		title</header><text display-inline="no-display-inline">This Act may be cited as
		the <quote><short-title>Child Care and Development Block Grant Act of 2014</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idb60c891c-4350-4ffd-9ce4-21eae3b80fe2" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Short
		title and purposes</header><text display-inline="no-display-inline">Section
		658A of the Child Care and Development Block Grant Act of 1990 (42 U.S.C. 9801
		note) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="id43e7cea9-fcae-43ec-bb34-c38652459376" style="OLC"><section commented="no" display-inline="no-display-inline" id="idfbe85468-7fc7-420f-b8d1-6935455a6f4e" section-type="subsequent-section"><enum>658A.</enum><header display-inline="yes-display-inline">Short title
		  and purposes</header><subsection commented="no" display-inline="no-display-inline" id="idc81c3ea5-9ef8-44f2-a500-3fc66bae00bd"><enum>(a)</enum><header display-inline="yes-display-inline">Short
		  title</header><text display-inline="yes-display-inline">This subchapter may be cited as the <quote><short-title>Child
		  Care and Development Block Grant Act of 1990</short-title></quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id31b07d68-6d84-4149-9432-3bbd3a5fbe2c"><enum>(b)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The
		  purposes of this subchapter are—</text><paragraph commented="no" display-inline="no-display-inline" id="id2d1fac18-dbc0-455e-9d89-e16a66bdbf2a"><enum>(1)</enum><text display-inline="yes-display-inline">to
		  allow each State maximum flexibility in developing child care programs and
		  policies that best suit the needs of children and parents within that
		  State;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9db9e660-c1f0-491b-acf1-d3318e7f1210"><enum>(2)</enum><text display-inline="yes-display-inline">to
		  promote parental choice to empower working parents to make their own decisions
		  regarding the child care that best suits their family’s needs;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc7133b18-6643-4894-9e0a-4c4e71da3e1b"><enum>(3)</enum><text display-inline="yes-display-inline">to
		  assist States in providing high-quality child care services to parents trying
		  to achieve independence from public assistance;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51b4e319-9982-42e3-94f2-d0eab102f9f4"><enum>(4)</enum><text display-inline="yes-display-inline">to
		  assist States in improving the overall quality of child care services and
		  programs by implementing the health, safety, licensing, training, and oversight
		  standards established in this subchapter and in State law (including
		  regulations);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idda97c080-3eb4-491e-81de-09a6b49c4bb8"><enum>(5)</enum><text display-inline="yes-display-inline">to
		  improve school readiness by having children, families, and child care providers
		  engage in activities, in child care settings, that are developmentally
		  appropriate and age-appropriate for the children and that promote children's
		  language and literacy and mathematics skills, social and emotional development,
		  physical health and development, and approaches to learning;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9b3b6b9-741c-4ef7-8908-7ce242910c69"><enum>(6)</enum><text display-inline="yes-display-inline">to
		  encourage States to provide consumer education information to help parents make
		  informed choices about child care services and to promote involvement by
		  parents and family members in the education of their children in child care
		  settings;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id097b4681-15a1-4382-a3fc-cbdd69d8739c"><enum>(7)</enum><text display-inline="yes-display-inline">to
		  increase the number and percentage of low-income children in high-quality child
		  care settings; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81a66eba-7c3b-4588-95a4-acc73bbe5836"><enum>(8)</enum><text display-inline="yes-display-inline">to
		  improve the coordination and delivery of early childhood education and care
		  (including child
		  care).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id13c78c4c-7f01-4d17-8791-61cb69d52a18" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Authorization of
		appropriations</header><text display-inline="no-display-inline">Section 658B of
		the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858</external-xref>) is
		amended by striking <quote>subchapter</quote> and all that follows, and
		inserting <quote>subchapter, such sums as may be necessary for each of fiscal
		years 2015 through 2020.</quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ide3207090-7682-496b-b4fa-fd19ac0bad36" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Lead
		agency</header><subsection commented="no" display-inline="no-display-inline" id="idF79108D894134D0EB3C933E9C2E50EC7"><enum>(a)</enum><header display-inline="yes-display-inline">Designation</header><text display-inline="yes-display-inline">Section 658D(a) of the Child Care and
		Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858b">42 U.S.C. 9858b(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id41685433-cb15-4bf9-ba68-77f6c1b8d741"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>chief executive
		officer</quote> and inserting <quote>Governor</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4d928d79-faab-4ad6-a834-395db310dde3"><enum>(2)</enum><text display-inline="yes-display-inline">by
		striking <quote>designate</quote> and all that follows and inserting
		<quote>designate an agency (which may be an appropriate collaborative agency),
		or establish a joint interagency office, that complies with the requirements of
		subsection (b) to serve as the lead agency for the State under this
		subchapter.</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4a4ddfc1d71c4f79b1be7b5fe40c3c08"><enum>(b)</enum><header display-inline="yes-display-inline">Collaboration
		with tribes</header><text display-inline="yes-display-inline">Section 658D(b)(1) of the Child Care and Development
		Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858b">42 U.S.C. 9858b(b)(1)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idaaadb9cab1c74a19b4548e7141d3049e"><enum>(1)</enum><text display-inline="yes-display-inline">in
		subparagraph (C), by striking <quote>and</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4e1f9b4ebc64081b0fbd1c59737db10"><enum>(2)</enum><text display-inline="yes-display-inline">in
		subparagraph (D), by striking the period and inserting <quote>; and</quote>;
		and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e0e1137ed814bd2a4b3953a6bce755e"><enum>(3)</enum><text display-inline="yes-display-inline">by
		adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id45113928fab343a6949a69c9c39a97ae" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="id29a6a028ae004bc7b52bbfe7a0fe04f7"><enum>(E)</enum><text display-inline="yes-display-inline">at the option of
		  an Indian tribe or tribal organization in the State, collaborate and coordinate
		  with such Indian tribe or tribal organization in the development of the State
		  plan.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ida3a0e11e-c3e2-4b92-ad0e-90640eb968b7" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Application and
		plan</header><subsection commented="no" display-inline="no-display-inline" id="ida654fe9f-0618-46d2-a25d-69765b450f8a"><enum>(a)</enum><header display-inline="yes-display-inline">Period</header><text display-inline="yes-display-inline">Section
		658E(b) of the Child Care and Development Block Grant Act of 1990 (42 U.S.C.
		9858c(b)) is amended, by striking <quote>2-year</quote> and inserting
		<quote>3-year</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idc243d32b-3766-46db-bf1c-31f6befa82c5"><enum>(b)</enum><header display-inline="yes-display-inline">Policies and
		procedures</header><text display-inline="yes-display-inline">Section 658E(c) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858c">42 U.S.C. 9858c(c)</external-xref>) is
		amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida01056e5-338a-4cdb-bbca-2828172e5a3c"><enum>(1)</enum><text display-inline="yes-display-inline">in
		paragraph (1), by inserting <quote>or established</quote> after
		<quote>designated</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3116b070-36d6-4049-a60b-f0c1bb8ba7c0"><enum>(2)</enum><text display-inline="yes-display-inline">in
		paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4dd01df5-9549-4772-b254-c9b3d0d5e1b4"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph
		(B), by inserting a comma after <quote>care of such providers</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida1138ca6-11bf-4153-b112-bc45659899be"><enum>(B)</enum><text display-inline="yes-display-inline">by striking
		subparagraphs (D) through (H); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc66ed8ef-be19-4dfe-a95e-4f4c3997c038"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the
		end the following:</text><quoted-block display-inline="no-display-inline" id="id00305c3b-0d7e-47ba-bcd8-0700ad211c27" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="id414c1f30-c4ce-48fd-96b2-cc1b177f6864"><enum>(D)</enum><header display-inline="yes-display-inline">Monitoring and
		  inspection reports</header><text display-inline="yes-display-inline">The plan shall include a certification that
		  the State, not later than 1 year after the State has in effect the policies and
		  practices described in subparagraph (K)(i), will make public by electronic
		  means, in a consumer-friendly and easily accessible format, organized by
		  provider, the results of monitoring and inspection reports, including those due
		  to major substantiated complaints about failure to comply with this subchapter
		  and State child care policies, as well as the number of deaths, serious
		  injuries, and instances of substantiated child abuse that occurred in child
		  care settings each year, for eligible child care providers within the State.
		  The results shall also include information on the date of such an inspection
		  and, where applicable, information on corrective action taken.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4f9449c1-3cd2-45f9-b715-fd38daace4e3"><enum>(E)</enum><header display-inline="yes-display-inline">Consumer
		  education information</header><text display-inline="yes-display-inline">The plan shall include a certification that
		  the State will collect and disseminate (which dissemination may be done, except
		  as otherwise specified in this subparagraph, through resource and referral
		  organizations or other means as determined by the State) to parents of eligible
		  children and the general public—</text><clause commented="no" display-inline="no-display-inline" id="id51fbc963-1305-4e35-b5bd-e6cd203d26a0"><enum>(i)</enum><text display-inline="yes-display-inline">information that
		  will promote informed child care choices and that concerns—</text><subclause commented="no" display-inline="no-display-inline" id="id973a2649-f427-4880-a964-90a417211ed2"><enum>(I)</enum><text display-inline="yes-display-inline">the availability
		  of child care services provided through programs authorized under this
		  subchapter and, if feasible, other child care services and other programs
		  provided in the State for which the family may be eligible;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida9cef47b-82f2-4bfe-a905-5c9889fca7d4"><enum>(II)</enum><text display-inline="yes-display-inline">if available,
		  information about the quality of providers, including information from a
		  Quality Rating and Improvement System;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id10c77762-ab04-42d2-99b9-63338903c21a"><enum>(III)</enum><text display-inline="yes-display-inline">information,
		  made available through a State website, describing the State process for
		  licensing child care providers, the State processes for conducting background
		  checks, and monitoring and inspections, of child care providers, and the
		  offenses that prevent individuals and entities from serving as child care
		  providers in the State;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3f7a729f-ee89-4167-9d6d-904272d1c5ab"><enum>(IV)</enum><text display-inline="yes-display-inline">the availability
		  of assistance to obtain child care services;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3c83a7e9-d63b-4869-af67-b78f15c9d56c"><enum>(V)</enum><text display-inline="yes-display-inline">other programs
		  for which families that receive child care services for which financial
		  assistance is provided in accordance with this subchapter may be eligible,
		  including the program of block grants to States for temporary assistance for
		  needy families established under part A of title IV of the Social Security Act
		  (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>), Head Start and Early Head Start programs carried out
		  under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>), the program carried out
		  under the Low-Income Home Energy Assistance Act of 1981 (42 U.S.C. 8621 et
		  seq.), the supplemental nutrition assistance program established under the Food
		  and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>), the special supplemental
		  nutrition program for women, infants, and children established under	section 17
			 of
		  the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>), the child and adult care food
		  program established under section 17 of the Richard B. Russell National School
		  Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>), and the Medicaid and State children's health
		  insurance programs under titles XIX and XXI of the Social Security Act (42
		  U.S.C. 1396 et seq., 1397aa et seq.);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2a5a876c-5fd6-4175-ac3e-bc1491fb0396"><enum>(VI)</enum><text display-inline="yes-display-inline">programs carried
		  out under section 619 and part C of the Individuals with Disabilities Education
		  Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1419">20 U.S.C. 1419</external-xref>, 1431 et seq.); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id77c65277-e469-4169-9a4d-dc89c5f9fc21"><enum>(VII)</enum><text display-inline="yes-display-inline">research and
		  best practices concerning children's development, including language and
		  cognitive development, development of early language and literacy and
		  mathematics skills, social and emotional development, meaningful parent and
		  family engagement, and physical health and development (particularly healthy
		  eating and physical activity);</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id9735c9ff-93b3-4439-aa7a-1e796e3ce93a"><enum>(ii)</enum><text display-inline="yes-display-inline">information on
		  developmental screenings, including—</text><subclause commented="no" display-inline="no-display-inline" id="id2cbef87b-ede9-4e5a-a023-9d492592f4f3"><enum>(I)</enum><text display-inline="yes-display-inline">information on
		  existing (as of the date of submission of the application containing the plan)
		  resources and services the State can deploy, including the coordinated use of
		  the Early and Periodic Screening, Diagnosis, and Treatment program under the
		  Medicaid program carried out under title XIX of the Social Security Act (42
		  U.S.C. 1396 et seq.) and developmental screening services available under
		  section 619 and part C of the Individuals with Disabilities Education Act (20
		  U.S.C. 1419, 1431 et seq.), in conducting developmental screenings and
		  providing referrals to services, when appropriate, for children who receive
		  assistance under this subchapter; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id00f60ff3-b940-48dd-81d1-527036219ddb"><enum>(II)</enum><text display-inline="yes-display-inline">a description of
		  how a family or eligible child care provider may utilize the resources and
		  services described in subclause (I) to obtain developmental screenings for
		  children who receive assistance under this subchapter who may be at risk for
		  cognitive or other developmental delays, which may include social, emotional,
		  physical, or linguistic delays; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idda9ebdf9-d4c2-483b-9dc8-039593786a63"><enum>(iii)</enum><text display-inline="yes-display-inline">information,
		  for parents receiving assistance under the program of block grants to States
		  for temporary assistance for needy families under part A of title IV of the
		  Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>) and low-income parents, about
		  eligibility for assistance provided in accordance with this subchapter.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30d2fc95-6662-40c7-9846-e8b3bf4cd957"><enum>(F)</enum><header display-inline="yes-display-inline">Compliance with
		  State licensing requirements</header><clause commented="no" display-inline="no-display-inline" id="idaf2b59f7-b96a-450d-94b2-adf5fedfd33e"><enum>(i)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">The plan shall include a certification that the State
		  involved has in effect licensing requirements applicable to child care services
		  provided within the State, and provide a detailed description of such
		  requirements and of how such requirements are effectively enforced.</text></clause><clause commented="no" display-inline="no-display-inline" id="idc9da3d7a-1631-494b-872d-41c9100874db"><enum>(ii)</enum><header display-inline="yes-display-inline">License
		  exemption</header><text display-inline="yes-display-inline">If the State uses funding received under this
		  subchapter to support a child care provider that is exempt from the
		  corresponding licensing requirements described in clause (i), the plan shall
		  include a description stating why such licensing exemption does not endanger
		  the health, safety, or development of children who receive services from child
		  care providers who are exempt from such requirements.</text></clause><clause commented="no" display-inline="no-display-inline" id="idE02F66117F344A3F80D80E5510B21B7C"><enum>(iii)</enum><header display-inline="yes-display-inline">Requests for
		  relief</header><text display-inline="yes-display-inline">As described in section 658I(d), a State may request
		  relief from a provision of Federal law other than this subchapter that might
		  conflict with a requirement of this subchapter, including a licensing
		  requirement.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f64dbea-8eac-48b4-9b8f-8e68d5990cec"><enum>(G)</enum><header display-inline="yes-display-inline">Training
		  requirements</header><clause commented="no" display-inline="no-display-inline" id="id3f980a89-9a9a-42e3-8230-75bcb25573f9"><enum>(i)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">The plan shall describe the training requirements that
		  are in effect within the State that are designed to enable child care providers
		  to promote the social, emotional, physical, and cognitive development of
		  children and that are applicable to child care providers that provide services
		  for which assistance is provided in accordance with this subchapter in the
		  State.</text></clause><clause commented="no" display-inline="no-display-inline" id="id2ea93835-fe1e-495d-ae64-0c3d78d345ce"><enum>(ii)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The
		  plan shall provide an assurance that such training requirements—</text><subclause commented="no" display-inline="no-display-inline" id="id56713884-3c16-465e-afe3-e61a762b331c"><enum>(I)</enum><text display-inline="yes-display-inline">provide a set of
		  workforce and competency standards for child care providers that provide
		  services described in clause (i);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9dcd2a79-fa56-4c3b-ae77-3837fc3b970a"><enum>(II)</enum><text display-inline="yes-display-inline">are developed in
		  consultation with the State Advisory Council on Early Childhood Education and
		  Care (designated or established pursuant to section 642B(b)(1)(A)(i) of the Head
		  Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9837b">42 U.S.C. 9837b(b)(1)(A)(i)</external-xref>));</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id235970fb-f16d-4408-86c0-8be81d07c3c1"><enum>(III)</enum><text display-inline="yes-display-inline">include an
		  evidence-based training framework that is designed to promote children's
		  learning and development and school readiness and to improve child outcomes,
		  including school readiness and early language and literacy development;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida13d142b-2b44-4457-81d2-7b63e4cad0e0"><enum>(IV)</enum><text display-inline="yes-display-inline">incorporate
		  knowledge and application of the State's early learning and developmental
		  guidelines (where applicable), and the State's child development and health
		  standards; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id28776598-5802-4a26-9f6e-8c8a92307898"><enum>(V)</enum><text display-inline="yes-display-inline">to
		  the extent practicable, are appropriate for a population of children that
		  includes—</text><item commented="no" display-inline="no-display-inline" id="id5c534a91-b403-4308-a1eb-499861110ec7"><enum>(aa)</enum><text display-inline="yes-display-inline">different age
		  groups (such as infants, toddlers, and preschoolers);</text></item><item commented="no" display-inline="no-display-inline" id="id846d2e7b-3790-4bda-a09f-eeb141b86158"><enum>(bb)</enum><text display-inline="yes-display-inline">English
