		<section id="H9A146269479643298C213D8E2C1E55B8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Protective Service Parity Act of 2014</short-title></quote>.</text>
		</section><section id="H68765E4D7C8F45D88C825724492767F1"><enum>2.</enum><header>Civil Service Retirement System and Federal Employees Retirement System</header>
			<subsection id="H6DAC3E45D6E2497BAE7E77CF874D7D9D"><enum>(a)</enum><header>Civil service retirement system</header>
				<paragraph id="HED6A2DEB2B594600A1EE846BB7F37E57"><enum>(1)</enum><header>Definition</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8331">Section 8331</external-xref> of title 5, United States Code is amended—</text>
					<subparagraph id="H88D4B6083E7F4B9E9193D22AD6523478"><enum>(A)</enum><text>in paragraph (31), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="H6FA2AFBFA9E8461FAE8194668CE6D010"><enum>(B)</enum><text>in paragraph (32), by striking the period at the end and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="HE7F45832603B4B39A9650B4B4C980274"><enum>(C)</enum><text>by adding at the end the following:</text>
						<quoted-block id="H679E87067CF44DC79C81D0D8DC3D0B9A" style="OLC">
							<paragraph id="H178A7DA259E04428B07B2E47D852D05F"><enum>(33)</enum><text>the term <term>Federal Protective Service law enforcement officer</term> means an employee in the Federal Protective Service of the Department of Homeland Security—</text>
								<subparagraph id="H3AAEF6F5C10B486DBBE509731435D563"><enum>(A)</enum><text>who holds a position within the GS–0083, GS–0080, GS–1801, or GS–1811 job series (determined
			 applying the criteria in effect as of September 1, 2007) or any successor
			 position; and</text>
								</subparagraph><subparagraph id="HEABD5795E0D24A359D81BE23620E7EED"><enum>(B)</enum><text>who are authorized to carry firearms and empowered to make arrests in the performance of duties
			 related to the protection of buildings, grounds and property that are
			 owned, occupied, or secured by the Federal Government (including any
			 agency, instrumentality or wholly owned or mixed-ownership corporation
			 thereof) and the persons on the property, including any such employee who
			 is transferred directly to a supervisory or administrative position in the
			 Department of Homeland Security after performing such duties in 1 or more
			 positions (as described under subparagraph (A)) for at least 3 years.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HB9226E5BCEC54F94AA83B0ACA09FC0A3"><enum>(2)</enum><header>Deductions, contributions, and deposits</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8334">Section 8334</external-xref> of title 5, United States Code, is amended—</text>
					<subparagraph id="H6167C628210F419C8243CD10AEF4D316"><enum>(A)</enum><text>in subsection (a)(1)(A), by inserting <quote>Federal Protective Service law enforcement officer,</quote> before <quote>or customs and border protection officer,</quote>; and</text>
					</subparagraph><subparagraph id="H01F922657D8C40B28791233F47C27416"><enum>(B)</enum><text>in the table contained in subsection (c), by adding at the end the following:</text>

					</subparagraph></paragraph><paragraph commented="no" id="H2EA3F240DF8A40F8A18157A4509A7D0E"><enum>(3)</enum><header>Mandatory separation</header><text>The first sentence of <external-xref legal-doc="usc" parsable-cite="usc/5/8335">section 8335(b)(1)</external-xref> of title 5, United States Code, is amended by inserting <quote>Federal Protective Service law enforcement officer,</quote> before <quote>or customs and border protection officer</quote>.</text>
				</paragraph><paragraph id="H3A77B3DF9A144E0BAC070184DAABD5F5"><enum>(4)</enum><header>Immediate retirement</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8336">Section 8336</external-xref> of title 5, United States Code, is amended—</text>
					<subparagraph id="HB9FBF9FF64F649F4AA8C8A5D2A93EB8E"><enum>(A)</enum><text>in subsection (c)(1), by inserting <quote>Federal Protective Service law enforcement officer,</quote> before <quote>or customs and border protection officer</quote>; and</text>
					</subparagraph><subparagraph id="HC4F19B7B40434D4895561C4A364E4796"><enum>(B)</enum><text>in subsections (m) and (n), by inserting <quote>as a Federal Protective Service law enforcement officer,</quote> before <quote>or as a customs and border protection officer,</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HF4989E8BE8194E869A5297143CFA53FE"><enum>(b)</enum><header>Federal employees retirement system</header>
				<paragraph id="HEE574A1C758B4B76854D168519B38001"><enum>(1)</enum><header>Definition</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8401">Section 8401</external-xref> of title 5, United States Code, is amended—</text>
					<subparagraph id="HFDB8EAA7E8CE42C1915D48FC5FDC7064"><enum>(A)</enum><text>in paragraph (37), by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="HFB4FAD79202247E3ADD520C1F437A44C"><enum>(B)</enum><text>in paragraph (38), by striking the period and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="H93D857060721492E8D9ED74E655EF475"><enum>(C)</enum><text>by adding at the end the following:</text>

