<legis-type>AN ACT</legis-type> 
<official-title display="yes">To authorize the Secretary of the Interior to conduct a special resource study of the archeological site and surrounding land of the New Philadelphia town site in the State of Illinois, and for other purposes.</official-title>

<section id="HB576714A83DE4FB9A7CD2910B329EA22" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>New Philadelphia, Illinois, Study Act</short-title></quote>.</text></section> 
<section id="H8CEDF408F7DD4D86815119A696A4D1EA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="H8DF4B0D02400435386A524AEEDE242F1"><enum>(1)</enum><text>Frank McWorter, an enslaved man, bought his freedom and the freedom of 15 family members by mining for crude niter in Kentucky caves and processing the mined material into saltpeter;</text></paragraph> 
<paragraph id="HF677139985DF4519AE20C03851B05602"><enum>(2)</enum><text>New Philadelphia, founded in 1836 by Frank McWorter, was the first town planned and legally registered by a free African-American before the Civil War;</text></paragraph> 
<paragraph id="H36142412F34A46DF9985FA7847A4CFE5"><enum>(3)</enum><text>the first railroad constructed in the area of New Philadelphia bypassed New Philadelphia, which led to the decline of New Philadelphia; and</text></paragraph> 
<paragraph id="H9F735EE7C85A4D7DA344F51D7AB4B436"><enum>(4)</enum><text>the New Philadelphia site—</text> 
<subparagraph id="H20C62201394140AC8F81D5B3978E221C"><enum>(A)</enum><text>is a registered National Historic Landmark;</text></subparagraph> 
<subparagraph id="HC2A53A9BD0F346D7ABF7064C6272F910"><enum>(B)</enum><text>is covered by farmland; and</text></subparagraph> 
<subparagraph id="HE87132E8CB914666A8B4B10CF9417012"><enum>(C)</enum><text>does not contain any original buildings of the town or the McWorter farm and home that are visible above ground.</text></subparagraph></paragraph></section> 
<section id="H769D28F2B0E248CB9F0B3BA109313576"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HCAED7E853EF349A690CBDE1D67365A99"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HE9D477A770814719B2AD83AF6B680948"><enum>(2)</enum><header>Study Area</header><text>The term <term>Study Area</term> means the New Philadelphia archeological site and the surrounding land in the State of Illinois.</text></paragraph></section> 
<section id="H12EDFEEBD6CD48AB97799B57A1865B43"><enum>4.</enum><header>Special resource study</header> 
<subsection id="HF1839E3ECF63406689399F2FD9005BBB"><enum>(a)</enum><header>Study</header><text>The Secretary shall conduct a special resource study of the Study Area.</text></subsection> 
<subsection id="H236B546157C441C88D5867751AA597D7"><enum>(b)</enum><header>Contents</header><text>In conducting the study under subsection (a), the Secretary shall—</text> 
<paragraph id="HA144029F7C7F42EB92933C0E7484B518"><enum>(1)</enum><text>evaluate the national significance of the Study Area;</text></paragraph> 
<paragraph id="H7D0DED17F1CD4D0697A450F7FCF51DF6"><enum>(2)</enum><text>determine the suitability and feasibility of designating the Study Area as a unit of the National Park System;</text></paragraph> 
<paragraph id="H1F60B19755334172B4AF3EF6C8712B51"><enum>(3)</enum><text>consider other alternatives for preservation, protection, and interpretation of the Study Area by—</text> 
<subparagraph id="H5948C71C62E545EC8C02C98501472807"><enum>(A)</enum><text>Federal, State, or local governmental entities; or</text></subparagraph> 
<subparagraph id="HB78299F3301B4FB891F677B08DEE623F"><enum>(B)</enum><text>private and nonprofit organizations;</text></subparagraph></paragraph> 
<paragraph id="H01BBA9C3FC1B482B9F7B981CA6B07D7B"><enum>(4)</enum><text>consult with—</text> 
<subparagraph id="HC19EF64C209D4A21AC765E7598D45623"><enum>(A)</enum><text>interested Federal, State, or local governmental entities;</text></subparagraph> 
<subparagraph id="HB373E498FEB841C0902CE8E5FA98BFFC"><enum>(B)</enum><text>private and nonprofit organizations; or</text></subparagraph> 
<subparagraph id="H17F8941C2D644555BBA8682CAA68CC57"><enum>(C)</enum><text>any other interested individuals;</text></subparagraph></paragraph> 
<paragraph id="HEB9F2D1F0EBC4F8187A08C0E2385AF1E"><enum>(5)</enum><text>identify cost estimates for any Federal acquisition, development, interpretation, operation, and maintenance associated with the alternatives considered under paragraph (3); </text></paragraph> 
<paragraph id="H2F24D4FBC168452F9ACDCC061B2171B1"><enum>(6)</enum><text>determine the effect of the designation of the Study Area as a unit of the National Park System on—</text> 
<subparagraph id="H5D0D63D6CA01499B95CEC796D97CD304"><enum>(A)</enum><text>existing commercial and recreational activities, including but not limited to hunting, fishing, recreational shooting, and on the authorization, construction, operation, maintenance or improvement of energy production and transmission infrastructure; and</text></subparagraph> 
<subparagraph id="H6999711AD1A24893ADF8DC8415F47471"><enum>(B)</enum><text>the effect of the authority of State and local governments to manage those activities; and</text></subparagraph></paragraph> 
<paragraph id="H5FFC5DCFAC68404E826DCD2353527A5F"><enum>(7)</enum><text>identify any authorities, including condemnation, that will compel or permit the Secretary to influence or participate in local land use decisions (such as zoning) or place restrictions on nonfederal land if the Study Area is designated a unit of the National Park System.</text></paragraph></subsection> 
<subsection id="H7A5B73423A3B4BF8911EFFB112D58B22"><enum>(c)</enum><header>Applicable law</header><text>The study required under subsection (a) shall be conducted in accordance with section 8 of <external-xref legal-doc="public-law" parsable-cite="pl/91/383">Public Law 91–383</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/16/1a">16 U.S.C. 1a–5</external-xref>).</text></subsection> 
<subsection id="HF8EFF4877BDE47FF8DA1E4A2B756861A"><enum>(d)</enum><header>Report</header><text>Not later than 3 years after the date on which funds are first made available for the study under subsection (a), the Secretary shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report containing—</text> 
<paragraph id="HB16B396BD2A54A7B83E6A05C0A16BECA"><enum>(1)</enum><text>the results of the study; and</text></paragraph> 
<paragraph id="H2D7528DBD214422A99CFCE25216F9117"><enum>(2)</enum><text>any conclusions and recommendations of the Secretary.</text></paragraph></subsection></section>