		  learners;</text></item><item commented="no" display-inline="no-display-inline" id="id636cc703-8559-49b3-87c4-71528d76adc9"><enum>(cc)</enum><text display-inline="yes-display-inline">children with
		  disabilities; and</text></item><item commented="no" display-inline="no-display-inline" id="id6f884cc8ee524c4d972923fb7ca5201b"><enum>(dd)</enum><text display-inline="yes-display-inline">Native Americans, including Indians, as the
		  term is defined in section 4 of the Indian Self-Determination and Education
		  Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>) (including Alaska Natives within the meaning of
			 that term), and Native Hawaiians (as defined in section 7207 of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7517)).</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id94ee4c81-31db-4253-a040-4fc305a4eb16"><enum>(iii)</enum><header display-inline="yes-display-inline">Progression
		  of professional development</header><text display-inline="yes-display-inline">In developing the requirements, the
		  State shall develop a statewide progression of professional development
		  designed to improve the skills and knowledge of the workforce—</text><subclause commented="no" display-inline="no-display-inline" id="id68C7F301D95F4FF1A6247C7611B93A49"><enum>(I)</enum><text display-inline="yes-display-inline">which may include
		  the acquisition of course credit in postsecondary education or of a credential,
		  aligned with the framework; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3F7C6C88ABEC41FC985007D941529233"><enum>(II)</enum><text display-inline="yes-display-inline">which shall be
		  accessible to providers supported through Indian tribes or tribal organizations
		  that receive assistance under this subchapter.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ida0b3bd63-3402-4f80-aba1-e05cf7f8115f"><enum>(iv)</enum><header display-inline="yes-display-inline">Alignment</header><text display-inline="yes-display-inline">The
		  State shall engage the State Advisory Council on Early Childhood Education and
		  Care, and may engage institutions of higher education (as defined in section
		  102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)), and other training
		  providers in aligning training opportunities with the State’s training
		  framework.</text></clause><clause commented="no" display-inline="no-display-inline" id="id70fb2f77-0d6e-4116-bb09-5b2d1602f97b"><enum>(v)</enum><header display-inline="yes-display-inline">Credentials</header><text display-inline="yes-display-inline">The
		  Secretary shall not require an individual or entity that provides child care
		  services for which assistance is provided in accordance with this subchapter to
		  acquire a credential to provide such services. Nothing in this section shall be
		  construed to prohibit a State from requiring a credential.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9150fa91-de14-4bb5-907b-173fb8ae175b"><enum>(H)</enum><header display-inline="yes-display-inline">Child-to-provider
		  ratio standards</header><clause commented="no" display-inline="no-display-inline" id="id48c9ceb1-c85c-4ef5-8bd5-753a2b9ed421"><enum>(i)</enum><header display-inline="yes-display-inline">Standards</header><text display-inline="yes-display-inline">The
		  plan shall describe child care standards, for child care for which assistance
		  is made available in accordance with this subchapter, appropriate to the type
		  of child care setting involved, that address—</text><subclause commented="no" display-inline="no-display-inline" id="id06d2d454-ab4d-4031-a1ca-cdee3e4a884e"><enum>(I)</enum><text display-inline="yes-display-inline">group size limits
		  for specific age populations;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida5a303ec-383d-4848-ac09-db9702ab26d5"><enum>(II)</enum><text display-inline="yes-display-inline">the appropriate
		  ratio between the number of children and the number of providers, in terms of
		  the age of the children in child care, as determined by the State; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb53ab497-85c4-41f5-b912-b096f17ba628"><enum>(III)</enum><text display-inline="yes-display-inline">required
		  qualifications for such providers.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id4e917424-eb4e-465c-9f76-5ee0ed1bfe77"><enum>(ii)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">The
		  Secretary may offer guidance to States on child-to-provider ratios described in
		  clause (i) according to setting and age group but shall not require that States
		  maintain specific child-to-provider ratios for providers who receive assistance
		  under this subchapter.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide6bf6a97-525e-4e86-8ffc-621cc4f1a456"><enum>(I)</enum><header display-inline="yes-display-inline">Health and
		  safety requirements</header><text display-inline="yes-display-inline">The plan shall include a certification that
		  there are in effect within the State, under State or local law, requirements
		  designed to protect the health and safety of children that are applicable to
		  child care providers that provide services for which assistance is made
		  available in accordance with this subchapter. Such requirements—</text><clause commented="no" display-inline="no-display-inline" id="id98eef9ec-d820-4c8b-a0e1-6cf75a131906"><enum>(i)</enum><text display-inline="yes-display-inline">shall
		  relate to matters including health and safety topics (including prevention of
		  shaken baby syndrome and abusive head trauma) consisting of—</text><subclause commented="no" display-inline="no-display-inline" id="id72045f73-ded0-471f-8cb3-d8ebdd80098a"><enum>(I)</enum><text display-inline="yes-display-inline">the prevention
		  and control of infectious diseases (including immunization) and the
		  establishment of a grace period that allows homeless children and children in
			 foster care to receive services under this subchapter while their families
			 (including foster families) are taking any necessary
		  action to comply with immunization and other health and safety
		  requirements;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5763572b-803b-4295-ad5b-33433bd9f6e5"><enum>(II)</enum><text display-inline="yes-display-inline">handwashing and
		  universal health precautions;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd1696c63-e78c-451d-a3b6-d6ab0635e972"><enum>(III)</enum><text display-inline="yes-display-inline">the
		  administration of medication, consistent with standards for parental
		  consent;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idfae9acbe-720d-4b63-8e9e-794da10345b6"><enum>(IV)</enum><text display-inline="yes-display-inline">the prevention
		  of and response to emergencies due to food and other allergic reactions;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc55c91c8-cb5a-4868-b57f-427f46519ca7"><enum>(V)</enum><text display-inline="yes-display-inline">prevention of
		  sudden infant death syndrome and use of safe sleeping practices;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2b4baf5e-5e15-475d-95b6-ff07b46ffbfb"><enum>(VI)</enum><text display-inline="yes-display-inline">sanitary methods
		  of food handling;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0c2d66c6-ebe8-451b-8577-7eca51c1181c"><enum>(VII)</enum><text display-inline="yes-display-inline">building and
		  physical premises safety;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide55a6e3f-0f44-4680-8a34-a9a970830d7f"><enum>(VIII)</enum><text display-inline="yes-display-inline">emergency
		  preparedness and response planning for emergencies resulting from a natural
		  disaster, or a man-caused event (such as violence at a child care facility),
		  within the meaning of those terms under section 602(a)(1) of the Robert T.
		  Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
		  5195a(a)(1));</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida2a5b221-4e50-4448-880a-aee417cb4c84"><enum>(IX)</enum><text display-inline="yes-display-inline">the handling and
		  storage of hazardous materials and the appropriate disposal of
		  biocontaminants;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5cb0bf08-84d1-4d64-a94b-b76867780d78"><enum>(X)</enum><text display-inline="yes-display-inline">identification of
		  and protection from hazards that can cause bodily injury such as electrical
		  hazards, bodies of water, and vehicular traffic;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd762357b-8bbc-4d8e-b17b-eeac013c7efe"><enum>(XI)</enum><text display-inline="yes-display-inline">for providers
		  that offer transportation, if applicable, appropriate precautions in
		  transporting children;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id75c53a8d-15ca-4bab-8f4c-05083d1712c7"><enum>(XII)</enum><text display-inline="yes-display-inline">first aid and
		  car­dio­pul­mo­nary resuscitation; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2b635ea1-9cf9-427d-98e2-3b977abf2ef7"><enum>(XIII)</enum><text display-inline="yes-display-inline">minimum health
		  and safety training, to be completed pre-service or during an orientation
		  period, appropriate to the provider setting involved that addresses each of the
		  requirements relating to matters described in subclauses (I) through (XII);
		  and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ida4ee2c53-fd47-42a0-92f3-075889018ff2"><enum>(ii)</enum><text display-inline="yes-display-inline">may
		  include requirements relating to nutrition, access to physical activity, or any
		  other subject area determined by the State to be necessary to promote child
		  development or to protect children's health and safety.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f6d519e-c8e4-4a20-8003-9a15ff89647d"><enum>(J)</enum><header display-inline="yes-display-inline">Compliance with
		  State and local health and safety requirements</header><text display-inline="yes-display-inline">The plan shall
		  include a certification that procedures are in effect to ensure that child care
		  providers within the State, that provide services for which assistance is made
		  available in accordance with this subchapter, comply with all applicable State
		  and local health and safety requirements as described in subparagraph
		  (I).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4fc7e207-00d9-40f7-9ef7-51dce1c92004"><enum>(K)</enum><header display-inline="yes-display-inline">Enforcement of
		  licensing and other regulatory requirements</header><clause commented="no" display-inline="no-display-inline" id="id5A22B2CC2FC34C8F8A434207C9903C09"><enum>(i)</enum><header display-inline="yes-display-inline">Certification</header><text display-inline="yes-display-inline">The
		  plan shall include a certification that the State, not later than 2 years after
		  the date of enactment of the <short-title>Child Care and Development Block Grant Act of 2014</short-title>, shall have in effect
		  policies and practices, applicable to licensing or regulating child care
		  providers that provide services for which assistance is made available in
		  accordance with this subchapter and the facilities of those providers,
		  that—</text><subclause commented="no" display-inline="no-display-inline" id="id345097a3-6a2a-4fba-9bc6-cdb4a222ba0a"><enum>(I)</enum><text display-inline="yes-display-inline">ensure that
		  individuals who are hired as licensing inspectors in the State are qualified to
		  inspect those child care providers and facilities and have received training in
		  related health and safety requirements, child development, child abuse
		  prevention and detection, program management, and relevant law
		  enforcement;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3ef0daab-cf83-4889-8b69-4945fa70876a"><enum>(II)</enum><text display-inline="yes-display-inline">require
		  licensing inspectors (or qualified inspectors designated by the lead agency)
		  of those child care providers and facilities to perform inspections,
		  with—</text><item commented="no" display-inline="no-display-inline" id="id428f0162-1458-4d01-a923-134d53733e1d"><enum>(aa)</enum><text display-inline="yes-display-inline">not
		  less than 1 prelicensure inspection for compliance with health, safety, and
		  fire standards, of each such child care provider and facility in the State;
		  and</text></item><item commented="no" display-inline="no-display-inline" id="idfc9c78a8c409497ca54ac26fe2fc5e2f"><enum>(bb)</enum><text display-inline="yes-display-inline">not
		  less than annually, an inspection (which shall be unannounced) of each such
		  child care provider and facility in the State for compliance with all child
		  care licensing standards, which shall include an inspection for compliance with
		  health, safety, and fire standards (although inspectors may or may not inspect
		  for compliance with all 3 standards at the same time); and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idc2f58b63-3ac8-4877-ab68-1b5b910523f0"><enum>(III)</enum><text display-inline="yes-display-inline">require the
		  ratio of licensing inspectors to such child care providers and facilities in
		  the State to—</text><item commented="no" display-inline="no-display-inline" id="idC89201437E0C44609ED71020E4EBB6AD"><enum>(aa)</enum><text display-inline="yes-display-inline">be
		  maintained at a level sufficient to enable the State to conduct inspections of
		  such child care providers and facilities on a timely basis in accordance with
		  Federal and State law; and</text></item><item commented="no" display-inline="no-display-inline" id="id75C55392A54E422BB3F6EA0242E83FA0"><enum>(bb)</enum><text display-inline="yes-display-inline">be
		  consistent with research findings and best practices.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idA8D39575363D467D93D2DDBE0E71BD09"><enum>(ii)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">The
		  Secretary may offer guidance to a State, if requested by the State, on a
		  research-based minimum standard regarding ratios described in clause (i)(III)
		  and provide technical assistance to the State on meeting the minimum standard
		  within a reasonable time period, but shall not prescribe a particular
		  ratio.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4c90a678-64ef-40b7-b93e-5eba8fdaaaa9"><enum>(L)</enum><header display-inline="yes-display-inline">Compliance with
		  child abuse reporting requirements</header><text display-inline="yes-display-inline">The plan shall include a
		  certification that child care providers within the State will comply with the
		  child abuse reporting requirements of section 106(b)(2)(B)(i) of the Child
		  Abuse Prevention and Treatment Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5106a">42 U.S.C. 5106a(b)(2)(B)(i)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id82cc27b1-9997-4af7-abb5-fce26c1a97d6"><enum>(M)</enum><header display-inline="yes-display-inline">Meeting the
		  needs of certain populations</header><text display-inline="yes-display-inline">The plan shall describe how the
		  State will develop and implement strategies (which may include the provision of
		  compensation at higher payment rates and bonuses to child care providers, the
		  provision of direct contracts or grants to community-based organizations,
			 offering child care certificates to parents, or
		  other means determined by the State) to increase the supply and improve the
		  quality of child care for—</text><clause commented="no" display-inline="no-display-inline" id="id72fef03e-81e9-42f5-a3e0-a9b319ce9515"><enum>(i)</enum><text display-inline="yes-display-inline">children in
		  underserved areas;</text></clause><clause commented="no" display-inline="no-display-inline" id="id41370503-d398-4498-a268-ca5da371ab3a"><enum>(ii)</enum><text display-inline="yes-display-inline">infants and
		  toddlers;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9991168c-55df-44be-bdd1-3debb46be224"><enum>(iii)</enum><text display-inline="yes-display-inline">children with
		  disabilities, as defined by the State; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd26158d6-f0ec-4f4a-a830-709684ce66a4"><enum>(iv)</enum><text display-inline="yes-display-inline">children who
		  receive care during nontraditional hours.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id16f324c4-4402-48f2-9e0c-d9259491ec34"><enum>(N)</enum><header display-inline="yes-display-inline">Protection for
		  working parents</header><clause commented="no" display-inline="no-display-inline" id="id2a6db008-62bd-4522-b194-19682eca60af"><enum>(i)</enum><header display-inline="yes-display-inline">Minimum
		  period</header><subclause commented="no" display-inline="no-display-inline" id="id7657edb0-588f-4ee6-8891-e6296826f10c"><enum>(I)</enum><header display-inline="yes-display-inline">12-month
		  period</header><text display-inline="yes-display-inline">The plan shall demonstrate that each child who receives
		  assistance under this subchapter in the State will be considered to meet all
		  eligibility requirements for such assistance and will receive such assistance,
		  for not less than 12 months before the State redetermines the eligibility of
		  the child under this subchapter, regardless of a temporary change in the
		  ongoing status of the child's parent as working or attending a job training or
		  educational program or a change in family income for the child's family, if
		  that family income does not exceed 85 percent of the State median income for a
		  family of the same size.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id18723c70-717e-49ac-a75e-b2e2d7b2e292"><enum>(II)</enum><header display-inline="yes-display-inline">Fluctuations
		  in earnings</header><text display-inline="yes-display-inline">The plan shall demonstrate how the State's processes
		  for initial determination and redetermination of such eligibility take into
		  account irregular fluctuations in earnings.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7405aca8-c8f4-4b71-841b-ce74a069a580"><enum>(ii)</enum><header display-inline="yes-display-inline">Redetermination
		  process</header><text display-inline="yes-display-inline">The plan shall describe the procedures and policies that
		  are in place to ensure that working parents (especially parents in families
		  receiving assistance under the program of block grants to States for temporary
		  assistance for needy families under part A of title IV of the Social Security
		  Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>)) are not required to unduly disrupt their
		  employment in order to comply with the State's requirements for redetermination
		  of eligibility for assistance provided in accordance with this
		  subchapter.</text></clause><clause commented="no" display-inline="no-display-inline" id="idc189c201-fbb0-4c32-9254-83b2ab3fe67e"><enum>(iii)</enum><header display-inline="yes-display-inline">Period before
		  termination</header><text display-inline="yes-display-inline">At the option of the State, the plan shall
		  demonstrate that the State will not terminate assistance provided to carry out
		  this subchapter based on a factor consisting of a parent's loss of work or
		  cessation of attendance at a job training or educational program for which the
		  family was receiving the assistance, without continuing the assistance for a
		  reasonable period of time, of not less than 3 months, after such loss or
		  cessation in order for the parent to engage in a job search and resume work, or
		  resume attendance at a job training or educational program, as soon as
		  possible.</text></clause><clause commented="no" display-inline="no-display-inline" id="ida9fbb77d-c25c-4f17-805b-0bd0ec38bc28"><enum>(iv)</enum><header display-inline="yes-display-inline">Graduated
		  phaseout of care</header><text display-inline="yes-display-inline">The plan shall describe the policies and
		  procedures that are in place to allow for provision of continued assistance to
		  carry out this subchapter, at the beginning of a new eligibility period under
		  clause (i)(I), for children of parents who are working or attending a job
		  training or educational program and whose family income exceeds the State's
		  income limit to initially qualify for such assistance, if the family income for
		  the family involved does not exceed 85 percent of the State median income for a
		  family of the same size.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61391e17-0c37-4606-ab76-d45b87f3ecb1"><enum>(O)</enum><header display-inline="yes-display-inline">Coordination
		  with other programs</header><clause commented="no" display-inline="no-display-inline" id="id75dc131a-5677-4ac0-ac65-44cc5005c531"><enum>(i)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">The plan shall describe how the State, in order to expand
		  accessibility and continuity of quality early childhood education and care, and
		  assist children enrolled in prekindergarten, Early Head Start, or Head Start
		  programs to receive full-day services, will efficiently coordinate the services
			 supported
		  to carry out this subchapter with—</text><subclause commented="no" display-inline="no-display-inline" id="id9c16b463-6734-46ba-9672-c48cf163889e"><enum>(I)</enum><text display-inline="yes-display-inline">programs carried
		  out under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>), including the Early Head
		  Start programs carried out under section 645A of that Act (42 U.S.C.
