			 environmental remediation and reclamation of the Three Kids Mine Project
			 Site, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="HAB3F3A6CC52F4AD5B4C25EA76D57CDE2" style="OLC"><section id="HAC2F1B87D642412B8B8452E8C886537A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Three Kids Mine Remediation and
			 Reclamation Act</short-title></quote>.</text></section><section id="HB2A73C939A8B409096D9E28E591BB75D"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H5E08C1BF33074C2CA389F64B0F2B35F1"><enum>(1)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the approximately
			 948 acres of Bureau of Reclamation and Bureau of Land Management land
			 within
			 the Three Kids Mine Project Site, as depicted on the map.</text></paragraph><paragraph id="H16348649DBA64515AAF7BA7E16885315"><enum>(2)</enum><header>Hazardous
			 substance; pollutant or contaminant; remedy</header><text>The terms
			 <term>hazardous substance</term>, <term>pollutant or contaminant</term>, and
			 <term>remedy</term> have the meanings given those terms in section 101 of the
			 Comprehensive Environmental Response, Compensation, and Liability Act of
			 1980
			 (42 U.S.C.
			 9601).</text></paragraph><paragraph id="H9DF152237C6E4185B72A5BBCF7A4F4AF"><enum>(3)</enum><header>Henderson
			 Redevelopment Agency</header><text>The term <term>Henderson Redevelopment
			 Agency</term> means the redevelopment agency of the City of Henderson, Nevada,
			 established and authorized to transact business and exercise the powers of
			 the
			 agency in accordance with the Nevada Community Redevelopment Law (Nev.
			 Rev.
			 Stat. 279.382 to 279.685).</text></paragraph><paragraph id="H142F1222EBA94BF1BC48D165D6F2DC04"><enum>(4)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <quote>Three Kids Mine Project
			 Area</quote> and dated February 6, 2012.</text></paragraph><paragraph id="H3EB93B12A38444AEAC38021FF11D9AA2"><enum>(5)</enum><header>Responsible
			 Party</header><text>The term <quote>Responsible Party</quote> means the private
			 sector entity designated by the Henderson Redevelopment Agency, and
			 approved by
			 the State of Nevada, to complete the assessment, remediation, reclamation
			 and
			 redevelopment of the Three Kids Mine Project Site).</text></paragraph><paragraph id="H97B3B793565647BA80729F4E2971F3BC"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF3E705A581D74E85A3FB4C0EEEDCD8C3"><enum>(7)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Nevada.</text></paragraph><paragraph id="HDE3682A6D25042CC81C467DF81314275"><enum>(8)</enum><header>Three Kids Mine
			 Project Site</header><text>The term <term>Three Kids Mine Project Site</term>
			 means the approximately 1,262 acres of land that is—</text><subparagraph id="HD25F2F06E1A64C55990BCDE2252F0CEF"><enum>(A)</enum><text>comprised
			 of—</text><clause id="HDF5056D935CD46E1B2B22BE50D844A54"><enum>(i)</enum><text>the
			 Federal land; and</text></clause><clause id="H417D74B82FEE43939855AFF90C89A176"><enum>(ii)</enum><text>the
			 approximately 314 acres of adjacent non-Federal land; and</text></clause></subparagraph><subparagraph id="HF9293A9098804005AC126F82D2758333"><enum>(B)</enum><text>depicted as the
			 <term>Three Kids Mine Project Site</term> on the map.</text></subparagraph></paragraph></section><section id="H4D35FF8EF0B242E7A1AFF42C7468B882"><enum>3.</enum><header>Land
			 conveyance</header><subsection id="H1A2E5531AB154B62923B0FAB83EC1011"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding sections 202 and 203 of the Federal Land
			 Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>,
			 1713), not later than 90 days after the date on which the Secretary
			 determines
			 that the conditions described in subsection (b) have been met, and subject
			 to
			 valid existing rights and applicable law, the Secretary shall convey to
			 the
			 Henderson Redevelopment Agency all right, title, and interest of the
			 United
			 States in and to the Federal land.</text></subsection><subsection id="H8824ADB9BB9143E5A028141A26256877"><enum>(b)</enum><header>Conditions</header><paragraph id="HF1F5726F946F4E94A419CB6CE1094FF1"><enum>(1)</enum><header>Appraisal; fair
			 market value</header><subparagraph commented="no" display-inline="no-display-inline" id="H1172812E052D47B8833801B397579E87"><enum>(A)</enum><header>In
			 general</header><text>As consideration for the conveyance under subsection (a),
