		<official-title>To amend the African Elephant Conservation Act of 1988 to conserve elephants while appropriately
			 regulating ivory in the United States.</official-title>

		<section id="HD63E265ECE72473BBCADEB11BE441F4E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>African Elephant Conservation and Legal Ivory Possession Act of 2014</short-title></quote>.</text>
		</section><section id="H76F2645AA4C649B79A74C2E02A8C6C79" section-type="subsequent-section"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise specifically provided, whenever in this Act an amendment or repeal is expressed
			 in terms of an amendment to, or repeal of, a provision, the reference
			 shall be considered to be made to a provision of the African Elephant
			 Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4201">16 U.S.C. 4201 et seq.</external-xref>).</text>
		</section><section id="H970F7547146A4B90847665629D1186B3"><enum>3.</enum><header>Limited exemption for certain African elephant ivory</header>
			<text display-inline="no-display-inline">Section 2203 (<external-xref legal-doc="usc" parsable-cite="usc/16/4223">16 U.S.C. 4223</external-xref>) is amended—</text>
			<paragraph id="H042E09F48472466BBE41BD2D8AE8E24F"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In general</header-in-text>.—</quote> before the first sentence;</text>
			</paragraph><paragraph id="HAC9597E0C1AF4BF6A4D2F9319FEED5C4"><enum>(2)</enum><text>by inserting <quote>and subsection (b) of this section</quote> after <quote>2202(e)</quote>; and</text>
			</paragraph><paragraph id="H0D8EB885865F41DE81587A560A39693A"><enum>(3)</enum><text>by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HEF103EC525DC4DF3B667EED1EA2AEA9C" style="OLC">
					<subsection id="HE73048BAAECC43839696F9A7BD8FC0AA"><enum>(b)</enum><header>Exemption</header><text display-inline="yes-display-inline">Nothing in this Act or subsection (a) or (d) of section 9 of the Endangered Species Act of 1973 (16
			 U.S.C. 1538) shall be construed to prohibit importation or exportation, or
			 to require permission of the Secretary for importation or exportation, of—</text>
						<paragraph id="H5D8AA8B27A07444F8929473A5C82C018"><enum>(1)</enum><text display-inline="yes-display-inline">any raw ivory or worked ivory—</text>
							<subparagraph id="H9C9AB7AB77F646D09626B40698FF6012"><enum>(A)</enum><text display-inline="yes-display-inline">imported solely for purposes of becoming part of a museum’s permanent collection, return to a
			 lending museum, or display in a museum; or</text>
							</subparagraph><subparagraph id="H17C371E410F34E219062AE724BCF861F"><enum>(B)</enum><text display-inline="yes-display-inline">exported solely for purposes of—</text>
								<clause id="H0C2EB7114C8D4FF18CCA0475F675B25F"><enum>(i)</enum><text>display in a foreign museum; or</text>
								</clause><clause id="H3CC7AF08DA424CABA1ADB21A500C67D2"><enum>(ii)</enum><text>return to a foreign person who lent such ivory to a museum in the United States;</text>
								</clause></subparagraph></paragraph><paragraph id="H63A2307A437245EC81B8B8F7D5192E60"><enum>(2)</enum><text display-inline="yes-display-inline">any raw ivory or worked ivory that was lawfully importable into the United States on February 24,
			 2014, regardless of when acquired; or</text>
						</paragraph><paragraph id="H791183CAFB9143258BFA996C4AC84A71"><enum>(3)</enum><text display-inline="yes-display-inline">any worked ivory that was previously lawfully possessed in the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H17224ED68596455FA717DA9AF1257CB7"><enum>4.</enum><header>Placement of United States Fish and Wildlife Service law enforcement officer in each African
			 elephant range country</header><text display-inline="no-display-inline">Part I (<external-xref legal-doc="usc" parsable-cite="usc/16/4211">16 U.S.C. 4211 et seq.</external-xref>) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HD7EF37BB32324913A66E1A1F28F6A808" style="OLC">
				<section commented="no" id="H7272CE83DFD44097BF5AEE76C221F861"><enum>2105.</enum><header>Placement of United States Fish and Wildlife Service law enforcement officer in each African
			 elephant range country</header><text display-inline="no-display-inline">The Secretary, in coordination with the Secretary of State, may station one United States Fish and
			 Wildlife Service law enforcement officer in the primary United States
			 diplomatic or consular post in each African country that has a significant
			 population of African elephants, who shall assist local wildlife rangers
			 in the protection of African elephants and facilitate the apprehension of
			 individuals who illegally kill, or assist the illegal killing of, African
			 elephants.</text></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H944051E98E974D269F4DE0CB691F4720"><enum>5.</enum><header> Certification for the purposes of the Fishermen’s Protective Act of 1967</header><text display-inline="no-display-inline">Section 2202 of the African Elephant Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4222">16 U.S.C. 4222</external-xref>) is amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H48F4A266ABFC4890AD0F518A38337665" style="OLC">