		  9840a);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide518b1d8-493f-4abe-b492-547666a020be"><enum>(II)</enum><text display-inline="yes-display-inline">programs carried
		  out under part A of title I, and part B of title IV, of the Elementary and
		  Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>, 7171 et seq.);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf99acbf6-ae53-40c9-ba4e-829ff5a6dda2"><enum>(III)</enum><text display-inline="yes-display-inline">programs
		  carried out under section 619 and part C of the Individuals with Disabilities
		  Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1419">20 U.S.C. 1419</external-xref>, 1431 et seq.);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd9784eec-083a-401b-9fe6-7115c5ea73b0"><enum>(IV)</enum><text display-inline="yes-display-inline">the maternal,
		  infant, and early childhood home visiting programs authorized under section 511
		  of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/711">42 U.S.C. 711</external-xref>), as added by section 2951 of the
		  Patient Protection and Affordable Care Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/148">Public Law 111–148</external-xref>);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0f8945fb-f16d-4037-a441-131986be7a08"><enum>(V)</enum><text display-inline="yes-display-inline">State, Indian tribe or tribal organization,
		  and locally funded early childhood education and care programs;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf2feb177-289a-4e53-8bed-0ea3e9504c8f"><enum>(VI)</enum><text display-inline="yes-display-inline">programs serving
		  homeless children and services of local educational agency liaisons for
		  homeless children and youths designated under subsection (g)(1)(J)(ii) of
		  section 722 of the McKinney-Vento Homeless Assistance Act (42 U.S.C.
		  11432(g)(1)(J)(ii));</text></subclause><subclause id="id3830115820F64B0FB1DCC5785997AD47"><enum>(VII)</enum><text>State agencies and programs serving children in foster care and the foster families of such
			 children; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3a59a3ef-158c-49a3-967c-8fec1cc9c4fb"><enum>(VIII)</enum><text display-inline="yes-display-inline">other Federal
		  programs supporting early childhood education and care activities, and, where
		  applicable, child care programs funded through State veterans affairs
		  offices.</text></subclause></clause><clause id="id770B82DF3A7947EEBB5634E8935EEF4B"><enum>(ii)</enum><header>Optional use of combined funds</header><text>If the State elects to combine funding for the services supported to carry out this subchapter with
			 funding for any program described in subclauses (I) through (VII) of
			 clause (i), the plan shall describe how the State will combine the 
			 multiple sets of funding and use the combined funding.</text></clause><clause commented="no" display-inline="no-display-inline" id="idd5f782a0-b606-4306-a0f3-c2f0968b6744"><enum>(iii)</enum><header display-inline="yes-display-inline">Rule of
		  construction</header><text display-inline="yes-display-inline">Nothing in clause (i) shall be construed to affect
		  the priority of children described in clause (i) to receive full-day
		  prekindergarten or Head Start program services.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81aa0ee0-6ba8-4796-8588-12ec0d5f82dd"><enum>(P)</enum><header display-inline="yes-display-inline">Public-private
		  partnerships</header><text display-inline="yes-display-inline">The plan shall demonstrate how the State encourages
		  partnerships among State agencies, other public agencies, Indian tribes and
		  tribal organizations, and private entities to leverage existing service
		  delivery systems (as of the date of the submission of the application
		  containing the plan) for early childhood education and care and to increase the
		  supply and quality of child care services for children who are less than 13
		  years of age, such as by implementing voluntary shared services alliance
		  models.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id226b04f6-a572-40c6-9126-979ca9caae26"><enum>(Q)</enum><header display-inline="yes-display-inline">Priority for
		  low-income populations</header><text display-inline="yes-display-inline">The plan shall describe the process the
		  State proposes to use, with respect to investments made to increase access to
		  programs providing high-quality early childhood education and care, to give
		  priority for those investments to children of families in areas that have
		  significant concentrations of poverty and unemployment and that do not have
		  such programs.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd105b0f3-4278-4aa6-931b-5971107cf128"><enum>(R)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The
		  plan shall include a certification that the State has developed the plan in
		  consultation with the State Advisory Council on Early Childhood Education and
		  Care designated or  established pursuant to section 642B(b)(1)(A)(i) of the Head
			 Start Act (42
		  U.S.C. 9837b(b)(1)(A)(i)).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id412c8d28-9127-43ee-bcf1-ed4e9197bfec"><enum>(S)</enum><header display-inline="yes-display-inline">Payment
		  practices</header><text display-inline="yes-display-inline">The plan shall include a certification that the payment
		  practices of child care providers in the State that serve children who receive
		  assistance under this subchapter reflect generally accepted payment practices
		  of child care providers in the State that serve children who do not receive
		  assistance under this subchapter, so as to provide stability of funding and
		  encourage more child care providers to serve children who receive assistance
		  under this subchapter.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b1c5c6e-359f-4e1a-99be-23a6cef862aa"><enum>(T)</enum><header display-inline="yes-display-inline">Early learning
		  and developmental guidelines</header><clause commented="no" display-inline="no-display-inline" id="id219b288b-5644-418d-bac2-746d6900530a"><enum>(i)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">The plan shall include an assurance that the State will
		  develop or implement early learning and developmental guidelines that are
		  appropriate for children from birth through entry into kindergarten, describing
		  what such children should know and be able to do, and covering the essential
		  domains of early childhood education and care and early childhood development
		  for use statewide by child care providers. Such child care providers
		  shall—</text><subclause commented="no" display-inline="no-display-inline" id="idea2ea3f8-7192-4d7b-b60f-2a236c0ac2c6"><enum>(I)</enum><text display-inline="yes-display-inline">be
		  licensed or regulated under State law; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf33971f3-a309-4866-b564-f3c24463c3c1"><enum>(II)</enum><text display-inline="yes-display-inline">not be a
		  relative of all children for whom the provider provides child care
		  services.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf11e7b73-ca9a-4f96-b686-830eda3db85e"><enum>(ii)</enum><header display-inline="yes-display-inline">Alignment</header><text display-inline="yes-display-inline">The
		  guidelines shall be research-based, developmentally appropriate, and aligned with
			 State standards for education in kindergarten through grade
		  3.</text></clause><clause commented="no" display-inline="no-display-inline" id="id36fcad07-d82d-45bf-ae34-ea36aae2c521"><enum>(iii)</enum><header display-inline="yes-display-inline">Prohibition
		  on use of funds</header><text display-inline="yes-display-inline">The plan shall include an assurance that funds
		  received by the State to carry out this subchapter will not be used to develop
		  or implement an assessment for children that—</text><subclause commented="no" display-inline="no-display-inline" id="ide0099989-4196-443c-8fa4-e7320f610f48"><enum>(I)</enum><text display-inline="yes-display-inline">will be the sole
		  basis for a child care provider being determined to be ineligible to
		  participate in the program carried out under this subchapter;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id05fb48b0-686a-4716-93bd-a28fcbcd5113"><enum>(II)</enum><text display-inline="yes-display-inline">will be used as
		  the primary or sole basis to provide a reward or sanction for an individual
		  provider;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id7dc536c1-b636-4e5d-bf07-423d6c472091"><enum>(III)</enum><text display-inline="yes-display-inline">will be used as
		  the primary or sole method for assessing program effectiveness; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb1215bdec2404812a1ea0631b009ec46"><enum>(IV)</enum><text display-inline="yes-display-inline">will be used to
		  deny eligibility to participate in the program carried out under this
		  subchapter.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="iddde57c3b-1099-4685-be9b-b93f106fbee3"><enum>(iv)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">Nothing
		  in this subchapter shall preclude the State from using a single assessment (if
		  appropriate) for children for—</text><subclause commented="no" display-inline="no-display-inline" id="id9e86ff96-fe4c-4e35-b2f8-a7c940ebbe70"><enum>(I)</enum><text display-inline="yes-display-inline">supporting
		  learning or improving a classroom environment;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1658f4ee-b446-4bda-869c-b8e2c9a3b7f2"><enum>(II)</enum><text display-inline="yes-display-inline">targeting
		  professional development to a provider;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc013d98e-4704-43ed-a232-6e36d3a404a8"><enum>(III)</enum><text display-inline="yes-display-inline">determining the
		  need for health, mental health, disability, developmental delay, or family
		  support services;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="iddd5c6c00-57fa-4843-8e79-52776f8ecf0e"><enum>(IV)</enum><text display-inline="yes-display-inline">obtaining
		  information for the quality improvement process at the State level; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb9875e09-717f-40b2-b71d-0e77870ee0b3"><enum>(V)</enum><text display-inline="yes-display-inline">conducting a
		  program evaluation for the purposes of providing program improvement and parent
		  information.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idd687484a-6270-4223-bbcb-e69d965999d2"><enum>(v)</enum><header display-inline="yes-display-inline">No
		  Federal control</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to
		  authorize an officer or employee of the Federal Government to—</text><subclause commented="no" display-inline="no-display-inline" id="id3e68034e-0185-4c4e-9e8a-3e9c646a23bd"><enum>(I)</enum><text display-inline="yes-display-inline">mandate, direct,
		  or control a State's early learning and developmental guidelines, developed in
		  accordance with this section;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id82e3696c-f4ac-4899-8d03-1d266e600b25"><enum>(II)</enum><text display-inline="yes-display-inline">establish any
		  criterion that specifies, defines, or prescribes the standards or measures that
		  a State uses to establish, implement, or improve—</text><item commented="no" display-inline="no-display-inline" id="id293751ea-9dc8-4147-9eae-6b2f6956d596"><enum>(aa)</enum><text display-inline="yes-display-inline">early
		  learning and developmental guidelines, or early learning standards,
		  assessments, or accountability systems; or</text></item><item commented="no" display-inline="no-display-inline" id="id6857a58d-248b-4b2b-b143-127d07d3c303"><enum>(bb)</enum><text display-inline="yes-display-inline">alignment of
		  early learning and developmental guidelines with State standards for education
		  in kindergarten through grade 3; or</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id0ebbd693-d9e9-4001-b79d-b6b9334b2f60"><enum>(III)</enum><text>require a State to submit such standards or measures for review.</text></subclause></clause></subparagraph><subparagraph id="id5F4CADFE1C3941D7B5BC73BCEBEAB507"><enum>(U)</enum><header>Disaster preparedness</header><clause id="idDE9C13A9D54E4D129E4BC3C36BB2C40F"><enum>(i)</enum><header>In general</header><text>The plan shall demonstrate the manner in which the State will address the needs of children in
			 child care services provided through programs authorized under this
			 subchapter, including the need for safe child care, during the period
			 before, during, and after a state of
			 emergency declared by the Governor or a major disaster or emergency (as
			 such terms are defined in section 102 of the Robert T. Stafford Disaster
			 Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>)).</text></clause><clause id="idC555BC5DD5264018AC3E3AB946C5F63F"><enum>(ii)</enum><header>Statewide child care disaster plan</header><text>Such plan shall include a statewide child care disaster plan for coordination of activities and
			 collaboration, in the event of an emergency or disaster described in
			 clause (i), among the	    State agency with jurisdiction over human
			 services, the agency with jurisdiction over State emergency planning, the
			 State lead agency, the State agency with jurisdiction over licensing of
			 child care providers, the local resource and referral organizations, the
			 State resource and referral system, and the State Advisory Council on
			 Early
			 Childhood Education and Care as provided for under section 642B(b) of the
			 Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9837b">42 U.S.C. 9837b(b)</external-xref>).</text></clause><clause id="id38F16DFD032C4956AE2B0803AEF14637"><enum>(iii)</enum><header>Disaster plan components</header><text>The components of the disaster plan, for such an emergency or disaster, shall include—</text><subclause id="idDEEFCE6392F341D89F3BD5E4B8789B30"><enum>(I)</enum><text>guidelines for the continuation of child care services in the period following the emergency or
			 disaster, including the provision of emergency and temporary child care
			 services, and temporary operating standards for child care providers
			 during that period;</text></subclause><subclause id="id825AAA29CF3A48B492A42010AC04E76A"><enum>(II)</enum><text>evacuation, relocation, shelter-in-place, and lock-down procedures, and procedures for
			 communication and reunification with families, continuity of operations,
			 and accommodation of  infants and toddlers, children with disabilities,
			 and children with  chronic medical
			 conditions; and</text></subclause><subclause id="id9105CDC0C77A44B69CCDED8DF2665AE3"><enum>(III)</enum><text>procedures for staff and volunteer training and practice drills.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id530ee8f5-a1fd-4d24-b6a9-95789ac88152"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph
		(3)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ided728246-f851-404f-b64c-e4096a598ad6"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph
		(A), by striking <quote>as required under</quote> and inserting <quote>in
		accordance with</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79996bba-e004-43ee-b4fa-82b6b840b642"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph
		(B)—</text><clause commented="no" display-inline="no-display-inline" id="id43d0433c-27dc-45b0-ba3e-a8ce4b597d11"><enum>(i)</enum><text display-inline="yes-display-inline">by striking
		<quote>The State</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id3a8ad5e3-ae8f-48f3-9536-60bf02b19714" style="OLC"><clause commented="no" display-inline="no-display-inline" id="id8627c2aa-e81d-45a9-b9c7-2bcdec72d418"><enum>(i)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">The
		  State</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="idc150359f-8af4-4ea7-9472-75cb21394328"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking
		<quote>and any other activity that the State deems appropriate to realize any
		of the goals specified in paragraphs (2) through (5) of section 658A(b)</quote>
		and inserting <quote>activities that improve access to child care services,
		including use of procedures to permit immediate enrollment (after the initial
		eligibility determination and after a child is determined to be eligible) of
		homeless children while required documentation is obtained, training and
		technical assistance on identifying and serving homeless children and their
		families, and specific outreach to homeless families, and any other activity
		that the State determines to be appropriate to meet the purposes of this
		subchapter (which may include an activity described in clause (ii))</quote>;
		and</text></clause><clause commented="no" display-inline="no-display-inline" id="idea5176f4-a2c3-443a-9ca3-79b3704fa74b"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at
		the end the following:</text><quoted-block display-inline="no-display-inline" id="id988fd86d-428a-44eb-9e7a-98dbf32728eb" style="OLC"><clause id="id5D3C9891A93B47BEBA97B91DE070CFA2"><enum>(ii)</enum><header>Report by Assistant Secretary for Children and Families</header><subclause id="idFDEE2F9F006B4F1AB1AD5E9966A1349D"><enum>(I)</enum><header>In general</header><text>Not later than September 30 of the first full fiscal year after the date of enactment of the Child
			 Care and Development Block Grant Act of 2014, and September 30 of each
			 fiscal year thereafter, the Secretary (acting through the Assistant
			 Secretary for Children and Families of the Department of Health and Human
			 Services) shall prepare a report that contains
			 a determination about whether each State uses amounts provided to such
			 State for the fiscal year involved under this subchapter in accordance
			 with the
			 priority for services described in clause (i).</text></subclause><subclause id="id4EC44623C91E4FD386DBB72093FE1531"><enum>(II)</enum><header>Penalty for noncompliance</header><text>For any fiscal year that the report of the Secretary
			 described in subclause (I) indicates
			 that a State has failed to give priority for services in accordance
			 with clause (i), the Secretary shall—</text><item id="idF0E7D2E4CB854FE5B65B4351DFD4C4B7"><enum>(aa)</enum><text>inform the State that the State has until the date that is 6
			 months after the Secretary has issued such report  to fully comply
			 with
			 clause (i);</text></item><item id="id4B6454311F0F430099EFE4B06E96F559"><enum>(bb)</enum><text>provide the State an opportunity to modify the State plan of such State, to make the plan
			 consistent with the requirements of clause (i), and resubmit such State
			 plan to the Secretary not later than the date described in item (aa); and</text></item><item id="id32E8C8C84DCF450B9FC369174C50C856"><enum>(cc)</enum><text>if the State does not fully comply with clause (i) and item (bb), by the date described in item
			 (aa), withhold 5 percent of the
			 funds that would otherwise be allocated to that State in accordance with
			 this subchapter for the first full fiscal year after that date.</text></item></subclause><subclause id="id2EF650F362D64D399E4E4BAFA202C794"><enum>(III)</enum><header>Waiver for Extraordinary Circumstances</header><text>Notwithstanding subclause (II) the Secretary may grant a 
waiver to a State for one year to the penalty applied in subclause (II) if the Secretary determines
			 there 
are extraordinary circumstances, such as a natural disaster, that prevent the State from complying
			 with 
clause (i). If the Secretary does grant a waiver to a State under this section, the Secretary
			 shall, within
30 days of granting such waiver, submit a report to the appropriate congressional committees on the 
circumstances of the waiver including the stated reason from the State on the need for a waiver,
			 the 
expected impact of the waiver on children served under this program, and any such other relevant 
information the Secretary deems necessary.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1e33f17c-e2f2-4982-921e-605b6ffe1d77"><enum>(iii)</enum><header display-inline="yes-display-inline">Child care
		  resource and referral system</header><subclause commented="no" display-inline="no-display-inline" id="id7937545f-d579-4dfb-8483-7d3ab4480377"><enum>(I)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">A State may use amounts described in clause (i) to
		  establish or support a system of local or regional child care resource and
		  referral organizations that is coordinated, to the extent determined
		  appropriate by the State, by a statewide public or private nonprofit,
		  community-based or regionally based, lead child care resource and referral
		  organization.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8948e023-0127-4a0e-a21b-0e2751173423"><enum>(II)</enum><header display-inline="yes-display-inline">Local or
		  regional organizations</header><text display-inline="yes-display-inline">The local or regional child care resource
		  and referral organizations supported as described in subclause (I)