			 the Henderson Redevelopment Agency shall pay the fair market value of the
			 Federal land, if any, as determined under subparagraph (B) and as adjusted
			 under subparagraph (F).</text></subparagraph><subparagraph id="HA769D9FD48204474BD4142D55D4FBA74"><enum>(B)</enum><header>Appraisal</header><text>The
			 Secretary shall determine the fair market value of the Federal land based
			 on an
			 appraisal—</text><clause id="HAAB581D1492D44E39CE9E751ED776C48"><enum>(i)</enum><text>that
			 is conducted in accordance with nationally recognized appraisal standards,
			 including—</text><subclause id="H1FE28D7E3BE94BB4B0CA12036CB59536"><enum>(I)</enum><text>the Uniform
			 Appraisal Standards for Federal Land Acquisitions; and</text></subclause><subclause id="H2560DDA21EB54FB5AA5DA346F905DD8F"><enum>(II)</enum><text>the Uniform
			 Standards of Professional Appraisal Practice; and</text></subclause></clause><clause id="HF56D2B7303344D5EBE04B04685C50397"><enum>(ii)</enum><text>that does not
			 take into account any existing contamination associated with historical
			 mining
			 on the Federal land.</text></clause></subparagraph><subparagraph id="H6B7015E585B54F9F85A66DD333B438DE"><enum>(C)</enum><header>Remediation and
			 reclamation costs</header><clause id="HC0D2D29FB747452B9FF5158456674FE7"><enum>(i)</enum><header>In
			 general</header><text>The Secretary shall prepare a reasonable estimate of the
			 costs to assess, remediate, and reclaim the Three Kids Mine Project
			 Site.</text></clause><clause id="H79D98BE8540144C388A122E7653B39CD"><enum>(ii)</enum><header>Considerations</header><text>The
			 estimate prepared under clause (i) shall be—</text><subclause id="H5932B6C6CD3F4104BACEF3CD0C999F6C"><enum>(I)</enum><text>based on the
			 results of a comprehensive Phase II environmental site assessment of the
			 Three
			 Kids Mine Project Site prepared by the Henderson Redevelopment Agency or a
			 Responsible Party that has been approved by the State; and</text></subclause><subclause id="HCBABE9C155CF41D08A814E9F8A7081FD"><enum>(II)</enum><text>prepared in
			 accordance with the current version of the ASTM International Standard
			 E–2137–06 (2011) entitled <quote>Standard Guide for Estimating Monetary Costs
			 and Liabilities for Environmental Matters</quote>.</text></subclause></clause><clause id="H0943E352505B4571B6F78079AD861A42"><enum>(iii)</enum><header>Assessment
			 requirements</header><text>The Phase II environmental site assessment prepared
			 under clause (ii)(I) shall, without limiting any additional requirements
			 that
			 may be required by the State, be conducted in accordance with the
			 procedures
			 of—</text><subclause id="HC57376F50C6E49339FDCB273E915A317"><enum>(I)</enum><text>the most recent
			 version of ASTM International Standard E–1527–05 entitled <quote>Standard
			 Practice for Environmental Site Assessments: Phase I Environmental Site
			 Assessment Process</quote>; and</text></subclause><subclause id="H45CA335756AF4AEEAB490F5DB1C1158A"><enum>(II)</enum><text>the most recent
			 version of ASTM International Standard E–1903–11 entitled <quote>Standard Guide
			 for Environmental Site Assessments: Phase II Environmental Site Assessment
			 Process</quote>.</text></subclause></clause><clause id="HB4C96BFC61474C749FB4150661642AB3"><enum>(iv)</enum><header>Review of
			 certain information</header><subclause id="H4AB7AF8C64664669B46E844EB645F497"><enum>(I)</enum><header>In
			 general</header><text>The Secretary shall review and consider cost information
			 proffered by the Henderson Redevelopment Agency, the Responsible Party,
			 and the
			 State in the preparation of the estimate under this subparagraph.</text></subclause><subclause id="H5AD895D83DD14F148CFE9009CD1653FC"><enum>(II)</enum><header>Final
			 determination</header><text>If there is a disagreement among the Secretary,
			 Henderson Redevelopment Agency, and the State over the reasonable estimate
			 of
			 costs under this subparagraph, the parties shall jointly select 1 or more
			 experts to assist the Secretary in making the final estimate of the
			 costs.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBB56DB7299F94A49BDABF4A11EC3D6FC"><enum>(D)</enum><header>Deadline</header><text>Not
			 later than 30 days after the date of enactment of this Act, the Secretary
			 shall
