<official-title display="yes">To provide for the issuance of coins to commemorate the 100th anniversary of the establishment of the National Park Service, and for other purposes.</official-title>

<section id="HA56BC4975CFF43A8B26E4E036D59E4B9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Park Service 100th Anniversary Commemorative Coin Act</short-title></quote>.</text></section> 
<section id="H8AD49647CA744F52BFD2BD05F6AD0FBA" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="H185A3E0E491E4FB59AD9A8499D4FAEFC"><enum>(1)</enum><text>In 1916, Congress established the National Park Service as a bureau within the Department of the Interior to administer America’s great national parks and monuments as a unified National Park System.</text></paragraph> 
<paragraph id="H13C48E1B7C4C41198B9522414A311193"><enum>(2)</enum><text>From 1916 to the present, the National Park System has grown from 37 park units with 6,000,000 acres of land in the western United States to more than 395 units with 84,000,000 acres of land in nearly all States and territories.</text></paragraph> 
<paragraph id="H563F34CB7D124F9FAB8BA22AC6A4EFCC"><enum>(3)</enum><text>The responsibilities of the National Park Service have grown to include—</text> 
<subparagraph id="H6A05202DCD4347A2AFC6F786B3F37F61"><enum>(A)</enum><text>managing national historic trails and national scenic trails;</text></subparagraph> 
<subparagraph id="HBEDDEFBE0E3445218FB26A419E7026EB"><enum>(B)</enum><text>administering wild and scenic rivers;</text></subparagraph> 
<subparagraph id="H689B0A6A36AC46F3964BB49F8455B796"><enum>(C)</enum><text>recognizing America’s most significant historic resources through the National Register of Historic Places and the National Historic Landmark program;</text></subparagraph> 
<subparagraph id="HD7C1F8BBC1274C318C31AC54B47B5E6A"><enum>(D)</enum><text>providing historic preservation grants; and</text></subparagraph> 
<subparagraph id="H4CF91CCB3C1B408487F0D9E906C7C538"><enum>(E)</enum><text>assisting communities in meeting their preservation, conservation, and recreation needs.</text></subparagraph></paragraph> 
<paragraph id="HC915038CB4C946FDB1D4163315E31CB6"><enum>(4)</enum><text display-inline="yes-display-inline">The National Park Service Organic Act of 1916, which established the National Park Service, remains the preeminent law guiding the management of parks and articulating the Service’s core mission, <quote>to conserve the scenery and the natural and historic objects and the wild life therein and to provide for the enjoyment of the same in such manner and by such means as will leave them unimpaired for the enjoyment of future generations</quote>.</text></paragraph> 
<paragraph id="H70A2ECAACA5E4B158FDE1FCB492591E9"><enum>(5)</enum><text display-inline="yes-display-inline">The 100th anniversary of the National Park Service in 2016 will be an occasion to celebrate a century of American vision and achievement in identifying and preserving our Nation’s special places for the benefit of everyone and the culmination of 100 years of accomplishment by the National Park Service’s employees, partners, and volunteers. It will also mark the beginning of the organization’s second century of service to the American people as environmental leaders and vigilant stewards of the Nation’s treasured places and stories.</text></paragraph> 
<paragraph id="H3F59C42A491E4BFBBDA44917F5CD9EBE"><enum>(6)</enum><text display-inline="yes-display-inline">Coins commemorating the 100th anniversary of the National Park Service will bring national and international attention to the National Park System and to the legacy Congress left in 1916 when it established a Federal agency to ensure the protection of our Nation’s most treasured natural and cultural resources for all time.</text></paragraph> 
<paragraph id="H688441090D7442D78273E3C874B7A9EE"><enum>(7)</enum><text display-inline="yes-display-inline">The proceeds from a surcharge on the sale of commemorative coins will assist the financing of the needs of the National Park Service’s parks and programs, helping to ensure that our Nation’s great natural and cultural resources will endure for generations to come.</text></paragraph></section> 
<section id="H7E1D42300A00462BBE96BF0965CF460D"><enum>3.</enum><header>Coin specifications</header> 
<subsection id="H12A2B90F52E848998EFF2B3417CDD7B6"><enum>(a)</enum><header>Denominations</header><text display-inline="yes-display-inline">The Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coins:</text> 
<paragraph id="H524494C138814E7F9C6B70C954DC9678"><enum>(1)</enum><header>$5 gold coins</header><text display-inline="yes-display-inline">Not more than 100,000 $5 coins, which shall—</text> 