		  shall—</text><item commented="no" display-inline="no-display-inline" id="id981fb0cc-ef5c-49fb-8ec2-b832042a1e1a"><enum>(aa)</enum><text display-inline="yes-display-inline">provide parents
		  in the State with consumer education information referred to in paragraph
		  (2)(E) (except as otherwise provided in that paragraph), concerning the full
		  range of child care options, analyzed by provider, including child care
		  provided during nontraditional hours and through emergency child care centers,
		  in their political subdivisions or regions;</text></item><item commented="no" display-inline="no-display-inline" id="id68754e0d-17d3-4079-b501-ba8ebec8dc2a"><enum>(bb)</enum><text display-inline="yes-display-inline">to the
		  extent practicable, work directly with families who receive assistance under
		  this subchapter to offer the families support and assistance, using information
		  described in item (aa), to make an informed decision about which child care
		  providers they will use, in an effort to ensure that the families are enrolling
		  their children in high-quality care;</text></item><item commented="no" display-inline="no-display-inline" id="ida240756d-5523-428b-8886-c174b9dcc628"><enum>(cc)</enum><text display-inline="yes-display-inline">collect and
		  analyze data on the coordination of services and supports, including services
		  under section 619 and part C of the Individuals with Disabilities Education Act
		  (<external-xref legal-doc="usc" parsable-cite="usc/20/1419">20 U.S.C. 1419</external-xref>, 1431 et seq.), for children with disabilities (as defined in
		  section 602 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>));</text></item><item commented="no" display-inline="no-display-inline" id="idcb11f5ec-3d5b-4943-9e9a-05a5787c241f"><enum>(dd)</enum><text display-inline="yes-display-inline">collect and
		  analyze data on the supply of and demand for child care in political
		  subdivisions or regions within the State and submit such data and analysis to
		  the State;</text></item><item commented="no" display-inline="no-display-inline" id="id0e57e462-cc95-4173-ac57-f42d4c2caaf5"><enum>(ee)</enum><text display-inline="yes-display-inline">work to
		  establish partnerships with public agencies and private entities to increase
		  the supply and quality of child care services in the State; and</text></item><item commented="no" display-inline="no-display-inline" id="id9a3873ab-1a70-4e1f-83e5-1f0c6266e895"><enum>(ff)</enum><text display-inline="yes-display-inline">as appropriate,
		  coordinate their activities with the activities of the State lead agency and
		  local agencies that administer funds made available in accordance with this
		  subchapter.</text></item></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id72eac1bc-a167-48b9-a62f-601d57d18e2c"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph
		(D)—</text><clause commented="no" display-inline="no-display-inline" id="id282ccece-cc54-4c13-9fe3-0ad16dce2107"><enum>(i)</enum><text display-inline="yes-display-inline">by striking
		<quote>1997 through 2002</quote> and inserting <quote>2015 through
		2020</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf94c5772-1563-4f1f-9fa1-fea1737d1e9f"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking
		<quote>families described in paragraph (2)(H)</quote> and inserting <quote>families with children described in clause (i), (ii), (iii), or (iv) of paragraph (2)(M)</quote>;
		and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id42c9aa2a-e3f1-4884-b441-d477de4ca815"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the
		end the following:</text><quoted-block display-inline="no-display-inline" id="ida54a015a-29a8-4206-8912-831395fa2190" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="idc52bd157-7106-4901-b973-2ca6090b7d5d"><enum>(E)</enum><header display-inline="yes-display-inline">Direct
		  services</header><text display-inline="yes-display-inline">From amounts provided to a State for a fiscal year to
		  carry out this subchapter, the State shall—</text><clause commented="no" display-inline="no-display-inline" id="id9a39f75b-69d5-40fa-8582-b7f0f67d3c6d"><enum>(i)</enum><text display-inline="yes-display-inline">reserve the
		  minimum amount required to be reserved under section 658G, and the funds for
		  costs described in subparagraph (C); and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide846a9f6-1dce-4562-9177-e1429d6da263"><enum>(ii)</enum><text display-inline="yes-display-inline">from
		  the remainder, use not less than 70 percent to fund direct services (provided
		  by the State) in accordance with paragraph
		  (2)(A).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6611c1aa-c6fa-4ad9-8339-4eb9ae79dd3c"><enum>(4)</enum><text display-inline="yes-display-inline">by striking
		paragraph (4) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id969a5965-e702-4dce-abce-a0db602f560e" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id71128087-b378-4457-8df0-bad3266e7dc5"><enum>(4)</enum><header display-inline="yes-display-inline">Payment
		  rates</header><subparagraph commented="no" display-inline="no-display-inline" id="idc2d86179-18dc-4437-bb5a-31ab1b28aacb"><enum>(A)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">The State plan shall certify that payment rates for the
		  provision of child care services for which assistance is provided in accordance
		  with this subchapter are sufficient to ensure equal access for eligible
		  children to child care services that are comparable to child care services in
		  the State or substate area involved that are provided to children whose parents
		  are not eligible to receive assistance under this subchapter or to receive
		  child care assistance under any other Federal or State program and shall
		  provide a summary of the facts relied on by the State to determine that such
		  rates are sufficient to ensure such access.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7c6d553d-a580-431e-bcb5-93670ca8b697"><enum>(B)</enum><header display-inline="yes-display-inline">Survey</header><text display-inline="yes-display-inline">The
		  State plan shall—</text><clause commented="no" display-inline="no-display-inline" id="ida1c8faa2-095c-4514-b7f9-b405b9cfc367"><enum>(i)</enum><text display-inline="yes-display-inline">demonstrate that
		  the State has, after consulting with the State Advisory Council on Early
		  Childhood Education and Care designated or established in section
			 642B(b)(1)(A)(i) of the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9837b">42 U.S.C. 9837b(b)(1)(A)(i)</external-xref>),
			 local child care program administrators, local
		  child care resource and referral agencies, and other appropriate entities,
		  developed and conducted (not earlier than 2 years before the date of the
		  submission of the application containing the State plan) a statistically valid
		  and reliable survey of the market rates for child care services in the State
		  (that reflects variations in the cost of child care services by geographic
		  area, type of provider, and age of child);</text></clause><clause commented="no" display-inline="no-display-inline" id="id29a9d3f8-3863-46bd-a8b0-d97ac2617880"><enum>(ii)</enum><text display-inline="yes-display-inline">demonstrate that
		  the State prepared a detailed report containing the results of the State market
		  rates survey conducted pursuant to clause (i), and made the results of the
		  survey widely available (not later than 30 days after the completion of such
		  survey) through periodic means, including posting the results on the
		  Internet;</text></clause><clause commented="no" display-inline="no-display-inline" id="id01c203b1-fd57-4cb8-aa0c-52196e4ba65e"><enum>(iii)</enum><text display-inline="yes-display-inline">describe how
		  the State will set payment rates for child care services, for which assistance
		  is provided in accordance with this subchapter—</text><subclause commented="no" display-inline="no-display-inline" id="idE494871DCA5945E785A298A9F558195C"><enum>(I)</enum><text display-inline="yes-display-inline">in
		  accordance with the results of the market rates survey conducted pursuant to
		  clause (i);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idE5D8105582E8430FBC0F39D53BB5F177"><enum>(II)</enum><text display-inline="yes-display-inline">taking into
		  consideration the cost of providing higher quality child care services than
		  were provided under this subchapter before the date of enactment of the
		  <short-title>Child Care and Development Block Grant Act of 2014</short-title>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6DD6155403254FEDAA5A3AC7BD547C98"><enum>(III)</enum><text display-inline="yes-display-inline">without, to the
		  extent practicable, reducing the number of families in the State receiving such
		  assistance to carry out this subchapter, relative to the number of such
		  families on the date of enactment of that Act; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ida946efe4-904d-4739-bcf2-df8c7016c8e0"><enum>(iv)</enum><text display-inline="yes-display-inline">describe how the
		  State will provide for timely payment for child care services provided in
		  accordance with this subchapter.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddfa2f88b-a48f-466e-b149-e2a516f84a25"><enum>(C)</enum><header display-inline="yes-display-inline">Construction</header><clause commented="no" display-inline="no-display-inline" id="id23a29933-06c6-4c21-82ff-67b0f9f48a49"><enum>(i)</enum><header display-inline="yes-display-inline">No
		  private right of action</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be
		  construed to create a private right of action.</text></clause><clause commented="no" display-inline="no-display-inline" id="ideae1daa2-d38c-411e-be6e-f793bda6875c"><enum>(ii)</enum><header display-inline="yes-display-inline">No
		  prohibition of certain different rates</header><text display-inline="yes-display-inline">Nothing in this subchapter
		  shall be construed to prevent a State from differentiating the payment rates
		  described in subparagraph (B)(iii) on the basis of such factors as—</text><subclause commented="no" display-inline="no-display-inline" id="id87480771-4db8-4b34-9844-71f989c0f675"><enum>(I)</enum><text display-inline="yes-display-inline">geographic
		  location of child care providers (such as location in an urban or rural
		  area);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id78865638-5794-4012-9bc9-ea514eb36812"><enum>(II)</enum><text display-inline="yes-display-inline">the age or
		  particular needs of children (such as the needs of children with disabilities
		  and children served by child protective services);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4bc6a66e-914b-4c69-96dd-cad957919c0e"><enum>(III)</enum><text display-inline="yes-display-inline">whether the
		  providers provide child care during weekend and other nontraditional hours;
		  or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida71b32eb-c47d-41f3-bea1-7835c9cfdf95"><enum>(IV)</enum><text display-inline="yes-display-inline">the State's
		  determination that such differentiated payment rates are needed to enable a
		  parent to choose child care that is of high
		  quality.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>;
		  and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd5e7b4c7-4099-4ca8-bf8d-8a66c1137936"><enum>(5)</enum><text display-inline="yes-display-inline">in paragraph (5),
		by inserting <quote>(that is not a barrier to families receiving assistance
		under this subchapter)</quote> after <quote>cost sharing</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id709624bd-fbb0-4731-aef9-e706336ff308"><enum>(c)</enum><header display-inline="yes-display-inline">Technical
		amendment</header><text display-inline="yes-display-inline">Section 658F(b)(2) of the Child Care and Development
		Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858d">42 U.S.C. 9858d(b)(2)</external-xref>) is amended by striking
		<quote>section 658E(c)(2)(F)</quote> and inserting <quote>section
		658E(c)(2)(I)</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id64db415f-471b-4ff8-b71d-69aabb6ec722" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Activities to
		improve the quality of child care</header><text display-inline="no-display-inline">Section 658G of the Child Care and
		Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858e">42 U.S.C. 9858e</external-xref>) is amended to read as
		follows:</text><quoted-block display-inline="no-display-inline" id="id46348236-ddda-45d4-a89e-795c6c7defe0" style="OLC"><section commented="no" display-inline="no-display-inline" id="id9dc6fb90-18a5-466f-9e50-2392d9393cb1" section-type="subsequent-section"><enum>658G.</enum><header display-inline="yes-display-inline">Activities to
		  improve the quality of child care</header><subsection commented="no" display-inline="no-display-inline" id="idbc9c011e-ef52-471c-9f68-f1d539373e4a"><enum>(a)</enum><header display-inline="yes-display-inline">Reservation</header><paragraph commented="no" display-inline="no-display-inline" id="id0aaa61a4-3cba-41bb-af16-f8da87b5c7c8"><enum>(1)</enum><header display-inline="yes-display-inline">Reservation for
		  activities relating to the quality of child care services</header><text display-inline="yes-display-inline">A State
		  that receives funds to carry out this subchapter for a fiscal year referred to
		  in paragraph (2) shall reserve and use a portion of such funds, in accordance
		  with paragraph (2), for activities provided directly, or through grants or
		  contracts with local child care resource and referral organizations or other
		  appropriate entities, that are designed to improve the quality of child care
		  services and increase parental options for, and access to, high-quality child
		  care, provided in accordance with this subchapter.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7624603a-d7c3-479b-a154-e0691960726b"><enum>(2)</enum><header display-inline="yes-display-inline">Amount of
		  reservations</header><text display-inline="yes-display-inline">Such State shall reserve and use—</text><subparagraph commented="no" display-inline="no-display-inline" id="idB2640676EA4A4841A4FE546D99948A6E"><enum>(A)</enum><text display-inline="yes-display-inline">to carry out the
		  activities described in paragraph (1), not less than—</text><clause commented="no" display-inline="no-display-inline" id="id3d567d11-1215-45ae-a787-0603d442e502"><enum>(i)</enum><text display-inline="yes-display-inline">6 percent of the
		  funds described in paragraph (1), for the first and second full fiscal years
		  after the date of enactment of the Child Care and Development Block Grant Act of
			 2014;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5673c38f-ab7c-4b53-b4ce-7da03964d86f"><enum>(ii)</enum><text display-inline="yes-display-inline">8 percent of
		  such funds, for the third and fourth full fiscal years after the date of
		  enactment; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id56113977-8a78-43c7-8cc1-890c01247b81"><enum>(iii)</enum><text display-inline="yes-display-inline">10 percent of
		  such funds, for the fifth full fiscal year after the date of enactment and each
		  succeeding fiscal year; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id660124e0-6fd0-4d6d-ad94-7bd27b809a63"><enum>(B)</enum><text display-inline="yes-display-inline">in addition to
		  the funds reserved under subparagraph (A), 3 percent of the funds described in
		  paragraph (1), for the first full fiscal year after the date of enactment and
		  each succeeding fiscal year, to carry out the activities described in paragraph
		  (1) and subsection (b)(4), as such activities relate to the quality of care for
		  infants and toddlers.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1bc64208-514f-447f-92ac-424fc209eab7"><enum>(b)</enum><header display-inline="yes-display-inline">Activities</header><text display-inline="yes-display-inline">Funds
		  reserved under subsection (a) shall be used to carry out not fewer than 2 of the
		  following activities:</text><paragraph commented="no" display-inline="no-display-inline" id="id1e7f0517-9a43-4779-94aa-c293f45af7ae"><enum>(1)</enum><text display-inline="yes-display-inline">Supporting the
		  training, professional development, and professional advancement of the child
		  care workforce through activities such as—</text><subparagraph commented="no" display-inline="no-display-inline" id="id33341c3e-ba76-4281-98b4-48ce00abb561"><enum>(A)</enum><text display-inline="yes-display-inline">offering child
		  care providers training and professional development that is intentional and
		  sequential and leads to a higher level of skill or certification;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida35081c8-916e-4bee-bd31-2fd7c4e0e517"><enum>(B)</enum><text display-inline="yes-display-inline">establishing or
		  supporting programs designed to increase the retention and improve the
		  competencies of child care providers, including wage incentive programs and
		  initiatives that establish tiered payment rates for providers that meet or
		  exceed child care services guidelines, as defined by the State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21c71c9d-4120-4b59-ba39-ceeeacbbee97"><enum>(C)</enum><text display-inline="yes-display-inline">offering
		  training, professional development, and educational opportunities for child
		  care providers that relate to the use of developmentally appropriate and
		  age-appropriate curricula, and early childhood teaching strategies, that are
		  scientifically based and aligned with the social, emotional, physical, and
		  cognitive development of children, including offering specialized training for
		  child care providers who care for infants and toddlers, children who are
		  English learners, and children with disabilities (as defined in section 602 of
		  the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id564ed400-62f7-4a45-813e-77ae97f2d88c"><enum>(D)</enum><text display-inline="yes-display-inline">providing
		  training concerning the State early learning and developmental guidelines,
		  where applicable, including training concerning early mathematics and early
		  language and literacy development and effective instructional practices to
		  support mathematics and language and literacy development in young
		  children;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9d7c4360-a42f-4401-af8f-425b23050d7c"><enum>(E)</enum><text display-inline="yes-display-inline">incorporating
		  effective use of data to guide instruction and program improvement;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id900ee5b3-5b60-4027-8588-5ab9f1fb056e"><enum>(F)</enum><text display-inline="yes-display-inline">including
		  effective behavior management strategies and training, including positive
		  behavioral interventions and supports, that promote positive social and
		  emotional development and reduce challenge behaviors;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id80e7f2ae-7388-40e0-bf26-ba8c05319523"><enum>(G)</enum><text display-inline="yes-display-inline">at the option of
		  the State, incorporating feedback from experts at the State’s institutions of
		  higher education, as defined in section 102 of the Higher Education Act of 1965
		  (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>), and other early childhood development experts and early
		  childhood education and care experts;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida96c32f4-a127-4a48-a01a-b69d155e80b9"><enum>(H)</enum><text display-inline="yes-display-inline">providing
		  training corresponding to the nutritional and physical activity needs of
		  children to promote healthy development;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id531fe981-3b88-4d05-9b26-b71958dc3627"><enum>(I)</enum><text display-inline="yes-display-inline">providing
		  training or professional development for child care providers to serve and
		  support children with disabilities;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAC65702605104B888E937E1E7B687AD0"><enum>(J)</enum><text display-inline="yes-display-inline">providing
		  training and outreach on engaging parents and families in culturally and
		  linguistically appropriate ways to expand their knowledge, skills, and capacity
		  to become meaningful partners in supporting their children's learning and
		  development;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id01929e45d85f4a3e9a6d93bf8c9b717a"><enum>(K)</enum><text display-inline="yes-display-inline">providing
		  training or professional development for child care providers regarding the
		  early neurological development of children; and</text></subparagraph><subparagraph id="id06A3C2192FD243E79F1A4759D86D5AE6"><enum>(L)</enum><text>connecting child care staff members of child care providers with available Federal and State
			 financial aid,  or other resources,
			 that would assist child care staff members in pursuing relevant
			 postsecondary
			 training.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc355231c-3970-4fea-9ed9-02f175fbff9e"><enum>(2)</enum><text display-inline="yes-display-inline">Supporting the