				<subsection id="HE211C770BDE449EB931042AACA2965FD"><enum>(g)</enum><header>Certification</header><text>When the Secretary of the Interior finds that a country, directly or indirectly, is a significant
			 transit or destination point for illegal ivory trade, the Secretary shall
			 certify such fact to the President with respect to the country for the
			 purposes of section 8(a) of the Fishermen’s Protective Act of 1967 (22
			 U.S.C. 1978 (a)).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H9DB66E9962DE40528306987BBE2DF311"><enum>6.</enum><header>Treatment of elephant ivory</header><text display-inline="no-display-inline">Section 2203 (<external-xref legal-doc="usc" parsable-cite="usc/16/4223">16 U.S.C. 4223</external-xref>) is further amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HFD4F9C0B460F48608F49E5427171E133" style="OLC">
				<subsection id="H16C9C9F8922B49CE86CCDD76A3BAE778"><enum>(c)</enum><header>Treatment of elephant ivory</header><text display-inline="yes-display-inline">Nothing in this Act or subsection (a) or (d) of section 9 of the Endangered Species Act of 1973 (16
			 U.S.C. 1538) shall be construed—</text>
					<paragraph id="HCF704BFDD70C432EA27D3ED1EC00CCA5"><enum>(1)</enum><text display-inline="yes-display-inline">to prohibit, or to authorize prohibiting, the possession, sale, delivery, receipt, shipment, or
			 transportation of African elephant ivory, or any product containing
			 African elephant ivory, that has been lawfully imported or crafted in the
			 United States; or</text>
					</paragraph><paragraph id="HD2FE609CDC32431B87B5CA394EF36269"><enum>(2)</enum><text display-inline="yes-display-inline">to authorize using any means of determining for purposes of this Act or the Endangered Species Act
			 of 1973 whether African elephant ivory has been lawfully imported,
			 including any presumption or burden of proof applied in such
			 determination, other than such means used by the Secretary as of February
			 24, 2014.</text>
					</paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block>
		</section><section id="H9D6B0E66484E45DA9B9A5EDCA54DB1B7"><enum>7.</enum><header>Sport-hunted elephant trophies</header><text display-inline="no-display-inline">Section 2203 (<external-xref legal-doc="usc" parsable-cite="usc/16/4223">16 U.S.C. 4223</external-xref>) is further amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HFA23534A51204F78A19C8AB99974B9A6" style="OLC">
				<subsection id="H51395E6B6A254D838ED6E63AD7481E1A"><enum>(d)</enum><header>Sport-Hunted elephant trophies</header><text display-inline="yes-display-inline">Nothing in this Act or subsection (a) or (d) of section 9 of the Endangered Species Act of 1973 (16
			 U.S.C. 1538) shall be construed to prohibit any citizen or legal resident
			 of the United States, or an agent of such an individual, from importing a
			 sport-hunted African elephant trophy under section 2202(e) of this Act, if
			 the country in which the elephant was taken has an elephant population on
			 Appendix II of CITES at the time the trophy is imported.</text>
				</subsection><subsection id="H34275AA552C34F37B64E6E5196D1C270"><enum>(e)</enum><header>Relationship to the Convention</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as modifying or repealing the Secretary’s duties to
			 implement CITES and the appendices thereto, or as modifying or repealing
			 section 8A or 9(c) of the Endangered Species Act of 1973 (16 U.S.C. 1537a
			 and 1538(c)).</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HC34996582032475F8B97F3779A2EA5FD"><enum>8.</enum><header>African Elephant Conservation Act financial assistance priority and reauthorization</header>
			<subsection id="HF73F4286D06F4F2F83BBD8E4F548DB37"><enum>(a)</enum><header>Financial assistance priority</header><text display-inline="yes-display-inline">Section 2101 of the African Elephant Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4211">16 U.S.C. 4211</external-xref>) is amended by redesignating
			 subsections (e) and (f) as subsections (f) and (g), respectively, and by
			 inserting after subsection (d) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0D1547DC78424031B00687B80A1C58F7" style="OLC">
					<subsection id="H0F405D22319940C7B059C576C5563E83"><enum>(e)</enum><header>Priority</header><text display-inline="yes-display-inline">In providing financial assistance under this section, the Secretary shall give priority to projects
			 designed to facilitate the acquisition of equipment and training of
			 wildlife officials in ivory producing countries to be used in
			 anti-poaching efforts.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC130778C838A4494B14C2CD7171978C2"><enum>(b)</enum><header>Reauthorization</header><text display-inline="yes-display-inline">Section 2306(a) of the African Elephant Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/4245">16 U.S.C. 4245(a)</external-xref>) is amended by striking <quote>2007 through 2012</quote> and inserting <quote>2015 through 2019</quote>.</text>
