Emergency
			 condition</header><text>The term <term>emergency condition</term> means a
			 condition—</text><subparagraph id="IDeee7ce592def4db9b48c01545c308ac6"><enum>(A)</enum><text>that results in
			 an—</text><clause id="IDe101db765af44e76b912967e34cb83e6"><enum>(i)</enum><text>imminent risk to
			 life or property; or</text></clause><clause id="IDe51e5c81a8d14d3d8637527803979e7e"><enum>(ii)</enum><text>immediate
			 impairment of the public use and enjoyment of a trail, road, highway,
			 public
			 facility, or public land; and</text></clause></subparagraph><subparagraph id="IDa80dc44300744a2aaf5aaa7cb3241e13"><enum>(B)</enum><text>with respect to
			 subparagraph (A)(ii), the urgency to address the emergency of which
			 outweighs
			 the benefits of full notice and comment.</text></subparagraph></paragraph><paragraph id="ID2f3dcc14da2b404d890ecb4f5b2fc03f"><enum>(6)</enum><header>Forest
			 health</header><text>The term <term>forest health</term> means conditions that
			 enable forested land—</text><subparagraph id="ID285b5907d4ab48dba69078072d0f1f36"><enum>(A)</enum><text>to be durable,
			 resilient, and less prone to uncharacteristic wildfire, insect, or
			 pathogen
			 outbreaks, while—</text><clause id="IDfab65a3fe1d843c3a4a59c0ec6df7f9c"><enum>(i)</enum><text>supporting
			 ecosystem services and populations of native species; and</text></clause><clause id="IDfe8c634db4e8405ca6b96b19ea0447c4"><enum>(ii)</enum><text>allowing for
			 natural disturbances;</text></clause></subparagraph><subparagraph id="IDbd6a9ea9232e442da821d33233b48fca"><enum>(B)</enum><text>to maintain or
			 develop species composition, ecosystem function and structure, hydrologic
			 function, and sediment regimes that are within an acceptable range that
			 considers—</text><clause id="ID43bba967ecb341b6bfdc297cd1ba91b1"><enum>(i)</enum><text>historic
			 variability; and</text></clause><clause id="ID9b70d09c2ece45be9e7e788638e558e6"><enum>(ii)</enum><text>anticipated
			 future conditions; and</text></clause></subparagraph><subparagraph id="IDb2eb256bfee743a8a8f47f7f3092b2cb"><enum>(C)</enum><text>to be resistant
			 and resilient to un­char­ac­ter­is­tic events.</text></subparagraph></paragraph><paragraph id="ID59c22dace9a94d3fa079406f62dd4977"><enum>(7)</enum><header>Forest
			 stand</header><text>The term <term>forest stand</term> means a contiguous group
			 of trees that are sufficiently uniform in age-class distribution,
			 composition,
			 and structure and that are growing on a site of sufficiently uniform
			 quality to
			 be a distinguishable unit.</text></paragraph><paragraph commented="no" id="ID36b469fb3b944f8fb8d5e793e01a08aa"><enum>(8)</enum><header>Initiative</header><text>The
			 term <term>Initiative</term> means an initiative established by the
			 Secretary—</text><subparagraph commented="no" id="ID8062d5403f464c7a8e0ebbe3e4ffeab6"><enum>(A)</enum><text>to restore and
			 improve the ecological structure, composition, and function and the
			 natural
			 processes of watersheds within the National Forest System;</text></subparagraph><subparagraph commented="no" id="IDbc17dd1f5d9f41ec8c9daddcf545cde7"><enum>(B)</enum><text>to preserve and
			 create local jobs in rural communities that are located in or near
			 National
			 Forest System land;</text></subparagraph><subparagraph commented="no" id="ID7067ed201852432a92b87ba148f7c676"><enum>(C)</enum><text>to sustain the
			 local wood products infrastructure and community capacity that is
			 necessary for
			 the appropriate management and restoration of National Forest System
			 land;</text></subparagraph><subparagraph commented="no" id="IDb7fa6859c6a34942a9872e7994a0caf9"><enum>(D)</enum><text>to promote
			 cooperation and collaboration in the management of National Forest System
			 land;</text></subparagraph><subparagraph commented="no" id="ID4a3e2de071204fabb6a5d455dc79f557"><enum>(E)</enum><text>to carry out
			 collaborative projects to restore forest health and watershed health and
			 to
			 reduce the risk of uncharacteristic disturbances from fire, insects, and
			 disease to communities, watersheds, and natural resources through a
			 collaborative process of planning, prioritizing, and implementing
			 ecological
			 restoration, hazardous fuel reduction, and other vegetation management
			 projects;</text></subparagraph><subparagraph commented="no" id="ID5fa72b9a721b4b51b33bfd799db9c9a9"><enum>(F)</enum><text>to collect
			 information from the projects carried out under this Act in an effort to
			 better
			 understand the manner in which to improve forest restoration and
			 management
			 activities;</text></subparagraph><subparagraph commented="no" id="IDde92a819d6bf42d29a8cf820175503b0"><enum>(G)</enum><text>that includes all
			 National Forest System land within the covered area; and</text></subparagraph><subparagraph commented="no" id="id4632725C42D540D09FDFE2467FB0CA20"><enum>(H)</enum><text>under which not
			 more than 15 National Forests may be selected to participate.</text></subparagraph></paragraph><paragraph commented="no" id="id0F589699A6BB43C2BC76077B38204440"><enum>(9)</enum><header>Inventoried
			 roadless area</header><text>The term <term>inventoried roadless area</term>
			 means 1 of the areas identified in the set of inventoried roadless area
			 maps
			 contained in the Forest Service Roadless Areas Conservation, Final
			 Environmental Impact Statement, Volume 2, dated November 2000.</text></paragraph><paragraph id="ID2f36d10a47874329ad079cf825164b4f"><enum>(10)</enum><header>National
			 forest system</header><text>The term <term>National Forest System</term> has
			 the meaning given the term in section 11(a) of the Forest and Rangeland
			 Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="id4e3af6c99d414728b49e66b0ba96b0ac"><enum>(11)</enum><header>Pilot
			 landscape</header><text>The term <term>pilot landscape</term> means a National
			 Forest entirely within the covered area on which a project is being
			 carried out
			 under section 4003 of the Omnibus Public Land Management Act of 2009 (16
			 U.S.C.
			 7303) as of January 1, 2013.</text></paragraph><paragraph id="IDd1027bcf259a4b98a04511da890a292c"><enum>(12)</enum><header>Plant
			 association</header><subparagraph id="IDad3a5f8aff8d4cafb3e03593a517d963"><enum>(A)</enum><header>In
			 general</header><text>The term <term>plant association</term> means a
			 description of a plant community that—</text><clause id="ID83893a123d6443b2855ecfcb7bdb4df7"><enum>(i)</enum><text>would
			 potentially, in the absence of a disturbance, occupy a site; and</text></clause><clause id="ID78beef5427d24770a9ae043076066c1c"><enum>(ii)</enum><text>may be
			 aggregated into 1 or more groups based on similarities in plant species,
			 composition, environment, and productivity.</text></clause></subparagraph><subparagraph id="IDc8cc5f1f53664a47a5b3d863974301e8"><enum>(B)</enum><header>Inclusion</header><text>The
			 term <term>plant association</term> includes, with respect to a forested site,
			 species representing tree, shrub, and herbaceous layers.</text></subparagraph></paragraph><paragraph id="IDf9178960fab440a588b641888191e7bb"><enum>(13)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture (acting through
			 the Chief of the Forest Service).</text></paragraph><paragraph id="ID099d3b1774da4cdda0f59652e163b05c"><enum>(14)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Oregon.</text></paragraph><paragraph id="IDdcc2c31ea0f547c9a95df40527b564b0"><enum>(15)</enum><header>Uncharacteristic</header><text>The
			 term <term>un­char­ac­ter­is­tic</term> means a wildfire, insect, or pathogen
			 outbreak or level of forest fuel, the severity, size, frequency, or
			 quantity of
			 which exceeds the historic range of variability.</text></paragraph><paragraph id="IDa46b921219404b42b1661f1040298f52"><enum>(16)</enum><header>Watershed
			 area</header><text>The term <term>watershed area</term> means 1 or more
			 subwatersheds (also known as 6th code hydrologic units).</text></paragraph><paragraph id="IDa4313144d3b7490f9927ae1912f986c1"><enum>(17)</enum><header>Watershed
			 health</header><text>The term <term>watershed health</term> means landscape
			 conditions that enable riparian and aquatic ecosystems—</text><subparagraph id="ID7514e62312ed4c16b3a6aa72ca624cb9"><enum>(A)</enum><text>to capture,
			 store, and release water, sediment, wood, and nutrients;</text></subparagraph><subparagraph id="ID8feef6664cd24431a9ec4a59dfb2faea"><enum>(B)</enum><text>to provide for
			 water temperatures that are within the range of variability of the natural
			 regimes for the processes described in subparagraph (A); and</text></subparagraph><subparagraph id="ID26a0c84421e44fc789a662c9909152ad"><enum>(C)</enum><text>to create and
			 sustain functional riparian, aquatic, and wetland habitats that are
			 capable of
			 supporting diverse populations of native aquatic- and riparian-dependent
			 species.</text></subparagraph></paragraph></section><section changed="deleted" committee-id="SSEG00" id="IDd3948c44c2d943adab73b1b02598dbb7" reported-display-style="strikethrough"><enum>4.</enum><header>Land
			 management</header><subsection id="ID6b7ea128c5424660aec4e131ce4e06b9"><enum>(a)</enum><header>Application of
			 the initiative to the covered area</header><paragraph id="IDf4ca4c21bd8a43d9a0af8b42505c329b"><enum>(1)</enum><header>In
			 general</header><text>Not later than 60 days after the date of enactment of
			 this Act, the Secretary shall select all or part of 1 or more National
			 Forests
			 in the State as part of the Initiative.</text></paragraph><paragraph id="ID136e38743ce04b5a80493a008efee9b6"><enum>(2)</enum><header>Term</header><text>The
			 selection under paragraph (1) shall be for a period of 15 years.</text></paragraph><paragraph id="ID3be9e54c8eb640e7bd985f9e5e1e566f"><enum>(3)</enum><header>Effect</header><text>The
			 provisions of this Act shall apply to the covered area.</text></paragraph></subsection><subsection id="ID59ed7f8991c04f289bab0f3faa938831"><enum>(b)</enum><header>Land management
			 goals</header><paragraph id="ID9036539cad7848acb8e47be66393b6cc"><enum>(1)</enum><header>In
			 general</header><text>In the covered area, the Secretary shall, considering the
			 best available science, seek—</text><subparagraph id="ID9adf25770ac743678b1423ab054d5e2b"><enum>(A)</enum><text>to conserve and
			 restore forest health, watershed health, and other ecosystems;</text></subparagraph><subparagraph id="IDa4f045f418424940a3bd67c9f5b7bc2c"><enum>(B)</enum><text>to reduce the
			 risk of, and increase the resistance and resiliency of the land to,
			 uncharacteristic disturbances;</text></subparagraph><subparagraph id="IDe68421475f0e44b6814e9312a4c63f4c"><enum>(C)</enum><text>to allow for
			 characteristic natural disturbances; and</text></subparagraph><subparagraph id="ID29efffb7d337461e86a2ae191b364636"><enum>(D)</enum><text>to harvest wood
			 to maintain adequate levels of industry infrastructure to accomplish the
			 goals
			 described in subparagraphs (A), (B), and (C).</text></subparagraph></paragraph><paragraph id="ID09744d3eb5144496b974820cb426d1e2"><enum>(2)</enum><header>Forest
			 management</header><text>To achieve the goals of paragraph (1) in the forested
			 land in the covered area, the Secretary shall consider opportunities—</text><subparagraph id="ID839e1866ea424ea182cc681afec93d1a"><enum>(A)</enum><text>to reduce the
			 basal area in overstocked forest stands;</text></subparagraph><subparagraph id="ID98597bd84035478e8f919529eb9bdcbb"><enum>(B)</enum><text>to increase the
			 mean diameter of forest stands;</text></subparagraph><subparagraph id="ID0ffd09ff0dc3423daa207d2ac0042a03"><enum>(C)</enum><text>to maintain or
			 create a forest composition that focuses on more fire- and
			 drought-tolerant
			 species;</text></subparagraph><subparagraph id="ID2574d2bbe0a44aa9a87d740e4d2d225f"><enum>(D)</enum><text>to restore
			 historic levels of within-forest stand spatial heterogeneity;</text></subparagraph><subparagraph id="ID1a6ee9f8c7f74e038f52df17026cd012"><enum>(E)</enum><text>to conserve and
			 restore old growth;</text></subparagraph><subparagraph id="ID30b4ce25b9dc4815bbfd4ab9a53aecbe"><enum>(F)</enum><text>to conserve and
			 restore population levels of older trees;</text></subparagraph><subparagraph id="ID904136d1e15b4306b225ac6786ce950d"><enum>(G)</enum><text>to conserve and
			 restore ecologically sustainable forest stands and landscapes to
			 incorporate
			 characteristic forest stand structures and older tree populations;</text></subparagraph><subparagraph id="ID8df2e764672b4394811b270e5f2329b3"><enum>(H)</enum><text>to harvest wood
			 and use the value of merchantable sawlogs and biomass to help offset the
			 cost
			 of improving forest health and watershed health;</text></subparagraph><subparagraph id="IDcba1eb8e870f4951afa162e44bab0cbf"><enum>(I)</enum><text>to restore or
			 maintain sustainable and fire-resilient conditions in perpetuity through
			 active
			 management (including management through prescribed or wildland fire and
			 mechanical treatments);</text></subparagraph><subparagraph id="ID00c7f2f9a4e8438192649c564d71b069"><enum>(J)</enum><text>to restore or
			 maintain ecologically appropriate spatial complexity (including a range of
			 open
			 to dense forest patches at scales from the forest stand to the
			 landscape);</text></subparagraph><subparagraph id="IDe55ca7d740d848aa89f3509166dfc366"><enum>(K)</enum><text>to create
			 nonuniform effects in carrying out vegetation management projects by
			 avoiding
			 extensive areas of uniform treatment, except for certain treatments (such
			 as
			 broadcast burns) that are carried out to enhance the spatial heterogeneity
			 of
			 the forest site;</text></subparagraph><subparagraph id="IDabdba01bc8c34b3fbd073cedaa106907"><enum>(L)</enum><text>to restore or
			 maintain ecologically appropriate understory plant community composition
			 and
			 condition, including—</text><clause id="ID22428c3bf0d746b4b0d5fb676aed45f9"><enum>(i)</enum><text>by
			 restoring and maintaining native ground cover; and</text></clause><clause id="ID8acae03b42d0465b98635a88a4d99f67"><enum>(ii)</enum><text>by
			 reducing the impacts of, and potential for, exotic and other invasive
			 species;
			 and</text></clause></subparagraph><subparagraph id="ID4f1020d9e75e4122ad0bc88d6223ae83"><enum>(M)</enum><text>to increase
			 stakeholder participation through collaborative groups.</text></subparagraph></paragraph></subsection><subsection id="IDee123ea762cb48f6b90d70190e53f4b1"><enum>(c)</enum><header>Planning</header><text>To
			 help to achieve the goals described in subsection (b), the Secretary shall
			 use
			 landscape scale planning based on watershed areas as a tool to implement
			 ecological restoration projects in the covered area.</text></subsection><subsection id="ID39826a884a564179afe20104255bca26"><enum>(d)</enum><header>Performance
			 goals</header><paragraph id="ID5e83134db4e34ece91a2ab65ba1d96de"><enum>(1)</enum><header>In
			 general</header><text>Not later than 60 days after the date on which the