		  use of the early learning and developmental guidelines described in section
		  658E(c)(2)(T) by—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd8f894fa-1482-4756-9dff-b2afa3a3b214"><enum>(A)</enum><text display-inline="yes-display-inline">developing and
		  implementing the State’s early learning and developmental guidelines;
		  and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idab1d54ef-4311-4b2d-aeee-dfea16795abe"><enum>(B)</enum><text display-inline="yes-display-inline">providing
		  technical assistance to enhance early learning for preschool and school-aged
		  children in order to promote language and literacy skills, foster school
		  readiness, and support later school success.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id654c2981-122f-4fed-a03f-f50166b52010"><enum>(3)</enum><text display-inline="yes-display-inline">Developing and
		  implementing a tiered quality rating system for child care providers, which
		  shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb52c4036-627f-4e3d-9247-347fb611f018"><enum>(A)</enum><text display-inline="yes-display-inline">support and
		  assess the quality of child care providers in the State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd6c10b46-a22b-4a01-882b-ae80b9dd6787"><enum>(B)</enum><text display-inline="yes-display-inline">build on
		  licensing standards and other State regulatory standards for such
		  providers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7e3a8cb2-9ffc-4a5f-9d12-d2913f62c2ec"><enum>(C)</enum><text display-inline="yes-display-inline">be designed to
		  improve the quality of different types of child care providers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0b18f2de-4e0a-4732-aba0-bfedcb7603e7"><enum>(D)</enum><text display-inline="yes-display-inline">describe the
		  quality of early learning facilities;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd883478b-ea5b-4363-bb06-63107d1ec22b"><enum>(E)</enum><text display-inline="yes-display-inline">build the
		  capacity of State early childhood education and care programs and communities to
			 promote parents’
		  and families’ understanding of the State’s early childhood education and care
			 system and the
		  ratings of the programs in which the child is enrolled; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5c3288d0-7254-4025-a169-b0f512e18942"><enum>(F)</enum><text display-inline="yes-display-inline">provide, to the
		  maximum extent practicable, financial incentives and other supports designed to
			 help child care providers 
		  achieve and sustain higher levels of quality.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcacde0b5-9cd4-4447-be30-b2b4ed89494e"><enum>(4)</enum><text display-inline="yes-display-inline">Improving the
		  supply and quality of child care programs and services for infants and toddlers
		  through activities, which may include—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf90f3dc2-9c43-4d15-9101-00d0afe8a3fd"><enum>(A)</enum><text display-inline="yes-display-inline">establishing or
		  expanding neighborhood-based high-quality comprehensive family and child
		  development centers, which may serve as resources to child care providers in
		  order to improve the quality of early childhood education and care and early
		  childhood development services provided to infants and toddlers from low-income
		  families and to help eligible child care providers improve their capacity to
		  offer high-quality care to infants and toddlers from low-income
		  families;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida3588261-1305-4029-995b-fd6c6aee4442"><enum>(B)</enum><text display-inline="yes-display-inline">establishing or
		  expanding the operation of community or neighborhood-based family child care
		  networks;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide572b88ce7234ccbbe855c9c1b3373e2"><enum>(C)</enum><text display-inline="yes-display-inline">supporting
		  statewide networks of infant and toddler child care specialists, including
		  specialists who have knowledge regarding infant and toddler development and
		  curriculum and program implementation as well as the ability to coordinate
		  services with early intervention specialists who provide services for infants
		  and toddlers with disabilities under part C of the Individuals with
		  Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1431">20 U.S.C. 1431 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8e72bd0f-8edf-474c-be77-9bb91657c6df"><enum>(D)</enum><text display-inline="yes-display-inline">carrying out
		  initiatives to improve the quality of the infant and toddler child care
		  workforce, such as providing relevant training, professional development, or
		  mentoring opportunities and linking such opportunities to career pathways,
		  developing career pathways for providers in such workforce, and improving the
			 State
		  cre­den­tial­ing of eligible providers caring for infants and toddlers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddbd5b39c-bfd4-4ec2-88aa-142952dceabd"><enum>(E)</enum><text display-inline="yes-display-inline">if applicable,
		  developing infant and toddler components within the State’s quality rating
		  system described in paragraph (3) for child care providers for infants and
		  toddlers, or the development of infant and toddler components in a State’s
		  child care licensing regulations or early learning and developmental guidelines;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7aa17635-c290-429a-8d06-f3dc2146900f"><enum>(F)</enum><text display-inline="yes-display-inline">improving the
		  ability of parents to access information about high-quality infant and toddler
		  care; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id66f977cb-ce0c-4a2a-a2f1-db334539eff5"><enum>(G)</enum><text display-inline="yes-display-inline">carrying out
		  other activities determined by the State to improve the quality of infant and
		  toddler care provided in the State, and for which there is evidence that the
		  activities will lead to improved infant and toddler health and safety, infant
		  and toddler development, or infant and toddler well-being, including providing
		  training (including training in safe sleep practices, first aid, and
		  cardiopulmonary resuscitation).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c9cdde7-5e46-4720-83f5-71bde99801d2"><enum>(5)</enum><text display-inline="yes-display-inline">Promoting broad
		  child care provider participation in the quality rating system described in
		  paragraph (3).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id416d03ec-c932-4fcc-afa1-273e25b7d81c"><enum>(6)</enum><text display-inline="yes-display-inline">Establishing or
		  expanding a statewide system of child care resource and referral
		  services.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b9cd7c5-4024-4cb5-9478-44557ab48682"><enum>(7)</enum><text display-inline="yes-display-inline">Facilitating
		  compliance with State requirements for inspection, monitoring, training, and
		  health and safety, and with State licensing standards.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b8a0f41-a0bc-43cb-a4fd-93db92d3bd93"><enum>(8)</enum><text display-inline="yes-display-inline">Evaluating and
		  assessing the quality and effectiveness of child care programs and services
		  offered in the State, including evaluating how such programs and services may
		  improve the overall school readiness of young children.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ed72be4-6076-4ba5-b0fa-c4f38e9dec95"><enum>(9)</enum><text display-inline="yes-display-inline">Supporting child
		  care providers in the pursuit of accreditation by an established national
		  accrediting body with demonstrated, valid, and reliable program standards of
		  high quality.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a20863d-57a8-41b7-877c-5e83aa08a8d8"><enum>(10)</enum><text display-inline="yes-display-inline">Supporting State
		  or local efforts to develop or adopt high-quality program standards relating to
		  health, mental health, nutrition, physical activity, and physical development
		  and providing resources to enable eligible child care providers to meet,
		  exceed, or sustain success in meeting or exceeding, such standards.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideee6b8e7-c482-4e7c-ae75-df7839b269c7"><enum>(11)</enum><text display-inline="yes-display-inline">Carrying out
		  other activities determined by the State to improve the quality of child care
		  services provided in the State, and for which measurement of outcomes relating
		  to improved provider preparedness, child safety, child well-being, or school
		  readiness is possible.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2b54d599-4d06-4bd0-a874-069fc8dc45ea"><enum>(c)</enum><header display-inline="yes-display-inline">Certification</header><text display-inline="yes-display-inline">Beginning
		  with fiscal year 2015, at the beginning of each fiscal year, the State shall
		  annually submit to the Secretary a certification containing an assurance that
		  the State was in compliance with subsection (a) during the preceding fiscal
		  year and a description of  how the State used funds received under this
			 subchapter to
		  comply with subsection (a) during that preceding fiscal year.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id2d4bb50b-4424-4910-b399-95831bcc6762"><enum>(d)</enum><header display-inline="yes-display-inline">Reporting
		  Requirements</header><text display-inline="yes-display-inline">Each State receiving funds under this subchapter
		  shall prepare and submit an annual report to the Secretary, which shall include
		  information about—</text><paragraph commented="no" display-inline="no-display-inline" id="iddcc6a261-9a9a-48e4-b44c-785c747cc5c0"><enum>(1)</enum><text display-inline="yes-display-inline">the amount of
		  funds that are reserved under subsection (a);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba07e46b-e649-4898-979c-cf4ef77e4f11"><enum>(2)</enum><text display-inline="yes-display-inline">the activities
		  carried out under this section; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfc001985-35d3-40ed-b03c-3c889970aa07"><enum>(3)</enum><text display-inline="yes-display-inline">the measures that
		  the State will use to evaluate the State's progress in improving the quality of
		  child care programs and services in the State.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf3f4ac18-4a4f-453e-8e28-8af771039aa2"><enum>(e)</enum><header display-inline="yes-display-inline">Technical
		  assistance</header><text display-inline="yes-display-inline">The Secretary shall offer technical assistance, in
		  accordance with section 658I(a)(3), which may include technical assistance
		  through the use of grants or cooperative agreements, to States for the
		  activities described in subsection (b).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id65657dd7-d704-4fbb-bfb5-83cfc2aa6d96"><enum>(f)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing
		  in this section shall be construed as providing the Secretary the authority to
		  regulate, direct, or dictate State child care quality activities or progress in
		  implementing those
		  activities.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id3c6e379e-80e1-4029-8ca7-1aa706b6d275" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Criminal
		background checks</header><text display-inline="no-display-inline">The Child
		Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858 et seq.</external-xref>) is
		amended by inserting after section 658G the following:</text><quoted-block display-inline="no-display-inline" id="id929e6d3f-c2ab-411a-b92b-a9658140b03b" style="OLC"><section commented="no" display-inline="no-display-inline" id="id6f72f5bb-212c-464b-9b40-1887b9d7d02d" section-type="subsequent-section"><enum>658H.</enum><header display-inline="yes-display-inline">Criminal
		  background checks</header><subsection commented="no" display-inline="no-display-inline" id="id6209dd48-b493-4b95-aad9-cef27443e8f1"><enum>(a)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">A State that receives funds to carry out this subchapter
		  shall have in effect—</text><paragraph commented="no" display-inline="no-display-inline" id="ide15f2d8f-e767-497c-922b-2bd59a5cc85e"><enum>(1)</enum><text display-inline="yes-display-inline">requirements,
		  policies, and procedures to require and conduct criminal background checks for
		  child care staff members (including prospective child care staff members) of
		  child care providers described in subsection (c)(1); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd283edfa-6fee-49d6-8e7a-dc76b09422b0"><enum>(2)</enum><text display-inline="yes-display-inline">licensing,
		  regulation, and registration requirements, as applicable, that prohibit the
		  employment of child care staff members as described in subsection (c).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5b52401d-68d7-4b5b-85a1-2803b4c71323"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">A
		  criminal background check for a child care staff member under subsection (a)
		  shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="id27a9a8c8-0ef8-41da-b088-5cd424ce4bbe"><enum>(1)</enum><text display-inline="yes-display-inline">a
		  search of each State criminal and sex offender registry or repository in the
		  State where the child care staff member resides and each State where such staff
		  member resided during the preceding 10 years;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5eb75162-4fe6-4a91-ae6d-f1a7ba570bd5"><enum>(2)</enum><text display-inline="yes-display-inline">a
		  search of State-based child abuse and neglect registries and databases in the
		  State where the child care staff member resides and each State where such staff
		  member resided during the preceding 10 years;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2396aa6-1084-4f5b-9538-b870502016ea"><enum>(3)</enum><text display-inline="yes-display-inline">a search of the
		  National Crime Information Center;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcb9c0ceb-b064-4466-be39-92abab1b42e8"><enum>(4)</enum><text display-inline="yes-display-inline">a
		  Federal Bureau of Investigation fingerprint check using the Integrated
		  Automated Fingerprint Identification System; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b25336e-3c07-40ce-bfbe-f9753a2b02f6"><enum>(5)</enum><text display-inline="yes-display-inline">a
		  search of the National Sex Offender Registry established under the Adam Walsh
		  Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16901">42 U.S.C. 16901 et seq.</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcc3a6599-9fda-4d2f-85fa-c0d08dd88448"><enum>(c)</enum><header display-inline="yes-display-inline">Prohibitions</header><paragraph commented="no" display-inline="no-display-inline" id="id7d3615e0-8144-47d5-bb21-fa6f5547f733"><enum>(1)</enum><header display-inline="yes-display-inline">Child care
		  staff members</header><text display-inline="yes-display-inline">A child care staff member shall be ineligible for
		  employment by a child care provider that is licensed, regulated, or registered
		  by the State or for which assistance is provided in accordance with this
		  subchapter, if such individual—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9f4c9586-3807-4953-a640-8c8bc924c7da"><enum>(A)</enum><text display-inline="yes-display-inline">refuses to
		  consent to the criminal background check described in subsection (b);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc8e10187-bce4-40a5-be52-2251c9355dce"><enum>(B)</enum><text display-inline="yes-display-inline">knowingly makes a
		  materially false statement in connection with such criminal background
		  check;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id31e63749-3338-48cb-a348-58b366ab0236"><enum>(C)</enum><text display-inline="yes-display-inline">is registered, or
		  is required to be registered, on a State sex offender registry or repository or
			 the National
		  Sex Offender Registry established under the Adam Walsh Child Protection and
		  Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16901">42 U.S.C. 16901 et seq.</external-xref>); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc0a1357c-4214-47f5-be71-fbed9d5f78e5"><enum>(D)</enum><text display-inline="yes-display-inline">has been
		  convicted of a felony consisting of—</text><clause commented="no" display-inline="no-display-inline" id="id9e69d611-4da2-4761-a7b0-e5f823e00ee5"><enum>(i)</enum><text display-inline="yes-display-inline">murder, as
		  described in <external-xref legal-doc="usc" parsable-cite="usc/18/1111">section 1111</external-xref> of title 18, United States Code;</text></clause><clause commented="no" display-inline="no-display-inline" id="idbbd76c28-0d1a-449e-8b78-36d003bbad44"><enum>(ii)</enum><text display-inline="yes-display-inline">child abuse or
		  neglect;</text></clause><clause commented="no" display-inline="no-display-inline" id="id31daf924-41fa-4a84-a5a7-b9b649a57444"><enum>(iii)</enum><text display-inline="yes-display-inline">a
		  crime against children, including child pornography;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5c54f7b1-71fb-4fa3-b0a0-291aca1cc368"><enum>(iv)</enum><text display-inline="yes-display-inline">spousal
		  abuse;</text></clause><clause commented="no" display-inline="no-display-inline" id="id536adbea-5cc1-4bbd-936e-72e917625026"><enum>(v)</enum><text display-inline="yes-display-inline">a
		  crime involving rape or sexual assault;</text></clause><clause commented="no" display-inline="no-display-inline" id="idccfd58b6-f6b2-456b-8eb8-531a503f082d"><enum>(vi)</enum><text display-inline="yes-display-inline">kidnaping;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1cf6e323-a047-4721-a761-04d1c8e6dec4"><enum>(vii)</enum><text display-inline="yes-display-inline">arson;</text></clause><clause commented="no" display-inline="no-display-inline" id="id14af1085-1430-4036-9542-fb3170e7419c"><enum>(viii)</enum><text display-inline="yes-display-inline">physical
		  assault or battery; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id9a66b06a-9e34-4b13-aa2e-42dd76a7128d"><enum>(ix)</enum><text display-inline="yes-display-inline">subject to
		  subsection (e)(4), a drug-related offense committed during the preceding 5
		  years; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC120BA06B58E40598D0BF45BB203B311"><enum>(E)</enum><text display-inline="yes-display-inline">has been convicted of a violent misdemeanor committed as an adult against a child, 
including the following crimes: child abuse, child endangerment, sexual assault, or of a
misdemeanor involving child pornography.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1e6e7347-bf79-4b23-b1b9-1c202559dc4f"><enum>(2)</enum><header display-inline="yes-display-inline">Child care
		  providers</header><text display-inline="yes-display-inline">A child care provider described in paragraph (1) shall
		  be ineligible for assistance provided in accordance with this subchapter if the
		  provider employs a staff member who is ineligible for employment under
		  paragraph (1).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id51cd7713-e487-451d-a449-cd97784778af"><enum>(d)</enum><header display-inline="yes-display-inline">Submission of
		  requests for background checks</header><paragraph commented="no" display-inline="no-display-inline" id="id1ebf874e-ad84-4045-a8a3-5871452bf177"><enum>(1)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">A child care provider covered by subsection (c) shall
		  submit a request, to the appropriate State agency designated by a State, for a
		  criminal background check described in subsection (b), for each child care
		  staff member (including prospective child care staff members) of the
		  provider.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34b98f42-974c-4510-b35a-1c384c1467ad"><enum>(2)</enum><header display-inline="yes-display-inline">Staff
		  members</header><text display-inline="yes-display-inline">Subject to paragraph (4), in the case of an individual
		  who became a child care staff member before the date of enactment of the Child
		  Care and Development Block Grant Act of 2014, the provider shall submit such a
		  request—</text><subparagraph commented="no" display-inline="no-display-inline" id="idad94db02-c60c-467e-a8b4-4662a57a5072"><enum>(A)</enum><text display-inline="yes-display-inline">prior to the last
		  day described in subsection (i)(1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc5ab947-a84d-4e94-98ea-59ad9ae9970a"><enum>(B)</enum><text display-inline="yes-display-inline">not less often
		  than once during each 5-year period following the first submission date under
		  this paragraph for that staff member.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7dbba0bd-a4f9-49ff-9fbe-b6d2493d2184"><enum>(3)</enum><header display-inline="yes-display-inline">Prospective
		  staff members</header><text display-inline="yes-display-inline">Subject to paragraph (4), in the case of an