<subparagraph id="HADF97C19ABBC4373B99645D23D5C5CD6"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph> 
<subparagraph id="H46B03B57E5934C35821181E7E8DC15C3"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph> 
<subparagraph id="HDE8EDEFACC354835946A54F320C6682B"><enum>(C)</enum><text>contain 90 percent gold and 10 percent alloy.</text></subparagraph></paragraph> 
<paragraph id="H9F9D0860B6FF4D4DB9A167EC482AA5AE"><enum>(2)</enum><header>$1 silver coins</header><text>Not more than 500,000 $1 coins, which shall—</text> 
<subparagraph id="HCFE6243D8DF447599D0C938327D1AF57"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph> 
<subparagraph id="H10464CDE7AC84918BD319C8E09929982"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph> 
<subparagraph id="H975D99889E6A48EA861165F6C939D651"><enum>(C)</enum><text>contain 90 percent silver and 10 percent copper.</text></subparagraph></paragraph> 
<paragraph id="HB0F87C772D904956B3E3722731EA6DB8"><enum>(3)</enum><header>Half dollar clad coins</header><text>Not more than 750,000 half dollar coins, which shall—</text> 
<subparagraph id="H021D96507E8643759154CC5A9BAE6456"><enum>(A)</enum><text>weigh 11.34 grams;</text></subparagraph> 
<subparagraph id="HB323A346F6354A478F06F9542C88479B"><enum>(B)</enum><text>have a diameter of 1.205 inches; and</text></subparagraph> 
<subparagraph id="H03124D7577104772AF7D65D3859BD31C"><enum>(C)</enum><text display-inline="yes-display-inline">be minted to the specifications for half dollar coins, contained in <external-xref legal-doc="usc" parsable-cite="usc/31/5112">section 5112(b)</external-xref> of title 31, United States Code.</text></subparagraph></paragraph></subsection> 
<subsection id="H42894F1D3DF34A58A83923E530A17F3E"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in <external-xref legal-doc="usc" parsable-cite="usc/31/5103">section 5103</external-xref> of title 31, United States Code.</text></subsection> 
<subsection id="H9B772057AF8B4DA5BBDDBD6190747EA8"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of sections <external-xref legal-doc="usc" parsable-cite="usc/31/5134">5134</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/5136">5136</external-xref> of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection></section> 
<section id="HAEAF623288224FD997ECB436D9B6483C"><enum>4.</enum><header>Design of coins</header> 
<subsection id="H30C76077E51948F6A47A22E24A28AA84"><enum>(a)</enum><header>Design requirements</header> 
<paragraph id="HE1447936BDC24261BF0AB0AAC334119F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The design of the coins minted under this Act shall be emblematic of the 100th anniversary of the National Park Service.</text></paragraph> 
<paragraph id="HBA4E544E06664BC488C0951B9EACE9DE"><enum>(2)</enum><header>Designation and inscriptions</header><text>On each coin minted under this Act there shall be—</text> 
<subparagraph id="H8A7F83CBF5224291B00873A397896843"><enum>(A)</enum><text>a designation of the face value of the coin;</text></subparagraph> 
<subparagraph id="H102A7E8B894B4C60B8689844F89DB567"><enum>(B)</enum><text>an inscription of the year <quote>2016</quote>; and</text></subparagraph> 
<subparagraph id="H4AE800C9BD44403EB0093BB12D43BD32"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HA170684A728240469435D4F762AD4B2C"><enum>(b)</enum><header>Selection</header><text>The design for the coins minted under this Act shall be—</text> 
<paragraph id="H429486F61F9541639C97D9F12C0F90E5"><enum>(1)</enum><text>selected by the Secretary after consultation with—</text> 
<subparagraph id="HD8537A7E485C4E5D9A2208BDE9927451"><enum>(A)</enum><text>the National Park Service;</text></subparagraph> 
<subparagraph id="H25A57AE196AE4B0FBF63495734F2CD18"><enum>(B)</enum><text>the National Park Foundation; and</text></subparagraph> 
<subparagraph id="H5F48E1C9C6BE4201A6D2A1F249183B15"><enum>(C)</enum><text>the Commission of Fine Arts; and</text></subparagraph></paragraph> 
<paragraph id="H74AB6665BA824C66A481E677F494A134"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section> 
<section id="H8C97ED4065BB4BA198E5DE631C5FDAA6"><enum>5.</enum><header>Issuance of coins</header> 
<subsection id="H3A912BE4949F475D86B801903630AAA1"><enum>(a)</enum><header>Quality of coins</header><text display-inline="yes-display-inline">Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection> 
<subsection id="HB5B5D7930D404AEDA2B0593951B881B9"><enum>(b)</enum><header>Period for issuance</header><text>The Secretary may issue coins minted under this Act only during the period beginning on January 1, 2016, and ending on December 31, 2016.</text></subsection></section> 
<section id="H7BD1D14E3E2B47118E529B2D0109D603"><enum>6.</enum><header>Sale of coins</header> 