			 Secretary selects the covered area, the Secretary, in consultation with
			 the
			 relevant collaborative groups, may establish performance goals, in
			 addition to
			 the goals that are established by subsection (b), that the Secretary shall
			 seek
			 to achieve consistent with the purposes of this Act and the goals and
			 opportunities described in subsection (b) for the covered area.</text></paragraph><paragraph id="ID203c6b8accbd47e9ac2f08d73307c399"><enum>(2)</enum><header>Term</header><text>Subject
			 to paragraph (3), each performance goal established under paragraph (1)
			 shall
			 be measured annually for a period of 15 years.</text></paragraph><paragraph id="IDbf93c03b2b6b482d9e756c9309b8e877"><enum>(3)</enum><header>Additions</header><text>The
			 Secretary may develop additional performance goals that the Secretary
			 determines to be appropriate during the period established by paragraph
			 (2).</text></paragraph><paragraph commented="no" id="ID035db4cf0d9749f3af6bd3c9a5c53695"><enum>(4)</enum><header>Prioritization</header><text>Subject
			 to the limitations described in section 12(c), the Secretary shall
			 prioritize
			 the vegetation management and hazardous fuels reduction program activities
			 in
			 the covered area to achieve the performance goals established under this
			 subsection.</text></paragraph><paragraph commented="no" id="id558C92B07A7440008958151BA446DBE2"><enum>(5)</enum><header> Restoration
			 goals</header><subparagraph commented="no" id="idA5F00936D87D4291A310CFAD16801C74"><enum>(A)</enum><header>In
			 general</header><text>Within the covered area, consistent with the goals, and
			 after considering the opportunities, described in subsection (b), the
			 Secretary
			 shall, to the maximum extent practicable, prepare, offer, and promptly
			 implement—</text><clause commented="no" id="idC264EB7CEDAB4EA5BE18F880D53834E4"><enum>(i)</enum><text>projects
			 that—</text><subclause commented="no" id="id8499FBE8FF7940BF99F6E658F34634E1"><enum>(I)</enum><text>are predominantly
			 comprised of mechanical treatment in the covered area that emphasize
			 sawtimber
			 as a byproduct; and</text></subclause><subclause commented="no" id="id8AA79C37CF4D4753A8BF1DE7C443464A"><enum>(II)</enum><text>are conducted
			 on—</text><item commented="no" id="idE37A78EA21DC4F30AC8CEA45AB65EC80"><enum>(aa)</enum><text>for the first
			 fiscal year after the date of enactment of this Act, not less than 60,000
			 acres;</text></item><item commented="no" id="idEB27E67FE650456C82F33979BE7C035E"><enum>(bb)</enum><text>for the
			 subsequent fiscal year, not less than 80,000 acres; and</text></item><item commented="no" id="id11594619D56A41DF975F7008D428D288"><enum>(cc)</enum><text>for each fiscal
			 year thereafter until the fiscal year in which at least 1 ecological
			 restoration project for each National Forest is initiated under section 7,
			 not
			 less than 100,000 acres; and</text></item></subclause></clause><clause id="id53ff502b5fec4a40b6a452ff727b5898"><enum>(ii)</enum><text>for each fiscal
			 year after the fiscal year specified in subparagraph clause (i)(II)(cc),
			 an
			 ecological restoration project on each National Forest in the covered area
			 with
			 a gross planning area of not less than 25,000 acres.</text></clause></subparagraph><subparagraph commented="no" id="idAB43506F681C41599A708943651ED1F4"><enum>(B)</enum><header>Annual
			 goals</header><clause commented="no" id="id4A9FD79D51EE40A5A422115E0D0353C6"><enum>(i)</enum><header>In
			 general</header><text>Beginning in the first fiscal year after the date on
			 which at least 1 ecological restoration project is initiated for each
			 National
			 Forest under section 8 and each fiscal year thereafter until the date on
			 which
			 the Initiative is completed, the Secretary may, subject to clause (ii),
			 set
			 annual acreage performance goals for projects that are predominantly
			 comprised
			 of mechanical treatment in the covered area that emphasize sawtimber as a
			 byproduct consistent with the goals, and after considering the
			 opportunities,
			 described in subsection (b).</text></clause><clause commented="no" id="idA2E00145D6F248808F1B6E171D601C71"><enum>(ii)</enum><header>Considerations</header><text>In
			 setting goals under clause (i), the Secretary shall consider—</text><subclause commented="no" id="id9AC5DE8161D4475481301478C920DA76"><enum>(I)</enum><text>any specific
			 recommendations of the advisory panel relating to acreage treatment needs;
			 and</text></subclause><subclause commented="no" id="id13F3F8C897354884BB1C23AE85A46B9E"><enum>(II)</enum><text>advice provided
			 by a collaborative group relating to acreage treatment needs.</text></subclause></clause></subparagraph><subparagraph id="id087a5addb7d64abca562f17b839c6f8d"><enum>(C)</enum><header>Priority for
			 restoration goals</header><text>In seeking to meet the restoration goals
			 established under subparagraph (A) or (B), the Secretary shall prioritize
			 for
			 treatment—</text><clause id="id3d98c9f5a026415aaa16e5b0b1fd48fc"><enum>(i)</enum><text>any
			 area located on a pilot landscape; and</text></clause><clause id="id2cb2573b49b24eeab7167e9b52e14669"><enum>(ii)</enum><text>any area that
			 has opportunities for reduced planning and implementation costs because
			 of—</text><subclause id="idEDC7069DBC5347B9A69FC16A653B4F97"><enum>(I)</enum><text>opportunities to
			 work with a collaborative group on the project; or</text></subclause><subclause id="idD8560422DC8246888632F4A63FC1484D"><enum>(II)</enum><text>opportunities to
			 use non-Federal resources to complete the project.</text></subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" id="IDb4e44e9a0946477f8c4fb000dbf6a8d6"><enum>(e)</enum><header>Prohibitions on
			 removal of certain trees</header><paragraph commented="no" id="ID591bdf05c56143ed8e5d92b64ab0ed02"><enum>(1)</enum><header>Older
			 trees</header><text>Except as provided in paragraph (2), the Secretary shall
			 prohibit the cutting or removal of any live tree located in the covered
			 area
			 that is 150 years of age or older measured at breast height.</text></paragraph><paragraph commented="no" id="IDb800bec07bd242ddb124b4bfa6791428"><enum>(2)</enum><header>Administrative
			 exceptions</header><subparagraph commented="no" id="IDbd163c89a45a4007b297d321d98fa9f0"><enum>(A)</enum><header>In
			 general</header><text>The prohibition described in paragraph (1) shall not
			 apply if the Secretary determines that there is no reasonable alternative
			 to
			 the cutting or removal of the tree to provide for a safe administrative,
			 public, or special use.</text></subparagraph><subparagraph commented="no" id="ID51b225e15ab74781a3503fe822238669"><enum>(B)</enum><header>Notice
			 requirement</header><text>The Secretary shall provide to the public and each
			 relevant collaborative group notice and an opportunity to comment before
			 making
			 a determination under subparagraph (A), unless the Secretary determines
			 that
			 the cutting or removal of the tree is necessary to respond to an emergency
			 condition.</text></subparagraph><subparagraph id="idc0dd66dadc954b60845436b1e9cd8700"><enum>(C)</enum><header>Application of
			 decision notice</header><clause id="idA87F6284DAC949CD98AF536D48E4BBBF"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), if the Secretary, after
			 considering the recommendations of the relevant collaborative group or the
			 recommendations report issued under section 6(d), determines that the
			 prohibition in paragraph (1) is infeasible to implement for a specific
			 vegetation management project, the Secretary shall apply the Decision
			 Notice
			 with respect to the specific vegetation management project.</text></clause><clause id="idDE372F5C748540018BD08D5A61A92888"><enum>(ii)</enum><header>Requirement</header><text>In
			 applying the Decision Notice to a specific vegetation management project
			 under
			 clause (i), the Secretary may make site-specific forest plan amendments to
			 allow the cutting or removal of live trees greater than 21 inches in
			 diameter
			 at breast height that are younger than 150 years old at breast height, the
			 cutting or removal of which is necessary to meet the land management goals
			 described in subsection (b)(1).</text></clause></subparagraph></paragraph></subsection><subsection id="ID747ff74c4a1948f49921ca7ad2ab38d3"><enum>(f)</enum><header>Limitations on
			 road construction</header><text>In carrying out any vegetation management
			 project in the covered area, the Secretary shall—</text><paragraph id="ID6c7e5434a90b4b3da732c7a66a395dab"><enum>(1)</enum><text>not construct any
			 permanent road, unless the Secretary determines that the road is a
			 justifiable
			 realignment of a permanent road to restore or improve the ecological
			 structure,
			 composition, and function and the natural processes of the affected forest
			 or
			 watershed; and</text></paragraph><paragraph id="ID909600dbae2546649ba389868baf285f"><enum>(2)</enum><text>by the earlier of
			 the date on which the vegetation management project is completed or the
			 date
			 that is 1 year after the activities for which the road was constructed are
			 complete, decommission any temporary road constructed to carry out the
			 vegetation management project by—</text><subparagraph id="IDfd4f0bd3e2af4eb1a53c949a553aab75"><enum>(A)</enum><text>reestablishing
			 vegetation on the road; and</text></subparagraph><subparagraph id="IDf52a6b5b61b34e1b864d4d869a39e650"><enum>(B)</enum><text>restoring any
			 natural drainage, watershed function, or other ecological processes that
			 are
			 disrupted or adversely impacted by the road, including by removing or
			 hydrologically disconnecting the road prism.</text></subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID87ef11ea56d24ffeb92d018230bc5dce" reported-display-style="strikethrough"><enum>5.</enum><header>Watershed
			 management</header><subsection id="ID17d2ba5918af4879a83ade7a2878e036"><enum>(a)</enum><header>Aquatic and
			 riparian resources management</header><paragraph id="IDb2a0ab4870bb48998ff7c8bfa831d0e8"><enum>(1)</enum><header>In
			 general</header><text>Within the covered area, each vegetation management
			 project in an area delineated under subsection (b) shall protect and
			 restore
			 the aquatic and riparian-dependent resources of the delineated area.</text></paragraph><paragraph id="ID7b3bcfce244048f98eab739af1e0087c"><enum>(2)</enum><header>Effects</header><text>A
			 project described in paragraph (1) may result in short-term negative
			 effects on
			 the aquatic and riparian-dependent resources of the delineated area if the
			 Secretary determines, after considering the best available science, that
			 the
			 project would result in a net improvement to the condition of those
			 resources
			 over the long term.</text></paragraph></subsection><subsection id="ID866f966a1b5b41c3a90e9549b631f837"><enum>(b)</enum><header>Delineation of
			 areas</header><paragraph id="ID74a8793ca92043189b38a9cab26c9649"><enum>(1)</enum><header>Fish-bearing
			 streams</header><text>The Secretary shall delineate each permanently flowing
			 fishbearing stream and the area extending away from each edge of the
			 active
			 stream channel to include—</text><subparagraph id="ID246d8e11c73d45e5ad9c61de09fdc73d"><enum>(A)</enum><text>the top of the
			 inner gorge;</text></subparagraph><subparagraph id="IDdceaa5fcf52e456e95bf930b1946a7bb"><enum>(B)</enum><text>the outer edges
			 of the 100-year floodplain;</text></subparagraph><subparagraph id="ID8583d425e27a4ee18d6a744afde508c9"><enum>(C)</enum><text>the outer edges
			 of riparian vegetation;</text></subparagraph><subparagraph id="ID8f7c980fcbea4973b011b396a8a8c4ae"><enum>(D)</enum><text>a distance equal
			 to the height of 2 site-potential trees; and</text></subparagraph><subparagraph id="ID2ddc258deeb542d98f00cfdaec108487"><enum>(E)</enum><text>a slope distance
			 of not less than 300 feet.</text></subparagraph></paragraph><paragraph id="ID8163b2bcaaa34071b15918711d548e5e"><enum>(2)</enum><header>Permanently
			 flowing non-fishbearing streams</header><text>The Secretary shall delineate
			 each permanently flowing non-fishbearing stream and the area extending
			 away
			 from each edge of the active stream channel to include—</text><subparagraph id="ID4dce40d6fd65405e8b2fd74609a6983b"><enum>(A)</enum><text>the top of the
			 inner gorge;</text></subparagraph><subparagraph id="ID609688b0b884437599bdfcc0befc170b"><enum>(B)</enum><text>the outer edges
			 of the 100-year flood plain;</text></subparagraph><subparagraph id="IDd59646b8bfd542a8955009a6edc3554c"><enum>(C)</enum><text>the outer edges
			 of riparian vegetation;</text></subparagraph><subparagraph id="IDe3504e0f4e7c45b5827cd5a03f4f080c"><enum>(D)</enum><text>a distance equal
			 to the height of 1 site-potential tree; and</text></subparagraph><subparagraph id="IDc5d6566f40e346c5a91847e4275068fe"><enum>(E)</enum><text>a slope distance
			 of not less than 150 feet.</text></subparagraph></paragraph><paragraph id="ID839d447db20543e6a47db924d43a9d7f"><enum>(3)</enum><header>Ponds, lakes,
			 reservoirs, and wetlands larger than 1 acre</header><text>The Secretary shall
			 delineate each pond, lake, reservoir, and wetland larger than 1 acre and
			 the
			 area extending away from the high-water edges to include—</text><subparagraph id="IDdf352dd024e5408488cc35290c88de87"><enum>(A)</enum><text>the outer edges
			 of the riparian vegetation;</text></subparagraph><subparagraph id="IDb86d1827c1834a389635617f94838d6c"><enum>(B)</enum><text>the extent of the
			 seasonally saturated soil;</text></subparagraph><subparagraph id="ID51b3ba820b2147eea651c1b4408087f1"><enum>(C)</enum><text>the extent of
			 moderately and highly unstable areas;</text></subparagraph><subparagraph id="IDd8a05a8c034e4f79a95cbd40b1f2a078"><enum>(D)</enum><text>a distance equal
			 to the height of 1 site-potential tree; and</text></subparagraph><subparagraph id="IDbb48c276cb25461fa233428e3d0e7166"><enum>(E)</enum><text>a slope distance
			 of—</text><clause id="IDe72c9ff7f54e46c7bdd7f48a8be8a32f"><enum>(i)</enum><text>if
			 the area located in a watershed identified as key or priority under the
			 applicable land and resource management plan, not less than 100 feet; or</text></clause><clause id="ID0a59150b12b4447fb68db2e9943f1ecb"><enum>(ii)</enum><text>not less than 50
			 feet.</text></clause></subparagraph></paragraph><paragraph id="IDd7a6cfdd6acb4063a845adb44479ea76"><enum>(4)</enum><header>Intermittent
			 streams, wetlands less than 1 acre, landslides, and landslide-prone
			 areas</header><text>The Secretary shall delineate each wetland smaller than 1
			 acre, landslide, landslide-prone area, intermittent stream channel, and
			 the
			 area extending away from the edges of the wetland, landslide,
			 landslide-prone
			 area, or intermittent stream channel to include—</text><subparagraph id="ID5243ce3739ab4152a71cac18171516d0"><enum>(A)</enum><text>the top of the
			 inner gorge;</text></subparagraph><subparagraph id="IDbb0a20249e3b4c8dab51630302beccd4"><enum>(B)</enum><text>the outer edges