		  individual who is a prospective child care staff member on or after that date
		  of enactment, the provider shall submit such a request—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5c486271-2146-43f2-abbc-9f15e90fcf22"><enum>(A)</enum><text display-inline="yes-display-inline">prior to the date
		  the individual becomes a child care staff member of the provider; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5e091ffe-2e5e-40d7-b66a-a179be80cf39"><enum>(B)</enum><text display-inline="yes-display-inline">not less often
		  than once during each 5-year period following the first submission date under
		  this paragraph for that staff member.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided143957-b0d1-4f88-a460-ed890d82bd58"><enum>(4)</enum><header display-inline="yes-display-inline">Background
		  check for another child care provider</header><text display-inline="yes-display-inline">A child care provider shall
		  not be required to submit a request under paragraph (2) or (3) for a child care
		  staff member if—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb7c9e557-7f42-4338-aa12-f60a5e2c41a3"><enum>(A)</enum><text display-inline="yes-display-inline">the staff member
		  received a background check described in subsection (b)—</text><clause commented="no" display-inline="no-display-inline" id="id7FC93A0FBE0949B5904916F9617A0F5D"><enum>(i)</enum><text display-inline="yes-display-inline">within 5 years
		  before the latest date on which such a submission may be made; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idC98B262EC2D5474DA98674DA00D656EF"><enum>(ii)</enum><text display-inline="yes-display-inline">while employed
		  by or seeking employment by another child care provider within the State;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD475FEE13E1B493FB45A9CF39F1B9744"><enum>(B)</enum><text display-inline="yes-display-inline">the State provided to the first provider a qualifying background check result, consistent with
		  this subchapter, for the staff member; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCDAE6DF03933401F9DBAD24681D7C332"><enum>(C)</enum><text display-inline="yes-display-inline">the staff member is employed by a child care provider within the State, or has been separated from
			 employment from a child care provider within the State for a period of not
			 more than 180 consecutive days.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id088514b1-ce1a-4173-b5f9-d2fe70374be5"><enum>(e)</enum><header display-inline="yes-display-inline">Background
		  check results and appeals</header><paragraph commented="no" display-inline="no-display-inline" id="idcbb166a1-3f66-4a22-ba8f-4a7304921bc2"><enum>(1)</enum><header display-inline="yes-display-inline">Background
		  check results</header><text display-inline="yes-display-inline">The State shall carry out the request of a child
		  care provider for a criminal background check as expeditiously as possible, but
			 in 
		  not to exceed 45 days after the date on which such request was submitted, and
			 shall provide the results of the criminal background
		  check to such provider and to the current or prospective staff member.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3fdd44dc-f798-46fa-af47-94dd50ffad40"><enum>(2)</enum><header display-inline="yes-display-inline">Privacy</header><subparagraph commented="no" display-inline="no-display-inline" id="id7e9344bb-999a-4adc-a1df-b98906cd53bb"><enum>(A)</enum><header display-inline="yes-display-inline">In
		  General</header><text display-inline="yes-display-inline">The State shall provide the results of the criminal
		  background check to the provider in a statement that indicates whether a child
		  care staff member (including a prospective child care staff member) is eligible
		  or ineligible for employment described in subsection (c), without revealing any
		  disqualifying crime or other related information regarding the
		  individual.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id72e8cb8f-e83d-4e62-857d-13ad6e92bc14"><enum>(B)</enum><header display-inline="yes-display-inline">Ineligible
		  staff member</header><text display-inline="yes-display-inline">If the child care staff member is ineligible for
		  such employment due to the background check, the State will, when providing the
		  results of the background check, include information related to each
		  disqualifying crime, in a report to the staff member or prospective staff
		  member.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id82a59d2e-8b09-4f2f-8982-de28d75edf5f"><enum>(C)</enum><header display-inline="yes-display-inline">Public release
		  of results</header><text display-inline="yes-display-inline">No State shall publicly release or share the results
		  of individual background checks, however, such results of background checks may
		  be included in the development or dissemination of local or statewide data
		  related to background checks, if such results are not individually
		  identifiable.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0d483dab-058a-4d9d-bd54-4bc5f18a5b66"><enum>(3)</enum><header display-inline="yes-display-inline">Appeals</header><subparagraph commented="no" display-inline="no-display-inline" id="id7e596f5f-b978-46d9-9c42-3032c430f7bc"><enum>(A)</enum><header display-inline="yes-display-inline">In
		  General</header><text display-inline="yes-display-inline">The State shall provide for a process by which a child
		  care staff member (including a prospective child care staff member) may appeal
		  the results of a criminal background check conducted under this section to
		  challenge the accuracy or completeness of the information contained in such
		  member’s criminal background report.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf6e24b42-7c3e-473e-8fd5-c76df7a20554"><enum>(B)</enum><header display-inline="yes-display-inline">Appeals
		  process</header><text display-inline="yes-display-inline">The State shall ensure that—</text><clause commented="no" display-inline="no-display-inline" id="id9d587d36-1046-45b0-b1b6-9dceaa3c9807"><enum>(i)</enum><text display-inline="yes-display-inline">each child care
		  staff member shall be given notice of the opportunity to appeal;</text></clause><clause commented="no" display-inline="no-display-inline" id="id60c8a907-6b6e-484d-b3af-d37b773c244e"><enum>(ii)</enum><text display-inline="yes-display-inline">a child care
		  staff member will receive instructions about how to complete the appeals
		  process if the child care staff member wishes to challenge the accuracy or
		  completeness of the information contained in such member's  criminal background
		  report; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id043eae59-2c80-4b82-ace6-a0618052b15c"><enum>(iii)</enum><text display-inline="yes-display-inline">the appeals
		  process is completed in a timely manner for each child care staff
		  member.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3bc56111-d1ca-4c3b-bc2c-aa462f522f37"><enum>(4)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">The
		  State may allow for a review process through which the State may determine that
		  a child care staff member (including a prospective child care staff member)
		  disqualified for a crime specified in subsection (c)(1)(D)(ix) is eligible for
		  employment described in subsection (c)(1), notwithstanding subsection (c). The
		  review process shall be consistent with title VII of the Civil Rights Act of
		  1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2451726f-a810-4029-88ea-7e6ba9720d34"><enum>(5)</enum><header display-inline="yes-display-inline">No private
		  right of action</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to
		  create a private right of action if the provider is in compliance with State
		  regulations and requirements.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id71c68769-35a5-4fe1-8977-c8fe0a961ab8"><enum>(f)</enum><header display-inline="yes-display-inline">Fees for
		  background checks</header><text display-inline="yes-display-inline">Fees that a State may charge for the costs of
		  processing applications and administering a criminal background check as
		  required by this section shall not exceed the actual costs to the State for the
		  processing and administration.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7da475f3-2735-4e6e-90e9-51debd9e7303"><enum>(g)</enum><header display-inline="yes-display-inline">Construction</header><paragraph commented="no" display-inline="no-display-inline" id="id14d2a397-93c6-4e23-8ef3-823cadc3937c"><enum>(1)</enum><header display-inline="yes-display-inline">Disqualification
		  for other crimes</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to
		  prevent a State from disqualifying individuals as child care staff members
		  based on their conviction for crimes not specifically listed in this section
		  that bear upon the fitness of an individual to provide care for and have
		  responsibility for the safety and well-being of children.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8105f095-a73c-47a3-8735-356fb2b9764d"><enum>(2)</enum><header display-inline="yes-display-inline">Rights and
		  Remedies</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to alter or
		  otherwise affect the rights and remedies provided for child care staff members
		  residing in a State that disqualifies individuals as child care staff members
		  for  crimes not specifically provided for under this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide504f6f4-e343-4f82-965f-1508284bed98"><enum>(h)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="idab8a7a63-9ff2-48ea-995e-51f09e5e6faa"><enum>(1)</enum><text display-inline="yes-display-inline">the term
		  <term>child care provider</term> means a center-based child care provider, a
		  family child care provider, or another provider of child care services for
		  compensation and on a regular basis that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbfc35507-c6f5-4b9e-95e3-53038cacfc9d"><enum>(A)</enum><text display-inline="yes-display-inline">is not an
		  individual who is related to all children for whom child care services are
		  provided; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id80e2afe5-d931-4d9a-8301-dfa017c44dd6"><enum>(B)</enum><text display-inline="yes-display-inline">is licensed,
		  regulated, or registered under State law or receives assistance provided in
		  accordance with this subchapter; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0a22fc31-b92e-4c1e-a855-5b2d43c02cc1"><enum>(2)</enum><text display-inline="yes-display-inline">the term
		  <term>child care staff member</term> means an individual (other than an
		  individual who is related to all children for whom child care services are
		  provided)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id504c30ba-9aee-43d2-b88f-b57b3577b8c0"><enum>(A)</enum><text display-inline="yes-display-inline">who is employed
		  by a child care provider for compensation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id02cef945-d535-460b-b809-1c03e49bff80"><enum>(B)</enum><text display-inline="yes-display-inline">whose activities
		  involve the care or supervision of children for a child care provider or
		  unsupervised access to children who are cared for or supervised by a child care
		  provider; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89380d4b-54fc-4e06-b9b1-497174be62fb"><enum>(C)</enum><text display-inline="yes-display-inline">who is a family
		  child care provider.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id932ea47d-02e9-44ef-a13d-d7b1f17d146e"><enum>(i)</enum><header display-inline="yes-display-inline">Effective
		  date</header><paragraph commented="no" display-inline="no-display-inline" id="ide5d8793f-856f-4b71-a48e-6bde3bc9538e"><enum>(1)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">A State that receives funds under this subchapter shall
		  meet the requirements of this section for the provision of criminal background
		  checks for child care staff members described in subsection (d)(1) not later
		  than the last day of the second full fiscal year after the date of enactment of
		  the Child Care and Development Block Grant Act of 2014.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf0eee078-0164-4be7-a9d3-9eda475e6c3e"><enum>(2)</enum><header display-inline="yes-display-inline">Extension</header><text display-inline="yes-display-inline">The
		  Secretary may grant a State an extension of time, of not more than 1 fiscal
		  year, to meet the requirements of this section if the State demonstrates a good
		  faith effort to comply with the requirements of this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide228a095-e9d3-46a5-9fe0-77ec2a2f6a03"><enum>(3)</enum><header display-inline="yes-display-inline">Penalty for
		  noncompliance</header><text display-inline="yes-display-inline">Except as provided in paragraphs (1) and (2), for
		  any fiscal year that a State fails to comply substantially with the
		  requirements of this section, the Secretary shall withhold 5 percent of the
		  funds that would otherwise be allocated to that State in accordance with this
		  subchapter for the following fiscal
		  year.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id4e517f23-7ec0-4cc4-a0a2-d2efafcfe06b" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Reports and
		information</header><subsection commented="no" display-inline="no-display-inline" id="idf4cfd3f5-e3f4-45f9-970f-714ee10ff9bf"><enum>(a)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">Section
		658I of the Child Care and Development Block Grant Act of 1990 (42 U.S.C.
		9858g) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id36D728BA0E8048678E77713383D0B2C9"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection

		  and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA0470D8B67E949008CAB3E4E059BFB2A"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the
		end the following:</text><quoted-block display-inline="no-display-inline" id="id266E9B2091D44B86ABB7090C1565E43C" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id19eb20b317464173b2f574c7d046bebd"><enum>(4)</enum><text display-inline="yes-display-inline">disseminate, for
		  voluntary informational purposes, information on practices that scientifically
		  valid research indicates are most successful in improving the quality of
		  programs that receive assistance with this subchapter;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8EB649277EDC437D8E5F9F5976FB236A"><enum>(5)</enum><text display-inline="yes-display-inline">after consultation with the Secretary of Education  and the heads of any other
			 Federal agencies involved, issue guidance, and disseminate
			 information on best practices, regarding use of funding combined by States
			 as described in section 658E(c)(2)(O)(ii), consistent with law other than
			 this
		  subchapter.</text></paragraph><after-quoted-block>;
		  and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5D25F97278BC41289465C46BB27B8CBF"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the
		end the following:</text><quoted-block display-inline="no-display-inline" id="id17451177f17446c3b5afde2fd274d7b4" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="ide8d585ef0f774be1adafda32acc322d0"><enum>(c)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">Nothing
		  in this subchapter shall be construed as providing the Secretary the authority
		  to permit States to alter the eligibility requirements for eligible children,
		  including work requirements that apply to the parents of eligible
		  children.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF0681E364C284B3696CA356F36F0CC4E"><enum>(b)</enum><header display-inline="yes-display-inline">Requests for
		relief</header><text display-inline="yes-display-inline">Section 658I of the Child Care and Development Block Grant Act of 1990, as amended by subsection
			 (a), is
		further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id26BF7847CD8A4AC6A0706F3BCBCE4BFC" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="id658ae81e6cb84ed592f67f67fd182442"><enum>(d)</enum><header display-inline="yes-display-inline">Request for
		  relief</header><paragraph commented="no" display-inline="no-display-inline" id="idA45C68BAB48E4F6489DA4D9BB93FCEFD"><enum>(1)</enum><header display-inline="yes-display-inline">In
		  general</header><text display-inline="yes-display-inline">The State may submit to the Secretary a request for
		  relief from any provision of Federal law (including a regulation, policy, or
		  procedure) affecting the delivery of child care services with Federal funds,
			 other
			 than this subchapter, that conflicts with a requirement of
		  this subchapter.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idef4bd05bf51747e082cb4cf7c81a6a68"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Such
		  request shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id877DE01BAAC942FF9586F6D643202DE2"><enum>(A)</enum><text display-inline="yes-display-inline">detail the
		  provision of Federal law that conflicts with that requirement;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC2982354DF48444090830923E46308B4"><enum>(B)</enum><text display-inline="yes-display-inline">describe how
		  modifying compliance with that provision of Federal law to meet the
		  requirements of this subchapter will, by itself, improve delivery of child care
			 services for
		  children in the State; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA7B4DC748033428185A8E43BC07C83D7"><enum>(C)</enum><text display-inline="yes-display-inline">certify that the
		  health, safety, and well-being of children served through assistance received
		  under this subchapter will not be compromised as a result.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62a0187e71ed42b9b4f203abeb6e4e91"><enum>(3)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The
		  Secretary shall consult with the State submitting the request and the head of
		  each Federal agency (other than the Secretary)  with responsibility for
			 administering the Federal law
		  detailed in the State’s request. The consulting parties shall jointly
		  identify—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6BFFF665DB83403D90E092333045BBAE"><enum>(A)</enum><text display-inline="yes-display-inline">any provision of
		  Federal law (including a regulation, policy, or procedure) for which a waiver
		  is necessary to enable the State to provide services in accordance with the
		  request; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4D3BCCEE308E47B1BFEB6EDC442150E4"><enum>(B)</enum><text display-inline="yes-display-inline">any corresponding
		  waiver.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9B6CD79522A04D0290D7CBA73765ECE9"><enum>(4)</enum><header display-inline="yes-display-inline">Waivers</header><text display-inline="yes-display-inline">Notwithstanding
		  any other provision of law, and after the joint identification described in
		  paragraph (3), the head of the Federal agency involved shall have the authority
		  to waive any statutory provision administered by that agency, or any
		  regulation, policy, or procedure issued by that agency, that has been so
		  identified, unless the head of the Federal agency determines that such a waiver
		  is inconsistent with the objectives of this subchapter or the Federal law from
			 which relief is sought.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09b7d9ad349a4245b46bb1ef4cedc044"><enum>(5)</enum><header display-inline="yes-display-inline">Approval</header><text display-inline="yes-display-inline">Within
		  90 days after the receipt of a State’s request under this subsection, the
		  Secretary shall inform the State of the Secretary’s approval or disapproval of
		  the request. If the plan is disapproved, the Secretary shall inform the State,
		  in writing, of the reasons for the disapproval and give the State the
		  opportunity to amend the
		  request.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71898DF7603743BAAA6FD56BA6667AF8"><enum>(6)</enum><header display-inline="yes-display-inline">Duration</header><text display-inline="yes-display-inline">The Secretary may approve a request under this subsection for a period of not more than 3 years,
			 and may renew the approval for additional periods of not more than 3
			 years.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4343A9A52E34453099995A17DE510502"><enum>(7)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">The Secretary shall terminate approval of a request for relief authorized under this subsection if
			 the Secretary determines,
			 after notice and opportunity for a hearing, that the performance of a
			 State granted relief under this subsection has been inadequate, or if such
			 relief is no longer necessary to achieve its original purposes.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id66d1ccd5-21ad-444c-a648-d0ea7586a0ff"><enum>(c)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Section
		658K(a) of the Child Care and Development Block Grant Act of 1990 (42 U.S.C.