					</subparagraph></paragraph><paragraph id="H2E3B5D0175094F3D816DEFC0EA767B58"><enum>(2)</enum><header>Immediate retirement</header><text>Paragraphs (1) and (2) of <external-xref legal-doc="usc" parsable-cite="usc/5/8412">section 8412(d)</external-xref> of title 5, United States Code, are amended by inserting <quote>Federal Protective Service law enforcement officer,</quote> before <quote>or customs and border protection officer,</quote>.</text>
				</paragraph><paragraph id="H9BD74C3C823546EC838F0ED4363ED4E4"><enum>(3)</enum><header>Computation of basic annuity</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8415">Section 8415(i)(2)</external-xref> of title 5, United States Code, is amended by inserting <quote>Federal Protective Service law enforcement officer,</quote> before <quote>or customs and border protection officer</quote>.</text>
				</paragraph><paragraph id="H9BA80D801F7D4543B6738AA6523163D6"><enum>(4)</enum><header>Deductions from pay</header><text>The table contained in <external-xref legal-doc="usc" parsable-cite="usc/5/8422">section 8422(a)(3)</external-xref> of title 5, United States Code, is amended by adding at
			 the end the following:</text>

			 2014.</entry></row></tbody></tgroup></table><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H1DDEA32ED10A421286AD34825031A05D"><enum>(5)</enum><header>Government contributions</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8423">Section 8423(a)</external-xref> of title 5, United States Code, is amended—</text>
					<subparagraph id="HA9CDEB6A0457478DBA9ACD2A513AF5EE"><enum>(A)</enum><text>in paragraph (1)(B)(i) by inserting <quote>Federal Protective Service law enforcement officer,</quote> before <quote>customs and border protection officers,</quote>; and</text>
					</subparagraph><subparagraph id="HE6029C1A788C457EB79D0D4D24EA9DB2"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)(A) by inserting <quote>Federal Protective Service law enforcement officer,</quote> before <quote>customs and border protection officers,</quote>.</text>
					</subparagraph></paragraph><paragraph id="H9F963BAB242C461E841CEBBFEF1101C2"><enum>(6)</enum><header>Mandatory separation</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/8425">Section 8425(b)(1)</external-xref> of title 5, United States Code, is amended by inserting <quote>Federal Protective Service law enforcement officer,</quote> before <quote>or customs and border protection officer</quote> the each place it appears.</text>
				</paragraph></subsection><subsection id="HAF1B843156064BA4A0350F79A28E483F"><enum>(c)</enum><header>Maximum age for original appointment</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/3307">Section 3307</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>
				<quoted-block id="H4368C409B8044864BC3CFE0F1172B906" style="OLC">
					<subsection id="H605EFB0DBAE04DD6B313FC1E024FB8A5"><enum>(h)</enum><text>The Secretary of Homeland Security may determine and fix the maximum age limit for an original
			 appointment to a position as a Federal Protective Service law enforcement
			 officer, as defined in section 8401.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H62553B4D470A4A0EB5CFFB67BB8FF1EC"><enum>(d)</enum><header>Regulations</header><text display-inline="yes-display-inline">Any regulations necessary to carry out the amendments made by this section shall be issued by the
			 Director of the Office of Personnel Management in consultation with the
			 Secretary of Homeland Security.</text>
			</subsection><subsection id="H1E77366F77E247BB86358763F080F084"><enum>(e)</enum><header>Effective date; transition rules; funding</header>
				<paragraph id="HBDA0DA80043C40B9A5C25A7E7C2741D5"><enum>(1)</enum><header>Effective date</header><text>The amendments made by this section shall become effective on the later of the first day of the
			 first pay period of fiscal year 2015 or the first day of the first pay
			 period beginning at least 6 months after the date of enactment of this
			 Act.</text>
				</paragraph><paragraph id="HC9183B452A194037AAD97D495171BA7B"><enum>(2)</enum><header>Transition rules</header>
					<subparagraph id="H464A9ADC46A8450099585347CFDA70D5"><enum>(A)</enum><header>Nonapplicability of mandatory separation provisions to certain individuals</header><text>The amendments made by subsections (a)(3) and (b)(6), respectively, shall not apply to an
			 individual first appointed as a Federal Protective Service law enforcement
			 officer before the effective date under paragraph (1).</text>
					</subparagraph><subparagraph id="HAD1A071BCFA846A495560FA57F49091C"><enum>(B)</enum><header>Treatment of prior Federal Protective Service law enforcement officer service</header>
						<clause id="H96F922D272034F7D8980BF26EA4A5441"><enum>(i)</enum><header>General rule</header><text>Except as provided in clause (ii), nothing in this section shall be considered to apply with
			 respect to any service performed as a Federal Protective Service law
			 enforcement officer before the effective date under paragraph (1).</text>
						</clause><clause id="HB2A26626A7FB4569BE4F2AC7AB54A544"><enum>(ii)</enum><header>Exception</header><text>Service described in section 8331(33) and 8401(39) of title 5, United States Code (as amended by
			 this section) rendered before the effective date under paragraph (1) may
			 be taken into account to determine if an individual who is serving on or
			 after such effective date then qualifies as a Federal Protective Service