			 of the riparian vegetation;</text></subparagraph><subparagraph id="ID778580876e1a478f889bda41e1bc539c"><enum>(C)</enum><text>a distance equal
			 to the height of 1 site-potential tree; and</text></subparagraph><subparagraph id="IDf00d35d3328b4d6888980f095a5fe4de"><enum>(D)</enum><text>a slope distance
			 of—</text><clause id="ID14cdff39fbf4444ba279348bc617c003"><enum>(i)</enum><text>if
			 the area is located in a watershed identified as key or priority under the
			 applicable land and resource management plan, not less than 100 feet; or</text></clause><clause id="IDd8c42cb5dd154d4cb747629d9b31ccb7"><enum>(ii)</enum><text>not less than 50
			 feet.</text></clause></subparagraph></paragraph></subsection><subsection id="ID259d0ce5e88c44ab93cddce730e53d11"><enum>(c)</enum><header>Aquatic and
			 riparian protection</header><paragraph id="ID4991f7ce32ca47be9e6e4248b524c886"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the Secretary shall
			 comply with the aquatic and riparian protection requirements of the
			 applicable
			 land and resource management plan in existence on the date of enactment of
			 this
			 Act in carrying out each vegetation management project in the covered
			 area.</text></paragraph><paragraph id="IDe6814f9d6bdd4783aed7c7cae95db7d4"><enum>(2)</enum><header>Modifications</header><text>The
			 Secretary may modify the aquatic and riparian protection requirements
			 described
			 in paragraph (1) if the Secretary determines, after considering the best
			 available science, that the modifications would meet or exceed the goals
			 of the
			 aquatic and riparian protection requirements.</text></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID923b931c286e4285a507d3f63198be3e" reported-display-style="strikethrough"><enum>6.</enum><header>Eastside forest
			 scientific and technical advisory panel</header><subsection id="IDf285cfda61964ac380267e234fe70bfc"><enum>(a)</enum><header>In
			 general</header><text>Not later than 90 days after the date on which the
			 Secretary selects the covered area, the Secretary shall establish an
			 advisory
			 panel—</text><paragraph id="IDc8d06807272e4aae8ceccd65af3854a1"><enum>(1)</enum><text>to be known as
			 the <term>Eastside Forest Scientific and Technical Advisory Panel</term>;
			 and</text></paragraph><paragraph id="ID8312616ba7f44c2c9cc87f11fd30b260"><enum>(2)</enum><text>to advise the
			 Secretary, collaborative groups, and the public regarding the development
			 and
			 implementation of—</text><subparagraph id="IDf0d14595592e419c828e13b8978fb367"><enum>(A)</enum><text>goals to improve
			 forest health, watershed health, and related social and economic goals in
			 the
			 covered area; and</text></subparagraph><subparagraph id="IDaa56ccdecc294728bdf7e24c503c4126"><enum>(B)</enum><text>projects needed
			 to accomplish the purposes of this Act.</text></subparagraph></paragraph></subsection><subsection id="ID4553a5f29c544c7db8b45de484d96db4"><enum>(b)</enum><header>Composition</header><text>The
			 advisory panel shall be composed of 9 members, each of whom shall have
			 expertise in 1 or more of the following:</text><paragraph id="ID61165cb668ad420987b938c25c137b00"><enum>(1)</enum><text>Silviculture.</text></paragraph><paragraph id="IDdb911c37c4ce4c68800214f22526021c"><enum>(2)</enum><text>Timber
			 economics.</text></paragraph><paragraph id="IDd4e247e3711b48088846ae0697592e61"><enum>(3)</enum><text>Road and logging
			 engineering.</text></paragraph><paragraph id="ID28c210b205264b669c38df2fb6ced859"><enum>(4)</enum><text>Soil science and
			 geology.</text></paragraph><paragraph id="ID5c37ada99e4c4746a3e297d74679341f"><enum>(5)</enum><text>Ecosystem
			 services or natural resources economics.</text></paragraph><paragraph id="ID36b825de10594f70af7ee9e4e886b059"><enum>(6)</enum><text>Community
			 economics or ecosystem workforce development.</text></paragraph><paragraph id="IDe7641f0aab13459f8cdf274ea1ac881e"><enum>(7)</enum><text>Forest
			 ecology.</text></paragraph><paragraph id="ID542cde3596ab46a3b12dd6aad100430e"><enum>(8)</enum><text>Aquatic and
			 riparian ecology.</text></paragraph><paragraph id="ID5f6816a8b7dd4d34ba47e8d0dbeea12f"><enum>(9)</enum><text>Wildlife
			 ecology.</text></paragraph><paragraph id="id130dc1bd488246ebae7a184a34ed2250"><enum>(10)</enum><text>Fish

			 control and eradication.</text></paragraph><paragraph id="IDb73ce533d84f4b58b5b1d85bd5d740e9"><enum>(13)</enum><text>Wildland
			 fire.</text></paragraph><paragraph id="ID1ba9533c91f1422c98f68c8081312bd5"><enum>(14)</enum><text>Hydrology.</text></paragraph><paragraph id="ID602bf41db8d44bb3a9137079807a3bb4"><enum>(15)</enum><text>Forest carbon
			 life-cycle and sequestration.</text></paragraph><paragraph id="IDf483ca61669249f9b5a2fac9582de6cf"><enum>(16)</enum><text>Social
			 science.</text></paragraph></subsection><subsection id="ID05821f9fd63b4767a47682c8ae10e7fc"><enum>(c)</enum><header>Appointments</header><text>The
			 Secretary shall—</text><paragraph id="IDd7dd0ce0f3a94426938afa09a075bac2"><enum>(1)</enum><text>ensure that the
			 advisory panel includes experts in a broad array of the fields described
			 in
			 subsection (b); and</text></paragraph><paragraph id="ID521a6d1992424a5b8f6369f391b574f2"><enum>(2)</enum><text>give
			 consideration to the recommendations of institutions of higher education
			 (as
			 defined in section 101(a) of the Higher Education Act of 1965 (20 U.S.C.
			 1001(a))), professional societies, and other interested organizations and
			 persons.</text></paragraph></subsection><subsection id="IDbc2d2dbfd6e049b5a7a4951549223f6e"><enum>(d)</enum><header>Duties</header><paragraph id="ID4d36443bbf1148a79e513b95f373002d"><enum>(1)</enum><header>Recommendations
			 report</header><subparagraph id="IDf5f93f041e1448e3a34f6fb6d78e17e2"><enum>(A)</enum><header>In
			 general</header><text>Not later than 180 days after the date on which the
			 Secretary appoints the members of the advisory panel, the advisory panel,
			 after
			 considering the best available science and information, shall submit to
			 the
			 Secretary and make available to the public a report that contains
			 recommendations regarding the manner by which the Secretary may best
			 achieve
			 the purposes and goals and consider the opportunities described in section
			 4(b).</text></subparagraph><subparagraph id="ID10d1249f95b44a42bc43e0ff343870ab"><enum>(B)</enum><header>Requirements</header><text>The
			 report shall provide recommendations based on the best available
			 science—</text><clause id="IDdc48bd49198846b0be2253327fe450f2"><enum>(i)</enum><text>for
			 the size and scope of projects needed to accomplish the goals and consider
			 the
			 opportunities described in section 4(b);</text></clause><clause id="ID5f9c70d848ac4aef80b4eec9d532e5d5"><enum>(ii)</enum><text>for increasing
			 local capacity to accomplish the goals and consider the opportunities
			 described
			 in section 4(b);</text></clause><clause id="id82aab0db867e4b38b259c2b18d5e967a"><enum>(iii)</enum><text>for
			 hydrologically and ecologically restoring land and water by—</text><subclause id="id13a79659457c4add8d1f1f0d2a91148c"><enum>(I)</enum><text>decommissioning
			 unnecessary and undesirable roads; and</text></subclause><subclause id="id6f802fa6b2aa442c85e8afab85d171d0"><enum>(II)</enum><text>reducing the
			 environmental impact of necessary and desirable roads; and</text></subclause></clause><clause id="ID90ab8513ba7c49b485d48486b1f60a66"><enum>(iv)</enum><text>for each
			 relevant plant association group—</text><subclause id="IDb039344669404b89990dfd2ddadd300f"><enum>(I)</enum><text>for protecting
			 and restoring terrestrial, aquatic, riparian, wildlife, fish, vegetation,
			 soil,
			 carbon, and other resources;</text></subclause><subclause id="IDfb1454a737124ae1985a00e561ed776d"><enum>(II)</enum><text>for the types of
			 activities necessary and desirable to restore forest health and watershed
			 health (including thinning, prescribed, and natural fire, and other
			 appropriate
			 activities);</text></subclause><subclause id="ID1f0c5885ec0c4a38a02a8268e413fd99"><enum>(III)</enum><text>for cases in
			 which the cutting or removal of trees described in section 4(e)(1) would
			 generally be considered to be ecologically appropriate; and</text></subclause><subclause id="ID4742571ef8fc4293aca659a2f7843abe"><enum>(IV)</enum><text>for cases in
			 which the cutting or removal of trees described in section 4(e)(2)(C)
			 would
			 generally be considered to be ecologically appropriate.</text></subclause></clause></subparagraph><subparagraph id="IDbfcf365f3afb486084c91a2e4e64df94"><enum>(C)</enum><header>Administration</header><clause id="ID159b0d7d19fe47e3827154fb841db8de"><enum>(i)</enum><header>In
			 general</header><text>To the maximum extent practicable, the advisory panel
			 shall achieve a consensus with respect to each recommendation included in
			 the
			 report.</text></clause><clause id="ID460d8f4e75b941138a700ac00668d71c"><enum>(ii)</enum><header>Inclusion of
			 dissenting opinions</header><text>If the advisory panel fails to achieve a
			 consensus with respect to any recommendation included in the report, the
			 report
			 shall include each dissenting opinion relating to the recommendation.</text></clause></subparagraph></paragraph><paragraph id="IDe6be9b8ccd534c6ea58e974211da881d"><enum>(2)</enum><header>Review
			 report</header><text>Not later than 5 years after the date on which the
			 Secretary appoints the members of the advisory panel, the advisory panel
			 shall
			 submit to the Secretary and make available to the public a report
			 providing—</text><subparagraph id="IDb5f12e327d484289b85815921d2ebd6e"><enum>(A)</enum><text>a quantitative
			 and qualitative assessment of the status of, and changes to, forest health
			 and
			 watershed health in the covered area, including the resiliency, aquatic
			 function, and plant composition, structure, and function; and</text></subparagraph><subparagraph id="IDd6bc343bfc1146c798f94074e7e322cd"><enum>(B)</enum><text>an assessment of
			 the implementation of the recommendations made under paragraph (1).</text></subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID92df6fafbfe845aba179676cd12c82e2" reported-display-style="strikethrough"><enum>7.</enum><header>Ecological
			 restoration projects</header><subsection id="ID75ddaf43ac3a49ba91d78ba73c7d235a"><enum>(a)</enum><header>In
			 general</header><text>As soon as practicable after the date on which the
			 Secretary selects the covered area, the Secretary shall, considering the
			 opportunities described in section 4(b)(2), implement ecological
			 restoration
			 projects in the covered area to further the goals described in section
			 4(b).</text></subsection><subsection id="IDd43c8142dc1b4058b188ae19bcb3d219"><enum>(b)</enum><header>Landscape-Scale
			 projects</header><text>Subject to the availability of appropriations in
			 accordance with section 12, the Secretary shall, to the maximum extent
			 practicable, implement 1 or more ecological restoration projects with a
			 gross
			 planning area of 50,000 acres for each National Forest in the covered area
			 that
			 provide landscape-scale work within a watershed area not later than 3
			 years
			 after the date on which the Secretary selects the covered area.</text></subsection><subsection id="ID0fbe4b6be85044d1ac6f19c6d645da8d"><enum>(c)</enum><header>Requirements</header><text>In
			 developing and implementing ecological restoration projects under this
			 section,
			 the Secretary shall consider—</text><paragraph id="ID707cd03c8b904028a9ec309098033064"><enum>(1)</enum><text>the best
			 available science and data;</text></paragraph><paragraph id="IDc5d112621d594fe1b6a7b858b1c49220"><enum>(2)</enum><text>the
			 recommendations of the advisory panel; and</text></paragraph><paragraph id="ID1b1b7d85498c45bea6d9ba6c7dcb8026"><enum>(3)</enum><text>the views of the
			 relevant collaborative groups.</text></paragraph></subsection><subsection id="IDc39989ca5a6d4bf5baa00fa237a92846"><enum>(d)</enum><header>Net road
			 reduction</header><text>In developing ecological restoration projects under
			 this Act, the Secretary shall examine opportunities for, and achieve, a
			 net
			 reduction in the permanent road system to improve forest and watershed
			 health
			 to the maximum extent practicable.</text></subsection><subsection id="IDac19fe5b9d6246548432b32d7d82ace3"><enum>(e)</enum><header>Prioritization</header><paragraph id="ID262b591e7c184b41a45e50d4f555c512"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall prioritize ecological restoration
			 projects in the covered area considering the requirements in subsection
			 (c) and
			 based on the degree to which the ecological restoration projects would
			 improve
			 forest health and watershed health, based on—</text><subparagraph id="ID741a5582440c4242b3fe835bb9e4563d"><enum>(A)</enum><text>dry and moist
			 forest plant association groups; and</text></subparagraph><subparagraph id="IDd7f352277a5646fbbe8a537440f56ca2"><enum>(B)</enum><text>the need to
			 sustain adequate levels of industry infrastructure to accomplish the goals
			 described in section 4(b).</text></subparagraph></paragraph><paragraph id="ID001a37b600cc4ffbb5b1b653956f8eb3"><enum>(2)</enum><header>Inclusions</header><text>In
			 carrying out this section, the types of projects the Secretary shall
			 consider
			 to be priority projects include projects that—</text><subparagraph id="IDb899d110289e45428b45e555d8866de6"><enum>(A)</enum><text>reduce the risk
			 of, and increase the resistance and resiliency of the land to,
			 uncharacteristic
			 disturbances, particularly if critical components or values are at risk,
			 including—</text><clause id="ID58c1682a4939452c8dfacbdcca2e807e"><enum>(i)</enum><text>communities
			 located in the wildland-urban interface (as defined in section 101 of the
			 Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>)); and</text></clause><clause id="ID44a5c8424bc34e018f79fb5b0e8ba7b5"><enum>(ii)</enum><text>valuable forest
			 structures (including old growth and older mature trees);</text></clause></subparagraph><subparagraph id="ID134c3e66c99a49729de6fae29b51d7b7"><enum>(B)</enum><text>restore the
			 structure and composition of forest stands at a high or moderate departure
			 from
			 the historic range of variability;</text></subparagraph><subparagraph id="ID7622dfc9cf0d44e7ba2253d76eab2764"><enum>(C)</enum><text>accelerate the
			 development of complex forest structure in a young forest that has been
			 simplified through past management, such as by—</text><clause id="IDfc288b8579654bbbab7cd6856d687370"><enum>(i)</enum><text>creating spatial
			 heterogeneity (including the creation of skips and gaps) using mechanical
			 treatments to create wildlife habitat; and</text></clause><clause id="ID0c123a4c506a45dd8d442645db0ddb30"><enum>(ii)</enum><text>retaining
			 biological legacies (including large standing, downed, live, and dead