			 begin the appraisal and cost estimates under subparagraphs (B) and (C),
			 respectively.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9AA78806764E4F39AE9D3235E8C47DD7"><enum>(E)</enum><header>Appraisal
			 costs</header><text>The Henderson Redevelopment Agency or the Responsible Party
			 shall reimburse the Secretary for the costs incurred in performing the
			 appraisal under subparagraph (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5DE74D16213F4719B85B6A5E7A0A7A4D"><enum>(F)</enum><header>Adjustment</header><text>The
			 Secretary shall administratively adjust the fair market value of the
			 Federal
			 land, as determined under subparagraph (B), based on the estimate of
			 remediation, and reclamation costs, as determined under subparagraph
			 (C).</text></subparagraph></paragraph><paragraph id="H255E5389F7C748528941BDF572FA85A3"><enum>(2)</enum><header>Mine remediation
			 and reclamation agreement executed</header><subparagraph id="H1E8FE339B1024DF9BDB7CD5FB09B18BB"><enum>(A)</enum><header>In
			 general</header><text>The conveyance under subsection (a) shall be contingent
			 on—</text><clause id="H8330758816FF4B7883126F5CE5A07346"><enum>(i)</enum><text>the
			 Secretary receiving from the State written notification that a mine
			 remediation
			 and reclamation agreement has been executed in accordance with
			 subparagraph
			 (B); and</text></clause><clause id="H3D54C9240FF843078DDB87857A9B22BE"><enum>(ii)</enum><text>the
			 Secretary concurring, not later than 30 days after the date of receipt of
			 the
			 written notification under clause (i), that the requirements under
			 subparagraph
			 (B) have been met.</text></clause></subparagraph><subparagraph id="H3D223691B9484359B689250BBA204FDA"><enum>(B)</enum><header>Requirements</header><text>The
			 mine remediation and reclamation agreement required under subparagraph (A)
			 shall be an enforceable consent order or agreement between the State and
			 the
			 Responsible Party who will be obligated to perform under the consent order
			 or
			 agreement administered by the State that—</text><clause id="HC2F2BE45F70749B0A8D26A57CB807765"><enum>(i)</enum><text>obligates the
			 Responsible Party to perform, after the conveyance of the Federal land
			 under
			 this Act, the remediation and reclamation work at the Three Kids Mine
			 Project
			 Site necessary to ensure all remedial actions necessary to protect human
			 health
			 and the environment with respect to any hazardous substances, pollutant,
			 or
			 contaminant will be taken, in accordance with all Federal, State, and
			 local
			 requirements; and</text></clause><clause id="H62A8D5E94BC24AC4B341834D2E550F79"><enum>(ii)</enum><text>contains
			 provisions determined to be necessary by the State and the Henderson
			 Redevelopment Agency, including financial assurance provisions to ensure
			 the
			 completion of the remedy.</text></clause></subparagraph></paragraph><paragraph id="HC9EC9A4D22E54C1B9A258BED8A17C778"><enum>(3)</enum><header>Notification
			 from agency</header><text display-inline="yes-display-inline">As a condition of
			 the conveyance under subsection (a), not later than 90 days after the date
			 of
			 execution of the mine remediation and reclamation agreement required under
			 paragraph (2), the Secretary shall accept written notification from the
			 Henderson Redevelopment Agency that the Henderson Redevelopment Agency is
			 prepared to accept conveyance of the Federal land under subsection (a).</text></paragraph></subsection></section><section id="H16F0A53A2DA44EF68534DF282985DA1E"><enum>4.</enum><header>Withdrawal</header><subsection id="H522A17665920400BB7C1A32F3FBC59D9"><enum>(a)</enum><header>In
			 general</header><text>Subject to valid existing rights, for the 10-year period
			 beginning on the earlier of the date of enactment of this Act or the date
			 of
			 the conveyance required by this Act, the Federal land is withdrawn from
			 all
			 forms of—</text><paragraph id="H7FB0E716A3164577BA5904081DD9A501"><enum>(1)</enum><text>entry,
			 appropriation, operation, or disposal under the public land laws;</text></paragraph><paragraph id="H7066BC65FF1641A9BDE7C714E056894D"><enum>(2)</enum><text>location, entry,
			 and patent under the mining laws; and</text></paragraph><paragraph id="H84065F6E015A4B969CFF80078CC316BC"><enum>(3)</enum><text>disposition under