			 law enforcement officer by virtue of holding a supervisory or
			 administrative position in the Department of Homeland Security.</text>
						</clause></subparagraph><subparagraph id="HDA2DFD92FFD14ED098D3E25C6D08BFD4"><enum>(C)</enum><header>Minimum annuity amount</header><text>The annuity of an individual serving as a Federal Protective Service law enforcement officer on the
			 effective date under paragraph (1) pursuant to an appointment made before
			 that date shall, to the extent that its computation is based on service
			 rendered as a Federal Protective Service law enforcement officer on or
			 after that date, be at least equal to the amount that would be payable to
			 the extent that such service is subject to the Civil Service Retirement
			 System or Federal Employees Retirement System, as appropriate, by applying
			 <external-xref legal-doc="usc" parsable-cite="usc/5/8339">section 8339(d)</external-xref> of title 5, United States Code, with respect to such
			 service.</text>
					</subparagraph><subparagraph id="HA3B41A1C93284844B8BD1593EEC8CD64"><enum>(D)</enum><header>Rule of construction</header><text>Nothing in the amendment made by subsection (c) shall be considered to apply with respect to any
			 appointment made before the effective date under paragraph (1).</text>
					</subparagraph></paragraph><paragraph id="H7F094116DE7A4B7F8358561D28C008B1"><enum>(3)</enum><header>Fees and authorizations of appropriations</header>
					<subparagraph id="H21EFCB957A7F4D0986B00D77F658FF6A"><enum>(A)</enum><header>Fees</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall adjust fees collected as necessary to
			 ensure collections are sufficient to carry out amendments made in this
			 section.</text>
					</subparagraph><subparagraph id="H9308AC9D1DCC476BB093D5F40CEA0B92"><enum>(B)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section.</text>
					</subparagraph></paragraph><paragraph id="H53DA3E9A861449828558CAA36D227AAD"><enum>(4)</enum><header>Election</header>
					<subparagraph id="H3606CB2F808F4654A9F01155CC86041E"><enum>(A)</enum><header>Incumbent defined</header><text>For purposes of this paragraph, the term <term>incumbent</term> means an individual who is serving as a Federal Protective Service law enforcement officer on the
			 date of the enactment of this Act.</text>
					</subparagraph><subparagraph id="HAD70FC201042479A8F36B8FC94B53BEA"><enum>(B)</enum><header>Notice requirement</header><text>Not later than 30 days after the date of enactment of this Act, the Director of the Office of
			 Personnel Management shall take measures reasonably designed to ensure
			 that incumbents are notified as to their election rights under this
			 paragraph, and the effect of making or not making a timely election.</text>
					</subparagraph><subparagraph id="H3C9C3E2A1740485799B1AB450F229035"><enum>(C)</enum><header>Election available to incumbents</header>
						<clause id="HF2894D0218554A18960FC1645166B397"><enum>(i)</enum><header>In general</header><text>An incumbent may elect, for all purposes, either—</text>
							<subclause id="H7174DE07866243D5B0042D44F5C9F266"><enum>(I)</enum><text>to be treated in accordance with the amendments made by subsection (a) or (b), as applicable; or</text>
							</subclause><subclause id="H1E0277C835F54686921D97D14E124ACF"><enum>(II)</enum><text>to be treated as if subsections (a) and (b) had never been enacted.</text>
							</subclause></clause><clause id="HA6C2BA704DB343EDAFBF970337E4BB3C"><enum>(ii)</enum><header>Failure to make a timely election</header><text>Failure to make a timely election under clause (i) shall be treated in the same way as an election
			 made under clause (i)(I) on the last day allowable under clause (iii).</text>
						</clause><clause id="H4A569C808E084BC1AD847C979BDAC1DB"><enum>(iii)</enum><header>Deadline</header><text>An election under this subparagraph shall not be effective unless it is made at least 14 days
			 before the effective date under paragraph (1).</text>
						</clause></subparagraph></paragraph><paragraph id="H041713D0FD914C7997A427165627E409"><enum>(5)</enum><header>Definition</header><text>For the purposes of this subsection, the term <term>Federal Protective Service law enforcement officer</term> has the meaning given such term by section <external-xref legal-doc="usc" parsable-cite="usc/5/8331">8331(33)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/8401">8401(39)</external-xref> of title 5, United States Code (as
			 amended by this Act).</text>
				</paragraph><paragraph id="HCA10A9A98ABA47C2BC4250EA3B92743B"><enum>(6)</enum><header>Exclusion</header><text>Nothing in this section or any amendment made by this section shall be considered to afford any
			 election or to otherwise apply with respect to any individual who, as of
			 the day before the date of the enactment of this Act—</text>
					<subparagraph id="H468B78FDAF0949D9AB8BF677F9B98983"><enum>(A)</enum><text>holds a position within the Federal Protective Service; and</text>
					</subparagraph><subparagraph id="H8D9AF7281DBE4910A2A9AAD81032EDF8"><enum>(B)</enum><text>is considered a law enforcement officer for purposes of subchapter III of chapter 83 or chapter 84
			 of title 5, United States Code, by virtue of such position.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