			 trees);</text></clause></subparagraph><subparagraph id="ID51e254fdc049415e820295110be5026d"><enum>(D)</enum><text>assist in the
			 implementation of community wildfire protection plans developed by at-risk
			 communities (as those terms are defined in section 101 of the Healthy
			 Forests
			 Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>));</text></subparagraph><subparagraph id="ID857d06affec0446f82224baf735d1333"><enum>(E)</enum><text>use the value of
			 merchantable sawlogs and biomass to help offset the cost of ecological
			 restoration projects;</text></subparagraph><subparagraph id="ID39bb23b9de6d4e709fc6b9587ebe84a6"><enum>(F)</enum><text>meet local and
			 rural community needs through a source that is selected on a best-value
			 basis;
			 and</text></subparagraph><subparagraph id="ID54e61da4565b4d63a4b05e2609404bbb"><enum>(G)</enum><text>reduce the
			 permanent road system to improve forest health and watershed health.</text></subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID48f3761aab2147f680e7202981fd4d90" reported-display-style="strikethrough"><enum>8.</enum><header>Collaboration</header><subsection id="ID10907534f7b84f01a390ebd2786b5e27"><enum>(a)</enum><header>Collaborative
			 groups</header><paragraph id="ID2b55f7fc48d0484dabaf3e166d6c249f"><enum>(1)</enum><header>In
			 general</header><text>To assist in the development of the projects needed to
			 accomplish the purposes of this Act in the covered area, the Secretary
			 shall
			 consult with, and consider the recommendations of, any collaborative group
			 that
			 meets the criteria described in paragraph (2).</text></paragraph><paragraph id="ID6effddf2cfb34669a99d4db90a490906"><enum>(2)</enum><header>Collaborative
			 groups</header><text>A collaborative group under paragraph (1) means a group
			 that—</text><subparagraph id="IDc6e7915415044c439056bdceb3e91146"><enum>(A)</enum><text>is interested in
			 the implementation of this Act;</text></subparagraph><subparagraph id="ID7e4c1b58cb1343e2855dd444f17935da"><enum>(B)</enum><text>includes multiple
			 individuals representing diverse interests that include—</text><clause id="IDb736a84382184701af5a6f2b33f62a6e"><enum>(i)</enum><text>environmental
			 organizations;</text></clause><clause id="ID0bffdd5db5c4450e9a3012b605ce4856"><enum>(ii)</enum><text>timber and
			 forest products industry representatives; and</text></clause><clause id="ID39561da4730a4cbfa339c50f0d9a4885"><enum>(iii)</enum><text>county
			 governments;</text></clause></subparagraph><subparagraph id="ID217355d131e0433b81de287547b8b070"><enum>(C)</enum><text>operates—</text><clause id="IDee6b5968546e42efb9d234b1f766e09c"><enum>(i)</enum><text>in
			 a transparent and nonexclusive manner; and</text></clause><clause id="ID0f4056971bdd450d931c66881ec5b868"><enum>(ii)</enum><text>by
			 consensus or in accordance with voting procedures to ensure a high degree
			 of
			 agreement among participants and across various interests; and</text></clause></subparagraph><subparagraph id="ID3b59cb30870948de941ee65147f615ba"><enum>(D)</enum><text>requires a level
			 of participation sufficient to ensure that members of the collaborative
			 group
			 are adequately informed before each decision.</text></subparagraph></paragraph></subsection><subsection id="IDa698890d0e6b42c18972d4f94491c8ae"><enum>(b)</enum><header>Multiparty
			 monitoring</header><text>The Secretary, in consultation with the relevant
			 collaborative groups, may develop a multiparty monitoring plan for any
			 vegetation management project carried out under this Act.</text></subsection></section><section changed="deleted" committee-id="SSEG00" id="id01c074592be7457097d219036f91848c" reported-display-style="strikethrough"><enum>9.</enum><header>Large scale
			 environmental impact statement</header><subsection id="idc4cf253fd7084fd59f63e0d7da8464ed"><enum>(a)</enum><header>Congressional
			 finding</header><text>Congress finds that it is expected that the environmental
			 impact statement described in subsection (b) would be adequate to support
			 the
			 requirements of the National Environmental Policy Act of 1969 (42 U.S.C.
			 4321
			 et seq.) for projects implemented under this section, as documented in
			 subsequent agency decision documents.</text></subsection><subsection id="id3f60023245714822b5221a7b5a541182"><enum>(b)</enum><header>Requirements</header><text>The
			 Secretary shall prepare a large scale environmental impact statement that
			 is
			 adequate under the National Environmental Policy Act of 1969 (42 U.S.C.
			 4321 et
			 seq.) to support a record of decision for vegetation management projects
			 under
			 this section in National Forests in the eastern part of the State for
			 projects—</text><paragraph id="id365782f9dcf0482cb91b61a0411924c1"><enum>(1)</enum><text>that are located
			 wholly in dry ponderosa pine and dry mixed conifer forests types;</text></paragraph><paragraph id="id7635c92d1877404183c99ed2a6901c9c"><enum>(2)</enum><text>that are located
			 on a pilot landscape;</text></paragraph><paragraph id="id9716f01fba6047f18c65230d6addd804"><enum>(3)</enum><text>that are endorsed
			 by or the product of a collaborative group; and</text></paragraph><paragraph id="id4ee2c47f2a23471dba83c362e04592dc"><enum>(4)</enum><text>no portion of
			 which are located in an inventoried roadless area.</text></paragraph></subsection><subsection id="ide208c515fe7a47aa9ed12bd7bcd02034"><enum>(c)</enum><header>Completion
			 date</header><text>The Secretary shall complete the record of decision for the
			 large scale environmental impact statement under subsection (b) not later
			 than
			 1 year after the date of enactment of this Act.</text></subsection><subsection commented="no" id="id12198fff986a4bd68334ed2ada64aaa1"><enum>(d)</enum><header>Timeliness</header><text>Any
			 legal challenge to the environmental impact statement and record of
			 decision
			 under this section shall be filed not later than 120 days after the record
			 of
			 decision is signed by the Secretary.</text></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID78b57cc4e5a14520be47ffb07ebe93a2" reported-display-style="strikethrough"><enum>10.</enum><header>Cooperative
			 partnership</header><subsection id="id0bc11426f09240a99e986221564dcf75"><enum>(a)</enum><header>Forest
			 planning</header><text>Section 327(b)(2) of the Department of the Interior and
			 Related Agencies Appropriations Act, 1996 (<external-xref legal-doc="usc" parsable-cite="usc/16/1611">16 U.S.C. 1611</external-xref> note; Public Law
			 104–134) is amended by inserting after <quote>may include</quote> the
			 following: <quote>expenditures for forest planning activities necessary for
			 timber sales for projects that are on a pilot landscape (as defined in
			 section
			 3 of the Oregon Eastside Forests Restoration, Old Growth Protection, and
			 Jobs
			 Act of 2013) and </quote>.</text></subsection><subsection id="id3edee9c5f5324eb9bbd05eed471157d9"><enum>(b)</enum><header>Cooperative
			 forest innovation partnership projects</header><text>Section 13B of the
			 Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2109b">16 U.S.C. 2109b</external-xref>) is amended
			 by
			 adding at the end the following:</text><quoted-block changed="deleted" committee-id="SSEG00" display-inline="no-display-inline" id="id2248F93700F64886BD0F0611BC18B1EB" reported-display-style="strikethrough" style="OLC"><subsection id="id2FDAE43D12F94BD8B0865BB406F8FE70"><enum>(d)</enum><header>Regulations</header><text>Not

				Restoration, Old Growth Protection, and Jobs Act of 2013, the
			 Secretary shall
				promulgate regulations to implement the authority of the Secretary
			 under that
				Act.</text></subsection><subsection id="id4e9e8773eed34ab09bafb7325c1ea1f8"><enum>(e)</enum><header>Cooperation
				with State governments</header><paragraph id="idCE699477D9A94AA694A11E90D0142E0A"><enum>(1)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				the Oregon Eastside Forests Restoration, Old Growth Protection, and
			 Jobs Act of
				2013, the Secretary shall carry out a project to support the
			 ability of the
				Department of Agriculture to address the restoration of forests in
			 cooperation
				with States.</text></paragraph><paragraph id="id2449fd8a71774832a898b4aee893357a"><enum>(2)</enum><header>Eligible
				areas</header><text>A project under paragraph (1) may be carried out on a pilot
				landscape (as defined in section 3 of the Oregon Eastside Forests
			 Restoration,
				Old Growth Protection, and Jobs Act of 2013).</text></paragraph><paragraph id="iddd845781dd4341699ae1a165ca4dfae5"><enum>(3)</enum><header>Funding</header><text>The
				Secretary shall use not more than 5 percent of the funds for the <term>Forest
				Health-Federal Lands</term> budget line item made available under the State and
				Private Forestry appropriation to pay not more than 50 percent of
			 the total
				cost of carrying out a project under paragraph
				(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section changed="deleted" committee-id="SSEG00" id="id55B2A23F25024DD596CB968B3E61A583" reported-display-style="strikethrough"><enum>11.</enum><header>Administration</header><subsection id="ID55ab90bf7bdd41af847beb8f34cccf21"><enum>(a)</enum><header>Effect</header><text>Nothing
			 in this Act affects—</text><paragraph id="ID9279f5dad3ac48d487d8a41c504cbfef"><enum>(1)</enum><text>any right
			 described in a treaty between an Indian tribe and the United States; or</text></paragraph><paragraph id="IDb2e5371f1d9a410cb51f63b796141a4d"><enum>(2)</enum><text>any biological
			 opinion, including any opinion associated with the aquatic and riparian
			 protection requirements of applicable land and resource management
			 plans.</text></paragraph></subsection><subsection id="id96797025cfe24c44b4f8c6a7468deb03"><enum>(b)</enum><header>No retroactive
			 effect during transition</header><paragraph id="id754b7cd0513249e188b0c3f759168f73"><enum>(1)</enum><header>Vegetation
			 management projects</header><text>The provisions of this Act shall not apply to
			 a vegetation management project that is—</text><subparagraph id="idc75ffa39133e4b879c712dbe6624c427"><enum>(A)</enum><text>initiated, either
			 through a scoping notice or a notice of intent, more than 180 days before
			 the
			 date on which the Secretary selects the covered area under section
			 4(a)(1);
			 or</text></subparagraph><subparagraph id="idc98d85c1b3944736bdb5c35685248647"><enum>(B)</enum><text>approved or under
			 contract before the date on which the Secretary selects the covered area
			 under
			 section 4(a)(1).</text></subparagraph></paragraph><paragraph id="id982d24b109d441738b9bff926ff619ec"><enum>(2)</enum><header>Recommendations
			 report</header><text>The completion of the Eastside Scientific and Technical
			 Advisory Panel recommendations report shall not automatically compel an
			 amendment or revision of any vegetation management project initiated,
			 approved,
			 or under contract before the date on which the recommendations report is
			 completed.</text></paragraph><paragraph id="idfb0eb3d735d34234baa517454b10d809"><enum>(3)</enum><header>Forest
			 plans</header><text>The completion of the Eastside Scientific and Technical
			 Advisory Panel recommendations report shall not automatically compel an
			 amendment or revision of any existing forest plan.</text></paragraph></subsection><subsection id="ID04fc494bb1654a4f9bb1b943b730814c"><enum>(c)</enum><header>Applicable
			 law</header><text>The Secretary shall carry out this Act in accordance with
			 applicable law (including regulations).</text></subsection><subsection id="ID806cfbfccf3c467d8f4ce6babbcefad9"><enum>(d)</enum><header>Principal
			 agency contact</header><paragraph id="IDe1904e236dbf4afea6c20cacc565647e"><enum>(1)</enum><header>Selection</header><text>The
			 Secretary shall select a principal agency contact for the implementation
			 of
			 this Act.</text></paragraph><paragraph id="IDf15e7f935fd34a5fb28399a13cf3e307"><enum>(2)</enum><header>Duties</header><text>The
			 principal agency contact shall—</text><subparagraph id="ID3b63b8428fea4e8a9e17bdf3d96d3fac"><enum>(A)</enum><text>serve as the
			 point-of-contact for the advisory panel; and</text></subparagraph><subparagraph id="IDd2a4087856bd4a75a3951b3ceb4b4941"><enum>(B)</enum><text>facilitate
			 communications among—</text><clause id="IDc78adb7319904260868e35d64a811294"><enum>(i)</enum><text>the
			 advisory panel;</text></clause><clause id="IDbdeef679b54d44a28485a8b0ddbd769b"><enum>(ii)</enum><text>collaborative
			 groups;</text></clause><clause id="ID25b2648ffe0448728a5b684a94bbcbbb"><enum>(iii)</enum><text>employees of
			 the Forest Service; and</text></clause><clause id="IDe5b5e809f3da44b39efdfeedfdf0a58d"><enum>(iv)</enum><text>any other
			 stakeholders (including the public).</text></clause></subparagraph></paragraph></subsection><subsection id="ID7e29eb2f52e842f5afeeb355bfeb7a3e"><enum>(e)</enum><header>Reporting</header><paragraph id="ID36e37301e28e4cd8ba862e5d9f61ef6f"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall prepare a report on the
			 implementation of this Act—</text><subparagraph id="ID0b3e2391ae254c3aab466cc058c448b5"><enum>(A)</enum><text>not later than 5
			 years after the date on which the Secretary selects the covered area;
			 and</text></subparagraph><subparagraph id="ID93a96cf7ef52408193e3f9542cdb160b"><enum>(B)</enum><text>2 years before
			 the date referred to in subsection (e)(1).</text></subparagraph></paragraph><paragraph id="IDaccc49d17f684762b247e296c375c087"><enum>(2)</enum><header>Contents</header><text>The
			 reports required under paragraph (1) shall, for each National Forest in
			 the
			 covered area, assess the progress toward accomplishing—</text><subparagraph id="ID8fdb9042b22142ebbac40d0da3b5000b"><enum>(A)</enum><text>the purposes of
			 this Act; and</text></subparagraph><subparagraph id="IDb719f66f2f9b4655beffd3c3de0adb15"><enum>(B)</enum><text>the performance
			 goals established under section 4(d).</text></subparagraph></paragraph></subsection><subsection id="IDa899574b341741a4a307fda3f0b4b23b"><enum>(f)</enum><header>Termination of
			 authority</header><paragraph id="ID93f97777e79b4965a74f69228f3449c4"><enum>(1)</enum><header>In
			 general</header><text>The authorities under this Act (other than the
			 authorities under sections 4(e) and 5(c)) shall terminate on the date that
			 is
			 15 years after the date of enactment of this Act.</text></paragraph><paragraph id="IDae703cbeb5a04f85b638d63800a12be3"><enum>(2)</enum><header>Effect</header><text>Nothing
			 in this subsection affects a valid contract in effect on the date
			 described in

			 amounts appropriated to the Secretary under subsection (a) may be used to
			 support implementation of any cost-sharing authorities provided by this

			 expended to carry out provisions of this Act that are not subject to a
			 cost-sharing requirement shall not reduce the allocations of appropriated
			 funds

			 panel</header><text>The term <term>advisory panel</term> means the Eastside
			 Forest Scientific and Technical Advisory Panel established under section