			 the mineral leasing, mineral materials, and the geothermal leasing laws.</text></paragraph></subsection><subsection id="H8998E674554E4726A2073F43BCCF3866"><enum>(b)</enum><header>Existing
			 reclamation withdrawals</header><text>Subject to valid existing rights, any
			 withdrawal under the public land laws that includes all or any portion of
			 the
			 Federal land for which the Bureau of Reclamation has determined that the
			 Bureau
			 of Reclamation has no further need under applicable law is relinquished
			 and
			 revoked solely to the extent necessary—</text><paragraph id="H1ABD270DFD314AEB8D46AEF302311682"><enum>(1)</enum><text>to exclude from
			 the withdrawal the property that is no longer needed; and</text></paragraph><paragraph id="H93A90B36F63040228AC6F1E8D3D983C8"><enum>(2)</enum><text>to allow for the
			 immediate conveyance of the Federal land as required under this Act.</text></paragraph></subsection><subsection id="H04BE4C8C73074EA9A53A6524154810E2"><enum>(c)</enum><header>Existing
			 Reclamation Project and Permitted Facilities</header><text>Except as provided
			 in subsection (a), nothing in this Act diminishes, hinders, or interferes
			 with
			 the exclusive and perpetual use by the existing rights holders for the
			 operation, maintenance, and improvement of water conveyance infrastructure
			 and
			 facilities, including all necessary ingress and egress, situated on the
			 Federal
			 land that were constructed or permitted by the Bureau of Reclamation
			 before the
			 effective date of this Act.</text></subsection></section><section id="HD7EC3E65346E492FB0EE40952EE460E9"><enum>5.</enum><header>ACEC boundary
			 adjustment</header><text display-inline="no-display-inline">Notwithstanding
			 section 203 of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C.
			 1713), the boundary of the River Mountains Area of Critical
			 Environmental Concern (NVN 76884) is adjusted to exclude any portion of
			 the
			 Three Kids Mine Project Site consistent with the map.</text></section><section commented="no" display-inline="no-display-inline" id="H5E66B4C3E8B44988989C15956678BFB7" section-type="subsequent-section"><enum>6.</enum><header>Responsibilities of
			 the parties</header><subsection id="H40AFD9C783AE4AF49BB9341FB95B2B83"><enum>(a)</enum><header>Responsibility
			 of parties to mine remediation and reclamation agreement</header><text>On
			 completion of the conveyance under section 3, the responsibility for
			 complying
			 with the mine remediation and reclamation agreement executed under section
			 3(b)(2) shall apply to the Responsible Party and the State of Nevada.</text></subsection><subsection id="H96019510FD8B43EEB8684EF72D1FDCAA"><enum>(b)</enum><header>Savings
			 provision</header><text>If the conveyance under this Act has occurred, but the
			 terms of the agreement executed under section 3(b)(2) have not been met,
			 nothing in this Act—</text><paragraph id="HB3310A4B8D42413395E7EF74FAB05A04"><enum>(1)</enum><text>affects the
			 responsibility of the Secretary to take any additional response action
			 necessary to protect public health and the environment from a release or
			 the
			 threat of a release of a hazardous substance, pollutant, or contaminant;
			 or</text></paragraph><paragraph id="HB6E223B7B71342CEB94ED3C0A0C01DD3"><enum>(2)</enum><text>unless otherwise
			 expressly provided, modifies, limits, or otherwise affects—</text><subparagraph id="HB86E5CE6100F40D68E7C5E16861E8360"><enum>(A)</enum><text>the application
			 of, or obligation to comply with, any law, including any environmental or
			 public health law; or</text></subparagraph><subparagraph id="H458853A1104C4CC3A17413DD1D9C03DD"><enum>(B)</enum><text>the authority of
			 the United States to enforce compliance with the requirements of any law
			 or the
			 agreement executed under section 3(b)(2).</text></subparagraph></paragraph></subsection></section><section id="HFCF2944A6CFA4EB4BC4B55382FD40BF5"><enum>7.</enum><header>Southern Nevada
			 Public Lands Management Act</header><text display-inline="no-display-inline">Southern Nevada Public Land Management Act
			 of 1998 (31 U.S.C.
			 6901 note;
			 Public Law
			 105–263) shall not apply to land conveyed under this
			 Act.</text></section></legis-body><endorsement><action-date date="20140408">April 8, 2014</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