		  disseminate publicly available child care consumer education information for
		  parents and help parents access safe, affordable, and quality child care in
		  their community; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91b04ef0-1a31-4205-8214-6e7761571195"><enum>(B)</enum><text display-inline="yes-display-inline">to allow persons
		  to report (anonymously if desired) suspected child abuse or neglect, or
		  violations of health and safety requirements, by an eligible child care
		  provider that receives assistance under this subchapter.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f8c5ffc-5e20-45b5-97b3-5e0013a08135"><enum>(2)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The
		  Secretary shall ensure that the hotline and Web site meet the following
		  requirements:</text><subparagraph commented="no" display-inline="no-display-inline" id="ida0b7d6bd-cb8a-44d5-84dc-ff62d31e03de"><enum>(A)</enum><header display-inline="yes-display-inline">Referral to
		  local child care providers</header><text display-inline="yes-display-inline">The Web site shall be hosted by
		  <quote>childcare.gov</quote>. The Web site shall enable a child care consumer
		  to enter a zip code and obtain a referral to local child care providers
		  described in subparagraph (B) within a specified search radius.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idccac397e-3127-4b83-b45d-70b925e42735"><enum>(B)</enum><header display-inline="yes-display-inline">Information</header><text display-inline="yes-display-inline">The
		  Web site shall provide to consumers, directly or through linkages to State
		  databases, at a minimum—</text><clause commented="no" display-inline="no-display-inline" id="idcbd78ead-4efb-4798-8135-47682018ca91"><enum>(i)</enum><text display-inline="yes-display-inline">a
		  localized list of all State licensed child care providers;</text></clause><clause commented="no" display-inline="no-display-inline" id="id51767a6b-ab0e-43a9-af83-ae65d713680b"><enum>(ii)</enum><text display-inline="yes-display-inline">any
		  provider-specific information from a Quality Rating and Improvement System or
		  information about other quality indicators, to the extent the information is
		  publicly available and to the extent practicable;</text></clause><clause commented="no" display-inline="no-display-inline" id="id58d2a62a-0e23-4702-a8e0-76def2c64086"><enum>(iii)</enum><text display-inline="yes-display-inline">any
		  other provider-specific information about compliance with licensing, and health
		  and safety, requirements to the extent the information is publicly available
		  and to the extent practicable;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide15015d0-600c-4bd9-8ac4-8205334927e6"><enum>(iv)</enum><text display-inline="yes-display-inline">referrals to
		  local resource and referral organizations from which consumers can find more
		  information about child care providers, and a recommendation that consumers
		  consult with the organizations when selecting a child care provider; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idffe92464-8a7a-4be6-9770-4e047927f4e2"><enum>(v)</enum><text display-inline="yes-display-inline">State
		  information about child care subsidy programs and other financial supports
		  available to families.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id671722b8-4cfa-4f2b-b227-ba044e6297f9"><enum>(C)</enum><header display-inline="yes-display-inline">Nationwide
		  capacity</header><text display-inline="yes-display-inline">The Web site and hotline shall have the capacity to help
		  families in every State and community in the Nation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb5cb9663-9334-4b6a-a13a-524429c4d994"><enum>(D)</enum><header display-inline="yes-display-inline">Information at
		  all hours</header><text display-inline="yes-display-inline">The Web site shall provide, to parents and families,
		  access to information about child care 24 hours a day.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56843aaf-95c1-4336-9fa5-a56a339c41ba"><enum>(E)</enum><header display-inline="yes-display-inline">Services in
		  different languages</header><text display-inline="yes-display-inline">The Web site and hotline shall ensure the
		  widest possible access to services for families who speak languages other than
		  English.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd5f23290-d496-44ed-88d9-02ac19afd069"><enum>(F)</enum><header display-inline="yes-display-inline">High-quality
		  consumer education and referral</header><text display-inline="yes-display-inline">The Web site and hotline shall
		  ensure that families have access to child care consumer education and referral
		  services that are consistent and of high quality.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21488e73-5d66-4733-9913-ce228c98b584"><enum>(3)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">Nothing
		  in this subsection shall be construed to allow the Secretary to compel States
		  to provide additional data and information that is currently (as of the date of
		  enactment of the <short-title>Child Care and Development Block Grant Act of 2014</short-title>) not publicly available, or is not
		  required by this
		  subchapter.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idD906F14A5BDB4F9DA260A360779A3008"><enum>(e)</enum><header>Protection of information</header><text>Section
		658K(a)(1) of the Child Care and Development Block Grant Act of 1990 (42 U.S.C.
			 9858i(a)(1)) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id387EF38570EA40ABAA36B81688BB171E" style="OLC"><subparagraph id="id4C2528B7174946C78256BF9322AD9907"><enum>(E)</enum><header>Prohibition</header><text>Reports submitted to the Secretary under subparagraph (C) shall not contain individually

			 subparagraph as the <quote>reservation year</quote>) if —</text><clause id="idBC55073F73E8466AA1CD1A2CB6598D94"><enum>(i)</enum><text>the amount appropriated under section 658B for the reservation year is greater than the amount
			 appropriated under section 658B for fiscal year 2014; and</text></clause><clause id="id054E6F4A1AB549C98FE98FCFDE51AC4A"><enum>(ii)</enum><text>the Secretary ensures that the amount allotted to States under subsection (b) for the reservation
			 year is not less than the amount allotted to States under subsection (b)
			 for fiscal year 2014.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id2DB4565B7DDD4BAB91987C48364802D0"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id9656b8c3-4977-4dd4-863e-db3769ef596a" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="idccf718e9-3034-4f11-bd2f-a90c2c07989d"><enum>(3)</enum><header display-inline="yes-display-inline">National
		  toll-free hotline and Web site</header><text display-inline="yes-display-inline">The Secretary shall reserve not
		  less than $1,000,000 of the amount appropriated under this subchapter for each
		  fiscal year for the operation of a national toll-free hotline and Web site,
		  under section 658L(b).</text></paragraph><after-quoted-block>;
		  and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3692BA042CE7400C8CE76192E5393BC6"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1161028AB02742E29CFDFAD10FA97148"><enum>(A)</enum><text>in paragraph (2), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id6FBD26A82A7F4DA99158BCC1BC550BB5" style="OLC"><subparagraph id="idd220ecbd250f4e42a74c56ff44b2de10"><enum>(D)</enum><header>Licensing and standards</header><text>In lieu of any licensing and regulatory requirements applicable under State or local law, the
			 Secretary, in consultation with Indian tribes and tribal organizations,
			 shall develop minimum child care standards that shall be applicable to
			 Indian tribes and tribal organizations receiving assistance under this
			 subchapter. Such standards shall appropriately reflect Indian tribe and
			 tribal organization needs and available resources, and shall include
			 standards requiring a publicly available application, health and safety
			 standards, and standards requiring a reservation of funds for activities
			 to improve the quality of child care provided to Indian children.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6CDA1B59EA524BADA66C5EDC0957663E"><enum>(B)</enum><text>in paragraph (6), by striking subparagraph (C) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id467356A0EACB4E8BAC71280406D321EC" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="idAA39E932AEDD42BD82AE0CD2113B60C0"><enum>(C)</enum><header>Limitation</header><clause commented="no" display-inline="no-display-inline" id="id05A2D9C48DD8428C9E035876B4294369"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), the Secretary may not permit an Indian tribe or tribal
			 organization to use amounts provided under this subsection for
			 construction or renovation if the use will result in a decrease in the
			 level of child care services provided by the Indian tribe or tribal
			 organization as compared to the level of child care services provided by
			 the Indian tribe or tribal organization in the fiscal year preceding the
			 year for which the determination under subparagraph (B) is being made.</text></clause><clause commented="no" display-inline="no-display-inline" id="idAAA3216D80DE4DC794415BF3E9ED09B0"><enum>(ii)</enum><header>Waiver</header><text>The Secretary shall waive the limitation described in clause (i) if—</text><subclause commented="no" display-inline="no-display-inline" id="id69275C30B8614C369BCEC2060A10BBDE"><enum>(I)</enum><text>the Secretary determines that the decrease in the level of child care services provided by the
			 Indian tribe or tribal organization is temporary; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3B935F2F904B4E8FBF56E8548C04C104"><enum>(II)</enum><text>the Indian tribe or tribal organization submits to the Secretary a plan that demonstrates that
			 after the date on which the construction or renovation is completed—</text><item commented="no" display-inline="no-display-inline" id="idE079E4B2499641AE8C8AF48BB35AB055"><enum>(aa)</enum><text>the level of child care services will increase; or</text></item><item commented="no" display-inline="no-display-inline" id="idAFDC8109ABD144CC85095DBD3BF4FC9F"><enum>(bb)</enum><text>the quality of child care services will improve.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idc687e7a5-98a0-4624-8bd5-29d9931b6a6f" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">Section 658P of the Child Care and
		Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858n">42 U.S.C. 9858n</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id5fffa280-c816-48d4-9681-39854c662edf"><enum>(1)</enum><text display-inline="yes-display-inline">by striking
		paragraph (4) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="ida4625518-b6f1-4b13-b0fc-51042b638f43" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id0b309c13-1517-488c-b586-f517bebb3eaf"><enum>(3)</enum><header display-inline="yes-display-inline">Child with a
		  disability</header><text display-inline="yes-display-inline">The term <term>child with a disability</term>

		  disability, as defined in section 602 of the Individuals with Disabilities
		  Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1b51f0e4-c320-4d69-ab09-d7d94deb8d79"><enum>(B)</enum><text display-inline="yes-display-inline">a child who is
		  eligible for early intervention services under part C of the Individuals with
		  Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1431">20 U.S.C. 1431 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf19e4d9d-ce01-4504-bb14-8a76447cbbd3"><enum>(C)</enum><text display-inline="yes-display-inline">a child who is
		  less than 13 years of age and who is eligible for services under section 504 of
		  the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id444d357e-f1ad-474c-9a8e-69c436c82207"><enum>(D)</enum><text display-inline="yes-display-inline">a child with a
		  disability, as defined by the State involved.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ba7075d-d2ca-4224-ba6c-e3b87b507af8"><enum>(4)</enum><header display-inline="yes-display-inline">Eligible
		  child</header><text display-inline="yes-display-inline">The term <term>eligible child</term> means an
		  individual—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3d668f68-9483-4c39-b69a-d75329411a62"><enum>(A)</enum><text display-inline="yes-display-inline">who is less than
		  13 years of age;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8be965f0-5e7d-4be6-9c72-b2e82c4d961f"><enum>(B)</enum><text display-inline="yes-display-inline">whose family
		  income does not exceed 85 percent of the State median income for a family of
		  the same size, and whose family assets do not exceed $1,000,000 (as certified by
			 a member of such family); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3400aa92-ea62-4a79-8011-ef3718972c1f"><enum>(C)</enum><text display-inline="yes-display-inline">who—</text><clause commented="no" display-inline="no-display-inline" id="id19818de1-21aa-4d55-a3d6-673b82d6ae03"><enum>(i)</enum><text display-inline="yes-display-inline">resides with a
		  parent or parents who are working or attending a job training or educational
		  program; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id257adb92-f948-4a0d-bf69-cd855fcaf8ac"><enum>(ii)</enum><text display-inline="yes-display-inline">is
		  receiving, or needs to receive, protective services and resides with a parent
		  or parents not described in clause

			 entities, such as faith-based providers.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="id8147856227B94D1BB39EAD817F3ADC43" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Studies on
		waiting lists</header><subsection commented="no" display-inline="no-display-inline" id="idD81FEB2B33694253A8967447A5E374F3"><enum>(a)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">The
		Comptroller General of the United States shall conduct studies to determine,
		for each State, the number of families that—</text><paragraph commented="no" display-inline="no-display-inline" id="id2BEE11D4A7294EBF8A62B21CADB87CFE"><enum>(1)</enum><text display-inline="yes-display-inline">are eligible to
		receive assistance under the Child Care and Development Block Grant Act of 1990
		(<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858 et seq.</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0BB769C528E54AF8B9529A7CF3FF7CC2"><enum>(2)</enum><text display-inline="yes-display-inline">have applied for
		the assistance; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD9C3313D45924D03AC0C6194515597E4"><enum>(3)</enum><text display-inline="yes-display-inline">have been placed
		on a waiting list for the assistance.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2D910A28E0E64114807A63F7269E54DD"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The
		Comptroller General shall prepare a report containing the results of each study
		and shall submit the report to the appropriate committees of Congress—</text><paragraph commented="no" display-inline="no-display-inline" id="id526484777EEB4115B0863F67E3639A8F"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 2
		years after the date of enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB13FF2B620704F2EB1518E78B9308649"><enum>(2)</enum><text display-inline="yes-display-inline">every 2 years
		thereafter.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC52C54543A6046E7B998F07DEA8AE3D1"><enum>(c)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In
		this section, the term <term>State</term> has the meaning given the term in
		section 658P of the Child Care and Development Block Grant Act of 1990 (42
		U.S.C. 9858n).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id4ADEA83FA0904717ACDD5A1CA3CBE08B" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="no-display-inline">Section 319C–1(b)(2)(A)(vii) of the Public Health Service Act (42 U.S.C. 247d–3a(b)(2)(A)(vii)) is
			 amended by inserting <quote>or established</quote> after <quote>designated</quote>.</text></section><section id="id6E6C56B22DA84D3C9AE63E67D0DA0026"><enum>13.</enum><header>Review of Federal early learning and care programs</header><subsection id="id1d82bed09b5742d183e471a1111eaad8"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services, in conjunction with the Secretary of Education, shall
			 conduct an interdepartmental review of all early learning and care
			 programs in order to—</text><paragraph id="iddcf651fbf9d64cd3833d695f8c8c9c7c"><enum>(1)</enum><text>develop a plan for the elimination of duplicative and overlapping programs, as identified by the
			 Government Accountability Office’s 2012 annual report (GAO–12–342SP); and</text></paragraph><paragraph id="idc7b9d9308da24e3fb3cf23aa85a0b89f"><enum>(2)</enum><text>make recommendations to Congress for streamlining all such programs.</text></paragraph></subsection><subsection id="ide2ea571268a14cc0ac2e68f8af1e9762"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human
			 Services, in consultation with the Secretary of Education and the heads of
			 all Federal agencies that administer Federal early learning and care
			 programs, shall submit to the Committee on Health, Education, Labor, and
			 Pensions  of the Senate and the Committee on Education and the Workforce
			 of the House of Representatives, a detailed report that outlines the
			 efficiencies that can be achieved by, as well as specific recommendations
			 for, eliminating duplication, overlap, and fragmentation among all Federal
			 early learning and care programs.</text></subsection></section><section id="id1E3EC93DBCBE416FBC7C520A26485F03"><enum>14.</enum><header>Safe Child Care Act</header><subsection id="S1"><enum>(a)</enum><header>Short
			 title</header><text display-inline="yes-display-inline">This section may be cited as
			 the <quote><short-title>Safe Child Care Act of 2014</short-title></quote>.</text></subsection><subsection id="id6C17143A55EC46EF919D3066FD2FB95E"><enum>(b)</enum><header>Background
			 checks</header><text display-inline="yes-display-inline">Section 231 of the

				search, including a fingerprint check, of the State criminal
			 registry or

				member previously resided during the longer of—</text><subclause commented="no" display-inline="no-display-inline" id="id46EF9995C53047B69C2130AA76C06165"><enum>(I)</enum><text display-inline="yes-display-inline">the 10-year period ending on the date on
				which the background check is initiated; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3888484010D5431BA6C965B21BDA1116"><enum>(II)</enum><text display-inline="yes-display-inline">the period beginning on the date on which
				the child care staff member attained 18 years of age and ending on
			 the date on
				which the background check is initiated;</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8075cf6eac384942aeddef16bf89e2a7"><enum>(B)</enum><text display-inline="yes-display-inline">a
				search of State-based child abuse and neglect registries and
			 databases
				in—</text><clause commented="no" display-inline="no-display-inline" id="idB03B932454704D0DBFF43ED12FD5D339"><enum>(i)</enum><text display-inline="yes-display-inline">the State where the child care staff member
				resides; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5051C453B4344EC9A0F7CDF408C43FEC"><enum>(ii)</enum><text display-inline="yes-display-inline">each State where the child care staff
				member previously resided during the longer of—</text><subclause commented="no" display-inline="no-display-inline" id="id0C6C57E142794972AB93ABA8AF1236A5"><enum>(I)</enum><text display-inline="yes-display-inline">the 10-year period ending on the date on
				which the background check is initiated; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idB1DDDE828661487DA0A285CCBE3C7DF2"><enum>(II)</enum><text display-inline="yes-display-inline">the period beginning on the date on which
				the child care staff member attained 18 years of age and ending on
			 the date on
				which the background check is initiated;</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3d40b686b651414bb51670f83392271e"><enum>(C)</enum><text display-inline="yes-display-inline">a
				search of the National Crime Information Center database;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID14baa835c324481a935af67339577160"><enum>(D)</enum><text display-inline="yes-display-inline">a
				Federal Bureau of Investigation fingerprint check using the
			 Integrated
				Automated Fingerprint Identification System;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID53a8ac71339f4cf99b2546201dce5829"><enum>(E)</enum><text display-inline="yes-display-inline">a
				search of the National Sex Offender Registry established under the
			 Adam Walsh
				Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16901">42 U.S.C. 16901 et seq.</external-xref>);
			 and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id70D21347BFE0419A9FE76840FDCEC7A3"><enum>(F)</enum><text display-inline="yes-display-inline">a
				search of the State sex offender registry established under that
			 Act in—</text><clause commented="no" display-inline="no-display-inline" id="id3F6983996F6E4765A186EFC6A1D62948"><enum>(i)</enum><text display-inline="yes-display-inline">the State where the child care staff member
				resides; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id18003869E96F400E9A3D6DC43F11249E"><enum>(ii)</enum><text display-inline="yes-display-inline">each State where the child care staff
				member previously resided during the longer of—</text><subclause commented="no" display-inline="no-display-inline" id="id76F90ECB9F1F49A7A5E48F93B03F86BC"><enum>(I)</enum><text display-inline="yes-display-inline">the 10-year period ending on the date on
				which the background check is initiated; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0422CD518C5D41D9BD5A47AEAF84BA59"><enum>(II)</enum><text display-inline="yes-display-inline">the period beginning on the date on which
				the child care staff member attained 18 years of age and ending on
			 the date on
				which the background check is initiated.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcdc116efb0ec441bb1ea697ee51119be" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A