			 105(a).</text></paragraph><paragraph id="id69682018-20b2-4124-a3b8-2496b5969286"><enum>(2)</enum><header>Collaborative
			 group</header><text>The term <term>collaborative group</term> means a group of
			 individuals that meets the requirements of section 107(b).</text></paragraph><paragraph id="id02dc4492-7a59-4112-9731-1b74971ab8d0"><enum>(3)</enum><header>Covered
			 area</header><text>The term <term>covered area</term> means the national forests within the State that are not within the
			 area covered by the document entitled <quote>Record of Decision for Amendments to Forest Service and
			 Bureau of Land Management Planning Documents Within the Range of the
			 Northern
			 Spotted Owl</quote> and dated April 1994.</text></paragraph><paragraph id="ide5fbae359576489581a020902a75c959"><enum>(4)</enum><header>Forest health</header><text>The term <term>forest health</term> means conditions that enable a forest to be resistant and resilient to disturbance events and to
			 support natural ecosystem and hydrologic processes, functions, and
			 structures, including viable populations of native wildlife and ecosystem
			 services.</text></paragraph><paragraph commented="no" id="idbdd67514-2934-4fdb-81c9-7732e363879b"><enum>(5)</enum><header>Inventoried
			 roadless area</header><text>The term <term>inventoried roadless area</term>
			 means 1 of the areas identified in the set of inventoried roadless area
			 maps
			 contained in the document entitled <quote>Forest Service Roadless Areas Conservation, Final
			 Environmental Impact Statement, Volume 2</quote> and dated November 2000.</text></paragraph><paragraph id="id36ffba15-fa35-4406-b6b1-bae7f237255d"><enum>(6)</enum><header>National
			 Forest System</header><text>The term <term>National Forest System</term> has
			 the meaning given the term in section 11(a) of the Forest and Rangeland
			 Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="idb771270e-3202-4b1b-805d-904201c8481e"><enum>(7)</enum><header>Plant
			 association group</header><subparagraph id="id837b7933-369b-4aac-9e6f-da518ca09c76"><enum>(A)</enum><header>In
			 general</header><text>The term <term>plant association group</term> means a
			 description of a plant community that—</text><clause id="id847403a3-e6be-42b6-a1df-ed779d9f4162"><enum>(i)</enum><text>would
			 potentially, in the absence of a disturbance, occupy a site; and</text></clause><clause id="idad031618-786d-4e2f-9161-68a9a1e2c09a"><enum>(ii)</enum><text>may be
			 aggregated into 1 or more groups based on similarities in plant species,
			 composition, environment, and productivity.</text></clause></subparagraph><subparagraph id="id243357d7-c69d-417a-b3c3-8d5fbecafd2f"><enum>(B)</enum><header>Inclusion</header><text>The
			 term <term>plant association group</term> includes, with respect to a forested site,
			 species representing tree, shrub, and herbaceous layers.</text></subparagraph></paragraph><paragraph id="id2b4aa821-750a-457e-bf12-a309c50d4663"><enum>(8)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture (acting through
			 the Chief of the Forest Service).</text></paragraph><paragraph id="id2a665bf0f85b47ac84052b5022d0ed3b"><enum>(9)</enum><header>Spatial heterogeneity</header><text>The term <term>spatial heterogeneity</term> means trees and other structural elements of the forest landscape that have a nonuniform,
			 diversely clustered spatial arrangement.</text></paragraph><paragraph id="id410d771d-60d4-48c8-96cd-e3a47213da03"><enum>(10)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Oregon.</text></paragraph><paragraph id="id795f5120c27c4cdab64fb83231c39d52"><enum>(11)</enum><header>Vegetation management project</header><subparagraph id="id470CFF4AE1EF4301AC387128055C6CF9"><enum>(A)</enum><header>In general</header><text>The term <term>vegetation management project</term> means a project involving activities that manipulate vegetation.</text></subparagraph><subparagraph id="idFDDF15B38B5644069C43B7C079B6B2DB"><enum>(B)</enum><header>Inclusions</header><text>The term <term>vegetation management project</term> includes—</text><clause id="idD4106DDE264D4165A7D141DBC12AD5CA"><enum>(i)</enum><text>ecological restoration or fuel reduction projects;</text></clause><clause id="idE75560672C554674A738DA23087ABEE9"><enum>(ii)</enum><text>harvesting timber;</text></clause><clause id="idB3DE223454DE43D684C8DACD468A6BAF"><enum>(iii)</enum><text>prescribed burning; and</text></clause><clause id="id0B464F27CB624078AD7EEEBA175EF36C"><enum>(iv)</enum><text>thinning trees, brush, weeds, or grass.</text></clause></subparagraph></paragraph><paragraph id="idfaa27281-b247-4054-a638-6701ff1b6984"><enum>(12)</enum><header>Watershed
			 area</header><text>The term <term>watershed area</term> means 1 or more
			 subwatersheds (also known as 6th code hydrologic units).</text></paragraph><paragraph id="idb5df71a3-565b-4361-938f-2729c473a170"><enum>(13)</enum><header>Watershed
			 health</header><text>The term <term>watershed health</term> means the range of landscape conditions that enable riparian, aquatic, and wetland ecosystems to
			 create and sustain functional habitats capable of supporting diverse
			 populations of native aquatic- and riparian-dependent species.</text></paragraph></section><section id="ida2c5f769-4f7a-49b2-86f8-b460a3f00a0d"><enum>102.</enum><header>Forest
			 management</header><subsection id="idc88d8e35-61fa-49e7-b0cb-7d1ae7df1cfa"><enum>(a)</enum><header>Application</header><text>The Secretary shall implement this title in the covered area during the 15-year period beginning on
			 the date of enactment of this Act.</text></subsection><subsection id="idcaf416db-e4af-416b-96f7-91d6e2d8a014"><enum>(b)</enum><header>Land management
			 goals</header><paragraph id="id984ab654-6808-4ff7-9dd8-9373947f36bb"><enum>(1)</enum><header>In
			 general</header><text>Taking into consideration the best available science, the Secretary shall seek in the covered area—</text><subparagraph id="idd97985ba-a08d-4a43-9d1d-a7efa9c5787b"><enum>(A)</enum><text>to conserve and
			 restore forest and watershed health;</text></subparagraph><subparagraph id="id8c7dfa31-024d-4083-8849-789f62b90dca"><enum>(B)</enum><text>to reduce the
			 risk of, and increase the resistance and resiliency of the land to,
			 uncharacteristic disturbances;</text></subparagraph><subparagraph id="id83765142-6527-4cb8-bba2-7d5f8b061b3e"><enum>(C)</enum><text>to allow for
			 characteristic natural disturbances; and</text></subparagraph><subparagraph id="id74d228e6-dc4a-445a-94bb-573d02b0cdf1"><enum>(D)</enum><text>to harvest wood
			 to maintain the appropriate scale of industry infrastructure to accomplish
			 the goals
			 described in subparagraphs (A), (B), and (C).</text></subparagraph></paragraph><paragraph id="id0f9b0179-4f30-4229-a893-9d3b82dca7ce"><enum>(2)</enum><header>Forest
			 management</header><text>To achieve the goals of paragraph (1) in the forested
			 land in the covered area, the Secretary shall consider opportunities—</text><subparagraph id="id8e9e373e-196a-4029-8a5c-806f874e723d"><enum>(A)</enum><text>to reduce the
			 basal area in overstocked forest stands;</text></subparagraph><subparagraph id="id805581a1-fe9f-4ca0-b56f-db8bdfd560e8"><enum>(B)</enum><text>to increase the
			 mean diameter of forest stands;</text></subparagraph><subparagraph id="id927dca05-6e9e-447b-a0d6-13c6a48f22c2"><enum>(C)</enum><text>to maintain or
			 create a forest composition that focuses on more fire- and
			 drought-tolerant
			 species;</text></subparagraph><subparagraph id="id37bb118d-662f-46a7-8f2a-a77509b4247a"><enum>(D)</enum><text>to restore
			 historic levels of within-forest stand spatial heterogeneity;</text></subparagraph><subparagraph id="id00d21ddb-8fa7-4ae8-8304-372c2126b874"><enum>(E)</enum><text>to conserve and
			 restore old growth;</text></subparagraph><subparagraph id="id85036fdb-f87e-4445-9e92-98270d0bf730"><enum>(F)</enum><text>to conserve and
			 restore population levels of older trees;</text></subparagraph><subparagraph id="idf939f33e-1095-426f-9497-4e7cb62ec072"><enum>(G)</enum><text>to conserve and
			 restore ecologically sustainable forest stands and landscapes to
			 incorporate
			 characteristic forest stand structures and older tree populations;</text></subparagraph><subparagraph id="id3e553abf-8c2e-4433-a20b-16b0526a6567"><enum>(H)</enum><text>to harvest wood
			 and use the value of merchantable sawlogs and biomass to help offset the
			 cost
			 of improving forest health and watershed health;</text></subparagraph><subparagraph id="idfe762c5b-ca66-4e28-8bed-eab7c10dc1ad"><enum>(I)</enum><text>to restore or
			 maintain sustainable and fire-resilient conditions in perpetuity through
			 active
			 management (including management through prescribed or wildland fire and
			 mechanical treatments);</text></subparagraph><subparagraph id="id9ccb3906-9be0-45a7-a292-8c00149502be"><enum>(J)</enum><text>to restore or
			 maintain ecologically appropriate spatial complexity (including a range of
			 open
			 to dense forest patches at scales from the forest stand to the
			 landscape);</text></subparagraph><subparagraph id="id8afefd06-7d96-40b8-95c0-64ba1dfefe0b"><enum>(K)</enum><text>to conduct vegetation management projects that create an uneven-aged mosaic of isolated individual
			 trees, clumps of trees, and openings to enhance the spatial heterogeneity
			 of the forest landscape;</text></subparagraph><subparagraph id="id4025617c881d40c89ed97327e1875667"><enum>(L)</enum><text>to restore or maintain understory plant communities that reflect a composition and condition that
			 is appropriate for the forest type, including native ground cover and
			 limiting exotic and invasive species;</text></subparagraph><subparagraph id="id159d9566-8c37-47fd-bcfe-1a46c37ca485"><enum>(M)</enum><text>to increase
			 stakeholder participation through collaborative groups; and</text></subparagraph><subparagraph id="id0726a4e1110d4a53a0f06b50cf59eb9c"><enum>(N)</enum><text>to restore and maintain the historic complement of aspen, willows, and other native hardwoods in
			 riparian and upland ecosystems, including by—</text><clause id="id55500518fade458c80ae8eba8b028fa1"><enum>(i)</enum><text>removing conifers that have invaded hardwood sites and overtopped hardwoods or have invaded wet and
			 dry meadow systems;</text></clause><clause id="id3e79daaa4c624791802da1dfde77a39d"><enum>(ii)</enum><text>restoring fire to hardwood ecosystems; and</text></clause><clause id="idf78add4be5744025adf989f48b96fa5b"><enum>(iii)</enum><text>creating barriers around hardwood sites to reduce ungulate pressure.</text></clause></subparagraph></paragraph></subsection><subsection id="idc7dd855a-bc5c-4575-96b3-41de1f4e2ced"><enum>(c)</enum><header>Planning</header><text>To
			 achieve the goals described in subsection (b), the Secretary shall—</text><paragraph id="id084A227B2A30457E944AC9DA4C8DC4AB"><enum>(1)</enum><text>use
			 landscape-scale planning based on watershed boundaries as a tool to
			 implement
			 vegetation management and ecological restoration projects in the covered
			 area; and</text></paragraph><paragraph id="id65186C935480484B9BC8753E3BC1D9DC"><enum>(2)</enum><text>seek to achieve planning and implementation efficiencies on projects carried out under this title
			 by working with—</text><subparagraph id="id8DA802B66DD64995AB8D3986BC01D1BE"><enum>(A)</enum><text>the relevant collaborative group;</text></subparagraph><subparagraph id="idC4AE7EDFEED4418BA32FA80280C0FD7C"><enum>(B)</enum><text>the advisory panel; and</text></subparagraph><subparagraph id="id6C71C7F9A67D4A60B8D93B072EF2447D"><enum>(C)</enum><text>other partners.</text></subparagraph></paragraph></subsection><subsection id="id6ab528a27c90473e83a4819eb0828d6e"><enum>(d)</enum><header>Older tree retention</header><paragraph id="idd155635567bc4cddbd0f950eed2da0dc"><enum>(1)</enum><header>In general</header><text>In developing and implementing any project in the covered area, the Secretary shall—</text><subparagraph id="id99567AB093C04D53A2BA5D22B06485E7"><enum>(A)</enum><text>identify, based on the protocols developed under paragraph (2), trees that are 150 years of age or
			 older, as measured at breast height; and</text></subparagraph><subparagraph id="id06BBFFC8D6AE4A3F82E08689E9D1099A"><enum>(B)</enum><text>retain the trees described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idcf044294bd844b81abddab483b650586"><enum>(2)</enum><header>Protocol</header><text>The Secretary, in collaboration with the advisory panel, based on the best available science, shall
			 develop protocols for identifying trees that are 150 years of age or
			 older, as measured at breast height.</text></paragraph><paragraph id="id5cb4dd12670a426da04ac4ce2d4ebb04"><enum>(3)</enum><header>Exceptions</header><subparagraph id="id7915A362BBF84106A9FA80EA9631C17A"><enum>(A)</enum><header>In general</header><text>The retention objectives described in paragraph (1)(B) shall not apply if the Secretary determines
			 that 1 of the following applies:</text><clause id="idcdb1e71d54aa41f498e284594c2141f9"><enum>(i)</enum><header>Administrative exceptions</header><text>There is no reasonable alternative to the cutting or removal of trees that are 150 years of age or
			 older, as measured at breast height, to provide for public safety,
			 administrative necessity, or special uses, such as rights of way.</text></clause><clause id="ideaad8faf47b8451e9e509cd6cc49b59d"><enum>(ii)</enum><header>Restoration project exceptions</header><text>The Secretary determines that the cutting or removal of trees that are 150 years of age or older,
			 as measured at breast height, is needed to help implement and fund
			 restoration projects, subject to the conditions that—</text><subclause id="id142f4f1592684d6280fa62888e8a9430"><enum>(I)</enum><text>no tree that is 200 years of age or older, as measured at breast height, may be cut;</text></subclause><subclause id="id0ac10caffa564d559023ac874923e026"><enum>(II)</enum><text>only as many trees as are needed to fund restoration work that protects and enhances the resiliency
			 of trees that are 200 years of age or older, as measured at breast height,
			 may be cut;</text></subclause><subclause id="ida15fa334d659493bb3da63c8eb6cd820"><enum>(III)</enum><text>the removal of trees that are 150 years of age or older, as measured at breast height, and less
			 than 200 years of age, as measured at breast height, shall not exceed 50
			 percent of the population of those trees in the project area; and</text></subclause><subclause id="id59e30bb4dda249cba2ac25fbafd853cb"><enum>(IV)</enum><text>there would be sufficient old-growth tree replacements remaining in the project area.</text></subclause></clause></subparagraph><subparagraph id="id135c4dde84214faa90ff6197ce0c49b9"><enum>(B)</enum><header>Notice requirement</header><text>The Secretary shall provide to the public and collaborative groups notice and an opportunity to
			 comment before making a determination under subparagraph (A), unless the
			 Secretary determines that the cutting or removal of the tree is necessary