<subsection id="HAE6ACB434AAC4F9FBF65396ACDBB81A9"><enum>(a)</enum><header>Sale price</header><text display-inline="yes-display-inline">The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text> 
<paragraph id="H1EE0B295635C4136963ABF1439789406"><enum>(1)</enum><text>the face value of the coins;</text></paragraph> 
<paragraph id="H0EB6C3ED4B1A4E8F853EE30A7DE99FA7"><enum>(2)</enum><text>the surcharge provided in section 7(a) with respect to the coins; and</text></paragraph> 
<paragraph id="H10DED6564D0143DEAB82757914F26873"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection> 
<subsection id="H9A32BBBC8ED84DA7A5968ECBD464E14A"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection> 
<subsection id="HA731F9792740407DA287CFF69298FD2B"><enum>(c)</enum><header>Prepaid orders</header> 
<paragraph id="H80B3003C0C5F4DCEABD19DD4D7E762C0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph> 
<paragraph id="H39B9C26694B042D8B448EBBBC8D4F2B0"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section> 
<section id="H74677C207B5F4C4FB7AAC283C0F5083A"><enum>7.</enum><header>Surcharges</header> 
<subsection id="H11EF1371E8C04ACDA0145A10B5CAEC47"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">All sales of coins minted under this Act shall include a surcharge as follows:</text> 
<paragraph id="HCA72B7E739EF474DB9B1F2E7730B9F22"><enum>(1)</enum><text>A surcharge of $35 per coin for the $5 coin.</text></paragraph> 
<paragraph id="HF4977A65503E4177A753E744362B4BA9"><enum>(2)</enum><text>A surcharge of $10 per coin for the $1 coin.</text></paragraph> 
<paragraph id="HCAAEFB31DE284734930A5DB7A9825686"><enum>(3)</enum><text>A surcharge of $5 per coin for the half dollar coin.</text></paragraph></subsection> 
<subsection id="H0817EEC044E3483BB04169089AE23128"><enum>(b)</enum><header>Distribution</header> 
<paragraph id="HF9D0E0727B2441AFA5615FA09D6CAAD9"><enum>(1)</enum><header>In general</header><text>Subject to <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)</external-xref> of title 31, United States Code, all surcharges which are received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the National Park Foundation for projects and programs that help preserve and protect resources under the stewardship of the National Park Service and promote public enjoyment and appreciation of those resources.</text></paragraph> 
<paragraph id="H637F17420AD345E3A7BF6EDD346DF1DB"><enum>(2)</enum><header>Prohibition on land acquisition</header><text>Surcharges paid to the National Park Foundation pursuant to paragraph (1) may not be used for land acquisition.</text></paragraph></subsection> 
<subsection id="HA8F49335FABA4971A20741D5D8F6E8A9"><enum>(c)</enum><header>Audits</header><text>The National Park Foundation shall be subject to the audit requirements of <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)(2)</external-xref> of title 31, United States Code, with regard to the amounts received by the Foundation under subsection (b).</text></subsection> 
<subsection id="HAC5DB8FD768E4DBDB593EBDC39788C3C"><enum>(d)</enum><header>Limitations</header><text>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin program issuance limitation under <external-xref legal-doc="usc" parsable-cite="usc/31/5112">section 5112(m)(1)</external-xref> of title 31, United States Code (as in effect on the date of the enactment of this Act). The Secretary of the Treasury may issue guidance to carry out this subsection.</text></subsection></section>
<section id="H61DA22F24C2A42AF921B64A39C76EDB9"><enum>8.</enum><header>Financial assurances</header><text display-inline="no-display-inline">The Secretary shall take such actions as may be necessary to ensure that—</text>
<paragraph id="HB255B1E274464FFCB0A04B6F106F0DD1"><enum>(1)</enum><text>minting and issuing coins under this Act will not result in any net cost to the United States Government; and</text></paragraph>
<paragraph id="H5F526947AB784DDDAFF27CBBCE14D292"><enum>(2)</enum><text>no funds, including applicable surcharges, shall be disbursed to any recipient designated in section 7 until the total cost of designing and issuing all of the coins authorized by this Act (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping) is recovered by the United States Treasury, consistent with sections <external-xref legal-doc="usc" parsable-cite="usc/31/5112">5112(m)</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/5134">5134(f)</external-xref> of title 31, United States Code.</text></paragraph></section>
<section id="HA2F70ED590DE40F19C866A2CA20DEB71"><enum>9.</enum><header>Budget compliance</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the Committee on the Budget of the House of Representatives, provided that such statement has been submitted prior to the vote on passage.</text></section>