				child care staff member shall be ineligible for employment by a
			 child care
				provider if such individual—</text><subparagraph commented="no" display-inline="no-display-inline" id="ID18cde011fae646b19040e142a8cf0681"><enum>(A)</enum><text display-inline="yes-display-inline">refuses to consent to the background check
				described in subsection (a);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDde3f9523f8b046b582e1098b3fb81e73"><enum>(B)</enum><text display-inline="yes-display-inline">makes a false statement in connection with
				such background check;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4c87a0ada93e4de9a86854c9ecc92af7"><enum>(C)</enum><text display-inline="yes-display-inline">is
				registered, or is required to be registered, on a State sex
			 offender registry
				or the National Sex Offender Registry established under the Adam
			 Walsh Child
				Protection and Safety Act of 2006; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDecd82753658f4738aeb49b0d9c73244e"><enum>(D)</enum><text display-inline="yes-display-inline">has been convicted of a felony consisting
				of—</text><clause commented="no" display-inline="no-display-inline" id="ID9b83d9b834bc4a76832c5c36a77bdd55"><enum>(i)</enum><text display-inline="yes-display-inline">murder, as described in section 1111 of
				title 18, United States Code;</text></clause><clause commented="no" display-inline="no-display-inline" id="ID8e4f4f51876a47b99a8f36fb893d3ad7"><enum>(ii)</enum><text display-inline="yes-display-inline">child abuse or neglect;</text></clause><clause commented="no" display-inline="no-display-inline" id="ID3dd0d16d93df4b17b64c3a94f92b231f"><enum>(iii)</enum><text display-inline="yes-display-inline">a crime against children, including child
				pornography;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDdb535319e6ec44eb9d2b6de844bbd7f3"><enum>(iv)</enum><text display-inline="yes-display-inline">spousal abuse;</text></clause><clause commented="no" display-inline="no-display-inline" id="ID7f152a5165e74b1489141db997d50883"><enum>(v)</enum><text display-inline="yes-display-inline">a crime involving rape or sexual
				assault;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDd5b93db455ff48d88c4aec00d21bcaf3"><enum>(vi)</enum><text display-inline="yes-display-inline">kidnapping;</text></clause><clause commented="no" display-inline="no-display-inline" id="IDa71bf0a01445431a8bf5145af3b31142"><enum>(vii)</enum><text display-inline="yes-display-inline">arson;</text></clause><clause commented="no" display-inline="no-display-inline" id="ID3326f3b0f5b04d3abfa9c90c5eb85f8f"><enum>(viii)</enum><text display-inline="yes-display-inline">physical assault or battery; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id6EDCBD712FC742FDAC5E1DAEC1DEB33A"><enum>(ix)</enum><text display-inline="yes-display-inline">subject to paragraph (5)(D), a drug-related
				offense committed during the preceding 5 years.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID491a340faa4940c0b7e1f9ab8bc53dca" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD2FDFEC96023484689F9F1288DC4372E"><enum>(A)</enum><text display-inline="yes-display-inline">A child care provider covered by paragraph
				(3) shall submit a request, to the appropriate State agency
			 designated by a
				State, for a background check described in subsection (a), for each
			 child care
				staff member (including prospective child care staff members) of
			 the
				provider.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD343A7CD55244A62A673CE9C91051B5F" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of an individual who is hired
				as a child care staff member before the date of enactment of the
				<short-title>Safe Child Care Act of 2014</short-title>,
				the provider shall submit such a request—</text><clause commented="no" display-inline="no-display-inline" id="id54581D03A28C4E958CB051F7ABA140C5"><enum>(i)</enum><text display-inline="yes-display-inline">prior to the last day of the second full
				fiscal year after that date of enactment; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idEB6DC0178CA04927A8A56818A65267C0"><enum>(ii)</enum><text display-inline="yes-display-inline">not less often than once during each 5-year
				period following the first submission date under this subparagraph
			 for that
				staff member.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCE9EE9153F464555B20A6F35472D3D84" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of an individual who is a
				prospective child care staff member on or after that date of
			 enactment, the
				provider shall submit such a request—</text><clause commented="no" display-inline="no-display-inline" id="id228A0B03391C4CB285A47123ACB6A42A"><enum>(i)</enum><text display-inline="yes-display-inline">prior to the date the individual becomes a
				child care staff member of the provider; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7B0E9F68ADF54C5E82C93DDF5D4AB912"><enum>(ii)</enum><text display-inline="yes-display-inline">not less often than once during each 5-year
				period following the first submission date under this subparagraph
			 for that
				staff member.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb752b7f2ee9b4d97a600a0324997461d" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idA20A069213BE4B0099E42112DD6EFE56"><enum>(A)</enum><text display-inline="yes-display-inline">The State shall—</text><clause commented="no" display-inline="no-display-inline" id="idCD2789DA6A60457384AFF6444707B74E" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">carry out the request of a child care
				provider for a background check described in subsection (a) as
			 expeditiously as
				possible; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9FA9E067C9E14F0B8DC92A2E95650650" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">in accordance with subparagraph (B) of this
				paragraph, provide the results of the background check to—</text><subclause commented="no" display-inline="no-display-inline" id="idBF47E34B89D64247A013FA713A0CB7F1"><enum>(I)</enum><text display-inline="yes-display-inline">the child care provider; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idF0F2BC25E15E4A30AB2E336FEA8EA632"><enum>(II)</enum><text display-inline="yes-display-inline">the current or prospective child care staff
				member for whom the background check is conducted.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcdc611da4b81486ea93c5a09303b9f9e" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idED4D3A341D244480B9007AEF1D48AFC3"><enum>(i)</enum><text display-inline="yes-display-inline">The State shall provide the results of a
				background check to a child care provider as required under
			 subparagraph
				(A)(ii)(I) in a statement that—</text><subclause commented="no" display-inline="no-display-inline" id="idC00DDCA18A9045518173F7B83BC81F5C" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">indicates whether the current or
				prospective child care staff member for whom the background check
			 is conducted
				is eligible or ineligible for employment by a child care provider;
			 and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id43B3C116D4E34D17AF5DDB3419596255" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">does not reveal any disqualifying crime or
				other related information regarding the current or prospective
			 child care staff
				member.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idB3A573B912C54742A6C3F929C04F6293" indent="up1"><enum>(ii)</enum><text>If a current or prospective child
				care staff member is ineligible for employment by a child care
			 provider due to
				a background check described in subsection (a), the State shall
			 provide the
				results of the background check to the current or prospective child
			 care staff
				member as required under subparagraph (A)(ii)(II) in a criminal
			 background
				report that includes information relating to each disqualifying
			 crime.</text></clause><clause commented="no" display-inline="no-display-inline" id="id731597714F54488D9BB342D4C8A42148" indent="up1"><enum>(iii)</enum><text>A State—</text><subclause commented="no" display-inline="no-display-inline" id="id742FF414B84243D4B6AC3FFE457E82D7"><enum>(I)</enum><text>may not publicly release or share the
				results of an individual background check described in subsection
			 (a);
				and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id12EFF093CACA49B3A825785BC2C9F002"><enum>(II)</enum><text>may include the results of background
				checks described in subsection (a) in the development or
			 dissemination of local
				or statewide data relating to background checks if the results are
			 not
				individually identifiable.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB4C19F6230D64DDD9848F2E49E030436" indent="up1"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id551C11104A8D49F5835DAFA035C4942C"><enum>(i)</enum><text>The State shall provide
				for a process by which a child care staff member (including a
			 prospective child
				care staff member) may appeal the results of a background check
			 required under
				subsection (a) to challenge the accuracy or completeness of the
			 information
				contained in the criminal background report of the staff member.</text></clause><clause commented="no" display-inline="no-display-inline" id="idD0AC506507314704B4DAC5AE0D667ED0" indent="up1"><enum>(ii)</enum><text>The State shall ensure that—</text><subclause commented="no" display-inline="no-display-inline" id="id3A458CC02AF84F1C86F20294EED6B679"><enum>(I)</enum><text>the appeals process is completed in a
				timely manner for each child care staff member;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idF220BE1324A84BF38E95402A9C2D6FA5"><enum>(II)</enum><text>each child care staff member is given
				notice of the opportunity to appeal; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3CD0413FD36C4E6AA13917644DB30062"><enum>(III)</enum><text>each child care staff member who
				wishes to challenge the accuracy or completeness of the information
			 in the
				criminal background report of the child care staff member is given
			 instructions
				about how to complete the appeals process.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20DE15E5696B40D9A022C0BA1D5E9E8D" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="id3D108DD5B30C4B3686D2EF536DF35B9E"><enum>(i)</enum><text>The State may allow for
				a review process through which the State may determine that a child
			 care staff
				member (including a prospective child care staff member)
			 disqualified for a
				crime specified in paragraph (3)(D)(ix) is eligible for employment
			 by a child
				care provider, notwithstanding paragraph (3).</text></clause><clause commented="no" display-inline="no-display-inline" id="id3629E501920540B986F63D6DEBB6FCC9" indent="up1"><enum>(ii)</enum><text>The review
				process under this subparagraph shall be consistent with title VII
			 of the Civil
				Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e">42 U.S.C. 2000e et seq.</external-xref>).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id615F3DBFFBA54668B67958B7B7D9A2BD" indent="up1"><enum>(E)</enum><text>Nothing in this section shall be
				construed to create a private right of action against a child care
			 provider if
				the child care provider is in compliance with this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ACAA09DA799482C9B10CF4A8391F5B9" indent="up1"><enum>(F)</enum><text>This section shall apply to each
				State that receives funding under the Child Care and Development
			 Block Grant
				Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858">42 U.S.C. 9858 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb39195406c7a40cda783b68f006e2006" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">Fees that the State may charge for the
				costs of conducting a background check as required by subsection
			 (a) shall not
				exceed the actual costs to the State for the administration of such
			 background
				checks.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc8fec13413764ddd8aeda4432f1f8423" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">Nothing in this subsection shall be
				construed to prevent a Federal agency from disqualifying an
			 individual as a
				child care staff member based on a conviction of the individual for
			 a crime not
				specifically listed in this subsection that bears upon the fitness
			 of an
				individual to provide care for and have responsibility for the
			 safety and
				well-being of children.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5dad29deafb84b5e8a7a06392d053d94" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">In this subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="IDd8961c9832a64fa19913f622a53e9bb3"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>child care provider</term>
				means an agency of the Federal Government, or a unit of or
			 contractor with the
				Federal Government that is operating a facility, described in
			 subsection (a);
				and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id55B171F11C664B97925D91F6DF9297B8"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>child care staff
				member</term> means an individual who is hired, or seeks to be hired, by a
				child care provider to be involved with the provision of child care
			 services,
				as described in subsection (a).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id7D157BB753924165A1E55DABD93D81C6"><enum>(5)</enum><text>by striking
			 subsection (c) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="id306075B7E284458187CA44AFE27441B0" style="OLC"><subsection id="ide979d9a647b645749f5fbf6c1ed24d85"><enum>(c)</enum><header>Suspension
				pending disposition of criminal case</header><text>In the case of an incident
				in which an individual has been charged with an offense described
			 in subsection
				(b)(3)(D) and the charge has not yet been disposed of, an employer
			 may suspend
				an employee from having any contact with children while on the job
			 until the
				case is
				resolved.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4A64D0FA52E342D7B6AC0F6B636862DE"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The
			 amendments made by this section shall take effect on October 1 of the
			 second full fiscal
			 year after the date of enactment of this Act.</text></subsection></section><section id="id80E6A01C24A94C889CA4506CD35B0D58"><enum>15.</enum><header>Allotment of space in Federal buildings for child care</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/40/590">Section 590</external-xref> of title 40, United States Code, is amended—</text><paragraph id="idD212B597F91649BA9DC75B5708EA0731"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (a) through (g) as subsections (b) through (h), respectively;</text></paragraph><paragraph id="idA7A132BEC65047BBB681E146C81B5E6A"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before subsection (b) (as so redesignated) the following:</text><quoted-block display-inline="no-display-inline" id="id487BE60CDD5A4FA4A51FCD0C89000AD7" style="OLC"><subsection id="id650B8E6D50614A3692D0EBAC5576B081"><enum>(a)</enum><header>Definition of Federal employee</header><text display-inline="yes-display-inline">In this section, the term <term>Federal employee</term> does not include a person that—</text><paragraph id="id63D0AD1072604DD68ACFA5822F4D7572"><enum>(1)</enum><text display-inline="yes-display-inline">is not employed by the Federal Government; and</text></paragraph><paragraph id="idF457B0F479A54A09A1C77F96ED0CC931"><enum>(2)</enum><text display-inline="yes-display-inline">meets the requirements described in subsection (c)(2)(C)(i)(II).</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id7F4D57F46CF34EF58D5F8C0D3E7D456F"><enum>(3)</enum><text>in paragraph (2)(C) of subsection (c) (as so redesignated), by striking clause (i) and
			 inserting the following:</text><quoted-block display-inline="no-display-inline" id="id9D027583F3A0438F86AE215C486499BC" style="OLC"><clause id="idA105947FEC4740A7BCA519380A5A9A2D"><enum>(i)</enum><text>the space will be used to provide child care services to children of whom at least 50 percent have
			 1 parent or guardian who—</text><subclause id="id58C2C91995914C96B9D0C228B910E375"><enum>(I)</enum><text>is employed by the Federal Government; or</text></subclause><subclause id="idE53B95DB222A446EAA10C664DE290A7D"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id19EE2D42A028431DB01A763D32C0D4B0"><enum>(aa)</enum><text>has met the requirements for a master’s degree or a doctorate degree from an institution of higher
			 education (as defined in section 102 of the Higher Education Act of 1965
			 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)); and</text></item><item id="idA3E6EFF72DD74D41A4284795B2889CA3" indent="up1"><enum>(bb)</enum><text>is conducting research in the Federal building under an arrangement between the parent or guardian 
			 and a Federal agency.</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id61D599917166474DA571211DB62DEA71"><enum>(4)</enum><text>in subsection (d) (as so redesignated), by striking <quote>subsection (b)</quote> each place it appears and inserting <quote>subsection (c)</quote>.</text></paragraph></section><section id="id9CC5F3F28C69483FA84C241FF468BB38"><enum>16.</enum><header>Sense of the Senate on significantly reducing child poverty by calendar year 2019</header><subsection id="idB9E7AADBC59F4C6CBC41AFA114A1B396"><enum>(a)</enum><header>Findings</header><text>The Senate finds that—</text><paragraph id="idddea7002b24c4bccaf3aeafe55a320d9"><enum>(1)</enum><text>the United States has the highest rate of childhood poverty among 34 major countries in the
			 Organisation for Economic Cooperation and Development, including Denmark,
			 Finland, Norway, Iceland, Cyprus, Austria, Sweden, the Czech Republic,
			 Germany, Slovenia, Hungary, South Korea, the United Kingdom, Switzerland,
			 the Netherlands, Ireland, France, Malta, Luxembourg, Slovakia, Estonia,
			 Belgium, New Zealand, Poland, Canada, Australia, Japan, Portugal, Greece,
			 Italy, Lithuania, Latvia, Spain, and Bulgaria;</text></paragraph><paragraph id="id945f64588a6d49dd92e0fd59d0517f7a"><enum>(2)</enum><text>a record-breaking 46,496,000 individuals lived in poverty in the United States in 2012, which is an
			 increase of 14,915,000 individuals since 2000;</text></paragraph><paragraph id="idfd3027d6f37c4b46810c999e1795cc63"><enum>(3)</enum><text>16,073,000 children in the United States lived in poverty in 2012,  which is an increase of
			 4,486,000 children since 2000;</text></paragraph><paragraph id="id493524bd5a4b47c89d3e95dcef2e66a7"><enum>(4)</enum><text>more than 7,100,000 children in the United States, 40 percent of children living in poverty in the
			 United States,  live in extreme poverty (defined as living in families
			 with an income that is less than half of the poverty level);</text></paragraph><paragraph id="id3bab3a0b3f634e8593fb426a8ab0464d"><enum>(5)</enum><text>nearly 1,200,000 public school students in the United States were homeless in  the 2011–2012 school
			 year, an
			 increase of 73 percent since the 2006–2007 school year;</text></paragraph><paragraph id="id2429c08a67b5405aab47ea35c642fc9e"><enum>(6)</enum><text>in an average month in fiscal year 2011, 1,200,000 households  with children in the United States
			 did not have any cash income and, for food, depended only on benefits
			 under the supplemental nutrition assistance program established under the
			 Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>);</text></paragraph><paragraph id="id0031b1d9a7344f758d16b1197dde8bb4"><enum>(7)</enum><text>in 2012, government assistance programs removed from poverty 9,000,000 children, including
			 5,300,000 children through the earned income tax credit under section 32
			 of the Internal Revenue Code of 1986 and the child tax credit under
			 <external-xref legal-doc="usc" parsable-cite="usc/26/24">section 24</external-xref> of the Internal Revenue Code of 1986, and 2,200,000 children
			 through the supplemental nutrition assistance program established under
			 the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>);</text></paragraph><paragraph id="idbcde1c1b26b64b0fba0ebd08fb0527a4"><enum>(8)</enum><text>in 2012, child poverty would have been 57 percent higher, and extreme poverty would have been 240
			 percent higher, without government tax credits and food, housing, and
			 energy benefits;</text></paragraph><paragraph id="id598371ba7ce34ab880d5b2f5cdd07b82"><enum>(9)</enum><text>in 2013, an individual working full-time at the Federal minimum wage could not afford the fair
			 market rent for a 2-bedroom rental unit and have enough money for food,
			 utilities, and other necessities;</text></paragraph><paragraph id="ida2f5df2f973643bea015d3f13b41bffc"><enum>(10)</enum><text>in school years 2009–2010 and 2010–2011, less than half of children ages 3 and 4 were enrolled in
			 preschool;</text></paragraph><paragraph id="idd076a351435445c7a1a600e4406b0b94"><enum>(11)</enum><text>Early Head Start programs carried out under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>) served only
			 4 percent of the 2,900,000 eligible poor infants and toddlers each day in
			 fiscal year 2012, and Head Start programs carried out under such Act
			 served only 41 percent of the 2,000,000 eligible poor children ages 3 and
			 4;</text></paragraph><paragraph id="id4e4a390db8784bef9df9e199158459ca"><enum>(12)</enum><text>more than 220,000 children are on waiting lists for child care assistance; and</text></paragraph><paragraph id="id8f566b23650c4e1188b6b849b9b7c822"><enum>(13)</enum><text>child poverty costs the United States not less than $500,000,000 each year in additional education,
			 health, and criminal justice costs and in lost productivity.</text></paragraph></subsection><subsection id="id8AD23E2D284C4EACB42E56AC64F8AD1D"><enum>(b)</enum><header>Sense of the Senate</header><text>It is the sense of the Senate that the President should immediately present to Congress a
			 comprehensive plan to significantly reduce child
			 poverty in the United States by calendar