			 to respond to an emergency condition.</text></subparagraph></paragraph><paragraph id="idb42e2b588624459a9162c9ca96180479"><enum>(4)</enum><header>Application</header><text>The retention requirements of this subsection shall not—</text><subparagraph id="idECA4B8D6ACAD450FA04F435EE4105DDC"><enum>(A)</enum><text>apply to any other forests in the National Forest System outside of the covered area; or</text></subparagraph><subparagraph id="id6D398616C4A04438B758C9A701ABCB7A"><enum>(B)</enum><text>establish a precedent for setting age limits on trees that may be cut on any National Forest System
			 land.</text></subparagraph></paragraph></subsection><subsection id="id5fb4c42dffe34cfaadc5e673307ee16e"><enum>(e)</enum><header>Limitations on road construction</header><text>In carrying out any vegetation management project in the covered area, the Secretary—</text><paragraph id="idf7525e2334e04d9bbb6c5d6428c8e49a"><enum>(1)</enum><text>shall not construct any permanent road, unless the Secretary determines that the road is a
			 justifiable realignment of a permanent road to restore or improve the
			 ecological structure, composition, and function and the natural processes
			 of the affected forest or watershed; and</text></paragraph><paragraph id="id2a8235692d21422483a212743659f763"><enum>(2)</enum><text>by the earlier of the date on which the vegetation management project is completed and the date
			 that is 1 year after the activities for which the road was constructed are
			 complete, shall decommission any temporary road constructed to carry out
			 the vegetation management project.</text></paragraph></subsection><subsection id="idd48e7ab7828e4e56a41761544fa941a4"><enum>(f)</enum><header>Monitoring and adaptive management</header><text>In carrying out this title, the Secretary—</text><paragraph id="id822E44D223454772A16CB6D91AB47FDC"><enum>(1)</enum><text>shall ensure that the projects developed pursuant to this title include monitoring to inform an
			 assessment of the effectiveness of treatments and adaptive management of
			 future projects; and</text></paragraph><paragraph id="id4D80190988C94F39BBDEFC692BEB6ADF"><enum>(2)</enum><text>in consultation with the relevant collaborative groups, may develop for a vegetation management
			 project carried out under this title  a multiparty monitoring plan, which
			 shall take into consideration the recommendations of the advisory panel.</text></paragraph></subsection></section><section id="idD8E2C47A28C441528134A66BBE4A4898"><enum>103.</enum><header>Restoration goals</header><subsection id="id16e5c3ce-d046-4c7b-9e20-6ee2982c8762"><enum>(a)</enum><header>Performance
			 goals</header><paragraph id="idBA2F6366AFCA4C2DAEA66F8EFD87F89E"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date on which the
			 Secretary selects the covered area, the Secretary, in consultation with
			 the
			 relevant collaborative groups, may establish performance objectives, in
			 addition to
			 the goals established by section 102(b), which the Secretary shall seek
			 to achieve for the covered area, consistent with those goals and the
			 purposes of this title.</text></paragraph><paragraph id="id89218da5-9e5f-4c74-88e5-f83042b27ad9"><enum>(2)</enum><header>Term</header><text>Subject
			 to paragraph (4), each performance goal established under paragraph (1)
			 shall
			 be measured annually for a period of 15 years.</text></paragraph><paragraph id="id138bde34-110c-455e-bb4f-43f881bfdda1"><enum>(3)</enum><header>Additions</header><text>The
			 Secretary may develop additional performance goals that the Secretary
			 determines to be appropriate during the period established by paragraph
			 (2).</text></paragraph><paragraph commented="no" id="id1dbf64d0-2418-45f9-b889-dbaee98f47a9"><enum>(4)</enum><header>Prioritization</header><text>Subject
			 to the limitations described in section 110(c), the Secretary shall
			 prioritize
			 the vegetation management project and hazardous fuels reduction program
			 activities in
			 the covered area to achieve the performance goals established under this
			 subsection.</text></paragraph></subsection><subsection commented="no" id="id795a23d3-44de-428b-b3a5-ed26eb64dca8"><enum>(b)</enum><header> Restoration
			 goals</header><paragraph commented="no" id="id01026d03-cd86-4412-8b94-1bb3020aed6e"><enum>(1)</enum><header>In
			 general</header><text>Within the covered area, consistent with the goals, and
			 after considering the opportunities, described in subsection (a), the
			 Secretary
			 shall, to the maximum extent practicable, prepare, offer, and promptly
			 implement—</text><subparagraph commented="no" id="id3b37466d-fca6-4828-8346-1269be670d8a"><enum>(A)</enum><text>projects
			 that—</text><clause commented="no" id="id815bf8e0-ed71-4449-900c-6d4578a48752"><enum>(i)</enum><text>are predominantly
			 comprised of mechanical treatment in the covered area that emphasize
			 sawtimber
			 as a byproduct; and</text></clause><clause commented="no" id="id486689c5-6420-4997-9dc8-0a9a43aca787"><enum>(ii)</enum><text>are conducted
			 on—</text><subclause commented="no" id="id047d85cc-e93b-4497-aa67-be19097b9664"><enum>(I)</enum><text>for the first
			 fiscal year after the date of enactment of this Act, not less than 60,000
			 acres;</text></subclause><subclause commented="no" id="ida9d15ef3-964c-409c-8e5d-5942f3f0240c"><enum>(II)</enum><text>for the
			 subsequent fiscal year, not less than 80,000 acres; and</text></subclause><subclause commented="no" id="id8b6014b1-5a65-4d7b-807a-44fc21b114e4"><enum>(III)</enum><text>for each fiscal
			 year thereafter until the fiscal year in which at least 1 ecological
			 restoration project for each National Forest is initiated under section
			 106, not
			 less than 100,000 acres; and</text></subclause></clause></subparagraph><subparagraph id="idd4887cf4-bb19-4b5a-8271-349abb3110d0"><enum>(B)</enum><text>for each fiscal
			 year after the fiscal year specified in subparagraph (A)(ii)(III), an
			 ecological restoration project on each National Forest in the covered area
			 with
			 a gross planning area of not less than 25,000 acres.</text></subparagraph></paragraph><paragraph commented="no" id="idcab6a163-a01b-490a-9d67-dd857ef18b8d"><enum>(2)</enum><header>Annual
			 goals</header><subparagraph commented="no" id="id379143b9-0d73-4a0c-a495-14c1723c8eff"><enum>(A)</enum><header>In
			 general</header><text>Beginning in the first fiscal year after the date on
			 which at least 1 ecological restoration project is initiated for each
			 National
			 Forest under section 106 and each fiscal year thereafter until the date on
			 which
			 the project is completed, the Secretary may establish, subject to
			 subparagraph (B), annual acreage performance goals for each project that
			 is predominantly comprised
			 of mechanical treatment in the covered area that emphasize sawtimber as a
			 byproduct consistent with the goals, and after considering the
			 opportunities,
			 described in subsection (b).</text></subparagraph><subparagraph commented="no" id="idb409889b-3469-4d55-80b8-cb90a27f2ae8"><enum>(B)</enum><header>Considerations</header><text>In
			 establishing the goals under subparagraph (A), the Secretary shall take
			 into consideration—</text><clause commented="no" id="id4b3887cd-f76d-4bec-b430-ec9e5a486518"><enum>(i)</enum><text>any specific
			 recommendations of the advisory panel relating to acreage treatment needs;
			 and</text></clause><clause commented="no" id="id1d385c70-d829-4d3c-8e5c-66802f7ef426"><enum>(ii)</enum><text>advice provided
			 by a collaborative group relating to acreage treatment needs.</text></clause></subparagraph></paragraph><paragraph id="id2625ae84-8152-4044-bd59-0a160401f887"><enum>(3)</enum><header>Priority for
			 restoration goals</header><text>In seeking to meet the restoration goals
			 established under paragraph (2), the Secretary shall prioritize for
			 treatment any area that
			 has opportunities for reduced planning and implementation costs because
			 of—</text><subparagraph id="idc7f94568-90a8-4050-b74a-28e036bbba4f"><enum>(A)</enum><text>opportunities to
			 work with a collaborative group on the project; or</text></subparagraph><subparagraph id="idc8a1bfb2-c698-437e-89d0-6d382f70ebda"><enum>(B)</enum><text>opportunities to
			 use non-Federal resources to complete the project.</text></subparagraph></paragraph></subsection></section><section id="id0ffd3694-2c9a-404a-8f43-df4f50c8a9cb"><enum>104.</enum><header>Aquatic and riparian resources
			 management</header><subsection id="id3f269308-ff71-4d6e-91e9-ea3ff8940898"><enum>(a)</enum><header>Primary focus</header><text>The primary focus of aquatic and riparian protection activities in the covered area shall be to
			 protect, maintain, and restore natural ecological functions and processes
			 beneficial to water quality and quantity, including temperature and
			 turbidity, native fish and wildlife, and watershed resilience.</text></subsection><subsection id="id93ead4129001404780d228cbc5f8f3c3"><enum>(b)</enum><header>Desired watershed conditions</header><text>Desired watershed conditions shall include maintaining or enhancing riparian processes and
			 conditions, including stable slopes, wood and nutrient delivery to aquatic
			 and terrestrial systems, stream shade, microclimate, water quantity, and
			 water quality, to ensure that the watersheds—</text><paragraph id="idAD05166AA1F44C7D871C8257378E35C3"><enum>(1)</enum><text>operate consistently with local disturbance regimes; and</text></paragraph><paragraph id="id49E7B01EEBE943BEA79ACEC53AF24871"><enum>(2)</enum><text>support native flora and fauna.</text></paragraph></subsection><subsection id="idc19bc8e943fe4b35a6dad79267538a46"><enum>(c)</enum><header>Strategy</header><text>The Secretary shall—</text><paragraph id="idBD9A07E17A7947F2AA10FF08DF1E80B1"><enum>(1)</enum><text>develop an aquatic and riparian conservation strategy that incorporates—</text><subparagraph id="id18220D2CBA8D40D490440B9284127108"><enum>(A)</enum><text>riparian management areas;</text></subparagraph><subparagraph id="id98708E2926D54943AC6D4EF73378D43B"><enum>(B)</enum><text>key watersheds;</text></subparagraph><subparagraph id="idE9E3B02D5BB947979FE9D14911A838B5"><enum>(C)</enum><text>watershed analysis;</text></subparagraph><subparagraph id="idC890CEBCD4AD422EAF4A10A025459715"><enum>(D)</enum><text>watershed restoration; and</text></subparagraph><subparagraph id="idEAD9C040E7E54E6AA0E910A5B3DAA156"><enum>(E)</enum><text>monitoring; and</text></subparagraph></paragraph><paragraph id="id6923F7D348ED4959BD9390B875B590A7"><enum>(2)</enum><text>use as the basis for watershed, aquatic, and riparian ecosystem management and restoration the
			 interaction of the elements described in paragraph (1) at the watershed or
			 landscape scale.</text></paragraph></subsection><subsection id="idfb7a176b44df41109d7960f493007887"><enum>(d)</enum><header>Modifications</header><text>The Secretary may modify the aquatic and riparian protection standards under subsection (a) if the
			 Secretary determines, taking into consideration the best available
			 science, that the modifications would meet or exceed the goals and
			 standards of the aquatic and riparian protection requirements of
			 subsection (e).</text></subsection><subsection id="id877424b69aaf4a6ca7fa4e284c548568"><enum>(e)</enum><header>Requirement</header><text>The management activities carried out within the covered area shall not retard or prevent the
			 attainment of—</text><paragraph id="id7435A66B645A4438AB0E3ABC6B5EAF30"><enum>(1)</enum><text>the aquatic, riparian, and watershed goals described in this section; and</text></paragraph><paragraph id="id49E7591E711F4E8C8D482453CDE2B791"><enum>(2)</enum><text>the goals of applicable resource management plans, biological opinions, and water quality standards
			 in effect on the date of enactment of this Act.</text></paragraph></subsection></section><section id="id6df9046f-69a8-498d-95bc-d8d54b4d4ef0"><enum>105.</enum><header>Eastside Forest
			 Scientific and Technical Advisory Panel</header><subsection id="id9d90092d-d37f-466e-a43e-86d8e6c76e3d"><enum>(a)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall establish an
			 advisory
			 panel, to be known as
			 the <quote>Eastside Forest Scientific and Technical Advisory Panel</quote>, to advise the
			 Secretary, collaborative groups, and the public regarding the development
			 and
			 implementation of—</text><paragraph id="idd006abca-f011-4ab8-b6e5-393aaf95b9f4"><enum>(1)</enum><text>goals and performance measures to improve
			 forest health, watershed health, and related social and economic goals in
			 the
			 covered area; and</text></paragraph><paragraph id="id9d16beb0-fd04-4e27-bba4-37e7e7fe8ce6"><enum>(2)</enum><text>projects needed
			 to accomplish the goals of this title.</text></paragraph></subsection><subsection id="id510742e7-321b-429f-b680-88798bb17e28"><enum>(b)</enum><header>Composition</header><text>The
			 advisory panel shall be composed of 9 members, each of whom shall have
			 expertise in 1 or more of the following:</text><paragraph id="id6031374a-2a29-49da-b751-a8b1b570d124"><enum>(1)</enum><text>Silviculture.</text></paragraph><paragraph id="id5bfc41b4-a741-48fe-9845-40e09efd917d"><enum>(2)</enum><text>Timber
			 economics.</text></paragraph><paragraph id="id914ab34b-7fcc-4e61-8741-7786c9d4516b"><enum>(3)</enum><text>Road and logging
			 engineering.</text></paragraph><paragraph id="id7276d131-adb2-4951-90b1-74caac01a1e2"><enum>(4)</enum><text>Soil science and
			 geology.</text></paragraph><paragraph id="ide0e4e15d-b0d7-42ce-b6eb-befb0e1e3904"><enum>(5)</enum><text>Ecosystem
			 services or natural resources economics.</text></paragraph><paragraph id="id9a763070-50bd-4317-953b-50e2ae4275b7"><enum>(6)</enum><text>Community
			 economics or ecosystem workforce development.</text></paragraph><paragraph id="id4367d273-6d49-46e0-a713-fd88505439a8"><enum>(7)</enum><text>Forest
			 ecology.</text></paragraph><paragraph id="id705e47dc-b50a-4ee4-96cc-89657a2d71a8"><enum>(8)</enum><text>Aquatic and

			 control and eradication.</text></paragraph><paragraph id="idd1c053cf-3a1a-4169-9a64-827bfa4e3166"><enum>(13)</enum><text>Wildland
			 fire.</text></paragraph><paragraph id="idaa442a46-539b-4ed3-ba26-bf52f8cbd74e"><enum>(14)</enum><text>Hydrology.</text></paragraph><paragraph id="iddb66eac8-78ca-45d5-9e5e-e4f81beb8629"><enum>(15)</enum><text>Forest carbon
			 lifecycle and sequestration.</text></paragraph><paragraph id="id6166be40-ff5b-4f9d-9c38-f39c52bdbbe1"><enum>(16)</enum><text>Social
			 science.</text></paragraph></subsection><subsection id="id9f46127d-aa6e-4859-ae65-6b78f4f109dc"><enum>(c)</enum><header>Appointments</header><text>The
			 Secretary shall—</text><paragraph id="idf0fd5554-6869-4cac-a434-bf21dcafcbaf"><enum>(1)</enum><text>ensure that the
			 advisory panel includes experts in a broad array of the fields described
			 in
			 subsection (b); and</text></paragraph><paragraph id="idf8228ea1-25d9-4e86-9917-cdf8e5f72423"><enum>(2)</enum><text>give
			 consideration to the recommendations of institutions of higher education
			 (as
			 defined in section 101(a) of the Higher Education Act of 1965 (20 U.S.C.
			 1001(a)), professional societies, and other interested organizations and
			 individuals.</text></paragraph></subsection><subsection id="idd7ff6d6d-cfe2-41d0-a57c-b32cfab9dea6"><enum>(d)</enum><header>Duties</header><paragraph id="idf008f1ff-5682-454d-972d-9a5a39eebb1c"><enum>(1)</enum><header>Recommendations
			 report</header><subparagraph id="id290b886d-44ca-4358-a48e-2f45f1a23b9e"><enum>(A)</enum><header>In
			 general</header><text>Not later than 180 days after the date on which the
			 Secretary appoints the members of the advisory panel, the advisory panel,
			 taking into
			 consideration the best available science and information, shall submit to
			 the
			 Secretary,  who shall make available to the public a report that contains
			 recommendations regarding the manner by which the Secretary can best
			 achieve
			 the purposes and goals, and consider the opportunities, described in
			 section
			 102(b).</text></subparagraph><subparagraph id="idf5cacf40-c3a7-456c-8130-8c4077983db3"><enum>(B)</enum><header>Requirements</header><text>The
			 report under subparagraph (A) shall provide recommendations based on the
			 best available science regarding—</text><clause id="idb41f8745-1537-41c5-b443-3efc8be10575"><enum>(i)</enum><text>the size and scope of projects needed to accomplish the goals and consider the
			 opportunities described in section 102(b);</text></clause><clause id="iddc198bc4-ad5c-4655-a4d8-955b40e30068"><enum>(ii)</enum><text>increasing
			 local capacity to accomplish the goals and consider the opportunities
			 described
			 in section 102(b);</text></clause><clause id="idc27c1588-206f-4141-9333-43b668ea8376"><enum>(iii)</enum><text>hydrologically and ecologically restoring land and water by—</text><subclause id="idf27a62b6-dac0-4ae7-84a5-02d49560a780"><enum>(I)</enum><text>decommissioning
			 unnecessary and undesirable roads; and</text></subclause><subclause id="id3480d33c-3aee-4553-9505-0404c8a25f8d"><enum>(II)</enum><text>reducing the
			 environmental impact of necessary and desirable roads; and</text></subclause></clause><clause id="id0969cfb2-8666-457d-8461-112143913d88"><enum>(iv)</enum><text>actions for each
			 relevant plant association group, taking into account current or future
			 potential vegetation and soil types that—</text><subclause id="id44bebe4a-9799-419d-8900-f38a4c41ebb6"><enum>(I)</enum><text>protect and restore terrestrial, aquatic, riparian, wildlife, fish, vegetation, soil,
			 carbon, and other resources; and</text></subclause><subclause id="id50549cc1-cfd5-4612-9779-f561dde4302e"><enum>(II)</enum><text>would  be necessary and desirable to restore forest health and watershed
			 health (including thinning, prescribed, and natural fire and other
			 appropriate
			 activities); and</text></subclause></clause><clause id="id39647ed87fd44f5f90629f96ba6540b6"><enum>(v)</enum><text>monitoring protocols to evaluate the success of the vegetation management projects and ecological
			 restoration projects on the covered area in meeting the goals and
			 objectives of this title.</text></clause></subparagraph><subparagraph id="idce589624-2e2f-4458-8aea-899f4bf4764c"><enum>(C)</enum><header>Administration</header><clause id="id990a85b1-d7e0-4fc8-8575-e7ef270deeb1"><enum>(i)</enum><header>In
			 general</header><text>To the maximum extent practicable, the advisory panel
			 shall achieve a consensus with respect to each recommendation included in
			 the
			 report under this paragraph.</text></clause><clause id="id00be702e-7291-4971-b7ed-2bca3f5aba2e"><enum>(ii)</enum><header>Inclusion of
			 dissenting opinions</header><text>If the advisory panel fails to achieve a
			 consensus with respect to any recommendation included in the report under
			 this paragraph, the report
			 shall include each dissenting opinion relating to the recommendation.</text></clause></subparagraph></paragraph><paragraph id="id2f2a58be-9c15-4d1a-9762-05490da664c5"><enum>(2)</enum><header>Review
			 report</header><text>Not later than 5 years after the date on which the
			 Secretary appoints the members of the advisory panel, the advisory panel
			 shall
			 submit to the Secretary and make available to the public a report
			 providing—</text><subparagraph id="idc6960936-f9cb-4714-be77-fa3e4f0cb65e"><enum>(A)</enum><text>a quantitative
			 and qualitative assessment of the status of, and changes to, forest health
			 and
			 watershed health in the covered area, including the resiliency, aquatic
			 function, and plant composition, structure, and function; and</text></subparagraph><subparagraph id="id1f716a3e-46ae-477e-8b8c-49c8d5c14e10"><enum>(B)</enum><text>an assessment of
			 the implementation of the recommendations made under paragraph (1).</text></subparagraph></paragraph></subsection></section><section id="idb68d5375-8e0c-42b8-a3f9-357796b2fd82"><enum>106.</enum><header>Ecological
			 restoration projects</header><subsection id="id8a65af6a-4d46-41b2-87d3-b5238babd0a5"><enum>(a)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall implement,
			 taking into consideration the
			 annual goals  described in section 103(b)(2), ecological restoration
			 projects in the covered area to support the land management goals
			 described in section
			 102(b).</text></subsection><subsection id="id35e4bada-f6f8-43eb-8f26-ca802c1e7d31"><enum>(b)</enum><header>Landscape-scale
			 projects</header><text>Subject to the availability of appropriations under section 110, the Secretary shall implement, to
			 the maximum extent
			 practicable, 1 or more ecological restoration projects with a gross
			 planning area of 50,000 acres for each National Forest in the covered area
			 that
			 provide landscape-scale work within a watershed area by not later than 3
			 years
			 after the date on which the Secretary selects the covered area.</text></subsection><subsection id="iddb3616df-f0db-4415-9f35-70abd35e3da8"><enum>(c)</enum><header>Criteria</header><text>In
			 developing and implementing ecological restoration projects under this
			 section,
			 the Secretary shall consider—</text><paragraph id="id8ef5d6b2-67b5-4a27-9ab5-23c60a9b2eb4"><enum>(1)</enum><text>the best
			 available science and data;</text></paragraph><paragraph id="id2e5c8b27-f005-4dfb-825f-416c03ea84b2"><enum>(2)</enum><text>the
			 recommendations of the advisory panel;</text></paragraph><paragraph id="id1bb7e109-c973-497a-b709-0cf618737f87"><enum>(3)</enum><text>the views of collaborative groups; and</text></paragraph><paragraph id="id1e3b02ab37fc40f585ad9fe2d7142768"><enum>(4)</enum><text>dry and moist forest plant association groups.</text></paragraph></subsection><subsection id="ide50c385c-c4b7-45a7-8e61-55dc30abf5ee"><enum>(d)</enum><header>Net road
			 reduction</header><text>In developing ecological restoration projects under
			 this section, the Secretary shall examine opportunities for, and achieve,
			 a net
			 reduction in the permanent road system to improve forest and watershed
			 health,
			 to the maximum extent practicable.</text></subsection><subsection id="idc05e178d-7b15-4576-8537-90debea07878"><enum>(e)</enum><header>Prioritization</header><paragraph id="id2e5dcfec-a0b0-4dbb-86a1-024987fbb6b0"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall prioritize ecological restoration
			 projects in the covered area, taking into consideration—</text><subparagraph id="id7BDA1D9B85DB45CD99DEE308A577A0EE"><enum>(A)</enum><text>the criteria described in subsection (c); and</text></subparagraph><subparagraph id="idB3D7DF54597D4C5E832EA2ADA6F0EB97"><enum>(B)</enum><text>the degree to which the ecological restoration projects would improve
			 forest health and watershed health.</text></subparagraph></paragraph><paragraph id="id59b39dae-db60-43f2-ac05-ba8b9ef06cbf"><enum>(2)</enum><header>Priorities</header><text>In
			 selecting and planning ecological restoration projects, the Secretary
			 shall prioritize projects that—</text><subparagraph id="id09436e6e-2f58-4e5b-ad9b-30755c1b470f"><enum>(A)</enum><text>reduce the risk
			 of, and increase the resistance and resiliency of the land to,
			 uncharacteristic
			 disturbances, particularly if critical components or values are at risk,
			 including—</text><clause id="id78b78c8f-83f7-4763-ab6f-b5be82668855"><enum>(i)</enum><text>communities
			 located in the wildland-urban interface (as defined in section 101 of the
			 Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>)); and</text></clause><clause id="id07d1ffd9-4e9f-41dc-b5cd-6dc077fb9de8"><enum>(ii)</enum><text>valuable forest
			 structures (including old growth and older mature trees);</text></clause></subparagraph><subparagraph id="id8af902cd-a601-4661-999f-4712cf18acd1"><enum>(B)</enum><text>restore the
			 structure and composition of forest stands at a high or moderate departure
			 from
			 the historic range of variability;</text></subparagraph><subparagraph id="idb8bbb2dc-6e81-45df-a633-f9ad55dbfbb9"><enum>(C)</enum><text>sustain the appropriate scale of industry infrastructure to accomplish the goals described in
			 section 102(b);</text></subparagraph><subparagraph id="id9B7C26B7F9DE4F70BF5A288563E5EFA5"><enum>(D)</enum><text>accelerate the
			 development of complex forest structure in a young forest that has been
			 simplified through past management, such as by—</text><clause id="iddb4b09f6-ae94-4c6d-8407-0cfeea731432"><enum>(i)</enum><text>creating spatial
			 heterogeneity (including the creation of skips and gaps) using mechanical
			 treatments to create wildlife habitat; and</text></clause><clause id="id96219289-41e3-4160-b359-1f8e360f843c"><enum>(ii)</enum><text>retaining
			 biological legacies (including large standing, downed, live, and dead
			 trees);</text></clause></subparagraph><subparagraph id="id1331f546-e5da-437a-bb12-fc07cf33a5e5"><enum>(E)</enum><text>assist in the
			 implementation of community wildfire protection plans developed by at-risk
			 communities (as those terms are defined in section 101 of the Healthy
			 Forests
			 Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>));</text></subparagraph><subparagraph id="id64476b90-c94d-4039-b5e5-57045b24962e"><enum>(F)</enum><text>use the value of
			 merchantable sawlogs and biomass to help offset the cost of ecological
			 restoration projects;</text></subparagraph><subparagraph id="id8abcada8-1f42-45a4-b276-f08e9ce017ad"><enum>(G)</enum><text>meet local and
			 rural community needs through a source that is selected on a best-value
			 basis;</text></subparagraph><subparagraph id="id1d38429e-0546-4c86-925e-bb3ea70c6689"><enum>(H)</enum><text>reduce the
			 permanent road system to improve forest health and watershed health; and</text></subparagraph><subparagraph id="idc680de5abffc46b1876c1da0fc457907"><enum>(I)</enum><text>help recover aspen, willows, and other native hardwoods in riparian and upland ecosystems.</text></subparagraph></paragraph></subsection></section><section id="id2623f474-e99a-4623-9c72-ef47aa648cf5"><enum>107.</enum><header>Collaboration</header><subsection id="id209c4c87-d764-4206-8abe-c629c3ffd608"><enum>(a)</enum><header>In
			 general</header><text>To assist in the development of the projects needed to
			 accomplish the purposes of this title in the covered area, the Secretary
			 shall
			 consult with, and consider the recommendations of, any collaborative group
			 that
			 meets the criteria described in subsection (b).</text></subsection><subsection id="idec3c6633-a1b5-4f91-85f0-0c6508eb0ee4"><enum>(b)</enum><header>Criteria</header><text>A collaborative group referred to in subsection (a) is a group
			 that—</text><paragraph id="idac90573e-2cd2-4979-b293-c969ae16e24b"><enum>(1)</enum><text>is interested in
			 the implementation of this title;</text></paragraph><paragraph id="idc200dc23-1ae3-478d-b902-bbe799342570"><enum>(2)</enum><text>includes multiple
			 individuals representing diverse interests, including—</text><subparagraph id="id026fec0a-f199-46af-89d1-4ea5a172fe2f"><enum>(A)</enum><text>environmental
			 organizations;</text></subparagraph><subparagraph id="idaf334c2d-0f79-40a8-872e-330723eec5e3"><enum>(B)</enum><text>timber and
			 forest products industry representatives; and</text></subparagraph><subparagraph id="id4c1679ef-0eaa-4c5c-88c0-a244bcc3805e"><enum>(C)</enum><text>county
			 governments;</text></subparagraph></paragraph><paragraph id="id1ca1c420-4302-4544-8952-667bbe4b12f3"><enum>(3)</enum><text>operates—</text><subparagraph id="id4dfe97c8-d045-401f-8f77-5330128002fa"><enum>(A)</enum><text>in
			 a transparent and nonexclusive manner; and</text></subparagraph><subparagraph id="id1472c3df-d22e-4cfd-826e-dc7be05d8c01"><enum>(B)</enum><text>by
			 consensus or in accordance with voting procedures to ensure a high degree
			 of
			 agreement among participants and across various interests; and</text></subparagraph></paragraph><paragraph id="id14a9b8f8-b757-4f90-8add-564512f63ff1"><enum>(4)</enum><text>requires a level
			 of participation sufficient to ensure that members of the collaborative
			 group
			 are adequately informed before making each decision.</text></paragraph></subsection></section><section id="idbfbfc99b-209f-41b4-b5a4-baf16355a515"><enum>108.</enum><header>Large-scale
			 environmental impact statement</header><subsection id="idd368331a-56c8-455f-87d0-5b11952c82d0"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out vegetation management projects and ecological restoration projects
			 under this section in accordance with the National Environmental Policy
			 Act of 1969 (42 U.S.C. 4321
			 et seq.).</text></subsection><subsection id="id41a641b4-1816-43a8-a19d-d310f0faf968"><enum>(b)</enum><header>Environmental impact statement</header><paragraph id="id151EBFCE2F644C79B9C0443B5CA82561"><enum>(1)</enum><header>In general</header><text>The
			 Secretary shall prepare 1 landscape-scale environmental impact statement
			 for purposes of compliance with the National Environmental Policy Act of
			 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) for vegetation management projects and
			 ecological restoration projects carried out under this title in National
			 Forests in the eastern part of the State that share ecological conditions
			 and resource issues, including projects—</text><subparagraph id="ide64cd6b7-90a7-436e-bfbc-8fd4278c4e43"><enum>(A)</enum><text>that are located
			 wholly in dry ponderosa pine and dry mixed conifer forests types;</text></subparagraph><subparagraph id="id465c314e-771c-4e50-91d6-53594e90588d"><enum>(B)</enum><text>that are endorsed
			 by, or are the product of, a collaborative group; and</text></subparagraph><subparagraph id="id988b48cd-a4b4-4b61-b0d5-c8aa482ac2d9"><enum>(C)</enum><text>no portion of
			 which are located in an inventoried roadless area.</text></subparagraph></paragraph><paragraph id="id8e2e3e0aee474bb59e5c0ee83d981c90"><enum>(2)</enum><header>Use</header><text>The large-scale environmental impact statement under paragraph (1) shall be used as the basis for
			 decisions on covered vegetation management projects and ecological
			 restoration projects, except for limited projects—</text><subparagraph id="id0FA3878F3DD54548B4852F95C8D6F8E9"><enum>(A)</enum><text>that are developed after the completion of the environmental impact statement; and</text></subparagraph><subparagraph id="idC44497344D9948C08DC9E1A9074BA9F8"><enum>(B)</enum><text>for which the environmental impact statement does not adequately analyze the work to be performed.</text></subparagraph></paragraph></subsection><subsection id="id7e3529b3-c308-425e-a207-4fce63264986"><enum>(c)</enum><header>Completion
			 date</header><text>The Secretary shall complete the record of decision for the
			 large-scale environmental impact statement under subsection (b) by not
			 later than
			 1 year after the date of enactment of this Act.</text></subsection><subsection commented="no" id="id46ff4528-d2bd-43a9-8ef7-63f24815316b"><enum>(d)</enum><header>Timeliness</header><text>A
			 legal challenge to the environmental impact statement and record of
			 decision
			 under this section shall be filed by not later than 120 days after the
			 date on which the record of
			 decision is signed by the Secretary.</text></subsection></section><section id="id498ec93e-c68a-45b2-a2aa-10f29cd71fd4"><enum>109.</enum><header>Administration</header><subsection id="id0d52e83c-7f11-4525-b2e6-2c0f3804af00"><enum>(a)</enum><header>Effect of title</header><text>Nothing
			 in this title affects—</text><paragraph id="id794443b3-67ec-4b5f-b6ae-e7a0c7d4f192"><enum>(1)</enum><text>any right
			 described in a treaty between an Indian tribe and the United States; or</text></paragraph><paragraph id="id15f8bac3-e87c-4970-9ab7-4e15e7db546c"><enum>(2)</enum><text>any biological
			 opinion, including any opinion associated with the aquatic and riparian
			 protection requirements of applicable land and resource management
			 plans.</text></paragraph></subsection><subsection id="ida62e1ecd-618f-451e-9eee-cd8ad46361d4"><enum>(b)</enum><header>No retroactive
			 effect</header><paragraph id="ide98df8da-e567-4ff9-be6b-763037d0fbc0"><enum>(1)</enum><header>Vegetation
			 management projects</header><text>This title shall not apply to
			 a vegetation management project that is—</text><subparagraph id="id22b5a894-1840-4087-92b0-c5f7c26a1be5"><enum>(A)</enum><text>initiated,
			 through a scoping notice or a notice of intent, more than 180 days before
			 the
			 date of enactment of this Act;
			 or</text></subparagraph><subparagraph id="id9d4575d3-b2ca-46a4-99f3-5095a39dcc4b"><enum>(B)</enum><text>approved or under
			 contract before the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="id209ea88f-b924-489d-a8ac-e898180b7bf3"><enum>(2)</enum><header>Recommendations
			 report</header><text>The completion of the recommendations report of the advisory panel under section 105(d)(2) shall
			 not automatically compel an
			 amendment or revision to—</text><subparagraph id="id064383D178F14046B83FE528BFCC18E1"><enum>(A)</enum><text>any vegetation management project initiated, approved,
			 or under contract before the date on which the recommendations report is
			 completed; or</text></subparagraph><subparagraph id="idc03270bd-86c5-459d-9a5a-cb19feb76938"><enum>(B)</enum><text>any existing forest plan.</text></subparagraph></paragraph></subsection><subsection id="id4d060b46-d729-4f03-821b-5444ec5a8ef7"><enum>(c)</enum><header>Applicable
			 law</header><text>The Secretary shall carry out this title in accordance with
			 applicable law (including regulations).</text></subsection><subsection id="id90554820-91af-467b-98a9-e22b0cc6011c"><enum>(d)</enum><header>Principal
			 agency contact</header><paragraph id="id8896d0dc-49a1-444f-b5e9-9c730e50bbda"><enum>(1)</enum><header>Selection</header><text>The
			 Secretary shall select a principal agency contact for the implementation
			 of
			 this title.</text></paragraph><paragraph id="idb7d89d0a-9b26-4a0a-aa01-2cd0404b1ed8"><enum>(2)</enum><header>Duties</header><text>The
			 principal agency contact shall—</text><subparagraph id="idca9d4c44-e9e0-41e3-9287-bc82d7dd26e1"><enum>(A)</enum><text>serve as the
			 point-of-contact for the advisory panel;</text></subparagraph><subparagraph id="id693e0aed-0ad8-4a76-9237-aac0dca3ba4e"><enum>(B)</enum><text>facilitate
			 communications among—</text><clause id="idbfa09275-c208-4770-a634-c8b56339f377"><enum>(i)</enum><text>the
			 advisory panel;</text></clause><clause id="id486870ae-b7fb-4627-a701-3dfcee509deb"><enum>(ii)</enum><text>collaborative
			 groups;</text></clause><clause id="idcaa61f00-f0ec-419b-bd9a-b1985dc1f74b"><enum>(iii)</enum><text>employees of
			 the Forest Service; and</text></clause><clause id="ide63352cf-b628-4a74-95bd-4c600894e399"><enum>(iv)</enum><text>any other
			 stakeholders (including the public).</text></clause></subparagraph></paragraph></subsection><subsection id="idcbc6f441-df13-4e68-b6ef-a62394a05d51"><enum>(e)</enum><header>Reporting</header><paragraph id="id8976f48d-e008-4ba6-9332-75e041a3b5ee"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall prepare a report on the
			 implementation of this title—</text><subparagraph id="idda58ddf9-c2b2-46f4-bc65-4dec68902396"><enum>(A)</enum><text>not later than 5
			 years after the date on which the Secretary selects the covered area;
			 but</text></subparagraph><subparagraph id="ide8f43b8d-80c5-4a5d-926b-ce08d35794da"><enum>(B)</enum><text>not earlier than 2 years before
			 the date described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idc8fa9ee9-236c-4f92-8885-bfed3aaf9bf1"><enum>(2)</enum><header>Contents</header><text>The
			 reports required under paragraph (1) shall assess, for each National
			 Forest in the
			 covered area, the progress achieved in accomplishing—</text><subparagraph id="id6df42023-1bd3-4cef-80a8-b85f55ef003b"><enum>(A)</enum><text>the purposes of
			 this title; and</text></subparagraph><subparagraph id="id206fb8b1-b68b-42d1-b10e-9cedd57d3f5d"><enum>(B)</enum><text>the performance
			 goals established under section 103.</text></subparagraph></paragraph></subsection><subsection id="id3fd360d1-05e0-4892-8bd7-ddfdc39e745b"><enum>(f)</enum><header>Termination of
			 authority</header><paragraph id="id2cd67659-ac7a-4702-9ead-cd8f2b13ab25"><enum>(1)</enum><header>In
			 general</header><text>The authority provided by this title shall terminate on the date that is
			 15 years after the date of enactment of this Act.</text></paragraph><paragraph id="id7cb4b82d-75bb-4abb-9a05-52a5d388d32e"><enum>(2)</enum><header>Effect</header><text>Nothing
			 in this subsection affects a valid contract in effect on the date
			 described in
			 paragraph (1).</text></paragraph></subsection></section><section id="idf1f9a811-e6da-4be7-bc0c-69511cf3945b"><enum>110.</enum><header>Authorization
			 of appropriations</header><subsection id="id69ac0afb-7774-40ff-a7d8-2b8d14b05bf3"><enum>(a)</enum><header>In
			 general</header><text>Subject to subsection (c), there is authorized to be
			 appropriated $50,000,000 to carry out this title, to remain available
			 until
			 expended.</text></subsection><subsection id="id9b69e9bb-9cf9-4265-b9e1-652daadf6dae"><enum>(b)</enum><header>Use</header><text>Any
			 amounts appropriated to the Secretary under subsection (a) may be used to
			 support implementation of any cost-sharing authorities provided by this
			 title.</text></subsection><subsection id="id0950e55328254a7681c441536b0fbf2f"><enum>(c)</enum><header>Effect on other funds</header><text>The Secretary may not divert funding from a National Forest or grassland outside of the State to
			 meet the performance requirements of this title.</text></subsection><subsection id="idc9552f62254641a4bcad1325475e2691"><enum>(d)</enum><header>Reprogramming authority</header><paragraph id="idBEFC576746D2448494DCB5CAA8D0339F"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), after submitting to the Committees on Appropriations of the
			 House of Representatives and the Senate a notice, the Secretary may
			 reprogram any funds—</text><subparagraph id="idf62b130b3dae49ff941d4102da9966a3"><enum>(A)</enum><text>made available to the Secretary through an appropriation for the National Forest System; and</text></subparagraph><subparagraph id="id0f2a3381dce642469006102fd3f50f56"><enum>(B)</enum><text>allocated to be used on the National Forests in the covered area.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id64dd0f593b9f4a719903345a6f167d2c"><enum>(2)</enum><header>Exception</header><text>No funds appropriated for a recreation or grazing activity may be subject to reprogramming under
			 paragraph (1).</text></paragraph></subsection></section></title><title changed="added" committee-id="SSEG00" id="id47E302867D8744D58EEA99BFB6B7F391" reported-display-style="italic" style="OLC"><enum>II</enum><header>Cooperative partnership funding</header><section id="ida41819a6f6c74ecf9a4fcba25eb2096a" section-type="subsequent-section"><enum>201.</enum><header>Forest planning</header><text display-inline="no-display-inline">Section 327(b)(2) of the Department of the Interior and Related Agencies Appropriations Act, 1996
			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1611">16 U.S.C. 1611</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/104/134">Public Law 104–134</external-xref>) is amended by inserting <quote>expenditures for forest planning activities necessary for timber sales for projects that are
			 located on any landscape that receives funding under section 4004 of the
			 Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/16/7304">16 U.S.C. 7304</external-xref>) and</quote> after <quote>may include</quote>.</text></section><section id="idf8d003142a634239baa5d8559d7b3672"><enum>202.</enum><header>Cooperative forest innovation partnership projects</header><text display-inline="no-display-inline">Section 13B of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2109b">16 U.S.C. 2109b</external-xref>) is amended by
			 adding at the end the following:</text><quoted-block changed="added" committee-id="SSEG00" display-inline="no-display-inline" id="id3be35978de03409aaf7ca7c5d3b01144" reported-display-style="italic" style="OLC"><subsection id="id0b1613938c7949bb84c547a1c8f0380e"><enum>(d)</enum><header>Regulations</header><text>Not later than 90 days after the date of enactment of the <short-title>Oregon Eastside Forests Restoration, Old Growth Protection, and Jobs Act of 2013</short-title>, the Secretary shall promulgate regulations to implement the authority of the Secretary under that
			 Act.</text></subsection><subsection id="idf4d0ed82b5cb4df399f27d796e6813fb"><enum>(e)</enum><header>Cooperation with State governments</header><paragraph id="id178CD52AD31746F59677B4D91E741CB6"><enum>(1)</enum><header>Projects authorized</header><text>Not later than 180 days after the date of enactment of the <short-title>Oregon Eastside Forests Restoration, Old Growth Protection, and Jobs Act of 2013</short-title>, the Secretary, in cooperation with the States, shall carry out projects to support the ability of
			 the Department of Agriculture to address the restoration of National
			 Forests in eligible areas.</text></paragraph><paragraph id="id43844f5f0d1841fe9881361cfab5c812"><enum>(2)</enum><header>Eligible areas</header><text>A project under paragraph (1) may be carried out on—</text><subparagraph id="idf1fbc3b159244ab59bd9ceb88cf9fb6d"><enum>(A)</enum><text>the covered area (as defined in section 101 of the <short-title>Oregon Eastside Forests Restoration, Old Growth Protection, and Jobs Act of 2013</short-title>); and</text></subparagraph><subparagraph id="idbc435c6c869d4b3e98ce7462601595cf"><enum>(B)</enum><text>any additional areas of the National Forest System that the Secretary selects to carry out
			 paragraph (1).</text></subparagraph></paragraph><paragraph id="id706773d0909c4677b485d597800209d1"><enum>(3)</enum><header>Funding</header><text>For each fiscal year, the Secretary shall use not more than 5 percent of the funds made available
			 for forest health on Federal land under the heading <quote><header-in-text level="appropriations-small" style="appropriations">State and private forestry</header-in-text></quote> of title III of an appropriations Act making funds available to the Department of the Interior to
			 pay for not more than 50 percent of the total cost of carrying out
